Speaker 1: What's up everyone and welcome back to the Epstein Chronicles.
• 0:04
Speaker 1: David Boies, lawyer for Virginia Roberts and Annie Farmer, has
• 0:09
Speaker 1: given his first interview since Ghislaine Maxwell has been sentenced.
• 0:14
Speaker 1: And in this interview with The Independent, he talks about
• 0:18
Speaker 1: how the other people who were involved in all of this,
• 0:23
Speaker 1: and as we all know, there were a lot of
• 0:25
Speaker 1: other people involved in all of this, how they should
• 0:28
Speaker 1: be held responsible. now that Maxwell has been. And for me,
• 0:34
Speaker 1: there is no other way that this should go. When
• 0:39
Speaker 1: you have as many people involved on a day-to-day basis
• 0:44
Speaker 1: as we had involved with Jeffrey Epstein and Ghislaine Maxwell,
• 0:49
Speaker 1: there is no way anyone can convince me that this
• 0:52
Speaker 1: isn't a RICO case and that there aren't other people
• 0:57
Speaker 1: who shouldn't be brought in. Now, we have all of
• 1:00
Speaker 1: the names Virginia has given us already. And David Boies
• 1:05
Speaker 1: and Company, they've handed all of that information over to
• 1:08
Speaker 1: the feds. They did that in 2015. So it's not
• 1:12
Speaker 1: like the feds didn't have this information, like they were
• 1:15
Speaker 1: waiting for somebody to come forward and clue them in
• 1:18
Speaker 1: on what happened. We all know what happened. And the
• 1:23
Speaker 1: FBI dropped the ball like it has many, many times
• 1:27
Speaker 1: before when it comes to severe, serious sexual assault investigations.
• 1:32
Speaker 1: Just take a look at how they're on the hook
• 1:34
Speaker 1: right now when it comes to Larry Nassar. This is
• 1:39
Speaker 1: something that has been pervasive within the FBI. They might
• 1:44
Speaker 1: not want to address it, but it's very clear for
• 1:47
Speaker 1: everybody else who's paying attention that the FBI really... has
• 1:52
Speaker 1: dropped the ball time and time again here. And if
• 1:55
Speaker 1: they don't go after this the way they should, and
• 1:57
Speaker 1: they don't go after all these other people, well, it's
• 2:00
Speaker 1: just another fumble, isn't it? All right, today our article
• 2:05
Speaker 1: is from The Independent, and the author of this article
• 2:10
Speaker 1: is Bevan Hurley. Headline, Virginia Roberts lawyer on prosecuting powerful abusers.
• 2:17
Speaker 1: There are many people involved in this beyond Maxwell and Epstein.
• 2:22
Speaker 1: Virginia Roberts' attorney tells Bevin Hurley, the rich and powerful
• 2:26
Speaker 1: implicated in the Epstein-Maxwell sex trafficking ring deserve to be
• 2:31
Speaker 1: brought to justice. 100%. And if there isn't a grand
• 2:36
Speaker 1: jury panel impaneled right now, then I don't know what
• 2:41
Speaker 1: they're doing. Because there's as much circumstantial evidence out there
• 2:46
Speaker 1: to arrest people like Indyke and Kahn and Sarah Kellen Vickers.
• 2:52
Speaker 1: as there was to bring in Maxwell. So what are
• 2:55
Speaker 1: they waiting for? And why have they waited this long?
• 3:02
Speaker 1: When powerhouse attorney David Boies received the news that Ghislaine
• 3:05
Speaker 1: Maxwell had been sentenced to 20 years in federal prison
• 3:09
Speaker 1: for child sex trafficking last week, he allowed himself a
• 3:12
Speaker 1: wry smile. It was very satisfying. Mr. Boies told The
• 3:16
Speaker 1: Independent in his first interview since the sentencing, this was
• 3:20
Speaker 1: an important step. There's no doubt this was an important step.
• 3:24
Speaker 1: A huge, a huge step. It sends a message too, right?
• 3:28
Speaker 1: But it only matters if the follow through continues. What
• 3:34
Speaker 1: do you think? Whoever's out there engaging in human trafficking
• 3:37
Speaker 1: right now is going to see the sentence that Ghislaine
• 3:40
Speaker 1: Maxwell got or that R. Kelly got? And say to
• 3:44
Speaker 1: themselves oh well this isn't worth it. We're just going
• 3:46
Speaker 1: to stop. Because that's not going to happen. No matter
• 3:50
Speaker 1: how harsh the sentence is. This needs to be a
• 3:53
Speaker 1: message to the people who were involved. And the only
• 3:57
Speaker 1: way that this message can truly be sent. Like they
• 4:00
Speaker 1: say they want to send it. Is if they bring
• 4:03
Speaker 1: in the rest of these people. But he also felt
• 4:07
Speaker 1: the lingering sense of unfinished business. About the many wealthy
• 4:11
Speaker 1: and powerful figures. who have not had to answer for
• 4:14
Speaker 1: their roles in Jeffrey Epstein and Maxwell's decades-long pyramid scheme
• 4:19
Speaker 1: of abuse. I get it. I understand. Now, obviously, I'm
• 4:24
Speaker 1: nowhere near as close to all of this as David
• 4:27
Speaker 1: Boies is. Dude's been in the trenches fighting against Epstein
• 4:32
Speaker 1: and Maxwell for years now. But I understand what he
• 4:35
Speaker 1: means with the unfinished business part, because I feel the
• 4:38
Speaker 1: same way here on this podcast. There's a lot of
• 4:41
Speaker 1: unfinished business. And all of these people like Indyk and
• 4:46
Speaker 1: Khan and Vickers especially, they definitely need to be brought in.
• 4:51
Speaker 1: Because if not, then what has really been accomplished besides,
• 4:57
Speaker 1: you know, bringing Maxwell to justice, which is great, don't
• 5:01
Speaker 1: get me wrong, as I've said a million times, definitely
• 5:04
Speaker 1: a huge part of fixing the problem. But it takes
• 5:08
Speaker 1: a little bit of the shine and the lacquer off
• 5:10
Speaker 1: of it if you don't follow through with the next step. Mr.
• 5:15
Speaker 1: Boyce has for decades been one of America's best-known litigants, famously,
• 5:20
Speaker 1: but unsuccessfully, representing the Democratic Party candidate Al Gore in
• 5:25
Speaker 1: a case against George W. Bush to settle the contested
• 5:29
Speaker 1: 2000 presidential election. The 81-year-old represented Annie Farmer and Virginia
• 5:35
Speaker 1: Roberts in civil lawsuits against Epstein and Maxwell. I remember
• 5:41
Speaker 1: when all of that was going on in 2000 and
• 5:44
Speaker 1: you had the whole battle royale about the hanging chad
• 5:48
Speaker 1: and the armies of lawyers and the lawsuits and all
• 5:51
Speaker 1: of the days it took to get the election locked in.
• 5:54
Speaker 1: And still, there's a lot of people who don't even
• 5:57
Speaker 1: believe that those election results were what they are. In 2015,
• 6:03
Speaker 1: he handed over their entire civil file to the Justice
• 6:06
Speaker 1: Department in the hopes they would investigate and prosecute Epstein, Maxwell,
• 6:11
Speaker 1: and some of the dozens of other rich and powerful
• 6:13
Speaker 1: associates named and identified by Ms. Roberts. And this should
• 6:20
Speaker 1: have happened back then. All of those people who were
• 6:23
Speaker 1: directly implicated by Virginia Roberts especially considering she went on
• 6:29
Speaker 1: record and stated those names, those people should all be
• 6:33
Speaker 1: looked at under the world's largest microscope. Every one of
• 6:38
Speaker 1: them should be brought in, put under oath, and they
• 6:40
Speaker 1: should all have to testify about their relationship with Epstein.
• 6:44
Speaker 1: And that includes guys like Bill Richardson. Because... Everything we've
• 6:50
Speaker 1: heard from Virginia leading up to this point has been
• 6:54
Speaker 1: at least some of the foundational basis for these convictions.
• 6:58
Speaker 1: And we've seen what's happened to people when there's been
• 7:01
Speaker 1: defamation lawsuits as well. Those people end up getting charged afterwards.
• 7:08
Speaker 1: She has shown that she's to be believed, at least
• 7:12
Speaker 1: in my opinion. So... when she's pointing her finger at
• 7:16
Speaker 1: these other people, why should I believe that they weren't involved?
• 7:20
Speaker 1: Especially considering that you can put the receipts together and
• 7:23
Speaker 1: the paperwork to put them in Epstein's presence a whole
• 7:28
Speaker 1: bunch of times. So all of those people, every last
• 7:33
Speaker 1: one of them, should be brought in. And if this
• 7:37
Speaker 1: was a RICO case like it should have been, they
• 7:40
Speaker 1: all would have been brought in. But so far, only
• 7:44
Speaker 1: three people have been held criminally liable. They are Epstein,
• 7:49
Speaker 1: who died by suicide in prison in 2019, allegedly, aged 66,
• 7:54
Speaker 1: while awaiting trial for sex trafficking. His close friend, Jean-Luc Brunel, 76,
• 8:00
Speaker 1: who in February hanged himself in a Paris jail where
• 8:03
Speaker 1: he had been held for a year on suspicion of
• 8:05
Speaker 1: rape of minors and trafficking of minors for sexual exploitation.
• 8:09
Speaker 1: and Maxwell convicted in New York on five sex trafficking
• 8:13
Speaker 1: counts in late December and jailed for 20 years at
• 8:17
Speaker 1: her sentencing on June 28th. But, you know, it's just
• 8:20
Speaker 1: a coincidence that Brunel and Epstein both suffered the same fate, huh? Now,
• 8:25
Speaker 1: with Brunel, doesn't seem as odd, the matter of his death. Again,
• 8:32
Speaker 1: I'm not a an expert on French lockups or French prisons,
• 8:37
Speaker 1: so I'm certainly not somebody who would sit here and
• 8:39
Speaker 1: tell you with any confidence, one way or the other, oh,
• 8:43
Speaker 1: I'm certain that XXX or X occurred in that French jail.
