0:20
Speaker 2: And good Thursday morning to you. Jeff Jenkins with you
0:23
Speaker 2: this morning on five eighty five with Dave Allen filling
0:27
Speaker 2: him for Dave today, nine oh eight, on this Thursday
0:32
Speaker 2: morning in the capital city of Charleston on its way
0:34
Speaker 2: to the seventies. Today, we may break a record tomorrow.
0:39
Speaker 2: If we get up to eighty degrees tomorrow, it'll be
0:41
Speaker 2: the warmest day on that date tomorrow, which is what
0:44
Speaker 2: the sixth of March, right the sixth of March, the
0:46
Speaker 2: warmest day since nineteen fifty six. So we've got a
0:50
Speaker 2: chance to break some records tomorrow. It looks like some
0:52
Speaker 2: of this rain is moving out. We've had a lot
0:54
Speaker 2: of fog in the area this morning, so we're looking
0:57
Speaker 2: forward to some warm temperatures. Thanks for joining us on
0:59
Speaker 2: the show. Filling in for Dave today. He plans to
1:01
Speaker 2: be back tomorrow.
1:02
Speaker 1: Of course.

1:34
Speaker 2: Tony coming up tomorrow, but he is the text line
1:37
Speaker 2: sponsor here on five eighty Live. Let's get right to it.
1:40
Speaker 2: We've got a couple of guests coming up during the
1:43
Speaker 2: next hour and we're gonna go now to Meghan Daily.
1:46
Speaker 2: Meghan is the lead designer with Echo Literary Arts and
1:52
Speaker 2: Literary Arts, and there's a big event coming up later
1:55
Speaker 2: today on the West Side. Megan, good morning, how you doing.
2:00
Speaker 3: I'm well, how are you this morning?
2:02
Speaker 2: I'm doing great. Well. Tell us about what's happening this
2:05
Speaker 2: evening the West Side Ripple Mural Project celebration.
2:09
Speaker 3: What's happening well, we have had eight amazing artists who
2:15
Speaker 3: have put together some murals, our first round of murals
2:20
Speaker 3: that are going to go up on our Arts park
2:23
Speaker 3: since here on the West Side at four twenty seven
2:28
Speaker 3: West Washington. So tonight we're going to gather with our
2:33
Speaker 3: friends from the West Virginia Creative Network, the West Virginia
2:38
Speaker 3: State University Extension Service, and we're just going to take
2:43
Speaker 3: some time to look at all the amazing artwork that
2:48
Speaker 3: has been done in the first round of mural projects,
2:53
Speaker 3: and we're going to look forward to the installation of
2:59
Speaker 3: the mural side that is going to go around our
3:01
Speaker 3: art park here in the coming weeks as the weather
3:05
Speaker 3: breaks and we have an opportunity to start our arts
3:11
Speaker 3: park here.
3:12
Speaker 2: Megan, tell me about about what people are going to see,
3:16
Speaker 2: and you know, you take a look at some of
3:18
Speaker 2: these murals and they're really impressive. Give me your impressions.
3:23
Speaker 3: We have artwork from eight artists from a range around
3:31
Speaker 3: the states. They're they're they're large, but they're not they're
3:37
Speaker 3: not the huge murals that take up the entire side
3:40
Speaker 3: of a building. We've got the murals inside right now,
3:44
Speaker 3: which probably sounds weird because most of the time people
3:48
Speaker 3: think of murals as being outdoor things. But we figured
3:53
Speaker 3: out a way to do this in the wintertime with
3:56
Speaker 3: our artists, and they were amazingly flex in working with us.
4:01
Speaker 3: So right now we have our murals inside it Echo
4:05
Speaker 3: Lit at four twenty seven Washington Street West and people
4:10
Speaker 3: can come in and look at them. We're going to
4:12
Speaker 3: have a concept drawing of the fence projects so people
4:16
Speaker 3: can see what's going to be happening as we move forward.
4:24
Speaker 3: We've just got some beautiful, colorful, vibrant, hopeful artwork that's
4:30
Speaker 3: going to be the start of some really great projects
4:33
Speaker 3: going on here on the West Side in the next
4:35
Speaker 3: few months.
4:36
Speaker 2: Is there Megan a general theme? Are there different themes
4:39
Speaker 2: to the different pieces of art? What about the themes?
4:43
Speaker 3: Well, when we put out a call for artists at
4:48
Speaker 3: the end of twenty twenty five, we asked our artists
4:52
Speaker 3: to focus on ideas of community, growth and creativity, and
5:01
Speaker 3: these artists just nailed it. Just some absolutely gorgeous work.
5:09
Speaker 3: I don't want to spoil imagery for everybody yet and
5:13
Speaker 3: want people to come out and see them, but I'm
5:16
Speaker 3: you know, we have eight different artists. We gave them
5:20
Speaker 3: the same three words creativity, community and growth, and they're
5:26
Speaker 3: amazingly different pieces of art, but there are they all
5:32
Speaker 3: work together so well. We were just so amazed at
5:37
Speaker 3: how even though they all come from different communities and
5:43
Speaker 3: different backgrounds and different experiences, they all came to us
5:49
Speaker 3: like they the artwork works together, and that films cliche,
5:59
Speaker 3: but it's nice to see that even without these artists
6:04
Speaker 3: knowing one another are collaborating. They all just picked up
6:09
Speaker 3: the vibes that we're hoping to share with the community
6:13
Speaker 3: here and they just knocked it out of the park.
6:17
Speaker 3: We've got some really gorgeous artwork that's going to be
6:20
Speaker 3: on our fence project here in no time.
6:24
Speaker 2: Nine thirteen, Meghan dailies with us talking about the West
6:27
Speaker 2: Side RiPP Or Mural Project celebration tonight. It goes from
6:31
Speaker 2: six and to eight at Echo Lit tonight on Charleston's
6:34
Speaker 2: West Side. Tell me about, Megan, about mural art and
6:38
Speaker 2: how just kind of the characteristics of that like as
6:42
Speaker 2: kind of as an art form in kind of where
6:45
Speaker 2: that kind of shakes out, and how you know, mural
6:48
Speaker 2: artists are different obviously than other artists. Just talk about
6:52
Speaker 2: that if you would, Well, a.
