- 0:32Speaker 2: morning in the capital city of Charleston on its way
- 0:34Speaker 2: to the seventies. Today, we may break a record tomorrow.
- 0:39Speaker 2: If we get up to eighty degrees tomorrow, it'll be
- 0:41Speaker 2: the warmest day on that date tomorrow, which is what
- 0:44Speaker 2: the sixth of March, right the sixth of March, the
- 0:46Speaker 2: warmest day since nineteen fifty six. So we've got a
- 0:50Speaker 2: chance to break some records tomorrow. It looks like some
- 0:52Speaker 2: of this rain is moving out. We've had a lot
- 0:54Speaker 2: of fog in the area this morning, so we're looking
- 0:57Speaker 2: forward to some warm temperatures. Thanks for joining us on
- 0:59Speaker 2: the show. Filling in for Dave today. He plans to
- 1:01Speaker 2: be back tomorrow.
- 1:02Speaker 1: Of course.

- 1:40Speaker 2: We've got a couple of guests coming up during the
- 1:43Speaker 2: next hour and we're gonna go now to Meghan Daily.
- 1:46Speaker 2: Meghan is the lead designer with Echo Literary Arts and
- 1:52Speaker 2: Literary Arts, and there's a big event coming up later
- 1:55Speaker 2: today on the West Side. Megan, good morning, how you doing.
- 2:00Speaker 3: I'm well, how are you this morning?
- 2:02Speaker 2: I'm doing great. Well. Tell us about what's happening this
- 2:05Speaker 2: evening the West Side Ripple Mural Project celebration.
- 2:09Speaker 3: What's happening well, we have had eight amazing artists who
- 2:15Speaker 3: have put together some murals, our first round of murals
- 2:20Speaker 3: that are going to go up on our Arts park
- 2:23Speaker 3: since here on the West Side at four twenty seven
- 2:28Speaker 3: West Washington. So tonight we're going to gather with our
- 2:33Speaker 3: friends from the West Virginia Creative Network, the West Virginia
- 2:38Speaker 3: State University Extension Service, and we're just going to take
- 2:43Speaker 3: some time to look at all the amazing artwork that
- 2:48Speaker 3: has been done in the first round of mural projects,
- 2:53Speaker 3: and we're going to look forward to the installation of
- 2:59Speaker 3: the mural side that is going to go around our
- 3:01Speaker 3: art park here in the coming weeks as the weather
- 3:05Speaker 3: breaks and we have an opportunity to start our arts
- 3:11Speaker 3: park here.
- 3:12Speaker 2: Megan, tell me about about what people are going to see,
- 3:16Speaker 2: and you know, you take a look at some of
- 3:18Speaker 2: these murals and they're really impressive. Give me your impressions.
- 3:23Speaker 3: We have artwork from eight artists from a range around
- 3:31Speaker 3: the states. They're they're they're large, but they're not they're
- 3:37Speaker 3: not the huge murals that take up the entire side
- 3:40Speaker 3: of a building. We've got the murals inside right now,
- 3:44Speaker 3: which probably sounds weird because most of the time people
- 3:48Speaker 3: think of murals as being outdoor things. But we figured
- 3:53Speaker 3: out a way to do this in the wintertime with
- 3:56Speaker 3: our artists, and they were amazingly flex in working with us.
- 4:01Speaker 3: So right now we have our murals inside it Echo
- 4:05Speaker 3: Lit at four twenty seven Washington Street West and people
- 4:10Speaker 3: can come in and look at them. We're going to
- 4:12Speaker 3: have a concept drawing of the fence projects so people
- 4:16Speaker 3: can see what's going to be happening as we move forward.
- 4:24Speaker 3: We've just got some beautiful, colorful, vibrant, hopeful artwork that's
- 4:30Speaker 3: going to be the start of some really great projects
- 4:33Speaker 3: going on here on the West Side in the next
- 4:35Speaker 3: few months.
- 4:36Speaker 2: Is there Megan a general theme? Are there different themes
- 4:39Speaker 2: to the different pieces of art? What about the themes?
- 4:43Speaker 3: Well, when we put out a call for artists at
- 4:48Speaker 3: the end of twenty twenty five, we asked our artists
- 4:52Speaker 3: to focus on ideas of community, growth and creativity, and
- 5:01Speaker 3: these artists just nailed it. Just some absolutely gorgeous work.
- 5:09Speaker 3: I don't want to spoil imagery for everybody yet and
- 5:13Speaker 3: want people to come out and see them, but I'm
- 5:16Speaker 3: you know, we have eight different artists. We gave them
- 5:20Speaker 3: the same three words creativity, community and growth, and they're
- 5:26Speaker 3: amazingly different pieces of art, but there are they all
- 5:32Speaker 3: work together so well. We were just so amazed at
- 5:37Speaker 3: how even though they all come from different communities and
- 5:43Speaker 3: different backgrounds and different experiences, they all came to us
- 5:49Speaker 3: like they the artwork works together, and that films cliche,
- 5:59Speaker 3: but it's nice to see that even without these artists
- 6:04Speaker 3: knowing one another are collaborating. They all just picked up
- 6:09Speaker 3: the vibes that we're hoping to share with the community
- 6:13Speaker 3: here and they just knocked it out of the park.
- 6:17Speaker 3: We've got some really gorgeous artwork that's going to be
- 6:20Speaker 3: on our fence project here in no time.
- 6:24Speaker 2: Nine thirteen, Meghan dailies with us talking about the West
- 6:27Speaker 2: Side RiPP Or Mural Project celebration tonight. It goes from
- 6:31Speaker 2: six and to eight at Echo Lit tonight on Charleston's
- 6:34Speaker 2: West Side. Tell me about, Megan, about mural art and
- 6:38Speaker 2: how just kind of the characteristics of that like as
- 6:42Speaker 2: kind of as an art form in kind of where
- 6:45Speaker 2: that kind of shakes out, and how you know, mural
- 6:48Speaker 2: artists are different obviously than other artists. Just talk about
- 6:52Speaker 2: that if you would, Well, a.
