Speaker 1: What's up everyone and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to pick up where we left
• 0:05
Speaker 1: off with the Tyler Robbins in prelim hearing, day number two.
• 0:11
Speaker 1: And we left off with Kathy Nestor asking if he
• 0:14
Speaker 1: was involved with the search for the gun. And his
• 0:16
Speaker 1: response was, I was not involved in the search for
• 0:19
Speaker 1: the gun, no. Now Ms. Nestor picks up. Did you
• 0:23
Speaker 1: notice when it was located? Answer, from the footage that
• 0:26
Speaker 1: we reviewed, we identified an area that we believed could
• 0:29
Speaker 1: potentially be of evidentiary value, and then it was secured.
• 0:33
Speaker 1: And then I was notified that as a result of
• 0:35
Speaker 1: that search, a gun had been located, yes. Question, were
• 0:39
Speaker 1: you involved in processing of that gun? In other words,
• 0:42
Speaker 1: boxing it, shipping it, sending it wherever it was going
• 0:45
Speaker 1: to be analyzed? Answer, I was not, no. Question, okay,
• 0:49
Speaker 1: thank you, all right. Now, I want to shift to
• 0:51
Speaker 1: the autopsy for just a moment. You were not present
• 0:54
Speaker 1: at the autopsy, is that right? Answer, I was not. Question, okay.
• 0:58
Speaker 1: So anything you know about the autopsy was not from
• 1:01
Speaker 1: personal observation? Answer, no. Other than from my meeting with
• 1:06
Speaker 1: the medical examiner and his report, no. I was not present. Question,
• 1:11
Speaker 1: did you meet with the medical examiner after he had
• 1:13
Speaker 1: conducted the autopsy? Answer, I did, yes. Question, and when
• 1:17
Speaker 1: you met with him, did you provide him information about
• 1:20
Speaker 1: what you had learned in your investigation so far? Answer,
• 1:24
Speaker 1: we didn't have any reason to provide any investigative information
• 1:27
Speaker 1: to him. The purpose of the meeting was to establish
• 1:31
Speaker 1: what information he could provide to us. Question, well, in fact,
• 1:35
Speaker 1: on the front page of the medical examiner's report, he
• 1:38
Speaker 1: talks about the investigation and the information he learned. Did
• 1:42
Speaker 1: he learn that from you or did he learn it
• 1:43
Speaker 1: from someone else? Answer would be my recollection that he
• 1:48
Speaker 1: did not learn it from us, but I couldn't speak
• 1:50
Speaker 1: to how he did learn about it. Question, okay, so
• 1:54
Speaker 1: what you didn't share with him Your conclusion about what
• 1:57
Speaker 1: happened or how Mr. Kirk was injured or anything like that? Answer,
• 2:02
Speaker 1: that's my recollection. Question, okay, thank you. And also, isn't
• 2:06
Speaker 1: it true that fingerprints were taken from Mr. Kirk and
• 2:09
Speaker 1: autopsy photos were provided to you on a CD? Answer, yeah. Question,
• 2:14
Speaker 1: was there anything else provided to you from the autopsy
• 2:16
Speaker 1: other than that? Answer, other than the CD and the report? Question, yes. Answer, no,
• 2:22
Speaker 1: not to me, no. Question, okay, you did not mention
• 2:26
Speaker 1: to you Were you aware of anything else from the
• 2:28
Speaker 1: autopsy going to anyone else? Answer. I believe standard practice
• 2:32
Speaker 1: is anything evidentiary value that the medical examiner collects is
• 2:35
Speaker 1: transferred through the chain of custody. Question. And are you
• 2:39
Speaker 1: aware of anything that was transferred after Mr. Kirk's autopsy? Answer.
• 2:44
Speaker 1: I'm aware that there were items transferred for evidence, yes. Question.
• 2:48
Speaker 1: What items? Answer. I believe some fragments of a bullet casing.