• 8:48
Speaker 1: I have no idea. Looks to me like Brunel probably
• 8:52
Speaker 1: killed himself. Now, is that 100% certain? Man, is anything
• 8:56
Speaker 1: 100% certain in this case, besides the fact that these
• 9:00
Speaker 1: people are scumbags? But with Epstein, boy oh boy, there
• 9:04
  Speaker 1: sure is a lot there. The cameras, D'Artagnan, I won't
• 9:08
Speaker 1: beat a dead horse, but you get my drift. There
• 9:13
Speaker 1: are many people who were involved in this beyond Maxwell
• 9:16
Speaker 1: and Epstein and Brunel, Mr. Boyce told The Independent. Sex
• 9:19
Speaker 1: trafficking could not have gone on remotely at the scale
• 9:23
Speaker 1: at which it went on or for the duration that
• 9:25
Speaker 1: it went on without the collaboration and cooperation of a
• 9:29
Speaker 1: lot of additional people. These people too should be brought
• 9:33
Speaker 1: to justice. But as time goes on and the prosecutors
• 9:36
Speaker 1: don't do anything, I think the chances that actually happens diminishes. Look,
• 9:41
Speaker 1: he's not wrong. He's not wrong. He's just giving you
• 9:44
Speaker 1: the truth. We all want to hope and pray that
• 9:47
Speaker 1: the prosecutors are going to move forward and that the
• 9:50
Speaker 1: co-conspirators are going to be brought to justice. But we
• 9:55
Speaker 1: also know that the reality that we live in, there's
• 9:58
Speaker 1: little of that to be had. Many of the famous
• 10:04
Speaker 1: names who flew on Epstein's so-called Lolita Express private jet
• 10:08
Speaker 1: have come out during civil litigation and at Maxwell's trial.
• 10:12
Speaker 1: They include Bill Clinton, Donald Trump, and Prince Andrew, the
• 10:16
Speaker 1: two former U.S. President's have adamantly denied any knowledge of
• 10:20
Speaker 1: Epstein's crimes while Prince Andrew settled a civil sexual assault
• 10:24
Speaker 1: case with Ms. Roberts for a reported $ 17 million in February.
• 10:28
Speaker 1: They say $ 14 million here. That's not the right number.
• 10:32
Speaker 1: But there are many names who have remained out of
• 10:34
Speaker 1: the public eye. Their identities hidden in sealed files at
• 10:39
Speaker 1: the Justice Department. A lot of the materials from our
• 10:43
Speaker 1: 2015-16 civil actions, which the government got, are still sealed
• 10:47
Speaker 1: to the public, Mr. Boyce said. These kinds of records
• 10:50
Speaker 1: should not be sealed. He is 100% correct about that,
• 10:54
Speaker 1: especially in this case. If there is any elected official
• 10:58
Speaker 1: or anyone who's taking or has taken public money involved
• 11:02
Speaker 1: in any list such as this, they should be outed
• 11:05
Speaker 1: right away. They generally fall into two categories, Mr. Boyce says.
• 11:10
Speaker 1: They are Epstein and Maxwell lieutenants who were involved in recruiting, grooming,
• 11:15
Speaker 1: and supervising the survivors that were trafficked. And then there
• 11:19
Speaker 1: are the other people who the survivors were trafficked to,
• 11:23
Speaker 1: which include a lot of rich and powerful people around
• 11:25
Speaker 1: the world, Mr. Boyes added. They're all heavily protected by
• 11:29
Speaker 1: cadres of lawyers and PR consultants and political consultants. And
• 11:34
Speaker 1: you've got to have a prosecutor who is really committed
• 11:37
Speaker 1: to the cause of sex trafficking That is prepared to
• 11:39
Speaker 1: take that group on. Well, if there's any prosecutor out
• 11:43
Speaker 1: there who has that courage. You better believe that there
• 11:47
Speaker 1: are plenty of us who are ready to take the
• 11:50
Speaker 1: fight to these people. And if you have any kind
• 11:54
Speaker 1: of interest in later on political office, this is a
• 11:58
Speaker 1: surefire way to get yourself elected. You go after people
• 12:01
Speaker 1: like Epstein's associates. You are definitely going to get the
• 12:06
Speaker 1: attention of people who are paying attention. And those votes, boy,
• 12:12
Speaker 1: they'll sure pour in. Imagine that campaign. I'm the man
• 12:15
Speaker 1: or woman who put away Jeffrey Epstein. Or Epstein's associates,
• 12:20
Speaker 1: I mean. I continued the case when no one else
• 12:22
Speaker 1: wanted to do it. My career could have been ended.
• 12:25
Speaker 1: You know, yada, yada, yada, yada. But there's no one
• 12:28
Speaker 1: out there that wants to do it.
• 12:29
  Speaker 2: Why?
• 12:30
Speaker 1: What are all of these prosecutors so scared of? Again,
• 12:34
Speaker 1: it comes back to the SDNY, right? Like I always say.
• 12:38
Speaker 1: The folks over at the SDNY... They run around and
• 12:40
Speaker 1: they talk about how they're the greatest at this. They're
• 12:43
Speaker 1: the greatest at that. They bring in all these convictions. Well,
• 12:46
Speaker 1: where are they at? They bring in convictions if it's,
• 12:50
Speaker 1: you know, people like maybe Kalief Browder or your cousin.
• 12:54
Speaker 1: But when it comes to these rich and powerful people
• 12:57
Speaker 1: like Glenn Dubin, like Les Wexner, like Alan Dershowitz, these
• 13:01
Speaker 1: people don't get brought to justice. That's only for peons, right?
• 13:05
Speaker 1: The children of never like us. Mr. Boyd said many
• 13:10
Speaker 1: of the survivors were easy to ignore, as Epstein and
• 13:13
Speaker 1: Maxwell deliberately sought out vulnerable girls, often from single-parent households
• 13:18
Speaker 1: and difficult financial circumstances. Some had already suffered sexual abuse.
• 13:24
Speaker 1: More names are coming out all the time. The question
• 13:27
Speaker 1: is whether that results in people being brought to justice.
• 13:30
Speaker 1: I'm a little pessimistic at this point. Yeah, he's not
• 13:35
Speaker 1: the only one. And he has all rights to be
• 13:37
Speaker 1: because it is a cause for pessimism. You would think
• 13:42
Speaker 1: that when they had the chance here with Maxwell, they
• 13:45
Speaker 1: would have really extended the scope of what they were
• 13:48
Speaker 1: going for. But they didn't do it. And at the time,
• 13:52
Speaker 1: I've said a million times, it's very concerning to see
• 13:56
Speaker 1: the small scope of what their charges are. And then
• 14:00
Speaker 1: come time for sentencing and the trial, people are all
• 14:03
Speaker 1: shocked that a bunch of names weren't named. Well, if
• 14:06
Speaker 1: you were paying attention, you knew that this this case
• 14:09
Speaker 1: was crafted in that manner. But now that Maxwell has
• 14:14
Speaker 1: been hemmed up and they've had a successful prosecution here,
• 14:18
Speaker 1: you would think that they'd smell some blood in the
• 14:20
Speaker 1: water and they'd go harder in the paint. But that
• 14:23
Speaker 1: is not the case. During Tuesday's sentencing, Judge Allison Nathan
• 14:28
Speaker 1: named former Epstein associate Sarah Kellen as a knowing participant
• 14:33
Speaker 1: in the criminal conspiracy. The judge says this. And you
• 14:37
Speaker 1: mean to tell me there's no prosecutors sitting around right
• 14:40
Speaker 1: now stuffing their face full of expensive lunch food from
• 14:44
Speaker 1: Manhattan in the SDNY that wants to go after these
• 14:47
Speaker 1: people or after Sarah Kellen Vickers? Why is that? Ms.
• 14:54
Speaker 1: Kellan was identified by survivors at Maxwell's trial as having
• 14:58
Speaker 1: booked them for massages with Epstein at his Palm Beach mansion.
• 15:02
Speaker 1: The defendant, Maxwell, was Epstein's number two and lady of
• 15:06
Speaker 1: the house, Judge Nathan said during the sentencing. At some point,
• 15:10
Speaker 1: Kellan took over some of the defendant's duties, but even
• 15:13
Speaker 1: after that time, the defendant retained her leadership position as
• 15:17
Speaker 1: evidenced by Carolyn's testimonies. Yeah, that's how it broke down.
• 15:23
Speaker 1: She was the number two. I always break it down
• 15:26
Speaker 1: in terms like the mafia. You have Epstein. He's the boss.
• 15:30
Speaker 1: You have Maxwell, the underboss. And Jean-Luc Brunel? Well, that
• 15:33
Speaker 1: was the consigliere. And underneath all of them are the capos.
• 15:37
Speaker 1: And Sarah Kellen Vickers is as much of a capo
• 15:41
Speaker 1: as Mike Francisis was. Carolyn was one of the four
• 15:47
Speaker 1: survivors who testified at Maxwell's trial and was only identified
• 15:51
Speaker 1: by her first name.
• 15:53
  Speaker 2: Ms.
• 15:53
Speaker 1: Roberts has claimed she was trafficked to have sex with
• 15:56
Speaker 1: Harvard University law professor Alan Dershowitz. The allegation has not
• 16:01
Speaker 1: been proven, and Professor Dershowitz adamantly denies it or any
• 16:05
Speaker 1: knowledge of other offending. And he's not the only one, right?
• 16:10
Speaker 1: Dershowitz certainly isn't the only one. But he's certainly one
• 16:14
Speaker 1: that had the finger pointed at him. But has that
• 16:16
Speaker 1: affected him? No, of course not. We saw Mr. I
• 16:19
Speaker 1: kept my underpants on. Has he lost any status or prestige?
