- 0:00Speaker 1: What's up, everyone, and welcome to another episode of the
- 0:03Epstein Chronicles. In this episode, we're picking up where we
- 0:06left off with the MCC Psychological Department and their explanation
- 0:12as to what happened to Jeffrey Epstein Number six Direct observation.
- 0:19Mister Epstein was on suicide watch from July twenty third,
- 0:22twenty nineteen until July twenty fourth, twenty nineteen. While on
- 0:27suicide watch, on July twenty third, twenty nineteen, mister Epstein
- 0:32attended an attorney visit from approximately twelve forty pm until
- 0:36seven to fifteen pm. During this time, he was without
- 0:40direct continuous observation by a dedicated BOP staff member as
- 0:44required by P. Five three two four dot zero eight.
- 0:48While on psychological observation, he attended attorney visits on July
- 0:52twenty fourth, twenty nineteen for eleven and a half hours,
- 0:56on July twenty fifth, twenty nineteen, eleven and a half hours,
- 1:01on July twenty six, twenty nineteen, for nine and a
- 1:04half hours, on July twenty seventh, twenty nineteen eleven zero
- 1:09point three three hours, on July twenty eighth, twenty nineteen,
- 1:14for ten and a half hours and on July twenty ninth,
- 1:17twenty nineteen, four eight hours. On July thirtieth, twenty nineteen,
- 1:24psychology observation was terminated. During these visits, continuous observation by
- 1:30a dedicated BOP staff member was not maintained as required
- 1:33by MCC New York procedural Memorandum for Psychological Observation seven
- 1:39follow up. Mister Epstein arrived at MCC New York on Saturday,
- 1:44July six, twenty nineteen. While conducting the ten PM institution
- 1:49count that evening, Redacted facility's assistant reported she observed mister
- 1:54Epstein in itself. In an email that she sent to
- 1:57doctor redacted and and Lieutenant redacted later that evening, she
- 2:02described mister Epstein as distraught, sad, and a little confused.
- 2:07She said that she then asked mister Epstein if he
- 2:10was okay, and he reportedly said he was. However, she
- 2:14noted in her email she was not convinced of this,
- 2:17adding he seems dazed and withdrawn. She went on to say, so,
- 2:22just to be on the safe side and prevent any
- 2:24suicidal thoughts, can someone from psychology come and talk to him?
- 2:29Despite the fact that Lieutenant redacted open this email. There's
- 2:33no evidence that he contacted the on call psychologist as
- 2:37is required by P. Five three two four dot zero
- 2:41eight Suicide Prevention Program. Additionally, if misredacted was concerned about
- 2:47suicide risk, P. Five three two four dot zero eight
- 2:51Suicide program requires her to maintain direct continuous observation of
- 2:56mister Epstein. When doctor redacted opened the ear email. The
- 3:00following one day morning, mister Epstein was evaluated by Doctor
- 3:04redacted at approximately nine thirty a m. Mister Epstein was
- 3:09denied bill on Thursday July eighteenth, twenty nineteen. This was
- 3:13a significant disappointment for mister Epstein and likely challenged disability
- 3:17and willingness to adapt to incarceration. Given the potential impact
- 3:22of the judge's decision, a psychologist should have assessed mister
- 3:25Epstein's mental status upon his return to the institution. The
- 3:30BOP developed a century assignment of sy alert for purposes
- 3:34such as this. Specifically, sy alert is used to ensure,
- 3:39if movement occurs, that all staff consider the special psychological
- 3:44and management conditions and related risks associated with the inmate. Furthermore, P.
- 3:50Five three two four dot zero seven Century Psychology Alert
- 3:55function states want a decision to move. Any sy alert
- 3:58and maate occurs, any special psychological needs of the inmate
- 4:03are reviewed and considered by psychology services staff, and any
- 4:07safety and security concerns are highlighted from non psychology services staff.
- 4:12Psychologists should use the SYE alert assignment more frequently with
- 4:16high profile cases and with inmates who have a history
- 4:19of charge of sex offense. Both of these groups of
- 4:23inmates are susceptible to exaggerated or unrealistic fears about correctional
- 4:28settings and experience stress associated during movement and periods of
- 4:33transition e g. Cell unit changes, movement to and from court,
- 4:38institutional movement, and release of information through the media. Mister
- 4:44Epstein was reportedly in court on July thirty first, twenty nineteen.
