- 0:03Speaker 1: This is a Bramble Jam podcast.
- 0:12Speaker 2: This week on your gabble gabble, is your left testicle
- 0:15Speaker 2: worth one million dollars? One thing for sure? The balls
- 0:19Speaker 2: and Judge Gino's court.
- 0:21Speaker 1: And if you can get hypnotized and it brings up something
- 0:24Speaker 1: that happened in your past, are you able to get
- 0:26Speaker 1: over that hump? Judge Ross tells us real people cases say,
- 0:30Speaker 1: just as.
- 0:35Speaker 2: I'm really proud about pulling Brandon, well.
- 0:37Speaker 1: You you just wait and see what I did there.
- 0:41Speaker 1: I don't want to give too much.
- 0:42Speaker 2: Ball is in Judge Gino's court. That's right, singular, that's good, right.
- 0:48Speaker 1: I love Judge. I mean, come on, man, I love judge.
- 0:51Speaker 3: Man.
- 0:51Speaker 2: Welcome to the gabble. Sounds like we've got a pair
- 0:54Speaker 2: of douce.
- 0:54Speaker 1: Hair of Doozy's.
- 0:56Speaker 3: Or it does, because shot don't know who to even
- 1:00Speaker 3: start with here in this this week's what do you think?
- 1:05Speaker 1: I'll go first?
- 1:05Speaker 2: You go first, We'll let the teesticle back clean up.
- 1:07Speaker 1: That's exactly as as you do. I want to answer you.
- 1:10Speaker 1: We're in a Judge Ross's court, America's court.
- 1:13Speaker 2: And here's the thing about that justice. A lot of
- 1:16Speaker 2: places you go and you're like Oh, it's like you're
- 1:18Speaker 2: speaking of different language.
- 1:19Speaker 3: I encourage everybody to go watch Judge Ross America's Court,
- 1:23Speaker 3: because without that, what we do every time we talk
- 1:25Speaker 3: about Judge Ross doesn't do.
- 1:26Speaker 2: Anything, doesn't do anything for it.
- 1:28Speaker 1: If you watch America's Court where they do the whole intro.
- 1:30Speaker 3: That was shot in the late nineties, Yes, it's so
- 1:34Speaker 3: funny how that show just always looks old, no matter
- 1:37Speaker 3: how the episodes are, it always I want.
- 1:42Speaker 1: To introduce you the Bruce Shuttlecock.
- 1:44Speaker 2: No, it can't be, it wouldn't be.
- 1:46Speaker 1: I do think that.
- 1:47Speaker 3: Last name is a joke based off of where we're
- 1:49Speaker 3: going here. But it's five thousand dollars for emotional distress.
- 1:53Speaker 3: He's suing Evan Davenport the Max, the Max five thousand dollars,
- 1:59Speaker 3: so Bruce claims. One night him, his then wife and
- 2:05Speaker 3: his friends went to go see Ahtist a show not
- 2:11Speaker 3: not a therapeutic.
- 2:12Speaker 2: No, they didn't like pay specifically to get like.
- 2:16Speaker 3: This is a show, okay. Evan is a professional hypnotist.
- 2:20Speaker 3: His shows are apparently, according to Bruce, he heard that
- 2:23Speaker 3: they're amazing and hilarious, so he had to go. Evan
- 2:26Speaker 3: pipes up and says, my shows are pretty basic. It's
- 2:30Speaker 3: a comedy show, and I use hypnotism. I was a
- 2:36Speaker 3: I did do this for therapy. I was a you know, hypnotherapist,
- 2:40Speaker 3: and that wasn't paying the bills. So I decided to
- 2:43Speaker 3: start doing the show. And it's gone gangbuster, gang buster.
- 2:46Speaker 2: Yeah.
- 2:47Speaker 3: Judge Ross asked real quick, how does it work? Do
- 2:51Speaker 3: what are we doing here? And he says, well, basically,
- 2:54Speaker 3: I just mess with your fight or flight thing in
- 2:57Speaker 3: your brain.
- 2:58Speaker 1: He uses the actual term, but you know your brain,
- 3:00Speaker 1: the fire flight thing in your brain.
- 3:01Speaker 2: Yes, I got it.
- 3:03Speaker 3: And but the key to this, the key to it working,
- 3:06Speaker 3: is that you have they have to consent to it.
- 3:09Speaker 1: Like if they are remotely skeptical or not.
- 3:14Speaker 2: They don't lean in.
- 3:15Speaker 1: They don't lean into it. It's not possible.
- 3:17Speaker 2: Basically, have you ever seen hypnotists not live? But I've
- 3:22Speaker 2: seen them, yeah, on TV and stuff.
- 3:23Speaker 1: I never that it's real hypnotists. They had it.
- 3:27Speaker 3: So after graduation, we had an all night thing in
- 3:32Speaker 3: a bowling alley, as you.
- 3:34Speaker 1: Do, to keep keep us out of the out of
- 3:36Speaker 1: trouble drinking and whatnot.
- 3:37Speaker 2: Class Titusville four exactly right, River Lanes Bowling and they
- 3:42Speaker 2: brought in a hypnotist, and it was it was, it was.