6:56
Speaker 3: Lot of artists people tend to think of art as
7:02
Speaker 3: something that you just you buy or you go and
7:06
Speaker 3: see it a museum. Mural art is almost always for
7:14
Speaker 3: public presentation. There are, of course a few people who
7:17
Speaker 3: commission private murals for their homes or their offices, but
7:22
Speaker 3: mural art tends to be public art. Art for the people,
7:27
Speaker 3: are presented in a way that you're not going to
7:32
Speaker 3: have a museum docent telling you what the artists want
7:36
Speaker 3: to say. So these artists who make public art do
7:40
Speaker 3: mural art there they're just putting it out there and
7:44
Speaker 3: they're not expecting that anyone's going to need an explanation,
7:51
Speaker 3: and it's just there for people of all facets of
7:57
Speaker 3: life to enjoy out in the world. You don't have
8:01
Speaker 3: to have an art history major to appreciate mural art.
8:06
Speaker 3: You don't. You just have to have eyes and a
8:09
Speaker 3: way to get to see the artwork. And it's out
8:14
Speaker 3: there for the people. It's it's one of the most
8:18
Speaker 3: egalitarian forms of art I think that there is. It's
8:23
Speaker 3: just out there to be enjoyed in the world. And
8:26
Speaker 3: sometimes it's it's the most amazing thing to be somewhere
8:31
Speaker 3: and see a new piece of mural art and just
8:37
Speaker 3: where'd that come from? That just used to be a
8:39
Speaker 3: brick wall two months ago, and now it's this big, beautiful,
8:44
Speaker 3: vibrant piece of artwork that's there to enjoy any time
8:48
Speaker 3: of day.
8:49
Speaker 2: The West Side Arts Park, So these murals will be
8:53
Speaker 2: in the West Side Arts Park. Again, where is that
8:56
Speaker 2: located and what's the timeline for getting that done?
9:01
Speaker 3: We are at four twenty echo. It is at four
9:05
Speaker 3: to twenty seven West Washington Street. The Art park will
9:09
Speaker 3: be right next door to us. It will be a
9:13
Speaker 3: fenced in green space that will be used for common gathering,
9:22
Speaker 3: community events. We're hoping to break grounds on the fence
9:29
Speaker 3: project that all the murals will be installed on. We're
9:32
Speaker 3: hoping to break ground just as soon as we're sure
9:37
Speaker 3: that we're out of the frost zone. We're not going
9:41
Speaker 3: to have hopefully not too much more frozen ground. And
9:44
Speaker 3: it sounds like from your forecast or approaching that so
9:51
Speaker 3: I'm not exactly. You never know how long it's going
9:55
Speaker 3: to take with construction projects, so I don't want to
9:58
Speaker 3: nail down a date, but we're hoping that we'll have
10:04
Speaker 3: a fence and murals up well in advance of everybody's springtime.
10:11
Speaker 1: Wandering about sounds great.
10:14
Speaker 2: Now, there's some key partners here right. You mentioned at
10:17
Speaker 2: the beginning. West Virginia Creative Network also Wes Virginia State
10:22
Speaker 2: University Extension Service, and I noticed in the release that
10:27
Speaker 2: announcing this tonight the Venimum Foundation, Greater Kanaw Valley Foundation,
10:31
Speaker 2: so key partners making all this possible.
10:35
Speaker 3: Absolutely, we've had some really great folks, as you said,
10:40
Speaker 3: Creative Network, West Virginia State University, which and the Creative
10:46
Speaker 3: Network receives some funding from the benadem Foundation, it's Greater
10:51
Speaker 3: Kannaw Valley Foundation. We've had some additional grants that have
10:57
Speaker 3: helped move this project forward from Mary Amy Goodwin Arts
11:03
Speaker 3: Amplified Charleston Urban Works. Just Pierson at the Office of
11:08
Speaker 3: Public Art has been absolutely a gold star assistant in
11:15
Speaker 3: this project, just helping us with fundamentals and the nuts
11:21
Speaker 3: and bolts to make sure we knew what we were
11:24
Speaker 3: doing with our first public art project. Naomi Bays started
11:33
Speaker 3: this whole project with West Virginia Creative Network, helped with
11:38
Speaker 3: the foundational planning of this event. Marrigolds their board. They've
11:44
Speaker 3: been great supportive. We've just had so much community support.
11:51
Speaker 3: I hope I haven't left anybody out, but we've had
11:53
Speaker 3: just an amazing amount of support and a lot of
11:57
Speaker 3: people swinging by asking what's going on when things are
12:00
Speaker 3: going to be ready and we just keep going, hopefully
12:04
Speaker 3: really soon.
12:05
Speaker 2: Yeah. So the details are they can stop by tonight
12:09
Speaker 2: at Echo Lit as you mentioned the four hundred block
12:11
Speaker 2: there of West Washington. You can stop by between six
12:14
Speaker 2: and eight, Right, that's the celebration. Get to see these
12:18
Speaker 2: these mural projects that will be eventually put outside, but
12:21
Speaker 2: you get a really good look at them inside tonight.
12:25
Speaker 3: Absolutely, it's we got set up last night. We were
12:30
Speaker 3: ready for folks to come by this evening. We're really
12:34
Speaker 3: excited to see people from our community come and actually
12:39
Speaker 3: experience the artwork of close and personal this evening.
12:42
Speaker 2: And also, Megan, you I guess have the opportunity to
12:45
Speaker 2: talk to the artists where they be there and kind
12:46
Speaker 2: of get their thoughts into their works.
12:49
Speaker 3: I believe that all eight artists are going to be
12:52
Speaker 3: here this evening. Hopefully no one's caught one of the
12:55
Speaker 3: colds that's running around or anything like that. But as
12:58
Speaker 3: far as I know, we haven't heard anybody say they
13:01
Speaker 3: wouldn't be here. So all eight artists will be here
13:05
Speaker 3: to talk and meet the community. And we're really excited
13:11
Speaker 3: to have everybody together this evening.
