- 0:24While we are one step closer to the Texas 10th Commandment law entering the Supreme Court, we are.
- 0:33We're there.
- 0:34We're knocking on the door while this is happening because of a decision by the Court of Appeals the other day.
- 0:42While this is happening.
- 0:44May 1st is just around the corner.
- 0:47And hundreds of schools, actually, with hundreds of students are planning to walk out.
- 0:56They're planning protests, which is a we we've got two opposing educational points of view here.
- 1:08And they are unfolding before our very eyes.
- 1:11We're going to get into the uh the dissection today.
- 1:14But before we do, before we dive into the federal court of appeals ruling in favor of the Ten Commandments, versus what's happening here on May 1st and the juxtaposition between these two opposing views of education.
- 1:32We've got a history class today.
- 1:35That's right.
- 1:35It's one of our favorite days of the week is history class day.
- 1:42I mean, it's mine.
- 1:43It's probably yours too.
- 1:45I don't know that you'd be listening.
- 1:48If you would continue listening, if maybe history class wasn't one of your one of your favorite things.
- 1:55Today, 1758, James Monroe is born in Westmoreland County, Virginia.
- 2:02Of course, James Monroe is indeed the fifth president.
- 2:05He is the last, the last president of the founding generation, James Monroe, president number five.
- 2:14We've got the bookends of Washington and Monroe, the presidents of the founding generation.
- 2:20The book ends in that famous painting of Washington crossing the Delaware, painted by Emmanuel Lutz.
- 2:28It's sitting behind me right now on the wall.
- 2:32Of course, uh Monroe was born in the same county as Washington.
- 2:40He's tall like Washington.
- 2:41He's tall and he's dignified.
- 2:44Matter of fact, many people said that because of this, because of his dignity and because of his height, they reminded he was Monroe reminded them of Washington.
- 2:56Thomas Jefferson reportedly declared about Monroe that he was so honest.
- 3:02If you turned his soul inside out, there would not be a spot on it.
- 3:07I mean, that's honesty right there.
- 3:10Umro is the son of a planner.
- 3:13He attended the College of William and Mary in Williamsburg.
- 3:17But Monroe abandoned his studies to fight in the Revolutionary War.
- 3:22And he was with Washington's army on Christmas night, 1776, when they crossed the Delaware to attack the um the uh the German troops at Trenton, the Hessians, as it were, Trenton, New Jersey.
- 3:42It was Monroe who led the charge, one of the charges against uh enemy cannon right there in downtown Trenton.
- 3:51A musket ball ripped into his shoulder, nearly killing him.
- 3:55Uh, when his wounds had healed, he went back to fighting for independence.
- 4:00But but the story here is an interesting one.
- 4:03The the story of the musket ball ripping through his shoulder, his his chest area nearly killing him, he would have died, except uh for one lone doctor, one lone doctor.
- 4:20And and the way that that the doctor joined the regiment is a very intriguing story in and of itself.
- 4:29Now, as you know, uh the the crossing of the Delaware was done in complete secrecy.
- 4:38The men didn't know where they were going.
- 4:41Most of the officers didn't know where they were going.
- 4:44I mean, the the officers that were in Washington's inner circle knew.
- 4:48But even, you know, the the commanders of the of the of the various companies, they didn't know.
- 4:53They just knew, hey, look, here are our orders.
- 4:55We're crossing the Delaware, and we're gonna march.
- 4:58We're gonna go on a long march, and and and it's going to be worth your time to stay awake and to stay alert.
- 5:06I mean, the men were pumped.
- 5:07They were like, okay, we're not retreating anymore.
- 5:10We're we're actually going to get to fight.
- 5:12I mean, that's what they wanted.
- 5:13They wanted to fight, they didn't want to retreat.
- 5:16And so they were excited about this operation being done in secrecy.
- 5:22And the they spent the the early morning hours crossing the Delaware.
- 5:28The crossing began on Christmas Day, 1776.
- 5:32Well, Christmas Day evening.
- 5:35And they finally made it across the Delaware about three o'clock in the morning.
- 5:40And they begin this quiet march.
- 5:43And the reason that they wanted to march quietly towards Trenton is because they didn't want to wake up any homeowners.
- 5:50They were unaware of the people in that area where they stood, if they were loyalists to the crown, or if they were patriots.
- 6:00And so this is this is a quiet march.
- 6:03They are doing their absolute best to march as quietly as humanly possible.
