- 0:12And here we go into our number two of the Morning Show with Preston Scott.
- 0:16I'm Preston. That's Grant Allen and it's a delight to be with you
- 0:20wherever however you find us and are listening to the program. Don't think for
- 0:26one second we don't appreciate you and your time so very very much. Thank
- 0:31you for honoring us with it. Please to be into the new year,
- 0:36because we are back with our monthly visits with Lee Williams. He is known
- 0:42as the gun Writer and the place to go to learn about things, and
- 0:46we're about to talk about a very important one that you're not likely to hear
- 0:50about any other place is his blog. It's the gun Writer dot substack dot
- 0:57com, The gun Writer dot substack dot com, and Lee Williams is with
- 1:03us. Good morning, sir, Happy New Year, Happy nearer to you.
- 1:06Thanks for the invite, good to be back. Absolutely sadly as I
- 1:11read as I read your latest piece yesterday, I squirmed a bit in my
- 1:15chair. Preventing Private Paramilitary Activity Act of twenty twenty four. What in the
- 1:22world. Yeah, when you read the title, you know, what does
- 1:26that mean? Private paramilitary activity? But my god, man, when we
- 1:32read it. When we read the bill and what it actually does, it
- 1:34is insane. It basically is a way to paint the target on the back
- 1:38of every law abiding gun owner in the country, and it's a way to
- 1:42stamp out firearm training. It's crazy. It criminalizes publicly patrolling, drilling,
- 1:49or engaging in these are the words. You got to pay attention to harmful
- 1:53or deadly paramilitary techniques or training to engage in such behavior. So we post
- 2:00a question, what are harmful or deadly paramilitary techniques? You know? Is
- 2:04this CQB, is this movement on the range transitioning from my carving to my
- 2:07pistol malfunction, drills, offense shooting, or just punching holes in paper.
- 2:14The authors of this bill, Jamie Raskin from of course Maryland, he's leaving
- 2:19that up to the federals and the prosecutors to determine what that is. So
- 2:23basically it's whatever they want. And if you violate this bill first time,
- 2:30you're looking at a year in jail. Repeat violators two years. If there's
- 2:35anybody hurt, five years. If the death occurs, it's a life sentence.
- 2:38They also, of course added a porfeiture clause, so they violate this
- 2:42bill that can take all your guns in year. It's clear they're going after
- 2:46training and they're trying they're trying to correlate, you know, the January sixth,
- 2:53they use that to try and sell their bill, and they mentioned the
- 2:57Oath Keepers and the Proud Voice. You know, first of all, militia
- 3:02used to be a holy thing. Everybody when the Founders were there, every
- 3:06able body man had to be a part of the militia. And now they've
- 3:09read they're redefining that to make it something nefarious to go after training. And
- 3:15it sucks because this could actually get through if they sell it correctly. Lee
- 3:20Williams Withers Lee, this this smacks of assault weapon, the ambiguous term that
- 3:28means anything or everything that they want it to mean. Yep, one hundred
- 3:32percent. I mean and I trained regularly, and I'm fortunate to live in
- 3:37the Free State of Florida where I can go to a range that treats me
- 3:40like an adult, where I can drop them a holster, I can shoot
- 3:43while moving. I can He's actually set up, of course as a player
- 3:46there where you're shooting for moving vehicles, which is a great time. You
- 3:51can shoot at night wearing nods, So basically I can train at my level.
- 3:55I don't have to stand there and just punch holes and pay at a
- 4:00flat range. All of this is going to be at risk if this goes
- 4:03through, and you know Biden wants it, and you know Raskin is no
- 4:09fool. I don't agree with his politics. He is a very smart character.
- 4:13So I hope this this could easily clear the Senate. I hope it
- 4:15doesn't clear the House. Well. I was just going to say, you
- 4:18know, even in in in Florida, stupid bills are introduced. In HR
- 4:23sixty nine eighty one is the bill we're talking about. It's a stupid bill.