13:13
Speaker 2: Okay, Meghan, well, congratulations and good luck on that we
13:16
Speaker 2: look forward to seeing the further development of the park
13:18
Speaker 2: there on the West Side.
13:20
Speaker 3: We're really excited to have people come out and enjoy
13:25
Speaker 3: all the great things that the arts community is happening
13:30
Speaker 3: here on the West Side.
13:31
Speaker 2: Okay, Meghan, have a good day. We appreciate it.
13:34
Speaker 3: Thank you so much. I have a great day, you too.
13:37
Speaker 2: Megan Daily, she's a lead designer with Echo Literary Arts
13:40
Speaker 2: and talking about at tonight at Echo litt there in
13:44
Speaker 2: the four hundred block of West Washington. This will be
13:47
Speaker 2: the unveiling tonight of the West Side Ripple Mural Project.
13:50
Speaker 2: The celebration from six and to eight tonight. You can
13:53
Speaker 2: drop by see the work of the eight artists before
13:57
Speaker 2: they head outside. And so there's still some work to
13:59
Speaker 2: do on the park. As she mentioned there, I'm going
14:01
Speaker 2: to put the murals out there. There's going to be
14:03
Speaker 2: a mural fence that's put up, nice green space. There's
14:06
Speaker 2: still some work there, but you can get to work
14:07
Speaker 2: a look at what the artists have accomplice in their projects.
14:11
Speaker 2: Tonight from six until eight The Dave Allen Show on
14:15

14:40
Speaker 2: Coming up. In a couple of minutes, we're going to
14:42
Speaker 2: talk to Metro New State White Courseponder Brad Micaelhaney. Of course,
14:45
Speaker 2: yesterday was crossover day at the State House, where senators
14:51
Speaker 2: and delegates work to get bills that started on their
14:54
Speaker 2: side out of their chambers with final passage before heading
14:59
Speaker 2: over to the other side. So you have to have
15:02
Speaker 2: the bill of origin. If your bill started in the house,
15:04
Speaker 2: you have to have it out by the fiftieth day,
15:06
Speaker 2: which was yesterday, And in the last ten days they
15:10
Speaker 2: mostly work on bills from the other side, and so
15:13
Speaker 2: that's kind of what we're seeing. Starting today. We've got
15:16
Speaker 2: Brad he's going to talk about that in just a
15:18
Speaker 2: couple of moments, and then we're going to be joined
15:20
Speaker 2: by Aubrey Sparks of the ACLU West Virginia about some
15:25
Speaker 2: ice protests we've seen in the area in the last
15:29
Speaker 2: couple of days. She'll talk about that as we get
15:32
Speaker 2: you caught up and get ready for the guys going
15:34
Speaker 2: to talk line, which is at ten oh six this
15:36
Speaker 2: morning here on five EIGHTYWCHS. I'm Jeff Jenkins filling in

18:42
Speaker 2: As you heard the promo there tonight on five eight
18:45
Speaker 2: WUCCHS the Voice of Charleston High School Basketball. And this is,
18:50
Speaker 2: you know, one of those games in the postseason where
18:53
Speaker 2: you win, you go keep going. If you lose, you're out.
18:57
Speaker 2: And South Charleston and Saint Albans now in Triple A
19:01
Speaker 2: and they're in a Triple A region it's a pretty
19:03
Speaker 2: tough region. We did their game earlier this year that
19:06
Speaker 2: they played. In fact, there's only a couple of weeks ago,
19:08
Speaker 2: I think just a little more than two weeks ago
19:10
Speaker 2: down at Saint Albans and South Charleston won that game.
19:13
Speaker 2: Saint Albans had a key player out that night. I
19:16
Speaker 2: expect a close game tonight the South Charleston Community Center.
19:19
Speaker 2: We'll tip it off a seven. We'll have it here
19:21
Speaker 2: on five ADWCCHS towards to Charleston. And another game that
19:24
Speaker 2: we're watching closely tonight is also here in Charleston. It's
19:27
Speaker 2: a regular season game. It's a quad, a matchup between
19:30
Speaker 2: number one and number two, and they've been basically number
19:33
Speaker 2: one and number two. Washington out of the Eastern Panhandle
19:37
Speaker 2: has been up there a little bit too, that highly ranked,
19:39
Speaker 2: but basically it's been GW and Morgantown most all of
19:43
Speaker 2: the year, and they battled tonight up at GW. It's
19:46
Speaker 2: a regular season game and they play tonight at six o'clock.
19:51
Speaker 2: And in fact, Dave Wilson is going to do that
19:53
Speaker 2: game on waj RS. If you want to go on
19:55
Speaker 2: to their app and listen to that game. Then turn
19:59
Speaker 2: it over to our game after that. Invite you to
20:02
Speaker 2: do that, because that'll be two good games in the
20:04
Speaker 2: Charleston area that you can hear tonight, nine twenty seven
20:08
Speaker 2: on five and Live with Dave Allen, Jeff Jenkins and
20:10
Speaker 2: for Dave Today Metro News talk Line coming up at
20:12
Speaker 2: ten oh six live from the State Capitol, and let's go,
20:16
Speaker 2: as someone would say, to the belly of the Beast
20:19
Speaker 2: right now. And here is Brad McIlhaney, our Metro News
20:22
Speaker 2: state Wide correspondent, alive and well after crossover day. Good morning, Brad.
20:29
Speaker 11: Oh hi, Yes, I have checked my spirit internally and
20:33
Speaker 11: I unfunctional. I truly am. If the belly of the
20:36
Speaker 11: Beach is defined as the basement, that's where I am.
20:39
Speaker 11: Talk Line is setting up upstairs, and you know, crossover
20:46
Speaker 11: day can be, as you know from experience, can be
20:50
Speaker 11: kind of draining, and there have been years, you know,
20:53
Speaker 11: when it's going well into the evening. It wasn't quite
20:56
Speaker 11: like that yesterday, but it was fairly rapid fire. And
21:00
Speaker 11: often the day after crossover Day it can feel like
21:04
Speaker 11: literally or not, everybody's hung over and it has been
21:09
Speaker 11: a little bit of a slow and to they start.
