Latest / The Jon and Marc Podcast / How a $6M Bellwether Verdict Changes the Social Media Addiction Landscape
Transcript
- 0:00We have late breaking news. It is now Thursday morning.
- 0:03We recorded tour talk on Monday morning and we usually drop it
- 0:07on Thursday because we have a little bit of editing to do.
- 0:10But this is. Such breaking.
- 0:12News that we wanted to make sure that we got it to you this week
- 0:15as quick as we possibly can late yesterday afternoon in Los.
- 0:18Angeles. The Lanier Law Firm social media
- 0:21victims. Law Center.
- 0:22Got a verdict back in the social media addiction trial.
- 0:25We had a win for the plaintiffs. The jury came back.
- 0:28And they awarded $6 million. To the.
- 0:31Plaintiff. For this bellwether trial.
- 0:33What does that actually mean and how?
- 0:34Does it? Break down, well we had
- 0:36$3,000,000 in. Compensatory damages. $3,000,000
- 0:39in punitive damages. The jury found that Meadow was
- 0:4370% liable and Google or YouTube was 30% liable.
- 0:47We had $3,000,000 in. Compensatory 3. $1,000,000 in
- 0:51punitive for a $6 million award for the plaintiff in this case.
- 0:54This is a huge, huge win because we got both the.
- 0:57Compensatory damages. And.
- 0:59We got. The punitive damages this.
- 1:01Will change the. Way that platforms are designed
- 1:04in the future to prevent hopefully the damages that are
- 1:07being done to the children that are getting addicted.
- 1:12And. Having mental health issues with
- 1:13these platforms? It is the first of hopefully
- 1:16many. Wins for the plaintiffs in the
- 1:18social media addiction trials, both in state court and in the
- 1:21MDL. And it was great to see Matt
- 1:24Bourbon, Mark Lanier walk out of the courthouse with a huge win.
- 1:28And we will see what that means. It's going to be all over
- 1:31mainstream news today. I saw it start hitting the wire
- 1:33last night. We'll hear what Mark Lanier has
- 1:35to say. We'll hear.
- 1:36What Matt Bergman has to say. I'm sure they're going to be all
- 1:38over the press. If you missed it, make sure you
- 1:41watch my interview with Matt Bergman That we did, I believe.
- 1:44Was the first or the second day of the trial right?
- 1:46Before Adam Mossiri testified. You can click that link here.
- 1:49And jump right to that episode and watch my sit.
- 1:51Down with him was. About an.
- 1:52Hour discussion of of what he thought was going to happen in
- 1:55the trial and what a win would mean for the plaintiffs.
- 1:58In the future of what? Social media.
- 2:00Will be in the world. On next week's Tor Talk, we're
- 2:03going to talk. In.
- 2:04Detail. About what this verdict actually
- 2:07means. We'll get all the details as
- 2:09they're coming out. In the press today, tomorrow,
- 2:11over the weekend, when we record Tor talk next week, we will be
- 2:14prepared. To discuss what this actually
- 2:17means for this litigation, we will see you then.
- 2:19Welcome to Tor talk. I am Mark Ryu and joined as
- 2:22always by John Robinson and Joe Fantini.
- 2:25We have an exciting show for you today.
- 2:27We're previewing the JPML hearing on Dupixent, tracking
- 2:31the explosive growth of the Depo Rivera MDL, and breaking down a
- 2:34new study on the weight loss drugs and vision loss.
- 2:37There's a lot to cover. Let's get into it.
- 2:39If your law firm's marketing is not helping drive signed cases,
- 2:42what exactly is it doing? At RR Digital, we build for the
- 2:46outcome that actually matters. SEO that gets you found, paid
- 2:50ads that bring in qualified leads, and social media that
- 2:53builds trust even before the first call is even made.
- 2:56Our digital was built to help law firms grow and sign cases is
- 3:00the metric that we care about. Ready for more cases?
- 3:03Let's talk more information at rrdigitalmedia.com.
- 3:07Back to the pod. All right, moving on to our
- 3:09second topic, the Second Judicial Panel of Multi District
- 3:12Litigation of 2026 is later this week with one key case involving
- 3:17the drug Dupixent on the agenda. What is this medication used for
- 3:21and why are plaintiffs seeking centralization like you
- 3:25mentioned there? Mark, we have the judicial panel
- 3:28multi district litigation meeting at the end of March.
- 3:31The one main case that everybody's focusing on is this
- 3:34medication that surprisingly somehow has multiple
- 3:38applications. It's been around for almost
- 3:40about 10 years now and we're seeing that it's being used a
- 3:43lot to treat eczema is kind of the most common application
- 3:48we're seeing right now. We're alleging that this
- 3:51medication can either cause or enhances a rare type of cancer
- 3:55AT cell type of cancer that we saw a pop up some in of the
- 3:59roundup cases and there's about 20 cases that are pending.
- 4:05So that gets us over that numerosity requirement.
- 4:08We have these commonality of facts and injuries with the same
- 4:12defendants of the plaintiffs use the same medication.
- 4:15They're all over the country. The defendants obviously don't
- 4:18want it centralized, but I think we'll end up having an MDL form
- 4:22should be the beginning of April when we hear about this one.
- 4:25Right now, indications are that this isn't going to be a giant
- 4:29mass tort. I think we'll have a couple
- 4:31thousand, maybe we can get the 5000 cases total, but it'll be
- 4:35exciting to have a new MDL formed in a couple weeks here.