- 3:45Speaker 1: It was told you. I didn't get picked.
- 3:47Speaker 2: I don't think it was a real deal. Did you
- 3:48Speaker 2: think it was real?
- 3:50Speaker 1: I don't know.
- 3:51Speaker 2: Do you talk to anybody that got hypnotis?
- 3:52Speaker 3: Yeah, they were, they were, I mean yeah, yeah, I
- 3:56Speaker 3: mean there were a couple of buddies that.
- 3:58Speaker 1: Did it and they were like, yeah, that's real.
- 3:59Speaker 2: That's the only way I would ever believe it's real
- 4:01Speaker 2: is I would have to be hypnotized and then see
- 4:03Speaker 2: video of what I did without remembering.
- 4:04Speaker 1: But the you won't because of the way you're going
- 4:07Speaker 1: into it. It would never work on you. I would
- 4:10Speaker 1: be willing to lean in and say, yo, let's do
- 4:12Speaker 1: it your skepticals.
- 4:13Speaker 3: No, no, no, of course you just said the only
- 4:15Speaker 3: way you would ever believe it.
- 4:17Speaker 2: Because of where I'm sitting. If I'm the person in
- 4:20Speaker 2: the chair, I will one hundred percent quiet my mind
- 4:22Speaker 2: and let you try to hypnotize.
- 4:23Speaker 3: All right, let's get him in here, get them in
- 4:25Speaker 3: and bring them in. No, okay, So that's kind of
- 4:30Speaker 3: the deal. You have to you have to be in
- 4:32Speaker 3: for or in for it. I'm there, shuttle Cock is
- 4:35Speaker 3: there with his friends and his wife. There's two to
- 4:38Speaker 3: three hundred other people there, and Judge Ross asked Bruce
- 4:41Speaker 3: if he wanted to be a part of the show,
- 4:43Speaker 3: and he's like, kind of, my wife and my friends
- 4:46Speaker 3: really wanted me to do it. They said that it
- 4:48Speaker 3: would be funny. You know, I'm an energetic extrovert, ready
- 4:52Speaker 3: to clown.
- 4:53Speaker 1: They said you'd be great up there.
- 4:54Speaker 3: So yeah, I kind of throw my hand in the
- 4:56Speaker 3: ring and he's like, well, okay, so you did want
- 4:58Speaker 3: to go up there, And he's like a kind of
- 4:59Speaker 3: and he's what are you four? You either want to
- 5:02Speaker 3: do it or you don't want to do So he
- 5:04Speaker 3: goes on stage and there's a person right next to
- 5:06Speaker 3: him that's been turned into James Bond. He thinks that
- 5:09Speaker 3: he's James Bond. There's a few other other people on stage.
- 5:12Speaker 3: We'll hear about one of those people here in just
- 5:14Speaker 3: a second. But he gets hypnotized, and Bruce says, at
- 5:17Speaker 3: this point, I don't recall anything that happens, So all
- 5:23Speaker 3: that you're about to hear is through my wife, my friends,
- 5:26Speaker 3: and and Evan, who will corroborate the story.
- 5:30Speaker 2: Corroborate Are you four corroborate?
- 5:34Speaker 3: So Evan says, so there's another person on stage that
- 5:39Speaker 3: thought he was a goat. Okay, okay, So he says
- 5:43Speaker 3: that Bruce ran up to the goat man and starts
- 5:48Speaker 3: humping it.
- 5:50Speaker 1: Okay, let's if you go back to my intro that hump.
- 5:54Speaker 2: I love it. So he's nicely done. Shuttlecock's humping the goat.
- 5:58Speaker 1: There's no way that last year is real.
- 5:59Speaker 3: So, uh, he was just Evan says he was really
- 6:04Speaker 3: going to town there and he says, naturally, since it's
- 6:07Speaker 3: a comedy show, I go over with the mic and
- 6:09Speaker 3: I started investigating what's happening. Yeah, and Bruce, and he
- 6:13Speaker 3: says that Bruce was like, I'm really gonna do it
- 6:15Speaker 3: this time.
- 6:17Speaker 2: Yeah. So Judge Ross.
- 6:18Speaker 1: Calls out Bruce's.
- 6:21Speaker 3: Ex wife they were married at the time.
- 6:24Speaker 1: Yes, we do find out they are still married, but
- 6:27Speaker 1: they're legally separate.
- 6:28Speaker 3: Got it, and asks what she was thinking at the time,
- 6:32Speaker 3: and she says, well, at first I thought it was funny,
- 6:34Speaker 3: but I then I didn't.
- 6:37Speaker 1: At the time, I didn't know about the fraternity goat situation.
- 6:41Speaker 2: Oh my gosh.
- 6:43Speaker 3: So Ross says, whoa, whoa, whoa what fraternity goat incident?
- 6:49Speaker 3: So Bruce says, okay, so when I was in college,
- 6:51Speaker 3: I was eighteen, I was pledging to get into a fraternity.