- 6:10And in so doing, and then trying to be quiet.
- 6:12They pass this particular house.
- 6:15And a dog hears them outside, and the dog starts barking profusely.
- 6:20And the owner of the house stumbles out of bed.
- 6:22He's like, what in the world's going on?
- 6:24Why won't my dog stop barking?
- 6:27And as he stumbles out of his house sleepily and tiredly, he sees these men marching down the road and he approaches them.
- 6:35And he inquires of who they are and where they're going.
- 6:39And it just so happens that he's speaking to James Monroe.
- 6:45And he says, where are you guys off to?
- 6:47And Monroe is like, you know, we're patriots.
- 6:50We're not really sure where we're going, but we're marching.
- 6:53We are we're going somewhere, uh, and there's gonna be a battle.
- 6:58And so the man introduces himself as a doctor.
- 7:00Introduces himself as a doctor.
- 7:01He says, I am I'm a doctor.
- 7:01He says, I am I'm a doctor.
- 7:04Uh Dr.
- 7:04Dr.
- 7:04Riker is his name.
- 7:05Riker is his name.
- 7:07And he says, you know what?
- 7:07And he says, you know what, you one of you guys might need me.
- 7:08One of you guys might need me.
- 7:10I'm coming with you.
- 7:10I'm coming with you.
- 7:11I'm a patriot.
- 7:11I'm a patriot.
- 7:11I'm a doctor.
- 7:11I'm a doctor, you might need me.
- 7:12You might need me.
- 7:13I'm on board this train.
- 7:13I'm on board this train.
- 7:15He packs up his stuff and he starts marching alongside of James Monroe.
- 7:15He packs up his stuff and he starts marching alongside of James Monroe.
- 7:21When they get to Trenton, and the surprise attack ensues, Monroe, as I said, leads this charge.
- 7:21When they get to Trenton and the surprise attack ensues, Monroe, as I said, leads this charge.
- 7:29And
- 7:29And he takes a musket ball to the to the chest shoulder area, severing an artery, about ready to bleed out.
- 7:38But because of Dr.
- 7:39Riker, standing there next to him, Riker takes his finger and plugs up the hole.
- 7:45Riker's like, I got you, Monroe.
- 7:48I am your man forever, you know, sort of thing.
- 7:53Riker saves the day, ends up uh getting the uh the wound cleaned out, ends up retrieving the musket ball, uh Riker essentially saves Monroe's life.
- 8:08And if not for the dog, if not for the dog waking up, or you know, and and and barking uh loudly and annoyingly and waking up Riker, Monroe is a dead man.
- 8:22These are the the fun stories of of history that you can kind of trace back the hand of providence, because if Monroe is a dead man, we don't have our fifth president.
- 8:35And if we don't have our fifth president, then we don't have the doctrine that bears his name.
- 8:45After the war, after Monroe lives, survives, Riker saves his life.
- 8:51He studies law under Thomas Jefferson, and he embarks on this remarkable career.
- 8:56He served in the Virginia Assembly, he serves in the Continental Congress, he serves in the U.S.
- 9:02Senate twice as governor of Virginia.
- 9:05Uh Washington sent him to Paris as a U.S.
- 9:08minister to France.
- 9:11And under uh Jefferson's presidency, Monroe helps to negotiate the Louisiana purchase.
- 9:17Uh he served as U.S.
- 9:19minister to Britain under President Madison's uh administration.
- 9:26Monroe was thought so highly that Madison appointed him to serve simultaneously as Secretary of State and Secretary of War.
- 9:35Never happened before.
- 9:36Monroe's taking up two two cabinet positions.
- 9:41Uh and of course, Americans reward him for his tireless tireless efforts.
- 9:48They elect him uh to turn two terms in the White House as president from 1817 to 1825.
- 9:58And in 1823, this is when the declaration that the Western Hemisphere was off limits to colonization by European powers was enacted by Monroe under the name of the Monroe Doctrine.
- 10:12The United States would not try to seize colonial possessions, uh Monroe said, but it would also not permit any European nation to establish new colonies in the Americas.
- 10:26And uh, but that's it.
- 10:28You this territory, this land is off limits to Europe.
- 10:32This is going to be an American dominated piece of land.
- 10:38And of course, this doctrine has been a pillar of American foreign policy ever since.
- 10:44And it's it's the doctrine that Trump uh referred to and enacted when he went down to Venezuela to arrest Maduro, essentially stating, hey, we're not gonna have, we're not gonna have thugs in our hemisphere.
