- 0:00Speaker 1: What's up everyone and welcome back to the program. Tyler
- 0:04Speaker 1: Robinson's lawyers have filed a new motion with the court
- 0:08Speaker 1: asking the court to ban cameras from the hearing that's
- 0:13Speaker 1: scheduled on September 1st. And of course this has to
- 0:16Speaker 1: do with the circus that surrounds this trial. And the lawyers,
- 0:22Speaker 1: they say that having cameras inside the courtroom could potentially
- 0:27Speaker 1: taint the jury and give biased information to the public,
- 0:31Speaker 1: considering the nature of the hearing, and that hearsay is allowed.
- 0:37Speaker 1: And look, I get it. If I was a lawyer
- 0:39Speaker 1: for Tyler Robinson, I'd be trying to get cameras out
- 0:42Speaker 1: of the courtroom too. But as a member of the public,
- 0:45Speaker 1: that's the last thing I want to see. Because if
- 0:48Speaker 1: there's no cameras in there, and we can't follow along,
- 0:51Speaker 1: then they can claim whatever, right? Oh, Tyler Robinson's getting
- 0:54Speaker 1: a raw deal. He's being set up. And if we
- 0:58Speaker 1: don't have access to that courtroom, then it certainly breathes
- 1:01Speaker 1: life into some of the conspiracies saying that this is
- 1:06Speaker 1: a cover-up and that the government doesn't want to be
- 1:09Speaker 1: honest with the American people. But this kind of battle
- 1:12Speaker 1: in a trial like this is not something that is unique.
- 1:18Speaker 1: When it comes to Brian Kohlberger, forget it. The battle
- 1:21Speaker 1: to have cameras in the courtroom or take them out,
- 1:24Speaker 1: it was massive. It went on for months. And I'm
- 1:29Speaker 1: sure that we're going to see the same kind of
- 1:30Speaker 1: battles take place here because the sort of interest in
- 1:35Speaker 1: this case is pretty overwhelming. And there's going to be
- 1:39Speaker 1: a lot of people that, you know, want to watch
- 1:42Speaker 1: what's going on. So I have a hard time believing
- 1:45Speaker 1: that Judge Graff is going to pull cameras out of
- 1:48Speaker 1: the courtroom as far as forever. But maybe for this trial,
- 1:54Speaker 1: he might do that considering some of the things that
- 1:56Speaker 1: we've seen previously. So today, we have an article from
- 2:00Speaker 1: Fox News and the headline, Tyler Robinson's lawyers seek camera
- 2:04Speaker 1: ban for September 1st hearing. Say case is not a
- 2:08Speaker 1: reality TV show. This article was authored by Michael Ruiz.
- 2:14Speaker 1: Tyler Robinson's attorneys are asking the judge to ban cameras
- 2:18Speaker 1: from the courtroom, this time alleging that cameras and streaming
- 2:21Speaker 1: of his upcoming September 1st hearing risk turning the case
- 2:24Speaker 1: into a reality TV show. Bad news for you guys.
- 2:27Speaker 1: It already is. the amount of nonsense that surrounds this
- 2:31Speaker 1: case is unbelievable. And people just pop off with all
- 2:36Speaker 1: kinds of crazy shit. I mean, look, I'm not opposed
- 2:41Speaker 1: to an alternative way of thinking, as you all know.
- 2:44Speaker 1: But there has to be some merit. There has to
- 2:46Speaker 1: be some meat on that bone. Let's see some evidence. Okay,
- 2:51Speaker 1: you tell me there's Egyptian planes. Well, let's see some evidence.
- 2:56Speaker 1: What were they doing? Who was involved? Where did they go?
- 2:59Speaker 1: And if you don't have that kind of evidence, then
- 3:02Speaker 1: all you have is speculation. And that's cool. There's a
- 3:04Speaker 1: place for that, right? We don't know what happened yet.
- 3:07Speaker 1: The idea should be to open every door, shake every bush,
- 3:12Speaker 1: and see what comes out. That's what you should be
- 3:15Speaker 1: doing during an investigation. But there's some wild shit. And
- 3:19Speaker 1: there's some wild conversation. I mean, what's next? It was
- 3:23Speaker 1: Bigfoot riding a chupacabra that killed Tyler Robinson? The media
- 3:29Speaker 1: presence in the courtroom both distracts and places added pressure
- 3:32Speaker 1: on the hearing participants to present for the media, as
- 3:36Speaker 1: opposed to focusing on the facts, evidence, and mechanics of
- 3:39Speaker 1: the hearing. Robinson's attorneys, Kathy Nestor, Michael Burt, and Richard Novak,
- 3:44Speaker 1: and Stacey Visser, wrote in one of two Saturday court filings, Mr.