- 6:53Speaker 3: There was a lot of alcohol, and something happened with
- 6:56Speaker 3: a goat. No, and Ross says, I don't need to
- 6:58Speaker 3: hear those details.
- 6:59Speaker 1: Don't either, So.
- 7:02Speaker 3: Hevin explains that something in hypnotherapy that they use is
- 7:07Speaker 3: called guided imagery. When somebody is under hypnosis and they
- 7:12Speaker 3: say that they see something, we try to guide them
- 7:15Speaker 3: through those images to explore.
- 7:17Speaker 2: Them, to explore them.
- 7:18Speaker 3: So when when when shutter cock over there brings up
- 7:24Speaker 3: the goat situation, yeah, I kept prying, of course in
- 7:29Speaker 3: exploring that. And he then went on to tell the
- 7:32Speaker 3: whole story. So this is the first time that his
- 7:36Speaker 3: wife at the time is hearing about and so Bruce says,
- 7:44Speaker 3: so after that happened, they go, you know, he leaves
- 7:48Speaker 3: and he later finds out.
- 7:51Speaker 1: Bruce is a teacher, and he later finds.
- 7:53Speaker 3: Out that there were some parents of his students in
- 7:56Speaker 3: the crowd. So the story of the fraternity goad incident
- 8:03Speaker 3: and him going to town on stage begins to spread
- 8:08Speaker 3: all over school.
- 8:09Speaker 1: Yes, and he ends up getting fired over this.
- 8:12Speaker 2: He got fired.
- 8:13Speaker 3: Now, Ross asks, why did you end up getting fired
- 8:16Speaker 3: for this, and he says, well, the kids were mocking
- 8:19Speaker 3: me and it became a distraction. Also, the term beast
- 8:24Speaker 3: reality was thrown around.
- 8:25Speaker 2: Oh my gosh.
- 8:29Speaker 1: So Ross looks at the paper showing that he lost
- 8:33Speaker 1: his job and is like, oh, you taught it a
- 8:36Speaker 1: Catholic school boy, and he says, yes.
- 8:44Speaker 2: Man, the hitch just keep on coming here, brain, you
- 8:46Speaker 2: are a lying. This is a good case.
- 8:47Speaker 3: I lost my job, my wife left me because she
- 8:50Speaker 3: couldn't handle it, my friends don't talk to me anymore.
- 8:55Speaker 1: Evan ruined my life.
- 8:58Speaker 3: So he's suing for five thousand dollars for the pain
- 8:59Speaker 3: and suffering and losing his job. And Judge Ross is,
- 9:04Speaker 3: does he have.
- 9:04Speaker 2: To sign anything when he goes to one of these events?
- 9:06Speaker 1: You don't sign.
- 9:07Speaker 3: But Evan does explain that when you walk in there
- 9:10Speaker 3: are signs saying that if you get called up, then
- 9:13Speaker 3: you are, you know, signing up. You get what you're
- 9:16Speaker 3: paying for there, and there's also disclaimers on screen.
- 9:19Speaker 2: There's disclaimers on screen. Yeah, he can't get any money
- 9:22Speaker 2: for this. Ross may be sympathetic because justice isn't a
- 9:25Speaker 2: foreign concept, but this is the wrong courtroom for this,
- 9:28Speaker 2: he could maybe go to personal injury court and have
- 9:31Speaker 2: a better plea of pain and suffering. But I just boy,
- 9:38Speaker 2: that's a tough spot to be in. There really got
- 9:43Speaker 2: its goat.
- 9:45Speaker 1: Yeah, so Ross is going to dismiss this case. Yeah,
- 9:49Speaker 1: he says, what's his name, Ross, Kevin Ross? No, what's
- 9:55Speaker 1: his name? You are he said?
- 10:00Speaker 2: Yeah.
- 10:00Speaker 3: He says, you're letting this story run your life. You
- 10:06Speaker 3: need to use this story to change lives. Go into colleges,
- 10:10Speaker 3: going to the fraternities, tell them this is what happened
- 10:13Speaker 3: to me.
- 10:14Speaker 1: This is what you should avoid.
- 10:16Speaker 3: Use this story as a platform mistake instead of instead
- 10:20Speaker 3: of letting the story ruin your life, use the story
- 10:23Speaker 3: to change lives.
- 10:24Speaker 1: Own the story.
- 10:25Speaker 2: Wow, it's a little inspiration from Ross.
- 10:27Speaker 3: And then he encouraged and then he encourages the wife
- 10:30Speaker 3: not to give up on him yet, Wow, to try
- 10:33Speaker 3: to work through this because they have a kid, and
- 10:36Speaker 3: you know, he's a big proponent of you know, to
- 10:39Speaker 3: toss to make this story.
- 10:42Speaker 1: So he dismisses it.
- 10:44Speaker 3: And in the postgame interview as we call it, Shuttlecock
- 10:49Speaker 3: is saying, Judge Ross said a lot of really good
- 10:51Speaker 3: things here that I needed to hear and he was thankful.
- 10:54Speaker 1: Wow.
- 10:54Speaker 2: So there you go, Ross, just bringing people together even
- 10:57Speaker 2: over a goat fraternity incident.
