- 0:14Speaker 1: Jane Doe number two, Jane Doe number three, Jane Doe four,
- 0:17Speaker 1: Jane Doe five, and Kirstie Ferguson and Audra Christensen and
- 0:22Speaker 1: their lawsuit against Frederick Fakai. Complaint and jury trial demanded.
- 0:27Speaker 1: Plaintiffs Jane Doe one, Jane Doe two, Jane Doe three,
- 0:31Speaker 1: Jane Doe four, Jane Doe five, Kersky Ferguson, and Audra Christensen,
- 0:35Speaker 1: collectively plaintiffs, by and through their attorney at Merson Law, PLLC,
- 0:41Speaker 1: and as for their verified complaint in this action against defendants,
- 0:45Speaker 1: collectively defendants, Frederick Fakai, Frederick Fakai and Company, and Patrick Coombs,
- 0:51Speaker 1: hereby allege the following, and upon information and belief, and
- 0:54Speaker 1: to all other matters as follows. 1. Nature of Claims
- 1:00Speaker 1: On August 31st, In 2026, Representative Thomas Massey named Frederick
- 1:05Speaker 1: Fekai as one of 14 Jeffrey Epstein co-conspirators who should
- 1:08Speaker 1: be investigated and prosecuted. Frederick Fekai was an enabler of
- 1:13Speaker 1: Jeffrey Epstein's abuse and victims and plaintiff Frederick Fekai and
- 1:17Speaker 1: his salons and entities acted as perk machines for Epstein
- 1:21Speaker 1: for over 15 years, enabling Epstein to control and abuse
- 1:25Speaker 1: young women while Frederick Fekai gained a financial windfall. Without Epstein,
- 1:30Speaker 1: Fakai Brands would not have grown into the billion-dollar beauty
- 1:33Speaker 1: product mainstay. Without Epstein, Fakai Product would not have landed
- 1:37Speaker 1: in stores like Victoria's Secret, a company owned by Les Wexner.
- 1:42Speaker 1: Bloomberg News reported that Epstein connected Fakai to global businessmen
- 1:46Speaker 1: in Hong Kong and Epstein helped form his hair care
- 1:49Speaker 1: products company. Epstein used Fakai and his entities to control
- 1:53Speaker 1: and further abuse the victims and in turn, Fakai made millions.
- 1:57Speaker 1: Jane Doe's 1-5, Kirstie Ferguson, and Audra Christensen were sent
- 2:02Speaker 1: to Fakai by Epstein during which services were always provided
- 2:05Speaker 1: under Epstein's direction and control. Fakai groomed the victims to
- 2:09Speaker 1: look as young as possible under Epstein's direction. Epstein would
- 2:13Speaker 1: direct Fakai to bleach victims' blonde and groom them, like dolls,
- 2:17Speaker 1: into Epstein and others' liking. Further, upon information and belief,
- 2:21Speaker 1: defendant Patrick Coombs, one of Fakai's employees and facilitated, enabled,
- 2:26Speaker 1: and groomed the victims to Epstein's liking and at his request.
- 2:30Speaker 1: Fakai and Coombs collaborated with Epstein so that plaintiffs looked
- 2:34Speaker 1: young and how he wanted them so that he could
- 2:36Speaker 1: sexually abuse them and have gender-motivated violence committed against them.
- 2:41Speaker 1: The Department of Justice released 3,118 documents and emails related
- 2:46Speaker 1: to Fakai's salon, which was the epicenter for victim grooming.
- 2:50Speaker 1: Frederick Fakai's flagship salon was located at 712 Fifth Avenue,
- 2:55Speaker 1: within the Henry Bendel Department Store, which was owned by
- 2:58Speaker 1: Epstein's affiliate, Leslie Wexner, until 2019. Fakai hair products were
- 3:03Speaker 1: carried at Victoria's Secret stores. Epstein could not commit gender-motivated
- 3:07Speaker 1: violence and sex trafficking of hundreds of children and very
- 3:11Speaker 1: young women without the ring of enablers who became richer
- 3:14Speaker 1: with every year of abuse. Epstein used Fakai as employees
- 3:18Speaker 1: and as entities to intimidate and control over his victims.
