1.29.26 · The Mountain Eagle

0:01
Speaker 1: Now we turn to the Mountain Eagle to read news
0:03
from Whitesburg. Your reader today is Bill and Arsdale. We
0:08
will begin with the addition dated January twenty eighth, twenty
0:11
twenty six, which the publishers have donated to Radio Eye
0:16
as a reminder. Radio Eye is a reading service intended
0:19
for people who are blind or have other disabilities that
0:22
make it difficult to read printed material. The first headline
0:27
is a caption Winters. Puffer jackets belong to the birds.
0:33
As bitter cold weather envelops the region this week, Northern
0:37
cardinals are among the few creatures still active outdoors. Given
0:42
their puffed up winter appearance, many people assume redbirds gain
0:46
weight to stay warm. In reality, they look fatter because
0:49
they fluff their down feathers, creating a puffer jacket effect
0:54
that traps body heat. Cardinals, Kentucky's state bird, can't add
0:59
much to wait without interfering with flight in extreme coal,
1:04
They also stop defending territories and may roost together for warmth.
1:09
With temperatures expected to dip as low as three degrees,
1:13
perhaps we could all take a queue and ruffle our
1:16
feathers a bit too. The next headline is new motion
1:21
is filed in lawsuit involving Stein's ex court bailiff. The
1:28
attorney for Sabrina Atkins has filed a new brief challenging
1:33
the validity of a declaration submitted by Attorney Daniel Dotson
1:37
in Atkins's lawsuit against former Deputy Jailer Ben Fields, the
1:42
Electric County Sheriff's Office, and Eastern Kentucky Correctional Services Incorporated.
1:48
The brief, filed in U S District Court in London,
1:51
characterizes Dotson's appearance at the deposition of former Sheriff Shawn
1:55
Mickey Steins as an apparent attempt to shield himself from
2:00
being subject to discovery or trial testimony. The brief states, however,
2:05
Dotson never entered an appearance in this action.
2:08
Speaker 2: He has now.
2:09
Speaker 1: Filed a declaration D two three I stating that he
2:14
has no knowledge of the matters asserted in Plaintiff's witness
2:17
list as attributable to him. Mister Dotson's statements should be
2:21
tested at trial. An issue is a declaration filed by
2:26
Dotson as part of emotion submitted by counsel for the
2:30
office of current Sheriff Billy Jones. Atkins had listed Dotson
2:35
as a witness for the plaintiff, expecting him to testify
2:38
regarding his knowledge of Sean Mickey Steins's alleged participation in
2:43
unlawful sexual activities involving female inmates, as well as Steines's
2:48
alleged knowledge of others involvement in such activities while he
2:52
served as Letcher County sheriff. While the brief largely defends
2:57
the plaintiff's selection of witnesses and evidence exhibits, it includes
3:01
one notable exception. The brief withdraws Robert Chad Brown from
3:06
the witness list without comment. Brown is currently an inmate
3:11
at the Leslie County Detention Center, where Stein's is being
3:14
held on a charge of murdering lecturer.
3:16
Speaker 2: District Judge Kevin R. Mullins.
3:20
Speaker 1: Atkins previously told investigators with the Attorney General's Office that
3:24
Brown told her he had a videotape depicting Mullens having
3:28
sex for the woman in his office. Brown denied possessing
3:32
such a tape when questioned by investigators and others. Despite
3:36
that denial, the defense had listed Brown as a witness
3:40
expected to testify about evidence he has or has seen
3:43
related to court officials having sexual relations with females on
3:47
home incarceration or otherwise incarcerated. The next story is After
3:55
seventy eight years, Western Auto nears the end of an
3:59
era in Whitsburg. After nearly eight decades on Main Street,
4:05
Whitesburg's oldest retail business is preparing to close its doors.
4:11
The Western Auto store in Whitesburg will close Friday, January thirtieth,
4:16
ending a seventy eight year run that began in nineteen
4:19
forty seven. While the national chain once sold everything from
4:24
appliances to bicycles, the Witsburg location has spent its final
4:29
years operating as a tire only store, quietly continuing a
4:33
long local tradition. The store was opened by Owen W.