- 10:59Speaker 1: Man, what a case. I didn't see it coming beyond
- 11:02Speaker 1: I didn't either. It was a.
- 11:03Speaker 2: Doozy Catholic school. That was the last one.
- 11:05Speaker 1: That was the one both. Oh my gosh. So there
- 11:09Speaker 1: you go.
- 11:09Speaker 3: I let to know if anybody that's listening has been hypnotized.
- 11:15Speaker 1: Yeah.
- 11:15Speaker 2: Now I'm very interested in this whole thing.
- 11:17Speaker 1: Has anybody that, like, we know, bring one to bramble Fest?
- 11:23Speaker 2: Now we're talking, are you looking to that?
- 11:25Speaker 1: How much does that cost?
- 11:27Speaker 2: Yeah?
- 11:27Speaker 1: I don't know.
- 11:28Speaker 3: Uh Dan, what do we Because you said you got
- 11:30Speaker 3: a case and I said I got a case, and
- 11:31Speaker 3: you were like, there's no way.
- 11:32Speaker 1: It's better than that.
- 11:33Speaker 2: That case is pretty great. I mean, this guy did
- 11:36Speaker 2: lose his left nut, but that's a pretty good case.
- 11:38Speaker 1: All right, give it to you.
- 11:40Speaker 2: Patrick Donaldson, also a high school teacher, believe it or not,
- 11:44Speaker 2: is suing Peter Jones for thirty thousand dollars for past.
- 11:51Speaker 2: Uh oh, this personal Part Court judge Gino Legal sauce
- 11:56Speaker 2: thirty thousand dollars for past and he actually Patrick and
- 11:59Speaker 2: his wife can are both there and both suing, and
- 12:01Speaker 2: this is important.
- 12:02Speaker 1: And you can get up to like a million dollars.
- 12:04Speaker 2: Per thirty thousand dollars for past medical, one thirty for
- 12:08Speaker 2: future medical, six ninety for pain and suffering, and one
- 12:14Speaker 2: fifty for loss of consortium consortium consort, So a million
- 12:20Speaker 2: dollarion loss of consortium. You know what that is? That
- 12:23Speaker 2: is the inability to provide for your family in a
- 12:28Speaker 2: loving way, like you and your wife. Something happens, he's intimacy.
- 12:33Speaker 2: It could be laying.
- 12:34Speaker 1: It all out there, all right, Yes.
- 12:37Speaker 2: One million smackers.
- 12:39Speaker 3: Losing a nut doesn't stop you from having intercourse.
- 12:44Speaker 2: We'll get there, brand, don't worry. Sorry, goat stuff. Was
- 12:49Speaker 2: it thirteen? Yeah, at the very least, I got two boys,
- 12:56Speaker 2: not as not not like my boys, like like, he
- 13:03Speaker 2: has two sons eleven and six years old. And we
- 13:08Speaker 2: took our family to the batting cages. So yeah, so, uh,
- 13:14Speaker 2: we're at the batting cages and my eleven year old
- 13:17Speaker 2: man he can hit a fastball, like and we got
- 13:19Speaker 2: video of him in literal lygue hitting the fastball. Really
- 13:21Speaker 2: proud of him.
- 13:22Speaker 1: We've watched the video.
- 13:23Speaker 2: We've seen the video. He can hit a fastball. There's
- 13:25Speaker 2: no doubt about it, and he's gonna hit a fastball.
- 13:29Speaker 2: Uh oh no, Peter Jones is the owner of the
- 13:34Speaker 2: batting cage.
- 13:34Speaker 1: That's who he's suing.
- 13:35Speaker 2: Yes, and the owner of the batting cage used to
- 13:38Speaker 2: play ball when he was younger. He's on this establishment
- 13:40Speaker 2: for three and a half years, and he wants to
- 13:42Speaker 2: let you know he has an impeccable safety record. And
- 13:45Speaker 2: he says the word impeccable no less than a half
- 13:47Speaker 2: dozen times, maybe a dozen times in this case.
- 13:50Speaker 1: Now, this is your standard batting play.
- 13:52Speaker 2: You know.
- 13:52Speaker 1: It's got the machine with the nets, nets, the nets.
- 13:55Speaker 1: You can't go out of the nets, shoot it off.
- 13:57Speaker 2: The se nets, you understand. So as soon as he
- 14:00Speaker 2: says impeccable safety record for the first time, Candace Donalds
- 14:02Speaker 2: and Patrick's wife says, excuse me, and uh basically Judge
- 14:09Speaker 2: Gino has to calm her down, ordering the court. That's
- 14:11Speaker 2: not the first we'll get it that he so. Uh so,
- 14:14Speaker 2: Judge Gina's like, so why did you open the cages?
- 14:16Speaker 2: He's like, I play when I was younger, my memories
- 14:18Speaker 2: my father and my grandfather playing, and I wanted it
- 14:20Speaker 2: to be ultimate fun, safe, ultimate fun. Impeccable.
- 14:27Speaker 3: Uh.
- 14:28Speaker 2: The wife comes in again, Candace and Gina's like, listen,
- 14:31Speaker 2: we're gonna get to it. You just need to call.