- 4:28It's a dangerous bill. Where what's the status? Is it even getting
- 4:31a committee hearing? Not yet, but anything possible. What we wanted to
- 4:39do is, you know, knowledge is power. We wanted to make sure
- 4:42everybody knows that this is this is a huge blow to trainers and training and
- 4:48what good are firearms if you're not training with them constantly? I mean,
- 4:53the true intent is to is to stop training, especially tactical training. I
- 4:57was on the radio yesterday with a good friend. He's delta veteran, I
- 5:00said, Bob, they want to put you out of business, which is
- 5:02what they want to do, so it scares them. Were the instructors in
- 5:10this company. If this goes through, would be one over zealous prosecutor away
- 5:14from being charged, as would anybody that would go to take one of their
- 5:17courses. So we wanted everybody to know about this abomination. Twelve minutes past
- 5:26the hour the gun writer dot substack dot com. You'll get this stuff to
- 5:33your email box when you sign up. I don't miss an article. Lee
- 5:39Williams our guest this morning. Lee, I asked you in an email,
- 5:44if we go back to the year twenty twenty three, the year that just
- 5:46was in all the things that you've had your eye on, and you've written
- 5:51about what was most impactful, good or bad on the Second Amendment front,
- 5:58I feel like I know where we might go, but I don't know.
- 6:00So you tell me the most important story from last year is something I never
- 6:08wrote humulively. Yeah, we wrote about them, but I never actually put
- 6:13it all together, and obviously that's my fault. We experienced what I like
- 6:19to call post bruin tantrum laws at a scale no one could imagine. We
- 6:26had the beautiful Bruin decision in twenty twenty two from the Supreme Court said you
- 6:30have a right to carrier to firearm outside of your home or self defense,
- 6:32said if you want to litigate a second member of related law, you have
- 6:38to find a corresponding law. From the hero of the Founder's great decision,
- 6:42we had no idea how intense the backlash would be. We had lawmakers in
- 6:47blue states and nationally sponsoring and introducing and getting signed into law laws that they
- 6:55know don't pass the Bruin test that they know are unconstitutional. And the creativity.
- 7:01No one had any idea. I mean, my god. In California
- 7:05they tried to They put a separate bill into further criminalize thirty round and standard
- 7:12capacity magazines by saying, if you have thirty rounds in an ar and akag
- 7:16that violates their local laws on gunpower storage. I mean, that's pretty creative.
- 7:24So we saw the absolute craziest crap from across the country. We had
- 7:30no idea we would see it. We look forward after Bruinton doings, finally
- 7:32doing some open field running being the Second Amendment Foundation that I worked for,
- 7:39and you know, we're spending a lot of time on these unconstitutional bills.
- 7:43I think at some point the judiciary at the federal level is going to be
- 7:47a little angry and start slapping some of these down. These are frivolous lawsuits,
- 7:51their frivolous laws that they're passing that they know damn well are unconstitutional.
- 7:58Where does the attack on the f You've highlighted some stories in particular over others
- 8:03because of just the egregious nature of what the federal government's doing to FFL hold
- 8:11holders. It's ramping up. We thought that by bringing sunshine to the fact
- 8:18that they're going after our gun dealers, our federal fire arm relcensese FFLs were
- 8:22the most trivial clerical mistakes, that they would back off. They haven't.
- 8:26They haven't. They're still going after them. We will see nearly a thousand
- 8:31FFL reputations or forced surrenders last year when everything's added up. I will say
- 8:39this, and that's coming straight from Biden and straight from Steve Dettelbock, the
- 8:43ATFAD, I will say this, and I'm kind of proud about it.
- 8:46Preston, my employer's second member foundation just sued Attorney General Garland and ATF director
- 8:52Dettal Bock and FBI Director Ray trying to restore the civil rights of folks,
- 9:00the Second Amendment rights a folk to use medicinal marijuana. All right, I'm
- 9:05pretty proud of that. Fla on your phone with the iHeart Radio app and
- 9:09on hundreds of devices like Alexa, Google Home, Xbox and Sonos, Yes,
- 9:13and iHeart Radio station. Man gosh, I just found out in the
- 9:20commercial break there that Lee Williams is a fellow Minnesoultan. I can break that
- 9:28accent out in a in a heartbeat. That's so funny. Are we both
- 9:35have spent a lot of years in the in the Land of ten Thousand Lakes?
- 9:39All right? Lee, what are your thoughts on the on the importance
- 9:43of the twenty twenty four race as it relates strictly to the Second Amendment.
