- 2:39Gemma Bentley, Advocate: Uh thank you for having me.
- 2:43Voices for Voices, Justin Alan Hayes: Absolutely.
- 2:44Voices for Voices, Justin Alan Hayes: Well, I'll I'll leave the floor to you um if you want to maybe talk a little bit about like a little timeline of um uh as uh you you you started to find out uh about what what's going on, what's has been going on in in Lecture County, and then we can uh work our way towards you know present day and what what the feeling is uh you know from you and in the community with uh what what uh what has happened.
- 3:22Gemma Bentley, Advocate: Well, um I moved back to Kentucky 13 years ago in uh 20 uh twelve.
- 3:29Gemma Bentley, Advocate: I remembered why I left Kentucky for 30 years real fast, and somebody said, Well, you know, you can go to college.
- 3:37Gemma Bentley, Advocate: And I'm thinking, oh great.
- 3:40Gemma Bentley, Advocate: The teachers passed me just to get me out of high school.
- 3:44Gemma Bentley, Advocate: So I had two young children, and I moved I when I moved back here, um, I went to college.
- 3:52Gemma Bentley, Advocate: Um, I graduated from Southeast Community and Technical College with a 4.0 injustice.
- 3:59Gemma Bentley, Advocate: Thank you.
- 4:00Gemma Bentley, Advocate: In my 50s, but um uh in 2017, um I worked for a program that was just a two-year program um that was called Paths to Promise.
- 4:20Gemma Bentley, Advocate: And the lady who was my boss um did not want me to work on campus like I had done for Ready to Work program.
- 4:29Gemma Bentley, Advocate: So um she wanted me to find a place to go.
- 4:34Gemma Bentley, Advocate: So I had known Kevin since I'd been here, um, out in public, uh, different functions that I did in the pu in the community, um, the Civil War reenactments, the different festivals, and so forth and so on.
- 4:49Gemma Bentley, Advocate: So I did know who Kevin was.
- 4:51Gemma Bentley, Advocate: So I went over to the courthouse and I asked Kevin Mullins if um he cared if I done my two-year program working in his office.
- 5:02Gemma Bentley, Advocate: He agreed.
- 5:04Gemma Bentley, Advocate: And um, so that was in 2017.
- 5:08Gemma Bentley, Advocate: Um, so I was working there for a little while, and uh I think it might have been during the spring months that I had to do this, okay?
- 5:19Gemma Bentley, Advocate: So I'd been working there, and at Christmas um time, you know, then we have our break, you know, everything's closed down Christmas, and then we all return back to work.
- 5:30Gemma Bentley, Advocate: Okay.
- 5:33Gemma Bentley, Advocate: During before the Christmas break, Kevin Muns had hit on me.
- 5:39Gemma Bentley, Advocate: Um came to me.
- 5:42Gemma Bentley, Advocate: He would come out and massage my shoulders, and I'd ask him not to do that because I felt very uncomfortable.
- 5:49Gemma Bentley, Advocate: Um, another time he came out and put his hand on my breast, and I took his hand down and I asked him not to do that.
- 5:57Gemma Bentley, Advocate: Another time he came out and actually put his hand on my crotch area, and I took his hand and I moved his hand and I told him not to do that no more.
- 6:07Gemma Bentley, Advocate: I said, um, this ain't going, I said, you just can't do this.
- 6:11Gemma Bentley, Advocate: This ain't gonna happen.
- 6:12Gemma Bentley, Advocate: And he says, Well, you know, you could come into my office, and he said, um, anytime he said, we can have some fun.
- 6:19Gemma Bentley, Advocate: And I looked at him and I said, Well, I just don't think that my boyfriend would appreciate that very much.
- 6:25Gemma Bentley, Advocate: And none of them liked my boyfriend because he was untouchable and and uh owned his own business.
- 6:33Gemma Bentley, Advocate: And uh, so we take our breath, then later we take our break, and then I'd make sure that I left before the secretary.
- 6:41Gemma Bentley, Advocate: When the secretary leaves, I didn't put in my full hours.
- 6:44Gemma Bentley, Advocate: I'm sorry, it's true.
- 6:45Gemma Bentley, Advocate: He signed off on it though, but I would make sure that I left.
- 6:49Voices for Voices, Justin Alan Hayes: Yeah.
- 6:50Gemma Bentley, Advocate: Okay.
- 6:50Gemma Bentley, Advocate: Uh when she did.
- 6:52Gemma Bentley, Advocate: I did not want him to, I did not want to be in the courthouse alone with him.
- 6:56Gemma Bentley, Advocate: Okay, so when we came back from our Christmas break, I had purchased a home in May before that, that May.
- 7:07Gemma Bentley, Advocate: I graduated from that and I was going to EK working for EKU in 2018.
- 7:12Gemma Bentley, Advocate: Okay, so um, I bought a home and I moved out of that guy's house that I was living with and moved over here.
- 7:23Gemma Bentley, Advocate: Okay.
- 7:24Gemma Bentley, Advocate: When I did this, the guy had come to the judge or to Jamie Hatton.
- 7:30Gemma Bentley, Advocate: Now that's who I really want to talk about.
- 7:32Gemma Bentley, Advocate: It's Jamie Hatton, Matt Butler, and Daniel Dotson.
- 7:37Gemma Bentley, Advocate: Kevin's dead.
- 7:38Gemma Bentley, Advocate: But so when we came back from break, the judge calls me into his office, and I'm like, oh god.
- 7:50Gemma Bentley, Advocate: So I made sure I did not close the door.
- 7:55Gemma Bentley, Advocate: Okay.
- 7:55Gemma Bentley, Advocate: Because I had op tried to open the door when a girl had gone in there because he had gotten a phone call that he needed to take.
- 8:04Gemma Bentley, Advocate: The door was locked.
- 8:06Gemma Bentley, Advocate: So I just went back to my little desk and I sat back down.
- 8:08Gemma Bentley, Advocate: So, anyways, he I go in there and he says, he informs me that he has uh a warrant for my arrest, a criminal warrant.
