- 2:32Speaker 4: want to welcome into the show now. He's only been
- 2:34Speaker 4: on the job for a couple of weeks, and I'm
- 2:36Speaker 4: only I'm gonna go ahead and apologize already if I
- 2:38Speaker 4: refer to him by a different title, but it is
- 2:41Speaker 4: Attorney General J. B. Mccusky. Good morning, sir, Good morning Dave.
- 2:46Speaker 6: How are you Dad?
- 2:47Speaker 4: I'm doing fine. I say that because you know when
- 2:49Speaker 4: you've been when you were in the Auditor's Officer for
- 2:51Speaker 4: so long, I may accidentally call you that, but you
- 2:54Speaker 4: are indeed the Attorney General I am, and.
- 2:57Speaker 6: I'm loving it. It's it's a really awesome job.
- 3:00Speaker 4: The best when you when you are out and you're
- 3:02Speaker 4: talking to people because you have the auditor's job, do
- 3:04Speaker 4: you do you accidentally refer to yourself as the auditor.
- 3:08Speaker 6: It's happened. It's kind of like when the new year
- 3:11Speaker 6: changes and you write the wrong You're down on the
- 3:13Speaker 6: on every form for the first month. But we're getting there.
- 3:16Speaker 4: Talk about how the first couple of weeks have been.
- 3:19Speaker 4: I mean, you're getting all the boxes unpacked and such.
- 3:22Speaker 6: Yeah, so we're working on getting the office put together.
- 3:25Speaker 6: But I think importantly what happened with me is that
- 3:28Speaker 6: I was able to put together a sort of transition
- 3:30Speaker 6: committee months and months ago, and I was able to
- 3:34Speaker 6: build a team of people that I was going to
- 3:35Speaker 6: bring in to add to the people that were already
- 3:37Speaker 6: in Patrick's office. So, you know, we were able to
- 3:39Speaker 6: hit the ground running on day one and we sort
- 3:42Speaker 6: of haven't looked back since. And you know, we got
- 3:45Speaker 6: off the ground pretty quickly with a suit against New York,
- 3:48Speaker 6: which we're really hopeful for and very proud of our
- 3:51Speaker 6: work in that case, and the coalition we're with the
- 3:53Speaker 6: build and now we're in the legislative session. So there's
- 3:56Speaker 6: there's a lot going on.
- 3:57Speaker 4: I want to talk to you about a couple of things.
- 3:59Speaker 4: One of those has spent Your office released some information
- 4:03Speaker 4: that you have joined roughly twenty five or so states
- 4:05Speaker 4: urging the US Senate to pass something called the Halt
- 4:09Speaker 4: Fentanyl Act. Explain that, sir.
- 4:12Speaker 6: Yeah, So the Halt Fentanyl Act is a sort of
- 4:15Speaker 6: a groundbreaking federal law that will enable law enforcement officers
- 4:20Speaker 6: at all to really start to crack down on sentinel
- 4:24Speaker 6: crimes and federl related crimes. So we were really really
- 4:27Speaker 6: proud to sign onto that to hurge the Senate to
- 4:31Speaker 6: get that through because it's important and as we know
- 4:34Speaker 6: in West Virginia, there are no bigger problems than the
- 4:37Speaker 6: needless and massive amounts of loss of life that we
- 4:41Speaker 6: continue to experience because of this drug crisis. And right
- 4:43Speaker 6: now that drug is fentinel and we needed every tool
- 4:46Speaker 6: in our coolbox to get it off streets.
- 4:48Speaker 4: And one of the things that I know that you
- 4:50Speaker 4: have you have done, and it goes along the lines
- 4:53Speaker 4: of drugs, is that And I don't know what the
- 4:55Speaker 4: exact title of the Gentleman is, but you got someone
- 4:57Speaker 4: working for you that's worked for you in the past
- 5:00Speaker 4: going to be focusing a lot on on on drug
- 5:04Speaker 4: drug issues. Do you want to talk about that a
- 5:06Speaker 4: little bit?
- 5:07Speaker 6: Yeah, I'd love to. So. Uh, it's a guy named
- 5:09Speaker 6: Josh Barker who I've known for a very long time.
- 5:12Speaker 6: But Josh was a field rep in the Auditor's office
- 5:15Speaker 6: and and Josh became an addict, and I remember getting
- 5:19Speaker 6: the phone call from his wife after he'd been dark hand,
- 5:21Speaker 6: and you know, it was a really informative sort of
- 5:25Speaker 6: time for me and for him. I mean, I learned
- 5:27Speaker 6: an enormous about amount about how prevalent and hard to
- 5:33Speaker 6: spot substance abuse can be. And I think both of
- 5:37Speaker 6: us together sort of, you know, we learned a lot about,
- 5:40Speaker 6: you know, how how we should be treating addicts, uh
- 5:42Speaker 6: that are trying to get better, and how to how
- 5:44Speaker 6: to manage that. So when I got elected to the
- 5:46Speaker 6: AG's office, I talked to Josh because I wanted somebody
- 5:49Speaker 6: in the community who could speak to both service providers
- 5:53Speaker 6: and addicts in a way that other people couldn't. And
- 5:55Speaker 6: Josh has that experience and jumped at the chance.
- 5:58Speaker 4: Uh.