21:12
Speaker 2: To the day, Yeah, because you kind of regroup because
21:15
Speaker 2: you've had these long floor sessions. The sentence, the floor
21:18
Speaker 2: session really wasn't that long, but the houses was longer.
21:20
Speaker 2: I think, wrapping up maybe a little bit after four o'clock,
21:23
Speaker 2: and you pass a ton of these bills, and then
21:26
Speaker 2: it just procedurally, it takes time to get to the
21:28
Speaker 2: other side and everything and now the committees. So now
21:32
Speaker 2: focus goes back at least for a couple of days
21:34
Speaker 2: to the committees. And as the committees start getting bills
21:38
Speaker 2: from the other side down to the floor to deal with,
21:41
Speaker 2: so kind of you shift back to committee. So we'll
21:43
Speaker 2: see a lot of committee work today and tomorrow probably,
21:46
Speaker 2: and then you start getting a lot more floor work
21:48
Speaker 2: next week. That's usually how it like, Right for the
21:51
Speaker 2: last five or six days, you get bills back to
21:54
Speaker 2: the floor and you start talking about bills on the
21:56
Speaker 2: floor again.
21:58
Speaker 11: Well, I mean, I'm always kind of as by the
22:01
Speaker 11: logic of the process, honestly, because the House focuses for
22:05
Speaker 11: all this time one House bills, and the Senate focuses
22:07
Speaker 11: all this time one Senate bills, and then crossover day
22:10
Speaker 11: happens and there's almost no time to consider the legislation
22:15
Speaker 11: that the other chambers work so long and hard on.
22:20
Speaker 11: I mean, it almost makes more sense to do like
22:22
Speaker 11: a day thirty customer day. Ye have more time with
22:25
Speaker 11: the other chambers bills because you know, I mean, we
22:29
Speaker 11: follow these things in each chamber and you but then
22:33
Speaker 11: they cross and you begin listening to the other committees
22:36
Speaker 11: and they're like, what was the House thinking? Why did
22:38
Speaker 11: they do this? Yeah, and you want to stand up
22:40
Speaker 11: and say, oh, I know, I know, but you know
22:44
Speaker 11: you're not allowed to do that. The other thing that's
22:45
Speaker 11: going to happen now that you and I and others
22:48
Speaker 11: will really be work watching is there was some budget
22:52
Speaker 11: action that went pretty early and you know, we all thought, wow,
22:56
Speaker 11: this is really running earlier than we've ever seen. And
23:00
Speaker 11: then that talk kind of went on hiatus as we
23:02
Speaker 11: reached this crossover day deadline for other bills to make
23:07
Speaker 11: it through. But I think you're going to see that
23:09
Speaker 11: kick back up again. There was, you know, some talk
23:13
Speaker 11: of a while they really went so early to try
23:17
Speaker 11: to maybe head off line item vetos from the governor.
23:20
Speaker 11: I think the governor wants the budgets in his hands.
23:23
Speaker 11: He's got like five days to do line item vetos.
23:27
Speaker 11: If if the House and the Senate went unusually early
23:32
Speaker 11: to pass that, then they would potentially have a you know,
23:36
Speaker 11: some leeway to override those kinds of line item veto's.
23:40
Speaker 11: The other thing we don't know that we're going to
23:42
Speaker 11: watch is that, you know, there seems to be a
23:44
Speaker 11: real difference of opinion about the governor's tax cut. He
23:47
Speaker 11: built in the five percent once the ten percent. The
23:51
Speaker 11: House passed its budget with nothing, no tax cut at all.
23:56
Speaker 11: The Senate did ten percent. And so where do they
23:59
Speaker 11: wind up? Is it in the middle, is it all?
24:01
Speaker 11: Is it nothing?
24:03
Speaker 10: Yeah?
24:03
Speaker 2: We were hoping, We thought right that it was going
24:06
Speaker 2: to be on the House Finance Committee agenda this morning,
24:08
Speaker 2: and did not make it on the agenda.
24:12
Speaker 11: Yeah, And I have trouble reading into that. I mean,
24:16
Speaker 11: the House Finance Chairman Vernon Chris was really specific. Two
24:20
Speaker 11: or three days ago that committee brought up what had
24:23
Speaker 11: been the Senate tax cut bill. Again, the Senate passed
24:28
Speaker 11: a ten percent personal income tax cut, somewhat offset that's
24:33
Speaker 11: about two hundred and fifty million dollars in state revenue,
24:36
Speaker 11: so somewhat offset by an increase in the vake tax,
24:39
Speaker 11: which equates to like twenty two million. The Senate or
24:43
Speaker 11: the House process is to bring up a bill and
24:45
Speaker 11: discuss it, review it, think about it one day, and
24:49
Speaker 11: then pass it a different day. So the House Finance
24:51
Speaker 11: Chairman Vernon Chris said a couple of days ago, well
24:56
Speaker 11: he specified Thursday, we will explore a bill again amended.
25:04
Speaker 11: I mean that was a key word in what he said, amended,
25:06
Speaker 11: and pass it Thursday. And here we are and that
25:10
Speaker 11: bill is not on the House Finance agenda, but that
25:14
Speaker 11: meeting is occurring right now.
25:15
Speaker 2: Yeah, Brad mic whenny's with US Metro New Statewide correspondent
25:18
Speaker 2: Jeff Jenkins in for Dave Allen here on five eighty
25:21
Speaker 2: Live is nine thirty two. Ryan Nicholson is my producer
25:24
Speaker 2: this morning. And you know, Brad, that's that's gonna be
25:28
Speaker 2: key now. Then I guess you know, they can meet
25:29
Speaker 2: this afternoon. It could pop up. That's just this you know,
25:32
Speaker 2: this time of year as a reporter, and that's the
25:36
Speaker 2: public too. You just got to watch these agendas. You gotta,
25:39
Speaker 2: you know, you got to watch and and it's a
25:42
Speaker 2: I tell people, it's a it's kind of an acquired taste,
25:44
Speaker 2: right because so a lot of the you might have
25:47
Speaker 2: a bill that pat would probably several bills that passed
25:50
Speaker 2: yesterday and in one form or another in the House
25:53
Speaker 2: of Delegates. If if a Senate committee decides at some
25:58
Speaker 2: point the chair of the commit he decides to put
26:00
Speaker 2: it on the agenda, and not all sometimes they don't
26:03
Speaker 2: make it on an agenda, but if they do decide
26:05
Speaker 2: to put on the agenda, then they might have a
26:08
Speaker 2: committee substitute where they may change.
