Latest / Kenny Wallace Media / Ravens Quarterback Lamar Jackson Files Trademark Complaint vs Dale Earnhardt Jr. Over Number 8 | Charlie Marlow Show
Transcript
- 0:00Hello everybody, we are live Charlie Marlowe here on the
- 0:03Kenny Wallace YouTube channel. Pretty interesting story you see
- 0:08there on the headline Ravens quarterback.
- 0:11And by the way, this is not a hoax.
- 0:12This is real. Baltimore Ravens quarterback
- 0:16Lamar Jackson files trademark complaint versus Dale Earnhardt
- 0:21junior over the number 8. This is crazy folks.
- 0:26The NFL NASCAR now this is not, is not filing a lawsuit.
- 0:32This is not technically you're suing someone.
- 0:35It is called trademark opposition.
- 0:38Let's dive into this because I saw this story last night.
- 0:40I'm like, what the heck is going on?
- 0:42People are talking about it all over social media.
- 0:46So here we go. I'm going to read you, by the
- 0:47way, from the the Daily Mail. You guys love the Daily Mail,
- 0:51right? What a quality, quality
- 0:53publication. Here's their headline.
- 0:55Lamar Jackson launches Petty legal attack on NASCAR legend
- 1:00Dale Earnhardt Junior in bitter feud.
- 1:03Is it really? Is it really bitter?
- 1:05We'll see. It does sure seem like it's
- 1:08Petty, not Richard Petty, pun intended.
- 1:11It does seem petty coming from Lamar Jackson, so I'll read
- 1:15further here. OK, so Dale Earnhardt Junior's
- 1:20company. According to this article, DEJ
- 1:22Holdings move to trademark the number 8 for merchandising back
- 1:28in 2024. Last year, remember, of course,
- 1:30he brought the car back for his late model race there.
- 1:34It was a huge success. They sold tons of die cast and
- 1:38all the gear and the Budweiser. It was fun.
- 1:40It was a throwback. Everybody was nostalgic about
- 1:44that. It was really cool.
- 1:46So he moved to trademark the number 8.
- 1:50And here's another thing, Dale Earnhardt Junior has been
- 1:53running the number 8 Budweiser car since 1999, or he started, I
- 1:58should say, in 1999. Do you know how old Lamar
- 2:02Jackson is? Lamar Jackson, I look this up, I
- 2:06think he's 27 years old, 27 years old.
- 2:10So he was born in 1997. So he'll be turning 28.
- 2:16So Lamar Jackson was two years old when Dale Earnhardt Junior
- 2:20started running the number 8 Budweiser car.
- 2:24It's a number, Lamar. It's the number 8, right?
- 2:28Who owns a number? Who owns a letter?
- 2:32Who owns a number? It's the number 8.
- 2:34And I think this is the interesting part of it.
- 2:36So, and I'll get to it in one second.
- 2:38So Jackson, according to this Daily Mail article, has
- 2:42previously filed a trademark Era 8, an Era 8 by Lamar Jackson for
- 2:48products including hats, shoes and bags.
- 2:51And apparently I was reading from another article that he
- 2:53also did a similar trademark opposition to Troy Aikman.
- 2:58Troy Aikman was trying to have a trademark on 8 spelled out
- 3:04EIGHTI just think this is crazy. First of all, I know that I'm
- 3:09speaking right now to a NASCAR audience.
- 3:11So you're all going to say that Dale Earnhardt Junior is more
- 3:13synonymous with the number 8, which I think I think he is big
- 3:17picture, but also the NFL. We know, let's just be honest,
- 3:21the NFL is much bigger than NASCAR.
- 3:24But Dale Earnhardt Junior is the biggest star in NASCAR still,
- 3:29even though he's no longer a NASCAR driver.
- 3:31He's an owner with Junior Motorsports in the Xfinity
- 3:35Series. And obviously, they ran the Cup
- 3:36car with Justin Allgeier for the Daytona 500.
- 3:39But I do find this kind of interesting because who do you
- 3:42think, whether it's United States or globally, who do you
- 3:46think is bigger? And I haven't even looked this
- 3:48up. I wanted to do it live on the
- 3:50show here. This doesn't really matter.
- 3:52But let's look at Instagram, right?
- 3:54Instagram followers, who has more?