- 9:46It seems pretty vital to me. Yeah. I mean, if if Joe
- 9:52gets back in, I should say, if Kamela gets back in because of
- 9:56a vote for Joe's going to be a book for her. He's not going
- 9:58to make it another four years. We are doomed in terms of our country,
- 10:03and we are doomed in terms of our Second Amendment rights. I mean,
- 10:05you have to realize we have never had a president administration as an anti
- 10:11this one. I mean, they created an anti gun office in the White
- 10:16House. In the White House and everything that we've talked about over the last
- 10:22couple of years has been caused by the White House in terms of your Second
- 10:28Amendment rights. This election is I hate to say it because it's so cliche,
- 10:31it's the most important election in our lives because they will continue to infringe,
- 10:37and you know they will. What do you expect this upcoming year?
- 10:39Backing away from the presidential race, and we I think we all agree on
- 10:43the importance of it from that perspective. You know, I looked at twenty
- 10:46sixteen as it was vital from a Supreme Court perspective. Turns out that not
- 10:52all those appointments have panned out for us. But let's talk about cases like
- 10:56you've covered in the last year. What do you see coming this year?
- 11:00We are going to finally get some definition on these so called assault weapon bands.
- 11:07I think they're going to be the first to go, and that'll be
- 11:09followed by standard capacity magazine bands. I think the Supreme Court is going to
- 11:13rule that both of those are unconstitutional. That ar is the most popular rifle
- 11:18in the country, and it comes with a thirty round standard capacity magazine.
- 11:24Now I'm so sick of I hear from all these people in these Blue states
- 11:28and the way they're treated just makes you crazy. You look at California and
- 11:33look at what's California complying out there. You can't even recognize it as a
- 11:35rifle. California maintains a list of pistols that they will allow you to purchase.
- 11:41Okay, your Second Amendment rights should not depend on your zip code,
- 11:46but that's the way it is right now. We not tolerate this with the
- 11:48First Amendment or the Fourth Amendment or the Fifth Amendment. Everyone should have the
- 11:54same rights, regardless of where they live. I think the Supreme Courts tried
- 11:58to make that happened with the Brewin decision, but I think they're going to
- 12:01have to define it even further this year. I'm curious, and I know
- 12:07that legal scholars, we have them on the show lead. They have an
- 12:11explanation, not an excuse, for why the Supreme Court doesn't just settle certain
- 12:16issues more broadly. You know you just mentioned one. Why not just force
- 12:22people to define what an assault weapon is? Because I'm convinced that if they
- 12:28do that, they'll have to define a Ford f one fifty a panel Van
- 12:31hond You know, you know what I'm saying. I mean, it's why
- 12:35are we still fighting this fight over terminology? Well, I know the Supreme
- 12:41Court, especially Thomas, wants to do the right thing. Yep. And
- 12:45trust me, I was in the same boat as you and probably started working
- 12:48for the Second Amendment Foundation, and I got a little better understanding from our
- 12:52founder Alan Gottlieb. We've been around for fifty years right now. By the
- 12:56way, they need a right case and they will reject cases if they're not
- 13:01one hundred percent what Thomas wants to do the right thing. And when it
- 13:07comes to judging what those guys and gals and the black robes we're going to
- 13:11do, I'm a total amateur. But they can only they can only act
- 13:15on the cases that are brought to them, and they're not going to risk
- 13:18any kind of bad case law. As you said, we do have a
- 13:22couple justices who would are willing to hop the fence if they so side.
- 13:26So they need to exact right case. But I think we're going to see
- 13:30it. There's a couple that are coming down the pike, we could have
- 13:33a ruling and finally get rid of all this assault weapon crap. Where are
- 13:39we on bump stocks? Where are we on on pistol braces? Pistol braces
- 13:43A bump stocks will be legal. They're just making their way through various courts.
- 13:48If you're a member of one of our pro gun organizations, the courts
- 13:52have already enjoyed enforcement against you for bumps and braces. ATF is striking out
- 13:58constantly in federal court regarding braces, regarding triggers, regarding you name it.
- 14:03I think we're going to also see some definition, especially with the Chevron decision
- 14:07coming down. That's not a gun decision, that has to do with fishing
- 14:11and the rights of these regulatory agencies. I think Chevron will end up spanking
- 14:18the heck out of ATF for all their overreach. You know, they want
- 14:22to be judged jury and execution says, they want to write the laws,
- 14:24they want to enforce the laws. Chevron will bring that to an end.
- 14:30Lee, As always, I appreciate the time with you and keep doing what
- 14:33you're doing, and we appreciate the work you're doing with the Second Amendment Foundation.
