- Ben: Morning and welcome to your short term rental bulletin on the 26th of August. So before we go back to Spain today, and specifically we're going to go to the Canaries. So if you rent a home in the Canaries for a month or less, there's a new law that now assumes that you are running a tourist rental until you prove it otherwise. So this changed on the 15th of August and it was published in the Canary Gazette the day before. It is a planning law about speeding up building licenses, and it's in its 11th final provision. But it quietly added two new articles to the island's holiday let law that redo the line between tourist rental and seasonal one. So any stay of 31 days or less in a residential home or any listing on a tourist sales channel now is presumed to be tourist activity. Rebutting that presumption is the landlord's job. So you have to ask the tenant why they need temporary accommodation and write up that reason if you Into a contract. Skip it, and the contract's contract sounds like tourist letting. Three new offenses came with it. Failing to record the reason is a serious infringement. So we're talking 1501, 230,000 euros. Failing to ask at all is a minor one, up to 1500 euros. And marking it as a tourist state without meeting the legal requirements is very serious. I mean, we're talking 30,000 to 300,000 euros. There is a deadline too. Anyone registered before December 2025 who never filled the municipal classified activity notice has until the 31st of July 2027. The Canaro Canary Rental Association says that this invades states. competence over seasonal tenancies and was slipped into an unrelated bill. So the midterm let is no longer a way around your tourism rules and it is a contract you have to be able to prove. That is your Wednesday bulletin. I will see you tomorrow. Thank you for watching.
