Transcript
- 0:00Speaker 1: Well, here's the best legal analyst in America, Greg Jarrett. Hey,
- 0:03Speaker 1: you get his books. He's got a lot of great books,
- 0:06Speaker 1: The Constitution and other patriotic documents, Trial of the Century,
- 0:09Speaker 1: the Riveting Book, and go back and get the earlier
- 0:11Speaker 1: books on the FBI, on what was going on there,
- 0:15Speaker 1: witch hunt and the Russia hoax. And he's with us
- 0:18Speaker 1: right now, Greg Jarrett. How you doing, Mark, I'm fine.
- 0:22Speaker 1: Good to be with you.
- 0:23Speaker 2: Hey.
- 0:23Speaker 1: I don't know if you saw the Mom Donny rally,
- 0:25Speaker 1: there was Letitia James screaming I will not bend, I
- 0:28Speaker 1: will not bow, I will not break. Well, what does
- 0:30Speaker 1: all that mean?
- 0:33Speaker 2: Well, you know she is, you know, creating a melodrama
- 0:39Speaker 2: for her own benefit. The problem for her is that
- 0:43Speaker 2: purely on the paperwork that she executed. You know, it's
- 0:47Speaker 2: a pretty serious case against her bank fraud, fault stavens
- 0:50Speaker 2: to a financial institution. You cannot claim a house, whether
- 0:56Speaker 2: it's primary or secondary, as an occupy residents and then
- 1:02Speaker 2: obtain a lower, more favorable mortgage rate and then rent
- 1:06Speaker 2: it out without telling the bank. You're cheating the lender
- 1:10Speaker 2: by lying about the financial risk. And documents show that
- 1:15Speaker 2: James incriminated herself. Take a look at her mortgage papers
- 1:20Speaker 2: or insurance application. In both of those she said she
- 1:25Speaker 2: would occupy the house at least partially, but on IRS
- 1:31Speaker 2: records she admitted it was cheerly a rental with zero
- 1:35Speaker 2: personal occupancy. Well, it can't be both, and it turns
- 1:39Speaker 2: out that James never resided there even briefly. Her defense,
- 1:44Speaker 2: through her attorney is, oh, it's all a terrible misunderstanding.
- 1:48Speaker 2: It's just a paperwork snaffo. Somebody else's to blame. But
- 1:54Speaker 2: under James's own stated standard in the case she brought
- 1:57Speaker 2: against Trump, she declared, that's never an excuse.
- 2:00Speaker 1: Under the law, the.
- 2:01Speaker 2: Borrower is always responsible, regardless of what other did. So
- 2:08Speaker 2: you know, she's she's hoisted on her own the tarts.
- 2:11Speaker 2: Shakespeare would say, that's.
- 2:12Speaker 1: A good point. Trump brought that up in his case,
- 2:14Speaker 1: that he didn't fill out any of that stuff and
- 2:16Speaker 1: he wasn't the one doing the loan.
- 2:18Speaker 2: Streak, and she said it didn't matter.
- 2:22Speaker 1: So let's get let's get to Komy James comy, Uh,
- 2:29Speaker 1: what how is he going to fight this case? What
- 2:31Speaker 1: will his strategy be in court?
- 2:34Speaker 2: Well? I wrote a column about this, so you can
- 2:37Speaker 2: read it on fox news dot Com. But you know
- 2:39Speaker 2: when he was preening like a peacock in front of
- 2:43Speaker 2: a camera the day the indictment came out, saying let's
- 2:48Speaker 2: have a trial. That was just another pretense, another lie
- 2:53Speaker 2: by phony Comy.
- 2:54Speaker 1: It's a con job.
- 2:56Speaker 2: The last thing he wants is a trial, which is
- 2:59Speaker 2: why his lawyers on the day of his plea notify
- 3:04Speaker 2: the judge that they're going to file motions to dismiss
- 3:08Speaker 2: claiming the charges are vindictive and selective retribution by Trump.
- 3:14Speaker 2: And so Comey's strategy obviously is to put Donald Trump
- 3:20Speaker 2: on trial to avoid his own trial. Now, typically that's
- 3:25Speaker 2: an uphill battle for a defendant under the law, for
- 3:30Speaker 2: example selective prosecution. Commy has to prove by clear evidence
- 3:34Speaker 2: that the charges have an unjustified motive. But if they're justified,
- 3:42Speaker 2: it's not a defense. And of course the argument that
- 3:46Speaker 2: Trump is the terrible villain, poor Jimmy is the innocent
- 3:51Speaker 2: victim is nothing more than a farce given Comey's long
- 3:57Speaker 2: list of wawless schemes lies to perceptions abuses of power.
- 4:01Speaker 2: I mean, remember Colley's the guy who invented law, there
- 4:06Speaker 2: by launching the perverted Russia hoax against Trump, So you know,
- 4:11Speaker 2: his hypocrisy and arrogance is quite stunny.
