The Epstein Investigation: Why an Independent Special Counsel Is Long Overdue (Part 5) (10/29/26) · The Epstein Chronicles

Speaker 1: What's up everyone and welcome to another episode of the
• 0:03
Speaker 1: Epstein Chronicles. In this episode, we're going to finish off
• 0:06
Speaker 1: talking about why it's time for a special counsel. The
• 0:11
Speaker 1: special counsel would also need a team capable of conducting
• 0:14
Speaker 1: difficult witness interviews without allowing wealth status or institutional prestige
• 0:20
Speaker 1: to dictate the terms of cooperation. Former prosecutors, investigators, correctional officials,
• 0:26
Speaker 1: financial professionals, employees, and other relevant witnesses should be interviewed
• 0:31
Speaker 1: according to the importance of their knowledge. Where lawful and appropriate,
• 0:37
Speaker 1: prosecutors should use grand jury subpoenas and other compulsory process,
• 0:41
Speaker 1: rather than relying exclusively on voluntary cooperation from people who
• 0:46
Speaker 1: may have reasons to withhold information. Statements should be tested
• 0:51
Speaker 1: against contemporary documents, communications, financial records, and other witness accounts.
• 0:57
Speaker 1: Inconsistencies that concern material facts should be investigated rather than
• 1:01
Speaker 1: dismissed because a witness possesses an impressive title or a
• 1:05
Speaker 1: powerful attorney. The passage of time will create legitimate evidentiary difficulties,
• 1:10
Speaker 1: including faded memories, unavailable records, and potential statute of limitation issues.
• 1:17
Speaker 1: These obstacles require careful legal work, not another sweeping announcement
• 1:21
Speaker 1: that pursuing the remaining questions would be pointless. A serious
• 1:26
Speaker 1: investigation would distinguish between a witness who genuinely cannot remember
• 1:30
Speaker 1: an event and a witness whose account is contradicted by
• 1:34
Speaker 1: reliable documentary evidence. It would also investigate potentially criminal false
• 1:39
Speaker 1: statements or obstruction without treating every inconsistency as proof of
• 1:44
Speaker 1: deliberate deception. The people who occupied powerful positions during the
• 1:48
Speaker 1: relevant period should be required to answer appropriate questions with
• 1:52
Speaker 1: the same seriousness expected any ordinary person summoned to provide
• 1:56
Speaker 1: evidence in a federal investigation. Now, the survivors must also
• 2:01
Speaker 1: have access to a process that does not repeat the
• 2:04
Speaker 1: extraordinary failures of the original prosecution. For years, women who
• 2:09
Speaker 1: reported abuse by Epstein have confronted legal proceedings, public attacks,
• 2:13
Speaker 1: disclosure controversies, and institutional decisions over which they possessed little control.
• 2:20
Speaker 1: The handling of the original non-prosecution agreement demonstrated how disastrously
• 2:24
Speaker 1: a system can function when the people most directly affected
• 2:28
Speaker 1: are treated as obstacles to a negotiated outcome. An independent
• 2:32
Speaker 1: special counsel should establish procedures for receiving information from survivors
• 2:37
Speaker 1: while honoring their rights, safety, and decisions about participation. That
• 2:42
Speaker 1: means experienced investigators, trauma-informed interviewing practices, clear explanations of the
• 2:47
Speaker 1: legal process, and serious protections against unnecessary exposure of identifying information.
