- 0:00Speaker 1: What's up, everyone, and welcome to another episode of the
- 0:02Epstein Chronicles. In this episode, we're picking up where we
- 0:06left off with a toven O Well interview with Congress.
- 0:12Question okay, thank you. And on July thirtieth, a staff
- 0:15psychologist from the Psychological Department sent an email to over
- 0:19seventy staff BOP staff stating that Epstein quote needs to
- 0:23be housed with an appropriate cell mate. Did you receive
- 0:26that email? Answer? I never saw that email? Question okay?
- 0:31Were you aware of it existing? Answer after the fact?
- 0:34Question okay? And how did you find out about the email?
- 0:38Answer when I was questioned? Question okay, so no one
- 0:41mentioned it to you before? Answer no question okay. Do
- 0:45you recall ever being aware of the fact that Epstein
- 0:47needed to have a cell mate? Answer no, question okay.
- 0:51And email says an appropriate cellmate. Do you have any
- 0:54understanding of what an appropriate cell mate would have been
- 0:57in this instance? Answer no, because Warden has to make
- 1:00that call. Question okay. And so it's our understanding that
- 1:04on July thirtieth, when he came back to the Shoe,
- 1:07Epstein was assigned an inmate named Dephyan Reyes as a
- 1:10cell mate, and that Reys remained a cell mate until
- 1:13August ninth. Is that your understanding? Answer? Correct question? Okay.
- 1:18And on August eighth, Epstein met with his attorneys and
- 1:21changed his last will and testament? Did you have any
- 1:23knowledge that he had done that at the time? Answer
- 1:26after the fact, at the time, no question, You learned
- 1:29after he died? Answer correct question. Okay, You didn't hear
- 1:34anyone else mention it or anything days leading up to it?
- 1:37Answer no question, okay. And then the OIG also reported
- 1:41that Epstein's Daly routine was to meet with his attorneys
- 1:44in the conference room. You mentioned that as well. Are
- 1:47you aware of that? Was that happening on August eighth?
- 1:50Was that his schedule? Answer? Yeah, question okay, mister Foy,
- 1:55you said August eighth redacted, Yes, when he signed out
- 1:59his last will and testament? Noel, Yes question, and you
- 2:03were working that day? Answer August eighth, yes, question okay,
- 2:07that's all from me. Question. We're going to go if
- 2:10we can. I think one of the members present has
- 2:12a few questions you'd like to ask, So we're gonna
- 2:15go down there. Mister Submaranium, thank you. I apologize I
- 2:19have to leave a little early, but thank you for
- 2:21being here. I appreciate you coming voluntarily and answering these questions.
- 2:26You said something earlier about you not received any sort
- 2:29of compensation for anything related to Jeffrey Epstein and no
- 2:33one Noel, correct question. Does that apply to anyone that
- 2:37you know, any friends, relatives? Noel, anything in regards to
- 2:42mister Epstein. I've never received any money, mister Submaranian. And
- 2:46what were those bank account payments for, for instance, the
- 2:50five thousand dollars one, Noel, my savings, my personal savings Submaranium.
- 2:56So do you you were shifting money from one account
- 2:58to another? Well, no, I do savings challenges for myself, Summaranium.
- 3:03Oh I see, so you were going you were sending
- 3:05money to a savings account Noel, No, not sending like
- 3:10I save. I do savings challenge books. Somemerannium, okay, Noel.
- 3:15And when I get to my goal, I deposit my
- 3:17money Somemeranium. Oh so you were saving it personally and
- 3:21then you deposited the money all at once? Was it
- 3:25a cash deposit? Noel, yes, Somemerannium, okay, thank you. And
- 3:30then do you have any reason to believe that Jeffrey
- 3:32Epstein did not commit suicide, Noel, no somemaranium or died
- 3:37in any other way, Noel, No question, because you had
- 3:41mentioned that you didn't actually see him hanging, Noel, correct
- 3:44question in a previous interview. But you strongly believe that
- 3:48there's no other You've ruled out any other sort of death, Noel, Right,
- 3:52because there was no one else in there, somemaranium. Great.
- 3:55And then you did an interview with the DOJ in
- 3:57twenty twenty one, you said That'll Loud placed Jeffrey Epstein
- 4:01in the shower to make a twenty minute personal, un
- 4:04monitored phone call to his girlfriend in Belarus. Is that correct, Noel.
- 4:09I don't know who he made the phone call to,
- 4:11but I know he was placed in there to make
- 4:12a phone call, not by a lieutenant by Bullock, a
- 4:15counselor unit counselor question, unit counselor. Yeah, you mentioned that earlier.