- 4:15Speaker 1: Yeah, Greg Terrett, you wrote the best stuff your books
- 4:18Speaker 1: about Comy and that seventh floor up there with all
- 4:20Speaker 1: his cronies, those dirty guys there. How much has been
- 4:24Speaker 1: done to clean that up and clean up the FBI.
- 4:28Speaker 2: Well, Comy created a cancer on the seventh floor, you know,
- 4:33Speaker 2: with the whole gang of people Andy McCabe and Peter
- 4:38Speaker 2: Struck and you know, the whole cast of misfits and
- 4:43Speaker 2: miscreants that abused the law and they did it for
- 4:47Speaker 2: political reasons. And as I say, you know, Comey's the
- 4:51Speaker 2: one who was the motivating driver behind the Russia hoak.
- 4:57Speaker 2: So you know Cash Fettel, the new FBI director, Dan
- 5:01Speaker 2: Bongino deputy director, and they got their work cut out
- 5:05Speaker 2: for them. You know, you've got to get rid of
- 5:08Speaker 2: the bad actors. They've done some of that, and you
- 5:12Speaker 2: have to dig deep in vaults where Comey squirreled away
- 5:18Speaker 2: all kinds of things and try to uncover the truth
- 5:23Speaker 2: and hold people accountable. That doesn't necessarily mean that you
- 5:26Speaker 2: criminally charge them, but you certainly expose their misfeasans and
- 5:32Speaker 2: mouth seasons.
- 5:33Speaker 1: Yeah, Greg Jared, who do you think is next to
- 5:37Speaker 1: get indict A lot of people think Bolton. The Bolton
- 5:40Speaker 1: indictment will come later this week.
- 5:42Speaker 2: Or next Yeah. I mean, look, Bolton's got problems for
- 5:47Speaker 2: pulling a Hillary Clinton and you know, allegedly maintaining classified
- 5:52Speaker 2: evidence at home and in his office, both of which
- 5:58Speaker 2: were rated the FBI. You know, you would think people
- 6:03Speaker 2: would learn from Hillary Clinton. She got away with her
- 6:07Speaker 2: thanks to comy. But you know, David Betraeus did the
- 6:12Speaker 2: same sort of thing eventually, you know, pled guilty. You know,
- 6:17Speaker 2: you cannot take top secret classified documents home with you
- 6:21Speaker 2: unless you have a skiff at home, you know, a
- 6:24Speaker 2: secured facility, and most people don't. And you know, Joe
- 6:28Speaker 2: Biden did the same thing, you know, squirreling away at
- 6:33Speaker 2: his home as well as his garage what turned out
- 6:36Speaker 2: to be classified documents. And of course he escaped any
- 6:40Speaker 2: prosecution because his special counsel said he's too old and
- 6:44Speaker 2: dement to bring charges against him. But it's okay if
- 6:48Speaker 2: he runs the United States as president. So you know,
- 6:53Speaker 2: this sort of thing happens sadly all too often, and
- 6:56Speaker 2: it jeopardizes national security. But you know, I think Adam Shift.
- 7:01Speaker 2: I think he's in deep trouble for mortgage fraud, same
- 7:05Speaker 2: sort of thing. So'll wait and see when the next
- 7:08Speaker 2: shoe drops.
- 7:09Speaker 1: Well, now, you're a great legal historian. When did this
- 7:12Speaker 1: legal development happen where it's only a crime if Trump
- 7:16Speaker 1: does it, it's not a crime if we do it.
- 7:19Speaker 1: Where is that legal standard in the law books?
- 7:23Speaker 2: It doesn't exist, you know. I mean the Lawfair campaigns
- 7:31Speaker 2: plural against Trump were really pretty shameful. Letitia James bringing
- 7:37Speaker 2: a ludicrous case, Alvin Bragg an even more absurd case,
- 7:43Speaker 2: and as I wrote in my column this week, you know,
- 7:46Speaker 2: Joe Biden's dirty fingerprints were all over the double indictments
- 7:50Speaker 2: brought by special counsel Jack Smith. You know, so, you know,
- 7:56Speaker 2: lawfair has really reached and apex, not with Trump but
- 8:04Speaker 2: with Democrats that we're trying to prevent him from seeking reelection.
- 8:12Speaker 2: It backfired on them tremendously. I mean, that's really one
- 8:16Speaker 2: of the biggest political boomerangs I've ever witnessed. You know,
- 8:20Speaker 2: people saw Trump not as a villain but a victim
- 8:24Speaker 2: of law fare, and it, you know, helped propel him
- 8:27Speaker 2: to a second term.
- 8:28Speaker 1: Yeah. Well, amazing period in history. Everybody, get Greg Jarrett's
- 8:32Speaker 1: great books. And hey, read these columns. Who've been talking
- 8:35Speaker 1: about the brilliant columns. You can go to foxnews dot com.
- 8:38Speaker 1: You can read Greg Jarrett's columns there. Of course, you'll
- 8:40Speaker 1: see him all over Fox News. Greg Jarrett, thanks for

- 8:45Speaker 2: Take care, Mark, thanks for having me on.
- 8:46Speaker 1: All right, take care. Hey, coming up, we'll get to
