- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to pick up where we left
- 0:05Speaker 1: off with the Tyler Robbins in prelim hearing, day number two.
- 0:11Speaker 1: And we left off with Kathy Nestor asking if he
- 0:14Speaker 1: was involved with the search for the gun. And his
- 0:16Speaker 1: response was, I was not involved in the search for
- 0:19Speaker 1: the gun, no. Now Ms. Nestor picks up. Did you
- 0:23Speaker 1: notice when it was located? Answer, from the footage that
- 0:26Speaker 1: we reviewed, we identified an area that we believed could
- 0:29Speaker 1: potentially be of evidentiary value, and then it was secured.
- 0:33Speaker 1: And then I was notified that as a result of
- 0:35Speaker 1: that search, a gun had been located, yes. Question, were
- 0:39Speaker 1: you involved in processing of that gun? In other words,
- 0:42Speaker 1: boxing it, shipping it, sending it wherever it was going
- 0:45Speaker 1: to be analyzed? Answer, I was not, no. Question, okay,
- 0:49Speaker 1: thank you, all right. Now, I want to shift to
- 0:51Speaker 1: the autopsy for just a moment. You were not present
- 0:54Speaker 1: at the autopsy, is that right? Answer, I was not. Question, okay.
- 0:58Speaker 1: So anything you know about the autopsy was not from
- 1:01Speaker 1: personal observation? Answer, no. Other than from my meeting with
- 1:06Speaker 1: the medical examiner and his report, no. I was not present. Question,
- 1:11Speaker 1: did you meet with the medical examiner after he had
- 1:13Speaker 1: conducted the autopsy? Answer, I did, yes. Question, and when
- 1:17Speaker 1: you met with him, did you provide him information about
- 1:20Speaker 1: what you had learned in your investigation so far? Answer,
- 1:24Speaker 1: we didn't have any reason to provide any investigative information
- 1:27Speaker 1: to him. The purpose of the meeting was to establish
- 1:31Speaker 1: what information he could provide to us. Question, well, in fact,
- 1:35Speaker 1: on the front page of the medical examiner's report, he
- 1:38Speaker 1: talks about the investigation and the information he learned. Did
- 1:42Speaker 1: he learn that from you or did he learn it
- 1:43Speaker 1: from someone else? Answer would be my recollection that he
- 1:48Speaker 1: did not learn it from us, but I couldn't speak
- 1:50Speaker 1: to how he did learn about it. Question, okay, so
- 1:54Speaker 1: what you didn't share with him Your conclusion about what
- 1:57Speaker 1: happened or how Mr. Kirk was injured or anything like that? Answer,
- 2:02Speaker 1: that's my recollection. Question, okay, thank you. And also, isn't
- 2:06Speaker 1: it true that fingerprints were taken from Mr. Kirk and
- 2:09Speaker 1: autopsy photos were provided to you on a CD? Answer, yeah. Question,
- 2:14Speaker 1: was there anything else provided to you from the autopsy
- 2:16Speaker 1: other than that? Answer, other than the CD and the report? Question, yes. Answer, no,
- 2:22Speaker 1: not to me, no. Question, okay, you did not mention
- 2:26Speaker 1: to you Were you aware of anything else from the
- 2:28Speaker 1: autopsy going to anyone else? Answer. I believe standard practice
- 2:32Speaker 1: is anything evidentiary value that the medical examiner collects is
- 2:35Speaker 1: transferred through the chain of custody. Question. And are you
- 2:39Speaker 1: aware of anything that was transferred after Mr. Kirk's autopsy? Answer.
- 2:44Speaker 1: I'm aware that there were items transferred for evidence, yes. Question.
- 2:48Speaker 1: What items? Answer. I believe some fragments of a bullet casing.