4:39
Wright Senior and became a fixture of downtown Whitesburg during
4:43
a time when Main Street was the center of local commerce.
4:48
In nineteen eighty one, following Wright's death, the business was
4:51
taken over by his son, Owen W. Wright Junior, and
4:55
his wife, Barbara Wright. For the next forty four years,
5:00
the couple ran the store through major changes in retail,
5:04
the decline of downtown shopping, and the eventual narrowing of
5:08
the business to tire sales and service, even as other
5:12
storefronts came and went, the Western Auto sign remained a
5:15
familiar sight to generations of Whitesburg residents. Now, Owen and
5:22
Barbara Wright are retiring and relocating to Prestonsburg to be
5:26
closer to their son, Owen Wright Third. A retirement reception
5:31
will be held from noon to two p m. Thursday,
5:34
January twenty ninth at the store, giving the community a
5:38
chance to say good bye and thank the rights for
5:41
decades of service. The event is open to the public.
5:45
As the doors close on one of Whitesburg's longest running businesses,
5:50
The end of the Western Auto Store marks not just
5:53
a retirement, but the close of a chapter in the
5:56
town's main street history. The next story is rule aims
6:04
to keep jail workers from answering critics on social media.
6:09
The Lecter Fiscal Court has adopted a new social media
6:12
policy aimed at preventing County Jail employees from arguing with
6:16
members of the public online. The policy was approved after
6:22
jailer Brian Sloane told the court that employees have become
6:26
upset about comments made about them on social media, with
6:29
some engaging in heated exchanges in comment sections.
6:34
Speaker 2: While Sloane said.
6:35
Speaker 1: He believes employees should be able to defend themselves. He
6:39
said identifying as a jail employee while arguing online has
6:43
created problems for the county. It's a big headache, Sloan said.
6:49
The Fiscal Court approved the social media policy unanimously at
6:54
Sloane's request. The court also agreed to formally clarify the
6:58
county's policy on in medical copays and commissary deposits. The
7:04
policy has been in practice since Don McCall served as jailer,
7:08
but had never been officially adopted. Sloan said inmates were
7:13
charged a twenty five dollars copay for doctor visits, but
7:17
some had been arranging for family members to send money
7:20
to other inmates accounts to spend on their behalf, allowing
7:23
them to avoid paying the medical fees owed to the jail.
7:28
Under the clarified policy, inmates will be charged half of
7:31
the copey upfront, with the remaining balance to be collected later.
7:35
If anybody gets released and they have money, we'll take
7:38
that for the copays, Sloane said. In the next headline,
7:46
civil war killing echoes through County's history. Barnabas Barnes Christian
7:54
was born in Virginia, in eighteen twenty five. He was
7:58
the son of Allan Christian and abbad Yale Abby Hagins Christian,
8:02
who were married on November fourteenth, eighteen twenty three. Alan
8:07
Christian was born October fifteenth, eighteen oh two, in Virginia
8:11
and died December nineteenth, eighteen eighty six, in Letcher County, Kentucky.
8:16
He was the son of Thomas Wilson Christian and Margaret
8:19
Rebecca Christian. Abby Hagens Christian was born in eighteen oh
8:23
four and died October tenth, eighteen fifty seven, in Letchri County.
8:28
She was the daughter of Reverend William Haggins and Mary
8:32
Polly Haggins. Allen moved to eastern Kentucky with his brother,
8:37
Thomas W. Christian Junior, prior to eighteen forty. Allen and
8:42
Abbey lived in Perry County before eighteen forty and moved
8:45
to adjoining Letchri County some time before Abbey's death.
8:48
Speaker 2: In eighteen fifty seven.