• 2:54
Speaker 1: It also means recognizing that survivors may possess evidence about
• 2:58
Speaker 1: specific individuals or incidents that have never been adequately evaluated
• 3:03
Speaker 1: in criminal investigation. Those allegations should be investigated rigorously with
• 3:09
Speaker 1: corroborating evidence pursued wherever possible and legal conclusions based on
• 3:14
Speaker 1: what investigators can establish. They should not have to submit
• 3:18
Speaker 1: to another parade of officials offering sympathetic language while refusing
• 3:22
Speaker 1: to examine the substance of their information. Nor should politicians
• 3:27
Speaker 1: be permitted to appropriate their experiences for campaign purposes, while
• 3:32
Speaker 1: showing little interest in the difficult investigative work necessary to
• 3:36
Speaker 1: establish criminal responsibility. An independent investigation should treat survivors as
• 3:41
Speaker 1: people whose information and rights deserve serious attention, not as
• 3:46
Speaker 1: convenient supporting characters in another Washington political spectacle. The international
• 3:52
Speaker 1: dimensions of Epstein's activities make it equally important that a
• 3:56
Speaker 1: special counsel possess the resources to coordinate with authorities outside
• 4:00
Speaker 1: the federal government. Epstein maintained residences and relationships beyond the
• 4:05
Speaker 1: United States, and relevant witnesses or records may exist in
• 4:10
Speaker 1: multiple foreign jurisdictions. The British and French dimensions of the
• 4:14
Speaker 1: broader Epstein story have already generated substantial public attention. while
• 4:19
Speaker 1: investigations and legal proceedings involving the United States Virgin Islands
• 4:23
Speaker 1: and New Mexico have raised their own questions. A federal
• 4:27
Speaker 1: special counsel would not possess unlimited authority to seize evidence
• 4:31
Speaker 1: or compel testimony overseas, but established legal cooperation mechanisms could
• 4:37
Speaker 1: permit relevant investigative assistance. State prosecutors and foreign authorities may
• 4:43
Speaker 1: also possess evidence that federal investigators have never fully incorporated
• 4:47
Speaker 1: into their own work Cooperation should extend to sharing legally
• 4:52
Speaker 1: releasable information, coordinating investigative requests, and identifying overlapping conduct that
• 4:58
Speaker 1: might support criminal proceedings in different jurisdictions. The federal government
• 5:03
Speaker 1: should not treat possession of Epstein-related evidence as a monopoly
• 5:07
Speaker 1: that gives Washington the right to determine whether other jurisdictions
• 5:10
Speaker 1: can pursue their own legitimate inquiries. Where legal restrictions apply,
• 5:16
Speaker 1: investigators should identify those restrictions and and pursue appropriate judicial
• 5:20
Speaker 1: authorization rather than treating every obstacle as a permanent prohibition.
• 5:26
Speaker 1: And as far as I'm concerned, the broader geographic scope
• 5:29
Speaker 1: of Epstein's activities is another reason the investigation requires experienced
• 5:34
Speaker 1: leadership capable of coordinating complex criminal matters. A fragmented collection
• 5:39
Speaker 1: of inquiries operating without meaningful cooperation is precisely the kind
• 5:44
Speaker 1: of environment in which critical evidence can be overlooked and
• 5:47
Speaker 1: and responsibility can disappear between jurisdictional boundaries. Congressional oversight should continue,
• 5:54
Speaker 1: but nobody should confuse a congressional investigation with the independent
• 5:57
Speaker 1: criminal inquiry that this case requires. Congressional committees can subpoena records,
• 6:02
Speaker 1: question witnesses, hold hearings, and expose government misconduct, but their
• 6:07
Speaker 1: principal responsibilities are legislative and oversight functions. They cannot replace
• 6:13
Speaker 1: federal prosecutors or grand juries, and they cannot personally bring
• 6:17
Speaker 1: federal criminal charges against the people that they investigate. Their
• 6:21
Speaker 1: proceedings are also vulnerable to political bargaining, shifting majorities, partisan messaging,
• 6:27
Speaker 1: and the constant temptation to prioritize the next headline over
• 6:31
Speaker 1: the next evidentiary lead. We have already watched Epstein-related congressional
• 6:36
Speaker 1: proceedings produce public arguments, document disputes, contested testimony, and endless
• 6:42
Speaker 1: accusations about what the other party is refusing to disclose.