- 6:56Speaker 3: Lot of artists people tend to think of art as
- 7:02Speaker 3: something that you just you buy or you go and
- 7:06Speaker 3: see it a museum. Mural art is almost always for
- 7:14Speaker 3: public presentation. There are, of course a few people who
- 7:17Speaker 3: commission private murals for their homes or their offices, but
- 7:22Speaker 3: mural art tends to be public art. Art for the people,
- 7:27Speaker 3: are presented in a way that you're not going to
- 7:32Speaker 3: have a museum docent telling you what the artists want
- 7:36Speaker 3: to say. So these artists who make public art do
- 7:40Speaker 3: mural art there they're just putting it out there and
- 7:44Speaker 3: they're not expecting that anyone's going to need an explanation,
- 7:51Speaker 3: and it's just there for people of all facets of
- 7:57Speaker 3: life to enjoy out in the world. You don't have
- 8:01Speaker 3: to have an art history major to appreciate mural art.
- 8:06Speaker 3: You don't. You just have to have eyes and a
- 8:09Speaker 3: way to get to see the artwork. And it's out
- 8:14Speaker 3: there for the people. It's it's one of the most
- 8:18Speaker 3: egalitarian forms of art I think that there is. It's
- 8:23Speaker 3: just out there to be enjoyed in the world. And
- 8:26Speaker 3: sometimes it's it's the most amazing thing to be somewhere
- 8:31Speaker 3: and see a new piece of mural art and just
- 8:37Speaker 3: where'd that come from? That just used to be a
- 8:39Speaker 3: brick wall two months ago, and now it's this big, beautiful,
- 8:44Speaker 3: vibrant piece of artwork that's there to enjoy any time
- 8:48Speaker 3: of day.
- 8:49Speaker 2: The West Side Arts Park, So these murals will be
- 8:53Speaker 2: in the West Side Arts Park. Again, where is that
- 8:56Speaker 2: located and what's the timeline for getting that done?
- 9:01Speaker 3: We are at four twenty echo. It is at four
- 9:05Speaker 3: to twenty seven West Washington Street. The Art park will
- 9:09Speaker 3: be right next door to us. It will be a
- 9:13Speaker 3: fenced in green space that will be used for common gathering,
- 9:22Speaker 3: community events. We're hoping to break grounds on the fence
- 9:29Speaker 3: project that all the murals will be installed on. We're
- 9:32Speaker 3: hoping to break ground just as soon as we're sure
- 9:37Speaker 3: that we're out of the frost zone. We're not going
- 9:41Speaker 3: to have hopefully not too much more frozen ground. And
- 9:44Speaker 3: it sounds like from your forecast or approaching that so
- 9:51Speaker 3: I'm not exactly. You never know how long it's going
- 9:55Speaker 3: to take with construction projects, so I don't want to
- 9:58Speaker 3: nail down a date, but we're hoping that we'll have
- 10:04Speaker 3: a fence and murals up well in advance of everybody's springtime.
- 10:11Speaker 1: Wandering about sounds great.
- 10:14Speaker 2: Now, there's some key partners here right. You mentioned at
- 10:17Speaker 2: the beginning. West Virginia Creative Network also Wes Virginia State
- 10:22Speaker 2: University Extension Service, and I noticed in the release that
- 10:27Speaker 2: announcing this tonight the Venimum Foundation, Greater Kanaw Valley Foundation,
- 10:31Speaker 2: so key partners making all this possible.
- 10:35Speaker 3: Absolutely, we've had some really great folks, as you said,
- 10:40Speaker 3: Creative Network, West Virginia State University, which and the Creative
- 10:46Speaker 3: Network receives some funding from the benadem Foundation, it's Greater
- 10:51Speaker 3: Kannaw Valley Foundation. We've had some additional grants that have
- 10:57Speaker 3: helped move this project forward from Mary Amy Goodwin Arts
- 11:03Speaker 3: Amplified Charleston Urban Works. Just Pierson at the Office of
- 11:08Speaker 3: Public Art has been absolutely a gold star assistant in
- 11:15Speaker 3: this project, just helping us with fundamentals and the nuts
- 11:21Speaker 3: and bolts to make sure we knew what we were
- 11:24Speaker 3: doing with our first public art project. Naomi Bays started
- 11:33Speaker 3: this whole project with West Virginia Creative Network, helped with
- 11:38Speaker 3: the foundational planning of this event. Marrigolds their board. They've
- 11:44Speaker 3: been great supportive. We've just had so much community support.
- 11:51Speaker 3: I hope I haven't left anybody out, but we've had
- 11:53Speaker 3: just an amazing amount of support and a lot of
- 11:57Speaker 3: people swinging by asking what's going on when things are
- 12:00Speaker 3: going to be ready and we just keep going, hopefully
- 12:04Speaker 3: really soon.
- 12:05Speaker 2: Yeah. So the details are they can stop by tonight
- 12:09Speaker 2: at Echo Lit as you mentioned the four hundred block
- 12:11Speaker 2: there of West Washington. You can stop by between six
- 12:14Speaker 2: and eight, Right, that's the celebration. Get to see these
- 12:18Speaker 2: these mural projects that will be eventually put outside, but
- 12:21Speaker 2: you get a really good look at them inside tonight.
- 12:25Speaker 3: Absolutely, it's we got set up last night. We were
- 12:30Speaker 3: ready for folks to come by this evening. We're really
- 12:34Speaker 3: excited to see people from our community come and actually
- 12:39Speaker 3: experience the artwork of close and personal this evening.
- 12:42Speaker 2: And also, Megan, you I guess have the opportunity to
- 12:45Speaker 2: talk to the artists where they be there and kind
- 12:46Speaker 2: of get their thoughts into their works.
- 12:49Speaker 3: I believe that all eight artists are going to be
- 12:52Speaker 3: here this evening. Hopefully no one's caught one of the
- 12:55Speaker 3: colds that's running around or anything like that. But as
- 12:58Speaker 3: far as I know, we haven't heard anybody say they
- 13:01Speaker 3: wouldn't be here. So all eight artists will be here
- 13:05Speaker 3: to talk and meet the community. And we're really excited
- 13:11Speaker 3: to have everybody together this evening.
- 13:13Speaker 2: Okay, Meghan, well, congratulations and good luck on that we
- 13:16Speaker 2: look forward to seeing the further development of the park
- 13:18Speaker 2: there on the West Side.
- 13:20Speaker 3: We're really excited to have people come out and enjoy
- 13:25Speaker 3: all the great things that the arts community is happening
- 13:30Speaker 3: here on the West Side.
- 13:31Speaker 2: Okay, Meghan, have a good day. We appreciate it.
