Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode, we're spinning back out to Idaho and we're
- 0:06Speaker 1: gonna check in on what went down on day number
- 0:08Speaker 1: 26 of the Chad Daybell trial. This article was published
- 0:13Speaker 1: by eastidahonews.com and the author of this article is Nate Eaton. 8.30 a.m.,
- 0:20Speaker 1: we are in the courtroom and there was a huge
- 0:22Speaker 1: crowd of people hoping to get into the trial today,
- 0:24Speaker 1: more than we have ever seen. Many are being turned
- 0:27Speaker 1: away due to not enough seats. 8.31 a.m. Chad Daybell
- 0:31Speaker 1: looks like he got a haircut over the weekend. He's
- 0:33Speaker 1: sitting next to Pryor. Prosecutor Lindsey Blake, Rob Wood, Ingrid Beatty,
- 0:38Speaker 1: Rocky Wixom are at their table. The bailiff is giving
- 0:42Speaker 1: instructions to everyone in the gallery to turn phones off,
- 0:45Speaker 1: no whispering, no symbolic wristbands or shirts, and no hats. 8.38 a.m.
- 0:51Speaker 1: Judge Stephen Boyce is on the bench. He says the
- 0:54Speaker 1: state has concluded its case in chief and the defense
- 0:57Speaker 1: will now present its case. Boyce says he has one
- 0:59Speaker 1: issue to address on the record before the jurors are
- 1:03Speaker 1: brought in. 8.40 a.m. Boyce says the clerical error on
- 1:07Speaker 1: the indictment will be addressed with a jury instruction. Jurors
- 1:10Speaker 1: can consider the date on the original indictment when they deliberate.
- 1:14Speaker 1: Boyce says his staff attorney, Courtney Stallings, discovered the error
- 1:17Speaker 1: on the indictment and she is preparing the jury instructions.
- 1:21Speaker 1: A jury instruction conference will be held before deliberations. 8.42 a.m.
- 1:27Speaker 1: Pryor says he's ready to call a witness. Jurors are
- 1:30Speaker 1: being brought in. 8.44 a.m. Pryor calls Emma Murray, Chad
- 1:35Speaker 1: Daybell's daughter, to the stand. 8.45 a.m. Emma's married to
- 1:40Speaker 1: Joseph Murray. Pryor asks if she received a subpoena from
- 1:43Speaker 1: the prosecutor or the defense. She says she received one
- 1:46Speaker 1: from both. Emma says she has not watched the trial.
- 1:49Speaker 1: Oh yeah, sure. I believe that. 8.47 a.m. Emma says
- 1:53Speaker 1: she has spoken to John Pryor three times in preparation
- 1:56Speaker 1: for the trial. including last night, she says she's prepared
- 2:00Speaker 1: to tell the truth. What truth? The arbitrary truth or
- 2:04Speaker 1: the actual truth? Because your testimony doesn't have too much
- 2:08Speaker 1: truth included, in my opinion. 8.48 a.m. Emma lives at
- 2:14Speaker 1: the house where her father used to live. She says
- 2:16Speaker 1: she has made a financial arrangement with her father to
- 2:19Speaker 1: live at the house, and she doesn't know what Chad
- 2:21Speaker 1: has arranged with Pryor. Emma says her mother, Tammy Daybell's health,
- 2:25Speaker 1: Started declining within the last year of her life. She
- 2:28Speaker 1: was always one to meet the demands of daily life
- 2:31Speaker 1: without being exhausted. And she started going to bed before
- 2:34Speaker 1: dinner some nights. It would be like 5, 6, 7
- 2:37Speaker 1: o'clock at night and she would sleep in a lot. 8.49 a.m.
- 2:41Speaker 1: Emma has sleep apnea and her grandfather does as well.
- 2:44Speaker 1: She wonders if Tammy did too. Tammy also had anemia.
- 2:48Speaker 1: She preferred herbal supplements and took the generic form of Prozac. 8.51 a.m.
- 2:55Speaker 1: Emma says her mom took colloidal silver and Tammy would
- 2:58Speaker 1: encourage others who were sick to take it. Emma says
- 3:01Speaker 1: her mom bruised easy and used Arnica gel to treat bruises.
- 3:05Speaker 1: If she were bumper hip on the counter when she
- 3:08Speaker 1: was walking by, she would get a massive bruise from that.
- 3:11Speaker 1: And if you drink enough of that colloidal silver, you're
- 3:13Speaker 1: going to turn blue. So I highly doubt that drinking
- 3:17Speaker 1: colloidal silver is a good way to go. Probably a
- 3:20Speaker 1: good idea to just go get some cough medicine or something, no? 8.53 a.m.
- 3:26Speaker 1: Pryor asks about October 18th, 2019, the day before Tammy died.
- 3:30Speaker 1: Emma says her mom was preparing for a book fair.
- 3:33Speaker 1: She says her mom worked in a computer lab at
- 3:35Speaker 1: the school and in the library. Emma says her mom
- 3:38Speaker 1: was an introvert at the core. She would be friendly
- 3:41Speaker 1: and small talk with people in general. She didn't confide
- 3:44Speaker 1: with people. But it doesn't fix the fact or change
- 3:48Speaker 1: the fact that Tammy seemed to be relatively healthy. Everybody
- 3:52Speaker 1: she worked with is saying it, Everybody she came into
- 3:54Speaker 1: contact with is saying it, and we have no doctor's
- 3:58Speaker 1: reports telling us otherwise. 8.55 a.m. Emma says she visited
- 4:02Speaker 1: her mom in her classroom any chance she got. Emma
- 4:05Speaker 1: says she never saw her mom talk about her health
- 4:07Speaker 1: with co-workers. Emma says her mother was a very private person.
- 4:11Speaker 1: Tammy didn't want to miss work. She wanted to go
- 4:14Speaker 1: every day. She was paid by the hour, so financially,
- 4:17Speaker 1: it was important that she go to work. Yeah, like
- 4:20Speaker 1: everybody else in the world. But if you're sick, you're
- 4:23Speaker 1: not going to work, especially if you're sick enough that
- 4:25Speaker 1: you just drop dead. Chances are you're not showing up
- 4:28Speaker 1: to work and everything's peachy, right? Some of your co-workers
- 4:31Speaker 1: are going to recognize that something might be wrong. Hey,
- 4:34Speaker 1: so-and-so's off. Have you taken a look at their skin tone?
- 4:37Speaker 1: They look pale or whatever it might be. We've heard
- 4:40Speaker 1: none of that. 8.56 a.m. Emma says as her mom
- 4:45Speaker 1: prepared for the book fair, she overloaded some boxes and
- 4:48Speaker 1: carried them as she rested them against her arms. Emma
- 4:52Speaker 1: noticed her mom needing help, so Emma stepped out of
- 4:54Speaker 1: a meeting to help her. Tammy drove her parents Dodge
- 4:57Speaker 1: Dakota to work that day. Emma says her dad was
- 5:00Speaker 1: the primary driver of the Dakota. Tammy drove the Chevy Equinox. 8.58 a.m.
- 5:06Speaker 1: The Dodge Dakota was sold to Emma and her husband.
- 5:09Speaker 1: They still drive it. Pryor asks about Tammy's Fitbit, which
- 5:13Speaker 1: would counter steps. Tammy wore the watch during the day
- 5:16Speaker 1: and charged it at night. Emma says her mom got
- 5:18Speaker 1: the Fitbit to increase her physical fitness. Emma says Tammy
- 5:22Speaker 1: and Emma both had a Fitbit and Tammy bought one
- 5:25Speaker 1: for Chad but he wouldn't wear it. 8.59 a.m. Emma's
- 5:29Speaker 1: in-laws were having a step competition with Tammy to see
- 5:32Speaker 1: who could get the most steps on Fitbit. Tammy wanted
- 5:35Speaker 1: to win. Blake objects to a question and asked Emma
- 5:38Speaker 1: about a conversation with her father where Chad told Emma
- 5:42Speaker 1: that Tammy would swing her arm off the bed to
- 5:44Speaker 1: get steps. Emma doesn't recall the conversation. Emma says her
- 5:48Speaker 1: mom would often swing her arm to get steps. 9.02 a.m.
- 5:51Speaker 1: Prior asked about Tammy training for a 5K race. Emma
- 5:55Speaker 1: says she was training for a race and invited her
- 5:57Speaker 1: mom to run in the race, but Tammy said she
- 6:00Speaker 1: would not do it. Joseph, Emma's husband, organized a 5K
- 6:03Speaker 1: for Operation Underground Railroad and Tammy helped plan it. 9.04 a.m.
- 6:08Speaker 1: Prior asked Emma about her mom taking clogging and Zumba
- 6:11Speaker 1: fitness classes. Emma says she and her mom were both
- 6:15Speaker 1: overweight and wanted to exercise more. Some ladies at the
- 6:18Speaker 1: school invited Tammy and Emma. to come to the class
- 6:21Speaker 1: at the local elementary school gym. They started going in
- 6:24Speaker 1: April of 2019. 9.06 a.m. Emma says the idea of
- 6:29Speaker 1: the Zumba high fitness class is you can participate to
- 6:32Speaker 1: your comfort level. She describes the instructor being on stage
- 6:36Speaker 1: and people in the class mimicking the instructor's movements. Lights
- 6:39Speaker 1: were dimmed and the party lights were turned on so
- 6:42Speaker 1: nobody could see how you were doing. Emma and Tammy
- 6:45Speaker 1: would be in the back of the room. 9.08 a.m.
- 6:48Speaker 1: The clogging classes took place once a week on Wednesdays.
- 6:52Speaker 1: Emma and Tammy went for about six weeks. They started
- 6:55Speaker 1: going about six weeks before Tammy died. 9.09 a.m. Pryor
- 7:00Speaker 1: asks if Tammy had any self-defense skills. Emma says nothing formal,
- 7:04Speaker 1: but occasionally there would be classes at church about self-defense.