26:11
Speaker 1: The whole thing.
26:12
Speaker 12: You know.
26:12
Speaker 2: So it's uh, just got just got to really watch this,
26:16
Speaker 2: you know, this time of year to see, you know,
26:17
Speaker 2: kind of how things pan out.
26:20
Speaker 11: Well, we've learned that, you know, again the hard way.
26:22
Speaker 11: All year long. There was a controversy of Hope Scholarship bill,
26:26
Speaker 11: people may remember, that made all kinds of reforms to
26:29
Speaker 11: that scholarship for people who are educating their kids outside
26:33
Speaker 11: the public school system, and the homeschool families were very
26:37
Speaker 11: upset about it. That bill appeared on the House Finance
26:40
Speaker 11: agenda day after day after day for about a week
26:44
Speaker 11: without being acted on, and so you know, you just
26:47
Speaker 11: kind of showed up and hovered and then nothing happened.
26:50
Speaker 11: In contrast, you know, there's this tax bill that we
26:55
Speaker 11: thought was going to be on the agenda, and then
26:57
Speaker 11: it wasn't. The tax build did go onto the House
27:02
Speaker 11: Finance agenda earlier this week. I've lost track of the
27:05
Speaker 11: entire week. Maybe a Monday, we had maybe an hour's notice,
27:09
Speaker 11: and it was only really through the kind of careful
27:13
Speaker 11: coming through agendas that you just described that any of
27:16
Speaker 11: us even knew that was going to happen. And then
27:19
Speaker 11: you know, another example is Rayley's Law, which is a
27:25
Speaker 11: recurring and heartfelt I don't want to say controversial, but
27:31
Speaker 11: it's a bill that would put a pause on transfers
27:37
Speaker 11: from public school to homeschooling if there is an active
27:41
Speaker 11: CPS investigation. That bill comes up the year after year,
27:46
Speaker 11: and it made a last second push onto the House
27:49
Speaker 11: Education Budget again I think maybe Monday, and you know,
27:54
Speaker 11: we didn't know until maybe an hour beforehand. So it
27:58
Speaker 11: really does pay to watch those agendas because who knows
28:01
Speaker 11: what's going to happen.
28:02
Speaker 2: Okay, here's one bill to watch, and we'll just we'll
28:04
Speaker 2: talk about this just for a second and I'll let
28:06
Speaker 2: you go. Is that they talked about it again yesterday
28:10
Speaker 2: actually after the House floor session, and it hasn't passed
28:16
Speaker 2: or anything yet. This is a bill that passed the Senate.
28:18
Speaker 2: The House Education Committee has it now. This is this
28:22
Speaker 2: bill that would be permissive. It would allow county school
28:24
Speaker 2: districts to go away from days of instruction which are
28:29
Speaker 2: now one hundred and eighty days of instruction, to hours
28:33
Speaker 2: of instruction. And there seems to be brad there seems
28:37
Speaker 2: to be some interest from like all stakeholders at least
28:40
Speaker 2: a little bit of interest in this.
28:43
Speaker 11: Yeah. I think so, you know, I think it's possible.
28:46
Speaker 11: But the House will change that bill, which makes it
28:49
Speaker 11: a little tricky here in the final days of the
28:51
Speaker 11: legislative session. But that House Education Committee talked about that
28:56
Speaker 11: bill for about an hour two days ago, and then
29:00
Speaker 11: they had maybe three expert witnesses, people you know, with
29:05
Speaker 11: expertise and what really works in terms of school scheduling
29:09
Speaker 11: yesterday afternoon. That was kind of an ambitious thing to do.
29:12
Speaker 11: I personally didn't have the capacity for it, but it
29:16
Speaker 11: shows me that the committee is interested in getting under
29:19
Speaker 11: the hood and trying to figure out what truly would
29:22
Speaker 11: work best. I would get in credit for due and
29:24
Speaker 11: due diligence because I think they really are trying to
29:27
Speaker 11: figure that out. The bill as it came over, was
29:30
Speaker 11: like nine hundred hours versus you know, whatever number of days.
29:38
Speaker 11: There's been some question about, well, is nine hundred hours
29:41
Speaker 11: really the equivalent of one hundred and eighty or is
29:45
Speaker 11: it selling you know, those education hours short. So I
29:48
Speaker 11: wouldn't be surprised to see a different set of numbers
29:53
Speaker 11: or something else come out of that. But you know,
29:56
Speaker 11: it's an interesting argument, and it's I think one that
29:59
Speaker 11: partly resonates with the public in this year of just
30:02
Speaker 11: so many school calculations because of weather.
30:05
Speaker 2: All right, Brad, we appreciate it. We'll let you get
30:07
Speaker 2: back at it. We're talking a little bit.

34:01
Speaker 2: let's go have another guess coming in with Aubrey Sparks.
34:05
Speaker 2: She's a legal legal director with a CLU West Virginia
34:10
Speaker 2: and she's one of those busy at the capitol running
34:12
Speaker 2: back and forth. You did okay with crossover day.
34:17
Speaker 12: Yeah, I mean, I'll admit I'm not the person at
34:19
Speaker 12: the ACLU who follows the legislative session most closely, but
34:22
Speaker 12: it definitely keeps everyone on their toes. I mean, it
34:25
Speaker 12: is a time where it feels like there's just news
34:28
Speaker 12: coming out all the time about what passes and doesn't pass.