- 13:34Speaker 3: Thank you so much. I have a great day, you too.
- 13:37Speaker 2: Megan Daily, she's a lead designer with Echo Literary Arts
- 13:40Speaker 2: and talking about at tonight at Echo litt there in
- 13:44Speaker 2: the four hundred block of West Washington. This will be
- 13:47Speaker 2: the unveiling tonight of the West Side Ripple Mural Project.
- 13:50Speaker 2: The celebration from six and to eight tonight. You can
- 13:53Speaker 2: drop by see the work of the eight artists before
- 13:57Speaker 2: they head outside. And so there's still some work to
- 13:59Speaker 2: do on the park. As she mentioned there, I'm going
- 14:01Speaker 2: to put the murals out there. There's going to be
- 14:03Speaker 2: a mural fence that's put up, nice green space. There's
- 14:06Speaker 2: still some work there, but you can get to work
- 14:07Speaker 2: a look at what the artists have accomplice in their projects.
- 14:11Speaker 2: Tonight from six until eight The Dave Allen Show on
- 14:15Speaker 2: five to eighty WCS brought to you emquired by Pinnacle Consultants,

- 14:37Speaker 2: you don't know can hurt you. It's nine to twenty two.
- 14:40Speaker 2: Coming up. In a couple of minutes, we're going to
- 14:42Speaker 2: talk to Metro New State White Courseponder Brad Micaelhaney. Of course,
- 14:45Speaker 2: yesterday was crossover day at the State House, where senators
- 14:51Speaker 2: and delegates work to get bills that started on their
- 14:54Speaker 2: side out of their chambers with final passage before heading
- 14:59Speaker 2: over to the other side. So you have to have
- 15:02Speaker 2: the bill of origin. If your bill started in the house,
- 15:04Speaker 2: you have to have it out by the fiftieth day,
- 15:06Speaker 2: which was yesterday, And in the last ten days they
- 15:10Speaker 2: mostly work on bills from the other side, and so
- 15:13Speaker 2: that's kind of what we're seeing. Starting today. We've got
- 15:16Speaker 2: Brad he's going to talk about that in just a
- 15:18Speaker 2: couple of moments, and then we're going to be joined
- 15:20Speaker 2: by Aubrey Sparks of the ACLU West Virginia about some
- 15:25Speaker 2: ice protests we've seen in the area in the last
- 15:29Speaker 2: couple of days. She'll talk about that as we get
- 15:32Speaker 2: you caught up and get ready for the guys going
- 15:34Speaker 2: to talk line, which is at ten oh six this
- 15:36Speaker 2: morning here on five EIGHTYWCHS. I'm Jeff Jenkins filling in

- 18:42Speaker 2: As you heard the promo there tonight on five eight
- 18:45Speaker 2: WUCCHS the Voice of Charleston High School Basketball. And this is,
- 18:50Speaker 2: you know, one of those games in the postseason where
- 18:53Speaker 2: you win, you go keep going. If you lose, you're out.
- 18:57Speaker 2: And South Charleston and Saint Albans now in Triple A
- 19:01Speaker 2: and they're in a Triple A region it's a pretty
- 19:03Speaker 2: tough region. We did their game earlier this year that
- 19:06Speaker 2: they played. In fact, there's only a couple of weeks ago,
- 19:08Speaker 2: I think just a little more than two weeks ago
- 19:10Speaker 2: down at Saint Albans and South Charleston won that game.
- 19:13Speaker 2: Saint Albans had a key player out that night. I
- 19:16Speaker 2: expect a close game tonight the South Charleston Community Center.
- 19:19Speaker 2: We'll tip it off a seven. We'll have it here
- 19:21Speaker 2: on five ADWCCHS towards to Charleston. And another game that
- 19:24Speaker 2: we're watching closely tonight is also here in Charleston. It's
- 19:27Speaker 2: a regular season game. It's a quad, a matchup between
- 19:30Speaker 2: number one and number two, and they've been basically number
- 19:33Speaker 2: one and number two. Washington out of the Eastern Panhandle
- 19:37Speaker 2: has been up there a little bit too, that highly ranked,
- 19:39Speaker 2: but basically it's been GW and Morgantown most all of
- 19:43Speaker 2: the year, and they battled tonight up at GW. It's
- 19:46Speaker 2: a regular season game and they play tonight at six o'clock.
- 19:51Speaker 2: And in fact, Dave Wilson is going to do that
- 19:53Speaker 2: game on waj RS. If you want to go on
- 19:55Speaker 2: to their app and listen to that game. Then turn
- 19:59Speaker 2: it over to our game after that. Invite you to
- 20:02Speaker 2: do that, because that'll be two good games in the
- 20:04Speaker 2: Charleston area that you can hear tonight, nine twenty seven
- 20:08Speaker 2: on five and Live with Dave Allen, Jeff Jenkins and
- 20:10Speaker 2: for Dave Today Metro News talk Line coming up at
- 20:12Speaker 2: ten oh six live from the State Capitol, and let's go,
- 20:16Speaker 2: as someone would say, to the belly of the Beast
- 20:19Speaker 2: right now. And here is Brad McIlhaney, our Metro News
- 20:22Speaker 2: state Wide correspondent, alive and well after crossover day. Good morning, Brad.
- 20:29Speaker 11: Oh hi, Yes, I have checked my spirit internally and
- 20:33Speaker 11: I unfunctional. I truly am. If the belly of the
- 20:36Speaker 11: Beach is defined as the basement, that's where I am.
- 20:39Speaker 11: Talk Line is setting up upstairs, and you know, crossover
- 20:46Speaker 11: day can be, as you know from experience, can be
- 20:50Speaker 11: kind of draining, and there have been years, you know,
- 20:53Speaker 11: when it's going well into the evening. It wasn't quite
- 20:56Speaker 11: like that yesterday, but it was fairly rapid fire. And
- 21:00Speaker 11: often the day after crossover Day it can feel like
- 21:04Speaker 11: literally or not, everybody's hung over and it has been
- 21:09Speaker 11: a little bit of a slow and to they start.
- 21:12Speaker 2: To the day, Yeah, because you kind of regroup because
- 21:15Speaker 2: you've had these long floor sessions. The sentence, the floor
- 21:18Speaker 2: session really wasn't that long, but the houses was longer.
