What an Investigation Into Darren Indyke and Richard Kahn Might Look Like (Part 1) (9/25/26) · The Vault: The Epstein Files

• 0:00
Speaker 1: What's up everyone and welcome to another episode of the
• 0:03
Speaker 1: Epstein Chronicles. Yesterday we were talking about Darren Indyke and
• 0:08
Speaker 1: Richard Kahn and the investigation that has allegedly been launched
• 0:12
Speaker 1: against them by the SDNY. And while we still don't
• 0:15
Speaker 1: have any confirmation that the investigation is underway, I've spoken
• 0:19
Speaker 1: with multiple sources and all of them say that there
• 0:23
Speaker 1: is an investigation. And according to them, a lot of
• 0:25
Speaker 1: this investigation has to do with shell companies and dark money.
• 0:30
Speaker 1: So today, we're going to talk a little bit about
• 0:32
Speaker 1: what that investigation, if the investigation actually kicks off, might
• 0:36
Speaker 1: look like. Because if federal investigators are now digging into
• 0:41
Speaker 1: Epstein's shell companies and the financial structures and the movement
• 0:45
Speaker 1: of money through a sprawling network of entities, then Darren
• 0:48
Speaker 1: Indyk and Richard Kahn are right in the middle of
• 0:50
Speaker 1: all of it. They're right in the middle of that
• 0:53
Speaker 1: financial map investigators would have to reconstruct. Indyk was Epstein's
• 0:57
Speaker 1: longtime attorney. while Kahn served as his accountant and financial administrator,
• 1:03
Speaker 1: giving both men access to parts of Epstein's financial machinery
• 1:06
Speaker 1: that few outsiders could have understood. Now, the government of
• 1:10
Speaker 1: the Virgin Islands previously alleged that Indyke was a signatory
• 1:14
Speaker 1: on Southern Trust Company's primary bank account and authorized a
• 1:18
Speaker 1: majority of its outgoing wire transfers. The same complaint alleged
• 1:22
Speaker 1: that Kahn, Southern Trust's treasurer, oversaw accounting, invoicing, and tax
• 1:27
Speaker 1: reporting for the company. Those allegations were never equivalent to
• 1:32
Speaker 1: criminal convictions, and neither man has been criminally convicted for
• 1:36
Speaker 1: participating in Epstein's crimes, but from an investigative standpoint, their
• 1:41
Speaker 1: positions would make them essential witnesses, document custodians, and potential
• 1:45
Speaker 1: subjects in any serious examination of where Epstein's money came
• 1:49
Speaker 1: from and where it went. I don't think I'm letting
• 1:52
Speaker 1: you folks in on any secret when I tell you
• 1:54
Speaker 1: that Indykin Khan and occupied positions from which money was documented, authorized, transferred,
• 2:01
Speaker 1: accounted for, and eventually administered after Epstein died. A genuine
• 2:06
Speaker 1: forensic investigation would therefore begin by reconstructing exactly what they knew,
• 2:11
Speaker 1: exactly what they controlled, and exactly what passed across their desks. Now,
• 2:17
Speaker 1: the first step would be considerably less glamorous than people
• 2:20
Speaker 1: imagine when they hear the words financial investigation. Investigators would
• 2:24
Speaker 1: begin by obtaining bank records, corporate records, tax returns, general ledgers, invoices, contracts,
• 2:31
Speaker 1: wire instructions, canceled checks, credit card statements, and correspondence covering
• 2:36
Speaker 1: years of Epstein's activities. Every Epstein-controlled company would be treated
• 2:41
Speaker 1: as a separate financial organism before investigators attempted to understand
• 2:45
Speaker 1: how the organisms interacted. Accounts belonging to Southern Trust Company
• 2:50
Speaker 1: would be compared with accounts that belonged to Epstein personally.