• 2:51
Speaker 1: I know Mr. Kirk's personal items. To be returned to
• 2:54
Speaker 1: the family, and that's all I can recall off the
• 2:56
Speaker 1: top of my head. Question, do you know how many
• 2:59
Speaker 1: fragments from the bullets? Answer, I don't. Question, okay. Now
• 3:03
Speaker 1: I'd like to talk a little bit about the ring
• 3:05
Speaker 1: camera that you obtained. And you interviewed a woman named
• 3:08
Speaker 1: Miss Noble, is that right? To get that camera footage
• 3:11
Speaker 1: that we watched with the car on the outside. Answer,
• 3:15
Speaker 1: we interviewed her to verify the authenticity of the video, yes. Question,
• 3:19
Speaker 1: were you involved in that interview? Answer, with Miss Noble? Answer,
• 3:23
Speaker 1: or question, mm-hmm. Answer, yes. Question, and do you recall
• 3:27
Speaker 1: what they told you about what they remember seeing in
• 3:30
Speaker 1: and around that car that night? Answer, I don't recall.
• 3:34
Speaker 1: I just know that we were there to verify the video.
• 3:36
Speaker 1: I didn't conduct an interview with Ms. Noble at that time. Question, okay,
• 3:41
Speaker 1: can we please bring up poll? Sorry, just for a moment.
• 3:44
Speaker 1: Let's see poll 48. This is Ms. Noble's interview. Do
• 3:47
Speaker 1: you have it? All right. Do you remember that? Looking
• 3:50
Speaker 1: at the interview, does that refresh your recollection? Answer, I
• 3:53
Speaker 1: remember reading the report at some point, yes. Question, and
• 3:56
Speaker 1: do you remember that the nobles told you that the
• 3:58
Speaker 1: driver of the vehicle was bald? Answer, I do remember
• 4:02
Speaker 1: that being in the report, yes. Question, and you didn't
• 4:05
Speaker 1: mention that today when you were talking about the ring camera,
• 4:08
Speaker 1: did you? Answer, I did not. Question, and did they
• 4:11
Speaker 1: also tell you that there were three other people in
• 4:13
Speaker 1: the car? Answer, yes, I believe they thought that was
• 4:16
Speaker 1: the case. Question, okay. I want to go back, if
• 4:20
Speaker 1: I can, to the scene itself. The preservation... of the
• 4:23
Speaker 1: actual scene where Mr. Kirk passed. Did you have all
• 4:27
Speaker 1: canine dogs at any point that sniffed that area? Answer,
• 4:31
Speaker 1: I don't know specifically that area, but I do know
• 4:34
Speaker 1: that canines were present or a canine was present on
• 4:37
Speaker 1: that day. Question, but you don't know what the tasks
• 4:40
Speaker 1: the canine were given? Answer, my understanding was that it
• 4:43
Speaker 1: was to be used in an effort to track an
• 4:46
Speaker 1: individual that jumped off the roof, but I don't know
• 4:49
Speaker 1: for certain. Question, and obviously... That didn't produce any results.
• 4:53
Speaker 1: Or we would have heard about it, right? Answer, yeah.
• 4:56
Speaker 1: Not that I was made aware of. Question, okay. Do
• 4:59
Speaker 1: you know when the tent and the stuff was actually
• 5:01
Speaker 1: removed from the scene? Answer, I don't. I would imagine
• 5:05
Speaker 1: it would have been at least a couple days, if
• 5:07
Speaker 1: not longer than that, before anything was removed from the scene. Question,
• 5:12
Speaker 1: you didn't have to give permission to remove the tent. Answer,
• 5:14
Speaker 1: me personally. Question, right. Answer, no. Question, so you're not
• 5:19
Speaker 1: sure when it was removed. Answer, no. Question, and were
• 5:23
Speaker 1: you involved in the decision to pave over the dirt
• 5:26
Speaker 1: that was under the tent? Answer, at UVU. Question, uh-huh. Answer, no. Question,
• 5:32
Speaker 1: did you know that happened? Answer, only because it was
• 5:35
Speaker 1: on the news. Question, all right, but you don't know
• 5:38
Speaker 1: when or who ordered it? Answer, no. Question, and it's
• 5:42
Speaker 1: true that during the time before Mr. Robinson turned himself in,
• 5:46
Speaker 1: you all received lots and lots of tips from the public.
• 5:48
Speaker 1: Is that fair? Agent Hall, correct. Question, you received tips
• 5:52
Speaker 1: of death threats that Mr. Kirk had received the day
• 5:54
Speaker 1: before the shooting. Is that right? Answer, I'm sorry, did
• 5:58
Speaker 1: we receive threats that Mr. Kirk had received before the event?