- 21:20Speaker 2: I think, wrapping up maybe a little bit after four o'clock,
- 21:23Speaker 2: and you pass a ton of these bills, and then
- 21:26Speaker 2: it just procedurally, it takes time to get to the
- 21:28Speaker 2: other side and everything and now the committees. So now
- 21:32Speaker 2: focus goes back at least for a couple of days
- 21:34Speaker 2: to the committees. And as the committees start getting bills
- 21:38Speaker 2: from the other side down to the floor to deal with,
- 21:41Speaker 2: so kind of you shift back to committee. So we'll
- 21:43Speaker 2: see a lot of committee work today and tomorrow probably,
- 21:46Speaker 2: and then you start getting a lot more floor work
- 21:48Speaker 2: next week. That's usually how it like, Right for the
- 21:51Speaker 2: last five or six days, you get bills back to
- 21:54Speaker 2: the floor and you start talking about bills on the
- 21:56Speaker 2: floor again.
- 21:58Speaker 11: Well, I mean, I'm always kind of as by the
- 22:01Speaker 11: logic of the process, honestly, because the House focuses for
- 22:05Speaker 11: all this time one House bills, and the Senate focuses
- 22:07Speaker 11: all this time one Senate bills, and then crossover day
- 22:10Speaker 11: happens and there's almost no time to consider the legislation
- 22:15Speaker 11: that the other chambers work so long and hard on.
- 22:20Speaker 11: I mean, it almost makes more sense to do like
- 22:22Speaker 11: a day thirty customer day. Ye have more time with
- 22:25Speaker 11: the other chambers bills because you know, I mean, we
- 22:29Speaker 11: follow these things in each chamber and you but then
- 22:33Speaker 11: they cross and you begin listening to the other committees
- 22:36Speaker 11: and they're like, what was the House thinking? Why did
- 22:38Speaker 11: they do this? Yeah, and you want to stand up
- 22:40Speaker 11: and say, oh, I know, I know, but you know
- 22:44Speaker 11: you're not allowed to do that. The other thing that's
- 22:45Speaker 11: going to happen now that you and I and others
- 22:48Speaker 11: will really be work watching is there was some budget
- 22:52Speaker 11: action that went pretty early and you know, we all thought, wow,
- 22:56Speaker 11: this is really running earlier than we've ever seen. And
- 23:00Speaker 11: then that talk kind of went on hiatus as we
- 23:02Speaker 11: reached this crossover day deadline for other bills to make
- 23:07Speaker 11: it through. But I think you're going to see that
- 23:09Speaker 11: kick back up again. There was, you know, some talk
- 23:13Speaker 11: of a while they really went so early to try
- 23:17Speaker 11: to maybe head off line item vetos from the governor.
- 23:20Speaker 11: I think the governor wants the budgets in his hands.
- 23:23Speaker 11: He's got like five days to do line item vetos.
- 23:27Speaker 11: If if the House and the Senate went unusually early
- 23:32Speaker 11: to pass that, then they would potentially have a you know,
- 23:36Speaker 11: some leeway to override those kinds of line item veto's.
- 23:40Speaker 11: The other thing we don't know that we're going to
- 23:42Speaker 11: watch is that, you know, there seems to be a
- 23:44Speaker 11: real difference of opinion about the governor's tax cut. He
- 23:47Speaker 11: built in the five percent once the ten percent. The
- 23:51Speaker 11: House passed its budget with nothing, no tax cut at all.
- 23:56Speaker 11: The Senate did ten percent. And so where do they
- 23:59Speaker 11: wind up? Is it in the middle, is it all?
- 24:01Speaker 11: Is it nothing?
- 24:03Speaker 10: Yeah?
- 24:03Speaker 2: We were hoping, We thought right that it was going
- 24:06Speaker 2: to be on the House Finance Committee agenda this morning,
- 24:08Speaker 2: and did not make it on the agenda.
- 24:12Speaker 11: Yeah, And I have trouble reading into that. I mean,
- 24:16Speaker 11: the House Finance Chairman Vernon Chris was really specific. Two
- 24:20Speaker 11: or three days ago that committee brought up what had
- 24:23Speaker 11: been the Senate tax cut bill. Again, the Senate passed
- 24:28Speaker 11: a ten percent personal income tax cut, somewhat offset that's
- 24:33Speaker 11: about two hundred and fifty million dollars in state revenue,
- 24:36Speaker 11: so somewhat offset by an increase in the vake tax,
- 24:39Speaker 11: which equates to like twenty two million. The Senate or
- 24:43Speaker 11: the House process is to bring up a bill and
- 24:45Speaker 11: discuss it, review it, think about it one day, and
- 24:49Speaker 11: then pass it a different day. So the House Finance
- 24:51Speaker 11: Chairman Vernon Chris said a couple of days ago, well
- 24:56Speaker 11: he specified Thursday, we will explore a bill again amended.
- 25:04Speaker 11: I mean that was a key word in what he said, amended,
- 25:06Speaker 11: and pass it Thursday. And here we are and that
- 25:10Speaker 11: bill is not on the House Finance agenda, but that
- 25:14Speaker 11: meeting is occurring right now.
- 25:15Speaker 2: Yeah, Brad mic whenny's with US Metro New Statewide correspondent
- 25:18Speaker 2: Jeff Jenkins in for Dave Allen here on five eighty
- 25:21Speaker 2: Live is nine thirty two. Ryan Nicholson is my producer
- 25:24Speaker 2: this morning. And you know, Brad, that's that's gonna be
- 25:28Speaker 2: key now. Then I guess you know, they can meet
- 25:29Speaker 2: this afternoon. It could pop up. That's just this you know,
- 25:32Speaker 2: this time of year as a reporter, and that's the
- 25:36Speaker 2: public too. You just got to watch these agendas. You gotta,
- 25:39Speaker 2: you know, you got to watch and and it's a
- 25:42Speaker 2: I tell people, it's a it's kind of an acquired taste,
- 25:44Speaker 2: right because so a lot of the you might have
- 25:47Speaker 2: a bill that pat would probably several bills that passed
- 25:50Speaker 2: yesterday and in one form or another in the House
- 25:53Speaker 2: of Delegates. If if a Senate committee decides at some
- 25:58Speaker 2: point the chair of the commit he decides to put
- 26:00Speaker 2: it on the agenda, and not all sometimes they don't
- 26:03Speaker 2: make it on an agenda, but if they do decide
- 26:05Speaker 2: to put on the agenda, then they might have a
- 26:08Speaker 2: committee substitute where they may change.
