- 0:00Hello, good morning. Welcome. I'm Samuel
- 0:03Trap. This International Flavor. I'm
- 0:05coming to you live from the Lake Ozark
- 0:06Real Estate Art Studio. Coming to you
- 0:08live on damradio.comlive
- 0:11uh in uh reverse or in um the past as it
- 0:16were. You know what? We should change
- 0:18it. Instead of uh damradio.com/mpodcast,
- 0:22we should we should call it damradio.com
- 0:29because it's in the past. It's history.
- 0:32It is now history. Kind of like the uh
- 0:36uh and and you know, my initial reaction
- 0:39to this is just
- 0:41bull crap is my initial reaction to
- 0:45this. And I'm not sure if I can get it.
- 0:48They're going to want me to pay for it,
- 0:50I'm sure. And uh let's see.
- 0:54I want to see it, but it does give the
- 0:56page, so I can get on to Pacer and pull
- 0:59it off. Maybe I will try to do that.
- 1:01It's a 26 page docket, and it is United
- 1:07States District Court for the Southern
- 1:09District of Florida.
- 1:12This is now my initial reaction before I
- 1:15ever read this is uh that um let's see
- 1:21that would be us.gov
- 1:23SDFl
- 1:25wouldn't it? Uh let's let's see if we
- 1:28can find this because I've been thinking
- 1:31about this
- 1:33uh
- 1:36stupidity ever since and this is lawyers
- 1:40being a-holes is all this is and um in
- 1:45my opinion and and and idiotic you know
- 1:48is is what this is site cannot be
- 1:52reached I wonder if it's if if if we are
- 1:55blocked in the studio video. Um,
- 1:59wonder why. I wonder if I go to my my
- 2:02base account.
- 2:08I'm sorry to be doing this on the fly
- 2:11while we're sitting here, but this is
- 2:15this is craziness. And here we are
- 2:19again.
- 2:21Uh, where's my registered app? I have to
- 2:25do two-party login.
- 2:28Well, I'm trying to get on and get the
- 2:30the Castro indictment. I want the
- 2:33original document from the court. I
- 2:36don't trust the ones that people people
- 2:39ship out to you um from New York Times
- 2:44and elsewhere. I don't trust any of
- 2:46those people. So,
- 2:48uh nor should you. It's a bad plan all
- 2:52the way around. But I got to get on to
- 2:55my Google authenticator
- 2:57in order to log in. And sorry, you get
- 3:00to walk through this with me, but where
- 3:02is my account? Hello. How's the family?
- 3:0755 5943. We'll get you in.
- 3:12943.
- 3:15And are we in? We are indeed in. Son of
- 3:19a nutcracker. They're doing it again.
- 3:23Uh, so the second time if you have to go
- 3:25in, it's 378-541.
- 3:28378541
- 3:31entered. I understand. Quit quizzing me.
- 3:35Uh, let's see. Please choose a court.
- 3:38Well, I tried to uh
- 3:43SDF.
- 3:46Nope, not South Carolina.
- 3:49F. Sorry you people get to listen to
- 3:52this, but here we are. Florida Southern
- 3:55District. There we have it. Southern
- 3:59District of Florida documents. Here we
- 4:02are. Query.
- 4:04What's this guy's name? Raul Castro,
- 4:07right? C A S T R O. They're indicting
- 4:12him for murder is what I hear. Uh and
- 4:15and you know
- 4:18he's not he's not a citizen of America
- 4:21and and this is my problem. Uh the party
- 4:25defendant is Raul uh Castro Ruse Castro
- 4:31Raul party defendant.
- 4:33Maybe it's cuz he filed action here
- 4:36before and submitted himself previously
- 4:39to uh here's a file closed in 1991.
- 4:44Gonzalez versus Castro. Where where's
- 4:47the latest ones? These are not it. But
- 4:50this gives me the case number. I have
- 4:52the case number. So, at least if they're
- 4:54not lying to us on the uh on the news.
- 4:59Here it is. Case number
- 5:0403
- 5:09USA Raul Modesto Castro ruse.
- 5:14Okay, so we're going to go back um
- 5:17because this was just Ro Modesto party
- 5:22defendant. Here he is. 03
- 5:27filed 821
- 5:29of 03.
- 5:31So they're they're game playing for
- 5:33sure. And if we go to the history and
- 5:37documents and run the query. Oh, yep. So
- 5:41this is so now they're claiming so that
- 5:44you can't see the prior you can't see
- 5:47the prior case filed 423 of 2026. Motion
- 5:52for miscellaneous relief. Order on
- 5:54motion for miscellaneous receive
- 5:56receipt. And then here we go. indictment
- 6:00filed um 423 of 2026.
- 6:06And I'm gonna download this so Jr. can
- 6:09have it later.
- 6:12Cost me $260.
- 6:15My download will come into the zip
- 6:19and we shall keep it up. Here's document
- 6:22number eight. Okay. Sorry to go through
- 6:25all of that with you here, but this was
- 6:29entered on 429 of 2026 and filed by BMDC
- 6:34Angela Noble, Clerk of District Court,
- 6:37US of America by Raul Madestro Castro
- 6:40Ree. So, so this indicates to me that
- 6:43what we're going to do is we're going to
- 6:44be flying into to to uh Cuba uh to you
- 6:50know attacking somebody and here's a
- 6:51superseding indictment general
- 6:54allegations.
- 6:57Let's see.
- 6:59We're going to read this whole thing to
- 7:01you just because. Okay. The grand jury.
- 7:04So, this is a grand jury. First of all,
- 7:06you can indict a ham sandwich into a
- 7:08grand jury because nobody's there. Okay?
- 7:11So, this isn't a prosecutor taking a a
- 7:15stand. This is a prosecutor saying,
- 7:17"Well, citizens, 12 citizens, or eight
- 7:19said whatever the hell they pick. 12
- 7:21citizens indicted this man, so they got
- 7:23to believe something." Well, they only
- 7:24believe what you tell them, you dumbass.
- 7:26They only believe that because you said
- 7:30something to them, and you're the
- 7:32lawyer, so there's nobody present but
- 7:33you. And there's there's nobody for the
- 7:36defense. There's no rules of evidence.
- 7:39There's nothing. It's whatever you say.
- 7:41So if you don't want to indict him,
- 7:44guess what you do? You shut up and
- 7:46nobody gets indicted, right? But if you
- 7:49want him to be indicted, you can say any
- 7:52lie that you want to say and then not
- 7:55take
- 7:57uh what do you call it? Not take
- 7:58responsibility for it. Right? You don't
- 8:01have to worry about all of that. We're
- 8:04and and this is all over J.R.'s TVs is
- 8:06the the reason I'm I'm watching this and
- 8:09I was interested in it anyway, but but
- 8:11oh my god, they've indicted the man.
- 8:13They indicted him on April the 23rd, you
- 8:16[ __ ] It's like, why are we putting
- 8:19it out now? And it was entered in the
- 8:21Florida Southern District docket on
- 8:24April the 29th of 2026. These guys are
- 8:28lying to you just like they always do.
- 8:32and they call it a superseding
- 8:34indictment. Something's happened. Now,
- 8:35first of all, this case is case number
- 8:3703
- 8:39CR20685
- 8:4203. You know what that means? 2003 is
- 8:46the first time they tried to file this.
- 8:48And when you look at the freaking docket
- 8:50and you look at the docket sheet, which
- 8:52is why you have to go to the docket
- 8:53sheet because these people lie and they
- 8:57lie across the board. You know, this is
- 9:00just BS. There's an attachment. It's
- 9:03restricted, which means I can't probably
- 9:04get it. Let's see. This document is
- 9:07sealed and not available. It's probably
- 9:09the original indictment because the
- 9:11document history starts at number six.
- 9:14Document number six. Motion for
- 9:16miscellaneous relief. Let's read that
- 9:18son of a bucket and we'll download this
- 9:21for you. Sealed documents are no longer
- 9:23available in CMS or or CMF or via Pacer.
- 9:27Contact the court directly to request
- 9:29the document. So this document has been
- 9:31sealed. Okay. So this is the request for
- 9:33miscellaneous relief and they sealed it
- 9:36and that is why they've done it and so
- 9:38they don't want you to be able to get it
- 9:40right and they don't want it's not p
- 9:42well it can be public. You send a
- 9:43sunshine request or whatever. And then
- 9:45there's the order for miscellaneous
- 9:46relief. Well, let's see if that one is
- 9:48sealed as well. View document. Uh this
- 9:52one sealed documents are no longer
- 9:53available. So, I'm paying whatever. I
- 9:55paid 10 cents for that uh new document
- 9:59that says, "Haha, you can't have it."
- 10:01Motion to unseal the case. Here's one.
- 10:03And number 10. Motion to unseal.
- 10:07This came afterward. Maybe now this is
- 10:09why it's unsealed, right? Maybe now
- 10:11they've unsealed something. View
- 10:13document. Nothing's happening.
- 10:17I'm trying to pay the the dime. Come on.
- 10:21To accept the charges. view document.
- 10:24Otherwise,
- 10:28nothing. Wonder how many times I paid
- 10:30for that.
- 10:32Wonder how many times I've done that.
- 10:34Let's see. But I do have the indictment
- 10:36now. But you can't get the rest. It's
- 10:38it's uh you know, they object. They
- 10:40don't want to give it to me. Um come on.
- 10:42What have I done? Son of a nutcracker.
- 10:46Let's see if I go back. That's the New
- 10:48York Times. I don't want that version.
- 10:50Uh
- 10:55I don't like you.
- 10:57Well, I'm on a roll today. Let's go back
- 10:59to our uh Southern District of Florida.
- 11:02Pacer login.
- 11:05Southern
- 11:07District
- 11:08Florida.
- 11:11Duh. Duh. Duh. Anyway, I am grumpy about
- 11:16this. Let's go back to the query and let
- 11:19us get our go back to uh uh what's his
- 11:23name?
- 11:26The old
- 11:28what have I been blocked? Hide the case.
- 11:31We want Raul.
- 11:35Raul Perez Perez. That is not who we're
- 11:38after here, folks, friends and
- 11:41neighbors. But where are we in our
- 11:44document download?
- 11:46Okay, let's get back there. We want case
- 11:50number 03CR
- 11:54and the superseding indictment.
- 11:59Here we go.
- 12:01But you can't get the rest. They haven't
- 12:03uh unlocked it. And uh it's it's there's
- 12:08stuff that is unavailable and that is
- 12:11unavailable to us. and Luis Ro Gonzalez.