8:50
Speaker 1: The couple purchased land along the North Fork of the
8:53
Kentucky River near present day Blackie. Allen and Abby had
8:58
at least five children. Rebecca, who married John Bursher Barnes
9:04
who married first Elpha and later Jane Kishingman, Sarah Sally
9:09
who married William Caudle, Letha Ann, and William. Following Abbey's death,
9:16
Alan married Margaret Collins, daughter of Burdeen and Mary Collins. Margaret,
9:22
identified as a sapony Indian, was born in North Carolina
9:27
in eighteen thirty one and died in Letter County in
9:30
eighteen ninety six. Allan and Margaret had at least two children, Mary, Margaret,
9:35
and Elizabeth. Christian Barnes married his first wife, Elpa, around
9:40
eighteen forty two. They are believed to have had five children, Mary, Silas, Elizabeth, Sarah, Sally,
9:49
and William. Barnes named Sarah and William after his sister
9:53
and brother. After Elpha's death, Barnes married Jane Kishingman, born
9:58
in eighteen forty. They had at least four children, Nancy Ann,
10:03
who married Jesse mc Daniel Liddy, and twin infants who
10:07
were still born. Barnes and his family lived next door
10:10
to his father in Perry County. The eighteen fifty Perry
10:14
County Agricultural Census shows that Barnes owned one horse, two oxen,
10:19
and one sheep. This was a typical amount of live
10:23
stock for a beginning farmer of the era. His father,
10:27
by contrast, owned a large number of live stock and
10:30
substantial crop land, indicating that Allan was a successful and
10:34
prosperous farmer. Sometime around the spring of eighteen sixty, Barnes
10:40
moved from Perry County to Letcher County, his father had
10:44
already relocated there. Barnes settled on Mill Branch of the
10:49
North Fork of the Kentucky River, near present day Roxanna.
10:53
This property is now owned by Doyle and Merlin Day.
10:57
Merlin Day was a long time member of the Electric
11:00
County Historical Society before her passing in twenty nineteen. Her
11:04
efforts helped keep the story of Barnes Christian alive. At
11:09
the outbreak of the Civil War in April eighteen sixty one,
11:14
Barnes and his neighbours in the mountains of eastern Kentucky
11:17
attempted to remain neutral. By the fall of that year, however,
11:21
many mountain families were forced to choose sides as the
11:25
conflict moved closer to home. Barnes and his brother William
11:29
traveled a few miles to Whitesburg to enlist in the
11:32
Confederate Army. Whitesburg was the nearest Confederate recruiting station for
11:37
this part of eastern Kentucky, largely due to its proximity
11:41
to the Virginia border. In October eighteen sixty one, Barnes
11:47
and william enlisted in Company F of the fifth Kentucky Infantry.
11:53
The company was organized by Captain Benjamin Caudle, a local minister,
11:57
under orders from General Humphrey Marshall. The regiment was commanded
12:02
by Colonel John S. Williams, a Mexican war veteran from
12:06
Montgomery County, Kentucky. The Fifth Kentucky trained on the large
12:11
bottom owned by John A. Caudle just west of Whitesburg,
12:15
before moving to Prestonsburg to continue drilling. While there, a
12:19
staff officer remarked to Colonel Williams that the poorly clothed
12:23
soldiers looked like ragamuffins. Amused, Williams adopted the nickname, and
12:29
the regiment became known as the Ragamuffins. By late October,
12:34
the regiment was assigned to the Department of Eastern Kentucky
12:37
under General Humphrey Marshall. The department included troops from Eastern
12:42
Kentucky and southwestern Virginia, and its primary mission was guarding
12:47
Pound Gap. Barnes and Williams saw their first major combat
12:52
on January tenth, eighteen sixty two, at the Battle of
12:56
Middle Creek in Floyd County. Marshall's men faced US Union
13:00
forces commanded by Colonel James Garfield, later President of the
13:04
United States. The Confederates held the high ground overlooking Middle Creek,
13:09
while Union troops repeatedly charged uphill in an attempt to
13:13
dislodge them. As dusk fell, the attacks had been repelled
13:18
and Garfield ordered a withdrawal. Confederate celebration was short lived, however,
13:24
when another Union regiment arrived as reinforcements.
13:28
Speaker 2: During the night.