- 11:03Uh we're kind of watching what's unfolding here in in Cuba.
- 11:07And perhaps under Kennedy, we should have been, and even under Eisenhower, we we perhaps should have been more stalwartish in the Monroe doctrine as it pertains to Cuba and even as it pertains to the rest of South America to keep communism out of our hemisphere.
- 11:29Um we owe this doctrine to James Monroe.
- 11:34And essentially, we owe James Monroe to Dr.
- 11:37Riker, uh, who on that fateful uh uh winter evening on December, it would have been December 26th at this point, in the early morning hours of December 26th, 1776.
- 11:52Riker joins the band and he says, I'm coming with you guys.
- 11:55Well, I'm gonna I'm gonna I'm gonna march alongside of it.
- 11:58He volunteers his services.
- 12:02This is the epitome of patriotism.
- 12:06And uh this is the very act right here that John Hancock was referring to years later, uh 18, I don't know, 89, 1888.
- 12:18I'm sorry, not 18, 17, 89 in that area, maybe 1788.
- 12:24He's the governor of Massachusetts.
- 12:26He's speaking to the assembly there in Massachusetts, and he's he's talking about how we can express our gratitude to Almighty God for giving us this glorious land.
- 12:38This is even before, obviously, before Monroe's president.
- 12:42Um, you know, we're still decades away from Monroe declaring the Monroe Doctrine.
- 12:49And uh Hancock is saying, as a people, we need to offer our gratitude for for the the many blessings, the blessings that we can't count and list.
- 13:00There, there's so many of them.
- 13:01And and the way we express our gratitude is through patriotism.
- 13:07It's it's by it's by being patriotic.
- 13:10It's by it's by loving the country.
- 13:12That's how we do it.
- 13:14We express our gratitude to God for giving this us the country by loving the country.
- 13:20It makes sense ultimately when you express your gratitude for something, the best way to do it is to love that something.
- 13:30Whatever that thing is, if if you're grateful for it, then you know, love it, take care of it, be tender towards it, uh, nurture it, develop it, cause it to grow, pour your love into it so that there is nothing but unadulterated growth.
- 13:49And this is this is what Hancock is saying, how uh we we we show our love and our gratitude to God for giving us this country by being patriotic.
- 13:59And it was Dr.
- 14:00And it was Dr.
- 14:00Riker who did that very thing.
- 14:00Riker who who did that very thing.
- 14:04His patriotism was on full display in the early morning hours of December 26, 1776.
- 14:04His patriotism was on full display in the early morning hours of December 26th, 1776.
- 14:16And because of that full display, because of that love, because of that patriotism, because of his willingness to walk with an army.
- 14:16And because of that full display, because of that love, because of that patriotism, because of his willingness to walk with an army, perhaps towards a certain doom and certain death.
- 14:24Perhaps towards certain doom and certain death.
- 14:28He didn't know what awaited him on that.
- 14:28He didn't know what awaited him on the other side of their wherever they were going of their destination.
- 14:33He just knew the men were marching.
- 14:36They were patriots.
- 14:37They loved the country.
- 14:38They were fighting to defend the country.
- 14:40And he had an opportunity to march with them.
- 14:43Just in case one of them needed him.
- 14:46And the one man that needed him would prove to become our fifth president, who would prove to become the final president of the founding generation, and who would establish a doctrine in this country, a doctrine of foreign policy that would carry on for centuries, even to this day.
- 15:09We would be better off, I think, as a people, as I said, had this doctrine been followed more closely, had it been followed profusely, had it been followed to the letter throughout throughout time.
- 15:24I think we'd be in a better position.
- 15:27Perhaps we wouldn't have Marxism overtaking one of the greatest cities on the planet, if not the greatest city, New York City.
- 15:37We probably wouldn't have this fight of Marxism unfolding before our very eyes.
- 15:42And I don't, I don't know.
- 15:43Maybe we haven't really uh explored that.
- 15:46I've been kind of we we will.
- 15:49We will absolutely explore it in detail because we're gonna watch it fail.
- 15:54We're gonna watch communism utterly fail.
- 15:57The the disappointing thing, and that is in order for it to fail, it's gonna have to do what it does.
- 16:02And it could very well tank the greatest city on the plan.
- 16:06Not very well.
- 16:07It's going to.