- 7:08Speaker 1: Pryor asks about life insurance, and Emma says the insurance
- 7:11Speaker 1: companies came to the school one day to speak about
- 7:13Speaker 1: increasing life insurance. It was really cheap insurance and they
- 7:16Speaker 1: encouraged us to purchase some, so both my mother and
- 7:19Speaker 1: I purchased some. 9.11 a.m. Pryor asks Emma if Tammy
- 7:23Speaker 1: consulted with Chad before she increased the insurance. Emma says
- 7:27Speaker 1: they filled out the paperwork together. We both signed to
- 7:29Speaker 1: take out more life insurance on ourselves and did not
- 7:32Speaker 1: consult with our husbands, Emma says. Emma did not take
- 7:36Speaker 1: out the maximum because she could not afford it, but
- 7:38Speaker 1: Tammy checked the box. 9.12 a.m. The day before Tylee died,
- 7:43Speaker 1: Emma says she did a search on Chad's desktop computer
- 7:46Speaker 1: for South Southwest Winds because they were planning an outdoor event.
- 7:51Speaker 1: I was trying to be an amateur meteorologist, Emma says.
- 7:54Speaker 1: Emma says there wasn't a login or anything. She just
- 7:56Speaker 1: jumped online. This is in reference to the search done
- 7:59Speaker 1: the day before Tylee was buried on the property. 9.14 a.m.
- 8:04Speaker 1: Pryor asks about the roles of Chad and Tammy in
- 8:06Speaker 1: the book publishing company. Emma says Tammy would help design
- 8:09Speaker 1: book covers. She did most of them by herself. and
- 8:13Speaker 1: she did the finances and taxes for the company. Chad
- 8:16Speaker 1: would try and find authors to have their books published. 9.16 a.m.
- 8:20Speaker 1: Pryor asks about the house. It's a brick house and garage,
- 8:23Speaker 1: and Pryor asks if it's one story. Emma says the
- 8:26Speaker 1: previous owner constructed a building over the pump house. She
- 8:30Speaker 1: says it's unheated, and it's built from a different material.
- 8:33Speaker 1: There isn't much electricity that goes to it, she says.
- 8:36Speaker 1: Emma says it's called the Cozy Cone. 9.17 a.m. Emma
- 8:40Speaker 1: says all the kids would play musical instruments in the
- 8:42Speaker 1: cozy cone. Her sister Leah would go up there to
- 8:45Speaker 1: study sometimes. You have to go through the garage to
- 8:48Speaker 1: get to the cozy cone. It was really inconvenient to
- 8:50Speaker 1: get there, Emma says. 9.18 a.m. Pryor asks Emma how
- 8:55Speaker 1: she describes her father's faith. He wanted to stick as
- 8:58Speaker 1: close to the original form as he could. He was
- 9:00Speaker 1: really interested in the teachings from Joseph Smith and Brigham
- 9:03Speaker 1: Young and other earlier leaders, Emma says. She describes them
- 9:08Speaker 1: as a fundamental. Emma says she didn't necessarily share her
- 9:11Speaker 1: dad's religious beliefs, but shared some. 9.19 a.m. Prior asks
- 9:16Speaker 1: Emma if her brothers and sisters share their dad's religious beliefs.
- 9:20Speaker 1: She says there are elements they might feel drawn to,
- 9:23Speaker 1: but not others. Prior asks Emma her views on the
- 9:26Speaker 1: concept of light and dark. Emma says good and evil
- 9:28Speaker 1: would be talking about your actions, while light and dark
- 9:31Speaker 1: would be motivations. Light, you're acting like the savior. Dark,
- 9:35Speaker 1: you're acting like Satan. Yeah, she believes all the same
- 9:38Speaker 1: shit her dad believes. I don't buy one single thing
- 9:41Speaker 1: Emma has to say. And frankly, that's how I feel
- 9:44Speaker 1: about the whole Last Daybell clan. 9.21am Emma says her
- 9:49Speaker 1: mother would frequently assign numbers to people as to whether
- 9:52Speaker 1: they were light or dark. Emma says her mom was
- 9:54Speaker 1: more fundamental than her dad as far as religious beliefs.
- 9:57Speaker 1: I don't buy that either. 9.22 a.m. Emma has struggled
- 10:01Speaker 1: with anxiety for years and says it was feeling unmanageable.
- 10:06Speaker 1: It felt like there was a being that was with me.
- 10:09Speaker 1: I talked to my parents about it and my dad
- 10:11Speaker 1: cast it out using the power of the priesthood. Then
- 10:13Speaker 1: I felt better afterwards. Pryor says She says it was
- 10:17Speaker 1: the power of God through the laying on of hands. Yeah,
- 10:21Speaker 1: she doesn't believe any of this stuff, though. What sort
- 10:24Speaker 1: of normal person thinks that their dad can lay their
- 10:26Speaker 1: hands on you and get rid of your anxiety? I'll
- 10:29Speaker 1: tell you who. Someone who's in a cult. 9.22 a.m.
- 10:33Speaker 1: Pryor asked about Emma learning her dad had a relationship
- 10:36Speaker 1: with another woman. Emma says it was not an appropriate relationship.
- 10:40Speaker 1: Prior asks if she would agree that nobody is perfect.
- 10:43Speaker 1: Emma agrees. Nobody is perfect. Yeah, that's true. But most
- 10:47Speaker 1: people aren't out here killing their new wife's kids or
- 10:50Speaker 1: killing their own wife to be with the new Skifuza.
- 10:53Speaker 1: So there's that. 9.23 a.m. Emma says any man who
- 10:58Speaker 1: is an adult and makes promises to keep teachings of
- 11:01Speaker 1: the church with the power to serve other people can
- 11:04Speaker 1: receive the priesthood. It wasn't unique to her father. Emma
- 11:07Speaker 1: says it's common for people in her faith to give
- 11:10Speaker 1: blessings as long as they are eligible to have the priesthood. 9.25 a.m.
- 11:15Speaker 1: Prior stresses it's men who give blessings to other people.
- 11:19Speaker 1: Emma says in the times of Joseph Smith, women gave
- 11:21Speaker 1: blessings too. Emma says after her dad gave her blessing
- 11:25Speaker 1: when she was struggling, I instantly felt better. I felt
- 11:28Speaker 1: the individual that was trying to affect my body was gone.
- 11:31Speaker 1: Emma says. 9.26 a.m. Prior asks if after the spirit
- 11:35Speaker 1: was cast out, she died. Emma says no. The goal
- 11:38Speaker 1: is so you have your own body back and can
- 11:41Speaker 1: be in control of yourself, she says. Prior asks if
- 11:44Speaker 1: she has ever heard the word zombies. Emma says just
- 11:46Speaker 1: on TV. The jury is focused intently on this testimony. 9.27 a.m.
- 11:52Speaker 1: Prior asks about the emotion code and if her parents
- 11:55Speaker 1: used it. Blake objects based on relevance. Boyce sustains. Prior
- 11:59Speaker 1: asks Emma if she believes her mom and dad could
- 12:01Speaker 1: sense whether a person was light or dark. Emma says yes. Colt.
- 12:05Speaker 1: This whole entire family was a cult. 9.28 a.m. Emma
- 12:10Speaker 1: says her mom learned about muscle testing and reflexology as
- 12:13Speaker 1: a child from her parents. She learned more about it
- 12:16Speaker 1: later in life. Emma says both her parents learned about it,
- 12:19Speaker 1: but Tammy was more skilled at it. 9.29 a.m. Emma
- 12:24Speaker 1: says her dad wrote fiction and non-fiction books. He gained
- 12:27Speaker 1: most of his inspiration from the more traditional Latter-day Saint
- 12:30Speaker 1: church and his own ideas, Emma says. Emma says her
- 12:34Speaker 1: dad wanted to teach about the future with fictional characters. 9.30 a.m.
- 12:40Speaker 1: Emma did not interpret her dad's books to be scripture.
- 12:43Speaker 1: Emma says her dad is very introverted, like her mom.
- 12:46Speaker 1: Prior asks if they were going to be more bookworm type.
- 12:49Speaker 1: Emma says yes. Her dad enjoyed speaking in front of
- 12:52Speaker 1: the groups and teaching, but not necessarily talking one-on-one with people.
- 12:56Speaker 1: Talking in front of people had a different energy about it,
- 12:59Speaker 1: Emma says. 9.32 a.m. Pryor asks Emma if her mom
- 13:03Speaker 1: is familiar with paintball guns. Emma says it's a common
- 13:07Speaker 1: recreational thing. Her mom may not have enjoyed going, but
- 13:10Speaker 1: she did. Tammy had an older brother and uncle who
- 13:13Speaker 1: liked to do adventurous things. Pryor asked about the events
- 13:16Speaker 1: of October 9th. Tammy dropped Emma off from her clogging
- 13:19Speaker 1: class and then immediately went home that night. Tammy posted
- 13:22Speaker 1: on Facebook about the incident, so Emma called her immediately.
- 13:26Speaker 1: She was very sure that it was a paintball gun,
- 13:28Speaker 1: Emma says. 9.34 a.m. Pryor asked Emma when she arrived
- 13:33Speaker 1: at her parents' home the day Tammy died. She arrived
- 13:36Speaker 1: before 7 a.m. Coroner Dye was inspecting my mom's body,
- 13:40Speaker 1: and she asked us some questions about our wishes. She
- 13:42Speaker 1: offered an autopsy in the area where we lived in.
- 13:45Speaker 1: The body would have to be taken to Boise, which
- 13:47Speaker 1: is about five hours away. It would delay the funeral.
- 13:51Speaker 1: Emma says, I don't think autopsy should be done on anyone.
- 13:54Speaker 1: The idea of my mother's body undergoing that was very
- 13:57Speaker 1: distressing to me. More distressing than her just dying overnight, huh?
