Latest / DEEP INSIGHT / Clancy defense seeks lone holdout juror's phone records
Transcript
- 0:00Speaker 1: Welcome back. Breaking just moments ago, two new moves from
- 0:03Speaker 1: Lindsey Clancy's defense attorney after her murder trial ended with
- 0:07Speaker 1: one holdout juror. Her attorney wants that single juror now questioned,
- 0:11Speaker 1: also wants his phone records examined, while also asking the
- 0:14Speaker 1: judge to end the case without having a retrial. The
- 0:17Speaker 1: defense arguing the prosecution's own evidence. failed to prove that
- 0:20Speaker 1: Lindsay Clancy was criminally responsible for the murders of her
- 0:23Speaker 1: three children. National correspondent Brian Yannis is tracking it for us.
- 0:27Speaker 1: He joins us live in New York with more. Brian,
- 0:29Speaker 1: you've been all over this case from the beginning. What
- 0:31Speaker 1: can you tell us?
- 0:32Speaker 2: Well, Bill, good afternoon. Lindsay Clancy's attorney, Kevin Reddington, filed
- 0:35Speaker 2: a motion in court asking the judge to further question
- 0:39Speaker 2: the loan holdout juror in court about whether he lied
- 0:43Speaker 2: on his juror questionnaire or void dear by failing to
- 0:47Speaker 2: mention a prior domestic violence incident. and a restraining order
- 0:51Speaker 2: against him. Reddington is asking, quote, that the court examine
- 0:55Speaker 2: juror Doe on the record with counsel present on three
- 0:59Speaker 2: subjects only, the truthfulness of the questionnaire and void Deere's answers,
- 1:04Speaker 2: the sworn assurance of September 3rd, 2026, and the use
- 1:08Speaker 2: of a mobile telephone or receipt of outside information during deliberations.
- 1:13Speaker 2: The inquiry will not touch the substance of deliberations. Reddington
- 1:17Speaker 2: is asking the court for all 18 confidential juror questionnaires,
- 1:22Speaker 2: and he wants to review the lone holdout juror's cell
- 1:25Speaker 2: phone records between the hours.
- 1:26Speaker 1: Of 8.30 a.m.
- 1:28Speaker 2: And 4.30 p.m. on all of the deliberation days. Reddington
- 1:32Speaker 2: has also asked that juror Nick Dargy be potentially questioned
- 1:37Speaker 2: as well about the holdout juror's alleged use of a
- 1:40Speaker 2: cell phone during deliberations. Dargy said the holdout juror was
- 1:45Speaker 2: essentially disengaged, quote, scrolling on his phone while people were
- 1:50Speaker 2: talking to him. Michael Duranville has been identified as the
- 1:53Speaker 2: holdout juror. He's been attacked by four other jurors who
- 1:57Speaker 2: have spoken out publicly, accused of not following the law
- 2:01Speaker 2: on reasonable doubt. He has said, though, in a statement
- 2:04Speaker 2: that he did not have any doubts, that he tried
- 2:06Speaker 2: to explain different possible theories during deliberations, but that he
- 2:10Speaker 2: kept getting cut off as if he had doubts. He
- 2:13Speaker 2: says there was enough proof that Lindsey Clancy knew what
- 2:16Speaker 2: she was doing and planned it. He's now represented by
- 2:19Speaker 2: a defamation attorney. So ultimately here we have a September
- 2:23Speaker 2: 29th court date in which Kevin Reddington will present his
- 2:27Speaker 2: case as to why he thinks Lindsey Clancy should be
- 2:30Speaker 2: found not guilty by lack of criminal responsibility. He says
- 2:34Speaker 2: because of a lack of evidence. And then on top
- 2:37Speaker 2: of that, he is hoping the judge on that day
- 2:40Speaker 2: will accept a motion to further question this lone holdout juror,
- 2:44Speaker 2: Michael Duronville, on his actions during deliberations today. And then
- 2:48Speaker 2: on top of all of that, Bill, we know that
- 2:50Speaker 2: Reddington is also looking to file a motion on dismissing
- 2:54Speaker 2: this entire case on motions of double jeopardy. So they
- 2:59Speaker 2: are trying everything they can here to ensure that Lindsay
- 3:02Speaker 2: Clancy does not find her way in prison and does
- 3:04Speaker 2: not find that we do not have another trial here.
- 3:07Speaker 1: And, Brian, I'm really interested in this segment of the
- 3:10Speaker 1: motion where the defense, you just mentioned it, is asking
- 3:13Speaker 1: for this holdout juror's cell phone records between 8.30 a.m.
- 3:16Speaker 1: and 4.30 p.m. every day of deliberations. There were accusations
- 3:20Speaker 1: from the other jurors he was just endlessly scrolling and
- 3:22Speaker 1: not really paying attention. Give us some thoughts, some color
- 3:25Speaker 1: on what you think Kevin Reddington might find on that phone.
- 3:29Speaker 1: Does he think this juror was talking to other people
- 3:31Speaker 1: or was just surfing the Internet and not paying attention?
- 3:34Speaker 2: Well, I think it all speaks to the fact that
- 3:36Speaker 2: Kevin Reddington is trying to essentially find out if, in fact,
- 3:41Speaker 2: perhaps this holdout juror was breaking the law by searching articles,
- 3:46Speaker 2: for instance, on this case. That might be a possibility. Essentially,
- 3:50Speaker 2: he wants to see all the records to figure anything
- 3:52Speaker 2: out here. Was he completely disengaged? That could also be
- 3:55Speaker 2: part of his argument as to why he thinks this
- 3:58Speaker 2: holdout juror should not have been a part of this case. So, honestly,
- 4:02Speaker 2: when you're asking for cell phone records for all of
- 4:05Speaker 2: those days, I think it could be anything. And the
- 4:08Speaker 2: bottom line here is I think you're going to hear
- 4:10Speaker 2: from a lot of critics in all of this is, well,
- 4:12Speaker 2: if you're going to pull the cell phone records of
- 4:13Speaker 2: the holdout juror, Michael Duronville, Are you going to pull
- 4:16Speaker 2: the cell phone records of the other 11 jurors who
- 4:19Speaker 2: happened to vote against you or for you, I should say?
- 4:23Speaker 2: So in that case, I think you're going to have
- 4:24Speaker 2: a lot of discussions here about what about their cell
- 4:27Speaker 2: phone records and also what about their potential criminal histories
- 4:31Speaker 2: and run ins with the law? And did any of
- 4:32Speaker 2: them lie also on the questionnaire? So Reddington is focused
- 4:36Speaker 2: on this holdout juror because he's the one guy that
- 4:38Speaker 2: did not vote his way. But there's me a lot
- 4:40Speaker 2: of questions here about, well, what about the others, Bill?
- 4:43Speaker 1: Yep, some really good points there on this very, very
- 4:45Speaker 1: interesting development in this national case. Brian Yannis, as usual,
- 4:48Speaker 1: thank you for tracking this for us. We'll check in
- 4:50Speaker 1: again with you soon. Of course.
