If Leon Black Can Drag Congress Into Court, Imagine What Epstein Survivors Were Up Against? (Part 1) (9/4/26) · The Epstein Chronicles

• 0:00
Speaker 1: What's up everyone and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to continue talking about Leon Black
• 0:07
Speaker 1: and his decision to sue Congress. Because Leon Black has
• 0:12
Speaker 1: now provided us with one of the clearest demonstrations imaginable
• 0:16
Speaker 1: of how power actually functions in the Jeffrey Epstein story.
• 0:20
Speaker 1: Congress issued subpoenas, scheduled a sworn deposition, and expected Black
• 0:25
Speaker 1: to appear and answer questions about matters lawmakers believe are
• 0:29
Speaker 1: irrelevant to their Epstein investigation. Black's response was not simply
• 0:34
Speaker 1: to object, negotiate, or complain about the scope of the questioning.
• 0:39
Speaker 1: He refused to appear and marched into federal court to
• 0:41
Speaker 1: sue the committee and its chairman. Think about the sheer
• 0:44
Speaker 1: audacity of that sequence for a moment. The institution supposedly
• 0:49
Speaker 1: doing the investigating suddenly finds itself defending its own authority
• 0:53
Speaker 1: against the billionaire it's attempting to investigate? The witness becomes
• 0:57
Speaker 1: the aggressor. Congress becomes the defendant. and the investigation starts
• 1:01
Speaker 1: revolving around what Leon Black will permit Congress to examine. Yo,
• 1:06
Speaker 1: that is completely fucking backwards. It's also an almost perfect
• 1:10
Speaker 1: miniature of the Epstein scandal itself, where ordinary expectations of
• 1:14
Speaker 1: accountability repeatedly seem to become strangely negotiable whenever enough money, lawyers, influence,
• 1:22
Speaker 1: and institutional prestige enter the room. And if Congress cannot
• 1:26
Speaker 1: recognize the humiliation inherent in that spectacle, perhaps somebody should
• 1:31
Speaker 1: explain to its members that the man under subpoena is
• 1:34
Speaker 1: not supposed to be running the investigation. Now, ask yourself
• 1:38
Speaker 1: the question that exposes the obscenity of this better than
• 1:42
Speaker 1: any congressional press release ever could. Would you be afforded
• 1:45
Speaker 1: the same latitude? If Congress subpoenaed you, would you stroll
• 1:50
Speaker 1: past the hearing room, retain a legal army, sue the committee,
• 1:53
Speaker 1: challenge its constitutional authority, and force lawmakers to spend their
• 1:57
Speaker 1: time explaining why they should be allowed to question you?
• 2:01
Speaker 1: Most Americans know exactly what would happen to them if
• 2:04
Speaker 1: they treated a federal subpoena like an invitation they could
• 2:07
Speaker 1: decline because they found the question inconvenient. They would discover
• 2:11
Speaker 1: very quickly that government authority becomes remarkably muscular when applied
• 2:16
Speaker 1: to ordinary people. Suddenly, deadlines would matter. Suddenly, compliance would matter.
• 2:22
Speaker 1: Contempt would matter. Suddenly, nobody would be standing around wondering
• 2:27
Speaker 1: whether enforcing the subpoena might be a little too confrontational.
• 2:32
Speaker 1: Yet when the man on the other side of the
• 2:33
Speaker 1: table is a billionaire who paid Jeffrey Epstein $ 158 million,
• 2:38
Speaker 1: Congress appears to need a fucking strategy meeting to decide
• 2:41
Speaker 1: whether its own subpoenas mean anything. And that $ 158 million
• 2:46
Speaker 1: figure should sit in the middle of every conversation about
• 2:50
Speaker 1: Leon Black and Jeffrey Epstein, because there's absolutely nothing trivial
• 2:54
Speaker 1: about it. Black says Epstein provided sophisticated tax, estate planning,
• 3:00
Speaker 1: and financial advice. And Black has repeatedly denied participating in
• 3:05
Speaker 1: Epstein's abuse or trafficking. Fine, that's his position. And nobody
• 3:10
Speaker 1: has to manufacture allegations that have not been proved in
• 3:13
Speaker 1: order to ask the obvious questions raised by the relationship.
