Speaker 1: Now we turn to the Mountain Eagle to read news
0:04
from Whitesburg. Your reader today is Bill van Arsdale. You
0:09
will begin with the addition dated January seventh, twenty twenty six,
0:14
which the publishers have donated to RADIOI as a reminder.
0:19
Radio I is a reading service intended for people who
0:21
are blind or have other disabilities that make it difficult
0:24
to read printed material. The first headline is Father Jim
0:31
Sichkow pays it forward for grocery customers at Isisum. Father
0:37
Jim Sichkow, a Lexington priest known nationally for acts of kindness,
0:43
spent part of a recent weekday working behind the register
0:46
at the isom IgA grocery store. But instead of collecting money,
0:51
Sichko paid for every customer's groceries himself. Sichko, a papal
0:58
missionary of mercy, worked as a cashier for several hours,
1:02
quietly covering grocery bills for unsuspecting shoppers. Only the Christin family,
1:09
a few media outlets in Lexington and The Mountain Eagle
1:13
were aware of the plan in advance. The surprise left
1:17
many customers stunned. Some tried to refuse the offer, Others
1:23
offered to pay for the next person in line, and
1:25
several reacted with laughter and disbelief. Sichko added to the
1:30
moment with humor of his own, joking that it was
1:33
his first day on the job and that free groceries
1:36
were part of his training. Store co owner Simon Kristen
1:41
said the gesture meant more than the groceries themselves. Folks
1:46
come into the region to help when there's a natural disaster,
1:49
Kristen said, once everything is cleaned up, they usually disappear.
1:54
Father Jim is different. He has a soft spot in
1:58
his heart because of the flood, and not only did
2:01
he make an impact on us, but this community made
2:05
a deep, heartfelt impact on him too. Sichko's relationship with
2:11
the Isomiga dates back to the July twenty eighth, twenty
2:16
twenty two Eastern Kentucky flood, when the store, owned by
2:21
the Christian family was inundated by floodwaters when Kristen, Simon's
2:27
mother once described the business as sitting in the middle
2:31
of a river during the flood. During multiple visits after
2:36
the flood, Sichko provided substantial assistance, including seventy five thousand
2:41
dollars to help rebuild the store, a new vehicle for
2:45
a flood victim who lost hers, and thousands of dollars
2:49
in gift cards for families in need. On a later visit,
2:54
he returned with an additional twenty thousand dollars for the
2:57
store and gift cards for employed poyees while the rebuilding continued.
3:04
The idea for the cashier event was first discussed several
3:08
months ago and was initially planned for just before Christmas,
3:12
but was delayed due to scheduling conflicts. In the short
3:17
time he worked the register, Sichko paid for more than
3:21
sixteen hundred dollars worth of groceries. He told store owners
3:25
he plans to return in the spring or summer to
3:28
do it again. Siko serves as a Papal Missionary of
3:33
Mercy in Kentucky, with a special focus on the Central
3:37
Appalachian region as well as in parts of Texas. According
3:41
to his website, he has spent more than twenty five
3:44
years as a preacher, evangelist, and motivational speaker. In twenty fifteen,
3:51
Pope Francis commissioned him as one of one hundred Papal
3:54
Missionaries of Mercy in the United States and one of
3:58
one thousand worldwide. Through his ministry, Sichko has carried out
4:04
random acts of kindness in all fifty states, ranging from
4:09
rebuilding flood damaged businesses to helping families cover funeral expenses.
4:15
His work has been featured by major national news outlets.
4:19
For a residence of West Letcher County, However, his impact
4:23
was felt one grocery receipt at a time. The next
4:30
story is Judge's order blasts defense ensued against Sheriff's department.
4:37
A federal judge has denied a motion by the Electra
4:41
County Sheriff's Office and former Deputy Ben Fields to reconsider
4:46
part of an order denying them summary judgment against a
4:49
woman suing them for improper sexual contact between her and Fields.
4:55
Fields pleaded guilty to second degree rape in Electric County
4:59
criminal case associated with the civil suit filed in U. S.