• 6:02
Speaker 1: Kathy Nestor, let me clarify. That was a confusing question.
• 6:06
Speaker 1: As you were going through tips that the public was
• 6:08
Speaker 1: giving you, did you receive a tip about online death
• 6:11
Speaker 1: threats that had been made against Mr. Kirk prior to
• 6:14
Speaker 1: his death? Answer, there was a huge variety of tips
• 6:17
Speaker 1: and information and suggestions that were being provided by the public. Question,
• 6:23
Speaker 1: and some of those filtered through to you, right? Answer,
• 6:26
Speaker 1: some of them filtered their way down to us, but
• 6:28
Speaker 1: predominantly that was being handled by our state information and
• 6:32
Speaker 1: analysis center that had been set up. Question, okay, and
• 6:36
Speaker 1: you also got multiple tips about potential suspects, people who
• 6:40
Speaker 1: thought they recognized people in the picture, right? Answer, yes.
• 6:44
Speaker 1: There were different calls and information provided by the public. Question,
• 6:49
Speaker 1: and you had quite a few of those. Answer, correct. Question,
• 6:51
Speaker 1: and then Mr. Robinson turned himself in, right? Answer, yes. Question,
• 6:56
Speaker 1: and is it your understanding that the individual they used
• 6:59
Speaker 1: to facilitate Mr. Robinson turning himself in was someone known
• 7:02
Speaker 1: to Mr. Robinson personally that had been connected to law enforcement? Answer,
• 7:08
Speaker 1: I know he was known to the family. I don't
• 7:09
Speaker 1: know his connection specifically with Mr. Robinson. But I'm aware
• 7:13
Speaker 1: that someone was used to facilitate Mr. Robinson turning himself in. Question.
• 7:18
Speaker 1: And were you aware that he was one of his
• 7:19
Speaker 1: Boy Scout leaders? Did you know that? Answer. I think
• 7:22
Speaker 1: I heard that at some point. There was a connection.
• 7:25
Speaker 1: I don't recall specifically what it was. Question. And Mr. Robinson,
• 7:29
Speaker 1: in fact, no police went to go arrest him. He
• 7:32
Speaker 1: drove himself or was driven with his parents to the
• 7:35
Speaker 1: Washington County Sheriff's Department, correct? Answer. That's my understanding, yes. Question.
• 7:41
Speaker 1: And he voluntarily walked in? Answer, that's my understanding, yes. Question,
• 7:46
Speaker 1: and that was the first moment you ever knew his
• 7:49
Speaker 1: name connected with the case? Answer, yeah. Aside from the
• 7:53
Speaker 1: image that we had, that was the first time that
• 7:55
Speaker 1: we had a name of an individual who had taken responsibility, yes. Question,
• 8:00
Speaker 1: and did you personally ever meet with Mr. Robinson? Answer,
• 8:04
Speaker 1: I did not. Question, and as far as you know, Mr.
• 8:07
Speaker 1: Robinson did what he said he was going to do.
• 8:10
Speaker 1: He told police that he was coming, he was coming peacefully,
• 8:13
Speaker 1: he was coming with his parents, and that's exactly what happened. Answer,
• 8:17
Speaker 1: I don't know any of the specifics of how he
• 8:19
Speaker 1: was arranged to turn himself in. In terms of what
• 8:22
Speaker 1: you just described, I just know that it's being facilitated
• 8:25
Speaker 1: with the sheriff's office. Question, okay, court's indulgence for just
• 8:29
Speaker 1: a moment, Your Honor. Judge, yes. Question by Ms. Nestor.
• 8:34
Speaker 1: Thank you, Agent Hull. I tender the witness, Your Honor. Judge,
• 8:38
Speaker 1: thank you. Redirect by state. Now the prosecution jumps back
• 8:42
Speaker 1: in for redirect. Prosecution. I'm just going to go back
• 8:47
Speaker 1: to a few things that Ms. Nestor asked you about.