• 3:18
Speaker 1: $ 158 million is an extraordinary amount of money to pay
• 3:22
Speaker 1: anyone for professional services. It becomes even more worthy of
• 3:26
Speaker 1: examination when the recipient is Jeffrey Epstein, a convicted sex
• 3:31
Speaker 1: offender whose relationship with extremely wealthy and influential people remain
• 3:35
Speaker 1: at the center of enormous public scrutiny. Congress does not
• 3:39
Speaker 1: have to declare Leon Black guilty of some hidden crime
• 3:42
Speaker 1: to demand an explanation for the depth, nature, mechanics, and
• 3:46
Speaker 1: surrounding circumstances of that relationship. That is what investigations are
• 3:51
Speaker 1: supposedly for. You identify facts that demand examination, and then,
• 3:57
Speaker 1: stick with me here, you fucking examine them. You don't
• 4:00
Speaker 1: recoil because the person holding the answers has lawyers capable
• 4:04
Speaker 1: of turning every demand into federal litigation. If Congress is
• 4:08
Speaker 1: intimidated by the price tag attached to challenging Leon Black,
• 4:12
Speaker 1: it's already surrendered the premise that everyone is equally accountable
• 4:16
Speaker 1: to the law. And this is where the House Oversight
• 4:19
Speaker 1: Committee deserves its share of contempt. because the chest-thumping means
• 4:23
Speaker 1: nothing unless somebody eventually follows through. Congressional committees love stern letters.
• 4:29
Speaker 1: They love deadlines printed in bold type. They love television cameras,
• 4:33
Speaker 1: angry statements, dramatic declarations about accountability, and threats about what
• 4:38
Speaker 1: might happen if somebody refuses to cooperate. Then somebody with
• 4:43
Speaker 1: real resources looks them directly in the face and says no. Suddenly,
• 4:47
Speaker 1: the lions at Capitol Hill start sounding like middle managers
• 4:51
Speaker 1: waiting for permission from legal. James Comer can call blacks'
• 4:55
Speaker 1: behavior unacceptable until the fucking paint peels off the committee
• 4:59
Speaker 1: room walls. But unacceptable conduct requires consequences if the word
• 5:04
Speaker 1: is going to mean anything. A subpoena that can be
• 5:07
Speaker 1: ignored while Congress deliberates about whether it possesses the courage
• 5:10
Speaker 1: to enforce it is not much of a subpoena. It's
• 5:14
Speaker 1: a strongly worded suggestion printed on expensive stationery. Leon Black
• 5:19
Speaker 1: appears perfectly willing to test whether this committee possesses anything
• 5:23
Speaker 1: beyond stationary. And look, Black's not some random stranger. We're
• 5:27
Speaker 1: talking about a guy who had a financial relationship with
• 5:30
Speaker 1: Epstein that's already established and acknowledged. Black himself has described
• 5:34
Speaker 1: hiring Epstein for financial work and said he regrets the association.
• 5:39
Speaker 1: Congressional investigators also want answers concerning non-disclosure agreements because they're
• 5:44
Speaker 1: examining whether Epstein played any role in those arrangements or
• 5:48
Speaker 1: related matters. Black argues that the requested information reaches into
• 5:53
Speaker 1: private affairs unrelated to any legitimate legislative purpose. That's an
• 5:58
Speaker 1: argument he has every legal right to make in court.