5:03
District Court in Pipeville and now moved to London with
5:07
the closure of the Pipeful division. In a blistering order
5:12
filed this week, U S. District Judge Robert Weir called
5:16
the motion to reconsider a lawyer's make work filing and
5:20
said that defendants haphazardly lodge a series of disjunct statements
5:25
in an attempt to undermine the Court's order. This motion
5:30
does nothing more than re raise the same set of
5:32
arguments already addressed by the Court. The order says defendants
5:37
have not demonstrated a sufficient basis for relief, and the
5:41
Court therefore denies the motion for reconsideration. The motion argued
5:47
that Fields was not a deputy but a court security officer,
5:51
and as such was not required to have the same
5:53
training as others. The judge, however, said former Sheriff Mickey
5:59
Steins testified in a deposition that Fields absolutely violated the
6:04
sexual misconduct policy, that he was a deputy who had
6:08
geographically limited authority. The judge noted that the policies encompass
6:14
all officers, all sworn officers, all employees or members of
6:19
the agency. Fields surely was sworn, and the last letter
6:24
in CSO stands for officer. The judge wrote, again, the
6:29
policymaker himself agreed on applicability, so the motion really is
6:34
a lawyer's make work filing that does not displace Defense
6:38
Exhibit one sixty five in any manner. The Court also
6:43
brushed aside the defendant's contention that the Court was wrong
6:47
in ruling that the Sheriff's Department should have had a
6:49
written approval of Field's employment with Eastern Kentucky Correctional Services, Incorporated,
6:55
the company for which he was moonlighting as the home
6:58
monitoring and home and car teration supervisor while working full
7:02
time as a bailiff in the court of the late
7:05
Judge Kevin R. Mullins. This argument was also raised in
7:10
defendant's reply in support of their motion for summary judgment
7:14
and therefore already considered by the court in rendering its order.
7:18
The ruling says, nevertheless, the Court unequivocally dispels it. Now
7:25
the ruling seems to render moot at least three other
7:28
filings in the case. The plaintiff's attorney, Joe Childers of Lexington,
7:33
had asked for leave to file a late response to
7:36
the original motion to reconsider, and the defense answered that
7:40
response was already three months late and would substantially delay
7:44
the trial in the case, which was originally filed in
7:47
early twenty twenty two. The case could be delayed anyway.
7:52
The plaintiff has sought to have Stein's testify in the case. However,
7:57
Stein's is currently in the Leslie County Detail Center awaiting
8:01
trial on a charge of murdering Judge Mullins. The shooting
8:05
was captured on a security camera in Mullins's chambers. The
8:11
next headline is doctor says flu cases are rising. This
8:18
year's influenza season is coming on more severely than usual
8:22
thanks to a rapidly mutating virus and a new dominant variant.
8:29
While the US Centers for Disease Control is floundering in
8:32
the wake of thousands of job cuts, Canadian researchers saying
8:37
there is a mismatch between the vaccine produced for this
8:39
year and the dominant strain of flu, circulating FLUA. The
8:45
most common influenza strain of the season was expected to
8:49
be H three N two, but a mutation of H
8:53
three N two, called subclade K, has become dominant and
8:58
has largely evaded the vaccine, causing more people to be
9:02
hospitalized this season, and H three N two is not
9:07
the only variety of flu A circulating doctors are also
9:11
seeing H one N one. According to the US Influenza
9:15
Surveillance Report for the week ending December twenty seventh, the
9:20
number of people testing positive for flu was up thirty
9:23
two point nine percent over the week before, and deaths
9:27
from influenza were up point nine percent. The CDC characterizes
9:32
incidents of the flu this year as very high and increasing.
9:38
There have already been seven point five million illnesses, eighty
9:42
one thousand hospitalizations and three thousand, one hundred deaths, said
9:47
doctor Faris Cotter, infectious disease specialist at Mountain Comprehensive Health
9:53
Corporation in Weinsburg. That's a lot. I just got an
9:57
email yesterday and there are five more pa theatric deaths
10:01
last week. Cotter said there have not been many people
10:05
hospitalized with flu in Weisberg yet, but the number of
10:09
cases is increasing nationwide. The elderly and children under the
10:14
age of four years are at the highest risk. So far,
10:18
he said, just one hundred thirty million flu vaccines have
10:22
been given this year, which he said is much less
10:25
than last year. Doctors are recommending everyone over the age
10:29
of six months yet the flu vaccine. Symptoms of the
10:35
H three N two subclade K are similar to the
10:38
symptoms of other flu strains, but are more severe. They
10:43
include high fever and chills, with many people reporting temperatures
10:47
near or at one hundred four degrees fahrenheit and a
10:51
persistent cough. That can last for two to three weeks.
10:56
Extreme fatigue and weakness, intense body aches, headaches, sore throat,
11:01
and running nose are common. Some less common symptoms have
11:06
been reported, including nausea, vomiting, and diarrhea. Cotter said there
11:12
are also some cases of COVID nineteen. Precautions are the
11:17
same for both illnesses. Vaccine and masking are the key.