- 4:20You also told investigators that Epstein was the only person
- 4:23to be allowed to have a long cord for his
- 4:26sleep apnea machine. Noel, correct question. Could you tell me
- 4:31more about that? Why was he able to get a
- 4:33sleep apnea machine? Answer? So that would have had to
- 4:36been authorized by like psychologists or the warden. But he
- 4:40was the only one in the shoe that has a
- 4:42seapap machine. And the way how the tears are like,
- 4:45they're up and down, so he was on the upper
- 4:48So the seapap is in the cell and there's a
- 4:50long cord that has to extend out of the cell
- 4:53to reach down because he's up to meet an outlet Summeranian. Okay,
- 4:59would he have been able to he haanked that cord out, Noel, absolutely, question.
- 5:04This would have been the warden that would have cleared this,
- 5:07Noel or the psychologist. I don't know who makes the
- 5:09decision to allow him to have a seapat machine or
- 5:12who gave it to him. Question. And then this is
- 5:16a long time ago, so it may be hard to remember.
- 5:18But when you were walking through and when you saw
- 5:21his cell, did you notice any extra bed linens that
- 5:24may have been in the cell? Noel? No After Summeranian
- 5:28afterwards you notice that. Do you know why he was
- 5:31given extra bed linens? Noel, So I'm not aware of
- 5:35him having extra bed linen. He had linen on his
- 5:38bed and Reyes had linen on his bed. Question. Okay, yeah,
- 5:42there was some reporting that he had extra bed linen, Noel,
- 5:45I'm not aware of that. Question. Is it common for
- 5:49someone in the shoe to have extra bed linens? Noel?
- 5:52No question. Was there anything else as far as Jeffrey
- 5:55Epstein's treatment that you would consider like special treatment that
- 5:59was unique from other people people who were there? Noel,
- 6:02I don't know who allowed him to have his medication
- 6:04that's not supposed to be submaranium by medication. Which medication
- 6:09are you talking about? Answer? I don't know which, But
- 6:13he had a bunch of medication in his cell. In
- 6:15the shoe, A nurse comes and administers medication to other inmates.
- 6:20I don't know who allowed him to have his own
- 6:22personal medication. Question. And then one of the files in
- 6:26the FBI's library of Epstein files includes an account that
- 6:29alleges Epstein met with a guard with the first name James,
- 6:33only days before Epstein was found dead. Do you know
- 6:35who James is, Noel, James. Question. Yeah, there was a
- 6:40file that said that someone named James met with Epstein
- 6:43a few days before. Are you aware of this meeting
- 6:45at all? Noel? No question. Okay, is there anyone named
- 6:50James that you work with? Noel, not that I know.
- 6:53Of question. Okay. And then there was also a report
- 6:56that detailed an interview between the FBI and an un
- 7:00named inmate at the jail. In the report, the inmate
- 7:02shares that he overheard you after Epstein was found dead,
- 7:05saying that, I quote, if Epstein's dead, we're gonna cover
- 7:09it up and he's going to have an alibi. My officers,
- 7:12do you know anything about this? And what was the
- 7:15officer you? Noel, no question? And did you say that
- 7:19at any point? Okay, thank you. And then so inmates
- 7:23at the Metropolitan Correctional Center evidence found to have reportedly
- 7:27said quote miss Noel killed Jeffrey Epstein unquote after they
- 7:31found out about Epstein died. Do you know of any
- 7:35inmates saying that Noel, no question? And do you know
- 7:38why they would say that, Noel, no question? And then
- 7:42I guess I would just also ask generally, if in hindsight,
- 7:44looking back at everything that happened, do you have any
- 7:47regrets about anything that happened, as far as not checking
- 7:50on him, knowing who he was now and the damage
- 7:53he caused and the damage his death caused. Foy hold
- 7:57on one second, they go off the record, then they
- 7:59come back some rannium. Would you like me to repeat
- 8:02the question? Noel, no question. Yeah, looking back at everything
- 8:07that's happened, do you have any regrets or maybe even
- 8:10remorse about what transpired as far as your actions or
- 8:13the actions of the mcc Noel, So, I would have
- 8:17liked to have conducted the counts and rounds, understanding that
- 8:20if they were done, that suicide could still have taken place.
- 8:23My only regret is that I worked for MCC, a
- 8:26poorly ran institution. Question follow up, one thing here? You
- 8:30said that even if you had done the counts and rounds,
- 8:33the suicide could have still occurred. Noel, correct question. Okay,
- 8:37that's all my questions redacted. All right, I have a
- 8:41few more questions. We're going to try to walk through
- 8:43the timeline of August ninth and tenth, just kind of
- 8:46one step at a time. Answer, okay. Question. One thing
- 8:50I think we wanted to try to clarify before we
- 8:52even kick that off is inmate movements in and out
- 8:55of the shoe. I think that's caused some confusion in
- 8:59terms of what exact numbers on which exact count slip,
- 9:03and what was the right number. So I'm going to
- 9:05introduce an exhibit, which I'll mark as minority Exhibit A redacted.