• 6:01
Speaker 1: But the existence of a legal argument does not magically
• 6:04
Speaker 1: erase the extraordinary public interest questions surrounding the relationship Congress
• 6:09
Speaker 1: is attempting to understand. Powerful people are allowed to challenge
• 6:13
Speaker 1: government power and they should be allowed to challenge it
• 6:16
Speaker 1: when they believe it exceeds constitutional limits. The scandal is
• 6:19
Speaker 1: not that Leon Black has lawyers or constitutional rights. The
• 6:23
Speaker 1: scandal is watching how radically different the experience of asserting
• 6:27
Speaker 1: those rights becomes when the person asserting them possesses billions
• 6:31
Speaker 1: of dollars and the ability to turn congressional scrutiny into
• 6:35
Speaker 1: prolonged institutional warfare. And look, we have to talk about
• 6:41
Speaker 1: that because people will inevitably try to reduce this discussion
• 6:45
Speaker 1: to some childish argument that criticizing Black's lawsuit means opposing
• 6:49
Speaker 1: due process bullshit. Due process is essential precisely because government
• 6:54
Speaker 1: power should be challenged when it exceeds lawful boundaries. The
• 6:58
Speaker 1: problem is that meaningful access to that challenge is distributed
• 7:01
Speaker 1: in this country with all the equality of first-class seating
• 7:05
Speaker 1: on a private fucking jet. Leon Black and higher elite
• 7:08
Speaker 1: attorneys initiate federal litigation, contest subpoenas, attack investigative scope, invoke
• 7:14
Speaker 1: constitutional doctrine, and potentially drag the dispute through a legal
• 7:18
Speaker 1: process that consumes time Congress does not have in unlimited supply.
• 7:23
Speaker 1: An ordinary citizen facing institutional power often has a mortgage,
• 7:27
Speaker 1: a job, children, attorney bills, and a rapidly shrinking bank account.
• 7:32
Speaker 1: A survivor contemplating litigation against wealthy and connected people has
• 7:36
Speaker 1: all of those disadvantages, plus the emotional burden of publicly
• 7:40
Speaker 1: revisiting some of the worst experiences of her life. Pretending
• 7:44
Speaker 1: those two litigants occupy the same practical universe because the
• 7:48
Speaker 1: courthouse doors technically open for both of them is insulting.
• 7:53
Speaker 1: Rights exist on paper, and rights you can afford to
• 7:56
Speaker 1: enforce are two very different fucking things. Leon Black is
• 8:00
Speaker 1: currently demonstrating the difference in real time. And that's why
• 8:04
Speaker 1: the people screaming that Epstein is a hoax should be
• 8:07
Speaker 1: forced to stare directly at this episode before opening their
• 8:10
Speaker 1: mouths again. Forget the memes. Forget the partisan garbage. Forget
• 8:14
Speaker 1: whichever politician they're currently trying to protect by turning a
• 8:18
Speaker 1: decades-long trafficking scandal into another brain-dead team sport. Look at
• 8:22
Speaker 1: the resources required simply to force answers from one immensely
• 8:26
Speaker 1: wealthy Epstein associate who denies wrongdoing. Congress itself is encountering
• 8:31
Speaker 1: resistance substantial enough to generate a federal lawsuit over the
• 8:35
Speaker 1: scope of its investigation. This is an institution armed with
• 8:39
Speaker 1: subpoena power, lawyers, staff, government resources, televised hearings, contempt procedures,
• 8:45
Speaker 1: and the theoretical backing of the United States House of Representatives. Now,
• 8:51
Speaker 1: replace Congress with one frightened woman sitting at a kitchen
• 8:54
Speaker 1: table trying to decide whether she wants to accuse somebody
• 8:57
Speaker 1: enormously richer and more powerful than she is. Then tell
• 9:01
Speaker 1: me again with a straight fucking face why every survivor
• 9:04
Speaker 1: did not immediately come forward. People ask that question as
• 9:07
Speaker 1: though disclosure occurs inside some sanitized morality play where a
• 9:11
Speaker 1: survivor speaks and the machinery of justice is instantly embraces her.
• 9:16
Speaker 1: That is not how the real world works. Coming forward
• 9:19
Speaker 1: can mean depositions, cross-examination, public scrutiny, leaks, reputational attacks, invasive
• 9:25
Speaker 1: demands for records, questions about relationships, questions about money, questions
• 9:30
Speaker 1: about memory, and an endless parade of strangers deciding whether
• 9:34
Speaker 1: you behaved enough like their preferred version of a victim.