- 8:16Gemma Bentley, Advocate: And I said, for what?
- 8:17Gemma Bentley, Advocate: He said, Well, he said, Greg, now he knows Greg too, my ex and he knew me.
- 8:26Gemma Bentley, Advocate: And uh, so he says, I saw he said, I've had this all laying on my desk for a couple of months.
- 8:32Gemma Bentley, Advocate: He said, but I I had to go ahead and sign it.
- 8:35Gemma Bentley, Advocate: And I said, but for what?
- 8:38Gemma Bentley, Advocate: And he tells me that Greg went down to Jamie Hatton's office and told them that I stole stuff when I left him.
- 8:46Gemma Bentley, Advocate: I said, I didn't steal nothing.
- 8:48Gemma Bentley, Advocate: I said he was stealing from me.
- 8:50Gemma Bentley, Advocate: He took stuff that he was going through my stuff when I'm packing it.
- 8:54Gemma Bentley, Advocate: He he wouldn't let me have the vehicle that I had purchased.
- 8:57Gemma Bentley, Advocate: He wouldn't let me have my own microwave that I brought here.
- 9:00Gemma Bentley, Advocate: When I moved into that man's home in 2012, he had a bedroom suit and a recliner.
- 9:07Gemma Bentley, Advocate: He had his cast iron stuff.
- 9:09Gemma Bentley, Advocate: He had nothing else, no towels, no dishes, no silverware, no curtains, no curtain rods, nothing.
- 9:16Gemma Bentley, Advocate: When I left, I left it all.
- 9:19Gemma Bentley, Advocate: Everything, furniture and all.
- 9:21Gemma Bentley, Advocate: All I took was what I wanted to put in my home.
- 9:24Gemma Bentley, Advocate: And I had plenty because I I had a lot.
- 9:26Gemma Bentley, Advocate: I'm a collector from antiques and stuff.
- 9:29Gemma Bentley, Advocate: But he was going through my stuff and taking it.
- 9:32Gemma Bentley, Advocate: So I said, Well, what am I supposed to do?
- 9:34Gemma Bentley, Advocate: And he says, Well, just take this down to the sheriff's office.
- 9:37Gemma Bentley, Advocate: He said, and turn yourself in.
- 9:39Gemma Bentley, Advocate: So I did.
- 9:41Gemma Bentley, Advocate: I go down there to Mickey Stein's was sheriff at this time.
- 9:45Gemma Bentley, Advocate: So I go down there and I turn it in.
- 9:47Gemma Bentley, Advocate: I turn myself in.
- 9:48Gemma Bentley, Advocate: I mean, I'm not arrested.
- 9:49Gemma Bentley, Advocate: I just had more or less, I just go down there and say, hey, here I am.
- 9:53Gemma Bentley, Advocate: I've been served this warrant, blah, blah, blah.
- 9:57Gemma Bentley, Advocate: Okay.
- 9:57Gemma Bentley, Advocate: So I go to court, go to court, go to court, go to court, go to court.
- 10:00Gemma Bentley, Advocate: And okay, Kevin had to recruise himself recuse himself from my case.
- 10:05Gemma Bentley, Advocate: So that's another one I'd like to talk about.
- 10:08Gemma Bentley, Advocate: Judge Crater from Knott County.
- 10:11Gemma Bentley, Advocate: Big buddies with Kevin.
- 10:14Gemma Bentley, Advocate: He would come over once a month and take care of cases that Kevin could not.
- 10:19Gemma Bentley, Advocate: So he was the judge.
- 10:25Gemma Bentley, Advocate: So when there's when he is setting me a jury trial, I was facing time, not probation.
- 10:32Gemma Bentley, Advocate: So when he's setting me this jury trial, I have no attorney with me because I've not done anything wrong.
- 10:39Gemma Bentley, Advocate: I looked at him and I said, Your Honor, I said, can you explain to me why this is a criminal warrant against me when it should be a civil matter?
- 10:49Gemma Bentley, Advocate: He looked up from that little desk and he said, I suggest if you're speaking to me, you speak to me through your attorney.
- 10:56Gemma Bentley, Advocate: I looked on both sides of me and I just crossed my arms and waited.
- 11:00Gemma Bentley, Advocate: When they handed me my piece of paper, I go to Jamie Hatton's office and I said, Can I get a warrant for Greg?
- 11:07Gemma Bentley, Advocate: And he said, Oh no, that'd be a civil matter.
- 11:10Gemma Bentley, Advocate: I said, Well, Jamie, I said, explain this to me.
- 11:13Gemma Bentley, Advocate: Why is it a criminal warrant against me, but a civil matter against Greg?
- 11:20Gemma Bentley, Advocate: And he says, Well, because you stole it.
- 11:22Gemma Bentley, Advocate: I said, Whoa, you done got me convicted, Jamie.
- 11:26Gemma Bentley, Advocate: That's what he said.
- 11:30Gemma Bentley, Advocate: I started to leave.
- 11:32Gemma Bentley, Advocate: And I said, No, you're not.
- 11:33Gemma Bentley, Advocate: Turned around.
- 11:35Gemma Bentley, Advocate: I walked one step closer to him and I looked at him and I said, You go ahead and take me to trial, Jamie.
- 11:40Gemma Bentley, Advocate: I'll have the bars association down here so fast as it'll make your head spin.
- 11:44Gemma Bentley, Advocate: I turned around and I walked out of his office.
- 11:47Gemma Bentley, Advocate: On the date that this judge had set me for a jury trial, I didn't make it up the courthouse steps.
- 11:54Gemma Bentley, Advocate: The clerk had met was had bet me outside and told me that my case had been dismissed and thrown out.
- 12:04Gemma Bentley, Advocate: I said, Well, that's fine.
- 12:05Gemma Bentley, Advocate: I said, I want my paperwork.
- 12:06Gemma Bentley, Advocate: I said, I want it uh expunged from my records.
- 12:10Gemma Bentley, Advocate: She said, Well, it'll take you 62 or 63 days, whatever.