- 3:48Speaker 1: Robinson's case is not and should not be made into
- 3:52Speaker 1: a reality TV show. Look, I agree with that. Tyler
- 3:55Speaker 1: Robinson deserves a fair shake. He deserves every protection that's
- 4:00Speaker 1: provided to him under the Constitution, just like anybody else
- 4:04Speaker 1: who's accused of something like this deserves the same. And
- 4:08Speaker 1: he's going to get it with as much publicity and
- 4:11Speaker 1: as many eyes that are on this case. They would
- 4:14Speaker 1: have a very hard time playing games. And if they
- 4:19Speaker 1: were playing games with, you know, discovery or anything like that,
- 4:23Speaker 1: the defense would already be talking about Brady violations. We
- 4:26Speaker 1: haven't heard any of that. The defense is arguing that
- 4:32Speaker 1: live streams and other images from the hearing could bias
- 4:35Speaker 1: the public against their client by showing evidence that may
- 4:38Speaker 1: not be admissible at trial later. And this has been
- 4:41Speaker 1: a big point of contention. Why are they talking about hearsay?
- 4:45Speaker 1: Why are they talking about things that won't be admitted
- 4:47Speaker 1: when it comes to the actual trial? Well, because it's
- 4:50Speaker 1: the same thing as a grand jury, right? You know
- 4:54Speaker 1: what they say about a grand jury. You can get
- 4:57Speaker 1: a conviction of a ham sandwich in a grand jury.
- 5:01Speaker 1: And that's because it's pretty much one-way traffic. So the
- 5:05Speaker 1: same goes for a prelim hearing in a place like Utah.
- 5:10Speaker 1: So there's going to be hearsay. There's going to be
- 5:13Speaker 1: qualified statements. And remember, it's not just about one bit
- 5:16Speaker 1: of evidence or one piece of evidence. It's about the
- 5:19Speaker 1: totality of what they've collected. So I think that's an
- 5:22Speaker 1: important distinction. And people need to understand that it's not
- 5:25Speaker 1: just about one piece of evidence. It never is. It's
- 5:29Speaker 1: about the totality of it. And what they do is
- 5:31Speaker 1: they use circumstantial evidence to build a base, the foundation.
- 5:35Speaker 1: And then on top of that foundation comes the stronger evidence.
- 5:39Speaker 1: But just about every single investigation starts with circumstantial evidence.
- 5:46Speaker 1: Specific to the oral argument on the prelim hearing, the EMC,
- 5:49Speaker 1: Electronic Media Coverage, will memorialize and widely disseminate arguments discussing
- 5:54Speaker 1: the largely hearsay-based evidentiary presentation made by the state. The
- 5:59Speaker 1: lawyer wrote, Such evidence is, by its very nature, insufficiently
- 6:03Speaker 1: reliable for admission at trial. Well, that's true, but that
- 6:09Speaker 1: doesn't mean it's not important. People need to understand what
- 6:12Speaker 1: the circumstantial evidence is and why the government has a
- 6:17Speaker 1: case against Tyler Robinson. And the best way to do
- 6:19Speaker 1: that is to see them lay out their evidence in
- 6:22Speaker 1: live court. Both of the filings also included redacted paragraphs
- 6:26Speaker 1: after Robinson's lawyers alleged that additional evidence of bias developing
- 6:31Speaker 1: as a result of the widespread publication of his case
- 6:34Speaker 1: can be tracked in real time. Well, look, this is
- 6:37Speaker 1: one of those cases that elicits a lot of emotion
- 6:40Speaker 1: one way or the other. And there's a lot of
- 6:43Speaker 1: people that get controlled by their emotions. So there's a
- 6:47Speaker 1: lot of people that have inserted themselves into this case
- 6:50Speaker 1: that have main character syndrome. Look, it's one thing to
- 6:53Speaker 1: cover it and it's a whole ass other thing to
- 6:57Speaker 1: think you're a fucking inspector gadget and you're going to
- 6:59Speaker 1: blow the doors off the investigation. It's absurd. Honestly, it's absurd. Now,
- 7:05Speaker 1: that doesn't mean people commentating on it don't have, you know,
- 7:08Speaker 1: good ideas. That doesn't mean they don't have good theories.
- 7:12Speaker 1: But there's some people that actually think they're a part
- 7:15Speaker 1: of the investigation. And I can assure you, they are not.
- 7:21Speaker 1: The defense also claimed that witnesses who provided statements that
- 7:24Speaker 1: were admitted as reliable hearsay ahead of the week-long July
- 7:28Speaker 1: preliminary hearing, experienced harassment by media and interested third parties. Oh,
- 7:33Speaker 1: I wonder who they're talking about. I wonder who was
- 7:36Speaker 1: harassing people. The same people that are grifting the fuck
- 7:42Speaker 1: out of this case. Here's an idea. Talk about it.
- 7:47Speaker 1: Cover it. Share evidence with your audience. Leave people alone.
- 7:53Speaker 1: I swear to God, I don't think I've ever seen
- 7:55Speaker 1: as much jackassery surrounding a case as we do here.