- 12:16Who are these people there? There's a
- 12:18bunch of people listed. Lorenzo, Alberto
- 12:20Perez, Perez, Emilio, Jose, Pallesio,
- 12:23Blanco, Jose Fidel, Gual
- 12:27Barzaga, Raul Simanca, Cardinas, and
- 12:31Luis Ro Gonzalez, Parardo Rodriguez,
- 12:34defendants superseding indictment. Okay,
- 12:37this thing is how many pages we got
- 12:40here, friends and neighbors. Page one of
- 12:4226, superseding indictment. Introduction
- 12:45since seizing power over the Republic of
- 12:47Cuba in 59. So this is your this is your
- 12:50grand write up of why the US should be
- 12:52able to charge anybody on the planet
- 12:54with murder, which is not what the law
- 12:57says, but they're doing it anyway cuz
- 13:00they're crooks. That's my initial
- 13:01initial take of how you file murder
- 13:04charges against somebody
- 13:06in another country. It's just [ __ ]
- 13:09Since seizing power of the Republic of
- 13:11Cuba in 1959, Fidel Alejandro Castro
- 13:14Ruiz Fidel Castro Raul Modesto Castro
- 13:18Rou Castro Rouge as depicted below. They
- 13:21put their pictures and others establish
- 13:23a dictatorship. The Castro regime
- 13:26designed to maintain and protect their
- 13:28rule and prevent regime change. What do
- 13:30we do? So, we we we engage in regime
- 13:33change. That's what we do. It's what we
- 13:35live for, right? And some people are all
- 13:37happy about this. I am not. It's none of
- 13:39your freaking business. Stay out of it.
- 13:41For the next several decades, Cubans
- 13:43fled to the United States through the
- 13:46Florida Straits, risking their lives and
- 13:48many times resulting in the death of
- 13:50those migrants in those waters on their
- 13:53journey to freedom.
- 13:56Hermanos Al- Rescata, Brothers to the
- 13:59Rescue, Inc., BTTR was organized in
- 14:02Miami and flew unnamed unarmed, sorry,
- 14:05Cessna aircraft to rescue or guide Cuban
- 14:09migrants stranded or lost at sea. In the
- 14:12'9s, BTR's flights also flew to support
- 14:15anti-Castro pro-democracy movements in
- 14:18Cuba. So, they're meddling in other
- 14:20countries. Now, fine. Good for them.
- 14:23That's fine. Cuba sent spies to Miami,
- 14:26Florida to obtain information on BTTR
- 14:29and report back to the Castro regime.
- 14:33These spies were part of a group cenamed
- 14:35Lored Aispa, the Wasp network. The spies
- 14:39successfully infiltrated BTR, reported
- 14:41back to the Castaster regime on BTTR
- 14:44activity. On around January 1996,
- 14:49BTTR flew unarmed Cessna aircraft in or
- 14:51around Cuban airspace and dropped
- 14:53pro-democracy leafets that landed on the
- 14:55Cuban mainland. Cessna aircraft used by
- 14:57BTTR flew at speeds significantly slower
- 15:00than the Cuban MIG uh fighter jets in or
- 15:04around January 1996. The Cuban military
- 15:07headed by Castro Rouge engaged in
- 15:09training missions during which Cuban MIG
- 15:11fighter jets located and followed planes
- 15:14with flight speeds and at the altitudes
- 15:16as those planes used by BTTR.
- 15:20So they trailed them. US does the same
- 15:22thing. You know, if we want to harass
- 15:24somebody, we do the same thing. Escort
- 15:28their planes, right? We seize their
- 15:31ships. We do whatever else we feel like.
- 15:34We surround their island. Okay. In or
- 15:39around February 96, pro-democracy groups
- 15:42in Cuba planned demonstrations in Cuba
- 15:44and BTTR plan to support those desk
- 15:48demonstrations through flights to Cuba
- 15:51at the time of the demonstration. The
- 15:53Castra regime did not permit the planned
- 15:56pro-democracy demonstrations. I imagine
- 15:58democracy would be wellreceived in Cuba,
- 16:02right?
- 16:04Just like it is in Ukraine,
- 16:07right? That's a place isn't corrupt. Not
- 16:10remotely. Right. And BTTR plan blah blah
- 16:14blah. The Castro regime did not permit
- 16:16the planned pro-democracy demonstrations
- 16:18in Cuba at that time. There's a
- 16:21surprise. They know that it's a
- 16:23dictatorship. You already said that
- 16:24ahead. You said that. Well, Qatar is a
- 16:26dictatorship dictatorship, too. I
- 16:29imagine if we went and scheduled a
- 16:31pro-democracy
- 16:33um uh what do you call it? A
- 16:35pro-democracy demonstration in front of
- 16:39the uh prince's residence or in the
- 16:43prince's private airport right next to
- 16:46the real airport, then you might have
- 16:49some arrests and people punished for it
- 16:53because guess what? That's a
- 16:55dictatorship, too.
- 16:58It's a but we're not attacking Qatar.
- 17:01We're not attacking anybody else that
- 17:03has dictatorships around the planet.
- 17:05Well, secretly we are, but we're not
- 17:07charging them with murder, you know.
- 17:08We're we're getting new airplanes from
- 17:10them. They're getting new airplanes, you
- 17:13know. Oh, geez. What? Well, since
- 17:14they're our friends and they provide us
- 17:16with oil and they don't piss us off like
- 17:18everybody else does. Well, you know what
- 17:20we'll do? Since they lick our rear ends,
- 17:23we will lick back
- 17:26and we'll never say a word. But if we
- 17:28don't like you, we're going to fly in,
- 17:30send some special forces goons to go in
- 17:32there and kill people uh and seize you
- 17:35and arrest you for criminal charges in
- 17:38America. Why? Because we're the biggest
- 17:41swinging dicks on the planet. And that's
- 17:44what we do because we played football.
- 17:46Hurwah, we play we're in the Marines.
- 17:48Hurrah. You know, that's what we did.
- 17:50And so in or around 26, these
- 17:52pro-democracy groups planned their
- 17:54demonstrations. They didn't get a go.
- 17:55The Castro regime didn't permit them.
- 17:57Surprise. And the planned per democracy
- 18:00demonstrations at Cuba at that time and
- 18:02instructed its spies not to fly with
- 18:05BTTR during the planned BTTR flights in
- 18:09February 96.
- 18:13On February 24, sorry about that. On
- 18:14February 24th, 1996, three BTR aircraft
- 18:19flew from South Florida toward Cuba
- 18:22anyway, and Cuban MiGs shot down two of
- 18:26them in international waters, killing
- 18:29four US nationals and three American
- 18:32citizens. Okay. Well, if you're going to
- 18:35take risks like that, how do I want to
- 18:38put this? If you're going to go to
- 18:40Ukraine and fight on behalf of Ukraine
- 18:43in Ukraine against the Russians and the
- 18:46Russians kill you, that's not on us.
- 18:50We don't get to charge
- 18:53Vladimir Putin with a crime because he
- 18:57happens to lead the country that you are
- 18:59fighting against and somebody killed
- 19:01you.
- 19:02It's crap. Do we say it's I mean we say
- 19:05the same thing, right? We say the same
- 19:06thing. If a if a Ukrainian goes into
- 19:10Russia and bombs in Kursk and and any of
- 19:13these foreigners that ran in there,
- 19:16which they did, a lot of mercenaries in
- 19:18there, a lot of US mercenaries in there,
- 19:19a lot of British, a lot of them have
- 19:21been captured in the U in the and in
- 19:22Russia, they're all over the news and
- 19:24and we are all up in arms. Oh, these
- 19:26people ought to be given Geneva
- 19:28Convention status. They're war
- 19:30combatants. No, they're not. They're
- 19:32freaking terrorists. They're
- 19:33mercenaries.
- 19:35They are. That's what they are. They
- 19:37were hired as mercenaries and they went
- 19:39over. They are not subject to the Geneva
- 19:42Convention. They're committing crimes.
- 19:44And that's true. You're a mercenary.
- 19:46You're not a You're not a a a combatant.
- 19:50You're not a combatant. You You are not
- 19:52fighting. You're You may be fighting on
- 19:54behalf of a country, but you're not part
- 19:56of their armed forces. You're not. Most
- 19:59of them don't even speak Ukrainian. It's
- 20:01crazy. Well, most Ukrainians don't speak
- 20:03Ukrainian.
- 20:05It's crazy. Uh, and I shouldn't say
- 20:08most, but a very good percentage.
- 20:10Anyway, including these three American
- 20:12citizens were all shot down. And you may
- 20:14not like what I'm saying. I don't care.
- 20:16This is the truth anyway. And so, you
- 20:19might be going, "Yeah, but yeah, but we
- 20:21need to do what's right. Who are we to
- 20:23determine what's right? Who the hell are
- 20:26you to determine what's right? My right
- 20:28might be different than your right."
- 20:29Right? So, here you're going to hear my
- 20:32right. If you want to call and argue
- 20:33with me, please do. 573746820.
- 20:37Convince me why some why we have
- 20:40jurisdiction over the planet other than
- 20:42saying we have the biggest military and
- 20:44the biggest dicks. That's it. We're so
- 20:47we're the we're the big bad we're the
- 20:48big bad wolf and therefore we get to do
- 20:50what we want. The end. That's it. That's
- 20:52what power buys you and you buy into
- 20:55that power narrative. You know that's uh
- 20:57you know a lot of people aren't going to
- 20:59like that, right?
- 21:01So anyway, let's get to the Castro
- 21:03regime here. They they subtitle. Here's
- 21:05sub paragraph one. Fidel Castro, Castro
- 21:07Ruse, and others seized power in Cuba on
- 21:09about January 9, 1959. Overthrowing then
- 21:12President Fulgensio Batista Ualdivar.
- 21:16The Castro regime controlled Cuba
- 21:18thereafter.
- 21:19The cat paragraph two. The Castro regime
- 21:22established various ministries to

- 22:19that's the unindicted co-conspirator
- 22:22one. They didn't indict him but they
- 22:24listed him as a co-conspirator. From in

- 22:30Castro Reese uh was the minister of

- 22:55Co-conspirator 2 was the base commander

- 23:23Francisco Perez Perez was also a trained
- 23:26MIG fighter pilot in DAA F during this
- 23:30time
- 23:32and they have pictures of them. Okay.
- 23:35At least as early as in or around 1992
- 23:38through February 24, 1996, La Perez
- 23:41Perez, Blanco Barzaga, Cardinius, and
- 23:43Rodriguez and LF Perez Perez were jet
- 23:46fighter pilots stationed at San Antonio
- 23:49de Laspanos airfield in Cuba.
- 23:53Okay, that's the background of the
- 23:55people. So, these people were uh fighter
- 23:58pilots. Okay, the other people Castro
- 24:01Ruse and others known and unknown to the
- 24:03grand jury,
- 24:05of course, because you don't freaking
- 24:06know. Cast and others known and unknown
- 24:09to the grand jury. You can indict a ham
- 24:12sandwich member grand jury. You ever get
- 24:14called to a grand jury, you got to say,
- 24:15"No thanks. This is crap. There's nobody
- 24:18to There's nobody to tell the other side
- 24:20of the story." You get one side of the
- 24:21story. If you can't win here, lawyer,
- 24:23you're a terrible freaking lawyer. And
- 24:25the lawyer, the prosecutor that goes up
- 24:27and says and and the prosecutor uh goes
- 24:30and gets a an indictment, tries to get
- 24:32an indictment by providing a uh an a
- 24:35sealed or unsealed indictment and gives
- 24:37it to the uh to the uh grand jury and
- 24:41the grand jury doesn't give him an
- 24:43indictment. That's a shitty lawyer. That
- 24:46is a very bad lawyer. And they go,
- 24:48"Well, the grand jury didn't find enough
- 24:50evidence." Oh, idiot. Because you didn't
- 24:53tell them more. Just lie. That's what
- 24:55everybody else is doing. The whole
- 24:56thing's a scam anyway. You get one side
- 24:59of the story. A grand jury is nothing.