- 12:14Gemma Bentley, Advocate: I said, Well, I don't care how long it takes.
- 12:16Gemma Bentley, Advocate: But I want it expunged.
- 12:19Gemma Bentley, Advocate: So I went upstairs and I sent that to be in front of Judge Mullen's to have to expunge it.
- 12:28Gemma Bentley, Advocate: Bless his little heart.
- 12:30Gemma Bentley, Advocate: So I did not make only the judge back down, I also made Jamie Hatton's office back down.
- 12:37Gemma Bentley, Advocate: Because they know I was in the right.
- 12:39Gemma Bentley, Advocate: Now let me explain to the public.
- 12:42Gemma Bentley, Advocate: Anytime you live in a domestic relationship, there is never any criminal case whatsoever.
- 12:50Gemma Bentley, Advocate: If you cannot decide on who gets what, in the separation, divorce, whatever, they're supposed to bring in a mediator who determines who gets what.
- 13:05Gemma Bentley, Advocate: Never a criminal case.
- 13:06Gemma Bentley, Advocate: Do not let these people do this to you.
- 13:08Gemma Bentley, Advocate: So now that I've got that out of my system, sorry.
- 13:13Gemma Bentley, Advocate: Okay.
- 13:14Gemma Bentley, Advocate: So yeah, that that that ate him.
- 13:18Gemma Bentley, Advocate: So anytime that I had anything that went in front of the judge, he was against me.
- 13:26Gemma Bentley, Advocate: So me and Jamie Hatton's had it out several times.
- 13:31Gemma Bentley, Advocate: Me and Matt Butler, we've had it out twice.
- 13:34Gemma Bentley, Advocate: Once because he was on an opposite divorce of mine.
- 13:38Gemma Bentley, Advocate: Second is when I was robbed uh three years ago, two years ago, somewhere between two and three.
- 13:48Gemma Bentley, Advocate: Okay.
- 13:48Gemma Bentley, Advocate: I have all my documentation.
- 13:50Gemma Bentley, Advocate: I have videos.
- 13:52Gemma Bentley, Advocate: I have voice messages that actually this kid literally admits that if you want your money back, so he's admitted to me in all of these my videos, because I have 10 cameras on my property of him stealing from me, robbing me blind.
- 14:12Gemma Bentley, Advocate: Okay.
- 14:13Gemma Bentley, Advocate: So I get a warrant for this boy.
- 14:18Gemma Bentley, Advocate: Jamie Hatton writes it up.
- 14:21Gemma Bentley, Advocate: Let's back up to Jamie Hatton before we go on to Matt Butler's bullshit.
- 14:25Gemma Bentley, Advocate: Sorry.
- 14:26Gemma Bentley, Advocate: Anyway.
- 14:28Gemma Bentley, Advocate: So I go to Jamie Hatton.
- 14:32Gemma Bentley, Advocate: He writes up the warrant.
- 14:34Gemma Bentley, Advocate: I go over and talk to Mickey Steines.
- 14:36Gemma Bentley, Advocate: I even help Mickey Steines find the boy.
- 14:40Gemma Bentley, Advocate: Because people are looking for him and telling me where he was at.
- 14:44Gemma Bentley, Advocate: So they do find him.
- 14:47Gemma Bentley, Advocate: It takes a little while, but they do find him.
- 14:50Gemma Bentley, Advocate: And what does the judge do?
- 14:54Gemma Bentley, Advocate: He puts him in rehab for 120 days.
- 14:56Gemma Bentley, Advocate: That's fine.
- 14:58Gemma Bentley, Advocate: He needed it.
- 14:59Gemma Bentley, Advocate: He was on meth.
- 15:00Gemma Bentley, Advocate: So he uh puts him in rehab, and then when rehab is over, then they take my case to the court.
- 15:10Gemma Bentley, Advocate: So I go in.
- 15:12Gemma Bentley, Advocate: And I'm standing in the hallway waiting for my for me to go into the courtroom over this.
- 15:20Gemma Bentley, Advocate: Our new judge is one of the greatest people you'll ever know.
- 15:25Gemma Bentley, Advocate: Nick Whitaker is one of the greatest people you'll ever know.
- 15:28Gemma Bentley, Advocate: He has morals.
- 15:30Gemma Bentley, Advocate: He is true.
- 15:31Gemma Bentley, Advocate: He's a good person.
- 15:32Gemma Bentley, Advocate: He's he's not corrupt and he's not a criminal.
- 15:36Gemma Bentley, Advocate: All right, so I'm standing in the hallway and he motions for me to come down to the end of the hallway.
- 15:42Gemma Bentley, Advocate: And I'm thinking, okay.
- 15:44Gemma Bentley, Advocate: So I go down there.
- 15:45Gemma Bentley, Advocate: Now he works side by side at this time with Jamie Hatton.
- 15:51Gemma Bentley, Advocate: And in the Commonwealth Attorney's Office filling in while the person that was over at Banks was, I think, is his name.
- 16:02Gemma Bentley, Advocate: But anyways, yeah, Edison Banks.
- 16:04Gemma Bentley, Advocate: Okay, he was very sick.
- 16:05Gemma Bentley, Advocate: So, you know, he motions for me to come down there and I said, Hey, how you doing, Nick?
- 16:09Gemma Bentley, Advocate: And he says, Jimmy, he said, tell me what this is going on, what this case is about.
- 16:13Gemma Bentley, Advocate: And I told him, I told him everything I had.
- 16:16Gemma Bentley, Advocate: I said, I've got videos, I've got voice messages, I've got text messages, everything.
- 16:21Gemma Bentley, Advocate: I said, even other people telling uh sending me videos that I don't even know of him trying to sell the motorcycle that he stole off my property.
- 16:30Gemma Bentley, Advocate: My brother's Harley Davidson.
- 16:31Gemma Bentley, Advocate: So he says, well, he says, I'm gonna give you a little piece of advice.
- 16:36Gemma Bentley, Advocate: Do not let Jamie Hatton's office handle this.
- 16:40Gemma Bentley, Advocate: I'm like, okay.