- 7:58Speaker 1: I mean, every time you turn around, there is another
- 8:01Speaker 1: theory and another ridiculous narrative that just doesn't fit. Robinson's
- 8:07Speaker 1: the man accused of assassinating Charlie Kirk, 31, at a
- 8:11Speaker 1: Turning Point USA event in Orem, Utah last year. Kirk
- 8:15Speaker 1: was shot and killed while speaking to a crowd of
- 8:17Speaker 1: thousands at Utah Valley University on September 10th, 2025. Separately,
- 8:22Speaker 1: a source close to the Kirk family said Tuesday that
- 8:25Speaker 1: Kirk's widow, Erica, and his parents, Rob and Kathy, all
- 8:29Speaker 1: planned to attend the September 1st hearing together, as they
- 8:31Speaker 1: did during the July hearing. Yo, I'd be there too
- 8:35Speaker 1: if it was my family member. Are you crazy right now? What,
- 8:38Speaker 1: they shouldn't be there? I know I would be. And look,
- 8:42Speaker 1: you can have all the problems in the world with
- 8:44Speaker 1: Erica Kirk. And frankly, I find some of the behavior
- 8:50Speaker 1: a bit off-putting. But the way people have attacked this woman? Wow.
- 8:57Speaker 1: That's a whole ass other level. And I have a
- 8:59Speaker 1: funny feeling when all said and done, there's going to
- 9:01Speaker 1: be some lawsuits filed. Judge Tony Graff will hear oral
- 9:05Speaker 1: arguments from both sides regarding the evidence introduced in July
- 9:09Speaker 1: and will decide whether there's enough probable cause to justify
- 9:12Speaker 1: sending Robinson to trial on the charges against him. Look,
- 9:16Speaker 1: there's no doubt. There's enough evidence. Is that evidence strong
- 9:20Speaker 1: enough to convict? We'll have to see. but there's certainly
- 9:23Speaker 1: enough evidence to take it to trial. I mean, come on.
- 9:27Speaker 1: And I don't think anybody is disputing that. I don't
- 9:29Speaker 1: think there's anybody out there that thinks this is not
- 9:32Speaker 1: going to trial. Robinson's defense objected to hearsay evidence from
- 9:37Speaker 1: the prelim hearing and also opposes the sole aggravating factor
- 9:41Speaker 1: in the aggravated murder charge that carries a potential death penalty.
- 9:45Speaker 1: That Robinson allegedly put other people at great risk of
- 9:48Speaker 1: death by shooting Kirk in a crowded place. Like, how
- 9:52Speaker 1: do you even dispute that All those people around, you're
- 9:55Speaker 1: firing bullets downrange. Yeah, somebody else could have been hurt.
- 10:00Speaker 1: Seems like a logical step for me. The defense argued
- 10:04Speaker 1: that only a single shot was fired from an elevated position.
- 10:08Speaker 1: It traveled over the crowd rather than through it and
- 10:11Speaker 1: only struck Kirk. Well, that's weird. If it was an
- 10:14Speaker 1: exploding microphone or a drone, don't you think his defense
- 10:18Speaker 1: would point that out? Hey, look, not only did he
- 10:22Speaker 1: not shoot this person, nobody shot anybody. There was no bullet.
- 10:27Speaker 1: It was an exploding microphone. And I love when people
- 10:29Speaker 1: are like, well, they can't present anything at a prelim hearing. Bro,
- 10:33Speaker 1: what do you think the whole entire point is? If
- 10:35Speaker 1: they have evidence that exonerates their client, oh, they're bringing
- 10:38Speaker 1: it to the table. You better believe that. Prosecutors countered
- 10:44Speaker 1: that Robinson was a bad shot. One who seldom hit
- 10:47Speaker 1: the bullseye and sometimes misses the target completely when practicing
- 10:52Speaker 1: shooting with a suspected murder weapon. Well, that certainly is
- 10:55Speaker 1: a bit weird. So he misses all the time, but
- 10:59Speaker 1: he just happens to be on point when it comes
- 11:01Speaker 1: to taking out Charlie Kirk? Look, I'm not saying that
- 11:03Speaker 1: there's not weird things that come along with this story.
- 11:07Speaker 1: There are. And there's a lot of unanswered questions. But
- 11:10Speaker 1: for me, the way to get to those answers is
- 11:12Speaker 1: to follow the actual evidence. Not what some jerk-off on
- 11:16Speaker 1: Twitter says. Robinson, 23, has not yet entered a plea. Well,
- 11:24Speaker 1: I don't think there's any doubt that this goes to trial.
- 11:27Speaker 1: But as far as the cameras in the courtroom on
- 11:30Speaker 1: September 1st, I think that's up for debate. While I
- 11:33Speaker 1: think they should be there, we'll have to see what
- 11:36Speaker 1: Judge Graff thinks and what he says. Because there's certainly
- 11:39Speaker 1: an argument to be made on both sides. And considering
- 11:42Speaker 1: that that hearing... is what a week away or so
- 11:46Speaker 1: i'm guessing that we'll have a ruling from judge graph
- 11:49Speaker 1: sometime in the next few days and when we get
- 11:51Speaker 1: that ruling obviously we'll get it added to the catalog
- 11:55Speaker 1: all the information that goes with this episode can be
- 11:58Speaker 1: found in the description box
