Speaker 1: What's up everyone and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to dive right back into the
• 0:05
Speaker 1: transcript from day four of the Tyler Robinson prelim hearing.
• 0:10
Speaker 1: And we're going to be picking up with the defense
• 0:12
Speaker 1: cross-examining Sergeant Falmina. Question by defense. Thank you. Good afternoon.
• 0:19
Speaker 1: Sergeant Falmina. Good afternoon. Defense. Your role in the case
• 0:24
Speaker 1: was as the traffic manager of the whole operation, right? Answer.
• 0:28
Speaker 1: That's a good way to put it. Yeah. Question, and
• 0:31
Speaker 1: we're talking about multiple agencies besides the SBI, correct? Answer, yes. Question,
• 0:36
Speaker 1: your agency, if I'm correct, wrote a massive report, 229
• 0:40
Speaker 1: pages long. Answer, yes. Question, you've read that? You're familiar
• 0:44
Speaker 1: with it? Answer, with most of them, yeah. Question, okay,
• 0:49
Speaker 1: and it's a compilation. You authored some reports, but a
• 0:52
Speaker 1: lot of other people wrote reports about aspects of the investigation. Answer, yeah. Question,
• 0:58
Speaker 1: and as those reports were getting done, You would kind
• 1:01
Speaker 1: of read them and decide who needed to get what
• 1:03
Speaker 1: done further? Answer, yes. Question, was that one of the
• 1:07
Speaker 1: roles that you performed in the case? Answer, yeah. As
• 1:10
Speaker 1: well as consulting with case agents? Answer, okay. Now, if
• 1:14
Speaker 1: my count is correct, nine of those reports in that
• 1:17
Speaker 1: larger body of reports were written by you, correct? Answer, yes. Question,
• 1:22
Speaker 1: did I miss any? Does that sound about right? Answer, yeah. Question, okay.
• 1:26
Speaker 1: I want to ask you about a couple of those reports.
• 1:29
Speaker 1: The first report was a report that you wrote on
• 1:31
Speaker 1: September 22nd that documented the overview of the crime scenes, correct? Answer, yes. Question?
• 1:39
Speaker 1: And there were various crime scenes that you've described on
• 1:42
Speaker 1: direct examination, correct? Answer, yes. Question? And one of them
• 1:47
Speaker 1: was the Fulton Library. Answer, yes. Question? Tell us why
• 1:51
Speaker 1: that was a potential crime scene. Answer, yeah, of course.
• 1:55
Speaker 1: When officers were canvassing the scene... They were also trying
• 1:58
Speaker 1: to see the route of the shooter as well as
• 2:01
Speaker 1: just trying to find the shooter. And they determined that
• 2:04
Speaker 1: the Fulton Library stood out because there were unattended items
• 2:08
Speaker 1: there at the bus stop that were away from the
• 2:10
Speaker 1: courtyard area. And so to them, they thought it was suspicious. Question,
• 2:15
Speaker 1: and were certain items seized? Answer, yes. Question, and what
• 2:19
Speaker 1: were they? Answer, you had a backpack, a jacket, as
• 2:23
Speaker 1: well as some gloves. And there may have been some
• 2:25
Speaker 1: other things. I just don't recall them right now. Question,
• 2:28
Speaker 1: and do you recall what the item numbers were on
• 2:31
Speaker 1: those seizures? Was it nine? Does that ring a bell? Answer,
• 2:35
Speaker 1: I don't remember. Question, whatever was seized was sent to
• 2:39
Speaker 1: the FBI lab for processing? Answer, yes. Question, and along
• 2:43
Speaker 1: with some information that the suspect may have shed some
• 2:46
Speaker 1: of these items as he fled, correct? Answer, yes. Question,
• 2:50
Speaker 1: was the decision at some time made, and you were
• 2:53
Speaker 1: requesting that both DNA and other type of analysis get done? Answer, yes. Question,
• 2:59
Speaker 1: at some point, did you decide to pull the plug
• 3:01
Speaker 1: on that? Answer, at the time when it was already sent,
• 3:05
Speaker 1: we didn't have more information as far as whether or
• 3:07
Speaker 1: not the evidence that was collected there was probative. Question,
• 3:11
Speaker 1: but eventually you communicated to the lab that those items
• 3:14
Speaker 1: were not in fact connected with the case and there
• 3:16
Speaker 1: was no need to do further testing. Answer, I don't
• 3:20
Speaker 1: remember communicating that. Question, okay, if that's in the notes
• 3:24
Speaker 1: of the FBI or ATF, would that be inconsistent with
• 3:27
Speaker 1: what you know Answer, no. Question, okay. I mention it
• 3:31
Speaker 1: because some of the reports, the lab reports, have those
• 3:34
Speaker 1: items listed. Answer, okay. Question, I just want to be
• 3:38
Speaker 1: clear that those items eventually you determined were not related
• 3:41
Speaker 1: to the case. Would that be fair? Answer, that would
• 3:44
Speaker 1: be fair. Question, okay. The second report, at least as
• 3:47
Speaker 1: far as I can see, that you wrote was on
• 3:49
Speaker 1: December 24th. And it had to do with, looks like
• 3:53
Speaker 1: a request for a search of firearms. Do you recall that? Answer, no.