• 8:49
Speaker 1: First of all, the unfired bullet that you referred to,
• 8:52
Speaker 1: is it your understanding that that bullet was accounted for? Answer,
• 8:55
Speaker 1: that's my recollection, yes. Question, okay. And it possibly belonged
• 8:59
Speaker 1: to an officer that could have maybe been clearing his weapon? Answer, yeah,
• 9:04
Speaker 1: that's what I recall being told about that particular item. Question,
• 9:08
Speaker 1: are you aware of? On the 10th, there were police
• 9:10
Speaker 1: officers present that were actually securing buildings and securing rooms
• 9:14
Speaker 1: there at UVU? Answer. I know prior to my arrival,
• 9:19
Speaker 1: it was a dynamic and active scene that I believe
• 9:22
Speaker 1: was originally being treated that there was an active shooter
• 9:24
Speaker 1: still on campus. So there was a large rapid response
• 9:27
Speaker 1: of law enforcement who were actively trying to clear, secure,
• 9:31
Speaker 1: and ensure that the campus was safe. If that answers
• 9:34
Speaker 1: the question. Question. The entire campus? Answer. Yes. Correct. Question, okay,
• 9:41
Speaker 1: and what types of officers were clearing the campus? Answer,
• 9:44
Speaker 1: originally there would have been probably local units who would
• 9:47
Speaker 1: have responded, but subsequently specialty teams would have been deployed
• 9:51
Speaker 1: to a more methodical search of the campus and what
• 9:54
Speaker 1: we would call a clearing of the campus. Question on
• 9:58
Speaker 1: those specialty teams. And any other officers, how were they equipped?
• 10:02
Speaker 1: What type of equipment were they carrying? Answer, I believe
• 10:05
Speaker 1: most officers carry a sidearm, a handgun, and most officers
• 10:09
Speaker 1: in this day and age are equipped with a rifle
• 10:10
Speaker 1: platform as well. Question, okay, and when you said that
• 10:14
Speaker 1: it was possible that the round was from an officer
• 10:16
Speaker 1: clearing his weapon, what exactly do you mean by that?
• 10:19
Speaker 1: Question or answer. Our standard practice in our department is
• 10:22
Speaker 1: to carry a rifle cruiser ready. Prosecution, I'm sorry. Answer.
• 10:29
Speaker 1: We carry our rifles in a situation which is called
• 10:31
Speaker 1: cruiser ready. Prosecution, what does that mean? Answer. It means
• 10:35
Speaker 1: we don't have a round chambered. So if an officer
• 10:37
Speaker 1: deployed with his rifle, he would chamber a round. Once
• 10:40
Speaker 1: he had done whatever task it was that he was doing,
• 10:43
Speaker 1: in order to put that weapon back, he would eject
• 10:45
Speaker 1: the magazine and eject the round. sometimes in doing so
• 10:48
Speaker 1: rounds are dropped or not accounted for. Question. Okay. Have
• 10:53
Speaker 1: you personally done that yourself? Answer. We do that in
• 10:56
Speaker 1: training and I've done that in the field as well. Yes. Question.
• 11:00
Speaker 1: And are you aware of, is that something that's common
• 11:02
Speaker 1: among police officers in this situation? Answer. I believe for
• 11:06
Speaker 1: most agencies, that's how they carry their weapons, but I
• 11:09
Speaker 1: can't speak specifically for agencies outside my own. Question. Do
• 11:13
Speaker 1: you have any idea how many officers were dedicated or
• 11:16
Speaker 1: sent out to the campus? Answer, I can tell you,
• 11:19
Speaker 1: I had to park on University Avenue and walk all
• 11:22
Speaker 1: the way onto campus between hundreds of police cars, so
• 11:24
Speaker 1: I would say hundreds if not thousands of officers. High
• 11:28
Speaker 1: hundreds would have responded to a campus that day. Alright folks,
• 11:31
Speaker 1: we're going to wrap up right here, and in the
• 11:33
Speaker 1: next episode dealing with the topic we're going to pick
• 11:35
Speaker 1: up with, now I'm going to ask you about Ms. Nestor,
• 11:38
Speaker 1: and what she asked you about your observation of seeing Mr.
• 11:41
Speaker 1: Robinson with something in his hand. All the information that
• 11:45
Speaker 1: goes with this episode can be found in the description box.