- 16:44Gemma Bentley, Advocate: Okay, if you understand by the look on my face, is like he works side by side with him.
- 16:51Gemma Bentley, Advocate: And he's telling me not to let Jamie Hatton handle this case.
- 16:57Gemma Bentley, Advocate: Okay.
- 16:59Gemma Bentley, Advocate: So I said, all right.
- 17:01Gemma Bentley, Advocate: He said, what you need to do is he said, when you go in there, he said, you tell them that you would like to have a special prosecutor brought in.
- 17:10Gemma Bentley, Advocate: Ask them to recuse themselves.
- 17:12Gemma Bentley, Advocate: I said, okay.
- 17:13Gemma Bentley, Advocate: All right.
- 17:13Gemma Bentley, Advocate: Now I walk in here, into the courtroom, it's my turn, okay?
- 17:19Gemma Bentley, Advocate: The polychick that works in uh Jamie Hatton's office, Jamie Hatton himself, neither one of them would even come and talk to me because they're supposed to talk to you.
- 17:28Gemma Bentley, Advocate: No, they send me the child support prosecutor out into the hallway to discuss my case.
- 17:36Gemma Bentley, Advocate: She tells me who she is.
- 17:37Gemma Bentley, Advocate: I said, I know who you are.
- 17:39Gemma Bentley, Advocate: And uh she says, Well, tell me about this.
- 17:43Gemma Bentley, Advocate: And I said, told her, I said, uh, well, I was robbed.
- 17:46Gemma Bentley, Advocate: Anthony Barrett robbed me.
- 17:48Gemma Bentley, Advocate: I said, I have videos, and I have she said, Well, do you have me proof?
- 17:51Gemma Bentley, Advocate: I said, look there, and I said, I sure do.
- 17:54Gemma Bentley, Advocate: I said, I have videos and text messages and voice messages, have them admitting to it.
- 18:00Gemma Bentley, Advocate: And she said, and I said, Well, let me stop you right there.
- 18:04Gemma Bentley, Advocate: I said, Jenny Hatton's a piece of shit.
- 18:08Gemma Bentley, Advocate: I do not want him handling my case.
- 18:10Gemma Bentley, Advocate: She says, Well, well, that's my boss.
- 18:13Gemma Bentley, Advocate: I said, Well, honey, and your boss is a piece of shit.
- 18:15Gemma Bentley, Advocate: And I mean, I told her this.
- 18:16Gemma Bentley, Advocate: I'm sorry for my language, people, but that's what I told her.
- 18:19Gemma Bentley, Advocate: I said, and I do not want his office or you to handle my case.
- 18:24Gemma Bentley, Advocate: She looks at me real funny and she says, So you're asking us to recuse ourselves and bring in a special prosecutor?
- 18:31Gemma Bentley, Advocate: I said, That's exactly what I'm asking for.
- 18:34Gemma Bentley, Advocate: So she stopped talking to me about it.
- 18:38Gemma Bentley, Advocate: We walked back in.
- 18:39Gemma Bentley, Advocate: The judge, my turn again, and I had to bite my tongue because Judge Mullins looks at me and he says, So you're wanting a special prosecutor.
- 18:50Gemma Bentley, Advocate: I said, I sure do, and I had to bite my tongue so hard because I started to say, and I would like to have you excuse yourself too, because you ain't nothing but I did, and I had to bite my tongue.
- 19:00Gemma Bentley, Advocate: So I left it there.
- 19:02Gemma Bentley, Advocate: So they did.
- 19:03Gemma Bentley, Advocate: They brought me in a prosecutor from Pikeville.
- 19:05Gemma Bentley, Advocate: All right, when I told this prosecutor what was going on the first time, he says, Can you send me all that?
- 19:13Gemma Bentley, Advocate: And gave me his email.
- 19:14Gemma Bentley, Advocate: I said, Sure can.
- 19:15Gemma Bentley, Advocate: I sent it all to him.
- 19:17Gemma Bentley, Advocate: We go back to court and he hasn't had time to go through it.
- 19:20Gemma Bentley, Advocate: He asks us for another court date.
- 19:22Gemma Bentley, Advocate: And then he informs me that on the third time we come back to court that he is going to drop this case.
- 19:32Gemma Bentley, Advocate: And I'm looking at him like, what?
- 19:34Gemma Bentley, Advocate: He said, Here, let me explain to you.
- 19:37Gemma Bentley, Advocate: He says, Your case is not a misdemeanor, it is a felony.
- 19:44Gemma Bentley, Advocate: So you need to have this as a felony.
- 19:48Gemma Bentley, Advocate: A felony.
- 19:52Gemma Bentley, Advocate: I said, okay.
- 19:53Gemma Bentley, Advocate: So he says, I'm going to drop it and the state's gonna pick it up.
- 19:55Gemma Bentley, Advocate: Well, I didn't think about the state being uh the new prosecuting attorney, which is uh now Matt Butler, just being uh sworn in.
- 20:06Gemma Bentley, Advocate: Hang on just a second.
- 20:08Gemma Bentley, Advocate: Cheyenne, please go and see who's outside.
- 20:10Gemma Bentley, Advocate: Someone's out there in my driveway.
- 20:14Gemma Bentley, Advocate: So, anyways, so he explained it to me and he came in and he told the judge, he says, I'm dropping this.
- 20:21Gemma Bentley, Advocate: We're going to send this to the state.
- 20:24Gemma Bentley, Advocate: He said, I've sent them everything.
- 20:26Gemma Bentley, Advocate: Okay, so there comes Matt Butler.
- 20:28Gemma Bentley, Advocate: So I assumed that it would be, who is it?
- 20:34Gemma Bentley, Advocate: Okay.
- 20:36Gemma Bentley, Advocate: So I assumed it would be the state, but I didn't know it would be the Commonwealth attorney and being Matt Butler.
- 20:45Gemma Bentley, Advocate: So they contact me to set up a uh grand jury.
- 20:53Gemma Bentley, Advocate: Okay, they wanted me to go in front of a grand jury.