- 2:51Speaker 1: I know Mr. Kirk's personal items. To be returned to
- 2:54Speaker 1: the family, and that's all I can recall off the
- 2:56Speaker 1: top of my head. Question, do you know how many
- 2:59Speaker 1: fragments from the bullets? Answer, I don't. Question, okay. Now
- 3:03Speaker 1: I'd like to talk a little bit about the ring
- 3:05Speaker 1: camera that you obtained. And you interviewed a woman named
- 3:08Speaker 1: Miss Noble, is that right? To get that camera footage
- 3:11Speaker 1: that we watched with the car on the outside. Answer,
- 3:15Speaker 1: we interviewed her to verify the authenticity of the video, yes. Question,
- 3:19Speaker 1: were you involved in that interview? Answer, with Miss Noble? Answer,
- 3:23Speaker 1: or question, mm-hmm. Answer, yes. Question, and do you recall
- 3:27Speaker 1: what they told you about what they remember seeing in
- 3:30Speaker 1: and around that car that night? Answer, I don't recall.
- 3:34Speaker 1: I just know that we were there to verify the video.
- 3:36Speaker 1: I didn't conduct an interview with Ms. Noble at that time. Question, okay,
- 3:41Speaker 1: can we please bring up poll? Sorry, just for a moment.
- 3:44Speaker 1: Let's see poll 48. This is Ms. Noble's interview. Do
- 3:47Speaker 1: you have it? All right. Do you remember that? Looking
- 3:50Speaker 1: at the interview, does that refresh your recollection? Answer, I
- 3:53Speaker 1: remember reading the report at some point, yes. Question, and
- 3:56Speaker 1: do you remember that the nobles told you that the
- 3:58Speaker 1: driver of the vehicle was bald? Answer, I do remember
- 4:02Speaker 1: that being in the report, yes. Question, and you didn't
- 4:05Speaker 1: mention that today when you were talking about the ring camera,
- 4:08Speaker 1: did you? Answer, I did not. Question, and did they
- 4:11Speaker 1: also tell you that there were three other people in
- 4:13Speaker 1: the car? Answer, yes, I believe they thought that was
- 4:16Speaker 1: the case. Question, okay. I want to go back, if
- 4:20Speaker 1: I can, to the scene itself. The preservation... of the
- 4:23Speaker 1: actual scene where Mr. Kirk passed. Did you have all
- 4:27Speaker 1: canine dogs at any point that sniffed that area? Answer,
- 4:31Speaker 1: I don't know specifically that area, but I do know
- 4:34Speaker 1: that canines were present or a canine was present on
- 4:37Speaker 1: that day. Question, but you don't know what the tasks
- 4:40Speaker 1: the canine were given? Answer, my understanding was that it
- 4:43Speaker 1: was to be used in an effort to track an
- 4:46Speaker 1: individual that jumped off the roof, but I don't know
- 4:49Speaker 1: for certain. Question, and obviously... That didn't produce any results.
- 4:53Speaker 1: Or we would have heard about it, right? Answer, yeah.
- 4:56Speaker 1: Not that I was made aware of. Question, okay. Do
- 4:59Speaker 1: you know when the tent and the stuff was actually
- 5:01Speaker 1: removed from the scene? Answer, I don't. I would imagine
- 5:05Speaker 1: it would have been at least a couple days, if
- 5:07Speaker 1: not longer than that, before anything was removed from the scene. Question,
- 5:12Speaker 1: you didn't have to give permission to remove the tent. Answer,
- 5:14Speaker 1: me personally. Question, right. Answer, no. Question, so you're not
- 5:19Speaker 1: sure when it was removed. Answer, no. Question, and were
- 5:23Speaker 1: you involved in the decision to pave over the dirt
- 5:26Speaker 1: that was under the tent? Answer, at UVU. Question, uh-huh. Answer, no. Question,
- 5:32Speaker 1: did you know that happened? Answer, only because it was
- 5:35Speaker 1: on the news. Question, all right, but you don't know
- 5:38Speaker 1: when or who ordered it? Answer, no. Question, and it's
- 5:42Speaker 1: true that during the time before Mr. Robinson turned himself in,
- 5:46Speaker 1: you all received lots and lots of tips from the public.
- 5:48Speaker 1: Is that fair? Agent Hall, correct. Question, you received tips
- 5:52Speaker 1: of death threats that Mr. Kirk had received the day
- 5:54Speaker 1: before the shooting. Is that right? Answer, I'm sorry, did
- 5:58Speaker 1: we receive threats that Mr. Kirk had received before the event?