• 6:46
Speaker 1: Some of that oversight has been valuable, but it's not
• 6:49
Speaker 1: eliminated the need for an investigation capable of making independent
• 6:54
Speaker 1: criminal charging decisions. Lawmakers should continue demanding records and testimony
• 7:00
Speaker 1: while recognizing that their authority is not a substitute for
• 7:02
Speaker 1: the investigative tools available to a federal prosecutor. They should
• 7:08
Speaker 1: also be willing to scrutinize the conduct of officials affiliated
• 7:11
Speaker 1: with their own political party, rather than restricting their outrage
• 7:15
Speaker 1: to convenient adversaries. A special counsel could pursue criminal evidence
• 7:20
Speaker 1: while Congress examines legislative failures, executive oversight, and the institutional
• 7:25
Speaker 1: policies that allow serious problems to persist. Those functions should
• 7:30
Speaker 1: complement one another instead of producing another turf war in
• 7:33
Speaker 1: which Washington is spends more time arguing about investigative authority
• 7:38
Speaker 1: than examining the underlying conduct. Even the appointment of a
• 7:42
Speaker 1: special counsel would not guarantee success and anyone promising otherwise
• 7:46
Speaker 1: would be selling the public another fantasy. A special counsel
• 7:50
Speaker 1: appointed under the current regulation would retain substantial investigative independence
• 7:55
Speaker 1: but would still operate with an illegal framework involving the
• 7:58
Speaker 1: Attorney General. The Attorney General establishes the original jurisdiction and
• 8:03
Speaker 1: retains certain oversight powers including authority to request explanations of
• 8:08
Speaker 1: investigative steps and to address actions deemed inappropriate under applicable
• 8:12
Speaker 1: departmental standards. Removal is subject to specified grounds and important
• 8:18
Speaker 1: departmental decisions can still affect the practical operation of the investigation.
• 8:24
Speaker 1: Those limitations make transparency about the appointment, jurisdiction, resources, conflicts,
• 8:29
Speaker 1: and supervisory arrangements essential from the beginning. The special counsel
• 8:34
Speaker 1: should possess a sufficiently broad factual mandate to pursue legitimate
• 8:38
Speaker 1: evidence without repeatedly asking permission to examine obvious connections. The
• 8:43
Speaker 1: team should be staffed by people selected for competence and
• 8:47
Speaker 1: independence rather than their usefulness to a political administration. Decisions
• 8:52
Speaker 1: about criminal charges should be documented according to the law
• 8:55
Speaker 1: and evidence, and the public should receive as complete an
• 8:58
Speaker 1: explanation of the investigation's outcome as legal restrictions permit. Independence
• 9:05
Speaker 1: requires more than a title on a letterhead, and the
• 9:08
Speaker 1: American people have endured far too much bureaucratic theater to
• 9:12
Speaker 1: accept another investigation whose outcome is effectively dictated from above. Now,
• 9:17
Speaker 1: the political class should understand that calling for a special
• 9:20
Speaker 1: counsel is only the beginning of responsibility it has finally
• 9:24
Speaker 1: begun to acknowledge. Democrats who are making this demand must
• 9:28
Speaker 1: be prepared to support a genuinely independent investigation, even if
• 9:32
Speaker 1: the evidence leads towards individuals they would rather not see questioned.
• 9:36
Speaker 1: Republicans who insist that previous investigations settled every important issue
• 9:41
Speaker 1: must be prepared to explain why independent scrutiny of those
• 9:45
Speaker 1: conclusions should be considered threatening. Neither side should be allowed
• 9:50
Speaker 1: to retreat into accusations of partisan persecution whenever investigators begin
• 9:54
Speaker 1: examining uncomfortable evidence. The American people have spent years watching
• 9:59
Speaker 1: politics discover their principles whenever an opponent appears in an
• 10:03
Speaker 1: Epstein-related document and abandon those principles whenever an ally appears instead.