- 14:01Speaker 1: This BS right here tells me everything I need to
- 14:04Speaker 1: know about Emma. 9.35 AM. Emma says her dad was
- 14:07Speaker 1: very distressed and not speaking at the moment. Emma told
- 14:11Speaker 1: the coroner she did not want an autopsy. Emma says
- 14:13Speaker 1: her dad nodded. Pryor asks if Chad ever expressed an
- 14:16Speaker 1: opinion on whether he wanted an autopsy or not. He
- 14:20Speaker 1: never expressed an opinion, Emma says. She says her dad
- 14:23Speaker 1: was more distressed than she was or had ever seen
- 14:26Speaker 1: him in his entire life. 9.37 a.m. Emma says her
- 14:30Speaker 1: dad was emotionally out of control and she has never
- 14:33Speaker 1: seen him so upset. I know the grief he felt
- 14:36Speaker 1: was real. He may not have had the same romantic
- 14:38Speaker 1: relationship with my mother that he had in the past,
- 14:41Speaker 1: but I knew he valued her as a person and
- 14:43Speaker 1: seeing her die was very traumatic, Emma says. Well, here's
- 14:46Speaker 1: an idea. He shouldn't have killed her. That would have
- 14:49Speaker 1: settled it all, huh? 9.38 a.m. Pryor asks about the
- 14:53Speaker 1: trip to California over Thanksgiving break. Chad, Emma, her husband...
- 14:57Speaker 1: Their son, Leah, her husband, their son, and Garth were
- 15:01Speaker 1: on the trip. They left Rexburg and drove to the
- 15:03Speaker 1: Salt Lake Airport. They then flew to California and went
- 15:07Speaker 1: to Knott's Berry Farm. The trip was just for a
- 15:09Speaker 1: few days. Chad was then going to live temporarily in Hawaii,
- 15:14Speaker 1: Emma says. Imagine this BS. Your dad says to you
- 15:17Speaker 1: right after your mom dies, I'm going to move to Hawaii.
- 15:20Speaker 1: No big deal. Did I tell you that I'm moving
- 15:22Speaker 1: in with some skafooza, though? And then these kids are
- 15:25Speaker 1: still riding on Team Chad. Okay, I guess. 9.40 a.m.
- 15:31Speaker 1: Lori Vallow was also on the trip. Emma doesn't know
- 15:34Speaker 1: where Lori left from, but she arrived in California by
- 15:37Speaker 1: vehicle later on. Defense and prosecutors arguing over an issue,
- 15:41Speaker 1: morning break time, back in 20 minutes. All right, so
- 15:44Speaker 1: this is where we're going to wrap as well, and
- 15:46Speaker 1: in the next episode, we're going to pick up where
- 15:47Speaker 1: we left off. All of the information that goes with
- 15:50Speaker 1: this episode can be found in the description box. What's up, everyone,
- 15:54Speaker 1: and welcome back to the program. In this episode, we're
- 15:57Speaker 1: getting right back to the Chad Daybell trial, and we're
- 16:00Speaker 1: going to pick up where we left off on day
- 16:02Speaker 1: number 26. Once again, the article was published by EastIdahoNews.com,
- 16:09Speaker 1: and the author of this article is Nate Eaton. 10.14 a.m.
- 16:13Speaker 1: We're back in the courtroom. 10.17 a.m. Judge Boyce is
- 16:17Speaker 1: back on the bench. He's taking up an issue outside
- 16:20Speaker 1: the presence of the jury whether the statement Vallow made
- 16:23Speaker 1: on the trip to California with Daybell family constitutes hearsay
- 16:26Speaker 1: or not. 10.20 a.m. Both sides argue their positions and
- 16:31Speaker 1: calls this an interesting issue. Suddenly, the jurors start walking
- 16:35Speaker 1: in and Boyce asks that they leave. Court isn't ready
- 16:38Speaker 1: for them yet. Boyce sustains Blake's objection about statements made
- 16:42Speaker 1: by Lori Vallow unless they are within the very narrow exceptions.
- 16:45Speaker 1: Pryor asks if the court is excluding Emma from testifying
- 16:49Speaker 1: about what Lori Vallow told her. Boyce says his ruling
- 16:52Speaker 1: is limited to the line of questions that came up
- 16:54Speaker 1: so further objections, exceptions, would need to be taken up
- 16:58Speaker 1: as they arise. 10.24 a.m. Emma walks into the courtroom.
- 17:03Speaker 1: To the witness stand, jurors walk in. Pryor continues to
- 17:06Speaker 1: question about Lori traveling separately to California. Pryor asks if
- 17:10Speaker 1: the location of the children was ever discussed. Emma says yes.
- 17:14Speaker 1: From my understanding, I was told the children were in
- 17:17Speaker 1: a safe place. Emma says yes. Yeah, we know what
- 17:19Speaker 1: Lori Vallow meant by that, and we also know that
- 17:22Speaker 1: your disgusting-ass dad knew what was going on as well. 10.30 a.m.
- 17:27Speaker 1: Pryor asks about planning of Tammy's funeral service. Emma says
- 17:31Speaker 1: they met with someone at Flam Funeral Home. They gave
- 17:34Speaker 1: us the choice of Tuesday or Saturday. There were other
- 17:37Speaker 1: customers the funeral home was helping. Those were the only
- 17:40Speaker 1: days available for the funeral home to help, Emma says.
- 17:44Speaker 1: Emma says there was a family discussion over whether to
- 17:47Speaker 1: have the funeral or on Tuesday or on Saturday. 10.32 a.m.
- 17:52Speaker 1: Emma says his decision to have the funeral in Springville
- 17:55Speaker 1: seemed natural because Tammy lived there most of her life
- 17:58Speaker 1: and there was a family gravesite plot. Emma says Tammy
- 18:01Speaker 1: loved to nurture things, gardening, taking care of plants, etc.
- 18:05Speaker 1: She liked ducks, rabbits, and chickens. 10.33 a.m. Emma says
- 18:10Speaker 1: if anything was modified in the pet cemetery, Tammy would know.
- 18:13Speaker 1: Pryor begins to ask about an email that's been all
- 18:16Speaker 1: over the news. and Boyce asks for a sidebar. Sidebar over,
- 18:20Speaker 1: and Prior asks about the raccoon text message. Emma says
- 18:24Speaker 1: she is aware of it. 10.35 a.m. Prior asks if
- 18:27Speaker 1: Emma has encountered animals on the property, and if those
- 18:31Speaker 1: animals were buried after being shot. Prior asks if she
- 18:34Speaker 1: has knowledge about animals being shot on her dad's property.
- 18:37Speaker 1: There were a lot of cats. We live right by
- 18:39Speaker 1: a busy highway, so all throughout, there's stray cats that
- 18:42Speaker 1: get hit. My mother would feel bad for them, and
- 18:45Speaker 1: they weren't even our cat, and they would get buried,
- 18:48Speaker 1: Emma says. Dogs, chickens, ducks, raccoons, sometimes sparrows too, Emma says,
- 18:53Speaker 1: were buried in the pet cemetery. And from everything I
- 18:56Speaker 1: hear about Tammy, she seems like a very nice woman, right?
- 19:00Speaker 1: Certainly someone who didn't deserve this fate, especially at the
- 19:02Speaker 1: hands of these monsters. 10.37 a.m. Pryor asks Emma if
- 19:06Speaker 1: her father owned a dog. My father did not own
- 19:09Speaker 1: a dog. He doesn't like dogs. That tells me everything
- 19:12Speaker 1: I need to know about Chad Daybell. Who the hell
- 19:14Speaker 1: doesn't like dogs? Emma had a dog across the street.
- 19:18Speaker 1: Pryor wants to talk about Emma's feelings with law enforcement.
- 19:21Speaker 1: I was aware of an event that had happened with
- 19:23Speaker 1: my brother, and I wanted to learn more about it,
- 19:25Speaker 1: so I contacted the same detective that had contacted him,
- 19:28Speaker 1: Emma says. Emma says the detective was Dave Hope. 10.39 a.m.
- 19:33Speaker 1: Emma asks Hope about her mother being exhumed. He told
- 19:36Speaker 1: her that it had already happened and it was the
- 19:39Speaker 1: first time she had heard about it. Pryor asks Emma
- 19:41Speaker 1: if she was ever misled about the exhumation. Emma says no.
- 19:45Speaker 1: Pryor asks the same question. Emma says she doesn't understand
- 19:49Speaker 1: the question. 10.41 a.m. Pryor asks if Emma felt like
- 19:53Speaker 1: she was under scrutiny as part of this case. She
- 19:55Speaker 1: says yes. Any interaction with law enforcement? Emma went to
- 19:59Speaker 1: exercise with her sister-in-law and they were in a section
- 20:02Speaker 1: of the gym when Detective Hermosillo came to start exercising
- 20:06Speaker 1: near them. It seemed like part of the gym that
- 20:08Speaker 1: would have been too easy for him, Emma explains. He
- 20:12Speaker 1: was standing closer to us than felt comfortable, and it
- 20:14Speaker 1: felt like he was trying to listen in on our conversation.
- 20:18Speaker 1: Oh yeah, I'm sure he was there trying to just
- 20:20Speaker 1: glean a bunch of information from you, Emma. Imagine being
- 20:23Speaker 1: this obtuse, with your mother laying in her grave, and
- 20:26Speaker 1: your father being charged with her murder. 10.42am. Emma says
- 20:31Speaker 1: a detective from Madison County confronted her in the hallway
- 20:34Speaker 1: at church, and it was really uncomfortable. She says after
- 20:37Speaker 1: the incident, she never went back to the congregation. 10.43 a.m.
- 20:41Speaker 1: Pryor asks if Emma met with Detective Hope at her school.
- 20:44Speaker 1: Emma says yes. She met with him one time. I
- 20:47Speaker 1: wanted to ask him what was going on, why he
- 20:49Speaker 1: was contacting members of my family. He was asking where
- 20:53Speaker 1: my dad was. We gave him my dad's phone number
- 20:55Speaker 1: and told him he was in Hawaii, but they said
- 20:58Speaker 1: they had no way of contacting him. That seemed untrue. 10.45 a.m.
- 21:02Speaker 1: Pryor asks about June 9th, the day Chad was arrested.