34:31
Speaker 2: Exactly exactly what you're We've we've seen a couple of
34:34
Speaker 2: things last couple of days, some ice protests. I know,
34:37
Speaker 2: there was a one of an organized protests in downtown
34:39
Speaker 2: last night. We saw some Capital High students they were
34:43
Speaker 2: protesting out in front of the Capitol. Tell me what's
34:45
Speaker 2: going on with that right now?
34:48
Speaker 17: Yeah?
34:48
Speaker 12: Well, I think that there are a lot of concerns
34:52
Speaker 12: generally about whether you know, government agencies broadly and here
34:57
Speaker 12: specifically in West Virginia are following the law. I know
35:00
Speaker 12: that there's a lot of situations where they are, but
35:02
Speaker 12: I think that some of the court filings that we've seen,
35:05
Speaker 12: the orders that judges have issued here in West Virginia
35:07
Speaker 12: have shown that there's a lot of times that they aren't.
35:11
Speaker 12: And when we sort of depend on the rule of law,
35:14
Speaker 12: that can be really intimidating, you know, And I think
35:17
Speaker 12: that it makes people upset and it means that there's
35:20
Speaker 12: something that has to be done about it.
35:22
Speaker 2: Aubry, you're one, obviously, you're the legal director of ACLU
35:25
Speaker 2: West Virginia, and you follow these these legal issues, and
35:29
Speaker 2: Brad mcilhaney's reported on several of these judges orders, their filings,
35:35
Speaker 2: these federal judges I'm talking about in West Virginia, several
35:37
Speaker 2: federal judges about some of these folks that were picked
35:40
Speaker 2: up in kind of the January sweep where ice and
35:44
Speaker 2: they got help from local authorities on those tell me
35:47
Speaker 2: just generally what you find interesting. What have you found
35:50
Speaker 2: interesting about some of those comments the judges have made.
35:54
Speaker 12: Yeah, well, I think the first thing is it's easy
35:56
Speaker 12: to sort of see that and just assume like, oh, well,
35:59
Speaker 12: be just must be liberal judges. You know, or these
36:01
Speaker 12: are judges who are sort of predisposed to have this position,
36:04
Speaker 12: but that's really not the case. It's been bipartisan judges
36:07
Speaker 12: appointed by an already of different you know, executives have
36:12
Speaker 12: come out with these orders. It hasn't just been one.
36:14
Speaker 12: I can't remember the exact number of how many it's
36:16
Speaker 12: been now, but I think maybe four of our federal
36:19
Speaker 12: court judges have issued sort of similar orders on these issues.
36:23
Speaker 12: And the real key thing is that these judges are
36:26
Speaker 12: saying over and over again that people are entitled to
36:28
Speaker 12: due process and we need to make sure we protect
36:31
Speaker 12: that because if someone can get picked up and carted
36:34
Speaker 12: off to a facility and they don't have an opportunity
36:37
Speaker 12: to make a case as to why they shouldn't be there, well,
36:40
Speaker 12: there's nothing saying that that couldn't happen to anyone, you know.
36:44
Speaker 12: The only thing that keeps us from being unlawfully detained
36:46
Speaker 12: is the idea that we have a due process right
36:48
Speaker 12: to make the cases to why we shouldn't be And
36:51
Speaker 12: the judges are looking at the way that this is
36:53
Speaker 12: being handled and saying, well, these people are being denied
36:55
Speaker 12: that basic due process right. And that's not just unfair
36:58
Speaker 12: to them. It's dangerous to everyone, and it's dangerous to
37:01
Speaker 12: a democratic system.
37:02
Speaker 2: Okay, going that a little bit, more about do process.
37:05
Speaker 2: What are you talking about specifically there?
37:08
Speaker 12: Yeah, so let's say, and this is sort of a
37:11
Speaker 12: I don't know, I don't want to say a far
37:13
Speaker 12: reaching example, but to put it in perspective, if I'm
37:16
Speaker 12: just on the street and I get picked up by
37:18
Speaker 12: ICE and they say, well, you're not a US citizen
37:21
Speaker 12: and I don't have my passport on me right, and
37:23
Speaker 12: they take me to South Central and then they take
37:27
Speaker 12: me into an ICE detention facility. If I don't have
37:29
Speaker 12: a chance to talk to a lawyer, if I don't
37:31
Speaker 12: have a chance to call my family, if I don't
37:32
Speaker 12: have a chance to go in front of a judge,
37:34
Speaker 12: well then I'm detained. And it doesn't matter whether I'm
37:37
Speaker 12: a US citizen or not. I haven't had the opportunity
37:39
Speaker 12: to say whether or not I am. I haven't had
37:41
Speaker 12: the opportunity to gather those PaperWorks to show that I am.
37:45
Speaker 12: And that gets even more complicated when we talk about
37:48
Speaker 12: people who are in the immigration process, because there's plenty
37:51
Speaker 12: of people who might not have legal documentation, but who
37:54
Speaker 12: are in the process of getting it. So, for example,
37:56
Speaker 12: someone who came here seeking asylum, they could have done
38:00
Speaker 12: everything right and still get picked up in that way.
38:03
Speaker 12: And right now it's really hard because people get moved
38:06
Speaker 12: between different detention facilities so quickly that their lawyers can't
38:09
Speaker 12: find them. You know, I know everyone has heard about
38:12
Speaker 12: like the horrifying stories of the conditions and these facilities,
38:15
Speaker 12: and especially in West Virginia where our jail system was
38:19
Speaker 12: already so overburdened. We've had all of these problems with
38:23
Speaker 12: overcrowding in our regional jails and now we're doubling up
38:26
Speaker 12: on that with ice detaining. That just makes a bad
38:28
Speaker 12: situation worse. And so if someone doesn't have the due
38:31
Speaker 12: process ability to explain why they shouldn't be there, well
38:35
Speaker 12: that's just fundamentally both unfair and should really give concern
38:40
Speaker 12: as to, you know, whether people have like a real
38:44
Speaker 12: opportunity to make their rights into a reality.