- 5:59Speaker 6: And so he is going to you know, our liaison
- 6:01Speaker 6: out of the AG's office into the substance abuse community,
- 6:04Speaker 6: so that we can make sure that we're doing every
- 6:06Speaker 6: single thing we can to help stop kids from getting
- 6:11Speaker 6: addicted in the first place, and finding resources for people
- 6:14Speaker 6: that are that are trying to do the right thing.
- 6:16Speaker 4: And I think sometimes in these kinds of situations a
- 6:20Speaker 4: g can be it can be very important to have somebody,
- 6:22Speaker 4: as you said, that speaks the language and somebody that's
- 6:25Speaker 4: been there, somebody and I know Josh very well is
- 6:27Speaker 4: good friend, and I think he'll do an incredible job
- 6:31Speaker 4: in that role. So hats off to you for giving
- 6:32Speaker 4: him that opportunity.
- 6:34Speaker 6: Is doing an incredible job, and we're just I'm just
- 6:37Speaker 6: really thankful to be able to have that kind of intel.
- 6:41Speaker 6: As you know, the West Virginia First Foundation and so
- 6:44Speaker 6: many things the AG's office touches that community, and we
- 6:46Speaker 6: want to make sure we're doing everything we can.
- 6:48Speaker 4: But Dave Allan showing five any Live has brought to
- 6:50Speaker 4: you a part by snap Funess. Snap has a wide
- 6:53Speaker 4: selection of equipment, including free weights, cardio machine, weights, and more.
- 6:56Speaker 4: Five convenient locations to Charleston, Hurricane, Winfield, Barbersville, and Milton
- 7:00Speaker 4: businessnapitness dot com for more details. So what's this about
- 7:04Speaker 4: the little war or whatever that not maybe not wars
- 7:08Speaker 4: not the right word. But with New York on climate change,
- 7:11Speaker 4: you've you've kind of gotten on the gloves here. Tell
- 7:13Speaker 4: us about that.
- 7:15Speaker 6: So New York decided, in their infinite wisdom that they
- 7:19Speaker 6: were going to find energy companies to the tune of
- 7:22Speaker 6: seven hundred and or seventy five billion dollars over the
- 7:25Speaker 6: next ten years. And you know, we saw this as
- 7:28Speaker 6: an affront not just to the to the great companies
- 7:31Speaker 6: that produce energy here in West Virginia, but sort of
- 7:33Speaker 6: to the Constitution at large. Right, So what we are
- 7:37Speaker 6: doing is we built a coalition of myself in twenty
- 7:39Speaker 6: two other states, and we have sued New York in
- 7:42Speaker 6: New York to invalidate this law. We think it's unconstitutional,
- 7:46Speaker 6: and to be honest, I think it is kind of
- 7:49Speaker 6: silly in its application and in its intent.
- 7:54Speaker 4: And I think it was last week that announcement came
- 7:58Speaker 4: down that several states and other parties had reached. I
- 8:02Speaker 4: think it was like a seven point four billion dollar
- 8:04Speaker 4: settlement something like that with the Gwen. Back to drugs
- 8:06Speaker 4: from moment with the Sackler family and their company producer
- 8:09Speaker 4: Farmer tell us about that.
- 8:11Speaker 6: Yeah, so that that was a case that was filed,
- 8:15Speaker 6: you know, under the opioid cases when Patrick was the AG.
- 8:18Speaker 6: And what happened was is that all the other drug
- 8:21Speaker 6: companies ponied up the settlements, but Purdue decided that they
- 8:25Speaker 6: were bankrupt, which is comical when you consider that all
- 8:28Speaker 6: of the people and the Sackler family are al still billionaires.
- 8:31Speaker 6: So they held up the process, sort of dragging their
- 8:34Speaker 6: feet through a bankruptcy. And what we were able to do,
- 8:38Speaker 6: our council was able to they were able to finally
- 8:40Speaker 6: get over all the bankruptcy hurdles and get in some
- 8:44Speaker 6: language that everyone could agree on about seven billion dollars
- 8:48Speaker 6: in total. West Virginia's share of that will be about
- 8:50Speaker 6: fifty five million, which is a great number, and we
- 8:54Speaker 6: will get paid out in a time frame that's a
- 8:56Speaker 6: little faster than the other states. So we'll start getting
- 8:58Speaker 6: a little bit more money faster than most to the
- 9:00Speaker 6: other states in the settlement.
- 9:02Speaker 4: Talking again with the Attorney General JB. Mccusky. And so before
- 9:05Speaker 4: we let you go, your name has been brought up
- 9:07Speaker 4: a lot in the office in regards to this section
- 9:09Speaker 4: five oh four of the Rehabilitation Act in the Americans
- 9:13Speaker 4: with Disabilities, explain what five oh four was going to
- 9:16Speaker 4: be and what your stance and what your office of
- 9:18Speaker 4: stance is on that.
- 9:20Speaker 7: Yeah.
- 9:21Speaker 6: So I have been an advocate for the disability community
- 9:24Speaker 6: throughout my career in politics. And what's happening here is
- 9:27Speaker 6: that there was a lawsuit filed in September of last
- 9:30Speaker 6: year challenging the addition of one additional disability to the
- 9:35Speaker 6: list of disabilities that are covered under five oh four.
- 9:38Speaker 6: There's some language in the lawsuit that quite frankly, probably
- 9:40Speaker 6: shouldn't have been there, but that's besides the point. We
- 9:44Speaker 6: are working very hard. We worked all through the weekend
- 9:47Speaker 6: to get this case stayed and dismissed, and we are
- 9:50Speaker 6: very hopeful that that's going to happen in the near future.