- 21:05Speaker 1: Pryor asks about the police car footage that showed the
- 21:08Speaker 1: conversation between Emma and Chad. Pryor asks how the car
- 21:11Speaker 1: was parked. He asks if someone was to look out
- 21:14Speaker 1: the right side of the car window, what would you
- 21:16Speaker 1: be looking at? Emma says the house. Pryor asks if
- 21:19Speaker 1: someone was looking out the other side, what would they
- 21:22Speaker 1: be looking at? Emma says whatever was behind the car,
- 21:25Speaker 1: but she says not the property. 10.46 a.m. Pryor asks
- 21:29Speaker 1: Emma if she observed Chad leaving at a high rate
- 21:32Speaker 1: of speed when he left the house that day. She
- 21:34Speaker 1: says the speed limit is 50, and she saw him
- 21:37Speaker 1: drive that speed. Now, how in the hell is she
- 21:39Speaker 1: supposed to know how fast he's going? Spoiler alert, she
- 21:42Speaker 1: has no idea. Pryor asks who Chad was going to see.
- 21:46Speaker 1: Blake objects on hearsay grounds. Pryor suggests he was going
- 21:49Speaker 1: to see a lawyer. Blake objects, judge sustains it, and
- 21:52Speaker 1: the questions and answers are struck from the record. 10.48 a.m.
- 21:57Speaker 1: Pryor asks her father's emotions on the day of her
- 21:59Speaker 1: mother's funeral, typical for any grieving Latter-day Saint husband. Latter-day
- 22:04Speaker 1: Saints believe we will be resurrected and with our families forever.
- 22:08Speaker 1: A funeral isn't saying goodbye forever. It's a see you later.
- 22:11Speaker 1: It's a break, Emma says. She says she cried, or
- 22:14Speaker 1: he cried, but also laughed and smiled at times. 10.49 a.m.
- 22:19Speaker 1: Prior is done. Blake will now cross-examine. 10.50 a.m. Blake
- 22:24Speaker 1: begins by reminding Emma that she promised to tell the truth.
- 22:27Speaker 1: Blake tells Emma that she has spoken with her dad
- 22:30Speaker 1: almost daily. Emma says that's true. Blake reminds Emma that
- 22:34Speaker 1: in early 2020, Chad told Emma not to cooperate with
- 22:37Speaker 1: law enforcement. Emma no longer met with the FBI. Well,
- 22:41Speaker 1: that's what happens in cults. When the prophet, or in
- 22:44Speaker 1: this case, do not, Chad Daybell tells you not to
- 22:47Speaker 1: do something, all these little lemmings did whatever he said.
- 22:50Speaker 1: He doesn't want you to talk to the cops? Okay,
- 22:52Speaker 1: no talking to the cops. And you see, Chad Daybell's
- 22:55Speaker 1: kids fall in line. 10.52 a.m. Blake asks if Emma
- 22:59Speaker 1: recalls talking to her dad about the 5K race. and
- 23:02Speaker 1: her dad saying certain things. Emma doesn't recall. Blake asks
- 23:05Speaker 1: about her dad telling Emma about Zumba. She says her
- 23:08Speaker 1: dad has never told her to say anything. 10.53 a.m.
- 23:13Speaker 1: Blake asks if it would surprise Emma to learn that
- 23:15Speaker 1: there was no mention of the anemia in her medical records.
- 23:19Speaker 1: She visited the doctor in 2019 and no mention of
- 23:22Speaker 1: anemia or sleep apnea. Emma says she isn't surprised that
- 23:26Speaker 1: there is no mention in her medical records. 10.54 a.m.
- 23:30Speaker 1: Blake asked if Emma would visit her mom when she
- 23:32Speaker 1: was going to bed. Blake asked if she knew what
- 23:35Speaker 1: Tammy would do with the Fitbit every night. Emma says
- 23:38Speaker 1: she saw her several times with the Fitbit. Blake asked
- 23:41Speaker 1: if it would surprise Emma to learn on October 18th
- 23:44Speaker 1: there was activity on Tammy's phone past 10. Blake asked
- 23:48Speaker 1: Emma if she was there that night. Emma says she
- 23:51Speaker 1: only knows what she was told about Tammy being sick
- 23:54Speaker 1: and throwing up that night. She wasn't there. 10.56 a.m.
- 23:58Speaker 1: Blake asks why her husband had to get the keys
- 24:01Speaker 1: to the truck from Tammy. Emma says he wanted to
- 24:04Speaker 1: borrow the truck for a potato harvest, and Tammy had
- 24:06Speaker 1: the keys and he was closest to it. Blake asks
- 24:09Speaker 1: Emma about Tammy playing on the Wii. It was an
- 24:11Speaker 1: exercise game. Emma says she did it a lot in
- 24:15Speaker 1: 2018 and earlier. Fair to say your mom enjoyed physical activities,
- 24:18Speaker 1: Blake asks. Emma responds she enjoyed video games. She also
- 24:22Speaker 1: liked farming and Pokemon games. 10.57 a.m. Emma says Tammy
- 24:28Speaker 1: was not training for a 5K. Would it surprise you
- 24:31Speaker 1: that other people said she was? Blake asks. Emma says no.
- 24:34Speaker 1: Blake asks if Emma was privy to all her parents' conversations.
- 24:38Speaker 1: Emma says no. Blake asks about her mom taking out
- 24:41Speaker 1: life insurance policy and why Chad's signature would have been
- 24:44Speaker 1: on the form if Tammy filled it out alone. Emma
- 24:47Speaker 1: says Tammy took out the life insurance on Chad. Blake
- 24:50Speaker 1: asks for an exhibit. 11 a.m. Emma is given the
- 24:54Speaker 1: insurance form. Blake asks whose signatures are on the form.
- 24:57Speaker 1: Emma says Tamara Daybell and Chad Daybell. The date is 9-8-19.
- 25:03Speaker 1: This was the only insurance for Tammy. 11-01-AM. Blake shows
- 25:08Speaker 1: the form on the big screen. She asks what company
- 25:10Speaker 1: the insurance is through. It's through LifeMap and the amount
- 25:14Speaker 1: is for $ 80, 000. Blake shows the signatures on the form
- 25:17Speaker 1: to the jury. 11-02-AM. Blake asks if her parents could
- 25:21Speaker 1: access each other's accounts because they shared passwords. Emma says yes.
- 25:26Speaker 1: Blake asks if her dad could block, access, or delete
- 25:29Speaker 1: emails on Tammy's accounts. If he knew how, Emma says. 11.03 AM.
- 25:34Speaker 1: Blake asks Emma if she ever saw her mom with
- 25:36Speaker 1: a paintball gun, rifle, assault rifle, or any gun. Emma
- 25:40Speaker 1: says no. Emma says she learned her mom had been
- 25:43Speaker 1: exhumed on December 13th. Blake asks about Emma's meeting with
- 25:46Speaker 1: Detective Hope. Emma says Hope told her that they were
- 25:49Speaker 1: concerned about JJ's whereabouts and they were still looking for him.
- 25:53Speaker 1: Blake asked Emma when she saw Hermosillo at the gym.
- 25:56Speaker 1: She says it was after Chad was arrested in 2020. 11.05 a.m.
- 26:01Speaker 1: Blake asked Emma if she ever asked her dad where J.J.
- 26:04Speaker 1: Vallow was. Yes, he told me he was in a
- 26:06Speaker 1: safe place. Same question about Tylee. Yes, he told me
- 26:10Speaker 1: she was in a safe place. Blake asked where the
- 26:13Speaker 1: kids were found. In the backyard, my dad's property. Yo,
- 26:17Speaker 1: that is devastating right there. That's an absolute bombshell. Chad
- 26:21Speaker 1: says these kids are in a safe place and they
- 26:24Speaker 1: end up being buried in his backyard. 11.06 a.m. Blake
- 26:27Speaker 1: asks Emma if she happened to be searching for South,
- 26:30Speaker 1: Southwest Wind the day before Tylee was last seen alive.
- 26:33Speaker 1: The day before her dad sent her mom a message
- 26:36Speaker 1: about a raccoon on the property, Emma says yes. Emma
- 26:39Speaker 1: says her dad taught her about castings and her mom
- 26:42Speaker 1: did them too. Are you still alive, Blake asks. Emma
- 26:45Speaker 1: responds yes. Emma says her dad taught her about multi-creations
- 26:49Speaker 1: but didn't teach her about zombies. 11.09 a.m. Blake asks
- 26:54Speaker 1: if when her dad taught her about castings, he told
- 26:56Speaker 1: her anything about the body having to be destroyed or
- 26:59Speaker 1: it had to die. Emma says no. Emma says her
- 27:02Speaker 1: dad never talked to her about Alex Cox. He never
- 27:05Speaker 1: spoke to her about Lori Vallow before Tammy died. 11.10 a.m.
- 27:08Speaker 1: Emma says she has read all of her dad's books.
- 27:11Speaker 1: In Chad's autobiography, he says the visions he had experienced
- 27:15Speaker 1: are all true. Blake asks about priesthood blessings and the
- 27:18Speaker 1: statement Emma made about a man living the covenant could
- 27:22Speaker 1: give a blessing. Blake asks if committing adultery is living
- 27:25Speaker 1: the covenant. Emma says no. Blake asks when she learned
- 27:28Speaker 1: Chad was having an affair with Lori. After he was arrested,
- 27:31Speaker 1: Emma says, I heard about things in the news after
- 27:34Speaker 1: Lori was arrested in February 2022, but I learned more
- 27:38Speaker 1: after he was arrested. Very shortly after. Once again, the news.
- 27:42Speaker 1: So if you're his kids, right, and he's not even
- 27:44Speaker 1: telling you about Lori Vallow or any of this other stuff,
- 27:47Speaker 1: you're going to believe him about your mom and about
- 27:50Speaker 1: the kids? Sorry, I wouldn't believe him for one single second. 11.12 a.m.
- 27:55Speaker 1: Emma said during an interview in 2021 that Chad's affair
- 27:59Speaker 1: was not physical. She says she later learned it was physical.
- 28:03Speaker 1: Blake says Emma, if she was present at the home
- 28:06Speaker 1: when 911 was called the day Tammy died, she was not. 11.13 a.m.
