- 0:09Tort Talk is back with Joe Fantini, John and Mark.
- 0:12We're here this week not to talk about college football.
- 0:14We're here to talk about the latest developments in mass
- 0:17torts. Joe, thanks again for joining
- 0:19us. Thanks for having me guys,
- 0:20really excited to go over a full docket of developments in the
- 0:24latest and greatest in the world of mass torts.
- 0:26Absolutely. I love how you've coined this,
- 0:28the best 10 minutes in mass torts each week.
- 0:31We're going to start full steam ahead with the first Uber sex
- 0:34assault bellwether trial. We're in that first week and
- 0:38it's in California State court. What is the latest from that
- 0:42Bellwether trial? As you mentioned, this is the
- 0:45first case to make it to trial and the Uber sex abuse lawsuits.
- 0:49So we have parallel litigations going on in the MDL in
- 0:53California federal court and then in state court and that's
- 0:56where this initial trial is. So there's about 600 cases
- 0:59pending in state court. We have about 2000 cases pending
- 1:02in the MDL. So right now we're just really
- 1:05going over a little bit of the initial motion practice.
- 1:08The judge is making rulings on what type of evidence can come
- 1:11in or can't come in. A key ruling the judge just
- 1:14issued said that we can present evidence that an executive from
- 1:18Uber allegedly said that these rape victims were trash.
- 1:22So that's not going to be able to come in.
- 1:25It could inflamed the jury potentially, but this is going
- 1:28to be a hard fought trial. It's going to last a couple
- 1:31weeks here, a little bit different than the traditional
- 1:33mass tort cases we see, not focusing so much on the science
- 1:38and we'll see how this shakes out.
- 1:39But after this, the next trial is going to be in the MDL.
- 1:43That's scheduled to kick off before the end of the year.
- 1:45So in the next four to six months, we could have two
- 1:48verdicts. I don't see a global settlement
- 1:50anytime soon, but if we get some big verdicts here, that might
- 1:53change this litigation completely.
- 1:55When do we expect the update the end of this first trial?
- 1:58Yeah, the first trial I, I think it will last us around through
- 2:01the end of the month. So we we should have a verdict
- 2:04here before we kick off October. On to the next one, weight loss.
- 2:09We saw an interesting filing by Eli Lilly requesting
- 2:13consolidation of lawsuits alleging vision loss.
- 2:16What does this mean for the cases moving forward?
- 2:19Yeah. This is very rare.
- 2:20We don't typically see the defendant seek consolidation.
- 2:24And so as you guys know, we have this MDL currently pending here
- 2:28in federal court in Pennsylvania, over 2000 cases
- 2:31and they're alleging stomach issues.
- 2:34We talked last week about this huge ruling about the stomach
- 2:37emptying studies needed for the gastroparesis.
- 2:40While that was going on and the science was developing, we've
- 2:43seen more and more reports of vision loss and clients that
- 2:46took these weight loss medications.
- 2:48So the plaintiffs filed for a consolidation in New Jersey,
- 2:53about 30 different plaintiffs. They're seeking to have a
- 2:56litigation set up in New Jersey for vision loss injuries.
- 3:00While that petition was pending, Eli Lilly came over the top and
- 3:04they filed a motion to get a new MDL form.
- 3:07So it's separate MDL from these stomach issue cases that's been
- 3:10going on for a year. A new MDL for the vision loss.
- 3:14They're seeking to have it in front of the same judge in the
- 3:17same court. So that tells us that they
- 3:19really prefer to be in Pennsylvania federal court
- 3:22instead of New Jersey State court where the plaintiffs are
- 3:25trying. We'll hear this motion at the
- 3:27end of the month here in September.
- 3:29Expect an order in early October.
- 3:31Really interesting move but it shows me they're scared of these
- 3:35vision loss cases. Do you have any idea what
- 3:37percentage of the cases filed include vision loss?
- 3:39Or is it all the ones that aren't currently in the MDL that
- 3:42are going to be filed separately?
- 3:43Yeah. So there's under 100 total
- 3:45vision loss cases currently pending.
- 3:48Like I said, in New Jersey State court, we have about 30 of them,
- 3:51not many other cases. There's actually no cases
- 3:54currently in the MDL because those cases were required to be
- 3:59stomach issues. So they're just a smattering of
- 4:01filings and based upon representations and
- 4:04investigations that offended Dunn.
- 4:06So not based upon a huge number of filings, but based upon what
- 4:09they think and their belief that these cases could be better
- 4:13handled in an MDL in federal court, not in New Jersey in an
- 4:17MCL. Little bit of news this week
- 4:20that hit the mainstream news cycle with RFK releasing the
- 4:23Make America Healthy Again strategy aimed at keeping
- 4:28children healthy. We're going to stay out of the
- 4:29policy politics of this, but there is a significant portion
- 4:32of this that discusses the link between Tylenol and autism when
- 4:35we all know about what happened about a year ago with that MDL.
