Transcript
- 0:01Speaker 1: All right, Sandra Fox, need's alert now and a judge
- 0:03Speaker 1: declaring a mistrial in the case against the man accused
- 0:06Speaker 1: of starting the last year's deadly Palisades fire. Jurors unable
- 0:10Speaker 1: to reach a unanimous verdict. Our senior national correspondent William
- 0:13Speaker 1: Lejenes has been watching the trial. He joins US now
- 0:16Speaker 1: from Los Angeles. Hi, William, Hey, good morning, John.
- 0:18Speaker 2: Yeah, kind of a big surprise, although last night we
- 0:21Speaker 2: kind of got some indications, but you're right. A mistrial
- 0:23Speaker 2: this morning declared in the case against the man accused
- 0:25Speaker 2: of setting the most expensive fire in US history. Ten
- 0:28Speaker 2: jurors said they would vote against conviction or not guilty.
- 0:32Speaker 2: Two others would not go along on any of the
- 0:35Speaker 2: three charges, arson, destruction of property, and lighting a timber fire.
- 0:39Speaker 2: US Attorney Bill A. Sale has already said he will
- 0:41Speaker 2: retry the case. Moments ago, two of our producers in
- 0:44Speaker 2: court say, defendant Jonathan rinderkanesh wipe back tears. A second
- 0:48Speaker 2: jur also cried, what is next. He's been a custody
- 0:52Speaker 2: for about nine months, so we expected detention here later
- 0:54Speaker 2: today where the judge will decide as he remain in
- 0:57Speaker 2: jail or be released. Probably with some condition. So how
- 1:00Speaker 2: do we get here? I want to read a note
- 1:03Speaker 2: that the jury sent to the judge last night. We
- 1:06Speaker 2: might have that quote. We have people on both sides
- 1:10Speaker 2: that are dead set, unwavering. We are at a standstill.
- 1:13Speaker 2: We are unsure how to proceed. There is nothing the
- 1:16Speaker 2: court can do to assist the jury and their deliberations.
- 1:19Speaker 2: Additional instructions or rereading the testimony would not help deliberations. Unfortunately,
- 1:24Speaker 2: we cannot reach a unanimous verdict. So those watching this
- 1:28Speaker 2: case not a real surprise. We have such different versions
- 1:32Speaker 2: of events that happened John, it's hard to see any
- 1:35Speaker 2: middle ground here. The prosecutor said the fire was intentionally set.
- 1:39Speaker 2: Cell Phone and video evidence put Jonathan Vinder Kanesh at
- 1:42Speaker 2: the edition point of this fire thirteen seconds after it started.
- 1:46Speaker 2: Uber passengers at night said he acted erratically, searches on
- 1:49Speaker 2: his phone show, he hated rich people, he loves fire,
- 1:52Speaker 2: he wanted revenge, He acted defensively in the police interview. Now,
- 1:57Speaker 2: how does a jury reconcile that? With the defense version
- 2:00Speaker 2: that prosecutors had no physical evidence, no accelerant, no witnesses,
- 2:04Speaker 2: and if he was guilty, why would he call nine
- 2:07Speaker 2: one one sixteen times, then wait around for cops to
- 2:11Speaker 2: question him. Makes no sense. Also, the vin said the
- 2:13Speaker 2: fireworks started the fire witnesses. They had witnesses to support that.
- 2:17Speaker 2: Bottom line is job at this point in time, we
- 2:21Speaker 2: the brother and the father were in court. We expect
- 2:24Speaker 2: the father to speak as well as a dire defense
- 2:26Speaker 2: attorney later today.
- 2:27Speaker 1: Back to you, all right, apparently now we're hearing from
- 2:29Speaker 1: some of the jurors outside of the courthouse, so let's
- 2:31Speaker 1: go live that.
- 2:32Speaker 2: Listen, then maybe they'll give us some ideas.
- 2:33Speaker 3: Was then really just too holding out the entire time
- 2:36Speaker 3: we were like kind of going back and forth, and
- 2:37Speaker 3: it was like undecided and decided. Maybe like four of
- 2:41Speaker 3: us were like set on the not guilty, and then
- 2:44Speaker 3: they were all undecided, and then there's it just happened
- 2:47Speaker 3: that one person was not gonna budge from the guilties.