- 16:08I mean, it's a horrible prediction that New York will fail and utterly end up in a trash heap.
- 16:16That is the only direction for it.
- 16:18Unfortunately, that is the only direction for it.
- 16:21Had Monroe's advice been followed, perhaps we would not uh see New York in this situation.
- 16:28And so again, this is why history class is so important around here.
- 16:32It's why we have to talk about it.
- 16:34Because we must remember, we have to remember where we came from.
- 16:39And in remembering where we came from, we should remember not only uh Providence, the hand of God in getting us here.
- 16:49Uh that the hand of God and that uh Riker was awakened, and that Riker went with with the troops, specifically James Monroe, but also the the patriotism that that was on display, the patriotism that that was put forth, the love of country that was uh that that was displayed in the hearts and minds and actions and lives of these men of this period.
- 17:18Now here we are.
- 17:19We're we're 250 years celebrating American independence, and part of that celebration is patriotism.
- 17:27Uh we we we can celebrate 250 years.
- 17:32We can celebrate this glorious once-in-a-lifetime anniversary through patriotism.
- 17:37We can take Hancock's advice here, and we can show our gratitude through patriotism.
- 17:42We can celebrate through patriotism.
- 17:44And we're going to be doing that, by the way, this summer in Nashville, Tennessee.

- 23:20All right.
- 23:21So April 21st, just last last week, a few days ago, the federal court of appeals issued a ruling in the state of Texas and the Ten Commandments.
- 23:36This thing is going to the Supreme Court.
- 23:39We we know it is.
- 24:25And in upholding Texas Senate Bill, the Fifth Circuit overturned a lower court injunction that had barred this law from taking effect.
- 24:37Judge Stuart Kyle Duncan wrote for the majority opinion when he said we conclude the Texas law does not violate either the establishment clause or the free exercise clause.
- 24:51And of course, this is this is making the opposition seethe with anger, seethe with disgust, seethe with fill in the blank, whatever negative adjective you want to come up with.
- 25:15They're the lead here in attacking this law.
- 25:21They don't want it to happen.
- 25:23They don't believe the Ten Commandments should be on display because they don't believe morality should be taught in our education system.
- 25:39The court's ruling goes against fundamental First Amendment principles and binding U.S.
- 25:45Supreme Court authority.
- 25:50Well, I wonder if it's still going to be binding Supreme Court authority when this Supreme Court rules in the exact same way that the Fifth Circuit has ruled here.
- 26:01That's my prediction.
- 26:02Now you can't really predict, I think what this particular Supreme Court is going to do on any given matter or and or subject, but I think on this one.
- 26:24And with Judge Stuart Kyle Duncan and his majority opinion, concluding that the Texas law calling for the Ten Commandments to be displayed in public school classrooms does not violate either of the of the clauses in the First Amendment that pertain to religion.
- 26:42The establishment clause or the free exercise clause.
- 26:46No violation here.
- 27:08So you've got you've got entities here that are antithetical to any religion at all in public schools.
- 27:18Although the state of Texas has said, look, this the fact that the Ten Commandments are being hung in public school classrooms has nothing to do with religion.
- 27:28It has everything to do with the uh historical legal foundations of this country that are indeed rooted in the Ten Commandments.
- 27:42How can you, how can you accurately educate students in America about American history and exclude the Ten Commandments?
- 27:53You can't.
- 27:54It's uh incongruent with itself.
- 27:59But the ACLU, they don't they don't see it that way.
- 28:00But the ACLU, they don't see it that way.
- 28:03They they see this as religion, and this Congress cannot establish a religion, and therefore this law breaks the establishment clause.
- 28:03They see this as religion, and this Congress cannot establish a religion, and therefore this law breaks the establishment clause.
- 28:14They continue in their statement, stating the First Amendment safeguards the separation of church and state and the freedom of families to choose how, when, and if to provide their children with religious instruction.
- 28:22And the freedom of families to choose how, when, and if to provide their children with religious.
- 28:31Okay, I'm going to stop right there because the First Amendment does none of those things.
- 28:44If we say safeguard the separation of church and state, I don't know that that's actually accurate.
- 28:51I think the First Amendment tells uh Congress that it cannot um it cannot interfere with uh religious practices.
- 29:04That's the point of the First Amendment.
- 29:08So I guess it's not that they're wrong here, but uh it's not uh that the point of the First Amendment was not to cancel religion, it's not to safeguard the canceling of religion, but it's to determine and dictate to Congress that they cannot interfere.
