- 0:00Speaker 1: What's up everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to spin back down the Moscow
- 0:06Speaker 1: and we're going to continue taking a look at the
- 0:08Speaker 1: experts behind the case against Coberger. Exhibit number eight amended
- 0:14Speaker 1: supplemental expert disclosure Eric Seat. The State has previously disclosed
- 0:19Speaker 1: Derek Seat, forensic scientist, as an expert witness in the
- 0:22Speaker 1: field of forensic biology in DNA, which includes, but in
- 0:26Speaker 1: no way is limited to DNA extraction, quantitation, amplification analysis,
- 0:31Speaker 1: and interpretation analysis, including but not limited to STR data,
- 0:36Speaker 1: Y STR data, and STR mix probabilistic genotyping. The State
- 0:42Speaker 1: hereby incorporates its previous response and attachments filed on December eighteenth,
- 0:46Speaker 1: twenty twenty four, and is hereby supplementing its response as follows.
- 0:51Speaker 1: Seat may testify regarding his involvement in this case in
- 0:54Speaker 1: which he developed a male DNA profile from Lab Item
- 0:57Speaker 1: six reference oral sample from Connor Chestnut. DNA is genetic
- 1:03Speaker 1: material contained in cells that may be utilized for human identification.
- 1:07Speaker 1: DNA may be present on an item in the form
- 1:10Speaker 1: of biological materials such as blood, semen, and saliva, or
- 1:14Speaker 1: may be left on an item when it's handled. Biological
- 1:17Speaker 1: evidence and possible potential DNA evidence is collected for a
- 1:20Speaker 1: preservation and may be sent for further testing by qualified analysts.
- 1:25Speaker 1: DNA may be used to identify individuals, link individuals to
- 1:29Speaker 1: prime scenes, link crime scenes, as well as exclude individuals
- 1:33Speaker 1: from DNA profiles that we obtain. SEAT will explain the
- 1:36Speaker 1: four steps the DNA analysis, such as the one extraction
- 1:40Speaker 1: of DNA from cells, which is done by adding chemicals
- 1:43Speaker 1: to a sample to break open the cells to release
- 1:46Speaker 1: the DNA. To the quantitation of DNA how much DNA
- 1:50Speaker 1: is present in a sample. Three the amplification of DNA,
- 1:54Speaker 1: which is copying specific locations of DNA using PCR generating
- 1:59Speaker 1: copies of DNA, and four the generation visualizes the DNA
- 2:04Speaker 1: profile which looks like peaks onograph of a DNA profile
- 2:08Speaker 1: for comparison. The involvement of SEAT as well as its
- 2:11Speaker 1: interpretations and conclusions is found in seat's lab report three.
- 2:15Speaker 1: Exhibit nine amended supplemental expert disclosure Paulette Sutton. The state
- 2:20Speaker 1: is previously disclosed paul Ette Sutton, an expert in the
- 2:23Speaker 1: field to crime scene reconstruction and blood stained pattern analysis.
- 2:27Speaker 1: The state hereby incorporates its previous responses and detachments filed
- 2:32Speaker 1: on December eighteenth, twenty twenty four and February sixteenth, twenty
- 2:36Speaker 1: twenty five, and is hereby supplementing those responses as follows.
- 2:41Speaker 1: The State is attaching a revised report of T. Paulette
- 2:44Speaker 1: Sutton revised on February thirteenth, twenty twenty five. State's Exhibit
- 2:48Speaker 1: S nine A. The revised report includes a basis for
- 2:52Speaker 1: the revised Report c Page one through two, Items one
- 2:55Speaker 1: through six, which details the revisions to the report. Sutton's
- 2:59Speaker 1: revist report includes rebuttal testimony and response to Matt Nodle
- 3:03Speaker 1: and doctor Brent Turvey. Definitions for technical terms reference throughout
- 3:07Speaker 1: the report, and the absence of evidence is not evidence
- 3:10Speaker 1: of absence kish Pe and McDonald hl Guest Editorial, nineteen
- 3:16Speaker 1: ninety six. In addition, the state is attaching a copy
- 3:20Speaker 1: of the presentation which the state intends to introduce to
- 3:22Speaker 1: AID Sutton in the presentation of her testimony. State Exhibit
- 3:26Speaker 1: S nine B. Paul Ette Sutton Revised Report Basis for
- 3:33Speaker 1: revised report. The report is the above mentioned case, which
- 3:36Speaker 1: was originally issued on August twenty ninth, twenty twenty four
- 3:40Speaker 1: and is being revised due to the following one update
- 3:43Speaker 1: list of items received to reflect a defense reports received
- 3:48Speaker 1: on January thirtieth, twenty twenty five. Two. Original list of
- 3:51Speaker 1: items received B. Evidence lists received via email from Officer
- 3:56Speaker 1: Timothy Smallridge, Moscow Police Department, February tenth, TI, twenty twenty five. Two.