• 10:09
Speaker 1: That kind of selective outrage has been one of the
• 10:12
Speaker 1: most corrosive features of the entire scandal. Epstein's operation didn't
• 10:16
Speaker 1: develop in a political vacuum. and the documented failures surrounding
• 10:20
Speaker 1: his prosecution cannot honestly be examined through the narrow lens
• 10:25
Speaker 1: of contemporary party competition. The investigation should proceed according to
• 10:29
Speaker 1: the law, regardless of who controls Congress, who occupies the
• 10:33
Speaker 1: White House, or which political figures become embarrassed by its discoveries.
• 10:38
Speaker 1: Anyone who campaigns on promises of Epstein accountability should be
• 10:42
Speaker 1: expected to support the investigative independence necessary to make those
• 10:46
Speaker 1: promises meaningful. If politicians are serious about accountability, they should
• 10:52
Speaker 1: welcome the possibility that an investigation might expose facts they
• 10:56
Speaker 1: did not anticipate and conclusions they do not particularly enjoy.
• 11:01
Speaker 1: So for me, what makes the situation so infuriating is
• 11:04
Speaker 1: that the demand for accountability has never required the public
• 11:07
Speaker 1: to believe every allegation, embrace every conspiracy theory, or assume
• 11:11
Speaker 1: that every powerful person acquainted with Epstein committed a crime.
• 11:15
Speaker 1: It has required something considerably simpler. a genuine willingness to
• 11:20
Speaker 1: investigate credible evidence without allowing wealth, political connection, or institutional
• 11:25
Speaker 1: self-preservation to determine the outcome. The government has had nearly
• 11:30
Speaker 1: three decades to demonstrate that willingness, and its record has
• 11:34
Speaker 1: provided more than enough reasons for profound skepticism. A proposed
• 11:38
Speaker 1: 60-count federal indictment gave way to a notorious non-prosecution agreement.
• 11:44
Speaker 1: A later federal trafficking case ended when Epstein died before trial.
• 11:48
Speaker 1: and Maxwell's conviction established criminal participation by another central figure.
• 11:54
Speaker 1: Enormous quantities of records have since entered the public domain,
• 11:57
Speaker 1: generating new questions about individuals, institutions, and the decisions made
• 12:01
Speaker 1: by authorities over many years. The Justice Department has published
• 12:06
Speaker 1: millions of pages and defended its handling of the investigation,
• 12:10
Speaker 1: but public disclosure is not equivalent to independently established accountability.
• 12:16
Speaker 1: Nor can the public be expected to forget the history
• 12:18
Speaker 1: of the case simply because officials insist that the latest
• 12:22
Speaker 1: review has exhausted every possible lead. The question is whether
• 12:27
Speaker 1: there is sufficient evidence to justify renewed investigation of particular
• 12:31
Speaker 1: conduct and where that threshold is met. The work should
• 12:34
Speaker 1: proceed without regard to political inconvenience. A properly constituted special
• 12:40
Speaker 1: counsel would not guarantee the discovery of a vast conspiracy
• 12:44
Speaker 1: but it could establish a credible process for pursuing the
• 12:47
Speaker 1: criminal questions that remain open. After years of contradictory messaging
• 12:52
Speaker 1: and institutional defensiveness, even that basic commitment would represent a
• 12:57
Speaker 1: dramatic departure from the way this scandal has too often
• 13:00
Speaker 1: been handled. Now, I think the most important thing about
• 13:03
Speaker 1: an independent special counsel is that the investigation would no
• 13:06
Speaker 1: longer exist primarily as an exercise in defending decisions made
• 13:10
Speaker 1: by the Department of Justice over the previous three decades.
• 13:14
Speaker 1: The prosecutors who negotiated Epstein's agreement would not get to
• 13:18
Speaker 1: determine the boundaries of an inquiry into that agreement simply
• 13:22
Speaker 1: because they believed their decisions were justified. Senior officials who
• 13:26
Speaker 1: participated in relevant discussions would not be insulated from questioning
• 13:31
Speaker 1: because of their former positions or professional reputations, while the
• 13:35
Speaker 1: associates would not receive preferential treatment because of their resources,
• 13:39
Speaker 1: their influence, or the embarrassment their testimony might cause powerful people.