- 20:56Gemma Bentley, Advocate: So I went into the grand jury, Matt Butler comes in, and all these people's in this room, and I brought my witnesses.
- 21:03Gemma Bentley, Advocate: So I he starts, he tells me, um, starts telling me what to do.
- 21:10Gemma Bentley, Advocate: He said, we're gonna be asking you some questions.
- 21:12Gemma Bentley, Advocate: We're gonna let you tell uh them what you've got, blah, blah, blah, about the case, he said, and everything.
- 21:17Gemma Bentley, Advocate: And I looked at him and I said, Before we start, uh, Matt, I said, I'd like to know if uh the divorces between us is going to cause an issue.
- 21:27Gemma Bentley, Advocate: He said, Well, we never married.
- 21:29Gemma Bentley, Advocate: I'm like, No, we sure weren't.
- 21:33Gemma Bentley, Advocate: I said, but we were on opposite sides of two divorces, my son's and mine.
- 21:37Gemma Bentley, Advocate: I'm asking you now if this is going to become an issue.
- 21:41Gemma Bentley, Advocate: I'm the Commonwealth attorney.
- 21:44Gemma Bentley, Advocate: I said, okay.
- 21:46Gemma Bentley, Advocate: So they asked me a few questions and I tell them my story and I tell them what I have, and they should already have this by now.
- 21:54Gemma Bentley, Advocate: Matt Butler had that by now because it had been sent to him.
- 21:57Gemma Bentley, Advocate: So um I get done, and I said, Well, I do have witnesses also, because you know they're supposed to speak to the witnesses also.
- 22:07Gemma Bentley, Advocate: Oh, they didn't need to speak to nobody else.
- 22:09Gemma Bentley, Advocate: They just wanted to speak to me and let me, then they let that go real fast.
- 22:13Gemma Bentley, Advocate: And they says, Well, you call our office in the morning and we'll give you uh your an answer to if we're going to take this to trial.
- 22:21Gemma Bentley, Advocate: Well, I said, Okay.
- 22:22Gemma Bentley, Advocate: I didn't call the office the next morning.
- 22:25Gemma Bentley, Advocate: The office called me, the secretaries, who were very distraught.
- 22:29Gemma Bentley, Advocate: The secretaries.
- 22:31Gemma Bentley, Advocate: Very distraught.
- 22:32Gemma Bentley, Advocate: They were upset because they could not understand why, with all of my proof, that the grand jury decided to take not to take this case to trial on this boy.
- 22:43Gemma Bentley, Advocate: So there's my issue with Matt Butler, one of them.
- 22:51Gemma Bentley, Advocate: Um Jamie Hatton.
- 22:56Gemma Bentley, Advocate: Evidently he's he's stepping down.
- 23:00Gemma Bentley, Advocate: It could be because uh I won't shut up about him.
- 23:03Gemma Bentley, Advocate: Because not once has he done me wrong, knowing me.
- 23:08Gemma Bentley, Advocate: But he wrote up some kind of paperwork against my ex-brother-in-law for touching my 14-year-old daughter as sex trafficking.
- 23:21Gemma Bentley, Advocate: Okay, that's not what the what it was supposed to be wrote up.
- 23:24Gemma Bentley, Advocate: And I asked him when they handed me that piece of paper, and I said, Why is it wrote up as sex trafficking?
- 23:28Gemma Bentley, Advocate: He didn't traffic her.
- 23:30Gemma Bentley, Advocate: He offered her $50 to s to have sex with him, and he offered her $50 more to keep her mouth shut.
- 23:37Gemma Bentley, Advocate: He has touched my daughter.
- 23:39Gemma Bentley, Advocate: I said, I have had, I thought I was going to put my daughter in a mental institution or somewhere because I couldn't handle her anymore.
- 23:45Gemma Bentley, Advocate: Couldn't understand why, because she wasn't telling me nothing.
- 23:48Gemma Bentley, Advocate: But she told my bro, my my oldest son's ex-wife.
- 23:55Gemma Bentley, Advocate: And then she told his new wife that now he's divorced.
- 24:00Gemma Bentley, Advocate: But anyways, and then she told him what happened.
- 24:04Gemma Bentley, Advocate: And then he told me about it.
- 24:07Gemma Bentley, Advocate: And then I couldn't understand why my daughter was acting up and getting in trouble at school and all this stuff, but he wrote it up as sex trafficking, therefore I had to take my daughter to hazard to be in to have an interview with all the cameras on every angle of her body while they questioned her.
- 24:22Gemma Bentley, Advocate: And then I heard nothing.
- 24:24Gemma Bentley, Advocate: Months and months went by and months.
- 24:28Gemma Bentley, Advocate: Well, I started asking questions.
- 24:30Gemma Bentley, Advocate: I went down and asked Jamie.
- 24:31Gemma Bentley, Advocate: He said, It's out of my hands, you need to speak to blah blah blah.
- 24:34Gemma Bentley, Advocate: So, okay.
- 24:35Gemma Bentley, Advocate: I asked the state.
- 24:37Gemma Bentley, Advocate: Policeman.
- 24:39Gemma Bentley, Advocate: Uh, don't know.
- 24:41Gemma Bentley, Advocate: So I go to the cabinet for children's services, who came to interview my daughter the next day after I filed the complaint.
- 24:50Gemma Bentley, Advocate: And he goes back in there and he comes back and he says, Well, Gemma, he says, to be really honest, he says, I don't have to tell you anything.
- 25:02Gemma Bentley, Advocate: And I'm like, Well, why not?
- 25:03Gemma Bentley, Advocate: He said, Well, because you're not the victim.
- 25:05Gemma Bentley, Advocate: I said, No, I'm the victim's mother and she is underage.
- 25:10Voices for Voices, Justin Alan Hayes: Yeah.
- 25:11Gemma Bentley, Advocate: And he looked at me and he says, Yeah, but she she has no rights to know, neither.
- 25:15Gemma Bentley, Advocate: Excuse me.
- 25:16Gemma Bentley, Advocate: He said, But hang on, Jim.