• 16:23
Speaker 1: Has anyone kicked in his door? Stole his cell phone
• 16:26
Speaker 1: so they can go through records? None of that happened. Instead,
• 16:30
Speaker 1: the naked volleyball player of Martha's Vineyard finds himself in
• 16:34
Speaker 1: the spotlight once again defending Donald Trump this time. So...
• 16:40
Speaker 1: Another person who has been credibly accused here has not
• 16:43
Speaker 1: had to answer any kind of serious questions from people
• 16:48
Speaker 1: in authority when it comes to what they're being accused of.
• 16:55
Speaker 1: In 2019, Ms. Roberts sued Professor Dershowitz for defamation and
• 16:59
Speaker 1: emotional distress, and he's since countersued her. The case is ongoing.
• 17:04
Speaker 1: Professor Dershowitz told The Independent in an interview he had
• 17:07
Speaker 1: visited Epstein's home in Palm Beach and his private island,
• 17:11
Speaker 1: Little St. James, and never seen any young or naked women.
• 17:15
Speaker 1: It was a deep, dark secret. Everything he did in
• 17:18
Speaker 1: part in a part of the house, which was off
• 17:20
Speaker 1: limits to anybody, he said. Nobody knew any of this.
• 17:24
Speaker 1: Nobody would have associated with Epstein if we had known
• 17:26
Speaker 1: any of this. Bro, shut up. You're over there getting
• 17:29
Speaker 1: massages by who the hell knows who at his house. Mr.
• 17:33
Speaker 1: I-kept-my-underpants-on Dershowitz. And we all know what massage was synonymous
• 17:39
Speaker 1: for over in the world of Epstein. So Dershowitz is
• 17:42
Speaker 1: another one. And I'm glad he's going to get outed
• 17:45
Speaker 1: here in this defamation case. Dershowitz said he saw pictures
• 17:50
Speaker 1: on the walls of the Palm Beach mansion of the
• 17:52
Speaker 1: billionaire with famous people, including Bill Clinton and Fidel Castro. Ah,
• 17:58
Speaker 1: a man accused of sexual crimes and a dictator. Fantastic company.
• 18:04
Speaker 1: He had me on the wall. I was one of
• 18:05
Speaker 1: the famous people, and believe me, I was fully dressed.
• 18:09
Speaker 1: You know, he makes a joke of it, like anyone
• 18:11
Speaker 1: thinks he's funny. Like his old ass is a comedian
• 18:15
Speaker 1: or something. Bro, the only thing funny is that you
• 18:17
Speaker 1: think people actually believe you. That's what's funny. He said
• 18:22
Speaker 1: he believed Maxwell's sentence and conviction was unjust. Of course
• 18:25
Speaker 1: he did. Birds of a feather and all, right? Mr.
• 18:29
Speaker 1: Boyce claimed it was stretching credulity for anyone in Epstein's
• 18:33
Speaker 1: orbit to maintain they couldn't have known what was going on.
• 18:37
Speaker 1: Everybody who was associated with the survivors has heard reams
• 18:41
Speaker 1: of testimony about how obvious it was what Epstein was doing.
• 18:45
Speaker 1: Survivor after survivor and law enforcement officers have testified how
• 18:51
Speaker 1: there were all these topless girls at the swimming pool
• 18:53
Speaker 1: and naked pictures of girls around the house. It was
• 18:56
Speaker 1: not something that people could miss. No, it wasn't. He
• 18:59
Speaker 1: had chess pieces carved into the likeness of his employees
• 19:04
Speaker 1: naked and shit. He had pictures of gross-ass, stank-ass Ghislaine
• 19:08
Speaker 1: Maxwell's busted ass all over the walls naked and shit.
• 19:12
Speaker 1: What do you mean you missed it? Mr. Boy's chairman
• 19:16
Speaker 1: and managing partner at Boy's Schiller Flexner typically charges up
• 19:20
Speaker 1: to $ 2, 000 an hour for his services. But he and
• 19:24
Speaker 1: fellow managing partner Sigrid McCauley represented Ms. Roberts free of
• 19:28
Speaker 1: charge throughout their pursuit of Maxwell and Epstein. And that's great.
• 19:32
Speaker 1: That's good that they did that. But in reality, we
• 19:35
Speaker 1: know that they also did it to help their own profile.
• 19:39
Speaker 1: They know that moving forward, this is good for them.
• 19:41
Speaker 1: They win this case against these people. Bang, they're going
• 19:44
Speaker 1: to make a ton of dough. And the same goes
• 19:46
Speaker 1: for a prosecutor. And that's why it's so crazy to me.
• 19:49
Speaker 1: that not one of these prosecutors, even a junior prosecutor,
• 19:53
Speaker 1: hasn't stepped up to the plate and said, look, give
• 19:55
Speaker 1: me that whole entire caseload and let me slam these fools.
• 20:02
Speaker 1: In court on Tuesday, Ms. McCauley read a survivor impact
• 20:05
Speaker 1: statement from Ms. Roberts, which she described Maxwell as a
• 20:08
Speaker 1: wolf in sheep's clothing. You could have put an end
• 20:11
Speaker 1: to the rapes, the molestations, the sickening manipulations that you arranged, witnessed,
• 20:16
Speaker 1: and even took part in. You could have called the
• 20:19
Speaker 1: authorities and reported that you were part of something awful.
• 20:23
Speaker 1: And she didn't, right? And if you don't do that,
• 20:25
Speaker 1: then what? You're complicit. Oh, I was scared. I was
• 20:29
Speaker 1: held against my will. Okay, well, what happens when Epstein
• 20:32
Speaker 1: is gone from your life and you still have not
• 20:34
Speaker 1: come forward? Speculation that Maxwell could flip on her former
• 20:39
Speaker 1: associates in order to receive a reduced sentence has never eventuated.
• 20:45
Speaker 1: Her brother, Ian Maxwell, told the Sunday Times in January
• 20:48
Speaker 1: that she had no plans to pursue a plea deal
• 20:50
Speaker 1: or offer up information about who else was involved. Maxwell
• 20:55
Speaker 1: has maintained her innocence and plans to appeal the verdict
• 20:58
Speaker 1: and the sentence. The Independent contacted the U.S. Attorney's Office
• 21:02
Speaker 1: for the Southern District of New York to ask if
• 21:05
Speaker 1: it plans to prosecute anyone else in relation to the conspiracy,
• 21:09
Speaker 1: and if not, whether it would unseal any records related
• 21:13
Speaker 1: to the case. Public Affairs Chief Nicholas Biasi declined to comment. Oh,
• 21:18
Speaker 1: of course, that's what they'll say. Oh, it's an ongoing investigation.
• 21:22
Speaker 1: You can't have any of these files. You know, you,
• 21:24
Speaker 1: the taxpayer. So if this is not an ongoing investigation still,
• 21:29
Speaker 1: and they're not going after the co-conspirators, they need to
• 21:31
Speaker 1: turn over and unseal every file that they have. And
• 21:36
Speaker 1: then let's see what's what. My guess is, unfortunately, folks,
• 21:40
Speaker 1: they won't do either. All right, that's going to do it.
• 21:44
Speaker 1: If you'd like to contact me, you can do that
• 21:46
  Speaker 1: at bobbycapucci at protonmail.com. That's B-O-B-B-Y-C-A-P-U-C-C-I at protonmail.com. You can
• 21:56
Speaker 1: also find me on Twitter at B-O-B-B-Y underscore C-A-P-U-C-C-I. The
• 22:02
Speaker 1: link that we discussed can be found in the description box.
• 22:06
Speaker 1: I talked about a story that had to do with
• 22:08
Speaker 1: the New York Times, David Boies, and a supposed source
• 22:13
Speaker 1: that ended up being garbage. If you remember, the source's
• 22:16
Speaker 1: last name was Kessler. And it was supposedly, you know,
• 22:20
Speaker 1: they had a source that had all the dirt on Epstein, etc., etc., etc.
• 22:25
Speaker 1: And it was the New York Times who this man approached. Well,
• 22:29
Speaker 1: we have a follow-up story to that in NPR today,
• 22:32
Speaker 1: so that's what we're going to go ahead and dive into.
• 22:35
Speaker 1: Like you all know, I always like to revisit stories
• 22:38
Speaker 1: if we have follow-ups. I always like to add a
• 22:41
Speaker 1: little bit more meat to that bone so that the
• 22:43
Speaker 1: context is proper, so that we have as much of
• 22:45
Speaker 1: the story as we possibly can here in the catalog.
• 22:49
Speaker 1: So today, that's what we're going to do. A little
• 22:51
Speaker 1: more meat on the bone. This article is from NPR,
• 22:56
Speaker 1: and the headline is, The New York Times, the unreliable source,
• 23:00
Speaker 1: and the expose that missed the mark. This article was
• 23:03
Speaker 1: written by David Folkenflick. The intriguing tale began in mid-September
• 23:09
Speaker 1: with an invitation for two New York Times reporters to
• 23:13
Speaker 1: come to the Midtown Manhattan offices of the legendary lawyer
• 23:16
Speaker 1: David Boies for an off-the-record session. And as you all know,
• 23:21
Speaker 1: David Boies is the lawyer locked in his own legal
• 23:24
Speaker 1: battle with Alan Dershowitz, and his firm is also representing
• 23:31
Speaker 1: Virginia Roberts. The two reporters, Jake Bernstein and Emily Steele,
• 23:37
Speaker 1: were asked to leave their phones and laptops outside the
• 23:40
Speaker 1: conference room. No taping. The guest of honor, a hard-drinking
• 23:44
Speaker 1: burly man who promised that he could link powerful politicians
• 23:48
Speaker 1: and globetrotting luminaries to the late Jeffrey Epstein, the financier
• 23:52
Speaker 1: and sexual predator. And pedophile. Boys and another lawyer for
• 23:57
Speaker 1: Epstein accusers introduce the reporters to the apparent informant. So
• 24:04
Speaker 1: this guy Kessler supposedly had the dirt on Jeffrey Epstein
• 24:09
Speaker 1: and had video proof, and he brought it to David
• 24:12
Speaker 1: Boies and Boies' law firm, and they, in turn, contacted
• 24:18
Speaker 1: the New York Times to come in and have a
• 24:20
Speaker 1: sit-down about the information. The man went by a pseudonym,
• 24:25
Speaker 1: Patrick Kessler, saying he feared retribution. He boasted about damning
• 24:29
Speaker 1: videos of prominent men at Epstein's properties. And Kessler showed
• 24:34
Speaker 1: the reporters, as he had the lawyers, blurry stills of
• 24:37
Speaker 1: what he said were men having sex with women and girls.