- 25:03You think it's grand. Why? Cuz they call
- 25:05it grand. It's grand. Oh my god. I've
- 25:09been invited to the grand jury. Isn't
- 25:13that grand? That's just freaking grand.
- 25:15I've been invited to the grand jury.
- 25:18Wonder who's going to show up? Nobody,
- 25:20you [ __ ] Nobody shows up. The only
- 25:23person standing there is the prosecutor.
- 25:25He gives you a presentation and at the
- 25:27end says, "Now, do you think we should
- 25:29indict him or not?" And you go, "Yeah, I
- 25:32only heard one side of the story. So,
- 25:34let's go watch a movie. Um, let's let's
- 25:37go watch a movie." And at the end of the
- 25:39movie, go, "Boy, that was a bad dude.
- 25:41That that Joker, he was a bad guy. Let's
- 25:45indict the actor who played him. That's
- 25:47the same freaking thing, you [ __ ]
- 25:51If you think the grand jury is grand,
- 25:54you better think again. It ain't so
- 25:56grand. It's stupid. And you what they
- 26:00have, okay, so in in in most states, and
- 26:02by the way, uh it's hard to do
- 26:04afterward. You have to file a motion to
- 26:06dismiss or you got to do something. But
- 26:07if they have the grand jury, suddenly
- 26:09they don't have to have a preliminary
- 26:10hearing, right? They don't have to have
- 26:12one. they've had the preliminary
- 26:13hearing. So, in a preliminary hearing,
- 26:15most lawyers go and and the reason they
- 26:18go to see the preliminary hearing. So,
- 26:19you get charged with a felony. You go to
- 26:21court in a felony, the very first step,
- 26:23and your idiot lawyer, if he isn't doing
- 26:25it, he's an idiot in my opinion. Okay?
- 26:27and uh or he has strategic other thing.
- 26:30But you better find out exactly why he's
- 26:32not doing it because the first thing
- 26:34that you should do if you're charged
- 26:36with a felony, especially in the state
- 26:38of Missouri, is at the end of it say,
- 26:42you know, before you ever because what
- 26:43happens is you'll get sent to associate
- 26:45court. You go to the lower court and in
- 26:47the lower court you sit there and your
- 26:48only thing at the lower court is either
- 26:51get a uh uh wave the preliminary hearing
- 26:56or they have a preliminary hearing. Even
- 27:00if you don't ask a question, go to the
- 27:04preliminary hearing cuz you'll get the
- 27:06evidence. You'll get to see what the uh
- 27:09prosecutor presents to the judge to
- 27:12charge you. He has to have all the
- 27:14elements of the crime. And if you got a
- 27:17good judge, judge might just throw it
- 27:18out. And if you have a good lawyer, you
- 27:20may win at the preliminary hearing part.
- 27:22This is where you attack the sufficiency
- 27:24of evidence. Okay, so here's this grand
- 27:27jury indictment. Why are they telling us
- 27:30all this? Why why are they giving us
- 27:31this whole long story of drama at the
- 27:34end? Because this is the movie they
- 27:36played for the grand jury. That's why.
- 27:39And so I'm sharing it with you. The
- 27:40grand jury process is a joke. Okay. And
- 27:43maybe not in every state. Maybe they
- 27:45have different provisions in different
- 27:47states, but in federal court and in
- 27:49state court, you don't get to be there.
- 27:52Okay? In Missouri, at least in most
- 27:54other places, doesn't freaking matter.
- 27:56If you have a preliminary hearing
- 27:57process, though, that's a different
- 27:59deal. You get to have a hearing to find
- 28:01out if there's sufficient information to
- 28:03charge you with a crime. Now, you're
- 28:06charged with a crime. The preliminary
- 28:08hearing replaces the grand jury. Okay?
- 28:11Then you can file an indictment. The
- 28:12indictment has to be heard by who? The
- 28:14grand jury. The grand jury hears it. Now
- 28:16they don't have to do anything. You they
- 28:18don't you don't get the right to have a
- 28:19hearing. There was Well, there's already
- 28:21been a a a a sort of preliminary
- 28:23hearing. There's a grand jury
- 28:24indictment. So the grand jury indictment
- 28:27gets rid of the need to have a
- 28:29preliminary hearing. Okay. And the state
- 28:31level. Okay.
- 28:34And there are ways, you know, there's
- 28:36defenses and all that is different for
- 28:38different charges, different for
- 28:39different stuff like that. But the
- 28:40reason you have a grand jury is because
- 28:42a grand jury is a joke and that that
- 28:44this lets people believe that there's
- 28:46some formal legal process that it's it's
- 28:48really [ __ ] But they put it out
- 28:50there anyway cuz there's nobody there to
- 28:52defend the accused. Nobody. And this is
- 28:55how you get past step one of charging
- 28:57somebody with a felony. So all you have
- 29:00is the basics. And so now if you go to
- 29:02trial and you go through, you have to
- 29:04attack the basics because you you have
- 29:07they've already gotten the right to
- 29:08charge you by putting this crazy
- 29:10[ __ ] uh process called the grand
- 29:14jury in your lap. Okay. So now we're
- 29:17going to have the background of the
- 29:18shootown. We have the background of the
- 29:20participants. You know what they did.
- 29:22And now we have the background to the
- 29:24shootdown. Castro Ruse and others known
- 29:27and unknown to the grand jury used their
- 29:30leadership, membership, and association
- 29:33to form a dictatorship with absolute
- 29:36authority in Cuba. Oh my god, that's
- 29:38horrible. Grand jury is sitting there
- 29:40thinking that's atrocious. They they're
- 29:42dictators, man. These are dictators. Of
- 29:46course, they're the bad guys. The Castro
- 29:48regime established and maintained
- 29:50control over Cuba and her people through
- 29:53a reign that eliminated disscent,
- 29:55preserved their power, territory, and
- 29:57reputation, and through expropriation
- 29:59and nationalization of private business
- 30:02funded those objectives. Gee, that
- 30:04sounds just like America. Only here we
- 30:07call it democracy. There they call it
- 30:10they call it that's a dictatorship. You
- 30:13think you think of the Clinton regime,
- 30:15the the Biden regime, Obama, you think
- 30:17that's not that's not those guys are all
- 30:20above board, right? They've never done
- 30:22anything. They never kill anybody. They
- 30:25didn't fly jets and kill, you know,
- 30:27private citizens. What about Israel?
- 30:30They don't just go out and kill
- 30:32humanitarian aid workers. That had never
- 30:34happened. They don't just fly into other
- 30:36countries and bomb the [ __ ] out of them,
- 30:37killing all kinds of civilians. They
- 30:39don't do that. No, no, no. We would
- 30:42never do that. We're a democracy. We're
- 30:44the good guys, right? We are the good
- 30:46guys. Well, we should quiz that because
- 30:49we're really not all that great. You
- 30:51know, individually, we're decent. You
- 30:53know, we're good folks. But don't go
- 30:55thinking that just because you happen to
- 30:56be elected that you're some kind of a
- 30:59good guy. I mean, just look in the look
- 31:01in the look in the state houses. Look
- 31:04around you. Wake up. Beginning in or
- 31:08around 1959, Cubans fled the Castro
- 31:10regime. Oh my god. They've been fleeing
- 31:13to the United States of America and
- 31:15elsewhere. Well, you know, there's
- 31:16plenty of Ukrainians here. Maybe they've
- 31:18been fleeing. Maybe they've been fleeing
- 31:22not a war. Maybe they've been fleeing
- 31:25the BS structure of the dictatorship
- 31:29that we installed.
- 31:31Maybe that's what they're doing. You're
- 31:34pretty selective in choosing who you get
- 31:36to charge with the crime, right? I
- 31:37better hurry this up or I'm never going
- 31:39to make it through. Beginning in I'm I'm
- 31:42having too much fun with this. This is
- 31:43crap. This is complete crap. The
- 31:47beginning in or around 1959, Cubans fled
- 31:49the Castro regime. Blah blah blah. I
- 31:50already said that. Beginning in at least
- 31:52or as early as around 1960. Oh my god.
- 31:55They've been doing it for 65 years. The
- 31:58former Soviet Union allied with Cuba. Oh
- 32:02my god. Vladimir Putin once again is the
- 32:05guilty party. Holy crap. It's Vlad. He's
- 32:09at it again. Beginning in 1960, the
- 32:13former Soviet Union allied with Cuba and
- 32:16pro began providing the Cuban government
- 32:19with significant economic and military
- 32:21support.
- 32:24Now, that's a big deal. I mean, my god,
- 32:26the US government doesn't ally with
- 32:29other countries and provide any of them
- 32:31with significant economic and military
- 32:33support. That doesn't happen, does it?
- 32:35in around 1978. I I want to know what
- 32:38sense that that what what what benefit
- 32:41that sentence has in here other than to
- 32:44say Soviet Unions are bad dudes. Those
- 32:47are some bad people. It was a bad it was
- 32:51a good theory. It just you you know
- 32:54can't quite work that way. Doesn't work
- 32:57that way.
- 32:58Doesn't work that way. Beginning uh
- 33:02inner well in or around 1978, the US and
- 33:05Cuba reached an agreement establishing a
- 33:09maritime and airspace boundary in the
- 33:12straits of Florida and elsewhere based
- 33:14on an equidistant measurement at the
- 33:1724th parallel, that is 40 to 60 nautical
- 33:21miles north of Cuba and well beyond
- 33:25Cuba's 12mile maritime and airspace
- 33:28jurisdiction.
- 33:30So they're talking about having some
- 33:32some rules, right? The 24th parallel did
- 33:37not extend Cuban maritime and airspace
- 33:39jurisdiction, but did serve as an
- 33:41operational identifier, triggering
- 33:43nottorious requirement to Havana air
- 33:46traffic control when planes crossed the
- 33:4924th parallel and route to Cuba. In or
- 33:52around 1980, Cubans fled Cuba by boat
- 33:57inmas from the Mariel Harbor through the
- 34:00Florida Straits. While many Cubans
- 34:02survived that voyage, others perished at
- 34:05sea.