• 2:54
Speaker 1: and with accounts belonging to the dozens of corporations, limited
• 2:58
Speaker 1: liability companies, foundations, and trusts surrounding them. Investigators would identify
• 3:05
Speaker 1: every account number, authorized signer, beneficial owner, corporate officer, and
• 3:09
Speaker 1: individual with online inquiry access. They would then build a
• 3:14
Speaker 1: transaction database containing every incoming and outgoing movement of money
• 3:18
Speaker 1: that could be obtained, a transfer that appeared meaningless by itself,
• 3:23
Speaker 1: might become important when placed beside another transfer occurring hours
• 3:26
Speaker 1: later from a different company. Money moving from company A
• 3:30
Speaker 1: to company B and then immediately to Epstein personally would
• 3:34
Speaker 1: be treated differently from an ordinary operating expense supported by
• 3:38
Speaker 1: legitimate invoices and business records. The objective would be to
• 3:42
Speaker 1: strip away the corporate names and reveal the human beings
• 3:46
Speaker 1: actually directing the transactions. Now, once that happens, titles like attorney, accountant, director, treasurer,
• 3:52
Speaker 1: and authorized signatory become enormously important because investigators can begin
• 3:57
Speaker 1: connecting individual decisions to specific movements of money. And the
• 4:03
Speaker 1: Southern Trust Company would almost certainly command extraordinary attention because
• 4:07
Speaker 1: existing litigation already identified it as one of the most
• 4:10
Speaker 1: significant financial vehicles in Epstein's later years. The Virgin Islands
• 4:16
Speaker 1: alleged that the Southern Trust Company reported roughly $ 184 million
• 4:19
Speaker 1: in revenue between 2013 and 2017, and that approximately $ 158
• 4:27
Speaker 1: million came from a single source or related entities. The
• 4:31
Speaker 1: government further alleged that this money became a major source
• 4:34
Speaker 1: of funding for Epstein's broader operation. Those assertions were made
• 4:39
Speaker 1: in civil litigation and should not be confused with findings
• 4:42
Speaker 1: that Indyk or Kahn committed a criminal offense. But investigators
• 4:47
Speaker 1: examining Epstein's finances would immediately want to know why such
• 4:51
Speaker 1: enormous sums entered a company described as providing sophisticated, financial,
• 4:56
Speaker 1: and data-related services. They'd demand the contracts supporting those payments.
• 5:02
Speaker 1: They'd examine invoices to determine what work was supposedly performed,
• 5:06
Speaker 1: who performed it, when it was performed, and whether contemporaneous
• 5:10
Speaker 1: records demonstrated that the work actually existed. They'd compare claim
• 5:14
Speaker 1: services against employee records, payroll, computer systems, office expenses, and
• 5:20
Speaker 1: other evidence showing whether Southern Trust possessed the operational capacity
• 5:24
Speaker 1: to perform what its invoices said it performed. They would
• 5:28
Speaker 1: also examine whether payments corresponded with legitimate service or whether
• 5:32
Speaker 1: the company served additional purposes beyond those represented in formal paperwork.
• 5:38
Speaker 1: And because Indyk and Kahn occupied important positions in Southern
• 5:42
Speaker 1: Trust banking, accounting, and tax operations, investigators would want explanations
• 5:48
Speaker 1: from both men for the mechanics of that company. And
• 5:52
Speaker 1: that's where the forensic accountant begins to do something that
• 5:55
Speaker 1: ordinary accounting does not. A normal accountant asks whether books balance,
• 6:01
Speaker 1: expenses were categorized properly and taxes were calculated according to
• 6:05
Speaker 1: the available information. A forensic accountant asks why the transaction
• 6:10
Speaker 1: occurred in the first place. Investigators would take every significant
• 6:14
Speaker 1: Southern Trust payment and trace it forward until the money
• 6:18
Speaker 1: reached its ultimate destination. If Southern Trust transferred $ 500, 000 to
• 6:23
Speaker 1: another Epstein entity, investigators would not stop at the second company.
• 6:27
Speaker 1: They would follow the money out of the account as well.
• 6:31
Speaker 1: If part of it paid aircraft expenses, another portion paid
• 6:34
Speaker 1: a credit card, and another portion entered Epstein's personal account,
• 6:38
Speaker 1: each branch would be documented. If money passed through three
• 6:41
Speaker 1: or four entities before reaching its destination, Investigators would ask
• 6:46
Speaker 1: what legitimate business purpose required those intermediate steps. They would
• 6:51
Speaker 1: look for circular transactions in which money left one Epstein entity,
• 6:55
Speaker 1: traveled through others, and eventually returned to an account controlled
• 6:59
Speaker 1: by Epstein. They would also identify instances where corporate money
• 7:03
Speaker 1: consistently paid personal expenses because that pattern can reveal whether
• 7:08
Speaker 1: supposed business were functioning independently or merely acting as financial conduits.
