- Marcus: Welcome back to VoraPrep Audio. Emma, today I want to talk about something that feels foundational but can get tricky fast: the different levels of government. We see questions about federal, state, and local entities all the time. Why is it so critical to know the difference? Emma: It’s critical because in government financial management, everything flows from legal authority. You can't spend a dollar, create a program, or even sign a contract without the proper authority. And that authority comes from a completely different place depending on whether you're at the federal, state, or local level. Marcus: Okay, so it’s all about knowing where the power comes from. Let’s start at the top. The Federal Government. Where does its authority originate? Emma: The U.S. Constitution. Think of the Constitution as the ultimate job description for the federal government. It lists very specific, or 'enumerated,' powers in Article I, Section 8. Things like collecting taxes, raising an army, and regulating commerce. If it's not in that job description, the federal government generally can't do it. Marcus: And I remember from civics class that this power is split up. The 'separation of powers,' right? How does that work in practice? Emma: Exactly. The power is divided into three branches to create a system of checks and balances. First, you have the Legislative Branch, which is Congress. Their job is to make the laws and, crucially for us, control the money through appropriations. Marcus: So Congress holds the purse strings. Then who carries out the laws? Emma: That’s the Executive Branch, headed by the President. It includes all the federal agencies. Their role is to implement and enforce the laws that Congress passes. They're the ones managing the day-to-day operations and spending the money Congress appropriates. Marcus: And the third branch? Emma: The Judicial Branch—the courts. Their job is to interpret the laws and the Constitution itself, ensuring the other two branches are acting within their authority. Marcus: That makes sense. So for a federal financial manager, what are the big, unmissable rules they live by every day? Emma: The absolute cornerstone is the Anti-Deficiency Act. It's a federal law with a very simple, very strict rule: you cannot spend or obligate more money than Congress has given you in an appropriation. Marcus: What’s a good way to think about that? Emma: It’s like a debit card, not a credit card. Once the balance hits zero, you stop spending. There’s no borrowing against next year's allowance. The Anti-Deficiency Act is the legal framework that enforces that rule, with serious consequences for violations. Marcus: And what about the accounting standards? Who sets the rules for how the federal government keeps its books? Emma: That's the Federal Accounting Standards Advisory Board, or FASAB. They establish the specific accounting standards for all federal agencies. So, for federal, you need to connect it with FASAB. Marcus: Okay, U.S. Constitution, three branches, Anti-Deficiency Act, and FASAB. Got it. Now, how do State Governments fit in? Are they just smaller copies of the federal system? Emma: They are similar in structure, but their source of authority is different. The Tenth Amendment to the U.S. Constitution creates what are called 'reserved powers.' The idea is that any power not specifically given to the federal government, or prohibited to the states, is reserved for the states. Marcus: So if it's not in the federal government's 'job description,' the states can probably do it. Emma: That’s a great way to put it. Each state also has its own state constitution, which is its own internal 'job description,' defining its powers and structure. And yes, they typically mirror the federal system with a legislative, executive, and judicial branch. Marcus: And what about their financial role? I’ve heard the term 'pass-through entity' used with states. Emma: Correct. States often act as intermediaries. The federal government will grant a large sum of money to a state for a specific purpose, like transportation, and the state is then responsible for distributing, or 'passing through,' those funds to local governments that do the actual roadwork. Marcus: Okay, so a different source of power. Do they also have different accounting standards? Do they use FASAB? Emma: No, and this is a key distinction for the exam. State governments—and local governments, as we'll see—follow standards set by the Governmental Accounting Standards Board, or GASB. So, Federal is FASAB; State and Local are GASB. Marcus: That’s a critical point. Federal is FASAB, State and Local is GASB. Now let’s go to that third level: local governments. Cities, counties, school districts. Where do they get their power? Do they have their own constitutions, too? Emma: No, they don't. This is probably the most important distinction of all. Local governments are considered 'creatures of the state.' They have no inherent sovereignty. All of their power is granted to them by the state government. Marcus: So they can only do what the state says they can do? Emma: Exactly. Think of the state as the parent company and the local government as a franchise. The franchise agreement, which might be a city charter or state enabling legislation, spells out exactly what the franchise is allowed to do. It has no independent authority outside of that agreement. Marcus: Does the state always grant the same amount of power, or does it vary? Emma: It varies dramatically, and this is governed by two opposing legal principles. The first, and more traditional one, is called Dillon's Rule. Marcus: Dillon's Rule. What does that mean? Emma: Dillon's Rule is a very narrow interpretation of local authority. It says a local government has only three types of powers: those expressly granted by the state, those that are necessarily implied by that express grant, and those absolutely essential to its purpose. Marcus: Give me an analogy for that. Emma: It’s like getting a permission slip from your parents. If the slip says you can go to the movies, you can go to the movies. It doesn't mean you can also go out for dinner afterwards. If it's not written down, the answer is no. It’s very restrictive. Marcus: That sounds limiting. Is there an alternative? Emma: Yes. The opposite concept is called Home Rule. Many states have granted 'home rule' authority to their local governments, especially larger cities. Marcus: And how is Home Rule different? Emma: Home Rule flips the presumption. Instead of asking 'Am I allowed to do this?', a home-rule city can do anything that isn't *banned* by state law or its charter. It provides much more flexibility and autonomy to manage local affairs. It’s less of a permission slip and more of a set of general house rules. Marcus: So, Dillon's Rule is "you can only do what's on the list," and Home Rule is "you can do anything that's *not* forbidden." Emma: Precisely. And just to close the loop, for accounting standards, local governments follow GASB, just like state governments. Marcus: This Dillon's Rule versus Home Rule distinction feels like a perfect exam trap. Can we walk through a scenario? Emma: Absolutely. Let's say a small town is in a state that strictly follows Dillon's Rule. The town wants to pass a new, complex zoning ordinance, but the power to do so isn't explicitly mentioned in its charter or any state law. Can they do it? Marcus: My gut says no. Under Dillon's Rule, if it’s not written down, they can't do it. Their authority is narrowly interpreted. Emma: You're exactly right. The action would likely be challenged in court and struck down as *ultra vires*, a legal term meaning 'beyond the powers.' They don't have the authority. If they were in a Home Rule state, however, they'd likely be able to proceed as long as no state law forbade it. Marcus: Great. Let's try one more, this time on the federal side. Imagine a CFO at a federal agency. They're reviewing a new contract that, if signed, would push their total obligations over their appropriation for the year. What specific law should immediately come to their mind? Emma: That is a direct bullseye for the Anti-Deficiency Act. That's the statute that explicitly prohibits federal officials from obligating or spending more than their appropriated funds. Not GASB, not another act—the ADA is the hard stop for a federal manager in that situation. Marcus: Okay, I can see the key distinctions now, but I can also see how they could blur together under exam pressure. What's the most common pitfall for candidates on this topic? Emma: There are two main traps. First, confusing the source of authority, especially remembering that local governments have *no* inherent power and are 'creatures of the state.' Second is mixing up the accounting standards: FASAB for federal, GASB for state and local. Marcus: So what’s a simple way to keep it all straight? A quick mental checklist. Emma: Here’s how I frame it. Federal: power from the Constitution, accounting by FASAB, and spending is policed by the Anti-Deficiency Act. State: power reserved by the 10th Amendment, accounting by GASB. Local: power granted by the state, accounting also by GASB. And for local power, just remember the two extremes: strict Dillon's Rule or flexible Home Rule. Marcus: That's a fantastic summary. For our listeners who want to drill this with more practice questions and really lock it in, this is just one piece of a much larger body of knowledge. Emma: Exactly.