13:29
Speaker 1: General Marshall ordered his outnumbered force to retreat toward Pound Gap.
13:35
Barnes and william had now seen the elephant, the phrase
13:39
used by soldiers to describe their first experience in battle.
13:44
While stationed near Whitsburg in early March eighteen sixty two,
13:48
Barnes learned that his wife, Jane, was about to give birth.
13:52
He requested leave to assist with the delivery and care
13:55
for his children, but his request was denied. On March
13:59
eight eight, eighteen sixty two, Barnes made.
14:02
Speaker 2: The decision to dessert.
14:05
Speaker 1: Leaving the regiment's camp at Weisberg, Barnes traveled down the
14:09
Kentucky River to the mouth of Mill Branch, and then
14:13
walked nearly two miles to his home. Jane, heavily pregnant,
14:17
and the children, welcomed him with joy. Unfortunately, word of
14:22
his return soon reached the local Union Home Guard men,
14:26
who had once been his neighbors and friends. Eastern Kentucky,
14:30
like many places, was experiencing a true brother against brother war.
14:37
Just days after Barnes returned home, a group of Union
14:40
Home Guards arrived at his cabin. Standing in front of
14:44
the house, they called for him to come out. Barnes
14:48
and Jane understood what this visit likely meant. Barnes stepped
14:53
onto the porch, attempting to keep his pregnant wife inside,
14:57
but Jane, a strong and courageous woman, forced her way
15:00
out and stood.
15:01
Speaker 2: In front of him.
15:03
Speaker 1: She hoped her condition might soften their hearts. Ignoring her
15:08
pleas the men raised their weapons, Barnes pushed Jane aside,
15:13
and a volley of rifle fire struck him, likely killing
15:17
him instantly. As his body fell onto the porch, floor.
15:22
The leader of the group warned that any one who
15:24
touched Barnes's body would suffer the same fate. The threat
15:29
applied only to men. The women of the neighborhood took
15:32
responsibility for Barnes's burial, tearing boards from the barn to
15:37
construct a coffin. While they dug the grave, Jane went
15:41
into labor. Tragically, her twin babies were still born, likely
15:46
due to the trauma she had endured. When the grave
15:50
was finished, the women laid Barnes in the coffin and
15:53
placed one infant under each of his arms. It was
15:57
a heart breaking scene. Little is known about the fate
16:02
of Barnes's surviving family, as Jane and the children eventually
16:06
scattered across the country. Barnes and the twins were buried
16:10
on a small flat across the creek from his cabin
16:14
in what is now known as the Davis Whittaker Day Cemetery.
16:18
Doyle Day now owns the surrounding property. In later years,
16:23
a marble military headstone was placed at the grave, with
16:27
the twins information added as well. Barnes's brother, William, completed
16:33
his service in the fifth Kentucky Infantry and later joined
16:37
the thirteenth Kentucky Cavalry commanded by Colonel Benjamin Caudle. After
16:43
the war, William moved to Colorado, attempting to leave painful
16:46
memories behind.
16:50
Speaker 2: Local legends suggest that.
16:51
Speaker 1: Barnes Christian may have been biracial, though no written confirmation
16:55
has been found. There were, however, at least two black
16:59
families with the surname Christian living nearby. Regardless of race,
17:05
Barnes's story is one of many tragic accounts from the
17:08
Civil War era in the Appalachian Mountains, Numerous feuds and
17:13
divisions had their roots in wartime violence and loss. The
17:20
next story is Letcher legend Ritter to receive another honor,
17:27
Goebel Tex Ritter, the Lake Letcher County School official, best
17:31
known for his professional basketball career and his success as
17:35
a high school coach at Fleming, Neon Hazard and Whitsburg,
17:40
has been selected for enshrinement in the twenty twenty six
17:43
class of the Madison County Sports Hall of Fame in Richmond. Ritter,
17:48
a long time Whitesburg resident, was a native of Richmond
17:52
and excelled in football, basketball, and baseball at Madison Model
17:57
High School from nineteen thirty nine to nineteen forty two,
18:01
he earned a football scholarship to Eastern Kentucky State College,
18:05
but instead of enrolling, joined the U. S. Marine Corps
18:08
during World War II. He was awarded two Purple Hearts
18:12
with oak leaf clusters for valor during combat operations at Iwo,
18:16
Jima and Guam. After the war, Ridder returned to Eastern
18:21
Kentucky State, where he became a Little All American in
18:24
three sports before being drafted by the New York Knickerbockers.