- 3:56And I have no clue. I'm doing this live with you,
- 4:00Dale. And her junior is a huge star.
- 4:02But we also know that the NFL is a different ball game.
- 4:05So here we go. Lamar Jackson on Instagram.
- 4:09His handle is New era 8. New under score era 8.
- 4:13He has 3.6 million followers on Instagram.
- 4:18Let's see what Dale Junior has. So 3.6 million for Lamar
- 4:21Jackson. Dale Junior has 1,000,000
- 4:26followers on Instagram. Does that really matter?
- 4:29I'm just talking about cachet, Q rating.
- 4:32Again, we all know Dale Earnhardt Junior is the biggest
- 4:34thing in NASCAR still the Earnhardt name, one of the
- 4:38biggest names, if not the biggest in the history of
- 4:40NASCAR. But the NFL is a different ball
- 4:42game when we're talking about a trademark dispute, right?
- 4:47And who has access or who owns a number.
- 4:52When I say owns, obviously they're both trying to trademark
- 4:55this number. Let's go to X.
- 4:56And I won't do this for every social media site, but I'm just
- 4:58kind of interested because people have more followers on
- 5:01different sites, so on and so forth.
- 5:03If you can hear the rain in the background, I'm here in St.
- 5:05Louis, MO. It's just been raining freaking
- 5:07non-stop for for weeks here. So on X, Dale Earnhardt Junior
- 5:13has 2.5 million followers. Lamar Jackson has 1.2 million
- 5:20followers. So there you go.
- 5:22Dale Junior has him on X double the followers.
- 5:25But on Instagram, Lamar Jackson, what do we say?
- 5:28We said 3.6. I already don't even remember.
- 5:32What did I say Dale Earnhardt Junior had on Instagram.
- 5:34I don't have the best memory. We had Lamar Jackson with 3.6
- 5:39million Instagram followers and Dale Junior with how many?
- 5:44How many? I'm finding it here folks.
- 5:46I'm not a big Instagram person. 1,000,000 So Lamar Jackson has
- 5:503.6 times the amount of followers on Instagram and is
- 5:54that really important? I just thought it was
- 5:56interesting to see because again, we're going to have two
- 5:58people here who are kind of saying no, this is my number,
- 6:01I'm the bigger name or I should have the rights to this.
- 6:04Dale Junior is the biggest thing in NASCAR.
- 6:06He was using the number first. He was using it back in 1999
- 6:10with the Budweiser car when Lamar Jackson was two years old.
- 6:15I also think it's funny because on on Herman Schrader this past
- 6:19week, there was a fun little debate about are numbers even
- 6:22relevant in NASCAR anymore? And I still think they are.
- 6:27Kenny Schrader didn't, but going back in the day, the iconic
- 6:31numbers, 43 for Petty and three for Earnhardt and 24 for Jeff
- 6:36Gordon and the two for Rusty Wallace.
- 6:39I still think there's a lot of cachet with with the numbers,
- 6:43probably not as much now. I would agree with that, but I
- 6:46do think somebody like Dale Earnhardt junior, especially the
- 6:51red 8, I feel like you can't both of them use this.
- 6:54By the way, with Dale Junior, it's a red 8.
- 6:58Excuse me, it's a white 8 with red all around.
- 7:00It looks totally different than a white 8 with purple all around
- 7:05it or whatever they're going to do with with Lamar Jackson.
- 7:08I I think this is kind of silly. So the article that said this is
- 7:11petty. It does feel petty.
- 7:14I feel like both these guys should be able to have
- 7:17merchandise with the number 8 in their different ways.
- 7:20It's a number. It's a number that's been out
- 7:22there since who? Who started numbers?
- 7:25The Egyptians. I don't even know.
- 7:26Numbers have been around forever, right?
- 7:29Does anybody really have ownership of a number?
- 7:32I understand color schemes around a number.
- 7:34OK, we're kind of getting in the legal weeds here, but I want to
- 7:37hear from you guys as well. I'm not going to go super long
- 7:40on this video. I just found it very, very
- 7:43interesting. And look, it's two iconic big
- 7:47names in Lamar Jackson, in Dale Earnhardt junior, in the NFL, in
- 7:53NASCAR. We got some overlap here.
- 7:56We got some sports overlap, which is always fun.