- 25:19Gemma Bentley, Advocate: And they all know me because I when I worked for the Ready to Work program, I worked in the cabinet with my boss with all the students because I was her assistant on the Whitesburgs campus.
- 25:29Gemma Bentley, Advocate: So, you know, I was hand all of it.
- 25:31Gemma Bentley, Advocate: All right.
- 25:32Gemma Bentley, Advocate: He said, but I'm going to tell you, anyways, the reason that nothing has come and you've not heard anything is because they dropped the case because there was no evidence for sex trafficking.
- 25:45Gemma Bentley, Advocate: So no, Jamie Hatton has um stepped across that line just one time, one time too many, as far as my me, because now the last time is when I was had filed for a warrant because my ex had throwed gravels five months after we were divorced into my truck because it came down here and brought his trash and throw it in my yard.
- 26:11Gemma Bentley, Advocate: And I took it back up there and throwed it in his yard on the hill because I didn't get on his property, he did.
- 26:16Gemma Bentley, Advocate: So I go and get a warrant for him because he busted my windshield.
- 26:18Gemma Bentley, Advocate: What does Jamie do?
- 26:20Gemma Bentley, Advocate: Oh, they arrested him and then he turns around and goes straight to Jamie's office, and they give him an EPO against me.
- 26:28Gemma Bentley, Advocate: Okay.
- 26:29Gemma Bentley, Advocate: That's fine.
- 26:32Gemma Bentley, Advocate: Because when I asked the judge uh why he is issuing this, why he is going to go for this when I had nothing to do with this, I would wasn't bothering him.
- 26:41Gemma Bentley, Advocate: He was on my property uh and everything, he said, um, well, he said, you can put it in writing and we'll discuss it uh if we're going to um it uh about it.
- 26:53Gemma Bentley, Advocate: And I said, you know what, don't worry about it, Judge.
- 26:56Gemma Bentley, Advocate: This was Kevin.
- 26:57Gemma Bentley, Advocate: I said, don't worry about it, Kevin.
- 26:59Gemma Bentley, Advocate: I said, you go ahead and issue that EPO.
- 27:01Gemma Bentley, Advocate: I said, if that makes sure that he is not around me or my children.
- 27:05Gemma Bentley, Advocate: And so um, sorry, I messed with my phone.
- 27:10Gemma Bentley, Advocate: So needless to say, the ex got out of jail, and because the little fella over there at the uh DMB office did not take a picture of the judge's signature on the divorce decree for me to ask for my name back when I went and changed my driver's license because I was waiting for that because I did not want to have his name on my next checking account.
- 27:36Gemma Bentley, Advocate: So because I had not changed it, he walked over to the bank out of the jail and emptied my bank account and closed my bank.
- 27:47Gemma Bentley, Advocate: And then he goes down and gets the EPO against me.
- 27:50Gemma Bentley, Advocate: But when I walk back down there to Jamie's office, and I said, Is this really how it's gonna go?
- 27:58Gemma Bentley, Advocate: Jamie, I said, uh, I get a warrant for him doing the things that he's done.
- 28:01Gemma Bentley, Advocate: I said, and you going to issue him an EPO and him go down there and take every dime I've got out of my bank account and close it?
- 28:08Gemma Bentley, Advocate: He looked at me and he said, Get the hell out of my office and don't ever come back.
- 28:12Gemma Bentley, Advocate: Ding.
- 28:13Gemma Bentley, Advocate: I have not been able to go back and I've not gotten any kind of support or help from Whitesburg.
- 28:21Gemma Bentley, Advocate: And I'm sorry, but isn't an accounty official supposed to help people?
- 28:28Gemma Bentley, Advocate: So yeah, but evidently Jamie Hatton must be stepping down because Michael Watts is running for it, and that's his buddy, that's his partner.
- 28:40Gemma Bentley, Advocate: And Jamie and Michael, uh Michael Watts is a wonderful young man.
- 28:46Gemma Bentley, Advocate: Bless his little heart, he hooked up with the wrong person.
- 28:48Gemma Bentley, Advocate: That's all I can say, but I hope he gets it.
- 28:52Gemma Bentley, Advocate: I know him well, but I don't know, I have not seen anything about Jamie running again.
- 29:02Voices for Voices, Justin Alan Hayes: So how um so it's giving you the motivation to continue on with so many hurdles that you've come across to to continue on, because uh somebody might say, Oh, like I don't know how I would have gone past the the first event, and yeah, there's 10 or 15 different events or more that you had to work yourself through.
- 29:34Gemma Bentley, Advocate: That's exactly right, right there.
- 29:36Gemma Bentley, Advocate: All because I turned the judge down.
- 29:39Gemma Bentley, Advocate: And okay, when I was working up at the courthouse, Jamie came up there and made a remark about well, how do I get free help?
- 29:47Gemma Bentley, Advocate: So, blah, blah, blah.
- 29:50Gemma Bentley, Advocate: And I said, Well, I'll come down and help you.
- 29:52Gemma Bentley, Advocate: Well, I went down there one day and I helped them just to get out of the courthouse.
- 29:58Gemma Bentley, Advocate: And very rude.
- 29:59Gemma Bentley, Advocate: Snotty.
- 30:01Gemma Bentley, Advocate: He treated me like I was trash.
- 30:04Gemma Bentley, Advocate: And I didn't go back.
- 30:06Gemma Bentley, Advocate: So I guess because he didn't get to keep my three health, that he didn't care for me.
- 30:14Gemma Bentley, Advocate: Now let's see.
- 30:20Gemma Bentley, Advocate: What did I have on my mind to say just now?
- 30:23Gemma Bentley, Advocate: Daniel Dotson.
- 30:28Gemma Bentley, Advocate: In my divorce, he was the divorce lawyer.
- 30:32Gemma Bentley, Advocate: He was the divorce judge.
- 30:34Gemma Bentley, Advocate: Hey.
- 30:36Gemma Bentley, Advocate: Um, the man that I divorced was divorcing, owes me a lot of money because he filed for his disability.