• 7:14
Speaker 1: and the shell companies would receive precisely the same treatment.
• 7:18
Speaker 1: The Virgin Islands allege that Indyke and Kahn themselves were
• 7:21
Speaker 1: paid through multiple entities, naming HBRK Associates and COATUE Co2
• 7:29
Speaker 1: Enterprises in connection with Kahn and Birch Tree, BR Harlequin Dane,
• 7:34
Speaker 1: and Darren K. Indyke PLLC in connection with Indyke. The
• 7:38
Speaker 1: complaint characterized several of those entities as shells that received
• 7:42
Speaker 1: the transmitted money with Epstein's network. Again, that characterization was
• 7:47
Speaker 1: an allegation by the territorial government, not a criminal adjudication.
• 7:52
Speaker 1: But a Kern investigator would ask whether each company had employees,
• 7:56
Speaker 1: independent clients, physical offices, legitimate business expenses, and revenue unrelated
• 8:02
Speaker 1: to Epstein. They would examine contracts describing services provided to
• 8:07
Speaker 1: Epstein and determine whether those services were actually performed. They
• 8:11
Speaker 1: would compare compensation with contemporaneous email, calendars, work product, and
• 8:16
Speaker 1: tax records. If an entity existed primarily to move money
• 8:20
Speaker 1: between members of Epstein's organization, investigators would want to understand
• 8:25
Speaker 1: why that structure was chosen and who designed it. The
• 8:29
Speaker 1: corporate formation records would become another major point of the
• 8:33
Speaker 1: investigation because shell company cases are often solved by reconstructing
• 8:37
Speaker 1: who created what and when. Investigators would assemble certificates of incorporation,
• 8:44
Speaker 1: operation agreements, annual reports, resolutions, ownership records, and registered agent
• 8:49
Speaker 1: files for every Epstein-related entity they could identify. They would
• 8:55
Speaker 1: create a timeline showing when each entity appeared and what
• 8:59
Speaker 1: financial event followed its creation. A company formed shortly before
• 9:03
Speaker 1: receiving millions of dollars would receive particular scrutiny. So would
• 9:08
Speaker 1: an entity that remained largely dormant until a specific transaction occurred,
• 9:12
Speaker 1: and then became inactive again. Investigators would determine who requested
• 9:17
Speaker 1: the company's formation, who communicated with the corporate service provider,
• 9:22
Speaker 1: and who approved its banking arrangements. Signatures would be compared
• 9:26
Speaker 1: across documents to establish who exercised actual control, rather than
• 9:31
Speaker 1: merely appearing on paper. Email traffic surrounding formation could reveal
• 9:36
Speaker 1: the stated reason for creating a particular company. Draft Documents
• 9:41
Speaker 1: could be even more revealing, because earlier versions sometimes describe
• 9:45
Speaker 1: purposes more candidly than final paperwork does. By the end
• 9:50
Speaker 1: of that process, investigators could transform Epstein's confusing collection of
• 9:55
Speaker 1: corporate names into a chronological diagram showing who established each view.
• 10:00
Speaker 1: and what happened to money after it entered. Now, the
• 10:04
Speaker 1: investigation would also move backward instead of simply forward. Investigators
• 10:10
Speaker 1: would identify every major source that deposited money into Epstein-controlled
• 10:14
Speaker 1: accounts and determine what those payments represented. That means examining
• 10:20
Speaker 1: advisory fees, investment proceeds, asset sales, loans, gifts, transfers from
• 10:26
Speaker 1: wealthy clients, and payments for financial or estate planning services.
• 10:32
Speaker 1: The extraordinary payment associated publicly with Leon Black, for example,
• 10:36
Speaker 1: would be examined in the context of the services Southern
• 10:39
Speaker 1: Trust said it was providing, because surviving documents describe financial
• 10:44
Speaker 1: estate planning and structuring work. The question would not automatically
• 10:49
Speaker 1: be whether a payer did anything illegal. The question would
• 10:52
Speaker 1: be whether the payments were accurately documented, properly reported, supported
• 10:57
Speaker 1: by real services, and subsequently handled in accordance with the law.