18:29
He played one hundred fifty one NBA games from nineteen
18:32
forty eight to nineteen fifty one, averaging about six points
18:36
per game. Following his professional playing career, Ritter returned to
18:41
Kentucky and began a high school basketball coaching career at
18:44
Flemingdeon High School. After one season, he accepted the head
18:49
coaching position at Hazard High School, where he led the
18:52
Bulldogs to four Sweet sixteen state tournament appearances over a
18:57
ten year span, including the nineteen fifty five KHSAA state championship.
19:05
Ridder's best teams at Hazard were led by star guard
19:08
Johnny Cox, who had played for Fleming Neon. During Ridter's
19:12
lone season there, Cox scored thirty two points in Hazzard's
19:18
seventy four to sixty six championship victory over Adair County.
19:24
Rider later returned to Letcher County to serve as head
19:27
coach of the Whitesburg High School Yellowjackets for four seasons.
19:31
He subsequently left coaching to become the school's assistant principal
19:35
and later served as director of transportation for the Letcher
19:38
County School District. In addition, Ridder worked for eighteen years
19:43
as a basketball referee. Ridder died in October two thousand four,
19:49
at the age of eighty. He was married for fifty
19:52
seven years to Letcher County native Pauline Penny Caudle, whom
19:57
he met while both were students at Eastern. She died
20:01
in November two thousand twenty three. Also selected for induction
20:06
into the two thousand twenty sixth class is Damian Harris,
20:10
the first five star recruit in Kentucky high school football history.
20:15
A two time High School All American at Madison Southern
20:18
High School, Harris rushed for six thousand, seven hundred forty
20:22
eight yards and one hundred twenty two touchdowns. He later
20:26
started three seasons at Alabama, helping lead the Crimson Tide
20:30
to two national championships. Harris played five seasons in the
20:35
NFL with the New England Patriots two thousand nineteen to
20:38
twenty two and Buffalo Bills two thousand twenty three. He
20:43
enjoyed a breakout season in two thousand twenty one, rushing
20:46
for nine hundred twenty nine yards and fifteen touchdowns.
20:50
Speaker 2: His career was.
20:51
Speaker 1: Cut short by a neck injury in two thousand twenty three,
20:54
forcing his retirement at age twenty seven. The induction ceremony
21:00
will be held Friday, May sixteenth at five pm in
21:03
the E. KU Perkins Building in Richmond. In the next headline,
21:10
lawsuit renews scrutiny of provider long involved on local recovery efforts.
21:17
Addiction Recovery Care ARC, a Louisa based company that expanded
21:23
into one of Kentucky's largest addiction treatment providers, is facing
21:27
a federal lawsuit in New York amid allegations of financial
21:31
wrongdoing and an ongoing federal investigation. The lawsuit, filed January
21:38
twelfth in U. S. District Court in Manhattan by Angelica
21:42
Capital Trust, names ARC and its owners Tim Robinson and
21:47
his wife Lelia Robinson, both of Lawrence County. It claims
21:51
Angelica advanced ARC eight million dollars that has not been
21:55
repaid as agreed. Angelica's lawsuit dge as ARC is attempting
22:01
to raise nearly twenty eight million dollars to resolve a
22:05
civil settlement with the US Department of Justice tied to
22:08
alleged Medicaid and Medicare billing fraud. ARC's court response asks
22:14
the judge not to freeze the disputed funds, saying such
22:17
a move would disrupt treatment services for patients across Kentucky,
22:21
but it does not address the settlement allegation. The lawsuit
22:26
also says the federal investigation began after a whistleblower complaint
22:31
was filed in twenty twenty three. The FBI has confirmed
22:35
as recently as this month that its investigation remains ongoing.