- 30:45Gemma Bentley, Advocate: The disability asked him when they done his interview, who is paying your bills?
- 30:51Gemma Bentley, Advocate: He told them, my girlfriend.
- 30:53Gemma Bentley, Advocate: At the time we were good, that was just his girlfriend, Gemma Bentley.
- 30:56Gemma Bentley, Advocate: And what then they said, well, what is her name?
- 30:58Gemma Bentley, Advocate: And they said he sold her to Gemma Bentley.
- 31:00Gemma Bentley, Advocate: He says, uh, then they asked him, Well, how do you intend to pay her back?
- 31:04Gemma Bentley, Advocate: He said, When I get my back pay.
- 31:06Gemma Bentley, Advocate: So during the divorce, I brought that up.
- 31:10Gemma Bentley, Advocate: You know what the judge said?
- 31:12Gemma Bentley, Advocate: Daniel Dotson.
- 31:14Gemma Bentley, Advocate: He said, You can forget that.
- 31:16Gemma Bentley, Advocate: He says, I've had to pay out my butt over these women.
- 31:18Gemma Bentley, Advocate: He said, So, nope.
- 31:20Gemma Bentley, Advocate: And I'm like, first of all, you can't tell me that.
- 31:25Gemma Bentley, Advocate: This is not between you and the Social Security.
- 31:29Gemma Bentley, Advocate: So yeah, it's a bunch of crap.
- 31:34Gemma Bentley, Advocate: Um I'm different.
- 31:38Gemma Bentley, Advocate: Okay.
- 31:38Gemma Bentley, Advocate: Let me explain to you one more about this.
- 31:41Gemma Bentley, Advocate: Okay.
- 31:42Gemma Bentley, Advocate: I know you talked to Taya and these other ladies, and a couple of Brandy and whomever.
- 31:46Gemma Bentley, Advocate: Okay, I'm not on the same side of this as they are.
- 31:50Gemma Bentley, Advocate: I wasn't in trouble.
- 31:52Gemma Bentley, Advocate: I have a bachelor's degree in criminal justice.
- 31:57Gemma Bentley, Advocate: I've raised my children.
- 31:59Gemma Bentley, Advocate: I did not have a drug problem.
- 32:01Gemma Bentley, Advocate: I turned him down.
- 32:04Gemma Bentley, Advocate: And then there is where it comes into how does he get me?
- 32:09Gemma Bentley, Advocate: He retaliates against me.
- 32:11Gemma Bentley, Advocate: When anything came against uh came in his courtroom, he went against me.
- 32:16Gemma Bentley, Advocate: Now they knew better.
- 32:18Gemma Bentley, Advocate: They have a better degree than me.
- 32:21Gemma Bentley, Advocate: They're judges, they're lawyers.
- 32:23Gemma Bentley, Advocate: I just have a criminal justice bachelor's degree.
- 32:26Gemma Bentley, Advocate: They knew better than to write that criminal warrant against me.
- 32:30Gemma Bentley, Advocate: They knew it was a civil matter.
- 32:32Gemma Bentley, Advocate: But they thought that evidently I just went to school to look pretty.
- 32:39Gemma Bentley, Advocate: No, if I sat there and learned, and then I got a job with EKU.
- 32:47Gemma Bentley, Advocate: Up on up on time for me to graduate, the main man of the program that brought the program to the community colleges sent me a private message and asked me to if I would like to have a job, which I told him the first day of class that I was gonna work for him one day.
- 33:02Voices for Voices, Justin Alan Hayes: Yeah.
- 33:03Voices for Voices, Justin Alan Hayes: So I mean you're you're definitely you're definitely an inspiration to uh continue on to be the be a beacon of uh of light that uh well one day or one situation may not turn out exactly right, but when you stand up for your yourself the way you have, and again look that whole looking in the mirror and say, you know, I'm uh happy with what I'm doing, how I'm approaching things, and at the end of the day, that's that's all that matters because if we can't support ourselves, not even not even financially, but just emotionally and all that, then we're gonna it it's gonna be hard for others to to believe us and and to really feel that feel that pressure and that heat that like look I'm I'm not messing around.
- 34:12Voices for Voices, Justin Alan Hayes: We need to get this handled and and as many times as it it's it's taken uh that you didn't graduate, which is fantastic.
- 34:23Voices for Voices, Justin Alan Hayes: Congratulations, it's not an easy feat at any age to do that.
- 34:30Voices for Voices, Justin Alan Hayes: Uh what would be your um as we're coming close to the end of our time uh together uh on our show, uh what would be maybe a couple takeaways that you'd want to share if somebody is in in a position like you or find someone they know in a position of what do what do they do?
- 34:57Voices for Voices, Justin Alan Hayes: What do they do first?
- 34:59Voices for Voices, Justin Alan Hayes: Or uh you can probably articulate it better than I can.
- 35:05Gemma Bentley, Advocate: Well, here's my here's my thoughts on it.
- 35:07Gemma Bentley, Advocate: Okay, here's my advice.
- 35:08Gemma Bentley, Advocate: Girls, never let no one take you down, never put you down.
- 35:15Gemma Bentley, Advocate: You are above that.
- 35:17Gemma Bentley, Advocate: You are a female.
- 35:20Gemma Bentley, Advocate: You can stand up for these people, you can stand up for yourselves.
- 35:24Gemma Bentley, Advocate: You have children.
- 35:25Gemma Bentley, Advocate: Don't ever, ever, ever fall for this again.
- 35:30Gemma Bentley, Advocate: Because if it happens, there is always above that you can go and bring those people down.
- 35:35Gemma Bentley, Advocate: These men are predators in this courtroom, in this courthouse, in this county.
- 35:41Gemma Bentley, Advocate: Not only this county, it it goes in in different counties, other counties, other states.
- 35:47Gemma Bentley, Advocate: Girls, you have daughters, don't let it happen to them.
- 35:52Gemma Bentley, Advocate: Make sure they they respect themselves, that they love themselves, because I have an 18-year-old daughter who was fondled and that brought her down.