- 7:58And remember, as I said earlier, if you're just joining us, Lamar
- 8:01Jackson also did a similar thing to Troy Aikman, who also has
- 8:05been around a lot longer than Lamar Jackson with the number 8,
- 8:08of course, from the Dallas Cowboys.
- 8:10So I'm going to read some of your guys comments as well.
- 8:14We have 172 of you watching live on YouTube.
- 8:18This is also going to be posted on Kenny Wallace media podcast.
- 8:22By the way, since I have you, please give us a like please
- 8:26subscribe if you haven't already, please comment That
- 8:30helps our engagement on YouTube and if you're listening on
- 8:32podcasts also, please give us that five star rating.
- 8:36We really appreciate it comment. All that engagement helps get
- 8:40our videos and our podcasts out to as many people as possible.
- 8:43I've been talking with Kenny Wallace all day.
- 8:44Actually. We also posted a video earlier,
- 8:48a funny story about Jimmy Spencer's dad and he walked into
- 8:53the wrong RV back in the day. It was Kenny Wallace's RV
- 8:55because all the RV's look the same.
- 8:57So there you go. That's what we have going on.
- 9:00And we also have Clay Milliken on the Kenny Conversation, NHRA
- 9:03drag racing champion. That's on YouTube, Kenny
- 9:07Wallace, YouTube, but also it's on Dirty MO Media podcast.
- 9:09So just quick catching you up with what's going on this week
- 9:12for us. But now back to the story of the
- 9:14day. If you're joining us right now,
- 9:17Ravens quarterback Lamar Jackson files trademark complaint or
- 9:21opposition. He's not suing Dale Earnhardt
- 9:23Junior. It's a trademark complaint or
- 9:25opposition versus Dale Earnhardt Junior over the iconic #8 which
- 9:30they both use. Dale Earnhardt Junior started
- 9:32driving the 8 car in 1999 when Lamar Jackson was two years old.
- 9:36But of course, now Lamar Jackson, very famous, very
- 9:38popular MVP quarterback, needs to win the playoffs.
- 9:41We know with the Baltimore Ravens, and I'm rooting for him.
- 9:44I got nothing against Lamar Jackson.
- 9:45I want him to win in the playoffs so he can cut everybody
- 9:49up about the fact that he doesn't win in the playoffs.
- 9:51But I do think this dispute is petty.
- 9:53Like the Daily Mail said, I don't think he's going to win.
- 9:56I feel like in the end, they're all going to be able to use the
- 9:59number 8 in their own ways to market products.
- 10:02And I feel like they should. Let's go find out what you guys
- 10:06are saying. I'm not going to read all of
- 10:07these and be nice people. Be nice Narnia 1086.
- 10:12This is what I'm saying. It's just a number.
- 10:14Why is it a big deal? That's what I'm saying.
- 10:18How about this from racer guy? Geez he doesn't understand
- 10:22messing with junior nation lol. But they both have huge huge fan
- 10:25bases. We said Instagram followers.
- 10:28Dale junior 1,000,000 Lamar Jackson 3.6 million X followers
- 10:34Lamar Jackson what? 1.2 Dale Earnhardt junior double
- 10:37s them up with 2.5. I'm just throwing it out there.
- 10:39So you see, right, We all know the NFL is the biggest, the
- 10:43biggest game in town in the United States for sure.
- 10:46I don't want to say the world because soccer is more global,
- 10:49but you know what I'm saying? Let's see, CP 6565 says.
- 10:56In other words, Lamar Jackson wants no one but him to be able
- 10:58to use the number 8 from now on, not on jerseys.
- 11:01This is trademark opposition. So Lamar Jackson is saying in
- 11:04terms of marketing products, hats, merchandise, that's where
- 11:08this feud, as the Daily Mail says, a bitter feud.
- 11:12I can't wait to hear what Dale Junior has to say about this, if
- 11:15he's allowed to talk about it. Because again, this is in the
- 11:18legal realm. I don't know exactly what we
- 11:20call it, trademark complaint opposition, but it is in the
- 11:22legal realm. So maybe he doesn't want to
- 11:24speak publicly, but who knows? I would think next week on the
- 11:27podcast, maybe he does, I don't know.
- 11:29We have a partnership with Dirty MO Media, but I don't talk to
- 11:32Dale Junior every day. If he wants to call me, we can
- 11:35talk. I don't think he wants to call
- 11:37me at all. Not that, hey, it's all good.