- 26:11Speaker 1: The whole thing.
- 26:12Speaker 12: You know.
- 26:12Speaker 2: So it's uh, just got just got to really watch this,
- 26:16Speaker 2: you know, this time of year to see, you know,
- 26:17Speaker 2: kind of how things pan out.
- 26:20Speaker 11: Well, we've learned that, you know, again the hard way.
- 26:22Speaker 11: All year long. There was a controversy of Hope Scholarship bill,
- 26:26Speaker 11: people may remember, that made all kinds of reforms to
- 26:29Speaker 11: that scholarship for people who are educating their kids outside
- 26:33Speaker 11: the public school system, and the homeschool families were very
- 26:37Speaker 11: upset about it. That bill appeared on the House Finance
- 26:40Speaker 11: agenda day after day after day for about a week
- 26:44Speaker 11: without being acted on, and so you know, you just
- 26:47Speaker 11: kind of showed up and hovered and then nothing happened.
- 26:50Speaker 11: In contrast, you know, there's this tax bill that we
- 26:55Speaker 11: thought was going to be on the agenda, and then
- 26:57Speaker 11: it wasn't. The tax build did go onto the House
- 27:02Speaker 11: Finance agenda earlier this week. I've lost track of the
- 27:05Speaker 11: entire week. Maybe a Monday, we had maybe an hour's notice,
- 27:09Speaker 11: and it was only really through the kind of careful
- 27:13Speaker 11: coming through agendas that you just described that any of
- 27:16Speaker 11: us even knew that was going to happen. And then
- 27:19Speaker 11: you know, another example is Rayley's Law, which is a
- 27:25Speaker 11: recurring and heartfelt I don't want to say controversial, but
- 27:31Speaker 11: it's a bill that would put a pause on transfers
- 27:37Speaker 11: from public school to homeschooling if there is an active
- 27:41Speaker 11: CPS investigation. That bill comes up the year after year,
- 27:46Speaker 11: and it made a last second push onto the House
- 27:49Speaker 11: Education Budget again I think maybe Monday, and you know,
- 27:54Speaker 11: we didn't know until maybe an hour beforehand. So it
- 27:58Speaker 11: really does pay to watch those agendas because who knows
- 28:01Speaker 11: what's going to happen.
- 28:02Speaker 2: Okay, here's one bill to watch, and we'll just we'll
- 28:04Speaker 2: talk about this just for a second and I'll let
- 28:06Speaker 2: you go. Is that they talked about it again yesterday
- 28:10Speaker 2: actually after the House floor session, and it hasn't passed
- 28:16Speaker 2: or anything yet. This is a bill that passed the Senate.
- 28:18Speaker 2: The House Education Committee has it now. This is this
- 28:22Speaker 2: bill that would be permissive. It would allow county school
- 28:24Speaker 2: districts to go away from days of instruction which are
- 28:29Speaker 2: now one hundred and eighty days of instruction, to hours
- 28:33Speaker 2: of instruction. And there seems to be brad there seems
- 28:37Speaker 2: to be some interest from like all stakeholders at least
- 28:40Speaker 2: a little bit of interest in this.
- 28:43Speaker 11: Yeah. I think so, you know, I think it's possible.
- 28:46Speaker 11: But the House will change that bill, which makes it
- 28:49Speaker 11: a little tricky here in the final days of the
- 28:51Speaker 11: legislative session. But that House Education Committee talked about that
- 28:56Speaker 11: bill for about an hour two days ago, and then
- 29:00Speaker 11: they had maybe three expert witnesses, people you know, with
- 29:05Speaker 11: expertise and what really works in terms of school scheduling
- 29:09Speaker 11: yesterday afternoon. That was kind of an ambitious thing to do.
- 29:12Speaker 11: I personally didn't have the capacity for it, but it
- 29:16Speaker 11: shows me that the committee is interested in getting under
- 29:19Speaker 11: the hood and trying to figure out what truly would
- 29:22Speaker 11: work best. I would get in credit for due and
- 29:24Speaker 11: due diligence because I think they really are trying to
- 29:27Speaker 11: figure that out. The bill as it came over, was
- 29:30Speaker 11: like nine hundred hours versus you know, whatever number of days.
- 29:38Speaker 11: There's been some question about, well, is nine hundred hours
- 29:41Speaker 11: really the equivalent of one hundred and eighty or is
- 29:45Speaker 11: it selling you know, those education hours short. So I
- 29:48Speaker 11: wouldn't be surprised to see a different set of numbers
- 29:53Speaker 11: or something else come out of that. But you know,
- 29:56Speaker 11: it's an interesting argument, and it's I think one that
- 29:59Speaker 11: partly resonates with the public in this year of just
- 30:02Speaker 11: so many school calculations because of weather.
- 30:05Speaker 2: All right, Brad, we appreciate it. We'll let you get
- 30:07Speaker 2: back at it. We're talking a little bit.

- 34:01Speaker 2: let's go have another guess coming in with Aubrey Sparks.
- 34:05Speaker 2: She's a legal legal director with a CLU West Virginia
- 34:10Speaker 2: and she's one of those busy at the capitol running
- 34:12Speaker 2: back and forth. You did okay with crossover day.
- 34:17Speaker 12: Yeah, I mean, I'll admit I'm not the person at
- 34:19Speaker 12: the ACLU who follows the legislative session most closely, but
- 34:22Speaker 12: it definitely keeps everyone on their toes. I mean, it
- 34:25Speaker 12: is a time where it feels like there's just news
- 34:28Speaker 12: coming out all the time about what passes and doesn't pass.
- 34:31Speaker 2: Exactly exactly what you're We've we've seen a couple of
- 34:34Speaker 2: things last couple of days, some ice protests. I know,
- 34:37Speaker 2: there was a one of an organized protests in downtown
- 34:39Speaker 2: last night. We saw some Capital High students they were
- 34:43Speaker 2: protesting out in front of the Capitol. Tell me what's
- 34:45Speaker 2: going on with that right now?
- 34:48Speaker 17: Yeah?
- 34:48Speaker 12: Well, I think that there are a lot of concerns
- 34:52Speaker 12: generally about whether you know, government agencies broadly and here
- 34:57Speaker 12: specifically in West Virginia are following the law. I know
- 35:00Speaker 12: that there's a lot of situations where they are, but
- 35:02Speaker 12: I think that some of the court filings that we've seen,
- 35:05Speaker 12: the orders that judges have issued here in West Virginia
- 35:07Speaker 12: have shown that there's a lot of times that they aren't.
