Speaker 1: What's up everyone and welcome to another episode of the
• 0:02
Speaker 1: Epstein Chronicles. In this episode we're going to pick up
• 0:06
Speaker 1: where we left off with the letter sent by Epstein's
• 0:08
Speaker 1: legal team to Alex Acosta during the negotiation for the MPA. C.
• 0:14
Speaker 1: Detective redacted made material omissions in the police report. In
• 0:19
Speaker 1: addition to the misstatements in the police report and probable
• 0:22
Speaker 1: cause affidavit as to the evidentiary record, there were also
• 0:26
Speaker 1: material omissions, both of facts known to the PBBPD and
• 0:30
Speaker 1: also facts not known to the PBPD, though known by
• 0:34
Speaker 1: the state attorney. In the latter instance, the lack of
• 0:37
Speaker 1: knowledge was a result of the PBPD's refusal to receive
• 0:41
Speaker 1: the exculpatory evidence. In fact, they refused to attend a
• 0:45
Speaker 1: meeting called by state attorney specifically to provide the relevant evidence. Thus,
• 0:49
Speaker 1: the police report and probable cause affidavit only offered a
• 0:52
Speaker 1: skewed view of the facts material to this matter. Examples follow. 1.
• 0:58
Speaker 1: the video surveillance equipment located in Mr. Epstein's office and garage.
• 1:03
Speaker 1: Both the police report at 43 and the probable cause
• 1:06
Speaker 1: affidavit at 18 make particular mention of the discovery of
• 1:09
Speaker 1: video surveillance equipment, or covert cameras as they are called,
• 1:14
Speaker 1: in Epstein's garage and library office. Inclusion of this information
• 1:18
Speaker 1: insinuates a link between the equipment and the events at issue.
• 1:22
Speaker 1: In the probable cause affidavit, Detective Redacted states, on the
• 1:26
Speaker 1: first floor of the Epstein residence, Detective Redacted found two
• 1:30
Speaker 1: covert cameras hidden within clocks. One was located in the
• 1:34
Speaker 1: garage and the other located in the library area on
• 1:37
Speaker 1: a shelf behind Epstein's desk. The computer's hard drive was reviewed,
• 1:41
Speaker 1: which showed several images of Redacted and other witnesses that
• 1:45
Speaker 1: have been interviewed. All of these images appeared to come
• 1:48
Speaker 1: from the camera positioned behind Epstein's desk. See probable cause
• 1:52
Speaker 1: affidavit at 18. Clearly omitted from both the police report
• 1:57
Speaker 1: and the probable cause affidavit, is the fact that the PBPD,
• 2:01
Speaker 1: and specifically Detective Redacted, knew about the cameras since they
• 2:04
Speaker 1: were installed in 2003 with the help of the PBPD
• 2:09
Speaker 1: to address the theft of cash from Epstein's home. This
• 2:12
Speaker 1: fact's detailed in a Palm Beach police report prepared in
• 2:15
Speaker 1: the October 2003 detailing the thefts, the installation of video equipment,
• 2:21
Speaker 1: the video recording capturing Juan Alessi, Mr. Epstein's then house manager, red-handed,
• 2:26
Speaker 1: and the incriminating statements made by Alessi when he was
• 2:29
Speaker 1: confronted at the time. See Alessi Police Report at 5
• 2:33
Speaker 1: and 8. The Contemporaneous Police Report confirms the fact that
• 2:37
Speaker 1: the video footage was turned over to Detective Redacted himself. 2.
• 2:42
Speaker 1: Polygraph Examination and Report On May 2, 2006, Mr. Epstein
• 2:47
Speaker 1: submitted to a polygraph examination by George Slattery, a highly
• 2:51
Speaker 1: respected polygraph examiner who was regularly used by the state attorney.
• 2:56
Speaker 1: The examination was done at a time when we were
• 2:58
Speaker 1: told that the sole focus of the investigation was the
• 3:01
Speaker 1: conduct with redacted. Mr. Epstein was asked whether he had
• 3:05
Speaker 1: sexual contact with redacted, B, whether in any way he
• 3:08
Speaker 1: threatened redacted, C, whether he was told by redacted that
• 3:12
Speaker 1: she was 18 years old, and D, whether he believed
• 3:15
Speaker 1: redacted was 18 years old. As set forth in the
• 3:18
Speaker 1: report of the examination, the term sexual contact was given
• 3:21
Speaker 1: an extremely broad meaning, in order to capture any inappropriate
• 3:25
Speaker 1: conduct that could have occurred. The results of the examination
• 3:29
Speaker 1: confirm that 1. No such conduct occurred. 2. Mr. Epstein
• 3:33
Speaker 1: never threatened Redacted. 3. Redacted told Mr. Epstein she was
• 3:37
Speaker 1: 18 years old. 4. Mr. Epstein believed Redacted was 18
• 3:41
Speaker 1: years old. 3. Broken sex toys in Mr. Epstein's trash.