- 36:06Gemma Bentley, Advocate: And I fought for her, and it didn't do no good.
- 36:10Gemma Bentley, Advocate: Why?
- 36:11Gemma Bentley, Advocate: Because there is uh there's a sister who works for City Hall.
- 36:15Gemma Bentley, Advocate: That's why nothing ever happens to these guys in Whitesburg.
- 36:21Gemma Bentley, Advocate: So you know it's all connected.
- 36:22Gemma Bentley, Advocate: But girls stand up for yourself, respect yourself, love yourself.
- 36:28Gemma Bentley, Advocate: Learn the laws.
- 36:31Gemma Bentley, Advocate: Look them up.
- 36:33Gemma Bentley, Advocate: They're not hard, go to libraries.
- 36:36Gemma Bentley, Advocate: If you can't find anything else, go to libraries, get you a law book, go to cook, go to school, learn these laws because I've always been one to stand up for myself.
- 36:49Gemma Bentley, Advocate: I'm tired.
- 36:50Gemma Bentley, Advocate: I've worked hard since I was a little girl.
- 36:53Gemma Bentley, Advocate: And I've been through hell since I've been since I was a little girl.
- 36:58Gemma Bentley, Advocate: I went through this.
- 36:59Gemma Bentley, Advocate: And I'm just not gonna let nobody else, and I'm not gonna let my daughter go down that hole.
- 37:05Gemma Bentley, Advocate: And if you're on drugs, girls, help.
- 37:11Gemma Bentley, Advocate: Get away from it.
- 37:13Gemma Bentley, Advocate: You're more important than that, so are your children.
- 37:16Gemma Bentley, Advocate: That drugs aren't your friends, and they don't love you.
- 37:21Voices for Voices, Justin Alan Hayes: And they never will.
- 37:22Voices for Voices, Justin Alan Hayes: Wow.
- 37:24Voices for Voices, Justin Alan Hayes: Thank you so much.
- 37:26Voices for Voices, Justin Alan Hayes: That was so powerful.
- 37:28Voices for Voices, Justin Alan Hayes: That that that closing.
- 37:30Voices for Voices, Justin Alan Hayes: Uh yeah, value yourself and uh again, like you're being today, and as you have done many times, you're you're being a voice for you, and then the others that are out there that you may or may not ever meet, but you know that you're setting that example, and I I can assure you that there's gonna be at least one person that watches uh uh and listens to this episode um because we're so widely distributed, uh, not just here in the the states, but uh across the world.
- 38:11Voices for Voices, Justin Alan Hayes: And I I know that by you speaking out, it is uh not easy to do.
- 38:20Voices for Voices, Justin Alan Hayes: Uh but we're here on this earth and uh you're deciding to not only help yourself, but you want to help others and and clean up the corruption and uh what's what's going on as much as possible.
- 38:36Voices for Voices, Justin Alan Hayes: Um Gemma, thank you so much for for your time and joining us on on the show today.
- 38:44Gemma Bentley, Advocate: I appreciate you inviting me.
- 38:46Gemma Bentley, Advocate: I um I'm glad that I could get this out to the other women, to the other people, to the people that are going through this today in other counties, other states.
- 38:58Gemma Bentley, Advocate: But I got one more last thing to say.
- 39:01Voices for Voices, Justin Alan Hayes: Please do.
- 39:02Gemma Bentley, Advocate: They call this corruption.
- 39:04Gemma Bentley, Advocate: I'm sorry, that's the wrong word.
- 39:07Gemma Bentley, Advocate: These people that are doing this to these women are criminals.
- 39:12Gemma Bentley, Advocate: They took an oath.
- 39:14Gemma Bentley, Advocate: So the word is wrong.
- 39:17Gemma Bentley, Advocate: It is not corruption, they are criminals, and they should be paying.
- 39:24Voices for Voices, Justin Alan Hayes: I I I love it.
- 39:26Voices for Voices, Justin Alan Hayes: That is yeah, corruption is like they cannot prosecute corruption.
- 39:38Gemma Bentley, Advocate: That's what I'm getting at.
- 39:40Gemma Bentley, Advocate: Yeah, you can prosecute a criminal, and what they've done, they took an oath to uphold these laws, and they're them they themselves are breaking these laws, which makes them a criminal.
- 39:54Voices for Voices, Justin Alan Hayes: That's right.
- 39:54Voices for Voices, Justin Alan Hayes: And you can prosecute prosecute a criminal.
- 39:58Gemma Bentley, Advocate: Yes.
- 39:59Voices for Voices, Justin Alan Hayes: Absolutely.
- 40:00Gemma Bentley, Advocate: I greatly appreciate you.
- 40:02Voices for Voices, Justin Alan Hayes: Oh, thank you.
- 40:03Voices for Voices, Justin Alan Hayes: Absolutely.
- 40:04Voices for Voices, Justin Alan Hayes: We're gonna uh we'll we'll we'll talk uh off off camera uh to let you know kind of time the timing of of everything.
- 40:14Voices for Voices, Justin Alan Hayes: So we'll uh we'll close this out for our viewers, our listeners.
- 40:19Voices for Voices, Justin Alan Hayes: Thank you so much for watching and listening to this episode and all the episodes of the Voices for Voices TV show and podcast near or far in the United States, in Kentucky, in Ohio, across the world, uh watching, listening.
- 40:37Voices for Voices, Justin Alan Hayes: Uh, and we want uh give uh again just another big thank you to Gemma Bentley for spending her time and uh again just sharing her voice about how she's standing up for not only herself but for women and and individuals uh everywhere.
- 40:57Voices for Voices, Justin Alan Hayes: So we want to uh again thank thank Gemma.
- 41:00Voices for Voices, Justin Alan Hayes: Thank you for watching and listening, and we will see you on the next episode.
- 41:06Voices for Voices, Justin Alan Hayes: And we say until then, uh to please be a voice for you or somebody in need.
- 41:13Voices for Voices, Justin Alan Hayes: We'll see you next time, everybody.
- 41:15Voices for Voices, Justin Alan Hayes: Thank you so much.