• 3:57
Speaker 1: Could you elaborate for me on the firearms? Question, this
• 4:01
Speaker 1: document documents the NIBIN request for firearms. Answer, so that
• 4:07
Speaker 1: was the request to conduct. What that stands for, the NIBIN,
• 4:12
Speaker 1: is the National Integrated Ballistics Information Network. It's run by
• 4:16
Speaker 1: the ATF. And that's where we test or we input
• 4:19
Speaker 1: test fires or cartridge casings, the head stamps and whatnot
• 4:23
Speaker 1: into a machine that is then run through the ATF
• 4:26
Speaker 1: to see if there's any other cartridge casings that match. Question,
• 4:30
Speaker 1: and nothing of value came from that part of your investigation, correct? Answer, correct. Question,
• 4:35
Speaker 1: now going back for a minute to the crime scenes.
• 4:38
Speaker 1: You talked about the warded area, and you used the phrase,
• 4:41
Speaker 1: we seize the towel. Who's we? Who are you referring
• 4:44
Speaker 1: to when you say, we seize the towel? Answer, we
• 4:48
Speaker 1: would be the FBI, as well as FBI. So that
• 4:51
Speaker 1: would be myself, as well as FBI evidence response team lead,
• 4:55
Speaker 1: Michelle Kamik. or Special Agent Michelle Kamik. Question, so you
• 4:59
Speaker 1: both reached into the bushes, and you both grabbed and
• 5:02
Speaker 1: pulled it out? Answer, she did, but I was there
• 5:05
Speaker 1: with her, and we were communicating the entire time. Question, okay,
• 5:09
Speaker 1: so when you say, we seized the towel, what you
• 5:11
Speaker 1: really mean is she seized the towel, and you observed
• 5:14
Speaker 1: her seize it? Answer, yes. Question, and when she seized
• 5:18
Speaker 1: the towel, can you describe a little bit more detail
• 5:21
Speaker 1: of how the process took place? Answer, as far as
• 5:24
Speaker 1: when it was found or when she removed it. Question, yeah,
• 5:27
Speaker 1: the photographs you showed us, were those the best photos
• 5:30
Speaker 1: you've got of the process? Answer, that was taken by
• 5:33
Speaker 1: the FBI, so that's all we got. Question, that's all
• 5:36
Speaker 1: we got. And nobody was videoing the discovery and recovery
• 5:39
Speaker 1: of that evidence. Answer, I believe one of the officers
• 5:42
Speaker 1: on scene actually had his body camera on. Question, and
• 5:46
Speaker 1: have you seen that? Answer, I have not. Question, do
• 5:49
Speaker 1: you know if there's any documentation of the exact process
• 5:52
Speaker 1: by which that towel got removed from the rifle, then
• 5:55
Speaker 1: I guess put back on the rifle, right? Answer, no,
• 5:58
Speaker 1: it was not. Question, it was not put back on? Answer, no. Question,
• 6:03
Speaker 1: didn't one of the photos show the rifle in the
• 6:05
Speaker 1: box with a towel over it? Answer, yes, it wasn't
• 6:08
Speaker 1: over it. It was still wrapped around the gun. Question, okay,
• 6:12
Speaker 1: but as I understood your testimony, the towel was seized
• 6:15
Speaker 1: by the FBI agent, and then somebody must have reached
• 6:18
Speaker 1: in and got the gun out, right? Answer, no. I'll
• 6:21
Speaker 1: clarify for you. So the entire time when we retrieved it,
• 6:24
Speaker 1: the gun was wrapped in the towel. So when Special
• 6:27
Speaker 1: Agent Kamek reached in, she grabbed not only the towel,
• 6:30
Speaker 1: but also the gun. And the towel and the gun
• 6:32
Speaker 1: remained basically intact. Lack of a better word. And then
• 6:36
Speaker 1: was placed onto the cardboard box, which is one of
• 6:39
Speaker 1: the photos that was shown earlier. Once we documented that,
• 6:42
Speaker 1: and then the towel was removed from the gun. Question,
• 6:45
Speaker 1: and you also mentioned, as to the other crime scenes,
• 6:48
Speaker 1: that we processed it, but was your role in terms
• 6:51
Speaker 1: of your actual participation limited to the wooded area? Or
• 6:55
Speaker 1: were you involved in actually seizing evidence at the other
• 6:58
Speaker 1: locations like the roof? Answer, yeah, I was involved in
• 7:01
Speaker 1: coordinating all of that and then determining from there where
• 7:05
Speaker 1: the evidence would go. Question involved in, is that the
• 7:08
Speaker 1: same thing as actually being on the roof and seizing
• 7:11
Speaker 1: the items? Or are we talking about someone else? Answer.
• 7:15
Speaker 1: Talking about somebody else. Question. And what is that something else? Answer.