• 3:47
Speaker 1: The police report details the police finding in Mr. Epstein's
• 3:50
Speaker 1: trash what's described as broken pieces of a sex toy.
• 3:54
Speaker 1: and that this discovery purportedly corroborated witness statements. Omitted from
• 3:58
Speaker 1: both the police report and the probable cause affidavit is
• 4:01
Speaker 1: the fact that during the course of executing the search
• 4:04
Speaker 1: warrant in Epstein's home, the police discovered the other piece
• 4:07
Speaker 1: of that key, sex toy, and realized it was in
• 4:10
Speaker 1: fact the broken handle of a salad server. Though sex
• 4:14
Speaker 1: toys play a prominent role in the police report and
• 4:16
Speaker 1: probable cause affidavit, the police report was never amended to
• 4:20
Speaker 1: reflect the discovery of this new and highly relevant evidence. 4.
• 4:26
Speaker 1: Failure to consider exculpatory or impeaching evidence. Other exculpatory and
• 4:30
Speaker 1: impeaching evidence known by the PBPD was omitted from the
• 4:34
Speaker 1: police report and probable cause affidavit by, in our view,
• 4:38
Speaker 1: manipulating the date the investigation was allegedly closed. According to
• 4:43
Speaker 1: police report at 85, Detective Redacted explained to ASA Redacted
• 4:48
Speaker 1: that PBPD had concluded its case in December of 2005.
• 4:51
Speaker 1: That assertion which is false, conveniently resulted in the omission
• 4:58
Speaker 1: of all information adduced subsequent to that date. Thus, though
• 5:02
Speaker 1: the police report in fact contains information obtained after December 2005,
• 5:05
Speaker 1: the PBPD purported to justify its refusal to consider or
• 5:11
Speaker 1: even to include in the police report the probable cause
• 5:14
Speaker 1: affidavit or what it released to the public. All the
• 5:17
Speaker 1: exculpatory and evidence impeaching the witness submitted on behalf of Mr. Epstein,
• 5:22
Speaker 1: most of which was provided in After December 2005, the
• 5:26
Speaker 1: evidence is listed below. Unreported criminal histories and mental health
• 5:31
Speaker 1: problems of the witnesses relied on in the police report
• 5:34
Speaker 1: and probable cause affidavit. Evidence obtained concerning the witnesses relied
• 5:39
Speaker 1: upon to support the probable cause affidavit shows significant doubt
• 5:44
Speaker 1: on whether these witnesses are sufficiently credible or to support
• 5:48
Speaker 1: the finding of probable cause, let alone to sustain what
• 5:51
Speaker 1: would be the prosecution's burden of proof at trial. Though
• 5:55
Speaker 1: such evidence was submitted to the PB, PD, none of
• 5:58
Speaker 1: it was included in the police report of the probable
• 6:01
Speaker 1: cause affidavit. While the police report at 57 and the
• 6:06
Speaker 1: probable cause affidavit at 21 contain assertions by Alessi, which
• 6:11
Speaker 1: allegedly support bringing criminal charges, the evidence revealing Alessi's evident
• 6:15
Speaker 1: mental instability Prior criminal conduct against Epstein and bias towards
• 6:20
Speaker 1: Epstein is notably omitted. As detailed above in 2003, Oleski
• 6:25
Speaker 1: was filmed taking money from Epstein's home after being caught
• 6:28
Speaker 1: on videotape unlawfully entering Epstein's home and stealing cash from
• 6:32
Speaker 1: a briefcase. Oleski admitted to the PBPD that he entered
• 6:36
Speaker 1: the house unlawfully on numerous occasions, stealing cash and attempting
• 6:40
Speaker 1: to steal Epstein's licensed handgun to commit suicide. Although this
• 6:44
Speaker 1: information was known by Detective Redacted at the time the
• 6:48
Speaker 1: police report and probable cause affidavit were prepared, it's clearly
• 6:52
Speaker 1: material to any determination of credibility that it was omitted.
• 6:56
Speaker 1: Redacted was the source of the vast majority of the
• 6:59
Speaker 1: serious allegations made against Epstein. While the police report and
• 7:03
Speaker 1: probable cause affidavit rely on Redacted's numerous assertions, there are
• 7:07
Speaker 1: two significant problems with that reliance. First, there is no
• 7:11
Speaker 1: mention of certain critical admissions made by Redacted during her interview,
• 7:16
Speaker 1: as well as on her MySpace page, discovered by defense
• 7:19
Speaker 1: investigators and turned over to the state attorney. Second, all
• 7:23
Speaker 1: but omitted from the police report is any reference to
• 7:25
Speaker 1: the fact known by the PBPD specifically that at the
• 7:29
Speaker 1: time Redacted was making these assertions, she had been arrested
• 7:33
Speaker 1: by the PBPD and was being prosecuted for possession of
• 7:37
Speaker 1: marijuana and drug paraphernalia. We can take each in turn.
