- 0:00So incredibly much to get to. I don't even know where to
- 0:03start. The short version is, is that if
- 0:08there was any doubt that this trial scheduled for December 1st
- 0:15was going to go the distance, if it would be settled, you could
- 0:19throw that out the window. And in fact, and his closing
- 0:22remarks, Judge Bell, who is overseeing this case since
- 0:27October, said it was clear to him that this was going the
- 0:31distance. And it has gotten very ugly, the
- 0:37things that have been uncovered in discovery, which is what
- 0:41happens when both sides get to open their respective books and
- 0:45look at text messages, emails, documents related to the case.
- 0:52And both the 2311 in front row and the NASCAR sides have
- 0:59uncovered some documents that are just absolutely downright
- 1:03brutal about the other side. And this is not a very
- 1:08professional video in the sense that I've got a lot to dig
- 1:11through here and I'm just going to hit a lot of the keynotes
- 1:15right. One upon reading the the NASCAR
- 1:23filing last week, there was one one line that was redacted that
- 1:27said, you know, Curtis Polk, how Curtis Polk, who is the co-owner
- 1:31of 2311 Michael Jordan's long time business partner, how he
- 1:35really feels about NASCAR. And he said, you know, Cup
- 1:40racing is boring. That race last night was boring
- 1:44as, uh, at one point Denny Hamlin said in a text message to
- 1:50to Michael and and Steve that his despise quote despise for
- 1:56the France family runs deep. Steve Loletta says that the only
- 2:01way that we hope we move forward is when Jim France dies.
- 2:07My point being, even before getting into a lot of the the
- 2:11legalese and the the technical stuff involving this case is
- 2:15that it is downright personal. The two sides do not like each
- 2:20other at all. And Judge Bell, even at the end,
- 2:24Judge Bell said there appears to be disputed material facts.
- 2:33The the two lawyers, these guys are friends.
- 2:36Jeffrey Kessler representing 2311 in front row, Christopher
- 2:40Yates. They have argued sports
- 2:43antitrust lawyer stuff cases for a long time, a very long time.
- 2:48They they consider themselves good friends, but they're on
- 2:51opposite sides a lot. And it got personal between
- 2:55them. Chris Yates brought up case in
- 2:58in January and I don't know if this is the UFC case or the the
- 3:02swimming league case. I need to double check that.
- 3:05But talking about how Jeffrey Kessler had lost that case and
- 3:11Jeffrey Kessler was like, it's irrelevant to to this case.
- 3:14But if you know, if, if, if my friend here, Christopher Yates
- 3:18wants to get into the mud, we'll get into the mud and he lost
- 3:20this case. And so the judge even says
- 3:23talking about a trial in December, that quote, I have a
- 3:27more lackadaisical position and I enjoy this.
- 3:33I don't like having you 2 going at each other.
- 3:36And when a jury is in the box, there will be none of that.
- 3:41And he also told them that you better understand what a
- 3:44Charlotte jury is because no matter what you think of your
- 3:47case in your position and your likelihood of success, you need
- 3:51to lean on your Charlotte area council.
- 3:53Because he has tried most of his career in the Western District
- 3:57of North Carolina, here in Charlotte.
- 3:59And he says that there are some nuances about the Charlotte
- 4:02juries that are just fundamentally different.
- 4:04He says, I do not mean to lecture you, but I have a lot
- 4:07more experience in this courtroom than you do.
- 4:10And so I'm going to go write this up in a minute.
- 4:13And there's just so much to get into, but I want to do to drop
- 4:16this video in here really, really quickly.
- 4:19But there's a lot of like material facts here too, right?
- 4:22Like things that go beyond the personal animus that's going to
- 4:26make the the headlines here. But basically what this thing is
- 4:32about today is that 2311 in front row, they they want to
- 4:38have their charter status back. Remember, there was a injunction
- 4:42ruling in December that forced NASCAR to recognize 2311 in
- 4:48front row as having charters this season.
- 4:51NASCAR appealed that to the 4th Circuit in Richmond, VA, which
- 4:56then overruled Judge Bell's ruling.
- 4:59And so for the last month and a half, 2311 in front row have not
- 5:02had recognizable charter status. That means NASCAR is no longer
- 5:07paying them as if they're charter teams.
- 5:10They haven't given the money back to NASCAR, but they are not
- 5:15guaranteed entrance, although NASCAR did change their rules
- 5:20right afterwards to basically lock in the two teams.
- 5:24So to basically head off the ability for them to claim
- 5:26irreparable harm because if they start missing races and then
- 5:30that could be damages that NASCAR would owe, right.
- 5:34So that was that was a case. That was a point made by Jeffrey
- 5:37Kessler representing the teams to judge asked me or are you at
- 5:41risk of missing races? And he said no, but only because
- 5:44they changed the rules and and Judge Bell said that's
- 5:47irrelevant for the sake of just getting to December.
- 5:51The other issue is what becomes of all these charters, right?
- 5:55The 4th Circuit no longer forced NASCAR to recognize 2311 in
- 6:00front row as having charters. Therefore, they're going to try
- 6:07to sell one of these charters and they of course released in
- 6:10that affidavit or in their filing last week they've they've
- 6:14reached an agreement with a currently unknown buyer or how
- 6:18do I say buyer? We don't know if they're going
- 6:20to sell it or just transfer or what have you.
- 6:25And the 2311 in front row are asking the court to to enjoin
- 6:30them from doing so to prevent them from doing so.
- 6:34And the judge says he will have a ruling on that sometime next
- 6:39week. So after the Southern 500, the
- 6:43case, the the arguments they made on that case is quite,
- 6:47quite thorough. I mean, Jeffrey Kessler said
- 6:50that the cleanest path to get to the December trial is to just
- 6:55maintain that status quo, which is where they were right before
- 6:59the lawsuit was filed that 2311 in front row where charter
- 7:03teams, where they were throughout most of this season
- 7:06until the the ruling was overturned by the 4th Circuit.
- 7:11Kessler's point is that we will be we will be irreparably harmed
- 7:18if NASCAR is allowed to move those charters to this mystery
- 7:23team, right? And so the rebuttal from NASCAR
- 7:28is that they will be irreparably harmed if they are not allowed
- 7:32to move forward approaching the 2026 season because they have
- 7:38interested parties. Which by the way, they say that
- 7:412311 in Front Row's case is kind of moot because if they were a
- 7:45proper monopsony and they were anti competitive, they would be
- 7:51suppressing team value and team revenue.
- 7:56So that's another point of it as well.
- 7:59There is a lot to unpack here. And I know this video does not
- 8:01do a great job of laying out all of this, and you really need to
- 8:05look at it. And this is the power of written
- 8:06word, right? But I think the key takeaways
- 8:08here there are that these two sides do not like each other at
- 8:12all. There are effectively wishes for
- 8:16people to die, deep resentment, a complete mistrust and
- 8:22disregard of how their businesses affect each other.
- 8:26And this is going the distance. And we're going to be right back
- 8:29here on December 1st to have a trial by jury to determine
- 8:34whether or not if NASCAR has acted in a violation of federal
- 8:38antitrust laws, but also if Curtis Polk has also violated
- 8:43antitrust laws by affecting NASCAR's TV deals, threatening
- 8:48boycotts, trying to undermine NASCAR business.
- 8:53And there are so many different sub layers to this.
- 8:57And I'm about to go over to a local coffee shop here in Uptown
- 9:00Charlotte and we're going to break it down.
- 9:02And I hope you guys will kind of peruse this and look forward
- 9:07later.