- 4:39A lot of the momentum here is. Being pushed.
- 4:41By 11 Papantonio and the. MTNP crew that did a webinar
- 4:45last week. I know a lot of attorneys are
- 4:47asking questions right now. About that.
- 4:49Particular litigation and I expect that we're going to learn
- 4:51more obviously at the JPML, but also at MTNP as we know 11,
- 4:54Papantonio already investigating it and some other firms as well.
- 4:58Yeah, they're definitely in on it.
- 4:59So it's Beasley, Allen, kind of all the firms you'd expect
- 5:03moving forward with this. Anapol Weiss, I know they're in
- 5:06on it as well. So seems like it's a pretty
- 5:08strong case based on the science, very rare signature
- 5:12injury, which we like in the mass torts instead of focusing
- 5:15on 20 cancers like we did in the beginning of Zantac.
- 5:18So it seems like the science is there, seems like the injuries
- 5:21are there deserving clients. Hopefully we'll get it
- 5:24centralized and maybe even the docket can move fast like we've
- 5:28seen in some of these other mass torts.
- 5:30Who knows? Coming back to Depo Provera,
- 5:32which we've. Been talking about for the past
- 5:34few weeks. It's obviously one of the
- 5:35busiest and most active mess towards right now we saw.
- 5:37Over 500 new cases filed. In the MDL.
- 5:39Last week alone, where do we stand in terms of of the two
- 5:42current biggest issues that we're facing, the preemption and
- 5:45the expert discovery? Yeah, those are the biggest
- 5:47issues pretty much in any litigation.
- 5:49But we were talking couple weeks back how there was a huge filing
- 5:53increase with Depo. There was 1000 cases in a month
- 5:56and now we're seeing 501 week alone.
- 5:59So the litigation is definitely picking up steam.
- 6:02The judge has a December date for the initial trial.
- 6:05We'll be able to see if that holds.
- 6:07But the two pending issues really are the preemption.
- 6:10The judge let us know that it's under advisement, it's fully
- 6:13briefed. We're just waiting for a
- 6:15decision. I think we're going to actually
- 6:17get that sometime in April. It should be a slam dunk being
- 6:20that the label got updated with the warning we said should have
- 6:23been on there the whole time. Kind of defeats the defendants
- 6:26argument there. And then the expert general
- 6:28discovery is wrapping up, I believe, I believe the last day
- 6:32for the general expert discovery was March 20th.
- 6:35So we'll really be able to focus forward going on, get some
- 6:39Dahlberg motions filed, get some hearings on that, see what comes
- 6:43in and what doesn't. But momentum drill building,
- 6:46this is actually been a rocket docket and no mass tort has ever
- 6:49moved this fast. So hopefully we can learn a lot
- 6:52from this and use it as an outline for the future mass
- 6:55torts. But we're getting the numbers up
- 6:57there, and we'll have some more positive momentum the next
- 7:00couple months. Moving on to our next topic,
- 7:03NAION cases are heating up, and a new study on this issue
- 7:06appears to indicate that medication made-up of
- 7:09semaglutide face higher risk of developing this terrible
- 7:13disease. What exactly did this breaking
- 7:16study show? Yes.
- 7:17So this is an injury that kind of came on to our radar towards
- 7:21the end of 2025. We ended up getting multi county
- 7:25litigation centralized in New Jersey and state court level.
- 7:29And then also in the MDL, we have this injury that's running
- 7:33parallel to the gastric injuries.
- 7:35And So what we've really been trying to figure out is, you
- 7:38know, what's the doses that's associated with this injury is a
- 7:42specific type of this GLP one that causes these injuries.
- 7:46And this new study you just mentioned, Mark, it's showing
- 7:49that there's more than a twice increased likelihood of
- 7:52developing this stroke of the eyes, what we're calling it,
- 7:56when you're using Ozempic or Wigobi.
- 7:59So it looks like those two medications are really linked to
- 8:03this specific eye injury. It seems to have to do with
- 8:06their chemical build up and what they're made of.
- 8:09So that's something we're going to be paying attention to.
- 8:11But it looks like this dock is going to be filled with those
- 8:14ZEM, PIC and Mcgovy medication cases as opposed to some of the
- 8:18other ones out there looking. At these.
- 8:20Weight loss. Drugs which people are taking to
- 8:22help reduce. Their weight.
- 8:25Yeah, some of them are just exceptionally.
- 8:27Some people really need. To lose the weight for health
- 8:29reasons and then to have. This completely out of left.
- 8:32Field condition causing blindness in some some cases.
- 8:36It's rare, but it is happening, and there it looks like there's
- 8:39a. A pattern that's starting to
- 8:40emerge here so. Two different.
- 8:42Directions. Still going on this weight loss
- 8:44litigation both of the eye injuries and with the
- 8:46gastrointestinal injuries. Yeah, it's like you're saying,
- 8:49you use the medication to lose a couple pounds, maybe get some of
- 8:53your blood pressure, diabetes under control.
- 8:56Nobody would trade that for losing their vision, right?
- 8:59You, you need your vision with everything you do.
- 9:01There was any warning at all that this could happen.
- 9:03Nobody would take the medication.
- 9:06That's why they don't have the warning on there.
- 9:08And now it's good that we're finally, you know, learning
- 9:10about it, seeing what the cause is.
- 9:12Hopefully, we can prevent the future cases.
- 9:14Another exciting week in mass torts.