• 24:41
Speaker 1: And see, folks, sometimes this is where our confirmation bias
• 24:45
Speaker 1: comes back to bite us in the ass. Of course
• 24:47
Speaker 1: the lawyers want to believe that this source has the dirt.
• 24:50
Speaker 1: Of course the lawyers want to believe that this guy
• 24:52
Speaker 1: has the info. And he has some blurry photos, etc., etc., etc.
• 24:56
Speaker 1: But is that enough when you're looking at it from,
• 25:00
Speaker 1: you know, maybe the outside looking in? Is that enough
• 25:03
Speaker 1: to call reporters in, especially from the New York Times,
• 25:06
Speaker 1: and trying to get an expose? Well, if it's not
• 25:09
Speaker 1: something that you're really gung-ho about and something you're not
• 25:13
Speaker 1: charging hard after, you don't really have to worry about
• 25:15
Speaker 1: your confirmation bias. But when it's something like this that
• 25:19
Speaker 1: falls in line with what you believe already, well, it's
• 25:22
Speaker 1: easier to be duped. And that's just the human psyche
• 25:25
Speaker 1: in general. He claimed the men were in the top
• 25:31
Speaker 1: echelons of politics, finance, and law. He promised proof. But
• 25:35
Speaker 1: the informant appears to have been a fraud, and he
• 25:37
Speaker 1: has since vanished. Even so, he inspired an investigation by
• 25:41
Speaker 1: the Times, not of Epstein, but of one of the
• 25:44
Speaker 1: country's most famous lawyers. In a 5,400-word expose published on
• 25:49
Speaker 1: November 30th and an hour-long television show, the Times placed
• 25:53
Speaker 1: boys at the center of a narrative that insinuates deceit
• 25:56
Speaker 1: and greed inside a morally corrupt legal system. Look, I
• 26:02
Speaker 1: agree that the legal system is morally corrupt and it's
• 26:07
Speaker 1: full of greed. But the thought that they would go
• 26:11
Speaker 1: after boys... with a 5,400-word expose, and they haven't done
• 26:16
Speaker 1: a 5,400-word expose on Sarah Kellen Vickers, tells you everything
• 26:20
Speaker 1: you need to know about the New York Times. I've
• 26:22
Speaker 1: heard it from survivors in this case directly, that the
• 26:25
Speaker 1: New York Times is not a good actor in this story,
• 26:28
Speaker 1: that the New York Times has done a lot of
• 26:32
Speaker 1: harm to these survivors and their stories. The story, the
• 26:38
Speaker 1: result of months of reporting by a team of four
• 26:40
Speaker 1: Times journalists, promised to reveal how even the lawyers representing
• 26:45
Speaker 1: alleged victims of sexual predators seek paydays in ways that
• 26:48
Speaker 1: enable powerful men to avoid accountability. Boyes says the Times
• 26:53
Speaker 1: account is terribly unfair. I didn't do anything deceitful here,
• 26:57
Speaker 1: and there's no basis for that allegation, Boyes tells NPR
• 27:00
Speaker 1: in December. For them to put that in the article,
• 27:02
Speaker 1: that is about me, without making clear that they're not
• 27:05
Speaker 1: making that allegation about me, it is, I think, quite misleading.
• 27:10
Speaker 1: And I agree with that. It is misleading. The New
• 27:11
Speaker 1: York Times loves to do this. And this is why
• 27:14
Speaker 1: I have no respect for the Grey Lady at this point.
• 27:17
Speaker 1: They're a joke of an organization. They are an absolute
• 27:21
Speaker 1: joke of a news organization. And I have zero respect
• 27:25
Speaker 1: for the Grey Lady, which is sad. Because when I
• 27:27
Speaker 1: was growing up and when I was younger, it was
• 27:29
Speaker 1: the standard bearer for what is real. And that all
• 27:33
Speaker 1: came crashing down around us when they took up the
• 27:36
Speaker 1: call for the disgusting fake war in Iraq, an illegal
• 27:39
Speaker 1: war in Iraq that should have never occurred. That was
• 27:42
Speaker 1: the beginning of the end, in my eyes, of the
• 27:45
Speaker 1: New York Times and their credibility. To this day, it
• 27:50
Speaker 1: remains unclear what the newspapers reporting uncovered. boy's own actions
• 27:55
Speaker 1: on other matters had already tarnished his reputation but the
• 27:59
Speaker 1: times journalists acknowledged they didn't have evidence that proved boy's
• 28:02
Speaker 1: either acted wrongfully or intended to profit from the epstein
• 28:06
Speaker 1: cases and their chief informant for the story had lied
• 28:09
Speaker 1: repeatedly the times itself concluded Again, I'm going to believe
• 28:14
Speaker 1: the survivors who have told me that David Boies is
• 28:17
Speaker 1: acting in good faith, that David Boies is doing right
• 28:20
Speaker 1: by them. I'm going to take them at their word,
• 28:22
Speaker 1: just like I'm taking them at their word for everything
• 28:25
Speaker 1: else that's occurred in this case. Do you know why?
• 28:27
Speaker 1: Because they're credible. They're credible. Whereas the New York Times
• 28:31
Speaker 1: is not credible. All they do is run garbage stories
• 28:36
Speaker 1: these days. And what they've also have done... They've inflicted
• 28:40
Speaker 1: a lot of harm by their fake reporting. I'll just
• 28:44
Speaker 1: call it what it is, folks. With their fake reporting
• 28:46
Speaker 1: on a lot of issues. You know, the idea for
• 28:49
Speaker 1: the media is to inform, not to divide. And all
• 28:52
Speaker 1: they want to do is divide people into groups these days.
• 28:55
  Speaker 2: Allegedly.
• 29:07
Speaker 1: In August, the man calling himself Patrick Kessler approached the
• 29:10
Speaker 1: Winchester star in Virginia's Shenandoah Valley with the same story
• 29:14
Speaker 1: about Epstein's powerful friends. As captured on an audio recording,
• 29:18
Speaker 1: one of the Winchester reporters asked Kessler why he didn't
• 29:21
Speaker 1: seek out a national news outlet. Kessler said he trusted
• 29:25
Speaker 1: the star because he had grown up nearby. Yeah, okay.
• 29:28
Speaker 1: He chose the star because he thought he could get
• 29:30
Speaker 1: one over on them, right? He thought, oh, this is
• 29:32
Speaker 1: a smaller operation, I'll be able to slide a little
• 29:35
Speaker 1: something in on them, and maybe I'll be able to
• 29:37
Speaker 1: catch a little bit of a payday for this bunk information.
• 29:40
Speaker 1: i have reporters there soon questioned his veracity his veracity
• 29:45
Speaker 1: the star spoke to a lawyer whom kessler claimed to
• 29:48
Speaker 1: have consulted he said he hadn't heard of kessler When
• 29:51
Speaker 1: he did not show up a week later, I thought, well,
• 29:54
Speaker 1: this guy's a crackpot or, you know, a fabulist. Somebody
• 29:57
Speaker 1: who just likes to spin stories and just wasted our time,
• 30:03
Speaker 1: says Winchester star reporter Evan Goodenow. And so I kind
• 30:07
Speaker 1: of dismissed it. Just a week after that, the two
• 30:10
Speaker 1: Times reporters met Kessler at Boy's office. Look, so the
• 30:14
Speaker 1: Times was hooscowed by this, right? But the Winchester Star
• 30:18
Speaker 1: picked up on it right away. Picked up on it
• 30:20
Speaker 1: right away that it was garbage. The Times, on the
• 30:23
Speaker 1: other hand, well, they're always looking for salacious information at
• 30:26
Speaker 1: this point. They don't even need to fact check anything. Oh,
• 30:29
Speaker 1: we have a source and unnamed sources say that That's
• 30:33
Speaker 1: all they use now. They don't, you know what, like
• 30:35
Speaker 1: I said, their credibility, at least with me, is absolutely
• 30:38
Speaker 1: and positively shot. I'd much rather get my information from
• 30:42
Speaker 1: independent content creators who are actually on the ground in
• 30:46
Speaker 1: these places and who are reporting from the ground level.