- 29:31In other words, they can't thwart, they can't Congress cannot uh choose one religion over another.
- 29:40Uh but I mean, if we if we are to look at, this is the beauty of it.
- 29:45This is the beauty of language, and we've talked about this here from time to time.
- 29:49I guess we're gonna talk about it again, because I'm feeling it.
- 29:53If you look at the the debates of that first amendment, the the the authors of it were synonymously using the word religion with denomination.
- 30:10In other words, this is a Christian country.
- 30:15The religion of this country is one of Christianity.
- 30:20And the founders and the framers of the Constitution did not want Congress to establish one denomination of Christianity over another.
- 30:36Actually, Pennsylvania, they were they were Quakers.
- 30:40And and Maryland, they're they're Catholic.
- 30:43And Virginia, they were Anglican.
- 30:47Uh other states were congregationalists, other states were anabaptists, other states were this, that, and the other.
- 30:54And the the framers didn't want the federal government to have the authority to establish one religion over another or one denomination.
- 31:07It wasn't that they were antithetical to religion.
- 31:11I mean, the record bears this out.
- 31:15They were not antithetical to religion.
- 31:19They they believed that religion should be in an education.
- 31:22Look at the Northwest ordinance.
- 31:25Uh religion, morality, and knowledge.
- 31:28That's what they felt was the foundation of education.
- 31:32The Bible was used in education throughout.
- 31:36And the framers of the Constitution, none of them were opposed to that.
- 31:43Not a single person who voted for the First Amendment was opposed on record as saying the Bible should not be in classrooms.
- 31:54Indeed, the Bible was in classrooms for decades.
- 31:59The Bible was part of classroom instruction.
- 32:03Without any without any pushback from these guys who drafted this document.
- 32:28Waiting for a time when the American memory would would wane and and fail and and wax short, as it were.
- 32:39And they just passed this idea on to their um their offspring, who was also antithetical to religion because they were taught to be.
- 34:03What the First Amendment does is it puts shackles on Congress saying that it cannot limit religious instruction.
- 34:13It cannot establish one Christian denomination over another, and it cannot limit the freedom to express your religious points of view.
- 34:25And as a family, as a parent, if you don't want your child to have this religious point of view, then you can raise them and in that regard, certainly.
- 34:45You didn't have to engage in it.
- 34:56We've talked about the Bible, actually, you know, Bible passages and portions of the Bible being included in curricula in the state of Texas.
- 35:00You know, Bible passages and portions of the Bible being included in um in curricula in the state of Texas.
- 35:08And and the passages that are included are not.
- 35:08And the passages that are included are not passages that that browbeat a student into Christianity.
- 35:21They're passages that are designed to help young people uh work through things.
- 35:28For example, the passage on anxiety, where Jesus is, you know, instructing his disciples look, don't worry, don't be anxious.
- 35:38Uh that is not brow beating somebody to believe in Christianity.
- 35:45So you you certainly have have a right to choose whatever religion you want to choose here, whatever particular denomination you want to be a part of.
- 35:57You you you've got that right.
- 35:58You have that um, you know, you have that ability.
- 36:02Go ahead, take it, choose it.
- 36:04It's yours for the choosing.
- 36:07Uh, and that the fact that there is perhaps a Bible passage being discussed in the classroom, doesn't dissuade anybody from this, or the fact that the Ten Commandments are hanging on the wall doesn't dissuade anybody from being whatever they want and following whatever religious belief and practice they want to follow.
- 36:32But the ACLU, they say that this decision tramples those rights.
- 36:37And the ACLU anticipates asking the Supreme Court to reverse this decision and uphold the religious freedom rights of children and parents.
- 36:47So this is where we're going.
- 36:48We're going to the Supreme Court.
- 36:51Uh they're going to ask the Supreme Court to reverse this decision.
- 36:56So I think this is a legitimate question.
- 36:59Do you think?
- 37:00Where do you think it falls?
- 37:02Do you think the Supreme Court reverses this decision?
- 37:06I I don't think they do.
- 37:08I think that this Supreme Court, who would they've they are on record as saying, look, we're going to look historically at how the nation has treated the Bible, how the nation has treated prayer, how the nation has treated Christianity.
- 37:23That the historical record is going to be our framework, the historical record is that's where we're going to start.
- 37:32We're not going to start in 1962 and 63.
- 37:35We're not even going to start in the 1950s when when the when this idea began to be planted in the hearts and minds of justices.