- 2:51Speaker 3: And then someone this morning said, I go on that
- 2:53Speaker 3: side too.
- 2:54Speaker 4: When they figure out that everybody was set.
- 2:56Speaker 3: In there, I mean probably yesterday for the most part,
- 3:00Speaker 3: but there were still like two that were undecided. Has
- 3:04Speaker 3: said that they're gonna retry the case if the evidence
- 3:06Speaker 3: is there.
- 3:07Speaker 4: What are your thoughts having sat in this journey sex.
- 3:10Speaker 3: It makes me sad as an American like that, you know,
- 3:13Speaker 3: we couldn't come to a conclusion. And I mean, honestly
- 3:15Speaker 3: wish I could come back and do it, you know,
- 3:18Speaker 3: because I wish we could have came to a conclusion.
- 3:22Speaker 4: What was the division when you were first or maybe
- 3:24Speaker 4: sometimes well, there wasn't any division. Honestly, we all got
- 3:28Speaker 4: along so well division as far as years. Oh, it's
- 3:35Speaker 4: definitely started out. The majority was always like not.
- 3:38Speaker 3: Guilty and seventy five yeah, like probably seven and then
- 3:44Speaker 3: like three undecided too guilty.
- 3:47Speaker 4: And then we talked and talked, and when.
- 3:49Speaker 3: We realized it was like someone wasn't gonna budge, we
- 3:52Speaker 3: were like, what are we doing here?
- 3:54Speaker 4: I'm gonna go nuts.
- 3:58Speaker 1: Yesterday before you send it, announced that they're going to
- 4:01Speaker 1: re trying and excuse me if this was already asked.
- 4:03Speaker 2: It's hard to hear your thoughts on the federal government
- 4:06Speaker 2: doing this all over again.
- 4:08Speaker 3: I'm trying not to be angry, but I was like, I,
- 4:11Speaker 3: I mean, I guess they have to to get to
- 4:14Speaker 3: I don't know, to conclude this case, but I think
- 4:17Speaker 3: it's such a waste of our American dollars.
- 4:22Speaker 4: Yesterday in the middle of the afternoon, jeers.
- 4:24Speaker 5: Left the church or a room at one point before.
- 4:26Speaker 4: The mail this passed back and tell us what was
- 4:28Speaker 4: happening there was after lunch, Oh, I said it was
- 4:32Speaker 4: a mistake. Our four person like just clicked the wrong thing.
- 4:36Speaker 4: Left the jury room to go downstairs.
- 4:38Speaker 2: It's like people were certain of the day.
- 4:41Speaker 4: This was before the new It was me, I needed
- 4:44Speaker 4: to stretch my legs, and.
- 4:45Speaker 3: They said we had to take a break if we
- 4:47Speaker 3: want to, and we want to do that, everybody has
- 4:49Speaker 3: to take a break.
- 4:49Speaker 4: It was it was that was just me wanting to
- 4:51Speaker 4: get out of the room. Some people who have been
- 4:56Speaker 4: figuring anything. Brianna was not on the She's.
- 4:59Speaker 6: Like, but I was an alternate. My name is Brianna.
- 5:02Speaker 6: So unfortunately I couldn't deliberate. But you know, I wish
- 5:06Speaker 6: I had the opportunity just to hear everyone's opinions.
- 5:09Speaker 3: But you know, yeah, Serena, did you have.
- 5:15Speaker 4: A chance to speak with the attorneys? Did you tell
- 5:17Speaker 4: anything to the prosecutors. I know they were so interested
- 5:20Speaker 4: in hearing from from all of them.
- 5:21Speaker 3: Apparently only I guess when it's like final, will they
- 5:24Speaker 3: do that?
- 5:25Speaker 4: Because they told us we were going to do that.
- 5:26Speaker 3: But that's because we made a mistake and like they
- 5:29Speaker 3: thought we came to a conclusion.
- 5:31Speaker 4: No really, no, that's not the sense anyone's signed me.