• 13:44
Speaker 1: Current government officials would not be entitled to dismiss material
• 13:47
Speaker 1: allegations without those allegations, receiving the scrutiny warranted by the
• 13:52
Speaker 1: available evidence. Every witness would be evaluated according to the
• 13:57
Speaker 1: relevance and credibility of their information, and every potential defendant
• 14:02
Speaker 1: would retain the legal protections that make a legitimate criminal
• 14:05
Speaker 1: prosecution possible. The special counsel's assignment would be to uncover
• 14:10
Speaker 1: provable criminal conduct, identify where the law permits prosecution, and
• 14:15
Speaker 1: establish an evidentiary record of the decisions that shaped the scandal.
• 14:19
Speaker 1: That means following the paper trail back to Florida, examining
• 14:23
Speaker 1: the federal offices that touched the case, investigating credible evidence
• 14:27
Speaker 1: involving Epstein's associates, and confronting questions at previous reviews left unanswered.
• 14:34
Speaker 1: It means recognizing that protecting the reputation of the Justice
• 14:37
Speaker 1: Department is not the same thing as protecting the administration
• 14:40
Speaker 1: of justice. And above all, It means finally abandoning the
• 14:44
Speaker 1: insulting premise that Americans should be satisfied with explanations produced
• 14:49
Speaker 1: by the same institutional machinery whose conduct has created so
• 14:53
Speaker 1: much of the controversy. So appoint the special counsel and
• 14:56
Speaker 1: make damn sure that the person selected is an outsider
• 15:00
Speaker 1: with the experience, independence, and willingness to examine everything the
• 15:04
Speaker 1: evidence legitimately places within reach. Give that prosecutor the resources
• 15:09
Speaker 1: to employ investigators, forensic accountants, experienced trial lawyers, and specialists
• 15:15
Speaker 1: capable of untangling the financial and institutional arrangements surrounding Epstein.
• 15:20
Speaker 1: Give the team a mandate that reaches from the original
• 15:23
Speaker 1: Florida prosecution through the subsequent federal investigations and the handling
• 15:27
Speaker 1: of relevant evidence under successive administrations. Require meaningful conflict screening,
• 15:33
Speaker 1: preserve the independence of prosecutorial decisions, and establish lawful procedures
• 15:38
Speaker 1: for making the findings available to the public. If the
• 15:42
Speaker 1: investigation uncovers federal crimes that can be prosecuted, bring the
• 15:46
Speaker 1: charges and present the evidence in court. If particular allegations
• 15:50
Speaker 1: cannot be substantiated, explain that conclusion as fully as the
• 15:54
Speaker 1: law permits instead of treating the absence of charges as
• 15:57
Speaker 1: proof that every investigative decision was flawless. If officials committed
• 16:02
Speaker 1: serious errors without committing crimes, document those errors and identify
• 16:07
Speaker 1: the institutional decisions that permitted them. If influential individuals exerted
• 16:13
Speaker 1: unlawful pressure to protect Epstein or anyone associated with him,
• 16:18
Speaker 1: pursue the evidence regardless of their names, titles, bank accounts,
• 16:21
Speaker 1: or political affiliations. The American people have heard enough about
• 16:26
Speaker 1: why this cannot be done, why now is not the
• 16:28
Speaker 1: right time, why the department should be trusted, and why
• 16:32
Speaker 1: asking further questions is supposedly unreasonable. It's long past time
• 16:37
Speaker 1: to stop asking the architects and defenders of this institutional
• 16:41
Speaker 1: catastrophe to investigate themselves. Hand the case to someone with
• 16:46
Speaker 1: no interest in protecting their reputations, and let's find out
• 16:50
Speaker 1: exactly how far this rot extends. All the information that
• 16:54
Speaker 1: goes with this episode can be found in the description box.