22:41
In Letcher County. ARC has been involved for years in
22:44
local efforts to connect people to treatment. In twenty eighteen,
22:50
ARC began working closely with Letcher District Judge Kevin R.
22:53
Mullins's court. The next story is Daniel Boone Hotel project
23:00
advances with the hiring of architects from Lexington, Joseph and
23:06
Joseph Architects of Lexington and Louisville will design the next
23:10
phase of renovations to the Daniel Boone Hotel, contingent on
23:14
the completion of contract negotiations. Opened one hundred six years ago,
23:20
the Daniel Boone Hotel was a first class hotel at
23:23
a time when Main Street was still mud and travelers
23:26
arrived in the city by rail. In a news release,
23:30
the city described the hotel as a symbol of Whitesburg's
23:34
history and potential. This is a milestone moment for Whitesburg,
23:39
said Tiffany Craft, Mayor of Whitesburg. The Daniel Boone Hotel
23:44
has been part of our story for generations. Today we
23:47
will take a major step toward giving it new life,
23:50
one that honors our past while investing in our future.
23:55
The nine two hundred twenty four square foot building opened
23:59
on Independence Day weekend in nineteen twenty and was last
24:03
used as a hotel in nineteen seventy four. Mountain Comprehensive
24:07
Health Corporation converted it into a clinic and office space
24:11
in nineteen seventy five. In the nineteen nineties, it served
24:15
as the Electric County Courthouse while the courthouse building down
24:18
the street was being renovated. The Dollhare family donated the
24:23
building to the City of Whitsburg in two thousand nine
24:26
after it had sat vacant and unused.
24:29
Speaker 2: For about a decade.
24:31
Speaker 1: The city has spent more than a decade planning and
24:34
seeking grant funding for the project, which is expected to
24:37
include retail and meeting space, as well as a boutique hotel.
24:43
Before renovation funding was secured, a leaking skylight caused the
24:47
roof to collapse, taking portions of all three floors below
24:51
with it. The city used a one point five million
24:55
dollar grant from the Appalachian Regional Commission to remove the
24:59
damaged interior and construct a new roof and floors, but
25:03
no further work could be done until additional funding became available.
25:08
The new phase of work is being funded through a
25:10
three million dollars state ear mark approved by the Kentucky
25:14
General Assembly and the next story is leaks flood damage
25:20
drive utility work in Neon. Utility work is moving ahead
25:26
in Fleming Neon, with more money on the way for
25:29
sewer improvements and water line replacements. Mayor Ricky Burke said
25:34
he is pretty positive we have the green light for
25:36
grinders and lift stations for the sewer system and bidding
25:40
should be advertised soon. The deadline for the next round
25:44
of funding for sidewalk repares was Monday. Burke said Phase
25:49
one of the city's water line project, which cost about
25:52
nine hundred thousand dollars, is complete. That project runs from
25:57
the city water plant at Shayse Fork to Fleming. Phase
26:01
one B will soon be underway at a cost of
26:04
two million, seven hundred seventy seven thousand dollars and will
26:08
include McRoberts. Phase two and Phase four are fully funded
26:14
at six million, four hundred seven thousand dollars and five
26:18
point four two eight million dollars respectively. Phase two will
26:22
run along Kentucky three seventeen from Goose Creek to Neon Junction.
26:27
Phase four will be Enhamond. The city has applied for
26:32
three point nine three two million dollars to complete Phase three,
26:36
which would run from Sicco to Martha Jane Potters School.
26:41
Phase five, which would go from Hemp Hill to the
26:43
foot of Rockhouse Mountain, is estimated to cost five point
26:47
seven three eight million dollars, but the city has not
26:50
yet been awarded funding for that project. The final phase
26:54
would include six new water tanks to feed the system,
26:58
estimated to cost five point seven seven five million dollars.
27:03
We got the green light, and when the bid goes out,