- 37:43And that was probably being implanted even prior to the 50s.
- 37:49But certainly they're not going to look at the 60s as their starting point when the decision was made that uh that the that the first amendment needs to be rewritten, redefined.
- 38:00There were words in the first amendment that were redefined, where Congress, not establishing a religion, the word Congress was redefined as a public school teacher, who then could not pray or could not use the Bible, because well, that was akin to Congress establishing a religion.
- 38:20Uh, when in fact the public school teacher is not a member of Congress, and there's not a law being established here.
- 38:29Ultimately, what happened is one portion of the First Amendment was weaponized.
- 38:36The establishment clause was weaponized to attack the freedom of expression clause.
- 38:43That was their whole point.
- 38:45And they achieved it.
- 38:46They miraculously achieved it.
- 38:48But this Supreme Court has said, look, that's not going to be our starting point.
- 38:52Our starting point is the historical record.
- 38:56How have we treated Christianity?
- 38:59How have we treated prayer?
- 39:00How have we treated the Bible in public schools historically?
- 39:05And that's what they're willing to look at.
- 39:07And based upon those statements, based upon that fact that they're going to look at history.
- 39:17That tells me I've got faith and confidence that this court is not going to reverse that this Supreme Court's not going to reverse the decision brought to us here by the Court of Appeals.
- 39:30And by this, is it the Fifth Circuit?
- 39:32I think it's the Fifth Circuit.
- 39:35Um, yeah, the ACLU, yeah, Fifth Circuit.
- 39:38Yeah, so the ACLU says we anticipate asking the Supreme Court to reverse this decision.
- 39:44I anticipate the Supreme Court telling the ACLU.
- 39:52No, we are not going to reverse this decision.
- 39:56I mean, what we'll see.
- 39:57We're going to see where this thing is is going to shape out, but it gets exciting.
- 40:01I mean, from here on out, I'm telling you, we are in, we are in the land of pure unadulterated excitement.
- 40:09Doesn't get any better than this.
- 40:11I mean, if you if you love this sort of thing, if you're if you're geeky about history and about um, you know, about just about this kind of stuff, I am.
- 40:20If if you if you're excited about education, if you're excited about the opportunity to actually educate our young people in truth, and to educate them in morality and to pour into them something different than what they're being given right now.
- 40:40Because right now, I mean, this Friday, uh, hundreds of schools are shutting their doors.
- 40:48So their kids can go protest law enforcement in America.
- 40:55Public schools and public school teachers are operating as activists and teaching children to do the same thing.
- 41:04That that, my friends, is not education.
- 41:07This Friday, May 1st, is a living breathing example of activation, not education.
- 41:16It it should tell the entire country why our test scores are as abysmal as they are.
- 41:24Right here on Friday, we're we're gonna see it live and in person across the country.
- 41:29It's unfortunate.
- 41:31It's absolutely unfortunate.
- 41:33But we have an opportunity to turn this thing around.
- 41:36And my friends, I say we take it.
- 41:39All right, uh more of this conversation on the other side of this break.
- 41:42You're listening to the dean's list on America out loud talk radio.

- 44:43All right.
- 44:44Um, so here we are.
- 44:46Texas is they're not messing around.
- 44:49Texas is is this is the real deal.
- 44:52And they they believe wholeheartedly that the 10 commandments should be on display.
- 45:00Uh and they're just you know, they're just going after it.
- 45:03And when they when they signed, uh, went when Greg Abbott signed SB 10 in into law in 2025.
- 45:14Uh it was supposed to take effect September 1st, 2025.
- 45:19I think he signed it into law.
- 45:20I think August, maybe.
- 45:23Uh again, it required every classroom to post a framed or mounted English translation of the Ten Commandments.
- 45:31And it was even specific with its measurements.
- 45:3416 by 20.
- 45:36The point was that so it could be read from anywhere in the room.
- 45:40Uh, and it the displays aren't, they're not paid for with tax money, they're all private donations, they're not part of the school budget.
- 45:48Uh, but but afterwards, after this, you know, after the after the law was passed, uh, 16 families coalesced to file suit against it.
- 46:01They specifically filed suit against 11 school districts in Texas.
- 46:08And in August 20th, 2025, Judge Fred Byery, I think, maybe B-I-E-R-Y, maybe Biery.