- 34:07After the Soviet Union dissolved in '
- 34:0991, their economic support for Cuba
- 34:12ceased. Cuba suffered economic recession
- 34:15which peaked in around 94. Cuban
- 34:18citizens continued to flee the Castro
- 34:20regime for the United States by boat
- 34:23raft and makeshift flotation vessels,
- 34:26including many who did not survive the
- 34:28journey. During that time, BTR rescued
- 34:32many fleeing Cubans at sea. At least as
- 34:36early as in or around 92, the DI, that's
- 34:40the Defense Intelligence Directorate,
- 34:43Directorate of Intelligence, sent spies
- 34:45to the center district of Florida to,
- 34:47among other tasks, infiltrate BTR and
- 34:51report to the Castro regime on its
- 34:54activities. Now, riddle me this, Batman.
- 34:58Are we not engaged in the same thing in
- 35:03reverse? Are there spies from America
- 35:07going into Cuba? Now, if they get caught
- 35:10on Cuban sto so soil, they're going to
- 35:12be killed or they're going to be denied
- 35:14by the United States, right? So, these
- 35:17guys, they they're the ones with all the
- 35:19genius. And I'm sure they didn't have to
- 35:21provide any of this evidence, but this
- 35:22is what they put. Those spies included
- 35:25Renee Gonzalez
- 35:27aka Castor aka Iselene and Juan Pablo Ro
- 35:33aka German aka Vedit. The spies posed as
- 35:39exiled pilots fleeing Cuba. Juan Pablo
- 35:43Ro also offered himself to the FBI as an
- 35:45informant on the activities of Miami
- 35:47based exile groups including BTR.
- 35:51the DIA directed and controlled his
- 35:54cooperation with the FBI. That's
- 35:56comfortable for you to say now, right?
- 35:59But back then, I guarantee you didn't
- 36:01either know that or you wouldn't have
- 36:03said it. And you you know, who knows
- 36:05whether it's true even now.
- 36:08This is this is it's it's you're not
- 36:10allowed to lie to the court, right?
- 36:12You're not allowed to. But but all of
- 36:13this is questionable questionable stuff.
- 36:17What evidence do you have of all this?
- 36:18Oh, we gave that to the grand jury, did
- 36:20you? You showed them a movie and they
- 36:22said, "Yeah, let's get these guys."
- 36:24That's what you did.
- 36:26And and how do you have anything if it's
- 36:29not if it if you're not willing to
- 36:30subject it to cross-examination by
- 36:33somebody else with a different uh focus
- 36:36with a that that isn't doesn't have the
- 36:38same goal as you to indict somebody.
- 36:42On about July 13, 1994, 70 Cubans
- 36:45attempted to flee the Caster regime in a
- 36:47tugboat named El de Marzo. The 13th of
- 36:50March, the Castro regime's coast guard,
- 36:51a branch of military controlled by
- 36:53Castroiz, sank the tugboat and killed
- 36:55dozens of their own citizenry. What does
- 36:58this have to do with anything? They sunk
- 37:02a tugboat of people trying to leave and
- 37:04they said, "You're not leaving." If
- 37:06America had a rule that said you
- 37:07couldn't take your tugboat and leave
- 37:09American waters and said, "By the way,
- 37:11if you go out there, we're going to kill
- 37:13you."
- 37:15Hm. H
- 37:18wonder what would happen there. Shortly
- 37:20thereafter, in or around August 1994,
- 37:23Cubans filled the streets in protest
- 37:25along with the iconic seaw wall known as
- 37:27El Malikon in Havana, Cuba in response
- 37:30to castaster continued repression of
- 37:32seafaring migration to the United
- 37:34States. On about November 1994, three
- 37:37unarmed United States civilian aircraft
- 37:40operated by BTTR dropped leaflets and
- 37:44other items that landed on the Cuban
- 37:48mainland.
- 37:50H. So, American aircraft flying over.
- 37:56What does this show?
- 37:58Oh, now I'm going to have to find out.
- 38:01Um,
- 38:03tell you what, the Castro regime took no
- 38:05military action against those aircraft.
- 38:08Isn't that crazy? Sorry, I got
- 38:10distracted. Honor about July 13, 1995.
- 38:14Four unarmed US civilian aircraft
- 38:16operated by BTTR
- 38:19flew along with a maritime flotilla from
- 38:21the US toward Cuba to commemorate the
- 38:23sinking of the El Traitz de Marta. So on
- 38:2713th of July they were celebrating the
- 38:29sinking of the 13th of March. The Castro
- 38:32regime's coast guard met the flotilla
- 38:34and formed a blockade. The Castro regime
- 38:36dispatched MIG fighters to the area. The
- 38:38regime took no further action. In or
- 38:41around 95, a Cuban dissident group
- 38:43advocating for peaceful transition from
- 38:45Castro to a democratic government formed
- 38:47in Cuba. They were known as Consilio
- 38:50Kubano.
- 38:53On or about January 9, 1996 and January
- 38:571396, four unarmed civilian aircraft
- 38:59operated by BTTR flew leafits containing
- 39:02epserts from the US nations uh United
- 39:04Nations Universal Declaration of Human
- 39:07Rights that landed on the Cuban
- 39:09mainland. Cubans including members of
- 39:11Consilo Kubano received the lease.
- 39:14Consilo Kubano planned a meeting to
- 39:16begin on about February 24, 1996. The DI
- 39:19Defense Intelligence Directorate on
- 39:21behalf of Castro regime formulated
- 39:23operation a scorpion operation scorpion
- 39:26to perfect the confrontation of the
- 39:29counterrevolutionary actions of BTTR and
- 39:31provided instructions to its Miami based
- 39:34agents to continue to provide
- 39:35information to on BTTR plans and
- 39:38activities but not to fly with BTTR to
- 39:41Cuba in around February 96.
- 39:46Part of the operation scorpion's mission
- 39:48was for the Wasp network to provide
- 39:49information related to BTTR which
- 39:51notably included any flight plan toward
- 39:53Cuba on February 2496 to coincide with
- 39:55the concealer Kubano meeting. The Wasp
- 39:58network provided information with the DI
- 40:00in which the DI was to turn provided uh
- 40:02was in turn to provide to the Cuban
- 40:05military including DEFAR Castroiz and
- 40:07the Castro regime in response to BTTR
- 40:09flights honor about January 96 and honor
- 40:12about January 1396 and in anticipation
- 40:14of future flights by BTTR uh DAFF
- 40:18engaged in training missions. This is
- 40:19the flight people with their MIG fighter
- 40:21pilots including La L Perez Press,
- 40:24Blanco Baraga, Cardinius Rodriguez, and
- 40:26LF Perez Press. The pilots practiced
- 40:29locating and flying low, slowflying
- 40:31civilian aircraft like the ones used by
- 40:33BTTR. At about this time, the Castro
- 40:36regime quashed Cusilio Kubano's planned
- 40:38meeting and prevented the organization
- 40:40from gathering on February 24,96 and
- 40:43thereafter.
- 40:45Okay, so these are all activities of a
- 40:47foreign government taken on foreign
- 40:49soil. Nothing has happened. If they
- 40:52didn't capture any of these guys, maybe
- 40:54they did and they're charging them with
- 40:55crimes. And so, uh, that's fine because
- 40:58they're in your jurisdiction and you
- 40:59catch them here. If you can catch them
- 41:01here, you can get them for murder, but
- 41:03you can't get them for murder in
- 41:04somewhere that occurred elsewhere in the
- 41:06world. Okay? The murder had to occur in
- 41:08the jurisdiction you're flying in. Okay?
- 41:11And and that's what they're talking
- 41:13about. Remember that little line that
- 41:14they gave you about here's a line that
- 41:15we agreed to under treaty. We said we'd
- 41:18give notice to each other and we
- 41:19wouldn't go any further than that.
- 41:20That's how I'm I'm that's seems to be
- 41:22the way they're trying to claim
- 41:23jurisdiction over these planes shot down
- 41:25uh over um um probably the Cuban spaces,
- 41:28but we're not there yet. Let's get to
- 41:30the shootown. And and that'll that that
- 41:32would give you uh maybe give you
- 41:34jurisdiction in the uh federal court in
- 41:38Florida, but I doubt it because it
- 41:40doesn't cover the sea. It covers
- 41:44everywhere else, right?
- 41:46A jurisdiction on a boat, that's
- 41:48different. If you have a jurisdiction on
- 41:50a boat and on a US boat, US licensed
- 41:52boat, something like that, maybe that
- 41:54would work, right? Maybe. But you can't,
- 41:57you know, you still got to have both
- 41:58parties located in the boat. If I blow
- 42:00up a boat from somewhere else, I'm not
- 42:02on the boat. I just blew up a licensed
- 42:04boat, right? You're not on that boat.
- 42:06You can't take jurisdiction of me on a
- 42:08boat that I'm not on as the captain of
- 42:10that boat. Anyway, the shootown. Now
- 42:12we're getting to the meat. At BTTR's
- 42:14January 96 flight, Casteries authorized
- 42:16use of deadly force against BTTR. Okay,
- 42:19that's his prerogative as he can say,
- 42:21"Kill those bastards. Shoot them down."
- 42:24You think we don't do the same? What do
- 42:26we do in America? Blow up that uh blow
- 42:28up that leader of Iran. Blow up his son.
- 42:31Blow up his wife and kids. Blow up that
- 42:33school over there full of girls because
- 42:35all the elites are over there going to
- 42:37school. You know, blow up Gaza. you
- 42:39know, blow it the freak up. Why not? I
- 42:42mean, geez, we're What are they going to
- 42:43do? Charges with murder? I don't think
- 42:45so. Not in America.
- 42:47They might be. If they could catch us in
- 42:49Iran at the time Donald Trump flies to
- 42:52Iran and maybe they'll pick him up and
- 42:55go, "Well, sir, we're going to charge
- 42:56you with a crime. Have a nice day." And
- 42:58they put him in prison. Okay. So, that's
- 43:00how you get jurisdiction. You don't get
- 43:01jurisdiction by creative means like
- 43:03this. This is good stuff. So, I'm I'm
- 43:05eager to find out where they're going.
- 43:07But I'm only halfway through and I'm
- 43:09only nine pages of 26. So I got to
- 43:11cruise a little faster and quit
- 43:12commenting and yelling at people. So
- 43:16Castro authorized the use of deadly
- 43:18force against BTTR. Oh my god. After
- 43:22January 1996,
- 43:24at least as early as in or around
- 43:26February 94 and continuing through at
- 43:28least around July 96, the military chain
- 43:31of command at San Antonio deboss
- 43:33airfield in Cuba was from the air base
- 43:35to Dayfar. from Dfar to Minfar then back
- 43:37down the same chain of command. All
- 43:39orders to kill by the Cuban military
- 43:41traveled through this chain of command
- 43:42with Castro and Fidel Fidel Castro as
- 43:45the final decision makers. Okay, similar
- 43:49Donald Trump if he chooses to kill the
- 43:51leader the Alamei they want to kill him.