- 11:40I'm just saying he's got he's got bigger fish to fry.
- 11:42But we'll see if he talks about it next week on the Dale Junior
- 11:44download. Let's see, here we go.
- 11:48Venom says, excuse me, it's not the DEI Style 8.
- 11:53It's the newer Style 8 that Junior Motorsports has.
- 11:57OK, either way, it's still the iconic 8.
- 12:00There's red, right? It's a throwback to the 1999 car
- 12:05when he started driving for Budweiser.
- 12:07I'm not going to get into the weeds of exactly what the 8
- 12:09looks like, but we all know Dale Earnhardt Junior, known for the
- 12:128 back in the day. He brought it back for his late
- 12:14model race. It is what it is.
- 12:17Let's see, Venom says Venom. It's still just a number that's
- 12:23from Narnia. They're arguing amongst
- 12:24themselves in the text in the chat.
- 12:27Let's see, let's see. OK, I want to make sure I I read
- 12:32these before I put up anything that's not appropriate.
- 12:35Silverado. I drive a Chevy Silverado by the
- 12:37way. I love that.
- 12:38So why not sue RCR? Because they run the 8 car every
- 12:41weekend. MF sounds like he's just hurting
- 12:43for money and wants to sue someone that had money to get
- 12:46rich like the rest of the sorry MFS in this world.
- 12:51Lamar's a bum. You guys are team junior on this
- 12:54for sure. Let's see, we also have Dale
- 13:00Junior had eight on his car at Concorde Speedway 1993.
- 13:04I was talking about the Budweiser 8.
- 13:06I don't know when Dale Junior first had the 8 on his car at
- 13:09all. You would know better than I,
- 13:11Jarrett. No one has the rights to a
- 13:13number. You can only trademark the
- 13:16stylization of a number. OK, so if they're saying the
- 13:19numbers are too similar, again, it's a it's a white 8 with red
- 13:23for Dale. It's a white 8 with the purple
- 13:25or whatever it is for Lamar. This is silly, folks.
- 13:27Come on, let's see, Catman says, talking about riding coattails.
- 13:33Who's Lamar? Come on, you know who Lamar
- 13:34Jackson, though, is? Very famous, very good Hall of
- 13:37Fame, future Hall of Fame quarterback, MVP multiple times.
- 13:40How many MVPS? 3 something like that for the
- 13:42Baltimore Ravens. I got nothing against Lamar, big
- 13:44picture, but I do think this is petty.
- 13:47Let's see, Media madness says so stupid.
- 13:51Let's see, I'm not going to get into all of this.
- 13:54Brandon Burnett, what a punk. Here we go.
- 13:58Al Milton says NASCAR owns the car numbers used in their
- 14:02series. A car owner has to get the car
- 14:03number from NASCAR. Jesse Harris says so.
- 14:07This is real. WTF.
- 14:11Here we go. I've seen a crosswalk countdown
- 14:14sign showing 8 ones. Watch out, that's from PJH
- 14:18making jokes. Yes, nobody owns the number 8.
- 14:21Come on now. Here we go.
- 14:23Everybody's saying who is Lamar? So stupid.
- 14:27It's a number. Never heard of Jackson until
- 14:29now. You never heard of Lamar
- 14:30Jackson? Come on now.
- 14:32Wow, from slow burn. I'm not going to put all these
- 14:34up there. Let's see.
- 14:38Dude, this is crazy. He's delusional.
- 14:41They've been using #8 before his Mama was in diapers smearing
- 14:47poop on the walls. Got a lot of comments.
- 14:50You guys are fired up. Fired up and I get it.
- 14:54So we're arguing over a font type.
- 14:56Good God Steve B football players don't market numbers for
- 15:02NASCAR. A driver's number is literally
- 15:03their brand. This is apples and oranges.
- 15:05I think some football players, some numbers are more iconic to
- 15:09different players than different sports.
- 15:10I think we can agree on that. Never seen more entitled butt
- 15:15hurt group of individuals. That's from slowburn.
- 15:19Kristen Angier says Dale Junior is 1000 times more important
- 15:22than Lamar will ever be. Well I understand if you think
- 15:25that. And look, I have nothing against
- 15:26either guy obviously, but we're in the NASCAR world.