- 46:19Uh, he's at a San Antonio, and this judge issued a preliminary injunction, uh, essentially ruling that this law was in violation of the First Amendment, specifically the establishment clause that Texas, the state of Texas, wanting to put the Ten Commandments up, violated the First Amendment establishment clause.
- 46:46Now, the First Amendment, again, let me just remind you.
- 46:49Let's just be clear about this.
- 46:51The First Amendment describes what the federal government cannot do.
- 46:57And that is to establish a religion.
- 47:00The First Amendment does not describe what the state governments can do.
- 47:05It doesn't.
- 47:06And for this judge to say, oh, the Texas, they can't.
- 47:11They can issue 10 commandments.
- 47:13They're people, they can't vote their legislature into office and then have their state legislature require the Ten Commandments to be posted in public schools in Texas.
- 47:24That violates the First Amendment establishment clause.
- 47:28It's it's completely upside down and backwards.
- 47:32Uh there's there's nothing in the in the law.
- 47:36There's nothing in the in the in the first amendment that says what the state of Texas can or cannot do.
- 47:41It's what the federal government can't do.
- 47:44Uh, the attorney general in Texas, Ken Paxton appealed the ruling to the Fifth Circuit the very next day.
- 47:53And then Paxton issued a legal advisory warning to to the school districts in the state of Texas, saying, Hey, this is still the law of the land.
- 48:02This is the law of the state of Texas, and you better obey the law.
- 48:08And then he went on to sue three school districts who who you know thumbed their noses at him.
- 48:14And he said, fine, I'm suing your hineies.
- 48:18A second district judge, then in November, Judge Orlando Garcia, uh, again granted a preliminary injunction calling on several school districts, uh specifically probably the school districts that the lawsuit pertained to.
- 48:37But he said, No, take down the display.
- 48:40Uh, and and he banned the school districts from from posting it, posting new displays.
- 48:47And again, he said that SB10 runs a foul of the establishment clause's prohibition on government endorsement of religion.
- 48:57This is a this is a judge here.
- 49:00This is a district judge.
- 49:00This is a district judge.
- 49:02Don't you think he understood?
- 49:02Don't you think he understood?
- 49:04Doesn't he have to know that what the First Amendment, what it restricts?
- 49:04Doesn't he have to know that what the first amendment?
- 49:08What it restricts, then it's the federal government.
- 49:09And it's the federal government.
- 49:12It's not the state government.
- 49:12It's not the state government.
- 49:15And even so, uh, don't uh I'm yelling.
- 49:15And even so, don't uh I'm yelling.
- 49:18I apologize.
- 49:18I apologize.
- 49:20My blood pressure is probably going up.
- 49:20My blood pressure is probably going up.
- 49:23And I'm starting to yell, okay.
- 49:23And I'm starting to yell, okay.
- 49:25I'm gonna dial it down.
- 49:25I'm gonna dial it down.
- 49:26I take it, I don't take any of it back.
- 49:26I take it, I don't take any of it back.
- 49:28I'm just I'm I apologize for.
- 49:28I'm just I apologize for yelling.
- 49:31I mean, you're a judge.
- 49:32You've got to understand the constitution, don't you?
- 49:36I mean, I'm I'm not a judge, I'm not a lawyer.
- 49:41I'm a I'm not even uh I wouldn't even, I couldn't even probably be classified as a as a historian.
- 49:47I more of a lay historian.
- 49:48I mean, I love history, and I love the constitution.
- 49:51You don't have to be a rocket scientist to read the constitution and understand what it means.
- 49:58You don't.
- 49:59I mean, we have constitutional lawyers, and you know, we have men and women who study this document and who study case law and you know, who dive into it, you know, head first, and and God bless these individuals.
- 50:13They um, you know, for the most part, I'm sure they're they're good people.
- 50:18But it, you know, all if you know how to read and you know how to comprehend, and you know how to do some research, you you can pretty much determine what the constitution says.
- 50:32You can determine what it means, and you know the Bill of Rights are shackles on the federal government.
- 50:39That's it, they're shackles on the federal government, they have nothing to do with the states at all whatsoever.
- 50:46But I mean, there are there be constitutional scholars that come along and say, well, I blah, it pertains to the blah blah blah blah blah.
- 50:53I mean, that that's fine.
- 50:54Uh, that's fine.
- 50:57But these two judges are wrong.
- 50:58I'm just telling you that right now, they're they're wrong.
- 51:02This is not uh a violation of the uh of the establishment clause.
