- 0:13the ground at SpaceX, Starbase during early Starship
- 0:16development. And before this, I spent my
- 0:18career as a software developer working with billion dollar

- 0:40Something happened the other day when I was on Reddit.
- 0:44We started a discussion around SpaceX sending people on a
- 0:49Starship from Earth into space. Now let's back up a little bit
- 0:56here. SpaceX is in the 11th test
- 0:59flight. The next test flight will be
- 1:00their Block 3 Starship, which is more powerful and bigger than
- 1:04their Block two flights. Now Block 2 has had some
- 1:08incidents. A few of the flights have, well,
- 1:12let's just say blown up, had a Rudd mid flight.
- 1:18And the problem with that is that when that happens, it is
- 1:25not a good thing if people are aboard, right?
- 1:27So we're going to be talking today about how people will be
- 1:30flying inside of a Starship and what it actually takes, the
- 1:34regulatory landscape that surrounds it.
- 1:37It is wild what people can do with Space Flight now because
- 1:41it's not all determined by NASA anymore or by a government body
- 1:48other than let's just say the FAA.
- 1:50And maybe there's gonna be another government body in the
- 1:52future that's going to be taking part of this.
- 1:54But right now, it's just the FAA that works on this stuff.
- 2:00This is actually one of the most fascinating regulatory gaps in
- 2:03the entire space industry. And understanding it requires us
- 2:07to explore how human spaceflight certification evolved from about
- 2:1160 years ago in why we're entering truly uncharted
- 2:16territory with Starship. Now let me take you through the
- 2:19landscape of how human spacecraft had been certified
- 2:21historically, because what you're identifying with this
- 2:26problem is a profound challenge that the industry hasn't really

- 3:48human spaceflight. The concept of human rating
- 3:51existed entirely within government agencies.
- 3:53NASA developed its human rating standards through hard learned
- 3:57lessons from Mercury, Gemini, and Apollo, and the Soviets had
- 4:02their own internal processes, though less formally documented.
- 4:06The Chinese space program follows similar government
- 4:08internal certification, and in every case, the same
- 4:11organization that operated the spacecraft also certified its
- 4:16safety. Now, this created a particular
- 4:19dynamic The certifying agency had skin in the game.
- 4:22When NASA certified that the space shuttle was safe for
- 4:25astronauts, NASA leadership was putting their own people at
- 4:28risk. The engineers who signed off on
- 4:31Crew Dragon safety knew that their colleagues, sometimes
- 4:34their friends, would be riding in it.
- 4:37This personal investment created a certain rigor, though, as
- 4:41Challenger and Columbia showed us, it wasn't foolproof.
- 4:46Now, the Commercial Crew program marked the first time that NASA
- 4:49certified vehicles it didn't own or operate.
- 4:52But even this wasn't truly independent certification.
- 4:55SpaceX and Boeing were contractors working to NASA
- 4:58specifications and requirements. When NASA deeply embedded in the
- 5:02design process from day one, Yes, engineers had visibly
- 5:08looked into every design decision, every test result,
- 5:11every anomaly investigation, and the companies couldn't just show
- 5:15up with a finished spacecraft and ask for certification.
- 5:18NASA was involved throughout the entire development process,
- 5:22making it more of a joint effort than independent verification.
- 5:26Now here is where things get really interesting.
- 5:29The Federal Aviation Administration.
- 5:31The FAA, which regulates commercial aviation with
- 5:34incredible strictness, takes a fundamentally different approach
- 5:38to commercial human spaceflight. Under current law, extended
- 5:41through January of 2028, the FAA is explicitly prohibited from
- 5:46creating safety regulations for spacecraft occupants.
- 5:50They can regulate launches to protect the public on the
- 5:53ground. They can protect airspace, but
- 5:56they cannot tell SpaceX or Blue Origin or anybody else how to
- 6:01keep passengers safe. This learning period or
- 6:05moratorium reflects a deliberate policy change by Congress.