- 3:22Speaker 1: Epstein frequently brought in groups of young women and would
- 3:25Speaker 1: have them sit on his lap and stroke his hair.
- 3:28Speaker 1: Fakai played a pivotal role in Epstein's grooming scheme by
- 3:31Speaker 1: routinely providing salon services to women at Epstein's instruction. Sarah
- 3:36Speaker 1: Kellen also provided testimony and named Fakai as an enabler
- 3:40Speaker 1: and an abuser. Ms. Kellen testified that she was sexually
- 3:43Speaker 1: assaulted by Fakai in the early 2000s. On June 4th, 2026,
- 3:49Speaker 1: House Republicans asked the Justice Department to investigate Fakai naming
- 3:53Speaker 1: him as Epstein's longtime assistant as being complicit in the abuse.
- 3:58Speaker 1: In a letter to the Department of Justice from the
- 4:00Speaker 1: Committee on Oversight and Government Reform, it was stated that Mr.
- 4:03Speaker 1: Fakai was a close friend of Epstein, who played a
- 4:06Speaker 1: role in his grooming schemes by routinely providing salon services
- 4:10Speaker 1: to women at Mr. Epstein's instruction. Fakai enabled Epstein to
- 4:15Speaker 1: commit acts of gender-motivated violence against plaintiffs and other women,
- 4:19Speaker 1: Epstein utilized Fakai's salons as a network to manipulate, coerce,
- 4:23Speaker 1: and commit acts of gender-motivated violence against victims and the plaintiff.
- 4:29Speaker 1: Without Fakai, Epstein would not have been able to control
- 4:32Speaker 1: and commit gender-motivated violence against the victims. Fakai, his employees,
- 4:37Speaker 1: and his entities enabled Epstein to build a vast and
- 4:40Speaker 1: sophisticated sex trafficking operation, which he used ruthlessly to commit
- 4:44Speaker 1: acts of gender-motivated violence upon plaintiff, causing them significant and
- 4:49Speaker 1: lifelong injuries. Background. Jeffrey Edward Epstein was a notorious sexual
- 4:54Speaker 1: predator responsible for committing gender-motivated violence against hundreds of women
- 4:59Speaker 1: and minor girls, including the plaintiffs herein. Every one of
- 5:03Speaker 1: Epstein's victims was female, conclusively demonstrating that his acts of
- 5:07Speaker 1: sexual violence were motivated by gender. As is clear, Epstein's
- 5:11Speaker 1: conduct against plaintiff constituted gender-motivated violence which resulted in severe
- 5:17Speaker 1: and protracted pain and suffering for plaintiffs. Defendant Frederick Fakai
- 5:23Speaker 1: and his entity Frederick Fakai & Company, LLC, and his
- 5:25Speaker 1: employee Patrick Coombs played critical roles in enabling and conspiring
- 5:30Speaker 1: with Epstein to commit acts of gender-motivated violence against plaintiffs
- 5:34Speaker 1: and grooming and controlling plaintiffs by following Epstein's direction and
- 5:39Speaker 1: instruction so that plaintiffs look younger and like he wanted
- 5:42Speaker 1: them to. If not for defendants acting as a cog
- 5:45Speaker 1: in the perks machine, Epstein would not have been able
- 5:48Speaker 1: to run a sex trafficking operation and commit gender-motivated violence
- 5:52Speaker 1: against hundreds of women and minor girls, including plaintiffs. Venue
- 5:56Speaker 1: jurisdiction and timeliness. This action is brought under the Gender-Motivated
- 6:01Speaker 1: Violence Protection Act, hereafter GMVA, New York Administrative Code Section 10-1101.
- 6:07Speaker 1: On January 29, 2026, an amendment to the GMVA Introduction 1297-A,
- 6:15Speaker 1: hereinafter Intro 1297, was enacted by the New York City Council.