• 30:49
Speaker 1: That's where I prefer to get my news at this
• 30:50
Speaker 1: point because I don't trust the media. I truly do
• 30:54
Speaker 1: not trust the legacy media to have our best interests
• 30:57
Speaker 1: at heart, folks. Not even an hour after the meeting,
• 31:02
Speaker 1: Kessler sent a text message to Times reporter Emily Steele
• 31:05
Speaker 1: saying that he wanted to meet again. That afternoon, at
• 31:08
Speaker 1: the back of a Chinese restaurant, Kessler steered the two
• 31:11
Speaker 1: Times reporters, Steele and Bernstein, toward what he argued was
• 31:15
Speaker 1: a different scandal, the behavior of the two lawyers they
• 31:18
Speaker 1: had just met. Kessler alleged the attorneys wanted to turn
• 31:22
Speaker 1: his material to their own advantage, rather than that of
• 31:25
Speaker 1: their clients, the women who said they had been victimized
• 31:30
Speaker 1: by Epstein and his social circle. Like I talked about
• 31:36
Speaker 1: when we first covered this case, We don't know who
• 31:39
Speaker 1: this Kessler guy is, we don't know who he was
• 31:42
Speaker 1: hired by, but I said it then and I'll say
• 31:44
Speaker 1: it now, an absolute disinformation attempt. This man was looking
• 31:48
Speaker 1: to muddy the waters, and I have no evidence of this, obviously, folks,
• 31:52
Speaker 1: but in my opinion, was probably hired by Epstein's crew
• 31:55
Speaker 1: to muddy the waters and to try and destroy the
• 31:58
Speaker 1: credibility of David Boies, so going forward... He wasn't credible
• 32:02
Speaker 1: when he came forward with evidence. It's just another cloak
• 32:06
Speaker 1: and dagger attempt by Team Epstein to make things move
• 32:10
Speaker 1: in a direction they want them to move. And that's
• 32:12
Speaker 1: the way I read this. That's my opinion of this
• 32:14
Speaker 1: whole Kessler situation. That was my opinion when we first
• 32:17
Speaker 1: covered this, and that is still my opinion now. This
• 32:24
Speaker 1: news direction appealed to the Times. Investigative reporter and one
• 32:28
Speaker 1: of the four journalists on the story, Jessica Silver Greenberg,
• 32:31
Speaker 1: tells NPR that she had been seeking a window into
• 32:34
Speaker 1: the universe of people, powerful men, that had potentially enabled
• 32:38
Speaker 1: Epstein and allowed him to continue to allegedly abused women
• 32:41
Speaker 1: for decades. What a bunch of bullshit. If they really cared,
• 32:45
Speaker 1: they'd be going after the core four like I'm doing.
• 32:47
Speaker 1: If I had the resources that the New York Times has,
• 32:50
Speaker 1: forget about it, folks. This would already be a wrap.
• 32:53
Speaker 1: These people would be living the Weinstein life if I
• 32:55
Speaker 1: had the resources that the New York Times had. I
• 32:57
Speaker 1: would not stop until these people were arrested. I would
• 33:01
Speaker 1: write story after story, make appearance after appearance, until the
• 33:05
Speaker 1: pressure was ramped up so high that it could not
• 33:08
Speaker 1: be ignored. But yet they sit here and they talk about, oh, well,
• 33:12
Speaker 1: we were going to, this direction, it appealed to us because,
• 33:15
Speaker 1: you know, we wanted to get in there and destroy
• 33:17
Speaker 1: people of power who were with Jeffrey Epstein and expose them. No, no,
• 33:22
Speaker 1: you weren't. You were just simply, like every other story,
• 33:26
Speaker 1: trying to sell papers from the New York Times. It
• 33:28
Speaker 1: had nothing to do with going after Epstein. Lawyers had
• 33:34
Speaker 1: helped to shield Epstein, Silver Greenberg says, creating a financial
• 33:37
Speaker 1: model in which they could secure big payouts for accusers
• 33:40
Speaker 1: and fees for themselves from the prominent men their clients accused,
• 33:44
Speaker 1: but let those men keep their actions secret. It reminded
• 33:48
Speaker 1: her of nondisclosure agreements and settlements of harassment claims against
• 33:52
Speaker 1: Hollywood producer Harvey Weinstein. Women were paid but had to
• 33:56
Speaker 1: keep silent, keeping the pattern of his behavior from public view. Well,
• 34:00
Speaker 1: everybody who listens to this podcast knows how I feel
• 34:02
Speaker 1: about NDAs when it comes to shit like this. There
• 34:04
Speaker 1: should be no NDAs when it comes to shit like this.
• 34:07
Speaker 1: If you get sued because you sexually assaulted somebody, that
• 34:10
Speaker 1: shouldn't become something that's quiet. Everybody should have a right
• 34:13
Speaker 1: to know that. Anybody that you're going to work with,
• 34:15
Speaker 1: anybody who's sending their children to you to intern, any
• 34:18
Speaker 1: of that stuff, people should know that. So, you know,
• 34:21
  Speaker 1: I don't... I don't like the fact that people have
• 34:26
Speaker 1: to keep silent after situations like this. And I think
• 34:29
Speaker 1: in the Epstein case, when it comes to the fund
• 34:33
Speaker 1: to pay victims out, the payment fund to pay them,
• 34:37
Speaker 1: I definitely believe that there should be no NDAs tied
• 34:40
Speaker 1: to that whatsoever. It's a bunch of bullshit. Lawyers struck
• 34:46
Speaker 1: similar deals for accusations against the late Roger Ailes and
• 34:50
Speaker 1: Bill O'Reilly, now both gone from Fox News. Ailes, Weinstein,
• 34:55
Speaker 1: and O'Reilly all denied those allegations. The Times reported extensively
• 34:59
Speaker 1: on them all, helping to usher in the Me Too movement. Look, folks.
• 35:05
Speaker 1: The New York Times is not an ally to the survivors, okay? Again,
• 35:12
Speaker 1: I've heard it directly from some of the survivors' mouths.
• 35:15
Speaker 1: The New York Times ignored them, did everything they could
• 35:18
Speaker 1: to stop the case. I mean, to stop the story.
• 35:21
Speaker 1: They ignored it. And all of a sudden now, the
• 35:24
Speaker 1: New York Times is some hard-charging champion for women. I'm sorry,
• 35:28
Speaker 1: I don't buy it. Nondisclosure pacts are legal and even
• 35:33
Speaker 1: common in corporate life. Some attorneys for alleged victims say
• 35:37
Speaker 1: clients seek to avoid public glare. Yet NDAs are increasingly
• 35:41
Speaker 1: under attack. Most recently, now former presidential candidate Mike Bloomberg
• 35:46
Speaker 1: announced he would release three women who filed complaints against
• 35:49
Speaker 1: him at Bloomberg LP from confidentiality clauses after rivals blasted
• 35:53
Speaker 1: him for it at a Democratic presidential debate. Look, if
• 35:57
Speaker 1: you're running for president or you're going to be the
• 35:59
Speaker 1: president and there's NDAs out there against you, well, you
• 36:03
Speaker 1: need to make them public. You need to make them
• 36:05
Speaker 1: public so the public knows exactly what you're up to,
• 36:08
Speaker 1: what you've been accused of, and then they can make
• 36:10
Speaker 1: their decision for themselves. All right? The public is capable
• 36:14
Speaker 1: of making a decision for themselves on who they want
• 36:17
Speaker 1: their elected officials to be. All of the evidence and
• 36:20
Speaker 1: all of the information must be presented, though, so the
• 36:22
Speaker 1: public can make the proper decision. I had been long
• 36:30
Speaker 1: looking at all this huge network of lawyers, Silver Greenberg
• 36:33
Speaker 1: tells NPR, not only in the defense of attorneys who
• 36:36
Speaker 1: were representing Epstein, but also the attorneys that had represented
• 36:40
Speaker 1: the survivors. Boyce stood out. He was a towering figure
• 36:44
Speaker 1: with an illustrious record as a litigator. He had argued
• 36:47
Speaker 1: the government's antitrust case against Microsoft a generation ago. He
• 36:51
Speaker 1: was Al Gore's go-to attorney in the 2000 election recount debacle.
• 36:55
Speaker 1: Boys helped persuade the U.S. Supreme Court to legalize gay marriage. Look,
• 37:01
Speaker 1: like I said, I've been critical of David Boys when
• 37:03
Speaker 1: I thought it was appropriate. I've definitely been critical of
• 37:08
Speaker 1: a lot of lawyers. I'm not a big fan of lawyers,
• 37:10
Speaker 1: as you all know. But what I will say here
• 37:12
Speaker 1: is I think Boys is getting a bum rap by
• 37:14
Speaker 1: the New York Times and and the way that they
• 37:16
Speaker 1: reported this. I think that the New York Times, in
• 37:19
Speaker 1: their zeal to try and bring down some big game, well,
• 37:24
Speaker 1: in their zeal to do that, they missed the mark here.
• 37:28
Speaker 1: And back in the day, you'd say, oh man, that's
• 37:30
Speaker 1: just an unfortunate error by New York Times. They missed
• 37:34
Speaker 1: the mark. But now it's just par for the course.
• 37:37
Speaker 1: Every article misses the mark, it seems like. Every article
• 37:39
Speaker 1: is pandering. Every article is divisive. Every article has a bend.
• 37:44
Speaker 1: When in reality, the media should just be reporting the facts.
• 37:50
Speaker 1: Boys also caught their attention because he represented the Hollywood
• 37:53
Speaker 1: producer Harvey Weinstein, accused of sexual assault or harassment by
• 37:57
Speaker 1: 100 women. Weinstein was convicted last month of felony sex
• 38:01
Speaker 1: crime and rape and sentenced Wednesday to 23 years in prison.
• 38:06
Speaker 1: I think he got off light, by the way. Not
• 38:08
Speaker 1: only would I give him 23 years... I would bury
• 38:11
Speaker 1: him underneath Guantanamo Bay or whatever prison is the most
• 38:14
Speaker 1: viciously harsh. Either bury him under the prison so he
• 38:18
Speaker 1: has no access to anybody ever or throw him right
• 38:20
Speaker 1: in general population and let the inmates sort it out.
• 38:26
Speaker 1: In Epstein's case, Boy Schiller represents several women with claims
• 38:29
Speaker 1: against the financier's estate and friends. In that first meeting
• 38:33
Speaker 1: with the Times, reporters, a second lawyer was present by
• 38:36
Speaker 1: the name of Stan Pottinger. Pottinger would play an essential
• 38:40
Speaker 1: role in the Times' tale. He and Boy are friends.