11:22
Cotter said, there is always a very good place for
11:25
masking because the mask protects you from the flu no
11:29
matter what. The next headline is psc Okay's plan allowing
11:37
Kentucky Power to raise monthly average bill two dollars and
11:42
thirty three cents. Kentucky utility regulators have approved a plan
11:48
allowing Kentucky Power Company to continue using electricity from the
11:53
Mitchell Generating Station after twenty twenty eight, concluding that the
11:58
aging coal fired plant remains the least costly option available
12:03
to meet the region's power needs in the near term.
12:07
In an order dated December thirtieth, twenty twenty five, the
12:11
Kentucky Public Service Commission granted Kentucky Power a certificate of
12:16
public convenience and necessity to maintain its fifty percent share
12:20
of the Mitchell plant located on the Ohio River in
12:24
West Virginia. The decision also approves environmental compliance upgrades and
12:30
changes to customer rates tied to those costs. The ruling,
12:35
which is separate from the company's current request for a
12:39
fourteen point nine per cent rate increase, follows months of
12:43
testimony and debate involving Kentucky Power, the Kentucky Attorney General's Office,
12:48
industrial customers, and environmental advocates. Capacity concerns drive decision. Regulators
12:58
found that Kentucky Power faces of growing shortage of generating
13:02
capacity beginning in twenty twenty nine, driven by changes in
13:07
the PJM regional power grid and rising demand during winter peaks.
13:13
Without Mitchell, the company would be forced to rely heavily
13:17
on the wholesale energy market or short term power contracts, options,
13:22
the Commission said, would expose customers to higher costs and
13:26
greater risk. While there are few good options, the Commission wrote,
13:32
continuing to take power from Mitchell was described as the
13:36
least bad option available at this time. Kentucky Power serves
13:42
roughly one hundred sixty three thousand customers across eastern Kentucky,
13:47
including most of Letcher County and surrounding counties of Pike, Knot,
13:52
and Perry, environmental upgrades and rate impacts. The approval includes
14:00
recovery of costs associated with federally required wastewater treatment upgrades
14:04
at Mitchell, known as the Affluent Limitation Guidelines or ELG project.
14:12
Those upgrades were necessary for the plant to continue operating
14:15
beyond earlier deadlines. Under a settlement agreement supported by industrial
14:21
customers and not opposed by the Attorney General, the costs
14:25
will be spread over a longer period, reducing the immediate
14:29
impact on residential bills. Regulators estimate the average household would
14:35
see an increase of about two dollars and thirty three
14:38
cents per month. Criticism of planning but approval granted. Environmental
14:46
group Sierra Club opposed the plan, arguing that Kentucky Power
14:51
failed to adequately analyze alternatives such as converting the plant
14:55
to natural gas or pursuing short term power purchase agreements.
15:01
Its expert testimony criticized the company's analysis as incomplete and
15:06
inconsistent with industry best practices. The Commission largely agreed that
15:12
Kentucky Power's planning had flaws, and noted that the company
15:16
waited too long to secure replacement resources. However, regulators concluded
15:22
that those shortcomings did not outweigh the lack of realistic,
15:26
affordable alternatives available today. Not a long term endorsement of coal,
15:35
The Commission emphasized that the approval does not lock Kentucky
15:39
Power into long term coal use. Federal environmental rules currently
15:45
limit Mitchell's ability to operate as a coal plant beyond
15:49
twenty thirty one without major additional changes. Further investments at
15:55
the plant will require separate review, and regulators warned that
16:00
all costs remain subject to scrutiny for reasonableness and prudence.
16:05
The Commission made clear this is not a blank check,
16:08
the order states, stressing that customer protections and oversight will
16:13
continue what comes next. Kentucky Power is expected to file
16:20
additional plans in coming years addressing how it will meet
16:24
customer demand beyond twenty thirty one, including possible fuel conversions
16:29
or new power plants. Regulators also encouraged the company to
16:34
explore financing tools such as securitization that could reduce long
16:40
term costs to customers. The next headline is sheriff is
16:47
warning of possible scam. The Electric County Sheriff's Department is
16:52
looking into a possible scam involving driveway surfacing. Sheriff Billy
16:58
Jones said here he was first notified Friday evening of
17:02
a group offering to use leftover materials from a job
17:06
to surface driveways cheap and then trying to stick customers
17:10
with a huge bill for substandard work. So far, they've
17:15
only got one guy for about four thousand dollars. Jones said.
17:19
They almost got another one, but the sun came home
17:22
and confronted them about it. Both the people who agreed
17:26
to have the work done were elderly. Jones said it's
17:30
not asphalt that's being spread, but a very thin layer
17:33
of something. Some who were targeted describe what was being
17:37
put down as gray mush. He said he's careful about
17:42
calling it fraud because work was done, even if it
17:46
was not a quality job and was overpriced. The man
17:50
whose son intervened had signed papers agreeing to pay and
17:55
wasn't told how much until the work was done. The
17:58
price was then set at three thound three hundred dollars.