- 35:11Speaker 12: And when we sort of depend on the rule of law,
- 35:14Speaker 12: that can be really intimidating, you know, And I think
- 35:17Speaker 12: that it makes people upset and it means that there's
- 35:20Speaker 12: something that has to be done about it.
- 35:22Speaker 2: Aubry, you're one, obviously, you're the legal director of ACLU
- 35:25Speaker 2: West Virginia, and you follow these these legal issues, and
- 35:29Speaker 2: Brad mcilhaney's reported on several of these judges orders, their filings,
- 35:35Speaker 2: these federal judges I'm talking about in West Virginia, several
- 35:37Speaker 2: federal judges about some of these folks that were picked
- 35:40Speaker 2: up in kind of the January sweep where ice and
- 35:44Speaker 2: they got help from local authorities on those tell me
- 35:47Speaker 2: just generally what you find interesting. What have you found
- 35:50Speaker 2: interesting about some of those comments the judges have made.
- 35:54Speaker 12: Yeah, well, I think the first thing is it's easy
- 35:56Speaker 12: to sort of see that and just assume like, oh, well,
- 35:59Speaker 12: be just must be liberal judges. You know, or these
- 36:01Speaker 12: are judges who are sort of predisposed to have this position,
- 36:04Speaker 12: but that's really not the case. It's been bipartisan judges
- 36:07Speaker 12: appointed by an already of different you know, executives have
- 36:12Speaker 12: come out with these orders. It hasn't just been one.
- 36:14Speaker 12: I can't remember the exact number of how many it's
- 36:16Speaker 12: been now, but I think maybe four of our federal
- 36:19Speaker 12: court judges have issued sort of similar orders on these issues.
- 36:23Speaker 12: And the real key thing is that these judges are
- 36:26Speaker 12: saying over and over again that people are entitled to
- 36:28Speaker 12: due process and we need to make sure we protect
- 36:31Speaker 12: that because if someone can get picked up and carted
- 36:34Speaker 12: off to a facility and they don't have an opportunity
- 36:37Speaker 12: to make a case as to why they shouldn't be there, well,
- 36:40Speaker 12: there's nothing saying that that couldn't happen to anyone, you know.
- 36:44Speaker 12: The only thing that keeps us from being unlawfully detained
- 36:46Speaker 12: is the idea that we have a due process right
- 36:48Speaker 12: to make the cases to why we shouldn't be And
- 36:51Speaker 12: the judges are looking at the way that this is
- 36:53Speaker 12: being handled and saying, well, these people are being denied
- 36:55Speaker 12: that basic due process right. And that's not just unfair
- 36:58Speaker 12: to them. It's dangerous to everyone, and it's dangerous to
- 37:01Speaker 12: a democratic system.
- 37:02Speaker 2: Okay, going that a little bit, more about do process.
- 37:05Speaker 2: What are you talking about specifically there?
- 37:08Speaker 12: Yeah, so let's say, and this is sort of a
- 37:11Speaker 12: I don't know, I don't want to say a far
- 37:13Speaker 12: reaching example, but to put it in perspective, if I'm
- 37:16Speaker 12: just on the street and I get picked up by
- 37:18Speaker 12: ICE and they say, well, you're not a US citizen
- 37:21Speaker 12: and I don't have my passport on me right, and
- 37:23Speaker 12: they take me to South Central and then they take
- 37:27Speaker 12: me into an ICE detention facility. If I don't have
- 37:29Speaker 12: a chance to talk to a lawyer, if I don't
- 37:31Speaker 12: have a chance to call my family, if I don't
- 37:32Speaker 12: have a chance to go in front of a judge,
- 37:34Speaker 12: well then I'm detained. And it doesn't matter whether I'm
- 37:37Speaker 12: a US citizen or not. I haven't had the opportunity
- 37:39Speaker 12: to say whether or not I am. I haven't had
- 37:41Speaker 12: the opportunity to gather those PaperWorks to show that I am.
- 37:45Speaker 12: And that gets even more complicated when we talk about
- 37:48Speaker 12: people who are in the immigration process, because there's plenty
- 37:51Speaker 12: of people who might not have legal documentation, but who
- 37:54Speaker 12: are in the process of getting it. So, for example,
- 37:56Speaker 12: someone who came here seeking asylum, they could have done
- 38:00Speaker 12: everything right and still get picked up in that way.
- 38:03Speaker 12: And right now it's really hard because people get moved
- 38:06Speaker 12: between different detention facilities so quickly that their lawyers can't
- 38:09Speaker 12: find them. You know, I know everyone has heard about
- 38:12Speaker 12: like the horrifying stories of the conditions and these facilities,
- 38:15Speaker 12: and especially in West Virginia where our jail system was
- 38:19Speaker 12: already so overburdened. We've had all of these problems with
- 38:23Speaker 12: overcrowding in our regional jails and now we're doubling up
- 38:26Speaker 12: on that with ice detaining. That just makes a bad
- 38:28Speaker 12: situation worse. And so if someone doesn't have the due
- 38:31Speaker 12: process ability to explain why they shouldn't be there, well
- 38:35Speaker 12: that's just fundamentally both unfair and should really give concern
- 38:40Speaker 12: as to, you know, whether people have like a real
- 38:44Speaker 12: opportunity to make their rights into a reality.
- 38:48Speaker 2: Abby sparks with this legal director of ACLU West Virginia
- 38:52Speaker 2: here on five at You Live, Jeff Jenkins and for
- 38:54Speaker 2: Dave Allen today it's nine point forty six. So what
- 38:56Speaker 2: do you think is going to be the response we've
- 38:59Speaker 2: had a couple of these judges rulings we've had, you know,
- 39:02Speaker 2: the status change for some of these folks that have
- 39:04Speaker 2: been picked up. Do you think that there's going to
- 39:07Speaker 2: be a change here? What do you think is going
- 39:09Speaker 2: to be the result?