- 28:11Speaker 1: Blake asks Emma if she has provided any statement about
- 28:14Speaker 1: her mother's health when her mother died. Emma doesn't remember.
- 28:18Speaker 1: Blake asks if at any point Emma reached out to
- 28:20Speaker 1: law enforcement about her mom's medical conditions. It wasn't a crime,
- 28:24Speaker 1: so no. 11.14 a.m. Emma repeats again that they didn't
- 28:29Speaker 1: want her mom to get an autopsy. Blake says once
- 28:31Speaker 1: the autopsy was done, did Emma want to know the results?
- 28:36Speaker 1: I told them I didn't want to interview with them.
- 28:38Speaker 1: I wanted to see the results and I didn't want
- 28:40Speaker 1: to discuss it with them, Emma says. Blake says police
- 28:43Speaker 1: told her she did not have to do an interview.
- 28:45Speaker 1: They were just going to share the results with her.
- 28:47Speaker 1: Emma says they never said that. 11.16 a.m. Blake says
- 28:51Speaker 1: she was unwilling to sit down with law enforcement. Emma
- 28:54Speaker 1: says in that instance, yes. Blake asks if it was
- 28:57Speaker 1: common for her dad to be in control and in charge. Yes,
- 29:01Speaker 1: as the patriarch of our home. Blake asks about how
- 29:03Speaker 1: Chad seemed when Tammy died. Did your dad ever share
- 29:07Speaker 1: with you a text to Lori that was sent less
- 29:09Speaker 1: than 24 hours after your mother's passing? Emma responds, my
- 29:13Speaker 1: dad never shared text messages with me. 11.18 a.m. Blake
- 29:16Speaker 1: asks about June 9th, 2020 and requests an exhibit from
- 29:19Speaker 1: the court. The exhibit is the body camera footage that
- 29:22Speaker 1: was previously admitted. Blake asked to publish a portion of
- 29:26Speaker 1: the video. This is the conversation Emma had with her
- 29:29Speaker 1: dad as police were searching the property for JJ and Tylee. 11.25 a.m.
- 29:35Speaker 1: Blake begins playing the video. Chad's in the backseat of
- 29:38Speaker 1: the car wearing a baseball cap. Emma opens the door
- 29:40Speaker 1: and says, I love you so much. Chad responds, I
- 29:43Speaker 1: love you. Glad you came over. Emma says, I thought
- 29:46Speaker 1: they took you downtown already. Chad says, I almost made
- 29:50Speaker 1: it to the county line. Emma says, she saw the
- 29:53Speaker 1: police chase Chad down. I almost made it to the
- 29:55Speaker 1: county line. What is this? the year 1846, and if
- 29:59Speaker 1: you get out of Dodge, you're going to be good
- 30:02Speaker 1: to go. Nobody's going to chase you down. What an
- 30:04Speaker 1: absolute fool. 11.27 a.m. Chad's asking Detective Ball about his wallet,
- 30:10Speaker 1: and Ball says Emma can take the wallet with the
- 30:12Speaker 1: credit cards. Chad tells Emma there is about $ 9, 000 in
- 30:16Speaker 1: two white envelopes in the middle drawer of Mark's dresser
- 30:19Speaker 1: in his room. Chad says they will talk more about
- 30:21Speaker 1: car payments, and they begin discussing bank account information. 11.29 a.m.
- 30:27Speaker 1: Chad tells Emma how to use the card for Telemate
- 30:30Speaker 1: to talk with Lori. He tells her how to sign in,
- 30:33Speaker 1: and Emma says she has an account that she's been
- 30:35Speaker 1: talking to Lori on. Chad tells her to use a
- 30:37Speaker 1: particular card to put money on and to give her
- 30:40Speaker 1: commissary money. He usually puts $ 30 a week on there.
- 30:44Speaker 1: Imagine talking to this lady on the phone after what
- 30:47Speaker 1: happened to your mom? And it's not like this was
- 30:49Speaker 1: a big secret, right? Everybody knew. Everybody was talking about it.
- 30:53Speaker 1: 1130 a.m. Chad says, cooperate with them as much as
- 30:56Speaker 1: you feel. Emma says, they have been kind to us today.
- 31:00Speaker 1: She says she texted John Pryor so he has her number.
- 31:02Speaker 1: Chad tells Emma that a lot of the accounts are
- 31:05Speaker 1: on auto-pay. It sounds like you're not going to be
- 31:08Speaker 1: out for a little while, Emma says. Emma is crying
- 31:11Speaker 1: and says she will take care of her and Joe
- 31:13Speaker 1: and Mark. Chad tells her to keep paying the mortgage.
- 31:16Speaker 1: 1132 a.m. I'm not coming back, Chad says. All that
- 31:20Speaker 1: stuff in the baby room is Lori's and mine. The suitcases,
- 31:23Speaker 1: you'll see. Just put it in the garage. Take the
- 31:26Speaker 1: mattress from upstairs. Do what you want, Chad says. We're
- 31:28Speaker 1: going to make it through. I'm glad we could talk. 11.33 a.m.
- 31:33Speaker 1: Chad tells Emma to move out of her house and
- 31:35Speaker 1: move into his. This is essentially your house, and we'll
- 31:38Speaker 1: talk to John Pryor about the financial arrangement, but you
- 31:41Speaker 1: should be fine for a while. Blake stops the clip
- 31:43Speaker 1: and asks Emma if she recalls a conversation with her dad.
- 31:46Speaker 1: She does. Chad didn't ask Emma if she knew why
- 31:50Speaker 1: he was arrested. Yeah, they all knew why he was arrested. Now,
- 31:53Speaker 1: if they believe it or not, that's a different story,
- 31:55Speaker 1: but they all knew. 11.35 a.m. Blake asks about the
- 31:58Speaker 1: upstairs room with the mattress. Emma says people typically didn't
- 32:01Speaker 1: live up there, and Chad had just moved it up there.
- 32:04Speaker 1: Blake asks about the $ 8, 000 deposit Chad made into her account.
- 32:08Speaker 1: Emma says it happened. Blake asks about the two bodies
- 32:11Speaker 1: being located. Whose bodies were those? Emma responds, Tylee Ryan
- 32:16Speaker 1: and J.J. Vallow. Blake has nothing further. Pryor will now redirect. 11.36 a.m.
- 32:22Speaker 1: Pryor back at the podium and displays the insurance form.
- 32:25Speaker 1: He asks what the line spouse's signature if applying for
- 32:28Speaker 1: coverage means. Emma says either her dad applied for coverage
- 32:31Speaker 1: or her mom didn't understand. Pryor asks about Chad discussing
- 32:35Speaker 1: with Emma about where the children were. Emma says her
- 32:38Speaker 1: dad never knew where the children were. Yeah, okay, sure.
- 32:42Speaker 1: He knew they were in a safe place though, right? 11.39 a.m.
- 32:45Speaker 1: Pryor asks about the exhumation of Tammy and has nothing further.
- 32:48Speaker 1: Emma Murray is released from the stand, but Pryor wants
- 32:52Speaker 1: to keep her under subpoena. 1140 a.m. Next witness is
- 32:56Speaker 1: Garth Daybell. 1141 a.m. Garth is Chad's son and the
- 33:01Speaker 1: oldest child. Pryor asks who was living at the home
- 33:04Speaker 1: when Tammy died. It was Tammy, Chad, and Garth. Garth's
- 33:07Speaker 1: bedroom was at the end of the hallway, and his
- 33:09Speaker 1: parents' room was across the hall. 1143 a.m. Prior asks
- 33:13Speaker 1: who drove the Dodge Dakota before 2017. It was Chad.
- 33:18Speaker 1: After 2017, Garth says his dad was not driving the truck.
- 33:22Speaker 1: His mom was the primary driver. Garth now says he
- 33:26Speaker 1: has it backwards. At the time of his mother's death,
- 33:29Speaker 1: Garth says his dad was driving the Dodge Dakota. Prior
- 33:32Speaker 1: asks Garth if he's nervous. He says he is and
- 33:34Speaker 1: considers himself pretty shy. 11.45 a.m. Garth now says his
- 33:39Speaker 1: mom drove the Dakota before 2017 and then began driving
- 33:43Speaker 1: the Chevy Equinox. Pryor asked about the summer of 2019
- 33:46Speaker 1: and raccoons. That summer I was testing out a new
- 33:50Speaker 1: tent in the backfield and I heard a rustling. I
- 33:53Speaker 1: went out and looked up in the tree and there
- 33:54Speaker 1: was a raccoon there. I ran inside and told my
- 33:57Speaker 1: dad and it was very close to where our rabbits
- 33:59Speaker 1: were being kept. I told my dad, he grabbed the
- 34:02Speaker 1: shotgun and he shot the raccoon. Garth says this was
- 34:05Speaker 1: around 10 p.m. 11.46 a.m. The raccoons went after the
- 34:11Speaker 1: rabbit food, and they were worried that they would start
- 34:13Speaker 1: going after the rabbits. In the summer of 2019, they
- 34:17Speaker 1: caught three to four raccoons, and they buried them in
- 34:19Speaker 1: the compost heap behind the silver shed. Pryor asks if
- 34:23Speaker 1: other animals were buried on different places on the property.
- 34:27Speaker 1: Animals that were pets were buried in the raspberry patch. 11.48 a.m.
- 34:32Speaker 1: Garth says there were a lot of raccoons. Boyce wants
- 34:34Speaker 1: to bring up an issue on Sidebar. 1150 a.m. Boyce
- 34:38Speaker 1: says we will break for lunch back in an hour.
- 34:42Speaker 1: All right. So we're going to break here as well.
- 34:44Speaker 1: And in the next episode, we're going to pick up
- 34:46Speaker 1: with the testimony of Garth Daybell. All of the information
- 34:50Speaker 1: that goes with this episode can be found in the
- 34:53Speaker 1: description box. What's up, everyone? And welcome back to the program.