18:02
The problem comes in if their strong arming elderly folks,
18:06
Jones said. Jones said the group is driving a yellow
18:10
dump truck with a West Virginia license plate. The person
18:15
they were able to get money from was at Premium,
18:18
and the man whose son interrupted them was at UZ.
18:23
They also approached homeowners at Smoot Creek and Little Dry Fork,
18:27
but Jones said he had received no other complaints. A
18:31
telephone number given to one of the people targeted had
18:35
a three to four area code, which is in West Virginia.
18:41
The next story is average gas price will fall below
18:46
three dollars. Gas Buddy this week released its twenty twenty
18:51
six fuel price Outlook, forecasting the yearly national average price
18:56
of gasoline will fall back below three dollars per gallon
19:00
for the first time since the COVID nineteen pandemic. The
19:04
yearly US average is projected to be two dollars and
19:08
ninety seven cents per gallon, down thirteen cents from twenty
19:12
twenty five's average of three dollars and ten cents and
19:15
marking the lowest yearly average since twenty twenty. Despite the
19:21
welcome relief from the highs seen earlier in the decade,
19:25
gas Buddy expects twenty twenty six to still bring familiar
19:29
bouts of volatility tied to seasonal demand, refinery maintenance, hurricane
19:35
season and ongoing geopolitical risks. Diesel prices are forecast to
19:41
remain elevated relative to gasoline, but continue easing from recent peaks,
19:47
averaging three dollars and fifty five cents per gallon for
19:49
the year. Key highlights from gas Buddies twenty twenty six
19:55
Fuel Outlook twenty twenty six national average projected to be
20:00
two dollars ninety seven cents per gallon, down from three
20:03
dollars and ten cents in twenty twenty five, the fourth
20:06
straight yearly decline. Spring peak prices may briefly reach the
20:12
low three dollars and twenty cents during the switch to
20:15
summer gasoline. Second half relief prices are likely to fall
20:21
after June, with December forecast to average two dollars and
20:25
eighty three cents. Diesel forecast to average three dollars and
20:30
fifty five cents nationally in twenty twenty six, down from
20:34
three dollars and sixty two cents in twenty twenty five.
20:38
Lowest priced regions the Gulf Coast and South are expected
20:42
to stay well under three dollars. Highest priced regions California,
20:48
the Northeast, and Chicago remain top cost areas but below
20:52
twenty twenty two highs US gasoline spending. Motorists are projected
20:59
to spend eleven billion dollars less on gasoline in twenty
21:03
twenty six compared to twenty twenty five. Average households spending
21:09
projected at two thousand, eighty three dollars, down slightly from
21:13
twenty twenty five. The world has spent years recovering from
21:17
the economic whiplash of the pandemic and the shock of
21:21
Russia's invasion of Ukraine, but the situation has been improving
21:25
quietly since twenty twenty two, said Patrick Dehan, head of
21:31
petroleum analysis at gas Buddy. As global central banks slammed
21:36
the brakes on an overheated economy and new refining capacity
21:40
came online, we've seen fuel prices ease year after year,
21:45
a trend few would have been on when chaos ruled
21:48
the energy market, and twenty twenty six keeps that momentum going.
21:53
It's not a return to ultra cheap fuel, but for
21:56
the first time in a long time, the wind is
21:59
clearly behindvers backs. If the market avoids major surprises, sustained
22:05
averages below three dollars per gallon could become commonplace in
22:09
the year ahead. The next story is felony charges filed
22:16
after Water and Sewer District goes after theft. A Electric
22:21
County man is charged with two felonies. After the Electra
22:24
County Water and Sewer District began cracking down on water theft,
22:30
The district obtained a warrant for thirty four year old
22:33
Joshua M. Brock, charging him with theft of service over
22:37
one thousand dollars but less than ten thousand dollars and
22:40
criminal mischief second degree. According to the warrant, Brock disconnected
22:46
the water meter and straight piped the water to a
22:49
line going into his house. Water District General manager Jason
22:53
Lewis said Water district employees went to the home repeatedly
22:57
and reinstalled the meter and spoke to abroad. Each time,
23:01
Lewis said they would find the meter connected but leaking
23:05
large amounts of water. Again. The water District estimated the
23:09
cost of the lost water at more than three thousand,
23:12
five hundred dollars. A broken lock on the meter was
23:15
estimated at two hundred dollars. We caught him stealing five
23:20
times in three weeks, Lewis said. According to court records.