- 9:52Speaker 6: And I would like to reassure that every family that
- 9:55Speaker 6: has either a child or as a part of the
- 9:57Speaker 6: five oh four community that we are not going to
- 9:59Speaker 6: allow anything to happen. Nothing has happened to the program
- 10:02Speaker 6: as it is now, and we're fighting very very and
- 10:05Speaker 6: very hopeful that soon we'll have some resolution here. But
- 10:08Speaker 6: the five oh four plans are not going anywhere, and
- 10:10Speaker 6: everyone that's on them to be assured that we're fighting
- 10:12Speaker 6: to make sure that they stay in place.
- 10:13Speaker 7: As they were.
- 10:14Speaker 4: I know that was a concern of a lot of people.
- 10:16Speaker 4: I read Attorney General JB. McCuskey as always, I appreciate
- 10:20Speaker 4: you being here. Be safe. We'll talk soon, Buddy, Thanks.
- 10:22Speaker 6: A lot, Dave, thanks buddy, talk to you to man.
- 10:25Speaker 4: Attorney General JB. Mccusky, I almost said Attorney General Patrick Morrissey,
- 10:28Speaker 4: and then I almost refer to him as state auditor,
- 10:30Speaker 4: because you know, when you're old and don't have a
- 10:32Speaker 4: lot of brain cells like I don't, sometimes old habits
- 10:35Speaker 4: that hard, but it is. Attorney General JB. McCuskey Thedave

- 15:11Speaker 7: The phone number in my contact for this show is

- 15:31Speaker 7: this morning I called Danny's personal cell phone instead of

- 15:45Speaker 7: I hope you're well.
- 15:45Speaker 2: Danny.
- 15:46Speaker 4: Well, you know, Brad, I've been doing this show for
- 15:48Speaker 4: nearly five years now, five years in May, so you
- 15:51Speaker 4: might want to make that change. Just saying I'm apparently
- 15:53Speaker 4: not going anywhere so not for.
- 15:55Speaker 7: A while, and I'm to update my contact.
- 15:57Speaker 4: Possibly finally, possibly finally, uh you you and you and

- 16:09Speaker 7: What would be funest if we could do that together,
- 16:11Speaker 7: that would be nice team bonding.
- 16:14Speaker 4: All right, let's get serious here for a moment. The
- 16:16Speaker 4: big news of the last couple of days has been
- 16:18Speaker 4: the widespread flooding, of course, in southern West Virginia. We
- 16:21Speaker 4: got a lot posted about it. Chris Lawrence actually spent
- 16:23Speaker 4: the last couple of days down there and I were
- 16:26Speaker 4: talking about off the air this morning. Governor Morrissey toured
- 16:29Speaker 4: the area yesterday and it's got a press or covered
- 16:31Speaker 4: up at ten this morning to talk about it. Now
- 16:33Speaker 4: we wait, I guess for word from Washington about aid
- 16:36Speaker 4: for the area. Is that right, Brad?
- 16:39Speaker 7: Yes? So the administration is applying for a national disaster declaration,
- 16:48Speaker 7: applying for help from FEMA UH and the what's for
- 16:53Speaker 7: He's congressional delegation I received an email this morning is
- 16:58Speaker 7: also on board with pursuing that disaster declaration. The Governor
- 17:05Speaker 7: Morrissey is having a briefing at ten regarding his travel
- 17:14Speaker 7: through southern West Virginia through the flood zone yesterday, so
- 17:17Speaker 7: we'll hear more about what he experienced. My understanding is
- 17:20Speaker 7: in the Metro News home office, Chris Lawrence is covering
- 17:26Speaker 7: Governor Morrissey's comments, and Jeff Jingens is headed for the
- 17:30Speaker 7: flood zone himself this morning live and in person. Yeah, yeah,
- 17:34Speaker 7: I talked to Riverage.
- 17:35Speaker 4: Yeah, as I said, I talked to Chris a little
- 17:37Speaker 4: bit as we were transitioning from one show to the next,
- 17:39Speaker 4: and he talked about being of course he was down
- 17:41Speaker 4: He was in Williamson. Chris was Saturday for the Southern
- 17:45Speaker 4: West Virginia Fishing Expo that was there at the field
- 17:47Speaker 4: House in Williams, and I think he just spent some
- 17:49Speaker 4: extra time down there and they went back again. I
- 17:50Speaker 4: know he was down there, spent a lot of time
- 17:52Speaker 4: down there yesterday. And I can say thankfully that in
- 17:54Speaker 4: my lifetime, Brad, I only went through one flood. That
- 17:57Speaker 4: was in nineteen ninety six. My family was impacted by
- 18:01Speaker 4: the Buffalo Creek flood back in seventy two. But I
- 18:04Speaker 4: will say a lot of those areas Brad for particularly
- 18:07Speaker 4: Mingo and McDowell counties. My native Logan County got hit two.
- 18:10Speaker 4: But I think Mingo and McDowell really got hit harder. Sadly,
- 18:16Speaker 4: it's just a way of life down there every couple
- 18:20Speaker 4: of years, sometimes more than that. It's it's sad really.