- 6:20Speaker 1: The amendment, D-2, allows survivors of gender-motivated violence who were
- 6:25Speaker 1: harmed prior to January 9, 2022 to file suit against
- 6:29Speaker 1: their abuser and or any other individual or entity who
- 6:32Speaker 1: enabled the conduct of said abuser within 18 months of
- 6:35Speaker 1: Intro 1297's enactment on January 29, 2026. As such, this
- 6:37Speaker 1: action is timely and under Intro 1297. Further, the GMVA
- 6:46Speaker 1: is not preempted by any other law because it addresses
- 6:49Speaker 1: all acts of gender-motivated violence, not merely conduct that constitutes
- 6:53Speaker 1: a violation of the penal law. The Child Victims Act,
- 6:56Speaker 1: hereinafter CVA, pursuant to New York Civil Practice Law, and
- 7:01Speaker 1: Rules Section 214G, hereinafter CPLR, and Adult Survivors Act, New
- 7:06Speaker 1: York CPLR, Section 214J, hereinafter ASA, revive common law assault, battery, negligence,
- 7:14Speaker 1: and negligent hiring, retention, and supervision causes of action, while
- 7:18Speaker 1: the GMVA's Intro 1297 provides a cause of action pursuant
- 7:22Speaker 1: to the GMVA for gender-motivated violence and includes explicit provisions
- 7:27Speaker 1: for punitive damages, attorney fees, and junk of relief that
- 7:31Speaker 1: the CVA and ASA do not. See DeDeuce v. State
- 7:36Speaker 1: of Jeffrey Epstein, New York Index No. 151301, 2026. Justice
- 7:43Speaker 1: Adam Silvera recently held that it's evident upon both a
- 7:46Speaker 1: plain reading and examination of purpose of the subject's statutes
- 7:50Speaker 1: and local law that the GMVPA which created a new
- 7:54Speaker 1: civil rights cause of action where none existed at the
- 7:57Speaker 1: time is not and was not intended to be preempted
- 8:00Speaker 1: by two revival statutes that were directed towards sexual assault
- 8:04Speaker 1: cases and causes of action. This court has personal jurisdiction
- 8:09Speaker 1: over the defendant's pursuant to New York CPLR Section 301
- 8:13Speaker 1: and 302. Further, jurisdiction is proper in the court pursuant
- 8:17Speaker 1: to CPLR Section 301, 302, as defendant Frederick Fekai and
- 8:22Speaker 1: plaintiff Christy Ferguson are domiciled in the state of Connecticut,
- 8:25Speaker 1: and Patrick Combs is domiciled in New York City, so
- 8:28Speaker 1: there is not complete diversity of parties. Venue is proper
- 8:32Speaker 1: in this court pursuant to CPLR Section 503, because at
- 8:36Speaker 1: all times herein mentioned, a substantial part of the acts
- 8:39Speaker 1: and omissions alleged herein occurred in New York County, in
- 8:43Speaker 1: the city of New York, and defendant Patrick Combs is
- 8:46Speaker 1: domiciled in New York County, in the city of New York.
- 8:49Speaker 1: Defendant's conduct violated New York's GMVA that exists to protect
- 8:54Speaker 1: and provide legal recourse to persons, including the plaintiffs herein,
- 8:58Speaker 1: from acts of gender-motivated violence as perpetrated by Epstein and
- 9:03Speaker 1: his associates. Furthermore, any statute of limitation that would otherwise
- 9:08Speaker 1: apply to plaintiffs' claims herein is told in accord with
- 9:11Speaker 1: the doctrine of equitable estoppel, as based on the deception, duress, fraud,
- 9:17Speaker 1: and or threats of retaliation and misconduct that Epstein and
- 9:21Speaker 1: his co-conspirators used to silence his victims, including plaintiffs. At
- 9:25Speaker 1: a minimum, the same conduct by Epstein and his associates
- 9:29Speaker 1: deprived plaintiffs of their legal rights and an opportunity to
- 9:32Speaker 1: commence this lawsuit prior to Epstein's death in August of 2019. Accordingly,
- 9:38Speaker 1: Defendants are equitably e-stopped from asserting a statute of limitations defense. Parties.

- 10:40Speaker 1: abuse and grooming of plaintiffs as described below. At all