• 38:43
Speaker 1: Their unrelated firms represent different clients with similar accusations against
• 38:47
Speaker 1: Epstein and his associates. Pottinger did not return four messages
• 38:50
Speaker 1: from NPR seeking comment. Well, why would he? Why would
• 38:54
Speaker 1: he at this point? He knows you're just going to
• 38:55
Speaker 1: try and kneecap him. That's all the media tries to
• 38:57
Speaker 1: do at this point is kneecap people, especially if they
• 39:00
Speaker 1: think that it's going to, you know, get them a
• 39:03
Speaker 1: couple of cheers from their friends on the sidelines. Though
• 39:08
Speaker 1: he is not nearly as prominent as Boyce, Pottinger was
• 39:11
Speaker 1: a Justice Department official under President Ford and dated Gloria
• 39:15
Speaker 1: Steinem in the 70s and 80s. He is now at
• 39:18
Speaker 1: Edwards Pottinger. Kessler promised the reporters a window into how
• 39:22
Speaker 1: the lawyers operated. Kessler shared with the Times text that
• 39:26
Speaker 1: Pottinger had sent in which he had drawn up a
• 39:28
Speaker 1: hot list of prominent men as possible targets. Boys was
• 39:32
Speaker 1: not copied on the exchanges. The Times wrote, it seemed
• 39:36
Speaker 1: to Kessler like Mr. Boys and Mr. Pottinger were plotting
• 39:39
Speaker 1: to use his footage to demand huge sums from billionaires.
• 39:43
Speaker 1: He said it looked like blackmail. Pottinger suggested in his
• 39:47
Speaker 1: text that lawyers can make up to 40% of the
• 39:49
Speaker 1: money they negotiated in private settlements. Pottinger confirmed that the
• 39:53
Speaker 1: texts were authentic, the paper reported. Pottinger said he had
• 39:57
Speaker 1: been deceiving Kessler to get him to share what videos
• 39:59
Speaker 1: and other documentation he had against Epstein's friends. Pottinger also
• 40:03
Speaker 1: told the paper he informed the FBI and a federal
• 40:06
Speaker 1: prosecutor about the material Kessler claimed to have. So again,
• 40:10
Speaker 1: we don't know what the truth is here. We have
• 40:12
Speaker 1: no idea what the truth is. The New York Times
• 40:15
Speaker 1: reports one thing, Pottinger says another. It comes down to
• 40:18
Speaker 1: who do you believe? Well, I don't know anything about Pottinger,
• 40:22
Speaker 1: so I don't really have an opinion one way or
• 40:25
Speaker 1: the other as far as his credibility. But like I said,
• 40:28
Speaker 1: I do know that the New York Times really is
• 40:30
Speaker 1: not very credible at this point. So, you know, I'll
• 40:33
Speaker 1: give them their props when they deserve it, like I
• 40:35
Speaker 1: always do. But in cases like this, they're on fishing expeditions.
• 40:39
Speaker 1: They're wasting their time. When we have the core four
• 40:43
Speaker 1: sitting there, ready to be rounded up, ready to be exposed,
• 40:46
Speaker 1: why are you wasting your time on this fake-ass guy
• 40:50
Speaker 1: Kessler that we all knew was fake right from the jump?
• 40:55
Speaker 1: Emails between Boys in the Times reporters show him wrestling
• 40:58
Speaker 1: over whether to trust Kessler, hoping but not certain the
• 41:01
Speaker 1: informant was real. The Times concluded that Boyes had outsourced
• 41:05
Speaker 1: his relationship with Kessler to Pottinger and that the lawyers
• 41:09
Speaker 1: were working in concert. The Times used Kessler's communication with
• 41:12
Speaker 1: Pottinger to convey the story of hypocrisy and greed about
• 41:17
Speaker 1: Boyes as well. Here's the defining passage of the article. Mr.
• 41:21
Speaker 1: Boyes and Mr. Pottinger would go from toasting Kessler as
• 41:24
Speaker 1: their whistleblower and informant to torching him as a fraudster
• 41:27
Speaker 1: and a spy. Kessler was a liar and he wouldn't
• 41:30
Speaker 1: expose any sexual abuse, but he would reveal something else.
• 41:34
Speaker 1: The extraordinary, at times deceitful, measures elite lawyers deployed in
• 41:38
Speaker 1: an effort to get evidence that could be used to
• 41:41
Speaker 1: win lucrative settlements and keep misconduct hidden, allowing perpetrators to
• 41:45
Speaker 1: abuse again. Mr. Boyce has publicly decried such deals as
• 41:50
Speaker 1: rich man's justice, a way that powerful men buy their
• 41:53
Speaker 1: way out of legal and reputational jeopardy. This is how
• 41:56
Speaker 1: it works. It's true. That is how it works. There's
• 42:00
Speaker 1: no doubt about it. There is no doubt about it.
• 42:03
Speaker 1: But at the same time, if you hire a lawyer,
• 42:06
Speaker 1: don't you want them to do whatever it takes within
• 42:08
Speaker 1: the law to make sure that your case goes forward,
• 42:11
Speaker 1: to make sure that you get the justice that you deserve?
• 42:14
Speaker 1: You want your lawyer to turn over every single rock,
• 42:16
Speaker 1: look under every single bush, and make sure that they're
• 42:20
Speaker 1: not missing anything. So it's prudent to meet with a
• 42:23
Speaker 1: guy like Kessler. It is also prudent to automatically dismiss
• 42:26
Speaker 1: him once you find out that he is not credible.
• 42:30
Speaker 1: David Enrich, a Times business editor who helped to report
• 42:33
Speaker 1: the story, tells NPR, our obligation is to be truthful
• 42:37
Speaker 1: and as transparent as possible and to tell the truth
• 42:40
Speaker 1: to our readers as best we can. Well, New York Times,
• 42:42
Speaker 1: I have breaking news for you. You're failing miserably at that.
• 42:45
Speaker 1: You're not the record, the newspaper of record anymore. You're
• 42:52
Speaker 1: just another tabloid. You're just another toss-away tabloid at this point.
• 42:55
Speaker 1: And I'm sorry if that offends some of you out
• 42:57
Speaker 1: there who are listening that still cling on to this
• 42:59
Speaker 1: hope that the legacy media cares about you and that
• 43:03
Speaker 1: they're telling you the truth. I'm here to break it
• 43:05
Speaker 1: to you, folks. They're not. If they were telling you
• 43:08
Speaker 1: the truth, I wouldn't have to do this podcast. You
• 43:10
Speaker 1: wouldn't be here listening.
• 43:12
  Speaker 2: All right?
• 43:12
Speaker 1: Those are just the facts. In November, video cameras captured
• 43:18
Speaker 1: a tense moment for the Times television show The Weekly.
• 43:21
Speaker 1: Reporters Silver Greenberg and Enrich confronted Boyes with the encrypted
• 43:27
Speaker 1: text between Pottinger and Kessler, prompted by Kessler's questions of
• 43:30
Speaker 1: how they can make money. In their joint interview with NPR,
• 43:34
Speaker 1: the two Times journalists say they believe Boyes was gently
• 43:36
Speaker 1: aghast at the text they showed him. Well, yeah. Again,
• 43:40
Speaker 1: like I said, David Boyes, from everything that I've heard
• 43:43
Speaker 1: from the survivors, is an honorable man. I aired him
• 43:47
Speaker 1: out over his Harvey Weinstein connections. There's no doubt that
• 43:49
Speaker 1: had to be talked about. But at the same time,
• 43:52
Speaker 1: I can only go by what people who actually know
• 43:55
Speaker 1: him and what people who are being represented by him
• 43:57
Speaker 1: have to say, right? I'm going to trust what they
• 44:00
Speaker 1: tell me about this guy. He was visibly surprised to
• 44:05
Speaker 1: see them, and I think visibly upset to see them,
• 44:07
Speaker 1: Enrich tells NPR, so I don't think he knew. He
• 44:10
Speaker 1: said that he did not intend to do what Stan
• 44:12
Speaker 1: Pottinger says they were discussing doing, and I can give
• 44:14
Speaker 1: him the benefit of the doubt on that. Well, that's good.
• 44:17
Speaker 1: That's good to see that the New York Times is
• 44:19
Speaker 1: willing to give him the benefit of the doubt there.
• 44:20
Speaker 1: because it's obvious that David Boies wasn't, you know, pitching this.
• 44:25
Speaker 1: It was this Stan Pottinger guy. And again, I'm not
• 44:28
Speaker 1: going to sit here and defame Stan Pottinger either. I
• 44:30
Speaker 1: don't know him and I don't know all the details
• 44:32
Speaker 1: to this story. I only have the information that the,
• 44:34
Speaker 1: you know, the New York Times and their buddies at
• 44:36
Speaker 1: the NPR want to provide to us. So unless we
• 44:38
Speaker 1: get to hear from Pottinger, then we only have one
• 44:41
Speaker 1: side of the story. So I think it's nice though
• 44:44
Speaker 1: that Uh, Enrich was willing to tell NPR that he
• 44:47
Speaker 1: didn't think that boys had anything to do with it.
• 44:50
Speaker 1: That's a standup move. The times article nonetheless suggests boys
• 44:55
Speaker 1: was a willing part of a larger effort to extract
• 44:58
Speaker 1: large sums of money and settlements from powerful men. What
• 45:02
Speaker 1: I think is not fair journalism is to somehow imply
• 45:06
Speaker 1: I was involved in what was being discussed when the
• 45:08
Speaker 1: Times knows and has acknowledged that I didn't even know
• 45:11
Speaker 1: about those text messages until they showed them to me,
• 45:15
Speaker 1: Boyes tells NPR. He says he's being tarred by the
• 45:18
Speaker 1: newspaper's conclusions over his friend's texts. I agree with that.
• 45:22
Speaker 1: We just read Enrich saying that he doesn't believe that
• 45:24
Speaker 1: Boyes had anything to do with it, but yet that
• 45:26
Speaker 1: narrative is still being run in the New York Times.