• 9:38
Speaker 1: At a billionaire defendant or subject with elite counsel, And suddenly,
• 9:42
Speaker 1: every inch of the process can become contested territory. A
• 9:45
Speaker 1: survivor does not look at the landscape and see an
• 9:48
Speaker 1: abstract civics lesson. She sees years of her life. She
• 9:52
Speaker 1: sees legal bills. Her name potentially dragged through public discourse
• 9:56
Speaker 1: while the opposing side possesses resources she could never hold back.
• 10:00
Speaker 1: to match. Now, look at Leon Black's confrontation with Congress
• 10:03
Speaker 1: through that lens. He's not suing a blogger. He's not
• 10:07
Speaker 1: suing some penniless accuser who can barely retain counsel. He's
• 10:11
Speaker 1: gone into federal court against a committee of the United
• 10:14
Speaker 1: States House of Representatives. Whatever the ultimate merits of his
• 10:18
Speaker 1: constitutional arguments, That decision broadcasts something unmistakable about his willingness
• 10:24
Speaker 1: and capacity to fight. If you're an ordinary person watching this,
• 10:28
Speaker 1: the message is impossible to miss. This man is prepared
• 10:32
Speaker 1: to litigate against Congress itself. Rather than comply with subpoenas,
• 10:36
Speaker 1: he considers illegitimate. Imagine contemplating a legal confrontation with someone
• 10:40
Speaker 1: operating at that level of resources and aggression. Imagine knowing
• 10:44
Speaker 1: that every procedural avenue available to him can be explored
• 10:48
Speaker 1: by attorneys whose fees... will never threaten whether his electricity
• 10:52
Speaker 1: stays on next month. Then, imagine some asshole on social
• 10:55
Speaker 1: media asking why survivors waited to speak. That question has
• 11:00
Speaker 1: always exposed a breathtaking ignorance about power. Powerful people do
• 11:05
Speaker 1: not need to win every case in order for their
• 11:08
Speaker 1: power to matter. They merely need to make resistance expensive enough,
• 11:12
Speaker 1: frightening enough, exhausting enough, and uncertain enough that many people
• 11:16
Speaker 1: decide never to begin litigation itself can become part of
• 11:20
Speaker 1: the battlefield. Delay can become leverage. Expenses can become leverage.
• 11:25
Speaker 1: Privacy can become leverage. Reputation can become leverage. Access to
• 11:30
Speaker 1: prestigious attorneys can become leverage. The willingness to spend enormous
• 11:34
Speaker 1: amounts of money defending a position can become leverage. None
• 11:37
Speaker 1: of that proves the underlying allegations against any particular person.
• 11:42
Speaker 1: But pretending those forces do not influence whether Uyghur parties
• 11:45
Speaker 1: come forward is straight up delusional. The Epstein story has
• 11:49
Speaker 1: been saturated with precisely this kind of imbalance from the beginning.
• 11:53
Speaker 1: Jeffrey Epstein did not operate in a social universe populated
• 11:57
Speaker 1: primarily by powerless people. He cultivated presidents, princes, billionaires, academics, financiers, lawyers, scientists, socialites,
• 12:06
Speaker 1: and institutional gatekeepers. The girls and women, describing abuse, overwhelmingly
• 12:12
Speaker 1: occupied a different stratum of power. That asymmetry is not
• 12:16
Speaker 1: incidental background decoration, It is one of the central facts
• 12:19
Speaker 1: necessary to understanding how Epstein survived scandal after scandal while
• 12:25
Speaker 1: maintaining access to extraordinarily influential circles. When someone asks why
• 12:29
Speaker 1: accountability moves so slowly, look at the architecture surrounding them.
• 12:33
Speaker 1: Look at the money. Look at the lawyers. Look at
• 12:35
Speaker 1: the institutions that repeatedly discovered reasons to hesitate. All right, folks,
• 12:40
Speaker 1: we're going to wrap up episode one right here. And
• 12:43
Speaker 1: in the next episode, we're going to finish this bad
• 12:45
Speaker 1: boy off. All the information that goes with this episode
• 12:48
Speaker 1: can be found in the description box.