- 4:48It's unknown what time he returned to mcc New York,
- 4:52because this information was not entered in century. Regardless, upon
- 4:57his return, the United States Marshall Service us MS provided
- 5:02R and D staff with a Prisoner of Custody Alert
- 5:04notice regarding mister Epstein. The notice indicated mister Epstein had
- 5:09MTL mental concern suicidal tendencies. The us MSS requested R
- 5:16and D staff sign the form and then they departed
- 5:18with the signed copy. On August first, twenty nineteen, at
- 5:22eight forty six am, Doctor adacted sent Doctor adacted in
- 5:27email reporting she had just become aware of the above information.
- 5:32In the absence of additional information about this notation, this
- 5:35should have been considered a referral to psychology about a
- 5:39potentially suicidal inmate, and procedures should have been followed as
- 5:43outlined in p. Five three two four dot zero eight
- 5:48Suicide Prevention Program. Specifically, when a staff member becomes aware
- 5:52an inmate may be thinking about suicide during normal working hours,
- 5:57that staff member must contact psychology services and maintained the
- 6:01inmate under direct continuous observation until he is placed on
- 6:05suicide watch or seen by a psychologist. There's no evidence
- 6:10mister Epstein was monitored under these conditions from the time
- 6:13he returned from court until he was seen by Doctor
- 6:17redacted for a suicide risk assessment on August first, twenty nineteen,
- 6:22at approximately one thirty pm. Number eight Inmate accountability and
- 6:28assignment accuracy. According to a Century Quarter's roster generated on
- 6:32August tenth, twenty ten, at twelve fifty one am, there
- 6:36were three inmates assigned to mister Epstein's shoe cell Z
- 6:40zero four dash to zero six LAD including him at
- 6:44the time of his death. However, his shoe cell was
- 6:48only double occupancy inmate Patrick A. Villa, inmate Gregory Ferreer,
- 6:55and mister Epstein were all assigned to the same cell.
- 6:58On August thirteenth, nineteen, at twelve oh six PM and
- 7:02twelve oh eight PM, we generated a quarter's history roster
- 7:06for inmate of Villa and Ferrera, respectively. In made of
- 7:10Villa's cell assignment was Z zero four to zero six
- 7:14la D from August fifth, two thousand and nine, until
- 7:17August eleventh, twenty nineteen, when he was moved to sell
- 7:21seven zero four two one two UAD. Inmate ferrera cell
- 7:26assignment was Z zero four two zero six ua D
- 7:31from August first, twenty nineteen until August eleventh, twenty nineteen,
- 7:36when he was moved to sell Z zero four to
- 7:39zero seven la D. We then generated a quarter's history
- 7:43roster from mister Epstein on August thirteenth, twenty nineteen at
- 7:48nine oh seven am. His cell assignment was Z zero
- 7:52four dash two zero six la D from July twenty ninth,
- 7:56twenty nineteen, until August tenth, nineteen. On Monday, August twelfth,
- 8:03twenty nineteen, photographs of name tags on shoe cell doors
- 8:06and shoe locator forms were sent to the Correctional Service
- 8:10Department in the Northeast region. The shoe locator form is
- 8:14dated August ninth, twenty nineteen. It shows inmate Fererer in
- 8:20cell two O seven. L Century states he was moved
- 8:22to the cell on August eleventh, twenty nineteen. In made
- 8:28Epstein is in cell to twenty L Century never shows
- 8:32them in this cell along within may Rayis. The locator
- 8:35shows inmate copper and inmate dockery in cell two O six.
- 8:40The photoshets show the cell being two twenty within made

- 8:52zero five to four was in cell Z zero six

- 9:00twenty nineteen. MCC has four suicide watch cells and each's
- 9:06for single occupancy use. The suicide watch cells are located
- 9:11in Hell Services. Each cells abbreviated with the unit code
- 9:15eight zero one in Century, followed by the four digit
- 9:18cell number. The doors are identified by a painted number
- 9:22from one to four. Two reviews are conducted. The first
- 9:26revealed mister Epstein was in H zero one dash zero
- 9:30zero one L according to Century, but the suicide Watch
- 9:33log books indicate that he was in cell four. A
- 9:36second review was conducted on April thirteenth, twenty nineteen. While
- 9:40there were four inmates on these cells, Century show two
- 9:45inmates assigned to h O one zero zero one L,
- 9:49one assigned to eight zero one dash zero two L,
- 9:52and the fourth inmate assigned to a general population housing unit.