- 43:55Trump gives the order. Okay, Trump
- 43:57ordered that guy killed. Period. End of
- 44:00sentence. Okay, so there you go. that
- 44:03happened and uh he gave that order while
- 44:05located on American soil. He's more
- 44:07guilty of a crime of murder in America
- 44:10than they're ever going to be able to
- 44:12establish by any creative weaving of a
- 44:14tale like I'm telling you right now.
- 44:16Okay? And not that I'm saying you should
- 44:18be. These are decisions that are made by
- 44:20foreign governments all the time. What
- 44:22was what was uh um Maduro charged with?
- 44:26Possession of machine guns. Possession
- 44:29of machine guns. That's even more
- 44:31creative. That is even more [ __ ] by
- 44:32the way. But uh uh this one, let's we'll
- 44:35we'll get to the end because I haven't
- 44:36read all this. I just knew I I knew what
- 44:38it was going to contain before I read
- 44:40it. So, I chose to do it right here.
- 44:41Right here live. So, you're getting
- 44:43Sam's live thought process while I read
- 44:46this horse crap. Uh uh indictment. Oh my
- 44:49god. They've indicted someone at the
- 44:51time of their destruction. Okay. Wait,
- 44:53wait, wait, wait, wait.
- 44:55On or about February 2496 at 1:30 p.m.
- 44:59approximately three unarmed US civilian
- 45:01aircraft operated by BTTR bearing tail
- 45:04numbers and November 259, November 2456
- 45:09Sierra and November 5485 Sierra left
- 45:14Opaaka
- 45:15airport in Miami Dade County, Florida.
- 45:18Honor about February 24, 1996, a DFR MIG
- 45:21fighter jet upright by La Perez Pres and
- 45:23LF Pres destroyed two of the BTR
- 45:26aircraft bearing tail numbers November
- 45:282456 Sierra and November 5485 Sierra.
- 45:33They killed four United States nationals
- 45:36including US citizens,
- 45:38three US citizens. At the time of their
- 45:41destruction, the two BTTR aircraft were
- 45:44flying outside Cuban territory. In fact,
- 45:47they're flying over international water
- 45:49traveling away from Cuba despite their
- 45:51contact with the Tavana air traffic
- 45:53control tower. Cuban military did not
- 45:55provide BTTR with any warning of the
- 45:58imminent destruction of their aircraft.
- 46:01Okay, those are facts that maybe maybe
- 46:04can be proven. Maybe they were just said
- 46:05in a movie format to the uh grand jury.
- 46:08After the Castro regime shot down the
- 46:10two BTTR aircraft, Barzaga, Cardinius,
- 46:13and Rodriguez followed the third BTTR
- 46:15aircraft with tail number November 256
- 46:18near the 24th parallel. But that
- 46:20aircraft escaped destruction.
- 46:24And then you show a picture of this soul
- 46:26surviving aircraft on February 26. Count
- 46:29one. Okay, those are the facts. Those
- 46:31are the facts. Okay, count one. Count
- 46:35paragraph count one. conspiracy to kill
- 46:37a US national under USC 18USC section uh
- 46:422332B2
- 46:44paragraph 1 through 33rd of the general

- 47:36by BTTR. Which conspiracy contemplated
- 47:39their murder? As defined in title 18, US
- 47:43code uh section 111, I'm sorry, 1,111,
- 47:48sub paragraph A. Object of the
- 47:50conspiracy was the object of the
- 47:52conspiracy to kill US nationals by
- 47:54shooting down BTTR aircraft using
- 47:57information provided by spies in Miami
- 47:59to terrorize, intimidate, and retaliate

- 48:03community.
- 48:05Overt acts to achieve the objective of
- 48:07this conspiracy. defendants and their

- 48:15the southern district of Florida and
- 48:17elsewhere because they know it's not
- 48:18southern district Florida in or around
- 48:201994 after BTTR's November 1994 flights
- 48:23and dropped leaflets in Cuban territory
- 48:25DI formulated plan for Juan Pablo Ro to
- 48:28fly to a BTTR aircraft to Cuba in late
- 48:31'95 to embarrass and undermine BTTR
- 48:34what's that got to do with anything
- 48:35seriously
- 48:37honor about December nomber 4, 1995. DI
- 48:40agreed to that Raul that Juan Pablo
- 48:43wrote should continue to inform on BTTR.
- 48:45Okay. At least as early as January 1396.
- 48:48And after BTR's January 96 and January
- 48:511396 dissemination of leaflets that
- 48:54landed on the Cuban mainland, Castro
- 48:55Ruse met with military leaders and
- 48:57authorized them to take decisive and
- 48:59deadly action against BTTR aircraft.
- 49:02Okay. He said what any leader would say.
- 49:04America would say that. China, you can't
- 49:06come fly your [ __ ] into our territory
- 49:09and drop leaflets telling Americans that
- 49:11Donald Trump is fat. You can't do that.
- 49:14You're not allowed. And so therefore, I,
- 49:16Donald Trump, say, "Blow those aircraft
- 49:17up if they cross our airspace again."
- 49:19You think we're not going to do that?
- 49:20We're absolutely going to do that. On or
- 49:23about January the 18th, 1996, DI
- 49:25instructed was network to report on US
- 49:27military personnel and asset movement as
- 49:28well as the United States military
- 49:30preparedness at the Bokeh Chica Naval
- 49:32Air Station. a United States military
- 49:34installation located in Key West
- 49:37Southern District of Florida. Honor
- 49:39about January 1896, DI instructed Juan
- 49:42Pablo Rokin and Renee Gonzalez to
- 49:44determine what aircraft BTTR used and
- 49:46other details regarding its January 13
- 49:50flight. Oh my god, they're looking for
- 49:52information on how to stop these people.
- 49:54On or about January 2696, Gardo
- 49:57Hernandez, a Cuban spy operating in the
- 49:59southern districts of Florida, returned
- 50:01to the US from Cuba with approval for
- 50:02Operation Scorpion and cancelling his
- 50:04previous plan for Juan Pablo Rou to fly
- 50:06a BTTR plane to Cuba to embarrass an
- 50:09undermined BTTR.
- 50:12But on about January 29, 96, DA convide
- 50:14instruct conveyed instructions to its
- 50:17Miami based spies regarding Operation
- 50:19Scorpion and the approved confrontation
- 50:21with BTTR. That's on change 29. On about
- 50:25January 3096, the DI instructed Juan
- 50:27Pablo Ro and Renee Gonzalez to avoid
- 50:29flying with BTTR and to use the
- 50:31particular phrases over the radio to
- 50:33communate with Cuba if they were on the
- 50:35flight with BTTR. On about February 196,
- 50:38the DI and its agents in the Southern
- 50:40District of Florida and elsewhere began
- 50:42planning Pablo Juan Pablo Ro's return to
- 50:45Cuba. The DI informed uh Gerardo
- 50:47Hernandez that the DI wanted Juan Pablo
- 50:50filmed entering and leaving a
- 50:51CubanAmerican exile group headquarters.
- 50:55On or about February 3rd or February
- 50:575th, 96, the DI instructed its agents to
- 51:01make Operation Scorpion a priority and
- 51:04urgently report to BTTR flight data. On
- 51:07about February 13, Cuban spies operating
- 51:09in Sardisa, Florida directed Renee
- 51:12Gonzalez to provide clear, detailed,
- 51:14precise information about upcoming BTTR
- 51:16flights. They ordered R. Renee Gonzalez
- 51:18not to join any flight and directed that
- 51:20if he could not avoid flying with BTTR,
- 51:23he should broadcast specified phrases
- 51:25via the aircraft's radio. On about
- 51:27February 18,96, DI instructed that Juan
- 51:30Pablo Rook and Renee Gonzalez should not
- 51:31fly with BTTR or any other organization.
- 51:34on February 24, 25, 26, 27, the
- 51:37anticipated meeting date of the uh
- 51:40Consilio Kubano.
- 51:42Honor about February 21, Juan Pablo Ro
- 51:44falsely informed the FBI that BTR would
- 51:47not be flying during the weekend of
- 51:49February 2496, even though, as he then
- 51:51knew, BTTR was scheduled to fly during
- 51:54that time. So they're they found a psy
- 51:56here. Honor about February 2296, the DI
- 52:00communicated that a DI officer had
- 52:01traveled to Mexico to support the
- 52:03departure of Juan Pablo Ro from the US
- 52:05to Cuba. Honor about February 2296, Juan
- 52:08Pablo Ro met with Herardo Hernandez. On
- 52:12about February 23, Renee Gonzalez met
- 52:14with Herardo Hernandez. On about
- 52:16February 23, Juan Paul Ro Juan Pablo Ro
- 52:19left Miami as directed and returned to
- 52:21Cuba. At least as early as in or around
- 52:24February 96, Castro Re's command and
- 52:26with direction from the unindicted
- 52:28co-conspirator number two, La Perez
- 52:31Perez, Blanco Barzaga, Cardinius,
- 52:34Rodriguez, LF Perez, Perez and others
- 52:36engaged in training missions
- 52:39using Cuban military aircraft to find,
- 52:41track, pursue, intercept small civilian
- 52:44aircraft off the coast of Cuba.
- 52:47Paragraph 22. On about February 24,96 on
- 52:50about uh at or about 3 p.m. Three
- 52:52unarmed civilian aircraft operated by
- 52:54BTTR having those tail numbers flew
- 52:57south across the 24th parallel. At
- 53:00approximately 3 p.m. La Perez Pres and
- 53:03LF Pres in MIG 1 and Blanco in a MIG 2
- 53:06took off from San Antonio Laspanos Air
- 53:09Force located near Havana, Cuba. at 3:20
- 53:12p.m. Perez Perez and uh sought
- 53:14authorization to destroy the unarmed
- 53:16civilian aircraft bearing tail number
- 53:19and November 2456s which was flying at
- 53:22the time over international waters. La
- 53:25Perez pres
- 53:27LF were given the authorization to
- 53:31destroy unarmed civilian aircraft. At
- 53:34approximately 3:21 p.m. without warning,
- 53:37Pres and LF Pres shot down BTR's unarmed
- 53:41civilian aircraft bearing tail numbers
- 53:43blah blah blah using air-to-air missile
- 53:46and killing pilot CC and his passenger
- 53:48PM. At approximately 3:26 p.m. in
- 53:52response to requests for authorization
- 53:53by Less Pres and the other press pilots
- 53:56were given authorization to destroy a

- 54:06destroyed the second unarmed civilian

- 54:11Sierra using an air-to-air missile
- 54:13killing the pilot and his passenger at
- 54:14time of the shootown of the two BTR
- 54:16aircraft. Barzag and Cardinius in MIG 3
- 54:18and Rodriguez and MIG 4 were inside
- 54:21their Cuban fighter jets ready to
- 54:23deploy. They listened to La Pres and LF
- 54:25Pres radio requests for authorization to
- 54:27destroy unarmed civilian aircraft. The
- 54:29authorization received for the same in
- 54:31conference that those aircraft were
- 54:33destroyed. Barzag and Cardinius in MIG 3
- 54:35and Rodriguez in MIG 4 took off from San
- 54:37Antonio Laspano air located in Havana,
- 54:40Cuba to join La Perez Perez and Pres in
- 54:43MIG 1's pursuit of third unarmed
- 54:44civilian aircraft bearing tail number
- 54:46and 25506 with the intent of destroying
- 54:50that aircraft as well. unindicted
- 54:52co-conspirator two authorized Barzaga
- 54:55and Cardinius in MIG 3 and Rodriguez in
- 54:58MIG 4 to take off from San Antonio Leos
- 55:00Bano Sarfeld located near Havana to join
- 55:03La Perez present other press pursuit of
- 55:05the third unnamed civilian aircraft with
- 55:07the intent of destroying that vi that
- 55:10aircraft all in violation
- 55:13of US code section 2332B2
- 55:18which by the way doesn't apply by
- 55:22to anything that we've talked about.