- 5:37Speaker 4: Why they picked up the fire or no, the fire?
- 5:42Speaker 4: What was that anyone saying that the fire? No, no one.
- 5:48Speaker 4: We had people in there who worked.
- 5:50Speaker 3: Like not in the fire, but was a delivery driver
- 5:53Speaker 3: who knows the area.
- 5:54Speaker 4: Most everybody's local.
- 5:56Speaker 3: I came from Long Polk, California, and so I've been
- 5:59Speaker 3: here in a hotel all this time. But yeah, no one,
- 6:03Speaker 3: no one. There was really no bias on.
- 6:08Speaker 2: The fire to think about.
- 6:12Speaker 3: I just feel like such negligence, Like honestly, I hate
- 6:17Speaker 3: saying that because I'm not you know, it didn't happen
- 6:20Speaker 3: to me. But there were so many, so many people
- 6:24Speaker 3: up there that said they did see smoldering, So why
- 6:27Speaker 3: wasn't it taken care of? It was put out and
- 6:30Speaker 3: no one was there. I think the photo was like
- 6:33Speaker 3: six am. Nobody was there. People were hiking and it
- 6:37Speaker 3: wasn't until the huge palisades happened and you guys were.
- 6:40Speaker 2: Going to it.
- 6:41Speaker 5: That was like a stras specially, a lot of things
- 6:45Speaker 5: were not maybe necessarily excluded, but the way that was
- 6:49Speaker 5: presented was very misleading.
- 6:51Speaker 3: I didn't realize that that camera was like still shots.
- 6:54Speaker 3: I thought it was a video. So that really like
- 6:57Speaker 3: changed my decision because how can you when you gaps
- 7:00Speaker 3: of time know what happened in between that time is impossible.
- 7:04Speaker 2: Because you're not How old are you?
- 7:07Speaker 4: Well?
- 7:07Speaker 3: How old do you think You're not supposed to ask
- 7:09Speaker 3: lady that.
- 7:11Speaker 4: I'm going to be fifty in next just in July?
- 7:14Speaker 4: So could he spill Serena place?
- 7:16Speaker 1: Yes?
- 7:17Speaker 4: S y r e Na And do you want to
- 7:19Speaker 4: share your last week? I don't, Okay, Rianna? Do you
- 7:22Speaker 4: feel what sharing?
- 7:24Speaker 3: How?
- 7:24Speaker 4: I mean you to all of the arguments back.
- 7:27Speaker 3: In more thing at the passion deliberating how they feel
- 7:31Speaker 3: about how they would have lunch.
- 7:32Speaker 6: Yeah, I think I agree with Serena here that you know,
- 7:36Speaker 6: I don't think he was. I would have leaned not
- 7:38Speaker 6: guilty as well.
- 7:40Speaker 4: I think a.
- 7:41Speaker 6: Lot of the witnesses that the defense brought really helped
- 7:44Speaker 6: suade me. They brought in their own experts who didn't
- 7:46Speaker 6: agree with the government's experts. Having not secured a scene
- 7:53Speaker 6: for almost two weeks.
- 7:55Speaker 4: Says a lot.
- 7:56Speaker 6: And to pin that on one person, you know, at
- 7:59Speaker 6: the end of the day, we're all human. I realize
- 8:01Speaker 6: mistakes are made, but this is a man's life and
- 8:05Speaker 6: we can't ignore that fact either.
- 8:08Speaker 4: Your person.
- 8:09Speaker 5: Yeah, b R, I A N A.
- 8:13Speaker 6: I'm from Long Beach, California.
- 8:19Speaker 3: Yeah, thank you, So you're welcome. I mean, we did
- 8:32Speaker 3: it not get along, but I thought we'd be sharing
- 8:35Speaker 3: more numbers. But I think it got a little eating
- 8:37Speaker 3: at the end that we were like.
- 8:39Speaker 4: I was surprised the one person didn't want to come
- 8:41Speaker 4: out here. I was like, I'll go because I feel
- 8:44Speaker 4: a certain way. But you you're so certain to feel
- 8:46Speaker 4: a certain way. Where are you? Oh? Yeah, hilarious.