- 34:58Speaker 1: In this episode, we're picking up where we left off
- 35:00Speaker 1: with day number 26 of the Chad Daybell trial. This
- 35:05Speaker 1: article was published by EastIdahoNews.com, and the author of this
- 35:09Speaker 1: article is Nate Eaton. 1.03 p.m. We're back in the courtroom.
- 35:14Speaker 1: Several people in line in the hall all day were
- 35:16Speaker 1: able to get into the courtroom this afternoon because others
- 35:19Speaker 1: left from this morning. Garth Daybell back on the stand. 1.05 p.m.
- 35:24Speaker 1: Pryor asks how many times before today have they spoken
- 35:28Speaker 1: to each other. Garth says no more than three, including today.
- 35:31Speaker 1: Garth says Pryor did not tell him what to say.
- 35:34Speaker 1: The only advice Pryor gave him was to tell the truth.
- 35:36Speaker 1: 108 p.m. Garth is an eighth grade science teacher at
- 35:40Speaker 1: Madison Junior High School. In October 2019, he also worked
- 35:44Speaker 1: as a scare person in a local haunted house. On
- 35:47Speaker 1: September 9th, 2019, Garth says he got home in the
- 35:51Speaker 1: late afternoon. As he pulled in, Chad came up to
- 35:54Speaker 1: him wearing yard work clothes. He sounded very excited, Garth said.
- 35:58Speaker 1: Chad told him he killed another raccoon. Garth believes that
- 36:01Speaker 1: the raccoon that kept breaking out of the cage they
- 36:04Speaker 1: were trying to catch. Chad showed Garth he had buried
- 36:07Speaker 1: the raccoon behind the silver shed. 1 10 p.m. Garth
- 36:10Speaker 1: says all the raccoons were buried behind the silver shed.
- 36:13Speaker 1: Garth was concerned that his mom was getting tired extremely easily.
- 36:17Speaker 1: She would work hard all day and just come home
- 36:20Speaker 1: and collapse. She had hurt her arm and I wanted
- 36:22Speaker 1: her to go get it looked at. She was trying
- 36:24Speaker 1: to rub this bruising ointment on it. She refused to go,
- 36:27Speaker 1: Garth says. Tammy did end up going to the doctor. 1.11
- 36:31Speaker 1: PM Garth often worked with his mom in the yard.
- 36:35Speaker 1: She had a hard time doing heavy things. I was
- 36:37Speaker 1: her muscle, he says. Garth says it became increasingly more
- 36:40Speaker 1: difficult for Tammy toward the end of her life. She
- 36:43Speaker 1: would have fainting spells, Garth said. The spells happened after
- 36:46Speaker 1: Tammy had been kneeling for a while. 1.12 PM Pryor
- 36:51Speaker 1: asks about October 9th, the day of the paintball gun incident.
- 36:54Speaker 1: Garth was on the couch watching TV. Chad was working
- 36:58Speaker 1: on the computer. When Tammy got home, she was really
- 37:00Speaker 1: in a panic-stricken state, saying someone had attacked her with
- 37:04Speaker 1: a paintball gun. When she said that, I was filled
- 37:07Speaker 1: with rage, and I wanted to go find whoever had
- 37:09Speaker 1: done this, but before I chased after someone, I said,
- 37:12Speaker 1: are you sure it was a paintball gun? She said yes.
- 37:14Speaker 1: It had the thing on the top. 1.14 p.m. Garth
- 37:18Speaker 1: said his mom and dad googled a picture of a
- 37:20Speaker 1: paintball gun to see what a hopper is. Detective Cannon
- 37:23Speaker 1: showed up and Garth says they showed him a photo
- 37:25Speaker 1: of a paintball gun on the computer. 1.15 p.m. Pryor
- 37:30Speaker 1: asked Garth about the evening of October 18, 2019. Garth
- 37:34Speaker 1: was working at a haunted house in Teton, about 20
- 37:36Speaker 1: to 30 minutes away from his house. He was dressed
- 37:39Speaker 1: up in a costume to scare people. Garth got home
- 37:42Speaker 1: from his first job. Tammy got home before him and said,
- 37:45Speaker 1: I don't feel good today. I don't want to cook.
- 37:48Speaker 1: Can you get some McDonald's for us? Garth drove to
- 37:50Speaker 1: Rexburg and picked up food for himself, mom, and dad.
- 37:53Speaker 1: Tammy got her favorite meal, the quarter pounder with cheese.
- 37:56Speaker 1: Pryor says a healthy meal. Garth responds, depends. No, nothing
- 38:01Speaker 1: healthy about a quarter pounder, okay? 1.17 p.m. Garth left
- 38:06Speaker 1: around 7 p.m. His mom said, have a good time.
- 38:09Speaker 1: I'll see you tomorrow. I'll let you sleep in. Garth
- 38:12Speaker 1: got home from the haunted attraction around 1 a.m. As
- 38:15Speaker 1: I passed their bedroom, I heard my father snoring. Garth says.
- 38:19Speaker 1: Garth didn't see any sign of struggle or fight. As
- 38:21Speaker 1: far as he knew, it was a normal night. Garth
- 38:24Speaker 1: then watched YouTube in his bedroom until around 3 a.m. 1.19 p.m.
- 38:29Speaker 1: Garth was awakened a few hours later from his dad saying, Garth, Garth,
- 38:33Speaker 1: get up. I need help. Garth went into his parents'
- 38:36Speaker 1: bedroom and observed his mother rolled out of bed with
- 38:38Speaker 1: her feet tangled in the sheets. Garth went to grab
- 38:41Speaker 1: his mom and help her into bed. I felt she
- 38:44Speaker 1: was cold and stiff and gray. I realized she's not
- 38:47Speaker 1: been breathing. 1.20 p.m. Garth said if there had been
- 38:50Speaker 1: a struggle or a fight, he would have heard it.
- 38:52Speaker 1: He says he heard nothing. Garth was present when his
- 38:55Speaker 1: family met with the funeral home. Garth said the funeral
- 38:57Speaker 1: director said they could have the funeral on Tuesday or Saturday. 1.21 p.m.
- 39:03Speaker 1: Pryor asked about the trip to Knott's Berry Farm. Garth,
- 39:06Speaker 1: his dad, Emma and Joe, Adam and Leah all went
- 39:09Speaker 1: on the trip. Lori Vallow was not with the group.
- 39:12Speaker 1: They drove to Salt Lake and caught a flight to California.
- 39:15Speaker 1: During his testimony, Chad is leaning forward on the table,
- 39:18Speaker 1: looking at his son. 1.22 p.m. Garth learned his mother
- 39:22Speaker 1: had been exhumed from Emma. Nobody contacted them ahead of time.
- 39:26Speaker 1: It was a complete surprise. Prior asked about May 7th, 2021.
- 39:30Speaker 1: Garth said it started as a normal school day, meaning
- 39:33Speaker 1: he was going to go and do his job. He
- 39:35Speaker 1: went out the driveway to his car and there were
- 39:37Speaker 1: several law enforcement vehicles across the street. Several officers go
- 39:41Speaker 1: out and surround me and insisted that I go with them. 1.24 p.m.
- 39:46Speaker 1: Prior asked which officers showed up at the house. Garth
- 39:49Speaker 1: names a few. Garth asked if they had a warrant.
- 39:51Speaker 1: They said no, but told him he needed to go
- 39:54Speaker 1: with them. Garth says he felt like he had no choice.
- 39:57Speaker 1: He went to the police station and his phone was taken.
- 40:00Speaker 1: Garth says his wife had also been detained and they
- 40:02Speaker 1: were kept in separate rooms for five to six hours.
- 40:05Speaker 1: They were telling me my story was untrue and I
- 40:07Speaker 1: needed to change it, Garth says. Look at this dude
- 40:10Speaker 1: trying to give his pops an assist. More worried about
- 40:13Speaker 1: your dad not getting in trouble more than the fact
- 40:15Speaker 1: that your mother was murdered. 1.26 p.m. Garth says he
- 40:20Speaker 1: asked to have an attorney. Garth was released and was
- 40:22Speaker 1: never charged. Pryor asked if there was another occasion where
- 40:26Speaker 1: he was asked to change his story. I was summoned
- 40:29Speaker 1: to two separate grand juries, he says. Pryor wants to
- 40:32Speaker 1: talk about the second grand jury. It was made pretty
- 40:34Speaker 1: plain that I needed to change my story to fit theirs,
- 40:37Speaker 1: Garth says. They had a list of charges that they
- 40:40Speaker 1: were threatening me with. 1.27 p.m. Garth hired Forrest Fisher,
- 40:44Speaker 1: an attorney. Garth testified in front of the second grand jury.
- 40:48Speaker 1: He had previously testified in another grand jury regarding his father.
- 40:52Speaker 1: I was feeling extremely pressured by the prosecutors, Garth says.
- 40:56Speaker 1: He says the second grand jury was for him. Garth
- 40:59Speaker 1: was never indicted. 1.29 p.m. Pryor asks if Garth is LDS.
- 41:05Speaker 1: He is. Garth says he interprets his faith different than
- 41:08Speaker 1: his father's. He describes his dad's faith as more traditional,
- 41:11Speaker 1: closer to the way it was 100 years ago. 1.30 p.m.
- 41:16Speaker 1: Garth was aware his father had beliefs about the 144,000.
- 41:19Speaker 1: Pryor asked Garth for differences between his father's and his
- 41:24Speaker 1: dad's faith. I teach and believe in evolution. I teach
- 41:27Speaker 1: that my students. I teach the earth is 4.5 billion
- 41:30Speaker 1: years old as opposed to 6,000, Garth says. He says
- 41:34Speaker 1: he partially shares his father's view on light and dark.
- 41:37Speaker 1: Garth says it could mean good and evil, good and bad,
- 41:39Speaker 1: opposing forces. 1.32 p.m. Garth said his parents put light
- 41:44Speaker 1: and dark numbers on people every now and then. Pryor
- 41:47Speaker 1: asks about a casting recorded in a book. Garth says
- 41:50Speaker 1: Joseph Smith was casting a devil out of a new
- 41:52Speaker 1: old knight. Garth says he isn't sure the story would
- 41:55Speaker 1: be shared as often anymore. Garth says Knight did not
- 41:59Speaker 1: die after the demon was expelled from him, and he
- 42:01Speaker 1: went on to do great things. 1.34 p.m. Pryor has
- 42:05Speaker 1: no further questions. Lindsay Blake will now cross-examine Garth. 1.35 p.m.