- 15:29This channel is NASCAR driven. You guys are NASCAR fans.
- 15:32I do think this is petty, but Lamar Jackson is a huge name
- 15:35also. So is Dale Earnhardt Junior, but
- 15:39it is 2 heavyweights. It's two heavyweights going toe
- 15:41to toe here over this trademark. Catman says lol Stevie B says I
- 15:47bet it's Lamar's team and not really him doing this.
- 15:49I don't know. Doesn't he have the final say?
- 15:51Come on now, this is funny. Kathy Wooden.
- 15:55What's next? Is Gretzky going to sue Suarez
- 15:58for the use of the 99? That one would not be close,
- 16:02let's be real. Wayne Gretzky?
- 16:05Daniel Suarez. All due respect.
- 16:06Daniel Suarez not on the same level.
- 16:09I do think it's fair to say Dale Earnhardt Junior and Lamar
- 16:12Jackson are pretty close to the same level.
- 16:15We're talking national cache, Q rating and all that.
- 16:18Understand, we're all NASCAR fans here, but the NFL is bigger
- 16:22than big, and Lamar Jackson's one of the best players in the
- 16:23NFLMVP, what, three times? Whatever it is, I don't even
- 16:26know. Somebody can check on that, so
- 16:29here we go. This isn't affecting other
- 16:32numbers like RCRS. This is a trademark.
- 16:34It's a stylistic opposition, apparently.
- 16:38I'm not an expert on this. I just thought it was
- 16:40interesting to talk about. It's been all over social media.
- 16:43You've probably been seeing this.
- 16:46Let's see. Here we go.
- 16:49So here we go. This is from Hildy.
- 16:52How can we be confused about the use of the number as stated by
- 16:56Lamar? Lamar uses era 8 on his merch.
- 16:59No confusion here. Plus, we waited for years for
- 17:01Junior to get his number back from Teresa.
- 17:04So good luck, Lamar. Yeah, I think this is petty.
- 17:06I don't think it's going to go very far and I think in the end
- 17:11they'll both be able to to trademark or whatever, use their
- 17:14numbers in different ways. That's me.
- 17:16If common sense prevails, which I do think it will, we're
- 17:20getting a lot of people got 169 people watching live on YouTube.
- 17:23Thank you again. Please hit that like button.
- 17:26Subscribe, please, if you haven't, drop a comment.
- 17:30And then if you're listening on Kenny Wallace media podcast,
- 17:32same deal. Please throw a comment out
- 17:34there. Give us that five star rating.
- 17:35It helps. We really, really appreciate it.
- 17:38Steve B says so Junior will just change the style of the 8 to
- 17:42something else, then make this go away.
- 17:43Sounds like not a big deal. Yeah, it's not a huge deal, but
- 17:46it's kind of interesting. And again, Lamar Jackson did
- 17:48this with Troy Aikman, who was also trying to trademark 8.
- 17:52I read EIGHT. In the end, I don't think this
- 17:56is a big deal. I think they'll all be able to
- 17:59use merch in different ways, and we'll figure this out.
- 18:01But it's fun to talk about right now on a slow Friday as it's
- 18:04raining like crazy here in Saint Louis.
- 18:06So there you go. I'm going to log off.
- 18:09Didn't want to go too long. 18 minutes.
- 18:11Thank you so much for watching and listening.
- 18:14Love you all. Love you all.
- 18:18And I'll read a couple more comments.
- 18:21Let's see. We got blue app NASA.
- 18:24No, thank you. Always go.
- 18:25Kenny, you better not cave. I don't think Junior can cave on
- 18:28this. You don't think Junior can cave
- 18:31on this? I'm trying to get rid of my
- 18:32comments here. What the heck is going on?
- 18:35How do I get rid of my comments? I don't want to show it.
- 18:37I don't want to show the comments.
- 18:39Hi there we go. OK, I'll shut her down 19
- 18:42minutes. Thank you guys didn't want to go
- 18:43too long. Interesting story comment once
- 18:46this video is is put on YouTube as it recorded and drop your
- 18:50comments podcast as well. Love you all have a great
- 18:52weekend everybody. Darlington throwback can't wait.
- 18:56See ya. Take care, Charlie Marlow
- 18:59signing off.