• 45:30
Speaker 1: And that is how the New York Times operates, folks. Unfortunately,
• 45:34
Speaker 1: that is how they operate. Just like their buddies over
• 45:38
Speaker 1: at the Washington Post, Pravda on the Potomac. Yeah, they
• 45:43
Speaker 1: operate the same way. And it's a shame because these
• 45:47
Speaker 1: used to be the outlets that we could turn to
• 45:48
Speaker 1: as Americans. And no, we're not getting jibed. No, we're
• 45:51
Speaker 1: not getting lied to. No, we're not having a story
• 45:54
Speaker 1: spun on us. But yet here we are. I didn't
• 45:59
Speaker 1: participate in them. I didn't know about them at the
• 46:02
Speaker 1: time that they were done, Boyes says. He says his
• 46:05
Speaker 1: retention agreements with Epstein's accusers allow him only to recoup
• 46:09
Speaker 1: costs and expenses, not fees from such settlements. NPR has
• 46:13
Speaker 1: reviewed the agreements, confirmed also by one of his clients.
• 46:16
Speaker 1: A foundation Boyes discussed with Enrich would not have benefited him,
• 46:20
Speaker 1: Boyes says. And it's true. Again, I've heard it from
• 46:25
Speaker 1: people that are being represented by him that this is
• 46:28
Speaker 1: all fact that he's saying. So again, everything that I've
• 46:31
Speaker 1: heard about David Boies has matched up with the story
• 46:37
Speaker 1: here that he's telling that he had nothing to do
• 46:39
Speaker 1: with this. It doesn't seem like a move that he
• 46:40
Speaker 1: would make in this specific case. As the Times knows,
• 46:46
Speaker 1: we were not going to make any money out of
• 46:48
Speaker 1: these cases, Boies says. The Times team does not fundamentally
• 46:54
Speaker 1: dispute that contention. Its article noted in passing that Boies
• 46:57
Speaker 1: was working pro bono without payment. Even so, Enrich and
• 47:01
Speaker 1: Silver Greenberg argue Boies remains a key player. Look, he's
• 47:05
Speaker 1: not even getting paid for it, folks, all right? That
• 47:08
Speaker 1: right there tells you the whole entire story. The man's
• 47:10
Speaker 1: not making any money out of it. Sure, he's going
• 47:13
Speaker 1: to build his, you know, the public view of the company.
• 47:17
Speaker 1: He's going to get, you know, more eyes on the company.
• 47:19
Speaker 1: More people are going to want to use his services
• 47:22
Speaker 1: after this case, etc., etc. But he's not making any
• 47:25
Speaker 1: money from the survivors here. It's not like he's Denise
• 47:28
Speaker 1: Georging them. He's not trying to, you know, snatch whole
• 47:32
Speaker 1: islands from them and liquidate them so that he has
• 47:34
Speaker 1: the money like Denise George. Where's the Times article on
• 47:37
Speaker 1: Denise George and her money grab? I don't think it
• 47:42
Speaker 1: matters whether or not David Boies is going to get
• 47:45
  Speaker 1: rich off these.
• 47:46
Speaker 2: Drew and Jonathan Scott here to tell you that with

• 48:15
Speaker 1: Settlements, Silver Greenberg says. Burying that information of sexual assault
• 48:19
Speaker 1: or misconduct, making it disappear, and letting some of the
• 48:23
Speaker 1: world's richest, most powerful men off the hook through these
• 48:25
Speaker 1: legal settlements is the issue. Well, that's not going to
• 48:28
Speaker 1: occur in this case, Mr. Silver, okay? Silver Greenberg. That's
• 48:33
Speaker 1: not the strategy being employed here, especially for the survivors
• 48:38
Speaker 1: that Boies is representing. They want justice, my man. J-U-S-T-I-C-E.
• 48:45
Speaker 1: Justice is what they're after. Though Boyes had built up
• 48:50
Speaker 1: a distinguished legal record stretching back more than a half century,
• 48:53
Speaker 1: he damaged that reputation badly in two recent episodes, one
• 48:57
Speaker 1: of which involved The Times directly. Boyes earned sharp criticism
• 49:01
Speaker 1: for his close ties to Theranos, a blood-testing startup that
• 49:05
Speaker 1: collapsed under accusations of fraud. Speaking of that, there's a
• 49:08
Speaker 1: great documentary about that on HBO. I forget the name
• 49:14
Speaker 1: right now, but if you Google Theranos documentary... you'll be
• 49:18
Speaker 1: able to find it. It was really, really good. good.
• 49:20
Speaker 1: And the scam that they were running, oh boy. Its
• 49:25
Speaker 1: founder now faces federal criminal charges. Boyd served as an
• 49:29
Speaker 1: outside lawyer and a corporate director. The former Wall Street
• 49:32
Speaker 1: Journal reporter who exposed the fraud, John Carreyrou, has said
• 49:37
Speaker 1: Boyd's firm acted to intimidate whistleblowers. Boyd denies that. Again,
• 49:43
Speaker 1: I don't have any information about any of that case.
• 49:45
Speaker 1: I don't know anything about Theranos. Those assertions might be correct.
• 49:49
Speaker 1: I don't know all the ins and outs of the
• 49:52
Speaker 1: actual legal battle. All I know is what I saw
• 49:55
Speaker 1: in that documentary. And like I was saying, that documentary
• 49:58
Speaker 1: is explosive and I highly recommend it. In recent years,
• 50:03
Speaker 1: Boy's firm did legal defense work for the Times. Then,
• 50:06
Speaker 1: in late 2017, the newspaper fired Boy Schiller Flexner over
• 50:11
Speaker 1: revelations he hired a private firm run by former Israeli
• 50:15
Speaker 1: spies for Harvey Weinstein. As the New Yorker first reported,
• 50:19
Speaker 1: that firm sought to intimidate the Times sources and even
• 50:22
Speaker 1: tailed its reporters. Boyce says he was unaware of the
• 50:25
Speaker 1: extent of the firm's work. Well, see, I don't know
• 50:28
Speaker 1: about all of that. I don't know if I'd buy that, Mr.
• 50:30
  Speaker 2: Boyce.
• 50:30
Speaker 1: I'm pretty sure you knew exactly the type of people
• 50:33
Speaker 1: you were hiring if you hired ex-Massad, my friend. So,
• 50:36
Speaker 1: come on, let's not try and be dishonest here, alright?
• 50:39
Speaker 1: We know if we're hiring ex-Massad as private investigators, you
• 50:44
Speaker 1: know what you're getting when you pay for that. You
• 50:46
Speaker 1: know what sort of people you're getting. The Times implied
• 50:51
Speaker 1: Boyce took on the Epstein case to help restore his reputation.
• 50:54
Speaker 1: By 2019, Mr. Boyce, 78, was representing a number of Mr.
• 50:56
Speaker 1: Epstein's alleged survivors. Boyd says he represented his first alleged
• 51:05
Speaker 1: Epstein victim in 2015, before Theranos became a scandal and
• 51:10
Speaker 1: added others subsequently. I think it's fair to say that
• 51:13
Speaker 1: Boyd's representation of Epstein's victims has helped him burnish his
• 51:17
Speaker 1: reputation when he needed it the most, Silver Greenberg says.
• 51:21
Speaker 1: So they're insinuating here, and this is a pretty rough insinuation,
• 51:24
Speaker 1: and I don't know how Silver Greenberg can make this insinuation,
• 51:28
Speaker 1: but what he's saying is, basically, if you read between
• 51:30
Speaker 1: the lines, that David Boies don't give a shit about
• 51:33
Speaker 1: the survivors. That all he cares about is his reputation. And, again,
• 51:38
Speaker 1: I don't know Mr. Boyce personally, and I don't know Mr.
• 51:42
Speaker 1: Silver Greenberg personally either, but I do know that Silver
• 51:44
Speaker 1: Greenberg works for the Times, who is notorious for kneecapping people,
• 51:49
Speaker 1: who is notorious for trying to destroy people they disagree with.
• 51:53
Speaker 1: And we know from just recently in the article that
• 51:58
Speaker 1: he had a relationship with the New York Times. And
• 52:00
Speaker 1: we know that it ended pretty on a rough patch.
• 52:04
Speaker 1: So how do we know that there's not animosity by
• 52:07
Speaker 1: the New York Times in this case? Again, folks, all
• 52:09
Speaker 1: I'm saying is we have to keep our minds open.
• 52:11
Speaker 1: We really don't know what's what. The Times has its
• 52:16
Speaker 1: own checkered backstory in covering Epstein. Bingo. Epstein was first
• 52:20
Speaker 1: convicted in a Florida state court of a sex crime
• 52:23
Speaker 1: involving a minor in 2008. After his release from prison,
• 52:27
Speaker 1: Epstein still held significant sway in New York City, hosting
• 52:30
Speaker 1: titans of finance, politics, media, academia, and high society. And
• 52:35
Speaker 1: people from the media. Let's not forget that, NPR. He
• 52:38
Speaker 1: hosted parties at a townhouse that was reportedly the largest
• 52:41
Speaker 1: in Manhattan. Even so, the Times wrote about Epstein sparingly,
• 52:45
Speaker 1: and when it did, even admiringly. Of course they did.
• 52:50
Speaker 1: Of course they did. All of those reporters and all
• 52:53
Speaker 1: of those people, the editors, they were all buddy-buddy with
• 52:56
Speaker 1: Epstein back then. They were all running in the same circles.
• 53:00
Speaker 1: His buddy George Stepanopoulos, Katie Couric, Woody Allen, you know,
• 53:05
Speaker 1: the whole lot of them. They were all thick as thieves,
• 53:09
Speaker 1: even after his conviction. One financial reporter who kept tabs
• 53:14
Speaker 1: on Epstein for the Times wrote a gauzy profile of
• 53:17
Speaker 1: him that ran just before Epstein was set to enter
• 53:20
Speaker 1: prison in 2008. Reporter Landon Thomas Jr. mostly portrayed the
• 53:25
Speaker 1: offense as patronizing prostitutes rather than highlighting it as a
• 53:29
Speaker 1: crime involving a minor. And this, my friends, is why
• 53:33
Speaker 1: from the very beginning of the Me Too movement, I
• 53:35
Speaker 1: laughed at places like the New York Times. They don't
• 53:38
Speaker 1: give a shit about victims. They don't give a shit
• 53:41
Speaker 1: about survivors. They want to sell papers. That's why they
• 53:46
Speaker 1: jumped in on the whole Me Too movement. That's why
• 53:48
Speaker 1: they got involved. That's why they act like they're hard-charging
• 53:50
Speaker 1: warriors for it. Meanwhile, Epstein's survivors couldn't even get a
• 53:57
Speaker 1: minute of their time, couldn't get any of their top reporters,
• 54:00
Speaker 1: top journalists to sit down with them and tell their story.