- 14:33Speaker 1: I'm gonna make Canda sit down here.
- 14:35Speaker 2: He's like, yeah, So Patrick, take me to the day
- 14:36Speaker 2: this happened. Patrick says, okay, well, we had a great day.
- 14:39Speaker 2: We were going to the batting cages as a family.
- 14:42Speaker 2: My oldest son is hitting in the cages. I'm watching him.
- 14:45Speaker 2: I'm coaching him. I get a phone call. Uh, it's
- 14:49Speaker 2: a work call. I gotta take this call.
- 14:50Speaker 1: Now our phone's allowed. I go against the safety right phone.
- 14:54Speaker 2: Gino is like, you're giving him a hard time. You're
- 14:56Speaker 2: taking a call, you're with your family. He's like, I
- 14:57Speaker 2: got to take a call. There's nothing I can do
- 14:59Speaker 2: about him.
- 15:00Speaker 1: Ever taken a call.
- 15:00Speaker 2: Yeah, come on, he says. So this is where it
- 15:03Speaker 2: gets the legal sauce gets murky. He goes there's an
- 15:06Speaker 2: alleyway between two of the cages. There's an alleyway.
- 15:11Speaker 1: And do we get pictures of the setup?
- 15:14Speaker 2: We don't get pictures of the alley. We get a
- 15:16Speaker 2: map on the plaza, not pictures, and and Peter says, yeah,
- 15:22Speaker 2: a gated alleyway is it has a gate.
- 15:26Speaker 1: And Patrick so kind of like a dugout.
- 15:29Speaker 2: Almost. No, it's like a just to you know how
- 15:32Speaker 2: all these cages are nets and they stick together. There's
- 15:34Speaker 2: like a separation between all the nets and then one
- 15:37Speaker 2: net and there's an alleyway and that.
- 15:39Speaker 1: But that alleyway has a cage around it.
- 15:42Speaker 2: It has nets.
- 15:43Speaker 1: Okay, so not a kid not.
- 15:45Speaker 2: The batting cages are on either side, but they're only nets.
- 15:48Speaker 2: It's not hard cages. They're nets on either side. So
- 15:51Speaker 2: people are hitting baseballs on either side of This alley
- 15:54Speaker 2: does have a gate. Peter says, it's a gated alleyway.
- 15:57Speaker 2: Gino says, what's it for. He says it's for employees
- 15:59Speaker 2: only and for maintenance. We go back there to inspect
- 16:03Speaker 2: the pitching machines. The blah blah blah. Patrick says there's
- 16:06Speaker 2: no sign and there's no gate. Later he will amend
- 16:10Speaker 2: his statement to say that there was a gate but
- 16:12Speaker 2: it was open, but there is no sign saying employees only.
- 16:16Speaker 2: Peter does not refute this. Later we will hear that
- 16:19Speaker 2: there are signs up that say this is where you
- 16:21Speaker 2: should stand, but there is no sign on the gate
- 16:24Speaker 2: that says employees only. Okay, Peter doesn't disagree with that,
- 16:27Speaker 2: but there is a gate, it is open. It's employees
- 16:29Speaker 2: maintenance only, according to Peter. So Patrick says, I went
- 16:33Speaker 2: to the alleyway so I could still see my kid
- 16:35Speaker 2: hit while I'm on the phone. I don't know why
- 16:37Speaker 2: you couldn't stand behind I don't. He goes over there,
- 16:40Speaker 2: so he's at like a forty five degree angle. His
- 16:43Speaker 2: kid's a ridy, and he's on the phone and he's
- 16:47Speaker 2: watching his kid and a baseball gets hit directly at
- 16:51Speaker 2: him and it goes through the net, sure and hits him.
- 16:54Speaker 2: As he says, right in my family jewels. It's what
- 16:57Speaker 2: he says, Yeah great. At this point is left testicle ruptures.
- 17:08Speaker 1: I don't like that word rupture.
- 17:09Speaker 2: I don't either. I heard when he said it.
- 17:11Speaker 1: Like that gives me like it's just like exploding.
- 17:15Speaker 2: His left testical ruptures. And he says, still to this day,
- 17:18Speaker 2: I have constant pain from just below my belly button
- 17:21Speaker 2: all the way.
- 17:22Speaker 1: Down all the way down to his feet, or just
- 17:25Speaker 1: all the way to his boys. Not that far.
- 17:28Speaker 2: Okay, Well, I mean sure, go ahead, so Patrick for me, Yeah, good,
- 17:40Speaker 2: let's keep going.
- 17:41Speaker 1: It's good. That's good, is it?
- 17:45Speaker 3: Don't? So? Uh?
- 17:48Speaker 2: Basically? Uh. Gina's like, okay, Peter, did you see the incident?
- 17:54Speaker 2: Were you there? Did you see it? Peter's like, I
- 17:56Speaker 2: didn't see it. I was there, I was on site.
- 18:00Speaker 2: And here, honor, we have an impeccable safety record. We've
- 18:03Speaker 2: had zero incidents. Wow, in over three years of running
- 18:07Speaker 2: this business.