- 55:25It's a US code. How in the world are
- 55:29these people all in violation of title
- 55:3318 US code? They aren't even located in
- 55:37America.
- 55:39Okay. So, that's interesting. The the
- 55:42easy answer would be just go screw you
- 55:44guys. We we aren't doing this. But
- 55:46they've politicized it. So the judge has
- 55:47to, you know, rethink and and and give
- 55:50any sort of re the grand jury indicted
- 55:53these people. Come on. What else are we
- 55:55going to do? That's it. So murder,
- 55:57that's the first count one murder has
- 56:00now been told to us about what that is.
- 56:04The you know all of these people full of
- 56:08photos. We have general allegations. We
- 56:10have a superseding indictment. We have
- 56:13overt acts that they conducted.
- 56:16Um, that's that's all count one.
- 56:22Conspiracy to kill US nationals. That's
- 56:26conspiracy, friends and neighbors. That
- 56:29is it.
- 56:31Count two, destruction of aircraft.
- 56:34Paragraphs 1 through 34 of the general
- 56:36allegations section and paragraph 4
- 56:38through31 of the overt act section are
- 56:41incorporated by reference on or about
- 56:43February 24 in the special jur aircraft
- 56:46jurisdiction of the United States.
- 56:50Right? So now they have a special
- 56:52aircraft jurisdiction because that's why
- 56:56they mentioned that agreement with the
- 56:58uh with the uh uh
- 57:02Cuban government from way back when they
- 57:04said if you crossed this parallel. So
- 57:07while in the special aircraft
- 57:09jurisdiction of the United States,
- 57:11unmentioned by the way, the US 18USC
- 57:1532A1
- 57:17uh 34 49 USC 46501 sub paragraph 2. So
- 57:23they're creating their own jurisdiction
- 57:25here all in an effort to be able to and
- 57:29this is extremely tenuous and BS just by
- 57:32reading it because they aren't even
- 57:33mentioning the jurisdiction. They're
- 57:35just, you know, you throw the grand jury
- 57:37doesn't know crap about jurisdiction
- 57:39anyway. Jurisdiction is for the the
- 57:41courts to decide. It's for lawyers to
- 57:43have before they get there. You know,
- 57:45you have to have the jurisdiction. So,
- 57:47they have to convince the court. But if
- 57:48the court's on your side and the court's
- 57:51going to, you know, just give you what
- 57:52you want, you have to wait till appeal.
- 57:54But in the meantime, you get to have an
- 57:56act. You get to file a case. And Donald
- 57:58Trump goes, "Well, man, let's go do what
- 58:00we did to Maduro. Man, that was great,
- 58:02wasn't it? And we charged him with
- 58:03holding a machine gun. He's got a
- 58:06machine. I'm the biggest baddest wolf on
- 58:09the planet. I'm going to go get him. And
- 58:12so, you know, this this is what they're
- 58:14trying to do. All the way back in April,
- 58:16they saw that. Oh my god. Here's a plan.
- 58:18We're going to capture that dude. Things
- 58:20will change in Cuba then. That's right.
- 58:26Excuse me. Jeez, what games we play. You
- 58:30got nothing better in your life than to
- 58:31lie about jurisdiction. You know, you
- 58:33just create your own jurisdiction. This
- 58:36is government overreach at its finest.
- 58:38This is this is what you do to make a
- 58:40name for yourself. Yeah, I charge Castro
- 58:42with a crime. Well, man, that was great.
- 58:45I guess I could do that. Who needs to be
- 58:46a lawyer? What difference does it make?
- 58:48You're not using it anyway. You're not
- 58:50using the law here. This is this is uh
- 58:53creativity at its finest. Uh so honor
- 58:57about February 24 in the special
- 58:58aircraft jurisdiction of the United
- 59:00States Ra Modestro Castro Ruiz Lorenzo
- 59:02Alberto Paris Paris. So here they're
- 59:04charging Castro
- 59:06did willfully destroy and wreck an
- 59:08aircraft aircraft that is a United
- 59:11States civilian aircraft bearing tail
- 59:14number blah by means of an air-to-air
- 59:16missile which resulted in the death of
- 59:18human beings CC and PM in violation of
- 59:21title 18 US code sections blah blah
- 59:24blah.
- 59:28Where is the jurisdiction over Raul
- 59:32Madestro Castro? Where? It's not
- 59:36mentioned. There's no jurisdiction
- 59:39mentioned.
- 59:41Even if we the aircraft happened to be
- 59:45in the special aircraft jurisdiction of
- 59:47the United States, the defendant wasn't
- 59:51Lorenzo Alberto Perez. Perez. Maybe he
- 59:55was. We don't know where he filed the
- 59:57missile, fired the missile from, do we?
- 59:59That's not mentioned. Whether he was in
- 1:00:01that aircraft or not, this is this is
- 1:00:02poorly written crap. This is just some
- 1:00:06guy telling a story to 12 citizen going,
- 1:00:08"Don't you want to get that Castro after
- 1:00:10all these years? This is what's going
- 1:00:12on." Count three, destruction of an
- 1:00:14aircraft.
- 1:00:16Same thing. And they're they're the next
- 1:00:18aircraft by means of an air-to-air
- 1:00:20missile. Nothing different in that
- 1:00:21count, just a different airplane. Count
- 1:00:24four, murder.
- 1:00:26Count for murder. Paragraph 1 through 34
- 1:00:29of general allegations, paragraph 4
- 1:00:31through 31 of the overt acts of count
- 1:00:33one are incorporated by reference under
- 1:00:36about February 2496 special maritime and
- 1:00:38territorial jurisdiction of the United
- 1:00:41States. Of course, Raul Modestro Castro
- 1:00:44was not there.
- 1:00:48Do you think that if Donald Trump is in
- 1:00:50his office in in uh Washington DC and he
- 1:00:54killed um uh Ayatoll uh which which
- 1:00:58Kmeni was it? Uh he killed one of the
- 1:01:00Kmenis
- 1:01:02that and everybody else that he ordered
- 1:01:05killed over there. Well, we just killed
- 1:01:06him, you know. We just we we killed him.
- 1:01:09He's admitted it. He's put it out there.
- 1:01:12I killed those guys. And that's that. I
- 1:01:14took them out. I gave the or of course
- 1:01:15he gave the order. who else gave the
- 1:01:17order that the special the special
- 1:01:21jurisdiction of Iran is going to take
- 1:01:24place and they'll arrest Trump in the
- 1:01:26White House through a special action,
- 1:01:28drag him on over to Iran and get him for
- 1:01:31murder under Iranian law. You'd think
- 1:01:33that was third world country law. That's
- 1:01:36what this is that I'm reading to you.
- 1:01:38This is third world country [ __ ]
- 1:01:41law. This is the the king changing his
- 1:01:44mind and and uh you get a you get a die
- 1:01:47because I say you get to die. Why don't
- 1:01:49you just send over the special forces,
- 1:01:51kill the guy like you did in Iran? What
- 1:01:54in the why this joke? I'd much more
- 1:01:57support the other stuff than going in a
- 1:02:00de destroying
- 1:02:02a system that I like to think is meant
- 1:02:06to be above reproach. This is not it.
- 1:02:11This is [ __ ] And the lawyers
- 1:02:14playing these games are horseshit
- 1:02:16lawyers. These aren't real lawyers. This
- 1:02:19is crap. And uh you can tell them I said
- 1:02:22so. I don't care. This is crap. Where
- 1:02:24you Let me go in there and defend this
- 1:02:28guy. No news, no nothing. And just keep
- 1:02:30going to the to the to Let me ask a
- 1:02:33couple of questions
- 1:02:35in front of the grand jury and see if
- 1:02:37they say. Well, wait a minute.
- 1:02:40How you going to get jurisdiction?
- 1:02:43Where are you creating this jurisdiction
- 1:02:46in the US? You have to we Oh, we can get
- 1:02:50once he shows up on American soil. Maybe
- 1:02:54if he committed murder in another
- 1:02:55country, there are exceptions to the
- 1:02:57rule that you can get it or that you or
- 1:02:59that he committed murder or directed a
- 1:03:02murder while located in another country,
- 1:03:04but the murder occurred on US soil and
- 1:03:08he directed it. You could get him for
- 1:03:09the crime of conspiracy to commit
- 1:03:11murder. any of things would be fine if
- 1:03:13he traveled to visit his grandma in
- 1:03:17Florida and you chose to arrest him then
- 1:03:20you could arrest him and maybe take
- 1:03:22jurisdiction but using it as a basis for
- 1:03:25Donald Trump to engage in a military
- 1:03:27action to go and capture the guy and
- 1:03:30bring him to bring him to the joke of a
- 1:03:32process like this in America just like
- 1:03:37the idiots did up in New York to Maduro.
- 1:03:40I'd have rather you just killed the guy
- 1:03:42and moved on. I'd have felt better about
- 1:03:44it, you know, cuz that at least it's a
- 1:03:47military action, you know. Sodom
- 1:03:49Hussein, we need to just kill that guy.
- 1:03:52Uh who the hell else was the guy uh ran
- 1:03:55the terrorist organizations? We chased
- 1:03:57him around forever, you know, and they
- 1:03:59killed him in Afghanistan somewhere and
- 1:04:01blah blah blah. That you you you at
- 1:04:04least can say, "Well, they've, you know,
- 1:04:05the CIA did the right thing." But this
- 1:04:07is [ __ ] I mean this lawfare crap is
- 1:04:11what we fight, what I fight. This is
- 1:04:14this is the rules being twisted for you
- 1:04:17to create some kind of scenario. And it
- 1:04:19no matter how you slice it, it's BS.
- 1:04:22Okay, so account five is also murder. So
- 1:04:25we had murder account four,
- 1:04:28the general allegations blah blah blah.