- 18:24Speaker 7: Well, it is, you know, such sharp terrain, those steep
- 18:29Speaker 7: hillsides you know in the river valley or the creek
- 18:34Speaker 7: bed down below. And anytime you get day after day
- 18:38Speaker 7: after day of precipitation, you know, it's just it lends
- 18:42Speaker 7: itself to situations like this one.
- 18:45Speaker 4: Unfortunately, right but Dave Iland Chilling five. Any line brought
- 18:48Speaker 4: to you part by Meek's Realtory group looking to buy
- 18:50Speaker 4: or sell Meeks as you covered from residential to commercial,
- 18:52Speaker 4: trust Rich the realtor one of the area's premier real
- 18:55Speaker 4: estate teams to guide you every step of the way. Meeks,

- 19:00Speaker 4: zero four nine three two seventy four eighty eight or
- 19:02Speaker 4: email are client climb with a K at Meeksrealtygroup dot com.
- 19:06Speaker 4: So Brown, I talked about this yesterday, all of the
- 19:09Speaker 4: hubbub surrounding what some what some legislators wanted to call
- 19:13Speaker 4: the artist formerly known as Spruce Knob, some wanted to
- 19:17Speaker 4: be called Trump Mountain. Now, it was a resolution and
- 19:19Speaker 4: not a bill. It was never gonna happen anyway, But
- 19:22Speaker 4: as I said yesterday, it had the desired effect in
- 19:25Speaker 4: getting the Trump base fired up as well as the
- 19:28Speaker 4: Trump haters, and I quickly I wanted to read a statement,
- 19:31Speaker 4: a portion of which I'm gonna read the whole thing
- 19:33Speaker 4: that was posted to social media last night from Delegate
- 19:36Speaker 4: Patrick Lewis Patrick Lucas. I'm sorry, sorry, Delegate out of
- 19:41Speaker 4: Cable County. It was a long post. I've got the
- 19:43Speaker 4: entire thing posted over on Dave Island Radio and Facebook,
- 19:46Speaker 4: so I'll shorten it for our segment here. He starts
- 19:47Speaker 4: out by stating it was a resolution, as I said,
- 19:51Speaker 4: not a bill, which we talked about yesterday as well.
- 19:53Speaker 4: He went on to say that the resolution has no
- 19:55Speaker 4: chance of becoming law. He states that he thought the
- 19:59Speaker 4: idea was simply to honor President Trump. He says he
- 20:02Speaker 4: sided not thinking much about it, and then once the
- 20:04Speaker 4: feedback started coming in that he requested on Friday that
- 20:08Speaker 4: his name be removed from the resolution. Now he says
- 20:11Speaker 4: it was officially the removal granted yesterday, and he goes
- 20:15Speaker 4: on to say, wait for it here, Brad. Because it's
- 20:18Speaker 4: not something that you often hear in political circles on
- 20:21Speaker 4: either side, I certainly would never hear President Trump say it.
- 20:25Speaker 4: He was wrong. He apparently felt so bad about it
- 20:28Speaker 4: that on Friday night, Del Lucas wrote a resolution that
- 20:33Speaker 4: says no West Virginia landmark, state park or other state
- 20:36Speaker 4: owned property shall be named after a politician. Now again,
- 20:42Speaker 4: you can read the entire statement on Dave Is of
- 20:45Speaker 4: Radio on Facebook. Your thoughts.
- 20:48Speaker 7: So I am the one person who did not get
- 20:50Speaker 7: fired up about this.
- 20:54Speaker 4: I didn't either, I was just reacting to other people.
- 20:56Speaker 7: So, you know, I mean, West Virginia is a seventy
- 21:02Speaker 7: percent Trump state, so obviously very much support for the
- 21:07Speaker 7: current and past president. But what West Virginia loves even
- 21:12Speaker 7: more than that is West Virginia, you know, very much
- 21:15Speaker 7: a state enamored with its own history, its own traditions,
- 21:19Speaker 7: its own pride, people have, you know, tattoos, the outline
- 21:25Speaker 7: of the state. Very much, a state with its own
- 21:31Speaker 7: identity that's taken to heart by its people. And I
- 21:33Speaker 7: think that's where this one washed out is. You know,
- 21:37Speaker 7: Spruce Knob, which you get in West Virginia history as
- 21:41Speaker 7: the highest point in the state, just outranked of all
- 21:44Speaker 7: things that identity with President Trump of the Trump state.
- 21:50Speaker 4: Yeah, So, I mean, what do you think though of
- 21:54Speaker 4: some of these these folks, particularly Delegate Lucas, you know,
- 21:58Speaker 4: coming back and saying, hey, I was wrong. You don't
- 22:00Speaker 4: hear that very often, Brad.
- 22:03Speaker 7: You don't hear that very often, and you know, good
- 22:05Speaker 7: for him. You certainly don't see it at the national level.
- 22:08Speaker 7: But West Virginia is a small state. People know each other,
- 22:12Speaker 7: and maybe maybe there's still a place in West Virginia
- 22:15Speaker 7: politics to say I was wrong, or I changed my mind,
- 22:18Speaker 7: or I've looked at it a different way, or the
- 22:21Speaker 7: people's opinion has prevailed upon me.
- 22:24Speaker 4: I wanted to bring something up here for you, if
- 22:26Speaker 4: you got a couple of seconds, Brad. I know I
- 22:27Speaker 4: told you I wouldn't keep it that long, but I
- 22:29Speaker 4: got one thing I got to bring up to you.