- 51:08Well, yeah, I guess it violates the establishment clause the way those Marxist judges interpreted it in 1962 and 60 whatever.
- 51:19But if you look at an accurate historical original interpretation, it violates nothing, absolutely nothing.
- 51:30Uh uh Rabbi Nathan v.
- 51:33Alamo Heights Independent School District uh had oral arguments made to the full 17 judge panel in January that included both the Texas law and the Louisiana law, and at that point the court permitted the Louisiana law to proceed, and they've done the same thing here with Texas.
- 51:59And I just I mean the Supreme Court, do you honestly think that it's going to be any different?
- 52:06I don't.
- 52:08I don't.
- 52:09This hearing is likely going to go to the Supreme Court by next June.
- 52:13We'll probably have an answer by next June.
- 52:17That's my prediction.
- 52:19We will we will know that the Ten Commandments historically are a part of our nation's founding.
- 52:30And they should be on display in public school classrooms, not only in Texas, but he but in and in left blue states, they should be on display.
- 52:42Public school classrooms.
- 52:44This isn't a battle against anything other than morality.
- 52:53That's it.
- 52:53It's a fight against morality.
- 52:55There are people who don't want citizens to receive a true and a good uh and a excellent pure education.
- 53:05They don't want it.
- 53:06They want they want us dumb, they want us stupid, they want us mind controlled, they want us going out to be activists.
- 53:17That's what they want.
- 53:18They would rather send us out to the streets.
- 53:20Like what's gonna happen here on May 1st.
- 53:23They they literally want these students to go out to the streets and become activists.
- 53:32Let me just here, I'm I'm looking at the clock, right?
- 53:35I see we've got a few minutes.
- 53:36Let me just pull up here.
- 53:38Uh, this is Madison, Wisconsin.
- 53:41The Madison Metropolitan School District in Wisconsin sent out a message notifying parents that May 1st classes will be canceled.
- 53:51So teachers can join anti-ICE protests, so the teachers can protest the law in this country.
- 54:04That's that's happening in Madison.
- 54:07Um this report says almost 2,000 teachers in Charlotte, North Carolina are calling out to protest on May 1st.
- 54:15At least seven school districts, including two of the biggest in the state, have now canceled classes because they don't have enough staff to supervise the kids.
- 54:27This is the reality when teachers choose activism over work.
- 54:33Hang on, there might be one more here.
- 54:36This is oh, Winston Salem, Forsyth County Schools, and multiple other North Carolina school districts are canceling classes on Friday, May 1st.
- 54:49Um teachers at Santa Fe High School passed out flyers, encouraging students to protest, uh, or I'm sorry, encouraging students to march out of school on May 1st in order to protest, in order to protest the actual law in this country, you know, we used to take pride in teaching the law.
- 55:17Lincoln's address to the young men's lyceum was just that.
- 55:21It was uh we need to teach the law.
- 55:24That needs to be our focus.
- 55:27We need to teach the constitution.
- 55:29That's what that's what Lincoln told him.
- 55:32Uh we used to we used to make it a uh an important feature in American education that we would raise God-fearing law-abiding citizens, and it's just not the case anymore.
- 55:47It's not the case.
- 55:48This system doesn't want to educate young people, it wants them to become activists, activists against the actual law.
- 55:59And I'm telling you, it's a problem.
- 56:00Telling you it's a problem.
- 56:01It is, it's a big problem.
- 56:01It is, it's a big problem.
- 56:03And I would encourage you if you if your school district is planning to go out, if your child is in a school district that is canceling school to go protest the law in this country, then um I'm not telling you what to do, but I'd I'd pull my child out of that school district so fast, heads would spin.
- 56:03And I would encourage you if you if your school district is planning to go out, if your child is in a school district that is canceling school to go protest the law in this country, then um I'm not telling you what to do, but I I'd I'd pull my child out of that school district so fast heads would spin.
- 56:28I'd do it.
- 56:28I'd do it.
- 56:29I'm telling you.
- 56:29I'm telling you, but you know what?
- 56:30You are your own.
- 56:32You're your own citizen.
- 56:33You're gonna do what you're gonna do.
- 56:34All I can do is encourage you to do what's right.
- 56:38All right, my friends, that's it.
- 56:40We are out of time.
- 56:41Thank you for joining us today.
- 56:42Encourage your friends and family, as always, to get on the dean's list.
- 56:47Let's unite to renovate the age.