- 6:09The thinking went like this. The commercial space industry is
- 6:12too young and evolving too rapidly for prescriptive safety
- 6:17regulations. If the FAA stepped in with
- 6:20requirements based on 1960s capsule designs, they might
- 6:24inadvertently prevent innovations that can make Space
- 6:27Flight safer and better and faster.
- 6:29Better to let the industry experiment and learn, with
- 6:32passengers accepting the risks through informed consent.
- 6:36Now think about what this means in practice, though.
- 6:39When Blue Origin flies paying customers on New Shepherd,
- 6:43there's no government certification that the vehicle
- 6:45is safe. Instead, passengers just sign a
- 6:47waiver acknowledging they understand the risks.
- 6:50The FAA verifies that Blue Origin has insurance that they
- 6:53won't drop debris on populated areas, in that they've informed
- 6:57passengers about these risks, but not that the vehicle meets
- 7:01any strict particular safety standards for the people inside.
- 7:05Virgin Galactic operates under the same framework, despite
- 7:08carrying paying customers to space.
- 7:10No government entity has human rated Spaceship 2 in the way.
- 7:14NASA human rates vehicles. The company developed its own
- 7:18internal safety standards, conducted its own test program,
- 7:21and made its own determination that the vehicle was ready for
- 7:24passengers. I think FAA licensed the flights
- 7:27but didn't certify the safety of the occupants.
- 7:31Now, the informed consent model works for tourism and private
- 7:34flights, but it has crucial limitations.
- 7:37NASA won't accept it for their astronauts.
- 7:41They require full human rating certification for their
- 7:43standards. No other government agency has
- 7:46shown willingness to put their personnel on vehicles certified
- 7:50only through informed consent in insurance companies, while
- 7:54willing to cover some risk, haven't yet figured out how to
- 7:57price policies for regular commercial human spaceflight
- 7:59operations. Now the model also assumes
- 8:02passengers can meaningfully consent to risks that might not
- 8:05be fully understood. And when you board a commercial
- 8:08airline, decades of operational data inform the safety
- 8:11statistics. When you board Starship, how do
- 8:14you evaluate the risk of the belly flop maneuver when it's
- 8:17never been done with humans on board?
- 8:19How do you price the risk of 18,000 heat shield tiles where
- 8:24we don't have statistical models for their failure rates?
- 8:28Looking internationally doesn't provide much additional
- 8:31precedent. Even Russia has sold seats on
- 8:34Soyuz for decades, but these flew under the Russian Space
- 8:37Agency's government certification.
- 8:39Tourists were essentially along for the ride and government
- 8:42missions. China hasn't opened the program
- 8:44to commercial participation yet. The ESA European Space Agency
- 8:49has never developed independent human spaceflight capabilities.
- 8:52The closest international parallel might be how maritime
- 8:56classification societies like Lloyd's Register or DNV evolved
- 9:02to certify ship safety independently of government
- 9:04agencies. These organizations developed
- 9:07from insurance industry needs. Insurers wanted independent
- 9:10verification that Sips were seaworthy.
- 9:14Over centuries, though, their standards became so respected,
- 9:17the governments often simply require classification society
- 9:20approval rather than conducting their own infections.
- 9:26Now. This maritime model points
- 9:27toward one possible future for spaceflight certification.
- 9:32We're seeing early movements in this direction.
- 9:34The Commercial Spaceflight Federation and industry group
- 9:37has developed some voluntary standards.
- 9:40ASTM International, which creates consensus standards for
- 9:43everything from steel to toys, has a committee on commercial
- 9:47spaceflight. But these are still voluntary
- 9:49guidelines, not certification programs with real teeth and
- 9:52grit. What would give such standards
- 9:55that grit and teeth? Insurance requirements might Dr.
- 9:58adoption. If insurers demanded independent
- 10:01certification before covering flights, operators would have to
- 10:05comply. Large corporate customers might
- 10:07require certification before putting their employees on
- 10:10spacecraft. And eventually, after the FAA
- 10:13moratorium expires, regulations might reference industry
- 10:17standards rather than creating government requirements from
- 10:21scratch. Now this brings us back to
- 10:23Starship. For NASA missions, SpaceX must
- 10:26meet NASA's human rating requirements.