- 22:30Speaker 4: Can you hang out with me here just one second?
- 22:32Speaker 7: Oh?
- 22:32Speaker 4: Sure, okay, you sound thrilled?
- 22:35Speaker 7: All right?
- 22:36Speaker 4: So this story, this came out yesterday. I'm gonna try
- 22:43Speaker 4: to get through this without laughing. Just when you thought
- 22:45Speaker 4: that we couldn't get any more ridiculous with the whole
- 22:48Speaker 4: spruce knob story, how about woke words in West Virginia.
- 22:53Speaker 4: We're gonna try to ban words now. And you know
- 22:55Speaker 4: how I feel about banning words. There was I guess.
- 22:59Speaker 4: I guess since a bill that was introduced yesterday, and
- 23:02Speaker 4: I've got an information posted about again on my Facebook page.
- 23:05Speaker 4: Dave Alan Radio that certain delegates Kathy has Kraus's friend
- 23:10Speaker 4: of the show was one of the one of the
- 23:11Speaker 4: lead delegates on this, but there are several others. She's
- 23:13Speaker 4: the one that I recall that they want to remove
- 23:17Speaker 4: certain words that we use or to be used in
- 23:22Speaker 4: state government language. For example, you know the term pregnant
- 23:26Speaker 4: people or pregnant person can only be called pregnant woman
- 23:31Speaker 4: or pregnant mom. No more chest feeding, which is I
- 23:35Speaker 4: guess the current their words of the woke term. Now
- 23:37Speaker 4: it would be breastfeeding, body fed or person fed needs
- 23:43Speaker 4: to go back to breastfed. Breast milk should be called
- 23:47Speaker 4: breast milk, not human milk. Rather than birthing person, it's
- 23:51Speaker 4: birthing mom rather than a laboring person. It's birthing mom
- 23:54Speaker 4: rather than menstruating person or menstruating people. Use the term
- 23:58Speaker 4: woman or women rather and birth giver. It has to
- 24:01Speaker 4: be a woman and rather uh than woman with an
- 24:05Speaker 4: ex or woman with a Y. I didn't know that
- 24:07Speaker 4: was a thing. It has to be women W M
- 24:11Speaker 4: E N. So this is what we have to focus on. Brad,
- 24:16Speaker 4: I mean nothing nothing.
- 24:18Speaker 7: Else, Thank goodness, we are free speech absolutists in this country.
- 24:22Speaker 4: I am one.
- 24:24Speaker 7: To free speech. Yeah, I mean about this bill this morning.
- 24:30Speaker 7: So does that apply to me and Dave or it
- 24:33Speaker 7: applies to government communications?
- 24:35Speaker 4: It's communications.
- 24:37Speaker 7: If it applies to me and Dave, I reserve my
- 24:39Speaker 7: right to call Dave a pregnant person, not stop me
- 24:44Speaker 7: from calling Dave a pregnant person.
- 24:46Speaker 4: Well, that's that's a body by Miller Lite. That's what
- 24:48Speaker 4: the problem there is.
- 24:50Speaker 6: Uh.
- 24:50Speaker 4: But but again, Brad, you know I and I and
- 24:52Speaker 4: I get what they're saying. And I you know, I've
- 24:55Speaker 4: railed for the fast five years about political correctness and
- 24:58Speaker 4: wokeism and things that. But come on, man, I mean
- 25:01Speaker 4: we are I mean, and with all due respect to
- 25:03Speaker 4: these delegates, all of whom I see as friends, I mean,
- 25:09Speaker 4: this is what we are concerned about right now. I mean,
- 25:12Speaker 4: we are forty ninth, fiftieth, fifty first in every damn
- 25:15Speaker 4: thing in the world, but we're worried about stupid crap
- 25:19Speaker 4: like this. Really, the whole state, or a portion of
- 25:23Speaker 4: the state is underwater right now. I mean, this is
- 25:28Speaker 4: what we're spending our time on. This is why we
- 25:32Speaker 4: send these people to the Capitol.
- 25:34Speaker 7: Really, we are fighting the WOP virus. But I will
- 25:39Speaker 7: say I am unfamiliar with that kind of language in
- 25:43Speaker 7: any official state communication. I've ever read, Yeah.
- 25:45Speaker 4: You and everybody else, I'm unfamiliar with that.
- 25:48Speaker 7: I've heard that language on occasion during the public hearings
- 25:53Speaker 7: that used to exist in the House of Delegates, but
- 25:55Speaker 7: that came in from the outside and people were exercising
- 25:59Speaker 7: their free speed to use the language that they choose.
- 26:02Speaker 7: I have absolutely never seen the kind of examples that
- 26:07Speaker 7: you cited. I mean, even from the former DHHR, which
- 26:12Speaker 7: might deal with pregnancies and that kind of thing. I'm
- 26:16Speaker 7: at a loss for an example of how it would
- 26:20Speaker 7: actually apply and why it would need to be done well.
- 26:23Speaker 4: Any of those debtly gets, many of whom have been
- 26:25Speaker 4: on this show in the past. They're welcome to come
- 26:26Speaker 4: on and explain it to me. What are you looking
- 26:28Speaker 4: at today, brand?