- 18:07Speaker 1: That's great.
- 18:09Speaker 2: And so this incident shocked me. And Genis said, well,
- 18:11Speaker 2: what did you do? And he said, well, you're ready
- 18:13Speaker 2: for this. The paramedic beat me to the incident. And
- 18:18Speaker 2: he said, what do you mean the paramedic And he says,
- 18:20Speaker 2: the paramedic we have on site. Geno says, you have
- 18:24Speaker 2: a paramedic on staff and he says, yes, sir, I do.
- 18:30Speaker 2: Geno says, looks over at Candace and Patrick. He goes, Folks,
- 18:34Speaker 2: to have a paramedic on staff at a batting cage
- 18:38Speaker 2: is a big deal. Wouldn't you agree that he's taken
- 18:41Speaker 2: precautions there? And Patrick and Candace say yes. And then
- 18:46Speaker 2: Candace says, if that means he's anticipating something bad is
- 18:51Speaker 2: going to happen, that's what he means. So Geno says,
- 18:54Speaker 2: so you think a paramedic is there because he knows
- 18:56Speaker 2: there's going to be an incident, and Candas says yes,
- 18:59Speaker 2: and Gino goes, but that's a good thing, right, and
- 19:02Speaker 2: Candas is sometimes being that cautious isn't a good thing.
- 19:06Speaker 2: It's suspect. And Gino says, I got to give you
- 19:09Speaker 2: a short legal lesson here. Having a paramedic that you
- 19:11Speaker 2: pay on staff, that shows that you care. It is
- 19:15Speaker 2: not that is not saying we're gonna have injuries. He should.
- 19:18Speaker 2: He's spending money in his own pocket to show you
- 19:21Speaker 2: that he cares about your well being. She stays quiet.
- 19:26Speaker 2: So Peter says, the paramedic sees the incident, he calls
- 19:29Speaker 2: nine one one. She calls nine one one immediately. I
- 19:32Speaker 2: was very concerned. And Candas is like, you were concerned
- 19:35Speaker 2: because your facility is faulty and it's just and Geno's
- 19:39Speaker 2: ordering the court hoole bit.
- 19:40Speaker 1: Let's take it down.
- 19:40Speaker 2: So then Gino makes Patrick go over to the plasma
- 19:45Speaker 2: and show this diagram. So Patrick limps on over, just
- 19:52Speaker 2: just hop alongs on over and there's a diagram where
- 19:55Speaker 2: there's the alleyway and it's pretty clear there's like three
- 19:58Speaker 2: caged nets there's one alley way, there's another one, and
- 20:01Speaker 2: there's a gate on the screen. It's open, right, so
- 20:04Speaker 2: he shows it. Peter's like, hey, only employees should go
- 20:08Speaker 2: back there. There are signs that shay where you should be.
- 20:10Speaker 2: There's a gate. Only employees should go back there. Patrick says,
- 20:14Speaker 2: there was a gate, it's wide open. I'm on the phone.
- 20:16Speaker 2: There's no sign I went back there. Peter says, your honor,
- 20:21Speaker 2: if he's paying attention at all and he's not in
- 20:24Speaker 2: an illegal area, that this doesn't happen. If you're just
- 20:28Speaker 2: paying attention a little bit, this doesn't happen. And Gina's like, well,
- 20:32Speaker 2: how did it happen? How the ball hit you? Aren't
- 20:35Speaker 2: the nets supposed to stop the ball. That's well, Patrick
- 20:39Speaker 2: has a service log of every single thing that happens.
- 20:42Speaker 2: His general manager is there. It's impeccable. He says it again.
- 20:46Speaker 2: The family Madenance log shows that there was a netting
- 20:49Speaker 2: issue in that batting cage net, and it shows that
- 20:52Speaker 2: it was fixed with the industry standard duct tape, which
- 20:56Speaker 2: is the duct tape they use to combine the nets
- 20:59Speaker 2: when they're fixed. His industry standard and it's there. Well,
- 21:03Speaker 2: Harvey Stewart. The GM comes in, he brings a net in.
- 21:05Speaker 2: He shows how he taped it up. It's boring, he said,
- 21:08Speaker 2: we never had an incident like this. Well, Patrick's like, look,
- 21:11Speaker 2: you may have taped the net, but the ball got
- 21:13Speaker 2: through the net. The ball is on the other side
- 21:16Speaker 2: of the net after it hits his ball like at
- 21:18Speaker 2: the baseball gets through the net. The net doesn't stop it, okay,
- 21:24Speaker 2: And Peter says, look, anytime we have these instances, we
- 21:28Speaker 2: fix them. We have a log that we continually fix them.
- 21:31Speaker 2: This may have gone.
- 21:33Speaker 1: By, I mean just going through the net.
- 21:36Speaker 2: The net being broken is what he's talking about. If
- 21:40Speaker 2: he wouldn't have been there, it never would have happened.