- 9:10I'll give you a moment to look it over. Question.
- 9:13I know I gave you the longest one page document
- 9:15in the history of documents. I appreciate you looking it over.
- 9:19I know there's a lot there. The documents called Count
- 9:21Discrepancies on August ninth, twenty nineteen. It was part of
- 9:25the DJ release. We don't know exactly what it is.
- 9:29We think probably it's written by the OIG when they
- 9:32were first trying to figure things out, but we don't
- 9:34know that for a fact. But it does says at
- 9:36the top that it's based on the Daily Activity Report
- 9:39and Lieutenant log from August ninth and tenth. First, do
- 9:43you have any understanding of what a daily Activity report is? Answer?
- 9:48No question. Okay, how about a lieutenant's log? Answer no question. Okay.
- 9:54This document has inmate movements for the shoe on the
- 9:57ninth and tenth, and it's got specific times on it.
- 10:00We think that those times are probably linked to the
- 10:02Century system. Are you familiar with that Century system? Answer yes?
- 10:07Question what is that? Answer? The Century system is the
- 10:10system that has the accurate number of inmates in the institution.
- 10:14That's all I know. Question did you ever know or
- 10:17do you remember whether the century system would be used
- 10:20to log inmate movements? Answer? I don't know what they
- 10:24used to log it? Question okay. Would you have had
- 10:27any knowledge of whether inmate movements are logged at the
- 10:30exact time of movement happens or maybe a few moments
- 10:34after something happens. Answer yeah, I don't know when they
- 10:37log it. Question okay. So I'm going to walk through
- 10:40a few of these individual inmates. I know it was
- 10:42a long time ago. I'll just ask the best of
- 10:44your recollection. It looks as if the day started with
- 10:47seventy seven inmates in the shoe. I guess it's also
- 10:50called ZA. Are you familiar with that? Answer? Yeah? Question okay?
- 10:55So ZA also means the shoe. Is that correct? Answer? Correct? Question? Great?
- 10:59And that eight in the morning inmate reys was pre
- 11:02removed out of the shoe and did not come back.
- 11:05And our understanding is that mister Epstein cellmate. Is that
- 11:08also your understanding? Answer? Correct question okay? And that would
- 11:13take the shoe number down to seventy six. This happened
- 11:16at eight thirty in the morning or eight thirty eight?
- 11:19You did not start work until four pm. I know that.
- 11:22But do you recall whether anybody mentioned to you that
- 11:25rays had been removed from the shoe? Answer? No, no one. Question,
- 11:29no one mentioned it to you? Answer? No question. And
- 11:33so did that leave you with the impression that mister
- 11:35Epstein still had a cell mate when you arrived? Answer
- 11:38when I first got there? Yeah. Question was there at
- 11:41some point in the day when you noticed that it
- 11:43did not look like he actually had a cell mate? Answer?
- 11:46After lock in? Question got it? And do you recall
- 11:49specifically one or how you would have noticed that? Answer?
- 11:54Even if an inmate is moved to somewhere, usually everybody
- 11:57will be back by the time of lock in, and
- 12:00at the time of lock in, there was not an
- 12:02inmate back other than Epstein. Question what time is lock in? Answer?
- 12:06I don't remember the exact time, to be honest. Question Ballpark,
- 12:10I won't hold you to it. It doesn't have to
- 12:11be exact. Answer. Well, in the shoe, they're always locked in.
- 12:15In the shoe, it's different. But I think in regular
- 12:18genual population nine pm maybe, But remember in the shoe
- 12:22they're not out unless you're orderlies. But by the time
- 12:26the count time if you're somewhere you would be back.
- 12:28So that's why Epstein has to come up before nine,
- 12:32because it's an institutional count. If that makes sense. Question
- 12:36it does? Would that be the ten pm count? Answer
- 12:39correct question? Okay, so sometime around ten pm, marker you
- 12:43recall noticing, Hey, everybody's locked in at this point, but
- 12:47there's nobody actually in mister Epstein's cell other than Epstein.
- 12:50Answer correct question. Okay. Do you recall whether you discuss
- 12:54the fact any other guards at the time. Answer no,
- 12:57I didn't. Question did you have any understanding at the
- 13:00time of whether mister Abstein was supposed to have a
- 13:03cell I understand you knew that Reyes was assigned to
- 13:06the cell, but whether there was some kind of policy
- 13:08that mister Abstein needed to always have a cell mate?
- 13:11Answer I was not aware. Question anybody ever mentioned that
- 13:16that you can recall? Answer no. All right, folks, we're
- 13:21gonna wrap up right here, and in the next episode
- 13:23dealing with the topic, we're gonna pick up where we
- 13:25left off. All the information that goes with this episode
- 13:28can be found in the description box.