- 26:30Speaker 7: Oh, so we're gonna there's going to be potential action
- 26:36Speaker 7: in the State Senate on actual viruses. The bill that
- 26:42Speaker 7: would loosen up vaccination requirements in public and private schools
- 26:48Speaker 7: today is amendment stage, so I do expect some amendments
- 26:53Speaker 7: focusing on particularly the private school aspect of that I mean,
- 26:57Speaker 7: if you're a Catholic school, should you have to abide
- 27:01Speaker 7: by the states uh loosened rules for your student population?
- 27:06Speaker 7: Or could you, as a private school have a fairly
- 27:10Speaker 7: strict vaccination policy. So that that's one thing, it's the
- 27:15Speaker 7: significant thing today. There is another culture issue in the Senate, Yeah,
- 27:24Speaker 7: clamping down on transgender issues among West Virginia's youth. Uh
- 27:33Speaker 7: further further scaling back on the kind of gender therapy
- 27:41Speaker 7: and gender treatment that potentially could be available to to
- 27:46Speaker 7: uh two kids under age eighteen.
- 27:49Speaker 4: Uh.
- 27:49Speaker 7: So that's that's coming out in the Senate Health Committee
- 27:52Speaker 7: this afternoon. So we are we are, we are doing
- 27:56Speaker 7: a lot of hot button issues here at the West
- 27:59Speaker 7: Virginia Legislature.
- 28:00Speaker 4: All right, all right, Brad, As always, I appreciate it.
- 28:03Speaker 4: You got to hear a little bit of my rant there,
- 28:05Speaker 4: so I appreciate you sitting through that. Man, Thanks a lot.
- 28:08Speaker 7: See, after I told you my things, don't you wish
- 28:10Speaker 7: they were arguing about the name of the fountains instead?
- 28:13Speaker 4: Yeah? Yeah, I'll go back to I'll go back to
- 28:15Speaker 4: the good old days of last Friday when we were
- 28:18Speaker 4: just talking about mountains. I appreciate you being here man,
- 28:20Speaker 4: Thanks a lot, Brad Macklheannay. Of course you can follow

- 29:05Speaker 4: opinion on everything. My point in saying all this is
- 29:09Speaker 4: to say again, we have a foster care crisis. We
- 29:13Speaker 4: have a childcare crisis. We are uh the lead what

- 32:33Speaker 2: That's the important part.
- 32:34Speaker 14: Yeah.
- 32:34Speaker 4: So did you finally get off the boat because you
- 32:36Speaker 4: were kind of you were stranded, You and Boson were
- 32:38Speaker 4: stranded on the boat, man, Is that right?
- 32:40Speaker 2: Yeah?
- 32:41Speaker 3: Yeah, we were, We were there, We got there Saturday
- 32:43Speaker 3: night and we finally both got to get off the
- 32:46Speaker 3: boat this morning at about two am.
- 32:49Speaker 4: Well that's good, that's good to hear. You know, I
- 32:51Speaker 4: told you the last time you were on, you were
- 32:52Speaker 4: on what I think it was Friday, talking about the
- 32:54Speaker 4: potential flooding, which you know, we did see in southern
- 32:58Speaker 4: West Virginia. Uh ticularly we had a mini snowstorm that
- 33:03Speaker 4: kind of caught some people like myself by surprise coming
- 33:05Speaker 4: in yesterday morning. It was pretty pretty rough drive in
- 33:08Speaker 4: yesterday morning from from.
- 33:09Speaker 3: Putneck cat fan of snow. It did, it did its
- 33:12Speaker 3: own thing, and it was only it's like from Milton
- 33:14Speaker 3: to Charleston back up to Drennan and that was it.
- 33:18Speaker 4: That was it. I mean, it was it was and
- 33:20Speaker 4: it was all gone and the sun was out by
- 33:21Speaker 4: about ten or ten thirty not going to be the
- 33:23Speaker 4: case with this next storm system though, right right.
- 33:27Speaker 3: We're expecting this. First of all, there's a couple of ployries,
- 33:30Speaker 3: so possible today at any point across the area because
- 33:33Speaker 3: we're just so cold. But as we head into tonight
- 33:37Speaker 3: ten eleven o'clock, we'll see a few little light snowshowers
- 33:39Speaker 3: popping up, and then by the time we get to
- 33:42Speaker 3: you know, two three o'clock in the morning, light snow
- 33:44Speaker 3: showers relatively steady. But here's the deal, and this is
- 33:48Speaker 3: going to be a slow roll on the snow. Accumulation's
- 33:52Speaker 3: gonna take, you know, a good solid eight to twelve
- 33:56Speaker 3: hours for us to accumulate the two to three inches
- 34:00Speaker 3: the snow, and then we're going to have a lull
- 34:02Speaker 3: as it go into Wednesday afternoon or early evening, and
- 34:05Speaker 3: then in the late night hours we'll get another little
- 34:07Speaker 3: batch of snow, maybe throws another inch or so in
- 34:11Speaker 3: going into early Thursday morning. So within about what would
- 34:15Speaker 3: be about a thirty hour time period, we'll have anywhere
- 34:19Speaker 3: from three to five inches worth of snow across the area.
- 34:22Speaker 3: So it takes a while for us to get there,
- 34:25Speaker 3: and the roads are going to be able to be
- 34:28Speaker 3: plowed properly, and people are going to be able to
- 34:30Speaker 3: get around relatively easy, So it's not coming down real
- 34:33Speaker 3: heavy all at once.
- 34:34Speaker 8: That's good news.