- 42:10Speaker 1: Blake asks about the Dodge Dakota and which parent drove it.
- 42:13Speaker 1: His recollection is his dad drove it in the later years.
- 42:17Speaker 1: Blake asks why Joseph Murray referred to the truck as Tammy's.
- 42:20Speaker 1: Garth had not heard that. Garth says Tammy drove the
- 42:23Speaker 1: truck on occasion. 1.36pm. Blake asks about the raccoon that
- 42:27Speaker 1: was shot on September 9th and where it was buried.
- 42:30Speaker 1: Garth says it was buried behind the silver shed. He
- 42:32Speaker 1: was not there when the raccoon was buried. Blake asks
- 42:35Speaker 1: about Tammy getting winded And if Garth ever shared those
- 42:38Speaker 1: concerns with police or the coroner. I don't recall, he says. 1.37 p.m.
- 42:44Speaker 1: Garth learned an autopsy was going to be performed on
- 42:46Speaker 1: his mom. Even with an autopsy being performed, you didn't
- 42:50Speaker 1: think law enforcement would want to know about Tammy being
- 42:52Speaker 1: short of breath? Garth says he assumes they would find it.
- 42:55Speaker 1: Garth never shot paintball guns with his mom, never saw
- 42:58Speaker 1: her with a paintball gun, etc. Blake asks if it
- 43:01Speaker 1: would surprise him that Detective Cannon never saw a picture
- 43:04Speaker 1: of a paintball gun that night. Garth says it would
- 43:06Speaker 1: surprise him because the deputy was there. 1.38 p.m. Garth
- 43:11Speaker 1: ran outside to try and see who shot at his mom,
- 43:14Speaker 1: but it was so dark he couldn't see anyone. Pryor
- 43:16Speaker 1: asked about the day Tammy died. Garth got home a
- 43:19Speaker 1: little after 1 a.m., got ready for bed, and watched
- 43:22Speaker 1: YouTube videos. He didn't see either of his parents. He
- 43:26Speaker 1: said they were both in bed. I saw their shapes
- 43:28Speaker 1: in the bed as I passed by their room, Garth said.
- 43:31Speaker 1: He did not go in and talk to them. He
- 43:33Speaker 1: assumed they were asleep. 1.40 p.m. Nobody else was in
- 43:37Speaker 1: the house when he got home. Blake asked what woke
- 43:39Speaker 1: him up on the morning of October 19th. I thought
- 43:42Speaker 1: I heard a thump, and my dad said, Garth, come
- 43:45Speaker 1: help me. He went into the bedroom, saw his mom
- 43:48Speaker 1: halfway off the bed with her legs still entangled in
- 43:50Speaker 1: the blankets. I immediately thought, she needs my help, so
- 43:53Speaker 1: I lifted her immediately into the bed. 1.41 p.m. Garth
- 43:58Speaker 1: says he is extremely close with his mom. Blake asked
- 44:01Speaker 1: about the day in May 2021 when When Garth went
- 44:04Speaker 1: to the police station, she asked if he recalls that
- 44:06Speaker 1: officers left the door open in the interview room. Garth
- 44:10Speaker 1: says the police brought him McDonald's. His attorney came for questioning. 1.42 p.m.
- 44:16Speaker 1: Garth says Detective Kaya Kamanu and an FBI agent went
- 44:19Speaker 1: to his classroom one day and told him that the
- 44:23Speaker 1: result of his mom's autopsy. Blake asked Garth about talking
- 44:26Speaker 1: to a person about finding his mom dead in bed
- 44:29Speaker 1: and his dad gone. Garth doesn't recall. 1.44 p.m. Blake
- 44:34Speaker 1: asks if he recalls telling Kara and or Emma about
- 44:37Speaker 1: finding his mom on the couch. I did not tell
- 44:39Speaker 1: them she was on the couch, Garth says. Garth says
- 44:42Speaker 1: the night before he had seen her on the couch
- 44:44Speaker 1: as she said goodbye to them. Blake asks if they
- 44:47Speaker 1: were to say something different, would that surprise you? Garth replies,
- 44:51Speaker 1: I've heard that before. 1.45 p.m. Blake asks Garth if
- 44:56Speaker 1: he's aware the second grand jury was conducted based on
- 44:58Speaker 1: the request of the first grand jury. Garth was not
- 45:01Speaker 1: aware of that. Blake asks about Joseph Smith and the casting.
- 45:05Speaker 1: Garth says the person being casted on in the story
- 45:08Speaker 1: continued to live and live his life. Garth had not
- 45:11Speaker 1: heard that his mom was possessed. He had not heard
- 45:14Speaker 1: about JJ or Tylee being possessed. Blake asks if his
- 45:17Speaker 1: mom is still alive. Garth says no. 1.47 p.m. Blake
- 45:23Speaker 1: has nothing further. Pryor will now redirect. Pryor says the
- 45:26Speaker 1: second grand jury was convened to find out if Garth
- 45:29Speaker 1: should face perjury charges. He was not aware. He says
- 45:33Speaker 1: he felt Madison and Fremont counties were threatening and intimidating
- 45:36Speaker 1: him to change his testimony. Pryor has nothing further and
- 45:39Speaker 1: asked for a sidebar. Blake asked for a brief recross.
- 45:43Speaker 1: So that's what he's going to try and say, right? Oh,
- 45:45Speaker 1: I was being threatened. I was being pressured. Here's an idea, dude.
- 45:49Speaker 1: If you're so close to your mom, like you're out
- 45:51Speaker 1: here opining, how about you step up and tell the
- 45:54Speaker 1: authorities what they need to know? But you couldn't even
- 45:57Speaker 1: be bothered to tell them about her shortness of breath. 1.51 p.m.
- 46:02Speaker 1: Boyce says there's a matter that needs to be taken
- 46:04Speaker 1: up outside the presence of the public and the jurors.
- 46:07Speaker 1: Boyce asks that we remain in the courtroom while this
- 46:09Speaker 1: issue is taken care of. So, brief break before the
- 46:12Speaker 1: next witness. 2.02 p.m. Attorneys are back. Garth is released
- 46:17Speaker 1: from his subpoena. Next witness is Forrest Fisher, Garth's attorney. 2.04 p.m.
- 46:22Speaker 1: Fisher works in Driggs and was asked to travel to
- 46:24Speaker 1: Fremont County to provide legal services for Garth Daybell during
- 46:28Speaker 1: grand jury proceedings. The focus of the grand jury was
- 46:31Speaker 1: on Garth. Fisher says Garth had previously testified in front
- 46:34Speaker 1: of the grand jury, and the jury had follow-up questions,
- 46:37Speaker 1: so Fisher was called in to assist. 2.06 p.m. Fisher
- 46:41Speaker 1: recalls Garth having questions. Fisher told him to answer only
- 46:45Speaker 1: the questions being asked, and if he wasn't sure, Garth
- 46:47Speaker 1: could consult with Fisher. Fisher wasn't in the room for
- 46:50Speaker 1: the grand jury, but was outside and told Garth he
- 46:53Speaker 1: could come and talk to him if he had questions.
- 46:55Speaker 1: Fisher told Garth not to talk to the media. 2.07 p.m.
- 47:00Speaker 1: Pryor asks if Fisher told Garth this was a trap
- 47:02Speaker 1: designed to trick him. Fisher doesn't recall exactly, but wouldn't
- 47:06Speaker 1: have been surprised if he did, because Garth had already
- 47:08Speaker 1: testified in the previous grand jury, and this grand jury
- 47:11Speaker 1: was about Garth possibly committing perjury. Pryor has nothing further.
- 47:15Speaker 1: Blake will now cross. 2.09 p.m. Blake asks if it
- 47:20Speaker 1: was his understanding, if it was the same grand jury
- 47:22Speaker 1: with additional questions. He believes so, but isn't sure. Fisher
- 47:26Speaker 1: says he provided legal counsel to his client, And there
- 47:29Speaker 1: was no charges against Garth. Blake is done. Pryor has
- 47:33Speaker 1: nothing further. 2.10 p.m. Mid-afternoon break. Back in 20 to
- 47:37Speaker 1: 30 minutes. 2.36 p.m. Joseph Murray, Emma's husband, is called
- 47:42Speaker 1: to the stand. 2.37 p.m. Joseph says he and Emma
- 47:46Speaker 1: have been married for seven years. They have three children,
- 47:49Speaker 1: including a newborn. Pryor asks how many times he and
- 47:52Speaker 1: Joseph spoke or met before last night. Joseph says just once,
- 47:56Speaker 1: on the phone for about five minutes. 2.38 p.m. Pryor
- 48:00Speaker 1: asks about October 9th, 2019 and what Joseph was doing
- 48:04Speaker 1: that day. He says in the evening he was out
- 48:06Speaker 1: chopping wood for their fireplace. He got a notification that
- 48:10Speaker 1: Tammy posted in a Facebook group that someone had attempted
- 48:12Speaker 1: to shoot her with a paintball gun. Joseph went inside
- 48:16Speaker 1: and Emma was calling Tammy. Joseph asked Tammy if she
- 48:19Speaker 1: called law enforcement. Tammy said no. So Joseph said, call
- 48:22Speaker 1: the police. 2.40 p.m. Joseph said that in the Facebook post,
- 48:27Speaker 1: Tammy said it was a paintball gun. Prior asked Joseph
- 48:30Speaker 1: if he recalls what he said when he called 911.
- 48:33Speaker 1: Joseph said he told him that his mother-in-law was shot
- 48:36Speaker 1: at by someone with a paintball gun and the person
- 48:38Speaker 1: ran away. This is based off what Tammy had told him. 2.43 p.m.