38:48
Speaker 2: Abby sparks with this legal director of ACLU West Virginia
38:52
Speaker 2: here on five at You Live, Jeff Jenkins and for
38:54
Speaker 2: Dave Allen today it's nine point forty six. So what
38:56
Speaker 2: do you think is going to be the response we've
38:59
Speaker 2: had a couple of these judges rulings we've had, you know,
39:02
Speaker 2: the status change for some of these folks that have
39:04
Speaker 2: been picked up. Do you think that there's going to
39:07
Speaker 2: be a change here? What do you think is going
39:09
Speaker 2: to be the result?
39:11
Speaker 12: You know, I can say what I hope for, which
39:13
Speaker 12: is that I hope there will be a change, but
39:16
Speaker 12: it's it's really hard to tell. I don't necessarily know
39:19
Speaker 12: where we go from here. And so one of the
39:21
Speaker 12: things that the ACOU has just rolled out is on
39:24
Speaker 12: our website, which is ahouwz dot org, is an opportunity
39:29
Speaker 12: for people who have information about things that are going
39:33
Speaker 12: right or things that are going wrong, if they'd like
39:35
Speaker 12: to share that information with us a portal where they
39:38
Speaker 12: can do that through and they can either submit with
39:41
Speaker 12: their name attached if they would like to seek legal
39:44
Speaker 12: advice about their rights as a whistleblower or about you know,
39:47
Speaker 12: any other concern that they may have, but it can
39:50
Speaker 12: also be submitted entirely anonymously. And part of the reason
39:53
Speaker 12: why we wanted to make that an option is because,
39:55
Speaker 12: of course, we hope that there is no waste, fraud, abuse,
39:58
Speaker 12: illegality going on. If that was the case, and nothing
40:01
Speaker 12: bad was happening, then we wouldn't get anyone telling us anything,
40:04
Speaker 12: and that would be a perfect world, right, But oftentimes
40:07
Speaker 12: when things go wrong, people are there to see it.
40:10
Speaker 18: Right.
40:11
Speaker 12: All it takes is one person to say, Hey, I
40:14
Speaker 12: just saw something happen and it's not how I was
40:16
Speaker 12: trained for how it was supposed to go, or I
40:18
Speaker 12: was just asked to, you know, say that this form
40:22
Speaker 12: was efficient when I know it's not, Or hey, you know,
40:26
Speaker 12: I was present and I saw this thing happen. I'm
40:28
Speaker 12: really uncomfortable with. And if people have questions about what
40:32
Speaker 12: their rights are in those situations, you know we would
40:35
Speaker 12: either be happy to answer those questions or put them
40:37
Speaker 12: in touch with other lawyers who can answer those questions,
40:41
Speaker 12: because you know, there's the saying like one bad apple
40:43
Speaker 12: ruins the whole bunch. And what we need is for
40:46
Speaker 12: the people who see are seeing these things happen to say, hey,
40:49
Speaker 12: I want a system that works. I want a system
40:52
Speaker 12: that follows the rules, and so I'm going to play
40:55
Speaker 12: my role in making sure that happens.
40:57
Speaker 2: Sparks is with ACOU West Virginia, the league director. Now,
41:01
Speaker 2: I know you guys have people on the ground at
41:03
Speaker 2: the Capitol to follow the bills. But I'm sure you're
41:05
Speaker 2: familiar with the camping band bill that passed yesterday. The
41:09
Speaker 2: organization did put out a release on that. What are
41:11
Speaker 2: your concerns about the camping band bill that pass that
41:14
Speaker 2: has passed the House.
41:16
Speaker 12: Well, I think that there's a few concerns. We've got
41:19
Speaker 12: moral concerns and policy concerns and legal concerns, and they
41:22
Speaker 12: all come together for us to think that it is
41:24
Speaker 12: not a very good bill. You know, we can't just
41:29
Speaker 12: criminalize our way out of poverty. We can't tell someone
41:32
Speaker 12: you'll be guilty of a crime if you don't, you know,
41:35
Speaker 12: get yourself out of this situation, because many people who
41:37
Speaker 12: are in that situation don't want to be and if
41:40
Speaker 12: they have the resources to not be in that situation,
41:42
Speaker 12: they would be in that situation. I think that so
41:46
Speaker 12: many people across the country, but especially in West Virginia,
41:49
Speaker 12: understands very closely to their own lives. A huge swath
41:53
Speaker 12: of people are living paycheck to paycheck right and if
41:56
Speaker 12: you ask people in West Virginia what happens if you
41:58
Speaker 12: miss to paychecks paychecks, a lot of people would say,
42:02
Speaker 12: I don't know what happens I don't know how it'd
42:04
Speaker 12: be able to get through that, And so I think
42:06
Speaker 12: it's important for us to remember the vast majority of
42:08
Speaker 12: people are closer to homelessness than we are to some
42:11
Speaker 12: sort of extreme wealth, you know. And so it's one
42:14
Speaker 12: of those situations where you just think, well, like, but
42:18
Speaker 12: for the grace of God, there go I you know,
42:20
Speaker 12: like it could happen to anyone. And I think to
42:22
Speaker 12: a certain extent, the cruelty of not acknowledging that is
42:26
Speaker 12: part of the point, you know, we have to distance
42:28
Speaker 12: ourselves from it and act like those are different people
42:31
Speaker 12: who are doing something bad and deserve to be punished
42:33
Speaker 12: for it, when really, you know, it could be any
42:36
Speaker 12: of us, and well, we shouldn't necessarily have to root
42:38
Speaker 12: it in our own experience to make us care about
42:41
Speaker 12: that situation. I think it's an important framing for us
42:44
Speaker 12: to keep in mind.
42:45
Speaker 2: Okay, and it's a house build that's past the house
42:47
Speaker 2: now on to the Senate. So I'm sure you're working
42:49
Speaker 2: on that other side to see what they do with it.
42:53
Speaker 12: Yeah, we're definitely. We're definitely curious to see what happens.
42:56
Speaker 12: It's one that we're following closely, and like I said,
42:58
Speaker 12: you know, a number of concerns, and I think that
43:02
Speaker 12: as we see what that final finding version would look like,
43:05
Speaker 12: if it does pass well, we'll probably you know, have
43:10
Speaker 12: even more concerns. Hopefully not, maybe it gets better.