- 34:35Speaker 4: Well, and unlike last week the differences I think too,
- 34:37Speaker 4: between what we had which turned out to be not
- 34:39Speaker 4: a whole lot for the Charleston Aarry, to be honest
- 34:41Speaker 4: with you, I mean almost nothing at all. It is
- 34:44Speaker 4: going to be a heck of a lot colder. I
- 34:45Speaker 4: mean even today, it's pretty dang cold out there, and
- 34:48Speaker 4: it's not going to warm up with the next couple
- 34:50Speaker 4: of days. So whatever snow we do get is going
- 34:52Speaker 4: to stick. It's not going to go away quickly like
- 34:54Speaker 4: what the what last week's snow did.
- 34:57Speaker 3: Right this is you know, we're looking at temperatures that
- 34:59Speaker 3: are money plus degrees below normal for this time off
- 35:03Speaker 3: y'ere for our daytime highs, and then you look at
- 35:05Speaker 3: the load temperatures. I mean, we're looking at about fifteen
- 35:09Speaker 3: degrees below normal.
- 35:10Speaker 2: So when you.
- 35:11Speaker 3: Look at that, you know, obviously stuff's going to stick around.
- 35:14Speaker 3: But thankfully, at least by the time we get this weekend,
- 35:17Speaker 3: you know, forty on Saturday, we'll be in the mid
- 35:19Speaker 3: upper forties on Sunday and next week we.
- 35:21Speaker 2: Do warm up.
- 35:22Speaker 3: But it's going to be a very efficient snow that's
- 35:25Speaker 3: going to be produced tonight through tomorrow, and so it's
- 35:29Speaker 3: going to be light and fluffy. It blows around easy,
- 35:31Speaker 3: and that's good if you're driving down the road and
- 35:33Speaker 3: it just kind of blows around. It's nine that it's
- 35:36Speaker 3: not stuff that's heavy and thick that is difficult to shovel,
- 35:39Speaker 3: things of that nature. But you know, more than anything, yes,
- 35:43Speaker 3: the cold is the big story because of the temperatures,
- 35:47Speaker 3: you know, being so low and so far below normal
- 35:50Speaker 3: for this time of year.
- 35:51Speaker 4: And everybody wants to know how is it going to
- 35:52Speaker 4: impact them? So go ahead and set that up for
- 35:55Speaker 4: people on that. Let's just take the morning commute tomorrow morning.
- 35:58Speaker 4: You know, most people seven eight o'clock, what can they expect.
- 36:01Speaker 3: You're going to expect some light stone showers that continue.
- 36:04Speaker 3: Would I would definitely be prepared to take my time
- 36:07Speaker 3: tomorrow morning. I do expect most schools to be on
- 36:10Speaker 3: a delay, with at least here in the Kanaal Valley,
- 36:13Speaker 3: so Kanauh County schools probably would go on a two
- 36:15Speaker 3: hour delay for tomorrow morning. There's the potential that they
- 36:18Speaker 3: do go ahead and roll in a cancellation. But at
- 36:22Speaker 3: this point I would project a two hour delay, same
- 36:25Speaker 3: thing across parts of Putnam County, Jackson, stretching back out
- 36:29Speaker 3: into Clay County, and also into sections of Fayette, Raleigh
- 36:34Speaker 3: and also Boom County.
- 36:35Speaker 4: But then we're going to be done with it next week. Right,
- 36:37Speaker 4: it's over. Winter's over, right, right? Right?
- 36:40Speaker 3: Yeah, Well, as much as I would like to say that, no,
- 36:45Speaker 3: we do have a winter is taking its sweet time
- 36:48Speaker 3: and spring will be a late spring. And I've had
- 36:51Speaker 3: people say what the length spring, Well, it just means
- 36:54Speaker 3: it's going to be colder for longer as we go
- 36:57Speaker 3: into spring, and it's going to take us while to
- 36:59Speaker 3: really get to the warm up. So we got to
- 37:01Speaker 3: wait till deep into the spring before we start the
- 37:03Speaker 3: season of that. So the water on the rivers and
- 37:06Speaker 3: the lakes are going to be colder than they should
- 37:07Speaker 3: be going into spring. But you know, hey, you wanted
- 37:10Speaker 3: to get rid of a drought, so we did. Unfortunately
- 37:13Speaker 3: we just didn't in one big, grand fashion.
- 37:15Speaker 4: All right, all right, Brian, as always, it's a pleasure
- 37:19Speaker 4: to talk to you. I want you to come back
- 37:20Speaker 4: on to talk about regatta. I want you to come
- 37:22Speaker 4: back on to talk about baseball, and I want you
- 37:23Speaker 4: I don't want you to talk about winter anymore. So
- 37:26Speaker 4: hopefully I'm gonna go. Hopefully this is the last time
- 37:28Speaker 4: I talked to you unless it's about those things. Okay,
- 37:31Speaker 4: Well we'll see what week in that.
- 37:32Speaker 8: Well we can do.
- 37:33Speaker 3: We're trying to book our acts right now. We're doing
- 37:35Speaker 3: fundraising and getting ready. We're adding new things to the regatta.
- 37:38Speaker 3: And guess what boat.
- 37:40Speaker 11: Right boat right?