- 6:02Speaker 1: Kathy Nestor, let me clarify. That was a confusing question.
- 6:06Speaker 1: As you were going through tips that the public was
- 6:08Speaker 1: giving you, did you receive a tip about online death
- 6:11Speaker 1: threats that had been made against Mr. Kirk prior to
- 6:14Speaker 1: his death? Answer, there was a huge variety of tips
- 6:17Speaker 1: and information and suggestions that were being provided by the public. Question,
- 6:23Speaker 1: and some of those filtered through to you, right? Answer,
- 6:26Speaker 1: some of them filtered their way down to us, but
- 6:28Speaker 1: predominantly that was being handled by our state information and
- 6:32Speaker 1: analysis center that had been set up. Question, okay, and
- 6:36Speaker 1: you also got multiple tips about potential suspects, people who
- 6:40Speaker 1: thought they recognized people in the picture, right? Answer, yes.
- 6:44Speaker 1: There were different calls and information provided by the public. Question,
- 6:49Speaker 1: and you had quite a few of those. Answer, correct. Question,
- 6:51Speaker 1: and then Mr. Robinson turned himself in, right? Answer, yes. Question,
- 6:56Speaker 1: and is it your understanding that the individual they used
- 6:59Speaker 1: to facilitate Mr. Robinson turning himself in was someone known
- 7:02Speaker 1: to Mr. Robinson personally that had been connected to law enforcement? Answer,
- 7:08Speaker 1: I know he was known to the family. I don't
- 7:09Speaker 1: know his connection specifically with Mr. Robinson. But I'm aware
- 7:13Speaker 1: that someone was used to facilitate Mr. Robinson turning himself in. Question.
- 7:18Speaker 1: And were you aware that he was one of his
- 7:19Speaker 1: Boy Scout leaders? Did you know that? Answer. I think
- 7:22Speaker 1: I heard that at some point. There was a connection.
- 7:25Speaker 1: I don't recall specifically what it was. Question. And Mr. Robinson,
- 7:29Speaker 1: in fact, no police went to go arrest him. He
- 7:32Speaker 1: drove himself or was driven with his parents to the
- 7:35Speaker 1: Washington County Sheriff's Department, correct? Answer. That's my understanding, yes. Question.
- 7:41Speaker 1: And he voluntarily walked in? Answer, that's my understanding, yes. Question,
- 7:46Speaker 1: and that was the first moment you ever knew his
- 7:49Speaker 1: name connected with the case? Answer, yeah. Aside from the
- 7:53Speaker 1: image that we had, that was the first time that
- 7:55Speaker 1: we had a name of an individual who had taken responsibility, yes. Question,
- 8:00Speaker 1: and did you personally ever meet with Mr. Robinson? Answer,
- 8:04Speaker 1: I did not. Question, and as far as you know, Mr.
- 8:07Speaker 1: Robinson did what he said he was going to do.
- 8:10Speaker 1: He told police that he was coming, he was coming peacefully,
- 8:13Speaker 1: he was coming with his parents, and that's exactly what happened. Answer,
- 8:17Speaker 1: I don't know any of the specifics of how he
- 8:19Speaker 1: was arranged to turn himself in. In terms of what
- 8:22Speaker 1: you just described, I just know that it's being facilitated
- 8:25Speaker 1: with the sheriff's office. Question, okay, court's indulgence for just
- 8:29Speaker 1: a moment, Your Honor. Judge, yes. Question by Ms. Nestor.
- 8:34Speaker 1: Thank you, Agent Hull. I tender the witness, Your Honor. Judge,
- 8:38Speaker 1: thank you. Redirect by state. Now the prosecution jumps back
- 8:42Speaker 1: in for redirect. Prosecution. I'm just going to go back
- 8:47Speaker 1: to a few things that Ms. Nestor asked you about.