43:13
Speaker 3: We'll see.
43:14
Speaker 12: I guess.
43:14
Speaker 2: Okay, Aubrey, Well, I know you're busy. I appreciate a

46:20
Speaker 2: to The Stay capitol now Where Metro News talk live
46:24
Speaker 2: or originate live here in just about twelve minutes or.
46:27
Speaker 2: So Dave wilson AND. Tj, meadows, GUYS i HEAR i
46:31
Speaker 2: hear the roar or is that just the mingling whatever
46:35
Speaker 2: it is there in the upper rotunda ready to go
46:37
Speaker 2: on the day after crossover day and kind of see
46:39
Speaker 2: where these bills end up landing in about nine.
46:42
Speaker 21: Days it's a subdued roar, Today. Jeff everybody's kind, of you,
46:47
Speaker 21: know cleaning up after crossover day. Yesterday and the big
46:51
Speaker 21: question here we are hearing, rumblings, tremors murmurs if you will, that,
46:56
Speaker 21: uh there could be some movement on the budget. Today
47:00
Speaker 21: we may even have a final budget that comes out
47:02
Speaker 21: of The house And senate.
47:03
Speaker 10: TODAY.
47:04
Speaker 22: Tj, SO i think that's right because it comes down
47:06
Speaker 22: to The governor's line item, veto and it comes down
47:09
Speaker 22: to the, legislature specifically The house having the ability to
47:13
Speaker 22: go back in and override anything in that line item
47:16
Speaker 22: veto that they don't, Like so it becomes about budget AND.
47:19
Speaker 22: Dave once that budget is, locked you may or may
47:21
Speaker 22: not be able to get much more in if costs.
47:23
Speaker 21: Money so that could be the big story of the day, Here.
47:26
Speaker 21: Jeff House Speaker Roger hanshaw is going to join us
47:28
Speaker 21: coming up about ten thirty this. Morning we'll talk to
47:32
Speaker 21: him About crossover day And Team West. Virginia that is
47:35
Speaker 21: the kind of the crown jewel of this leg slave
47:38
Speaker 21: session got out of The. House we'll see how it'll
47:40
Speaker 21: fare over in The.
47:40
Speaker 2: Senate you, guys that would be a, record is you,
47:44
Speaker 2: know if they passed the. Budget, yeah if they passed the,
47:46
Speaker 2: budget because now this this particular you, know if you
47:50
Speaker 2: can go back eight or ten, years you, know this
47:53
Speaker 2: kind of group of lawmakers in the last decade or
47:55
Speaker 2: so have done a good job of getting the budget
47:57
Speaker 2: done by the final. NIGHT i, mean there were years
47:59
Speaker 2: THAT i covered the legislature and others that cover the
48:01
Speaker 2: legislature that about this time or sometime during the last,
48:05
Speaker 2: week there would be a proclamation that would extend the
48:08
Speaker 2: session for three days to work on the. Budget that
48:10
Speaker 2: was always a. Given you know they were going to
48:12
Speaker 2: see what eventually, passed and then they were going to
48:15
Speaker 2: work on the budget for the last three days and
48:17
Speaker 2: then lawmakers would come back a week later The, sunday
48:20
Speaker 2: after The sunday when the session, ended and then they
48:23
Speaker 2: would pass a. Budget but this particular group of, lawmakers,
48:27
Speaker 2: Again i'll say in the last decade or, so they've
48:28
Speaker 2: done a good job of completing it before the session.
48:31
Speaker 2: End but to get it and to get it signed
48:34
Speaker 2: and lineed item vetoed before the session, ends that would
48:37
Speaker 2: be a. Record but then lawmakers lose loose if they
48:40
Speaker 2: want to overturn. Anything, obviously they lose their leverage after
48:44
Speaker 2: the session is. Over so they if they want to
48:46
Speaker 2: try to overturn the line out in, veto as you,
48:48
Speaker 2: mentioned they got to get it into him his five
48:50
Speaker 2: day clock would start and then they would get it
48:52
Speaker 2: back before the regular session is.
48:54
Speaker 21: Over and we've talked about that a couple of different
48:56
Speaker 21: times throughout this SESSION tj And jeff THAT i think
48:59
Speaker 21: that's part of the, motivation maybe even the majority of
49:02
Speaker 21: the motivation to get that thing done early in case
49:04
Speaker 21: the governor uses that authority that you can come back
49:07
Speaker 21: in and override.
49:08
Speaker 1: Them Before siney die Next.
49:09
Speaker 22: Saturday power they've always, had but power they've never really. Exercised,
49:13
Speaker 22: jeff to your, point be interesting to, see you, Know
49:15
Speaker 22: Arch moore was a master if you go back to
49:19
Speaker 22: only giving the legislature what they needed to get it
49:22
Speaker 22: done by that sixty day. Mark if this happens and
49:25
Speaker 22: the governor's line At veto gets, overright be interesting to
49:27
Speaker 22: see if maybe he takes a page out of the
49:29
Speaker 22: More Book mexico around and kind of drags his feet
49:31
Speaker 22: a little bit.
49:31
Speaker 21: Too and as one delegate pointed out to us this, Morning,
49:34
Speaker 21: jeff it's the only reason we're.
49:36
Speaker 1: Here all the rest of it's just.
49:37
Speaker 5: Fluff.
49:37
Speaker 1: Anyway that's the, budget.
49:38
Speaker 2: Yep that's their one constitutional duty is they have to
49:42
Speaker 2: have a balanced. Budget that is very, true very. True,
49:45
Speaker 2: Okay so we've got A handshaw coming up in a
49:47
Speaker 2: couple of longmakers too on talk.
49:48
Speaker 21: Line, Right, Yeah Senator Brian helton AND tj are going

49:58

50:09

50:12
Speaker 21: of The. Senate there was a childcare bill that came
50:14
Speaker 21: out of The house yesterday that's been years in the.
50:17
Speaker 21: Making she's going to get us caught up on, those
50:20
Speaker 21: and we'll try to work in a text or.