- 4:39How do you think the release of this report will impact these
- 4:42cases? I think it's going to help these
- 4:44cases. So like you mentioned, we had an
- 4:46MDL. It was a big talk, a mass tort
- 4:48made perfect. Everybody was really excited
- 4:51about it. We started the litigation.
- 4:54The judge decided to rule upon expert Dauber motions early on,
- 5:00comic tactic. Usually the cases are fully
- 5:02worked up years later. We got to Daubert, this MDL
- 5:05judge ruled on it initially and excluded all of our experts and
- 5:10basically ended the litigation right there.
- 5:12We appealed that decision obviously.
- 5:14And the good news is the oral argument set to be heard next
- 5:17month. So typically, I don't expect a
- 5:20ruling before the end of the year, but early first quarter
- 5:232026, we'll have a ruling on average, maybe only 8 to 10% of
- 5:28appeals are granted. So, so it's an uphill battle.
- 5:31But with this new development coming out, I think it
- 5:33strengthens our case. And I believe as time goes on
- 5:36and more studies are conducted, it's going to strengthen the
- 5:39cause and the connection between Tylenol and autism.
- 5:43Interesting. As soon as that report came out,
- 5:45the manufacturer's stock tanked by more than 10%.
- 5:48So they're obviously concerned about this.
- 5:50So people who who have a large amount of cases signed
- 5:54originally as part of the MDALE, what is your advice to them
- 5:56right now? You know, they're sitting on a
- 5:57ton of cases. They've delivered mostly bad
- 6:00news to their clients they've signed up for so far.
- 6:02What advice do you have for those people listening?
- 6:04Yeah, I don't represent any of them, so I can't give them legal
- 6:06advice. But what I would tell them is
- 6:09the majority of those cases may not have been filed in the MDL
- 6:13court. So there were only maybe 50 or
- 6:16so cases actually filed that the ruling applied to.
- 6:19So in those cases where a lot of them are minors, there's
- 6:23something called a minor tolling statute.
- 6:26So most states have this provision where if somebody
- 6:28under the age of 18 is injured, the statute of limitations on
- 6:32their case doesn't begin to run until they were 18 years old.
- 6:35So a lot of those cases, the statutes are still viable.
- 6:38Again, I don't represent them, so I can't give them any legal
- 6:41advice, but you can wait and see what ends up happening at this
- 6:45appeal argument. And then even if we're
- 6:47unsuccessful, I think we're going to pivot and you'll see a
- 6:50lot of state court action popping up for Tylenol.
- 6:53Definitely going to be a hard case, but just like we lost
- 6:56initially in the MDL, we were able to move on to state court
- 7:01for Zantac litigations and have some success there.
- 7:03So I think, I think we'll be hearing more about Tylenol and
- 7:06this litigation is not going anywhere.
- 7:08On to Roundup, Bayer announced that is seeking approval of a
- 7:11new herbicide called Crop Key. What are your thoughts on this
- 7:15development? Yeah, this is a move that we
- 7:18often see in litigations. A manufacturer could do with
- 7:22silent withdrawal or suddenly develop a a new product that's
- 7:26going to replace the product that's in existent that we're
- 7:29litigating about. So I've been involved in
- 7:31previous cases where say a mesh manufacturing had a certain
- 7:35product, we sue, identify the flaws and the problem with that.
- 7:39They develop this new product and bring it to the market.
- 7:42That's what it seems like Bear potentially could be doing here.
- 7:45This is going to be a way for them to end this litigation once
- 7:48and for all. So it sounds like they're going
- 7:50to try beginning in 2028 have this product on the market
- 7:54worldwide. It seems like they may no longer
- 7:56be selling Roundup and said that's going to help limit the
- 7:59tail on the potential litigation.
- 8:02So we won't have people using Roundup in 20302035 developing
- 8:07NHL still. There's going to be that latency
- 8:09period. But I think this is an example
- 8:12where they learn from their mistakes previously where they
- 8:14did the prior settlement and kept the product on the market.
- 8:17The cases kept coming. So it seems to me that they
- 8:20realize that they have to do something different, which is
- 8:23what we wanted as plaintiffs attorneys getting this
- 8:26defective, harmful product off the shelves.
- 8:28So it seems like that mission may be accomplished.
- 8:31Still a bit of a ways away, but hopefully making these
- 8:35herbicides a little bit safer for the general populace who
- 8:38uses them, which at the end of the day, is kind of our end
- 8:40goal, right? Keeping people safe from these
- 8:42corporations that may not have their best interests in mind.
- 8:45Joe, another great week. I think by next week, we should
- 8:48have some updates in this Uber trial that's going on.
- 8:50Maybe some more updates as we head into mass torts on some
- 8:53other litigations that we haven't touched on.
- 8:55But once again, thanks for joining us on the best 10
- 8:58minutes in Mass Torts each week. Thanks, Joe.
- 9:01Thanks for having me.