- 21:43Speaker 2: It's clearly marked. Now there's an argument over if it's
- 21:46Speaker 2: clearly marked, which I've already gone through with you. There's
- 21:49Speaker 2: yelling and screaming back and forth. Geno calls old. Peter says,
- 21:53Speaker 2: it's a gated area. I don't know how much clear
- 21:55Speaker 2: I can make it. Gina says, was the gate open?
- 21:57Speaker 2: The General manager says.
- 21:59Speaker 3: Yes, explain the gate to me. Because so if the
- 22:01Speaker 3: alleyways are just nets, like what.
- 22:03Speaker 2: Is on either side, I think the gate like the
- 22:05Speaker 2: way they had it. It looked like a gate to
- 22:07Speaker 2: a farm, like how it was like a triangle. But
- 22:10Speaker 2: I don't know, we don't get to see a picture
- 22:11Speaker 2: of I'm just having They agree that the net the
- 22:14Speaker 2: gate is open and should have been closed. They agree
- 22:17Speaker 2: on that, sure, right, So he then brings in a
- 22:20Speaker 2: urologist who puts a giant picture of a testicle on
- 22:24Speaker 2: the plasma screen. And the thing about plasma screens is
- 22:27Speaker 2: if you don't have any ambient light coming in, it
- 22:29Speaker 2: is crystal clear. Sure, I mean, it's like O lead
- 22:32Speaker 2: before oh lead. So we get a big nutshot here,
- 22:36Speaker 2: like a bit like a giant but it's like.
- 22:38Speaker 3: It's it's it's like you know metas diagree y, yes, ok, yeah,
- 22:42Speaker 3: yeah yeah.
- 22:43Speaker 2: And he basically talks about what happens with a rupture testicle.
- 22:47Speaker 2: There's a lot of different things and if you need
- 22:48Speaker 2: to remove a testcl blah blah blah. Yeah, it's not great.
- 22:51Speaker 2: But one thing he says is that a rupture testicle
- 22:54Speaker 2: would not one would not stop you from fathering any
- 22:57Speaker 2: kids in the future. You can continue on. And also
- 23:00Speaker 2: the pain shouldn't last fathering. Do you mean like no, no, no,
- 23:04Speaker 2: like biologically having a child, so you can still you
- 23:07Speaker 2: can still do that. Yes, and not only that, you
- 23:10Speaker 2: only need one that's right to go, that's right, one
- 23:13Speaker 2: not to go. But also his pain shouldn't last forever.
- 23:17Speaker 2: Two and three, that the only thing that would keep
- 23:20Speaker 2: him from fathering a kid or being intimate with his
- 23:22Speaker 2: wife after he completely healed is him being hesitant mental. Yeah,
- 23:27Speaker 2: it's psychological, right, And he says, I'm a eurologist. I
- 23:30Speaker 2: can't account for that.
- 23:32Speaker 1: So how long ago did this happen?
- 23:33Speaker 2: I don't remember, I don't I don't know, I don't know.
- 23:36Speaker 2: Oh no, she's gonna say it here in a second,
- 23:39Speaker 2: because uh, Gina wants to move to the inconsortium. Part
- 23:42Speaker 2: of it's the loss of consortium. And he goes to Candace,
- 23:44Speaker 2: and Candace conjures up some tears and she says, we've
- 23:48Speaker 2: always planned on having at least three kids. For the
- 23:50Speaker 2: last six months he's been healed, we've been trying. It's
- 23:54Speaker 2: not happening. He won't let me near him. Okay, she's like,
- 23:59Speaker 2: Patrick says, it's been difficult. At this point, Peter says
- 24:03Speaker 2: it could be her mouth. He says that in the
- 24:08Speaker 2: court room like that He says it could be her mouth, and.
- 24:12Speaker 1: By that he means she talks.
- 24:14Speaker 2: Gino loses it on this dude, like, how dare you
- 24:18Speaker 2: blah blah blah. Peter apologizes to the court, your honor, apologize,
- 24:23Speaker 2: apologize to the court. Patrick's like, I've seen counseling. I've
- 24:26Speaker 2: been depressed. I can't run, I can't move around, can't
- 24:29Speaker 2: sleep at night. I have to sleep in one position always,
- 24:31Speaker 2: can't do all the things I used to do with
- 24:33Speaker 2: my kids. I just it's been hard, real roy Hard.
- 24:37Speaker 2: Peter says, as a man, I certainly feel his pain,
- 24:39Speaker 2: and had he never wandered into this area, we would
- 24:43Speaker 2: have never met. Gino is ready to rule thirty k past, medical,
- 24:50Speaker 2: one thirty k future. I'm assuming that is counseling in nature,
- 24:56Speaker 2: one fifty K loss of consortium, six nine pain, and
- 25:01Speaker 2: suffering one million dollars.
- 25:04Speaker 3: So you know, I know how Gino operates here. He
- 25:08Speaker 3: gotta be over fifty one percent at fault to be
- 25:12Speaker 3: found guilty teaching this in this situation. And I do
- 25:17Speaker 3: think that the gate being open without a sign.
- 25:23Speaker 1: Does make him liable.