- 39:11Speaker 12: You know, I can say what I hope for, which
- 39:13Speaker 12: is that I hope there will be a change, but
- 39:16Speaker 12: it's it's really hard to tell. I don't necessarily know
- 39:19Speaker 12: where we go from here. And so one of the
- 39:21Speaker 12: things that the ACOU has just rolled out is on
- 39:24Speaker 12: our website, which is ahouwz dot org, is an opportunity
- 39:29Speaker 12: for people who have information about things that are going
- 39:33Speaker 12: right or things that are going wrong, if they'd like
- 39:35Speaker 12: to share that information with us a portal where they
- 39:38Speaker 12: can do that through and they can either submit with
- 39:41Speaker 12: their name attached if they would like to seek legal
- 39:44Speaker 12: advice about their rights as a whistleblower or about you know,
- 39:47Speaker 12: any other concern that they may have, but it can
- 39:50Speaker 12: also be submitted entirely anonymously. And part of the reason
- 39:53Speaker 12: why we wanted to make that an option is because,
- 39:55Speaker 12: of course, we hope that there is no waste, fraud, abuse,
- 39:58Speaker 12: illegality going on. If that was the case, and nothing
- 40:01Speaker 12: bad was happening, then we wouldn't get anyone telling us anything,
- 40:04Speaker 12: and that would be a perfect world, right, But oftentimes
- 40:07Speaker 12: when things go wrong, people are there to see it.
- 40:10Speaker 18: Right.
- 40:11Speaker 12: All it takes is one person to say, Hey, I
- 40:14Speaker 12: just saw something happen and it's not how I was
- 40:16Speaker 12: trained for how it was supposed to go, or I
- 40:18Speaker 12: was just asked to, you know, say that this form
- 40:22Speaker 12: was efficient when I know it's not, Or hey, you know,
- 40:26Speaker 12: I was present and I saw this thing happen. I'm
- 40:28Speaker 12: really uncomfortable with. And if people have questions about what
- 40:32Speaker 12: their rights are in those situations, you know we would
- 40:35Speaker 12: either be happy to answer those questions or put them
- 40:37Speaker 12: in touch with other lawyers who can answer those questions,
- 40:41Speaker 12: because you know, there's the saying like one bad apple
- 40:43Speaker 12: ruins the whole bunch. And what we need is for
- 40:46Speaker 12: the people who see are seeing these things happen to say, hey,
- 40:49Speaker 12: I want a system that works. I want a system
- 40:52Speaker 12: that follows the rules, and so I'm going to play
- 40:55Speaker 12: my role in making sure that happens.
- 40:57Speaker 2: Sparks is with ACOU West Virginia, the league director. Now,
- 41:01Speaker 2: I know you guys have people on the ground at
- 41:03Speaker 2: the Capitol to follow the bills. But I'm sure you're
- 41:05Speaker 2: familiar with the camping band bill that passed yesterday. The
- 41:09Speaker 2: organization did put out a release on that. What are
- 41:11Speaker 2: your concerns about the camping band bill that pass that
- 41:14Speaker 2: has passed the House.
- 41:16Speaker 12: Well, I think that there's a few concerns. We've got
- 41:19Speaker 12: moral concerns and policy concerns and legal concerns, and they
- 41:22Speaker 12: all come together for us to think that it is
- 41:24Speaker 12: not a very good bill. You know, we can't just
- 41:29Speaker 12: criminalize our way out of poverty. We can't tell someone
- 41:32Speaker 12: you'll be guilty of a crime if you don't, you know,
- 41:35Speaker 12: get yourself out of this situation, because many people who
- 41:37Speaker 12: are in that situation don't want to be and if
- 41:40Speaker 12: they have the resources to not be in that situation,
- 41:42Speaker 12: they would be in that situation. I think that so
- 41:46Speaker 12: many people across the country, but especially in West Virginia,
- 41:49Speaker 12: understands very closely to their own lives. A huge swath
- 41:53Speaker 12: of people are living paycheck to paycheck right and if
- 41:56Speaker 12: you ask people in West Virginia what happens if you
- 41:58Speaker 12: miss to paychecks paychecks, a lot of people would say,
- 42:02Speaker 12: I don't know what happens I don't know how it'd
- 42:04Speaker 12: be able to get through that, And so I think
- 42:06Speaker 12: it's important for us to remember the vast majority of
- 42:08Speaker 12: people are closer to homelessness than we are to some
- 42:11Speaker 12: sort of extreme wealth, you know. And so it's one
- 42:14Speaker 12: of those situations where you just think, well, like, but
- 42:18Speaker 12: for the grace of God, there go I you know,
- 42:20Speaker 12: like it could happen to anyone. And I think to
- 42:22Speaker 12: a certain extent, the cruelty of not acknowledging that is
- 42:26Speaker 12: part of the point, you know, we have to distance
- 42:28Speaker 12: ourselves from it and act like those are different people
- 42:31Speaker 12: who are doing something bad and deserve to be punished
- 42:33Speaker 12: for it, when really, you know, it could be any
- 42:36Speaker 12: of us, and well, we shouldn't necessarily have to root
- 42:38Speaker 12: it in our own experience to make us care about
- 42:41Speaker 12: that situation. I think it's an important framing for us
- 42:44Speaker 12: to keep in mind.
- 42:45Speaker 2: Okay, and it's a house build that's past the house
- 42:47Speaker 2: now on to the Senate. So I'm sure you're working
- 42:49Speaker 2: on that other side to see what they do with it.
- 42:53Speaker 12: Yeah, we're definitely. We're definitely curious to see what happens.
- 42:56Speaker 12: It's one that we're following closely, and like I said,
- 42:58Speaker 12: you know, a number of concerns, and I think that
- 43:02Speaker 12: as we see what that final finding version would look like,
- 43:05Speaker 12: if it does pass well, we'll probably you know, have
- 43:10Speaker 12: even more concerns. Hopefully not, maybe it gets better.
- 43:13Speaker 3: We'll see.
- 43:14Speaker 12: I guess.
- 43:14Speaker 2: Okay, Aubrey, Well, I know you're busy. I appreciate a
- 43:16Speaker 2: couple of minutes. Thank you, well, thank you very much. Okay,

- 46:18Speaker 2: Today dave plans to be back. Tomorrow let's go up
- 46:20Speaker 2: to The Stay capitol now Where Metro News talk live
- 46:24Speaker 2: or originate live here in just about twelve minutes or.