- 9:56Through physical observation of the dedicated suicide Watch c sets,
- 10:00there were four eight zero one cells. However, a review
- 10:04of the bop ware inmate housing format only shows three cells.
- 10:09Inmate movement and assignment are not accurately reflected in Century
- 10:13as required by p. Five five zero zero dot one
- 10:16four Correctional Service Procedure Manual. Nine Attorney logbooks four log
- 10:23books were not secured following mister Epstein's death. Specifically, three
- 10:26attorney log books located in the attorney visiting and front
- 10:30lobby areas and an inmate search logbook located in the
- 10:34attorney visiting area were not secured. All four books were
- 10:37still in use at the outset of the reconstruction and
- 10:40after the reconstruction team advised staff to secure them. P.
- 10:44Five three two four dot zero eight states in the
- 10:47event of suicide, institution staff, particularly correctional staff and other
- 10:52law enforcement personnel, will handle the site with the same
- 10:55level of protection as any crime scene in which a
- 10:58death has occurred. The policy further states all possible evidence
- 11:03and documentation will be preserved to provide data and support
- 11:07for subsequent investigations and investigators doing the psychological reconstruction. Further,
- 11:13a review of the attorney logbooks identified many errors and
- 11:17signify a systematic concern. For example, there were two concurrently
- 11:22open attorney logbooks in the attorney visiting area. Further, the
- 11:26different purposes of the two attorney logbooks, one in the
- 11:29attorney visit area and one in the front lobby, could
- 11:32not be explained. BOP staff were unable to articulate a
- 11:36system of control for the logbooks, and during reconstruction some
- 11:41of the logbooks could not be accounted for. Within the logbooks,
- 11:44entries were made out of the chronological order. Attorneys did
- 11:48not consistently sign in and doubt and significant information was
- 11:52illegible or missing. Columns were not consistently labeled. Logbook opening
- 11:57and closing dates were inconsistent, and the cover had been
- 12:01torn off several books. At the current time, these logbooks
- 12:04are not functioning as an adequate system of control and
- 12:08monitoring ten automatic external defibrillators. A review of available AEDs
- 12:15in the institution revealed that the list used for accountability
- 12:18and inspection purposes was inaccurate and incomplete. Eleven post orders
- 12:23and shoe training Shoe post orders sign in sheets were
- 12:27reviewed for the third quarter spanning June ninth, twenty nineteen
- 12:31to September seventh, twenty nineteen. Officer L. Gray failed to
- 12:36sign post orders for shoe number three posts. Quarterly shoe
- 12:40training sign in sheets were reviewed. The twenty nineteen third
- 12:44quarter shoe training was conducted on June six, twenty nineteen.
- 12:49Three staff assigned to the third quarter shoe roster in
- 12:53shoe did not attend or receive the shoe training. Officer adapted,
- 12:57Officer adacted, and Officer adacted. Twelve staffing. The Drug Abuse
- 13:03Program Coordinator position at mcc New York was abolished during
- 13:07phase one of staff realignment during fiscal year twenty eighteen.
- 13:12Re Establishing the Drug Abuse Program Coordinator position would provide
- 13:15the institution with an additional supervised repsychologist to provide critical
- 13:20clinical service. Staffing in the Correctional Service department is relevant
- 13:25to the reconstruction. However, the details about this topic are
- 13:29provided in the after action review completed separately from the
- 13:32report Number thirteen. Case conceptualization, a broad understanding of risk
- 13:38factors associated with sex offenders by staff at mcc New
- 13:42York did not appear to be present, but was vital
- 13:45to his adjustment and safety in prison. There is limited
- 13:49time for psychologists to dedicate extended periods conceptualizing cases. However,
- 13:54it's recommended in particularly complex and high profile cases in
- 13:59order to provide the effective psychological interventions and maximize support
- 14:04for executive staff management of inmates. The documents examined true

- 15:24came up with after Epstein's death. Now, does it sound
- 15:29to you like they're sure of what went down? Because
- 15:32the sure seems to me that they have no idea
- 15:34what happened in that jail cell that Epstein was sharing
- 15:37with Nicholas Tartaglioni. And if the BOP is lying about that,
- 15:41what else are they lying about? And why? And that,
- 15:44of course is the million dollar question. All the information