- 10:28But for private missions, SpaceX faces a genuine certification
- 10:32vacuum. The FAA can't certify occupant
- 10:34safety until at least 2028, and even then they'll likely take
- 10:39years to develop regulations. No independent body exists with
- 10:43credibility and expertise to certify something as complex as
- 10:47Starship. SpaceX could sell, certify,
- 10:50essentially saying we've done our homework and believe this is
- 10:53safe. That's legally sufficient for
- 10:55private flights under current regulations.
- 10:57But would customers accept it? Some would.
- 11:00Now, would Jared Isaac men climb aboard A Starship based solely
- 11:04on Spacex's internal assessment? Probably.
- 11:07In. The cancellation of Deer Moon
- 11:09suggests at least some customers want more assurance than SpaceX
- 11:12can currently provide. Now the company could pursue
- 11:16voluntary oversight, perhaps inviting independent experts to
- 11:19review their safety processes, similar to how some crypto
- 11:23exchanges undergo voluntary audits to build customer
- 11:25confidence. They could publish their safety
- 11:28analysis and test data for peer review.
- 11:31They could adopt standards from aviation or other industries
- 11:35where applicable. But none of this would
- 11:37constitute true independent certification of the kind
- 11:41government agencies have traditionally provided.
- 11:45Now, perhaps the most likely near term development involves
- 11:49the insurance industry stepping in as de facto certifiers.
- 11:53If SpaceX wants to carry passengers, they'll need
- 11:56liability insurance. Insurers, before writing
- 11:59policies, will demand extensive technical reviews, test data,
- 12:03and possibly design modifications.
- 12:05The requirements might become the de facto safety standard for
- 12:09commercial human spaceflight. And this insurance driven model
- 12:13has precedent. And early aviation insurance
- 12:15requirements often drove safety improvements faster than
- 12:18government regulations. Insurers had direct financial
- 12:21incentive to reduce accidents, leading them to demand pilot
- 12:25training standards, maintenance procedures, and design
- 12:28improvements that later became regulatory requirements.
- 12:31And for Starship specifically, insurers might demand
- 12:35demonstrated reliability through hundreds of cargo flights.
- 12:39Independent review of critical systems, additional redundancy
- 12:43in certain areas, or even design changes like adding a board
- 12:47capabilities for human flights. The premiums they charge would
- 12:50reflect their assessment of risk, creating market signals
- 12:54about safety that might be more responsive than government
- 12:57regulations. Now what we're witnessing with
- 12:59Starship is the space industry grappling with a fundamental
- 13:02transition from government dominated to commercially driven
- 13:05human spaceflight. The regulatory and certification
- 13:09frameworks haven't caught up with the technology.
- 13:11There's no established independent board with the
- 13:13expertise, authority and credibility to certify something
- 13:17as revolutionary as Starship for human flight.
- 13:20And this gap creates both opportunity and risk.
- 13:23It allows SpaceX to innovate without regulatory constraints
- 13:25that might prevent breakthrough approaches.
- 13:27But it also means passengers on early flights will be pioneers
- 13:31in the truest sense, test dummies accepting risks that
- 13:35aren't fully quantified or independently verified.
- 13:39The industry will likely evolve toward more formal certification
- 13:42processes, but Starship might fly humans before those
- 13:45processes exist, making its early crew participants in a
- 13:50grand experiment in commercial space governance.
- 13:53Now, the precedent that Starship sets, whether through successful
- 13:57flights or tragically, through failures, will likely shape how
- 14:01this whole industry approaches human certification for decades
- 14:05to come. And in that sense, SpaceX isn't
- 14:07just developing a new vehicle, they're pioneering an entirely
- 14:11new model for determining what a spacecraft is safe enough for
- 14:15humans. The fact that no clear precedent
- 14:17exists outside government agencies isn't just irregular
- 14:22curiosity anymore. It's a fundamental challenge
- 14:24that can determine whether a commercial human spaceflight
- 14:27beyond tourism becomes viable. Hey, thank you so much for