- 8:49Speaker 1: First of all, the unfired bullet that you referred to,
- 8:52Speaker 1: is it your understanding that that bullet was accounted for? Answer,
- 8:55Speaker 1: that's my recollection, yes. Question, okay. And it possibly belonged
- 8:59Speaker 1: to an officer that could have maybe been clearing his weapon? Answer, yeah,
- 9:04Speaker 1: that's what I recall being told about that particular item. Question,
- 9:08Speaker 1: are you aware of? On the 10th, there were police
- 9:10Speaker 1: officers present that were actually securing buildings and securing rooms
- 9:14Speaker 1: there at UVU? Answer. I know prior to my arrival,
- 9:19Speaker 1: it was a dynamic and active scene that I believe
- 9:22Speaker 1: was originally being treated that there was an active shooter
- 9:24Speaker 1: still on campus. So there was a large rapid response
- 9:27Speaker 1: of law enforcement who were actively trying to clear, secure,
- 9:31Speaker 1: and ensure that the campus was safe. If that answers
- 9:34Speaker 1: the question. Question. The entire campus? Answer. Yes. Correct. Question, okay,
- 9:41Speaker 1: and what types of officers were clearing the campus? Answer,
- 9:44Speaker 1: originally there would have been probably local units who would
- 9:47Speaker 1: have responded, but subsequently specialty teams would have been deployed
- 9:51Speaker 1: to a more methodical search of the campus and what
- 9:54Speaker 1: we would call a clearing of the campus. Question on
- 9:58Speaker 1: those specialty teams. And any other officers, how were they equipped?
- 10:02Speaker 1: What type of equipment were they carrying? Answer, I believe
- 10:05Speaker 1: most officers carry a sidearm, a handgun, and most officers
- 10:09Speaker 1: in this day and age are equipped with a rifle
- 10:10Speaker 1: platform as well. Question, okay, and when you said that
- 10:14Speaker 1: it was possible that the round was from an officer
- 10:16Speaker 1: clearing his weapon, what exactly do you mean by that?
- 10:19Speaker 1: Question or answer. Our standard practice in our department is
- 10:22Speaker 1: to carry a rifle cruiser ready. Prosecution, I'm sorry. Answer.
- 10:29Speaker 1: We carry our rifles in a situation which is called
- 10:31Speaker 1: cruiser ready. Prosecution, what does that mean? Answer. It means
- 10:35Speaker 1: we don't have a round chambered. So if an officer
- 10:37Speaker 1: deployed with his rifle, he would chamber a round. Once
- 10:40Speaker 1: he had done whatever task it was that he was doing,
- 10:43Speaker 1: in order to put that weapon back, he would eject
- 10:45Speaker 1: the magazine and eject the round. sometimes in doing so
- 10:48Speaker 1: rounds are dropped or not accounted for. Question. Okay. Have
- 10:53Speaker 1: you personally done that yourself? Answer. We do that in
- 10:56Speaker 1: training and I've done that in the field as well. Yes. Question.
- 11:00Speaker 1: And are you aware of, is that something that's common
- 11:02Speaker 1: among police officers in this situation? Answer. I believe for
- 11:06Speaker 1: most agencies, that's how they carry their weapons, but I
- 11:09Speaker 1: can't speak specifically for agencies outside my own. Question. Do
- 11:13Speaker 1: you have any idea how many officers were dedicated or
- 11:16Speaker 1: sent out to the campus? Answer, I can tell you,
- 11:19Speaker 1: I had to park on University Avenue and walk all
- 11:22Speaker 1: the way onto campus between hundreds of police cars, so
- 11:24Speaker 1: I would say hundreds if not thousands of officers. High
- 11:28Speaker 1: hundreds would have responded to a campus that day. Alright folks,
- 11:31Speaker 1: we're going to wrap up right here, and in the
- 11:33Speaker 1: next episode dealing with the topic we're going to pick
- 11:35Speaker 1: up with, now I'm going to ask you about Ms. Nestor,
- 11:38Speaker 1: and what she asked you about your observation of seeing Mr.
- 11:41Speaker 1: Robinson with something in his hand. All the information that
- 11:45Speaker 1: goes with this episode can be found in the description box.