- 48:43Speaker 1: Joseph says that he was in a woodshed when he
- 48:45Speaker 1: learned about the Facebook post. Joseph never heard a scream
- 48:49Speaker 1: or yell from Tammy. He never heard a swooshing sound
- 48:52Speaker 1: or rifle or anything like that. Joseph never saw anything.
- 48:56Speaker 1: Pryor asked Joseph about his talk with Deputy Coulter Cannon.
- 48:59Speaker 1: Joseph says after calling 911, he saw Cannon in his
- 49:02Speaker 1: vehicle and spoke to him. 2.45 p.m. Pryor asked Joseph
- 49:07Speaker 1: if he spoke with any member of the family after
- 49:09Speaker 1: the incident. He says he talked to his wife. The
- 49:12Speaker 1: discussion about whether it was a paintball gun or another
- 49:14Speaker 1: gun was never discussed. Based on what Tammy said, Joseph
- 49:18Speaker 1: understood it was a paintball gun. gun. 2.47 p.m. Pryor
- 49:22Speaker 1: asked about the Dodge Dakota. He got it in December
- 49:25Speaker 1: 2019 from Chad. Pryor asked Joseph if he observed Chad's
- 49:29Speaker 1: regular patterns of travel, living kitty-cornered to him. Joseph works
- 49:33Speaker 1: at the hospital, said his work shift began at noon.
- 49:36Speaker 1: Joseph would often cross paths with Chad as Chad was
- 49:38Speaker 1: headed to the Salem Church to write at around 9 a.m. 2.50 p.m.
- 49:44Speaker 1: Chad also did some writing at the BYU-Idaho Library, Joseph says.
- 49:48Speaker 1: The majority of each day, Chad was either riding at
- 49:51Speaker 1: the church or the campus, Joseph explains. Pryor asks who
- 49:55Speaker 1: was the primary driver of the Dodge Dakota, Tammy or Chad.
- 49:59Speaker 1: Joseph says Tammy was. Tammy and Chad then bought a
- 50:03Speaker 1: black Equinox and Tammy drove that to 52 p.m. Pryor
- 50:06Speaker 1: asks about Tammy Daybell preparing for a book fair on Friday,
- 50:09Speaker 1: October 18th. Tammy was driving the Dodge Dakota that day.
- 50:13Speaker 1: Joseph said that fall there was a major issue with
- 50:16Speaker 1: potatoes freezing. Joseph was helping his friend get the potatoes in.
- 50:20Speaker 1: Joseph went and picked up Emma from school. They only
- 50:23Speaker 1: had one working vehicle and Joseph wanted to help his friend.
- 50:27Speaker 1: Tammy said Joseph could use the truck and Emma said
- 50:29Speaker 1: she would take Tammy home. 2.53 p.m. Joseph said he
- 50:33Speaker 1: needed to get Tammy's set of keys that had keys
- 50:36Speaker 1: to the truck and the Equinox. He used the truck
- 50:39Speaker 1: and returned it to the Daybell home. Joseph got there
- 50:42Speaker 1: around 5 to 5.30 p.m. early evening. Joseph went into
- 50:46Speaker 1: the house and handed Tammy the keys. She was sitting
- 50:49Speaker 1: on the couch. Chad was also there. 2.55 p.m. Pryor
- 50:53Speaker 1: asked Joseph if he observed anything unusual when he went
- 50:56Speaker 1: in to see Tammy. Joseph says earlier in the day
- 50:59Speaker 1: around 2 to 3 p.m. when he went to get
- 51:01Speaker 1: the truck, Tammy seemed exhausted. She was carrying around several
- 51:05Speaker 1: scholastic school boxes that were pretty heavy, Joseph says. She
- 51:08Speaker 1: seemed exhausted and exasperated. 2.57 p.m. That evening, When he
- 51:14Speaker 1: brought the keys back to Tammy, she was sitting on
- 51:16Speaker 1: the couch and seemed very exhausted and was coughing pretty hard.
- 51:20Speaker 1: Chad was sitting at the computer desk. Tammy was sitting
- 51:22Speaker 1: up on the couch. Pryor asked if she was in distress.
- 51:25Speaker 1: Joseph says it appeared she was sick and wasn't feeling well. 2.58 p.m.
- 51:31Speaker 1: The next morning, Joseph was getting ready for work. He
- 51:34Speaker 1: saw a deputy vehicle outside and he was worried Garth
- 51:37Speaker 1: may not have come home from work. Joseph went back
- 51:39Speaker 1: inside and told Emma. Emma called Garth. Chad and Tammy,
- 51:43Speaker 1: but nobody answered. Joseph and Emma started walking across the
- 51:46Speaker 1: street to the houses and then a deputy and Garth
- 51:49Speaker 1: told them what happened. Garth was very shaken up. Joseph
- 51:53Speaker 1: says when he saw Chad, he was wandering aimlessly and
- 51:56Speaker 1: kept holding his head. He kept asking, what are we
- 51:59Speaker 1: going to do? What are we going to do? Joseph
- 52:01Speaker 1: said he'd never seen him in that state before. 3 p.m.
- 52:05Speaker 1: Pryor asks how far away Joseph is from Chad's house.
- 52:08Speaker 1: He asks who lives in the home near Chad's house.
- 52:11Speaker 1: Pryor asked about raccoon problems. The summer of 2019, Joseph
- 52:15Speaker 1: said raccoons were getting into the animal feed bins, so
- 52:18Speaker 1: a neighbor offered Joseph the use of a trap. Raccoons
- 52:21Speaker 1: were caught. 3.03 p.m. Pryor asked about a red shed
- 52:25Speaker 1: on the Daybell property. Joseph borrowed tools from the neighbor
- 52:28Speaker 1: or from Chad's red shed. Joseph explains the shed and
- 52:32Speaker 1: how it was never locked. Joseph says the red shed
- 52:35Speaker 1: is about the distance from the wall behind them to
- 52:37Speaker 1: where Pryor is standing at the podium. 3.05 p.m. Pryor
- 52:42Speaker 1: asks if there were two driveways on the Daybell property.
- 52:45Speaker 1: Joseph says there is a short driveway on the northwest
- 52:47Speaker 1: side of the lot in front of the house. Behind
- 52:50Speaker 1: the house, there is a much longer driveway. Pryor asks
- 52:52Speaker 1: if there is access to the field from the long driveway.
- 52:56Speaker 1: Joseph says there are two access points from the driveway
- 52:59Speaker 1: to the pasture area. 3.07 p.m. Pryor asks where JJ
- 53:03Speaker 1: and Tylee were buried. Joseph answers. Pryor asks if someone
- 53:06Speaker 1: could access the burial sites from the driveway. and not
- 53:09Speaker 1: be visible. Joseph says that's possible. 308 p.m. Joseph says
- 53:14Speaker 1: even after Chad was arrested, Detective Hermosillo drove by the
- 53:17Speaker 1: property several times a week. Pryor asked about the 5K
- 53:20Speaker 1: race for September 2019. Joseph put on a race for
- 53:24Speaker 1: Operation Underground Railroad. He was the lead organizer. Tammy and
- 53:28Speaker 1: their publishing company sponsored the race. Tammy was a volunteer
- 53:32Speaker 1: in the race, and she didn't run it, Joseph says. 3.10 p.m.
- 53:36Speaker 1: Pryor asks Joseph about him going to Sunday school and
- 53:39Speaker 1: a lesson in church that Matt Daybell, Chad's brother, was giving.
- 53:42Speaker 1: Rocky Wixom objects based on relevance. Boy sustains. Murray says
- 53:46Speaker 1: after Chad was arrested, he got a lot dirty looks
- 53:49Speaker 1: at church and on Facebook, the deputy prosecutor for Fremont
- 53:52Speaker 1: County at the time made a pretty nasty post about
- 53:55Speaker 1: the case. 3.11 p.m. Pryor wants to ask Joseph about
- 53:59Speaker 1: his parents and a competition between them and Tammy. Joseph
- 54:02Speaker 1: says it was a Fitbit competition regarding the number of
- 54:05Speaker 1: steps they got in each day. His parents were competitive
- 54:09Speaker 1: and Tammy was competitive. Joseph says there was a family
- 54:12Speaker 1: joke about Tammy shaking her arm to get more steps
- 54:15Speaker 1: on her Fitbit. 3.13 p.m. Joseph says his dad was
- 54:18Speaker 1: losing weight and Tammy was jealous. Prior as nothing further,
- 54:21Speaker 1: Boyce asked for a brief sidebar. 3.14 p.m. Larry Woodcock
- 54:26Speaker 1: just walked in during the sidebar. He and Kay left
- 54:28Speaker 1: for the weekend for a graduation. Kay stayed back in
- 54:31Speaker 1: Louisiana as her brother Jerry is in the hospital. 3.15 p.m.
- 54:36Speaker 1: Boyce says we're dismissing for the day. We'll be back tomorrow.
- 54:39Speaker 1: So I don't think that his kids did him any
- 54:41Speaker 1: favors here. And I don't think the jury is going
- 54:44Speaker 1: to say to themselves, you know what? Our minds are
- 54:46Speaker 1: changed now. We think that Chad Daybell is a hell
- 54:49Speaker 1: of a guy. Look at how much his kids love him.
- 54:51Speaker 1: In fact, what I came away with was that Chad
- 54:53Speaker 1: was controlling and that he was somebody that would not
- 54:56Speaker 1: be above telling these kids what to say. Now, they
- 54:59Speaker 1: say that didn't happen, but I don't know if I
- 55:01Speaker 1: believe it. I look at this whole family like a cult.
- 55:05Speaker 1: And I look at Chad Daybell as the leader of
- 55:07Speaker 1: that cult. And we all damn well know that when
- 55:09Speaker 1: the leader of a cult speaks, all of these members,
- 55:12Speaker 1: they listen. And guess what? You know who else is
- 55:14Speaker 1: listening to all the BS? The jury. And my guess
- 55:17Speaker 1: is they weren't moved one single bit by the testimony
- 55:21Speaker 1: heard today. But either way, we'll be back tomorrow with
- 55:24Speaker 1: another update about what went down at the Chad Daybell trial.
