- 0:05A twenty eight billion dollar hemp THC industry is fighting to save
- 0:08itself from a looming federal ban. His
- 0:14article is being read by an automated voice generated by Everlett. In
- 0:20a
- 0:20commercial kitchen outside Raleigh, North Carolina, Nicholas Holmes spreads a blue green
- 0:24goo into a gridded mold, making one of his company's signature products,
- 0:28Potent THC Gummies, featuring the primary intoxicating compound found in marijuana It's
- 0:35a business he might soon have to give up. America's multi billion
- 0:38dollar market for impairing hemp products, from THC seltzers sold at some
- 0:43target stores to smokable cannabis flowers, and different from the regulated legal
- 0:47marijuana industry, faces potential elimination after Congress voted to close a loophole
- 0:52in federal law that has allowed it to flourish. Advocates for the
- 0:56industry, along with some lawmakers, are fighting to save it. The short
- 1:01term government funding bill signed by President Donald Trump last month delayed
- 1:05the effective date of the hemp THC ban from november twelfth to
- 1:09december eleventh, giving Congress more time to consider regulating the products rather
- 1:14than banning the It's such a weird spot to be in, said
- 1:17Holmes. You worked one hundred hours a week for the past four
- 1:21years, and, yeah, you made some money. But now you might have
- 1:24nothing to show for it. Senator Mitch McConnell closed a loophole in
- 1:28the hemp law he championed. Marijuana and hemp are the same plant,
- 1:33cannabis. Marijuana is cultivated for high levels of THC in its flowers.
- 1:37Low THC hemp has historically been grown for its sturdy fibers, food,
- 1:41or wellness products. Rope knot dope was long the motto of farmers
- 1:45who supported legalizing hemp. To give farmers a new cash crop, Kentucky
- 1:50Republican Senator Mitch McConnell successfully pushed the legalization of industrial hemp in
- 1:55the twenty eighteen Farm Bill. But the way that law defined hemp
- 1:59as having less than zero point three percent of a specific type
- 2:02of THC, called Delta nine, by weight, opened a huge loophole. Beverages
- 2:07or snacks could meet that threshold and still contain more than enough
- 2:10THC to get people high. Vape oil, gummy candies, chips, sodas, and
- 2:15other unregulated untested products
- 2:17laden with hemp derived THC spread around the country, including in gas
- 2:21stations or convenience stores, where they were available even to teens. Some
- 2:25businesses start idling marijuana under the theory that raw marijuana's THC is
- 2:29in a form called THC a which only turns into impairing Delta
- 2:33Nine when heated or burned. The products evaded state prohibitions on recreational
- 2:38weed or undercut heavily taxed and regulated cannabis where it is legal.
- 2:43Dozens of States responded by regulating or banning impairing hemp products. McConnell
- 2:49finally closed the loophole late last year by inserting a hemp THC
- 2:53ban into a measure that ended the longest government shutdown in history.
- 2:57The ban which limits the amount of THC in hemp products to
- 3:000.4 milligrams per container wouldn't take effect for a year. An industry
- 3:06tries to save itself. The
- 3:08ban threatens to reduce retail revenues by twenty eight point three billion
- 3:12dollars, displacing two hundred twenty five thousand jobs and reducing state sales
- 3:17tax potential by two point one billion dollars, according to a report
- 3:21last month from Whitney Economics, which studies the market. The industry hopes
- 3:26to save itself by restricting impairing products to people twenty one and
- 3:29older, limiting how much THC can be in a package, and banning
- 3:33imported cannabis compounds. The owners of Kentucky's Cornbread Hemp, Eric Zipperl and
- 3:39Jim Higdon, are prepared to cap their products at, say, five milligrams,
- 3:43if that's what it takes to win support from lawmakers. But the
- 3:47zero point four milligram limit would destroy their business, they said. If
- 3:51it goes through in December, his place is toast. It's gone, Zipril
- 3:55said. They have one hundred and five employees, sell hemp beverages in
- 4:00eighteen states, and expect to bring in sixty five million dollars this
- 4:03year. The zero point four milligram cap is so low that it
- 4:07would ban even some non impairing C B D products, such as
- 4:11topical lotions, said Jonathan Miller, general counsel of the industry group US
- 4:15Hemp Roundtable. Some consider other work. Holmes, who runs Duterman
- 4:21Farms in Clayton, North Carolina, entered the hemp industry after losing his
- 4:25job as a personal trainer during the COVID nineteen pandemic. North North
- 4:29Carolina has not legalized either medical or recreational marijuana, but many of
- 4:34the edibles Holmes makes are more potent than what's available in states
- 4:37that have. When I started seeing THC edibles being sold, I was
- 4:42like, I got eighteen months to two years to make money in
- 4:45this industry, Holmes said. No way is the government just going to
- 4:48sit here and let us do this when this was supposed to
- 4:51be for fiber, plastics, building materials, rope. That was more than four
- 4:56years ago. Holmes kept his capital investments minimal, fearing a shutdown. He
- 5:00has considered making other products, such as creatine gummies, if he has
- 5:04to get out of the hemp THC business. Things have been more
- 5:08stressful for others. Drinkin Buds, a cannabis beverage company in Sheboygan, Wisconsin,
- 5:13has mothballed production. Co founder Matt Swanson took himself off the payroll
- 5:17on Thursday. There's just so much uncertainty, Swanson said. I'm actively looking
- 5:23for employment. Allies and opponents line up. Among those who have come
- 5:28to the
- 5:29defense of the hemp industry are alcohol retailers, including Total Wine and
- 5:33more. Sales of cannabis seltzers have helped offset falling alcohol sales. Opponents
- 5:39include people who say the products are dangerous. I have sympathy for
- 5:44people losing their jobs, but I also have sympathy for the many,
- 5:47many more people whose lives are affected by this, said Kevin Sabet,
- 5:51CEO of Smart Approaches to Marijuana. The regulated legal marijuana industry, which
- 5:56sees hemp THC as unfair competition, also supports the ban. Corey Harris,
- 6:01a lobbyist for state legal cannabis operators, suggested that dire predictions about
- 6:05its effect on the intoxicating hemp industry are overstated. While the ban
- 6:10would end interstate sales of products like THC seltzers and gummies, some
- 6:14could find a home in legal in state markets, he said. It's
- 6:18possible THC drinks could be sold at stores in the states where
- 6:21they were produced. States like North Carolina could adopt legal hemp programs.
- 6:26If you go from having virtually no rules to suddenly having an
- 6:29awful lot of rules, that's a buzzkill, Harris said. Welcome to our
- 6:33world. But if you establish your whole business within a legally questionable
- 6:37loophole, that's just sort of the risk you take. Associated Press reporters
- 6:42Alan G. Breed in Clayton, North Carolina, and Dylan Loven in Louisville,
- 6:46Kentucky contributed.