- 1:04:30They did willfully and unlawfully with
- 1:04:33malice of forethought. kill CC a human
- 1:04:36being with premeditation and during the
- 1:04:38perpetration of an attempt to perpetrate
- 1:04:40sabotage, that is the destruction of an
- 1:04:43aircraft in violation of title 18 US
- 1:04:46code 32. So they're extrapolating the
- 1:04:49supposed jurisdiction of somebody that
- 1:04:52destroys an aircraft
- 1:04:55into murder, not using the murder
- 1:04:58statute, but using he destroyed the
- 1:05:00aircraft. Okay. So, this is this is
- 1:05:03creative writing 101 from your, you
- 1:05:06know, eighth grade literature class for
- 1:05:10for your eighth grade teacher. This is
- 1:05:12these facts are pretty solid, right? Not
- 1:05:15they're [ __ ] The same thing goes
- 1:05:17for count number five. They same exact
- 1:05:19uh title, just different person.
- 1:05:21Paragraph uh count six, murder. Same
- 1:05:24thing. Same maritime special. They
- 1:05:26destroyed an aircraft in violation of
- 1:05:29title 18 and somebody got killed. Count
- 1:05:31seven murder. Same thing. And that is
- 1:05:34it. Um, and they didn't say who the
- 1:05:38juror signed. They wiped his name out so
- 1:05:40you can't see it. So, it's a US
- 1:05:42attorney. Get this. Jason Reading
- 1:05:45Quinones. Wonder if he's a Cuban. Uh,
- 1:05:49Yara Lorenzo Clucas, first assistant US
- 1:05:52attorney. and Abby Waxman, assistant US
- 1:05:56attorney, and Michael Gilfarb, assistant
- 1:05:59US attorney. These guys are the morons
- 1:06:02who signed this. Okay. And uh they made
- 1:06:06sure to get rid of the jury for P four
- 1:06:09person, you know, because that guy
- 1:06:10doesn't want to get killed by any of the
- 1:06:12spies from Cuba that are around. But
- 1:06:14they're the idiots that have been sucked
- 1:06:17into. I mean, imagine you got four US
- 1:06:19attorneys going, "Yeah, I'll sign this
- 1:06:20thing." But boy, it's much more
- 1:06:22important that you believe what we told
- 1:06:25you and you uh you uh you know, help us
- 1:06:30get this bad guy sign this indictment so
- 1:06:32so that we can get on TV and say, "Well,
- 1:06:35all we did was give the grand jury the
- 1:06:37facts." You know, the facts. You know,
- 1:06:40we told him you the grand jury doesn't
- 1:06:42understand jurisdiction. That's for
- 1:06:45sure.
- 1:06:46You know when when was Castro located on
- 1:06:52the aircraft that k that killed these
- 1:06:54people? You can't just destroy an
- 1:06:56aircraft and get and get picked up. So
- 1:06:58something so now they're just sitting
- 1:07:00there going, "Well, we indicted the man.
- 1:07:02We indicted him for destroying an
- 1:07:04aircraft." And by the way, once we get
- 1:07:06him on US soil,
- 1:07:08you know, jurisdiction will will apply
- 1:07:10then. And this is what happened in 2003.
- 1:07:13So, what they're doing is they're taking
- 1:07:15the stuff from 2003. Murder lasts
- 1:07:17forever. I'll bet you I'll bet you
- 1:07:19anything that the uh code provision of
- 1:07:23uh destruction of an aircraft in Title
- 1:07:2618, US Code 32.
- 1:07:30Let's see if we can find that.
- 1:07:32Title 18, US Code 32. Where are we
- 1:07:38morons? Where are we? Let's see if
- 1:07:43somebody's selling you something. Wait,
- 1:07:45I'm not creating a PDF. I am
- 1:07:49researching. This is what's happening.
- 1:07:51Okay, these people are amazing lawyers,
- 1:07:55aren't they? Wow.
- 1:07:59Wow. These guys are geniuses. Title 18,
- 1:08:03US Code section 32A is a federal
- 1:08:06criminal statute defining the crime of
- 1:08:09destruction of aircraft or aircraft
- 1:08:12facilities. Also known as the Aircraft
- 1:08:16Sabotage Act. It criminalizes the
- 1:08:19willful damage destruction or disable
- 1:08:21disablement of civil aircraft and
- 1:08:24surrounding facilities.
- 1:08:26This the statute, let's see, 18 US code.
- 1:08:31Let's get to the actual code.
- 1:08:34Okay, here's the code.
- 1:08:37A, whoever willfully sets fire to
- 1:08:41damages, destroys, and wait, which
- 1:08:43paragraph did they use on us? Hang on a
- 1:08:45second. They used paragraph se, let's
- 1:08:48see, 18 US code 32A.
- 1:08:54And A has Jesus,
- 1:08:57eight sub paragraphs. Okay, first
- 1:09:00paragraph. Sets fire to, damages,
- 1:09:03destroys, disables, or wrecks any
- 1:09:06aircraft in the special aircraft
- 1:09:08jurisdiction of the United States or any
- 1:09:10civil aircraft used, operated, or
- 1:09:13employed in interstate, overseas, or
- 1:09:15foreign air commerce.
- 1:09:17Two, place or cause to be placed a
- 1:09:19destructive device substance in or upon
- 1:09:21blah blah blah. That one doesn't apply.
- 1:09:23Sets fire to, damages, destroys, or
- 1:09:25disables an air navigation facility.
- 1:09:27That one doesn't apply. Four. With
- 1:09:29intent to damage, destroy or disable an
- 1:09:31aircraft. Sets fire to damage destroyers
- 1:09:32disabled or places destructive device in
- 1:09:35or approximately two. Nope, that's a
- 1:09:36bomb. In interferes with or disables
- 1:09:39with intent to endanger the safety of
- 1:09:41any person, or with reckless disregard
- 1:09:43for the safety of life, anyone engaged
- 1:09:45or operating an aircraft in any air
- 1:09:47navigation facility. Now, that's not
- 1:09:49there either. uh performs an act of
- 1:09:52violence against or incapacitates any a
- 1:09:54vehicle or any individual on any such
- 1:09:56aircraft if such air act of violation of
- 1:09:59incapacitation is likely to endanger the
- 1:10:01safety of the aircraft.
- 1:10:03Communicates information knowing the
- 1:10:05information to be false and circumstance
- 1:10:08in which information may reasonably
- 1:10:10believed thereby endangering the safety
- 1:10:12of any aircraft in flight. Nope.
- 1:10:14attempts to cons or conspires to do
- 1:10:16anything prohibited under subp
- 1:10:18paragraphs 1 through seven
- 1:10:21shall be fined under this title or
- 1:10:23imprisoned not more than 20 years or
- 1:10:27both. Okay, that's if you committed any
- 1:10:30of these things, it's 20 years and the
- 1:10:32special aircraft jurisdiction of the
- 1:10:35United States is defined as terms
- 1:10:40defined in other law. In this chapter,
- 1:10:43the terms aircraft engine, air
- 1:10:45navigation, appliance, civil aircraft,
- 1:10:47foreign air commerce, interstate air
- 1:10:49commerce, landing area, overseas
- 1:10:51commerce, propeller, spare part, special
- 1:10:53aircraft jurisdiction of the United
- 1:10:56States have the meanings given to those
- 1:10:59terms in 4,000
- 1:11:024,102A
- 1:11:06of title 49. So now we're going to go to
- 1:11:10there.
- 1:11:12and find out what title 49
- 1:11:16says. T I T L E 49 USC.
- 1:11:23Oops. See,
- 1:11:26and see what this says.
- 1:11:31There is no statute uh you are thinking
- 1:11:34of
- 1:11:36which is the foundation definition
- 1:11:38section for aviation. Okay. This section
- 1:11:43overview transportation aviation
- 1:11:45definitions. This section defines
- 1:11:49where is it?
- 1:11:51Mhm.
- 1:11:53We need the full text. General
- 1:11:55definitions. Here we are. Uh blah blah
- 1:11:59blah. Landing. Landing. Landing. There
- 1:12:01are a lot of of paragraphs.
- 1:12:06What was it? Special. Special. What was
- 1:12:09it? What was that title? Definition of
- 1:12:12special aircraft jurisdiction. Special.
- 1:12:15That'll be in the S's. Foreign. Boy,
- 1:12:18there's a lot of them. Um person small
- 1:12:22hub aircraft. Um limited definitions.
- 1:12:26Come on.
- 1:12:29It's gone. Public aircraft person
- 1:12:32predatory.
- 1:12:35Nope. There's nothing here. United
- 1:12:38States air traffic.
- 1:12:41Well,
- 1:12:44we're going to search
- 1:12:47because it looks like it might be uh
- 1:12:51it might it'd be really funny if it
- 1:12:53wasn't even uh wasn't even there
- 1:12:56anymore. Um
- 1:13:00it'd be real hilarious if it wasn't even
- 1:13:03part of it anymore. if it wasn't even
- 1:13:05part of the general definitions.
- 1:13:08Uh,
- 1:13:10but I can't find it so far. Um,
- 1:13:14definitions 41102
- 1:13:18policy.
- 1:13:22Wow, this is huge though. These titles
- 1:13:25go on forever.
- 1:13:27I'll have to look that up for you and
- 1:13:28figure out tomorrow whether or not these
- 1:13:31special well this is the last show of
- 1:13:33the week sadly but uh we have um
- 1:13:37aviation we have these definitions that
- 1:13:40they put in there uh that is just um
- 1:13:45we're not able to get there definition
- 1:13:48of special aircraft jurisdiction we're
- 1:13:51not able to get to it and uh
- 1:13:56Let's see.
- 1:13:59Let's find this and see if we can can
- 1:14:02get to it. I think we can, but I'm not
- 1:14:04in my legal research thing. I'm just in
- 1:14:06regular old Google right now. So, I'll
- 1:14:09have to look this up when I'm um
- 1:14:12federal jurisdiction for crimes aboard
- 1:14:15aircraft. Okay. Um, so certain aircraft
- 1:14:20outside the US, foreign aircraft that
- 1:14:22have their next scheduled destination,
- 1:14:24blah blah blah. Special aircraft
- 1:14:27jurisdiction. Um,
- 1:14:34yeah.
- 1:14:36Added July. It's it's it's not there.
- 1:14:40It's uh Department of Justice. this.
- 1:14:43It'd be really funny if it just isn't
- 1:14:46there.
- 1:14:48It'd be freaking hilarious if that
- 1:14:50jurisdiction uh sentence just doesn't
- 1:14:53work anymore. But I'm going to have to
- 1:14:54look it up. I apologize for my diet
- 1:14:56tribe this morning on reading this uh
- 1:15:00this craziness of charging people with
- 1:15:03murder. I'm very much against the use of
- 1:15:07the legal system uh as a joke, right?
- 1:15:10And uh we do it far too often. All the
- 1:15:14crap creation. And now what do they do?
- 1:15:17They honor these a-holes. They, oh geez,
- 1:15:20these are great lawyers. No, they're
- 1:15:22idiots. And what they're doing is is
- 1:15:26really not lawyerly behavior. Okay? If
- 1:15:31you have a valid, reasonable argument to
- 1:15:34put something out there, I expect you
- 1:15:37to. But using the law as a as a freaking
- 1:15:42club to beat people over the head with,
- 1:15:45I don't like that. It It drives me
- 1:15:48crazy. And uh and I just don't like it.