23:25
Brock has a Daniel's Branch address, but Lewis said the
23:28
theft occurred at a home between Smoot Creek and Little Collie.
23:33
Brock was arrested at two four five one DL Drive,
23:37
which turns off Kentucky eighteen eleven. Brock was arrested on
23:42
December sixteenth. He was released from jail December twentieth on
23:47
a five thousand dollars bond at ten percent, meaning the
23:50
person bailing him out had to pay five hundred dollars.
23:55
The next story is video rebuts defense CLIs that judge
24:01
in Stein's case was pal of Mullins's. A written motion
24:06
filed by defense attorneys for former Elector County Sheriff Mickey
24:10
Steins claims that the judge sitting in his murder trial
24:14
spent two hours inches away from the victim, District Judge
24:18
Kevin R. Mullins, just a week before his death. But
24:22
a review of video from a link sent by the
24:25
attorney shows Judge Christopher Korn arrived at the meeting of
24:29
the Judicial Commission on Mental Health an hour and fourteen
24:32
minutes after it began. He sat down at a conference
24:36
table with a chair between him and Mullens, and the
24:40
two never appeared to acknowledge each other. Koran was therefore
24:44
approximately fifty two minutes and spent part of Mullins's committee
24:48
presentation scrolling through his cell phone. Defense attorney Jeremy Bartley
24:54
wrote in his motion that state law requires a judge
24:58
to step down from hearing a case where he has
25:01
a personal bias or prejudice concerning a party, or personal
25:05
knowledge of disputed evidentiary facts concerning the proceedings, or has
25:09
expressed an opinion concerning the merits of the preceding, or
25:13
knowledge of anything else that might call his impartiality into question.
25:18
The motion says that the video has been brought to
25:21
the attention of counsel for the defense, and that upon
25:25
information derived from the defense's investigator. Mullins's widow is also
25:29
in attendance and show in the video. Missus Mullins appears
25:33
to be seated across the room from where her husband
25:36
is seated at a long conference table. The reference to
25:41
an investigator appears to be a reference to Joel Newton Cotton,
25:45
a private investigator from Anderson County who has been visiting
25:49
and questioning potential witnesses here. The meeting held September twelfth,
25:56
was chaired by Kentucky Chief Justice Deborah H. Lambert. While
26:00
the commission includes seventy five members, many of those were
26:04
not in attendance in person, with many attending via zoom
26:08
video conferencing. Mullins, who was very active in the organization,
26:13
spoke at length about the Treatment and Access Commission, which
26:16
he chaired. During the video, Mullens reports on his involvement
26:21
with legislative efforts as well as the Women's with Dignity bills.
26:25
The motion says Mullins also highlights his recent recovery events
26:30
and expungement efforts in Weisberg. Mullins then discusses his professional
26:35
plans for the following week at the District Judges's College.
26:40
When discussing this upcoming event, Judge Koran appears to nod
26:43
in approval. The request that Koran recused himself was first
26:49
made just before bond hearing on December eighteenth was about
26:53
to begin. That hearing was canceled abruptly after the defense,
26:58
the prosecution, and the judge arrived when defense attorneys brought
27:02
up the video in chambers before court began. The motion
27:06
addresses that only obliquely saying that this motion is filed
27:10
immediately upon discovery of the facts upon which the disqualification risks,
27:15
as required by Kentucky law. The defense argues that there
27:20
is an appearance of bias in favor of Mullens because
27:23
of the video and because Chloron denied their motion to
27:27
use a mental health report about Stein's to be used
27:30
during the bond hearing. The motion says that despite the
27:34
consent of the defendant, the mental health report from the
27:37
state's own expert has been disallowed as evidence in the
27:40
bond hearing. While the undersigned is restrained by the previous
27:44
order from discussing the findings in the report or the contents,
27:49
our client made multiple revelations to the examiner that fall
27:53
into the category of evidence that would conflict with the
27:56
judges professional knowledge of the deceased. The prosecution also filed
28:02
documents supporting its motion for the case to be moved
28:05
to another county. The papers include affidavit's file by County
28:09
Attorney Jamie Hatton, Commonwealth Attorney Matthew Butler, and Attorney Ashley Storgel,
28:15
saying that neither the defense nor the prosecution could receive
28:19
a fair trial in Letcher County This concludes the reading
28:25
of The Mountain Eagle. Your reader has been Bill then Arsdale.
28:29
Now please stay tuned for continued programming on behalf of
28:34
every One here at Radio. I thank you for listening
28:37
and have a good day.