- 4:01Speaker 1: Addition of rebuttal to the reports prepared by defense expert
- 4:05Speaker 1: Matt Nodle Appendix A and doctor Brent Tervey Appendix B
- 4:09Speaker 1: received on January thirtieth, twenty twenty five. Three. Addressed a
- 4:13Speaker 1: discrepancy in DNA testing results related to the following stains
- 4:17Speaker 1: identified my original report issued August twenty ninth, twenty twenty four.
- 4:22Speaker 1: As described in the report prepared by Matt Nodle, Mister
- 4:26Speaker 1: Nodle reports that the numbers reflected on the placards depicted
- 4:29Speaker 1: in the scene photographs were not the same as the
- 4:32Speaker 1: sample numbers used when the evidence was submitted to the
- 4:35Speaker 1: laboratory for testing. One needed to increase the placard number
- 4:39Speaker 1: by six to correlate to the intake number, the pre
- 4:41Speaker 1: logging number used when samples were submitted to the laboratory
- 4:45Speaker 1: for testing. To confirm this observation. I requested the original
- 4:50Speaker 1: evidence log from the Moscow Police Department on February tenth,
- 4:53Speaker 1: twenty twenty five, and compared the information to the laboratory worksheets.
- 4:57Speaker 1: Mister Nodle's observation does appear to be correct, so the
- 5:01Speaker 1: laboratory results for several stains were amended. A stayin F
- 5:06Speaker 1: on the beer pong table in the living room. Results
- 5:08Speaker 1: corrected B stayin at placard forty eight on Mogan's bedroom door.
- 5:14Speaker 1: Results corrected C stayin at placard forty two on Mogan's
- 5:18Speaker 1: bedroom door. Results corrected D stand on placard forty one
- 5:23Speaker 1: on hand rall of stairs from third floor to second floor.
- 5:27Speaker 1: Results corrected E staying at placard thirty five on the
- 5:32Speaker 1: study desk in Kernodle's bedroom. Results added F stain at
- 5:37Speaker 1: placard thirty six on the exterior of kernodles b our door.
- 5:41Speaker 1: Results added G stain at placard thirty seven on the
- 5:45Speaker 1: floor of Kernodle's bedroom near the bedroom door. For delete
- 5:51Speaker 1: original conclusion six from my original report dated August twenty ninth,
- 5:55Speaker 1: twenty twenty four, due to erroneous DNA results for stayin
- 5:58Speaker 1: f on the edge of the beer pong table. The
- 6:01Speaker 1: original conclusion read, a single spatter stain attributed to the
- 6:04Speaker 1: blood of Xana Kernodle, located on the edge of the
- 6:08Speaker 1: west side of the table on the second level, indicates
- 6:11Speaker 1: that she sustained an injury in this area. There is
- 6:14Speaker 1: no physical evidence to indicate that a significant amount of
- 6:17Speaker 1: blood occurred in this area is retracted. Five Observation eight,
- 6:23Speaker 1: regarding screening tests conducted on the debris from the third
- 6:26Speaker 1: floor bathroom, is amended to reflect the weekly positive O
- 6:31Speaker 1: Taladeen test when examined at the laboratory. Six Opinion ten
- 6:36Speaker 1: is added to the report regarding speculation about secondary footwear
- 6:39Speaker 1: transfer stains items examined. On September twenty seventh, twenty twenty three,