- 37:42Speaker 4: Boat rides cool? Sounds good, sounds good right now. I'll
- 37:45Speaker 4: take it, Brian, I appreciate it. Glad you're off the
- 37:47Speaker 4: boat man. We'll talk to you soon. Thanks a lot.
- 37:50Speaker 4: Sounds good, Brian Houston, Storm Tracker thirteen. Yeah, it just

- 41:05Speaker 4: in everything because people didn't support President Trump. So it
- 41:10Speaker 4: only happened since, you know, last year, since twenty sixteen.
- 41:16Speaker 4: I've been pretty fair about this. West Virginia's problems cannot
- 41:19Speaker 4: be blamed on one person or one party and anybody.
- 41:22Speaker 4: And again I've been fair about this. Anybody that thinks

- 46:21Speaker 4: a little personal out here for a moment, if you
- 46:23Speaker 4: allow me to. I learned last night of the death
- 46:25Speaker 4: of someone who has literally been a part of my
- 46:28Speaker 4: life since shortly after I was born. My family originally
- 46:31Speaker 4: from West Virginia. My dad was in the military. We
- 46:34Speaker 4: were living in Georgia. I was born in Georgia and
- 46:36Speaker 4: then we moved back to West Virginia. I became very
- 46:38Speaker 4: close with the Coger family. Cog A r out of
- 46:43Speaker 4: the Man area of Logan County. They had a son
- 46:45Speaker 4: who was just a few months older than I was,
- 46:48Speaker 4: and he and I went through the crib days together
- 46:51Speaker 4: in the first day of kindergarten, et cetera, et cetera.
- 46:54Speaker 4: His name was an old coger, and he and I
- 46:57Speaker 4: still touch base when we can. I learned last night
- 46:59Speaker 4: that father Noel s passed away. And I bring this
- 47:03Speaker 4: up because, through the miracle of modern technology, mainly online
- 47:06Speaker 4: listening through the website and or the app, he listened
- 47:10Speaker 4: to the show every morning from his home in Wyoming County.
- 47:14Speaker 4: He was retired mid seventies. A great man, practically a
- 47:18Speaker 4: second father to me, as I said, And he listened
- 47:22Speaker 4: to the show as I said, from his home Wyoming
- 47:24Speaker 4: County every day, frequently would comment on things, and always
- 47:28Speaker 4: followed me on social media. He's a great man. So
- 47:33Speaker 4: I just want to kind of throw that out there.
- 47:34Speaker 4: Rest in peace to Noel Cocher. Vaccines are your best

- 47:53Speaker 4: last and everything over the years that they were the
- 47:56Speaker 4: political majority. President Trump's policies and the Conservative republic Party
- 48:00Speaker 4: majority will bring West Virginia and the country out of
- 48:03Speaker 4: this mess and last place on everything. Get on board, Dave.
- 48:08Speaker 4: You know I am. I am a conservative for the
- 48:10Speaker 4: most part. I am. I just have an issue with
- 48:16Speaker 4: a lot of the time we spend on social issues,
- 48:19Speaker 4: conservative policies.
- 48:20Speaker 16: On board.
- 48:22Speaker 4: I'm concerned about my bank account, That's what I'm concerned about.
- 48:25Speaker 4: I'm concerned about paved roads. I'm concerned about the military.
- 48:28Speaker 4: But when it comes to this other stuff that we
- 48:30Speaker 4: spend so much time arguing about many times, that's not
- 48:33Speaker 4: even an issue in West Virginia. Yeah, I do. I
- 48:37Speaker 4: do get a little bit upset by that. Let's go
- 48:42Speaker 4: live to the Capitol now. I think we've got Dave
- 48:44Speaker 4: Wilson live from the belly of the Beast. Is that right, North?
- 48:48Speaker 4: TJ's here too, Say hi TJ.

- 48:54Speaker 4: All right, all right?
- 48:55Speaker 6: How much time?
- 48:56Speaker 17: How much time we waste on these eighty twenty issues?
- 48:59Speaker 4: We waste time? Serious, we waste we waste too much.
- 49:01Speaker 4: We waste too much time. And you miss my rie.
- 49:04Speaker 2: Wait wait wait no, no, wait, wait hold hang hang

- 49:07Speaker 17: Okay, Okay, these are eighty twenty ninety ten issues that
- 49:10Speaker 17: are going to sail through.
- 49:12Speaker 4: What's the problem. What do we I mean you lost
- 49:15Speaker 4: me here. What are we talking about any any of
- 49:17Speaker 4: these social issues? These social issues, and you say we're
- 49:19Speaker 4: wasting time?
- 49:20Speaker 8: How much time are we wasting?
- 49:21Speaker 4: We're wasting because we're bringing it up. You know, we're
- 49:24Speaker 4: wasting a lot of time on crap that doesn't matter
- 49:27Speaker 4: in West Virginia, mister Wilson. That's what we're doing. We
- 49:30Speaker 4: need there's somebody because they're bringing it up. It matters

- 50:13Speaker 4: I don't know. I totally lost my train of thought.
- 50:15Speaker 4: Irritated me this morning. I'm just saying. I'm just saying
- 50:21Speaker 4: that we're going to we focus on words, and like
- 50:24Speaker 4: Brad said, I am a I am a free speech absolutist.
- 50:29Speaker 4: I don't have a problem with saying certain words. I
- 50:32Speaker 4: have a problem with the fact that we're wanting to

- 50:37Speaker 4: we have half of the state right now, or the