• 7:20
Speaker 1: So after the teams would have packaged all the items,
• 7:23
Speaker 1: sealed them properly, create an evidence log, they would then
• 7:26
Speaker 1: bring them back to the command post. And from there,
• 7:28
Speaker 1: we would compile everything. And then there was a discussion
• 7:32
Speaker 1: that was had as to who would take custody. Question.
• 7:36
Speaker 1: Fair to say you did not observe yourself the seizure
• 7:38
Speaker 1: of the screwdriver from the roof. Answer. That's correct. Question.
• 7:42
Speaker 1: And who are the people who are actually conducting that
• 7:45
Speaker 1: part of the crime scene processing? Answer, that would have
• 7:48
Speaker 1: been our state crime lab. Those two people are part
• 7:50
Speaker 1: of the state crime lab's crime scene response team. Question,
• 7:54
Speaker 1: when did you review the video of the suspect running
• 7:57
Speaker 1: towards the area from which he jumped off? Answer, that
• 8:00
Speaker 1: would have been, I don't know the exact time, but
• 8:03
Speaker 1: it would have been the day of September 10th. Question,
• 8:07
Speaker 1: you saw that on September 10th? Answer, yes. Question, And
• 8:11
Speaker 1: when were the windows processed for the latent fingerprints? Answer,
• 8:15
Speaker 1: the windows were processed on September 11th, the next day. Question,
• 8:19
Speaker 1: and was the reason that those latent lists were taken
• 8:22
Speaker 1: was because you wanted to rule out whether the suspect
• 8:25
Speaker 1: had touched the window? Answer, yes. Question, that's what the
• 8:29
Speaker 1: notes say, right? Answer, yes. Question, you were not present
• 8:33
Speaker 1: when the scene was processed either, correct? Answer, not the
• 8:36
Speaker 1: entire time, no. Question, okay. Now, the other reports that
• 8:40
Speaker 1: I have that you did, and correct me if I'm wrong,
• 8:43
Speaker 1: is one report dated September 24th, documenting the forensic analysis
• 8:48
Speaker 1: as of September 24th, summarizing what you were hearing back
• 8:51
Speaker 1: from the ATF and the FBI. Answer, yeah. Question, okay.
• 8:56
Speaker 1: And then the fifth report was, again, about the progress
• 8:59
Speaker 1: of the forensic testing, right? Answer, yes. Question, all right.
• 9:03
Speaker 1: And then you have a report which you document a
• 9:05
Speaker 1: firearm trace and a firearm seized at River Street. Answer, yes. Question,
• 9:11
Speaker 1: nothing of value came of that, correct? Answer, correct. Question,
• 9:16
Speaker 1: you have a report that has to do with the
• 9:18
Speaker 1: latent print report from your people, SBI? Answer, yes. It's
• 9:22
Speaker 1: not SBI. It's actually the state crime lab. But yes,
• 9:25
Speaker 1: the same department. Question, same department. Just detailing the results
• 9:29
Speaker 1: of that examination, which the stipulation addressed. Answer, yes. Question. Okay.
• 9:34
Speaker 1: You have a report documenting the transfer of evidence from
• 9:37
Speaker 1: the FBI to your department? Answer. Yes. Question. And then
• 9:42
Speaker 1: the last one that I have that you personally wrote
• 9:44
Speaker 1: has to do with, again, summarizing forensic reports. Answer. Yes. Question. Okay.
• 9:51
Speaker 1: The larger 229-page report indicates that there was some investigation
• 9:55
Speaker 1: done by your agency that involved interviewing associates of Mr.
• 9:59
Speaker 1: Robinson to see if you could develop some profile of
• 10:01
Speaker 1: him having animosity towards Mr. Kirk, correct? Answer, I'm not
• 10:06
Speaker 1: familiar with that. Question, so you weren't involved in that
• 10:09
Speaker 1: at all? Answer, no. Question, some of these documents in
• 10:12
Speaker 1: that large report indicate that your agency has also, up
• 10:15
Speaker 1: to the present time, Been monitoring Mr. Robinson's mail and
• 10:19
Speaker 1: communications at jail, correct? Answer. Correct. Question. And have you
• 10:24
Speaker 1: been kept abreast of that investigation? Answer. No. Question. Do
• 10:28
Speaker 1: you know whether anything of value has been developed as
• 10:31
Speaker 1: a result of that? Answer. Nope. Defense. That's all I have.
• 10:37
Speaker 1: Thank you. Judge Graff. Prosecution. Redirect. Prosecution. Nothing, Your Honor.
• 10:44
Speaker 1: Judge Graff. All right. May this witness be excused? Answer, yes.
• 10:48
Speaker 1: Judge Graff? Thank you, Sergeant Fulmina. You've been excused. All right, folks,
• 10:54
Speaker 1: we're going to wrap up right here. And in the
• 10:56
Speaker 1: next episode dealing with the topic, we're going to pick
• 10:58
Speaker 1: up where we left off. All the information that goes
• 11:00
Speaker 1: with this episode can be found in the description box.