- 46:27Speaker 2: So Dave wilson AND. Tj, meadows, GUYS i HEAR i
- 46:31Speaker 2: hear the roar or is that just the mingling whatever
- 46:35Speaker 2: it is there in the upper rotunda ready to go
- 46:37Speaker 2: on the day after crossover day and kind of see
- 46:39Speaker 2: where these bills end up landing in about nine.
- 46:42Speaker 21: Days it's a subdued roar, Today. Jeff everybody's kind, of you,
- 46:47Speaker 21: know cleaning up after crossover day. Yesterday and the big
- 46:51Speaker 21: question here we are hearing, rumblings, tremors murmurs if you will, that,
- 46:56Speaker 21: uh there could be some movement on the budget. Today
- 47:00Speaker 21: we may even have a final budget that comes out
- 47:02Speaker 21: of The house And senate.
- 47:03Speaker 10: TODAY.
- 47:04Speaker 22: Tj, SO i think that's right because it comes down
- 47:06Speaker 22: to The governor's line item, veto and it comes down
- 47:09Speaker 22: to the, legislature specifically The house having the ability to
- 47:13Speaker 22: go back in and override anything in that line item
- 47:16Speaker 22: veto that they don't, Like so it becomes about budget AND.
- 47:19Speaker 22: Dave once that budget is, locked you may or may
- 47:21Speaker 22: not be able to get much more in if costs.
- 47:23Speaker 21: Money so that could be the big story of the day, Here.
- 47:26Speaker 21: Jeff House Speaker Roger hanshaw is going to join us
- 47:28Speaker 21: coming up about ten thirty this. Morning we'll talk to
- 47:32Speaker 21: him About crossover day And Team West. Virginia that is
- 47:35Speaker 21: the kind of the crown jewel of this leg slave
- 47:38Speaker 21: session got out of The. House we'll see how it'll
- 47:40Speaker 21: fare over in The.
- 47:40Speaker 2: Senate you, guys that would be a, record is you,
- 47:44Speaker 2: know if they passed the. Budget, yeah if they passed the,
- 47:46Speaker 2: budget because now this this particular you, know if you
- 47:50Speaker 2: can go back eight or ten, years you, know this
- 47:53Speaker 2: kind of group of lawmakers in the last decade or
- 47:55Speaker 2: so have done a good job of getting the budget
- 47:57Speaker 2: done by the final. NIGHT i, mean there were years
- 47:59Speaker 2: THAT i covered the legislature and others that cover the
- 48:01Speaker 2: legislature that about this time or sometime during the last,
- 48:05Speaker 2: week there would be a proclamation that would extend the
- 48:08Speaker 2: session for three days to work on the. Budget that
- 48:10Speaker 2: was always a. Given you know they were going to
- 48:12Speaker 2: see what eventually, passed and then they were going to
- 48:15Speaker 2: work on the budget for the last three days and
- 48:17Speaker 2: then lawmakers would come back a week later The, sunday
- 48:20Speaker 2: after The sunday when the session, ended and then they
- 48:23Speaker 2: would pass a. Budget but this particular group of, lawmakers,
- 48:27Speaker 2: Again i'll say in the last decade or, so they've
- 48:28Speaker 2: done a good job of completing it before the session.
- 48:31Speaker 2: End but to get it and to get it signed
- 48:34Speaker 2: and lineed item vetoed before the session, ends that would
- 48:37Speaker 2: be a. Record but then lawmakers lose loose if they
- 48:40Speaker 2: want to overturn. Anything, obviously they lose their leverage after
- 48:44Speaker 2: the session is. Over so they if they want to
- 48:46Speaker 2: try to overturn the line out in, veto as you,
- 48:48Speaker 2: mentioned they got to get it into him his five
- 48:50Speaker 2: day clock would start and then they would get it
- 48:52Speaker 2: back before the regular session is.
- 48:54Speaker 21: Over and we've talked about that a couple of different
- 48:56Speaker 21: times throughout this SESSION tj And jeff THAT i think
- 48:59Speaker 21: that's part of the, motivation maybe even the majority of
- 49:02Speaker 21: the motivation to get that thing done early in case
- 49:04Speaker 21: the governor uses that authority that you can come back
- 49:07Speaker 21: in and override.
- 49:08Speaker 1: Them Before siney die Next.
- 49:09Speaker 22: Saturday power they've always, had but power they've never really. Exercised,
- 49:13Speaker 22: jeff to your, point be interesting to, see you, Know
- 49:15Speaker 22: Arch moore was a master if you go back to
- 49:19Speaker 22: only giving the legislature what they needed to get it
- 49:22Speaker 22: done by that sixty day. Mark if this happens and
- 49:25Speaker 22: the governor's line At veto gets, overright be interesting to
- 49:27Speaker 22: see if maybe he takes a page out of the
- 49:29Speaker 22: More Book mexico around and kind of drags his feet
- 49:31Speaker 22: a little bit.
- 49:31Speaker 21: Too and as one delegate pointed out to us this, Morning,
- 49:34Speaker 21: jeff it's the only reason we're.
- 49:36Speaker 1: Here all the rest of it's just.
- 49:37Speaker 5: Fluff.
- 49:37Speaker 1: Anyway that's the, budget.
- 49:38Speaker 2: Yep that's their one constitutional duty is they have to
- 49:42Speaker 2: have a balanced. Budget that is very, true very. True,
- 49:45Speaker 2: Okay so we've got A handshaw coming up in a
- 49:47Speaker 2: couple of longmakers too on talk.
- 49:48Speaker 21: Line, Right, Yeah Senator Brian helton AND tj are going
- 49:51Speaker 21: to arm wrestle to the show. Today we might get
- 49:56Speaker 21: an octagon later put them. In we're going to talk
- 49:58Speaker 21: About Senate bill four twenty that came out that requires
- 50:01Speaker 21: coal firepower plants to run at sixty nine percent capacity
- 50:04Speaker 21: all the. Time talk To Brian helton about That brattill
- 50:06Speaker 21: stop BY i mean nicely is going to join, Us.
- 50:09Speaker 21: Jeff there were some foster care bills that came out
- 50:12Speaker 21: of The. Senate there was a childcare bill that came
- 50:14Speaker 21: out of The house yesterday that's been years in the.
- 50:17Speaker 21: Making she's going to get us caught up on, those
- 50:20Speaker 21: and we'll try to work in a text or.
- 50:21Speaker 5: Two we might Get Tom.
- 50:22Speaker 21: Susman he's actually over here broadcasting from our friends AT.