• 7:41
Speaker 1: Redacted admits voluntary sexual contact with Epstein, refuses to disclose
• 7:46
Speaker 1: the disposition of the monies she earned, and lies about
• 7:50
Speaker 1: being given a car by Epstein. Detective Redacted failed to
• 7:53
Speaker 1: include in the police report Redacted's admission that on one
• 7:57
Speaker 1: occasion she engaged in sexual conduct with Epstein's girlfriend as
• 8:01
Speaker 1: her birthday gift to Epstein. Nor does Detective Redacted include
• 8:05
Speaker 1: the fact that Redacted flatly refused to discuss with him
• 8:09
Speaker 1: the disposition of the thousands of dollars she said she
• 8:12
Speaker 1: was given by Epstein, or that she falsely claimed that
• 8:15
Speaker 1: she did not use drugs despite her MySpace entries, in
• 8:18
Speaker 1: which she exclaims, I can't wait to buy some weed.
• 8:21
Speaker 1: Detective Redacted was aware the car had been rented, not purchased,
• 8:25
Speaker 1: and only it was leased on a monthly basis for
• 8:28
Speaker 1: two months. While Redacted's fanciful claim that she was given
• 8:31
Speaker 1: a car appears in the police report, it was never corrected.
• 8:36
Speaker 1: Redacted was arrested for possession of marijuana and drug paraphernalia.
• 8:41
Speaker 1: As noted on September 11, 2005, Redacted was arrested for
• 8:45
Speaker 1: possession of marijuana and drug paraphernalia. In response to this arrest,
• 8:49
Speaker 1: Redacted came forward as a probable cause affidavit implies at
• 8:53
Speaker 1: 10 and 11, claiming she had knowledge of sexual activity
• 8:56
Speaker 1: taking place at Epstein's residence and misconduct by Epstein. This
• 9:01
Speaker 1: coming forward appears nowhere in the police report. Thus, it
• 9:05
Speaker 1: becomes clear that Redacted's assertions of misconduct by Epstein were
• 9:09
Speaker 1: motivated by her desire to avoid repercussions of her own
• 9:12
Speaker 1: criminal conduct, which should have been taken into account when
• 9:16
Speaker 1: assessing her credibility as a witness. Redacted steals from Victoria's
• 9:20
Speaker 1: Secret store. An investigation by a private investigator working for
• 9:25
Speaker 1: the defense revealed that in late 2005, Redacted was employed
• 9:29
Speaker 1: at a Victoria's Secret store in Florida. Three days after
• 9:32
Speaker 1: her marijuana case was terminated, Redacted was caught by a
• 9:35
Speaker 1: store manager as she attempted to leave the store with
• 9:38
Speaker 1: merchandise in her purse, the security tag still attached. Seeing
• 9:43
Speaker 1: the manager, Redacted claimed, someone's trying to set me up.
• 9:46
Speaker 1: Following an internal investigation which disclosed additional thefts from both
• 9:50
Speaker 1: the store and the customer, she was fired. In a
• 9:53
Speaker 1: recorded interview, Redacted admitted to stealing and asserted she had
• 9:57
Speaker 1: reasons for doing so. Was that she was not getting
• 10:01
Speaker 1: paid enough. This information and supporting documentation was presented to
• 10:05
Speaker 1: the PBPD, but was never included in the police report
• 10:09
Speaker 1: or probable cause affidavit. Redacted lies on MySpace about Victoria's
• 10:14
Speaker 1: Secret store termination. Also uncovered by defense investigators is Redacted's
• 10:19
Speaker 1: disassembling version of the Victoria's Secret debacle on her MySpace webpage. There,
• 10:24
Speaker 1: Redacted announced that she forgot to let everyone know I
• 10:28
Speaker 1: quit my job at VS. They said they suspected me
• 10:30
Speaker 1: of causing losses to their company, which by the way
• 10:33
Speaker 1: is bullshit. I was by the book on everything. I
• 10:37
Speaker 1: got so fed up in that office that I handed
• 10:40
Speaker 1: the loss prevention lady back my keys and walked out.
• 10:43
Speaker 1: This information and supporting documentation was provided by the defense
• 10:47
Speaker 1: to the PBPD, but was not included in the police
• 10:50
Speaker 1: report or probable cause affidavit. Alright folks, we're going to
• 10:54
Speaker 1: wrap up right here, and in the next episode, we're
• 10:56
Speaker 1: going to pick up where we left off. All the
• 10:59
Speaker 1: information that goes with this episode can be found in
• 11:02
  Speaker 1: the description box.