- 25:25Speaker 3: Now, I understand you have signs saying this is where
- 25:28Speaker 3: you stand. But if there's not a sign saying employees only,
- 25:35Speaker 3: that's opening you up for situations like this now, granted
- 25:39Speaker 3: has never happened before, hopefully never happens again. Impeccable, impeccable.
- 25:43Speaker 3: But I do find him at fault, at least fifty
- 25:47Speaker 3: one percent that fault.
- 25:50Speaker 1: Now, I don't know how.
- 25:51Speaker 3: I do think part of this is also on our
- 25:55Speaker 3: guy over here, right, Like you.
- 25:58Speaker 1: You're told to stand back there, you decide not too.
- 26:01Speaker 1: Granted there's a sign, but you know, not a sign.
- 26:04Speaker 1: I mean, so, I personally would never walk out in
- 26:08Speaker 1: front of where this is happening. There's a reason why
- 26:12Speaker 1: you stand behind.
- 26:13Speaker 2: Yeah.
- 26:14Speaker 3: Common sense says that if you go in front, you
- 26:17Speaker 3: are opening yourself up.
- 26:19Speaker 2: Common senses, if you stand somewhere in the purview of
- 26:22Speaker 2: the battery, your nut could get hitten.
- 26:23Speaker 3: Yes, yes, especially when it's just a net. That's right,
- 26:27Speaker 3: it's not a cage, a net.
- 26:29Speaker 1: Yes, So I'm just gonna say that it's just a
- 26:32Speaker 1: fifty one percent that fault.
- 26:33Speaker 3: So I think it's gonna get happy for that money.
- 26:36Speaker 3: I think that's what we're gonna do here.
- 26:37Speaker 2: You know what, brand That's what I'd have done. Okay,
- 26:40Speaker 2: that's not what Judge Gino did. Wow, Okay, Judge Gino says,
- 26:44Speaker 2: you have to prove that mister Jones Uh committed a
- 26:47Speaker 2: wrong that caused your injury. You've proven that wrong, and
- 26:51Speaker 2: the net didn't protect you as it should. There wasn't
- 26:54Speaker 2: a sign the gate was closed. The gate was open,
- 26:58Speaker 2: and I understand why you followed filed the lawsuit. Safety
- 27:00Speaker 2: nets are for safety and are not supposed to fail.
- 27:03Speaker 2: This one did. The gate was opened, there was no sign.
- 27:06Speaker 2: Here's thirty k for past, Here's one thirty k for future.
- 27:09Speaker 2: Here's one fifty k for loss of consortium. Here's six
- 27:13Speaker 2: ninety for pain in the here's a million dollars on
- 27:18Speaker 2: the million dollars for his left testicle.
- 27:22Speaker 1: Yeah, but he still made the choice.
- 27:24Speaker 2: A million brand.
- 27:26Speaker 1: I could not.
- 27:26Speaker 2: And you know what else, It is clear to me,
- 27:29Speaker 2: as someone who sympathized with this dude, when he said
- 27:31Speaker 2: ruptured his left testicle, I doubled over. But they are
- 27:36Speaker 2: playing like if you watch them, Candice and Patrick are
- 27:40Speaker 2: playing this up to become millionaires. In my head, I
- 27:44Speaker 2: was like, they are, they are trying to do this.
- 27:47Speaker 2: It was wild out there, just.
- 27:52Speaker 1: Batting cage place watches this and decides to invest in
- 27:57Speaker 1: actual like fences.
- 28:00Speaker 2: So it's like, yeah, yeah, the indoors is tough. Outdoors,
- 28:04Speaker 2: you can do it. Indoors is tough. It's tough indoors.
- 28:07Speaker 2: It's tough from a fire safety thing, sure, because you
- 28:09Speaker 2: get in there. It's a different animal. I think that's
- 28:11Speaker 2: what it is.
- 28:11Speaker 1: Anyway, I don't know, boy.
- 28:12Speaker 2: What a gavel brand.
- 28:14Speaker 3: You throw up some chain length fins from top to bottom,
- 28:18Speaker 3: top to bottom, stem to stern.
- 28:19Speaker 2: Stem to stern. You got to connect it because you
- 28:21Speaker 2: can't have the balls getting through.
- 28:23Speaker 1: I understand.
- 28:24Speaker 3: Yeah, what if you just go up to like eight
- 28:26Speaker 3: like we're on the height of a human and then.
- 28:29Speaker 2: You go nett Dude, you've done it right. Aluminum seven
- 28:35Speaker 2: eight feet aluminum netting above. That's a great idea.
- 28:39Speaker 3: Well, it's like it's like it's like hockey at that point.
- 28:42Speaker 3: Hockey has the thing and then it goes to net
- 28:45Speaker 3: up there.
- 28:46Speaker 2: Yeah, or like the mouse in the in the in
- 28:48Speaker 2: the baseball there's a wall wall and there's.
- 28:53Speaker 1: Out everybody. Wow, what a couple of cases today.
- 28:56Speaker 2: Man can't believe those were in the same That should
- 28:58Speaker 2: have been the bramble Fest. No, man, we really did it. Well,
- 29:02Speaker 2: what can you do? We'll see what we do next time.