- 1:15:52Any person could read. I mean, my first
- 1:15:54thing that I found there was um uh
- 1:15:58remember what this said? Uh where'd it
- 1:16:00go?
- 1:16:02Overview. This section defines terms by
- 1:16:06uh you know you're likely looking the
- 1:16:08foundation definitions for section of
- 1:16:11aviation and transportation law in 40
- 1:16:14USC 102 which contains general property
- 1:16:18and administrative definitions right and
- 1:16:22these definitions navigable airspace
- 1:16:25stuff like that where they get to uh put
- 1:16:30the transportation
- 1:16:32sections in there. Let's see. Uh let's
- 1:16:36see if this one has the the interstate
- 1:16:41errors, transport, mail, medium, public
- 1:16:44aircraft, small hub,
- 1:16:47state authority, ticket a kinds of uh
- 1:16:52limited definitions here. And I want to
- 1:16:56find here in find law. I want to search
- 1:17:01the
- 1:17:03uh special what was it called again?
- 1:17:06Let's get to it. The special aircraft
- 1:17:08jurisdiction
- 1:17:11um
- 1:17:12is
- 1:17:14where I was Darn it. Where'd my PDF go?
- 1:17:21Let's see here.
- 1:17:26All of these things I mean these are
- 1:17:27important. uh destruction of the
- 1:17:30aircraft in violation of title 18 US
- 1:17:33code is where they are and the given the
- 1:17:37definition
- 1:17:38of uh the destruction of the aircraft in
- 1:17:42violation of of the special jurisdiction
- 1:17:45the special aircraft jurisdiction
- 1:17:50special maritime
- 1:17:52honor about February 24 in the special
- 1:17:56maritime and territorial jurisdiction
- 1:17:58iction of the United States, right?
- 1:18:02Special maritime and territorial
- 1:18:04jurisdiction. Okay, it's not maritime.
- 1:18:06They weren't on the water.
- 1:18:09The territorial jurisdiction of the US
- 1:18:13doesn't apply to Castro. Arguably, if
- 1:18:18this uh Lorenzo Alberto Perez was flying
- 1:18:21in US airspace, maybe you could get him.
- 1:18:25But all this joke of a document is is to
- 1:18:28give these people something to say to
- 1:18:31show that they are doing something.
- 1:18:34These people have higher aspirations
- 1:18:37and so they have to take these, you
- 1:18:40know, and and the people with money now
- 1:18:42know that these guys
- 1:18:45these guys will um will uh uh file
- 1:18:52anything, you know, we'll file anything,
- 1:18:54right? And uh the penalty sheets are
- 1:18:58listed, all this stuff is listed for for
- 1:19:01all of these people. So if they've what
- 1:19:03they're trying to do is
- 1:19:07name these pilots, even the ones that
- 1:19:09didn't kill anybody, the ones that just
- 1:19:11flew and escorted, they're going to name
- 1:19:12these guys with the conspiracy so that
- 1:19:15they can go and maybe one of them ran
- 1:19:18away to the United States, got on a boat
- 1:19:19and got here. So they got him and so
- 1:19:21they arrested him and they're they got
- 1:19:24him and his family and everybody trying
- 1:19:26to figure out how they can coax uh
- 1:19:28Castro to show up in the United States
- 1:19:31or give his whereabouts or spy inside or
- 1:19:34whatever to find out where he is so they
- 1:19:37can do a Maduro type raid in uh in Cuba
- 1:19:40and arrest a guy. And this is Donald
- 1:19:43Trump cleaning up the world. This is us.
- 1:19:45I I object. I I I object. Overruled. I
- 1:19:50strenuously object.
- 1:19:53Remember that? Anyway, that's a movie
- 1:19:55reference. Sorry. I strenuously object.
- 1:19:58Oh, great. You know that helps. I
- 1:20:00strenuously object.
- 1:20:02So, well, stress yourself out there.
- 1:20:05Strain, will you? Go ahead. Strain
- 1:20:07there. Do it again. Uh, no. It's
- 1:20:10overruled. Uh, that's funny. Um, at any
- 1:20:13rate, I believe this is uh uh joke law
- 1:20:17101 for those of you who didn't go to
- 1:20:19law school and uh you know they they
- 1:20:22taught jurisdiction on the one day that
- 1:20:24you were absent. Um you got to be there.
- 1:20:27Uh and even if I went to uh Australia
- 1:20:31and killed somebody,
- 1:20:34they might be a How are they going to
- 1:20:36get jurisdiction? There's extradition.
- 1:20:39There are all kinds of ways to submit
- 1:20:41yourself to the jurisdiction. You commit
- 1:20:43a crime in uh you commit a felony drug
- 1:20:46felony in I don't know, pick a state.
- 1:20:48Pick it. Pick pick it. Let's come up
- 1:20:50with something uh reasonable like
- 1:20:52Georgia. You create a crime. You commit
- 1:20:54a crime in Georgia. A felony. Okay. And
- 1:20:57then you immediately leave the state.
- 1:21:01So, can the German or German Georgian
- 1:21:03police come to your home in Wyoming
- 1:21:09and arrest you?
- 1:21:12Nope. They got no authority. Now, the
- 1:21:15feds could for something else. If they
- 1:21:17charge you with a federal crime, but
- 1:21:18that's not what happened. You know, you
- 1:21:19have your you have your drug crime that
- 1:21:21you committed in whatever. The feds can
- 1:21:23go anywhere pick you up the the end.
- 1:21:25They just pick you up. That's what they
- 1:21:26do. It's what they live for. uh
- 1:21:29selectively of course and if they want
- 1:21:32to heck they go to other countries and
- 1:21:33arrest you there and uh drag you back
- 1:21:36but they don't really have jurisdiction
- 1:21:37over you until you get back. Okay. Now
- 1:21:40arguably if you're on an American uh
- 1:21:43airplane somewhere else there's probably
- 1:21:46limit, you know, limitations or
- 1:21:49extensions of authority with a US air
- 1:21:53person on a US aircraft.
- 1:21:57But if you're on Turkish Airways, I
- 1:21:59wonder when they take uh they take
- 1:22:01effect there. Do they take effect inside
- 1:22:04of uh um
- 1:22:08uh the aircraft or is it when you cross
- 1:22:10into US airspace? I'm not sure how that
- 1:22:12works. Maybe it's only in the airport. I
- 1:22:14haven't read that. I haven't studied
- 1:22:15that. What I'm saying though is you
- 1:22:18cannot create jurisdiction that doesn't
- 1:22:21exist.
- 1:22:23You just can't do it. And uh so
- 1:22:26jurisdiction that doesn't exist, you
- 1:22:28can't you can't cure bad um bad
- 1:22:33jurisdiction doesn't work. Uh a lack of
- 1:22:37jurisdiction is attackable any time. If
- 1:22:42you didn't have jurisdiction, the first
- 1:22:44thing first thing that should be done is
- 1:22:46maybe see but if you hire a lawyer that
- 1:22:48lawyer has to limit because if a lawyer
- 1:22:51appears on your behalf to fight
- 1:22:53something they say you've submitted to
- 1:22:55the jurisdiction of the court just to
- 1:22:57make an argument. So you got to limit
- 1:22:59the jurisdiction at the very beginning.
- 1:23:01You say, "Listen, I want to um enter
- 1:23:04appearance for this guy only to fight
- 1:23:07jurisdiction
- 1:23:09and talk about the jurisdiction issue,
- 1:23:12but I want to enter appearance on this
- 1:23:14guy." Uh, you know, or I want you, you
- 1:23:17know, create get a charitable
- 1:23:18organization
- 1:23:20to fight the jurisdiction. In fact, I
- 1:23:22have a charitable organization. And I
- 1:23:24had to I had to hire a lawyer for Castro
- 1:23:26just to go fight these guys. Um just to
- 1:23:29go, how you getting jurisdiction? Let's
- 1:23:32have a fight over jurisdiction for
- 1:23:34Maduro.
- 1:23:36You can't take it the way that you've
- 1:23:38taken it. And I wonder if anybody is
- 1:23:40really defending the guy or if you know,
- 1:23:43well, geez, look what they've done.
- 1:23:45That's what the lawyers are saying. Look
- 1:23:46what they've done. What a horrible
- 1:23:49fight. Well, we're be going against the
- 1:23:51entire group of people. Everybody hates
- 1:23:53Castro. Who's going to defend him?
- 1:23:55Nobody. Nobody's going to defend him.
- 1:23:58And that's the shame of our system right
- 1:24:01there. The shame is it ain't about the
- 1:24:03law anymore. It's about a system that
- 1:24:06doesn't exist and that they they use as
- 1:24:09a club and the people who are in it are
- 1:24:13part of a club that the that the
- 1:24:17clubbers are using the club the legal
- 1:24:20club to fight the people who would stand
- 1:24:23up for it like me by the way because I
- 1:24:26am not a member of the club that just
- 1:24:29buries my head in the sand to say that
- 1:24:32OG jurisdiction exists. My ass
- 1:24:36jurisdiction doesn't exist and you
- 1:24:38aren't that stupid or that far gone that
- 1:24:41you think it does. These whoever these
- 1:24:44uh a-holes are that signed this joke of
- 1:24:48a pleading, you know, this joke of an
- 1:24:51indictment. And then you know why they
- 1:24:53really want the record sealed? because
- 1:24:56they're creating a BS scenario that they
- 1:24:59don't want any yahoo to just be able to
- 1:25:02log on and pull down. Maybe that would
- 1:25:05be the fun part would be to send a uh
- 1:25:07request
- 1:25:09uh an a freedom of information request
- 1:25:12or a court request and say, "Hey, I want
- 1:25:15these documents. Can you provide them,
- 1:25:17please?
- 1:25:18Why can't I have them if you're not
- 1:25:20willing to give them up?" you know, oh
- 1:25:22gee, we have security measures in place.
- 1:25:25We have to worry about the security of
- 1:25:28the world. You know, we're we're we're
- 1:25:30taking care of you. Really, you just
- 1:25:32don't realize it, right?
- 1:25:36Yeah.
- 1:25:37Anyway, that's my diet tribe for today.
- 1:25:40I'm uh I'm leaving you. I'm done. I'm
- 1:25:42Samuel Trap. This is U DAM radio. Samuel
- 1:25:47Trap. uh samuel t@
- 1:25:51internationalflavor.com
- 1:25:53should should you wish to send me a uh
- 1:25:57an email.
- 1:25:58I'd like to hear from you. Um and at any
- 1:26:02rate, I think that is going to end
- 1:26:05today's diet tribation. D is that a
- 1:26:09word? Datribalization.
- 1:26:11I don't know. Let's make up a new word.
- 1:26:12I have coined a new phrase. In the
- 1:26:16meantime, you just have a fantastic
- 1:26:19Thursday and I will see you come Monday
- 1:26:22morning.