• 11:02
Speaker 1: Investigators would interview people who paid Epstein large sums of
• 11:06
Speaker 1: money and ask them what they believed that they were buying.
• 11:10
Speaker 1: Those answers would then be compared with contracts, invoices, and
• 11:13
Speaker 1: internal communications. Any meaningful discrepancy between what the payer believed
• 11:18
Speaker 1: was happening and what Epstein's internal record said was happening
• 11:22
Speaker 1: would become another investigative lead. That's how a financial investigation
• 11:27
Speaker 1: gradually turns mountains of paperwork into a coherent account of
• 11:31
Speaker 1: how an enterprise actually functioned. Tax records would constitute another
• 11:37
Speaker 1: massive piece of the puzzle. Investigators would compare corporate tax
• 11:41
Speaker 1: returns against bank deposits to determine whether reported revenue corresponded
• 11:46
Speaker 1: with money actually received. They would examine deductions to determine
• 11:51
Speaker 1: what expenses were claimed and whether supporting documentation existed. They
• 11:56
Speaker 1: would review transfers between Epstein-controlled businesses for tax treatment and
• 12:01
Speaker 1: determine whether transactions were characterized consistently across the entities. Southern
• 12:06
Speaker 1: Trust would again loom large because Epstein benefited substantially from
• 12:11
Speaker 1: Virgin Island tax incentives connected to that company. The Virgin
• 12:15
Speaker 1: Islands alleged that Southern Trust received tens of millions of
• 12:18
Speaker 1: dollars in tax benefits during the relevant period. Investigators would
• 12:23
Speaker 1: therefore want to understand precisely what representations were made to
• 12:28
Speaker 1: territorial authorities regarding the company's activities, staffing, income, and eligibility.
• 12:34
Speaker 1: They'd compare those representations with what employees, accountants, computers, and
• 12:39
Speaker 1: financial records showed was actually happening. If the representations match reality,
• 12:45
Speaker 1: that would be important evidence in one direction. If investigators
• 12:49
Speaker 1: discovered material discrepancies, those discrepancies could become significant depending upon
• 12:54
Speaker 1: who prepared, reviewed, approved, or knowingly relied upon the underlying information.
• 13:00
Speaker 1: And control would be especially important during that part of
• 13:03
Speaker 1: the inquiry because accounting creates a paper trail that is
• 13:06
Speaker 1: supposed to explain money after it moves. Investigators would want
• 13:10
Speaker 1: every general ledger he maintained or supervised. They would obtain
• 13:15
Speaker 1: journal entries, adjusting entries, invoices, tax work papers, spreadsheets, and
• 13:20
Speaker 1: communications with outside accountants. They would examine how payments were
• 13:24
Speaker 1: characterized and whether descriptions changed over time. A transfer labeled
• 13:29
Speaker 1: consulting expense in one record but shareholder distribution in another
• 13:34
Speaker 1: would immediately require an explanation. So would expenses recorded by
• 13:38
Speaker 1: one Epstein company despite apparently benefiting another company or Epstein personally.
• 13:44
Speaker 1: Investigators would identify who supplied Kahn with information used to
• 13:48
Speaker 1: prepare records and who had authority to change those records.
• 13:52
Speaker 1: They would determine whether unusual transactions generated questions from accountants and,
• 13:57
Speaker 1: if so, how those questions were answered. They would examine
• 14:01
Speaker 1: whether supporting documents were produced contemporaneously or created later to
• 14:06
Speaker 1: explain transactions after scrutiny arose. In a financial investigation involving
• 14:11
Speaker 1: a labyrinth of closely related companies, The person overseeing accounting
• 14:16
Speaker 1: becomes central because accounting is where the story told about
• 14:20
Speaker 1: the money is formally recorded. Alright folks, we're going to
• 14:24
Speaker 1: wrap up episode 1 right here, and in the next episode,
• 14:27
Speaker 1: we're going to pick up where we left off. All
• 14:29
Speaker 1: the information that goes with this episode can be found
• 14:32
Speaker 1: in the description box.