• 54:05
Speaker 1: You know why? Because the New York Times does not
• 54:09
Speaker 1: give a shit, okay? Point blank, period. They don't give
• 54:12
Speaker 1: a shit. In the summer of 2018, Thomas refused an
• 54:19
Speaker 1: assignment to call Epstein on a story citing a conflict.
• 54:22
Speaker 1: At his request, the financier, Pedophile, had made a $ 30, 000
• 54:26
Speaker 1: donation to a Harlem cultural center. Enrich, Thomas' editor, ordered
• 54:31
Speaker 1: him not to write about Epstein again. Thomas was forced
• 54:34
Speaker 1: to leave the paper at the start of 2019. Enrich
• 54:37
Speaker 1: says the Times should have told readers about the episode,
• 54:40
Speaker 1: which the paper has never done before. Of course they haven't,
• 54:44
Speaker 1: because they're a dishonest trash-rag outlet. Everything you read in
• 54:48
Speaker 1: the New York Times, take with a grain of salt, folks.
• 54:54
Speaker 1: The Miami Herald's Julie K. Brown broke the story open
• 54:57
Speaker 1: in November 2018 by chronicling accusations against Epstein and the
• 55:01
Speaker 1: failures of major institutions to hold him accountable. Brown says
• 55:05
Speaker 1: the press is among those institutions. Boy, cites the press
• 55:09
Speaker 1: failings too. Yeah, no shit. If it wasn't for the
• 55:12
Speaker 1: press being such miserable failures, I wouldn't have this podcast.
• 55:15
Speaker 1: I wouldn't be here talking to you folks about this.
• 55:17
Speaker 1: There would be no need for it. But when you
• 55:19
Speaker 1: have survivors of Jeffrey Epstein's reign of terror reaching out
• 55:22
Speaker 1: to me, just some average guy who was pissed off
• 55:26
Speaker 1: and decided, hell, I need to make a podcast so
• 55:28
Speaker 1: my friends are aware of what's going on. I had
• 55:30
Speaker 1: no idea that it would turn into what it is
• 55:32
Speaker 1: now with, you know, hundreds of thousands of downloads, etc., etc.,
• 55:37
Speaker 1: But the fact is, the New York Times should have
• 55:40
Speaker 1: been the one stepping up. The New York Times should
• 55:42
Speaker 1: have been a place, a safe harbor for these survivors
• 55:45
Speaker 1: to contact, for these survivors to go and get help.
• 55:48
Speaker 1: But no, it wasn't that. We filed our first Epstein
• 55:53
Speaker 1: case in 2015. We filed a second case in 2016.
• 55:58
Speaker 1: And in 2016, we tried to get the Times to
• 56:01
Speaker 1: write about this, Boyce says. Until July 2019, the Times
• 56:05
Speaker 1: showed no interest at all in Epstein's survivors or in
• 56:09
Speaker 1: the scope and scale of Epstein's trafficking, or even in
• 56:13
Speaker 1: the fact that a sex trafficking ring was going on.
• 56:20
Speaker 1: Enrich doesn't flinch at the criticism. I think that we
• 56:23
Speaker 1: missed the ball on the Epstein coverage. Yeah, no shit
• 56:25
Speaker 1: you did. Add a great detriment to the survivors. Add
• 56:28
Speaker 1: a great detriment to their health and their securing justice.
• 56:32
Speaker 1: So good job, New York Times. Remember this, folks. Remember
• 56:35
Speaker 1: what we're talking about here. Next time you go and
• 56:37
Speaker 1: you're trying, you're going to pay for the New York
• 56:39
Speaker 1: Times to get behind their firewall. Screw that. Take that
• 56:42
Speaker 1: money and give it to your favorite content creator. Donate
• 56:46
Speaker 1: that money, whatever it may be, but the New York
• 56:48
Speaker 1: Times is not the sort of outlet that should be trusted.
• 56:55
Speaker 1: I think we missed the ball on the Epstein coverage,
• 56:57
Speaker 1: says Enrich, who joined the paper in 2017 and is
• 57:01
Speaker 1: now its business investigations editor. I am really disappointed in
• 57:04
Speaker 1: myself and the New York Times for not having responded
• 57:07
Speaker 1: as forcefully and as quickly and as aggressively as we
• 57:10
Speaker 1: should have. Yeah, because you were still protecting him, alright?
• 57:14
Speaker 1: Just be honest. You didn't respond because, you know, you
• 57:16
Speaker 1: weren't going to be able to score your political points
• 57:18
Speaker 1: this way. It wasn't, you know, your enemies, your political
• 57:22
Speaker 1: enemies weren't going to be taken down, so forget the story.
• 57:25
Speaker 1: That's what we've devolved into in this country. Every big
• 57:28
Speaker 1: story is all about, oh, which politician can we take down?
• 57:31
Speaker 1: Who can we take down that doesn't think like us? Meanwhile,
• 57:35
Speaker 1: there's sex trafficking rings operating right underneath our noses, and
• 57:39
Speaker 1: everybody's too busy engaged in tribalism and petty political fights
• 57:43
Speaker 1: to stand up and protect these people. Well, I've had enough.
• 57:49
Speaker 1: The Times intensified its Epstein's coverage after a grand jury
• 57:52
Speaker 1: handed up indictments against him on more serious charges of
• 57:55
Speaker 1: sex crimes against minors last summer. The guy was an
• 57:58
Speaker 1: effing pedophile. Everybody knew it. The New York Times knew it.
• 58:02
Speaker 1: The people all over the world knew it. The Times
• 58:06
Speaker 1: was also slow to cover developments involving Joy Ito, then
• 58:10
Speaker 1: director of the MIT Lab. Ito resigned from the New
• 58:13
Speaker 1: York Times Company Board and the Massachusetts Institute of Technology
• 58:17
Speaker 1: last September as his ties to Epstein came into focus. Again,
• 58:21
Speaker 1: they can't even clean their own house of people that
• 58:23
Speaker 1: were tied to Jeffrey Epstein. But they had the audacity
• 58:26
Speaker 1: to get on their... pillar and yell down at the
• 58:30
Speaker 1: rest of us and call David Boyce names and call
• 58:33
Speaker 1: this one names and call this one an accuser and
• 58:35
Speaker 1: call this one an enabler. Hey, New York Times, here's
• 58:39
Speaker 1: an idea. Why don't you take a good hard look
• 58:41
Speaker 1: in the mirror, okay? And what you'll find is you'll
• 58:44
Speaker 1: find an enabler right there. Ito had solicited contributions for
• 58:51
Speaker 1: the lab and his own venture fund from Epstein years
• 58:54
Speaker 1: after the financier conviction for crimes involving sex with underage teenagers. Pedophilia.
• 59:03
Speaker 1: The Times journalists wrote that their report lays bare how
• 59:06
Speaker 1: powerful men buy their way out of legal and reputational jeopardy.
• 59:10
Speaker 1: You know, that's funny because I'm pretty sure that's what
• 59:12
Speaker 1: the Times does as well. And in interviews, they say
• 59:18
Speaker 1: their reporting did so in a transparent way, acknowledging false
• 59:21
Speaker 1: starts and unanswered questions. Their lengthy interview with NPR about
• 59:25
Speaker 1: the story is part of that transparency, they say. This
• 59:28
Speaker 1: is one of the pieces of journalism, both the weekly
• 59:31
Speaker 1: television show and the article, that I'm most proud of,
• 59:34
Speaker 1: Silver Greenberg says. And I'm proud of us showing our
• 59:37
Speaker 1: process in this. Oh, shut up. You have nothing to
• 59:39
Speaker 1: be proud of. You know, I try not to get
• 59:42
Speaker 1: too wound up. about these articles and these reporters who
• 59:46
Speaker 1: are reporting these articles like they're some champion of these survivors, man,
• 59:51
Speaker 1: you are not a champion of anybody. Your whole entire
• 59:54
Speaker 1: operation turned their back on these survivors when they needed
• 59:57
Speaker 1: them most. When nobody was listening to their stories, the
• 1:00:01
Speaker 1: New York Times turned their back on them. And if
• 1:00:03
Speaker 1: you think I'm ever going to forget that, if you
• 1:00:05
Speaker 1: think I'm ever going to stop driving that point home,
• 1:00:08
Speaker 1: you are sorely mistaken. And what about that man who
• 1:00:12
Speaker 1: called himself Patrick Kessler? He told the lawyers and the
• 1:00:16
Speaker 1: Times reporters that he had material implicating former Israel Prime
• 1:00:20
Speaker 1: Minister Ehud Barak, Britain's Prince Andrew, and Harvard Law Professor
• 1:00:25
Speaker 1: Emeritus Alan Dershowitz, who had been a legal advisor for
• 1:00:28
Speaker 1: Epstein and served on President Trump's legal team during the
• 1:00:32
Speaker 1: Senate impeachment trial. All have denied any impropriety. All right, well,
• 1:00:37
Speaker 1: he might not have the dirt on Ehud Barak, Prince
• 1:00:39
Speaker 1: Andrew and Alan Dershowitz, but we know that dirt exists.
• 1:00:43
Speaker 1: We know that Ehud Barak had a very cozy relationship
• 1:00:46
Speaker 1: with Jeffrey Epstein. I haven't even dove into that yet.
• 1:00:49
Speaker 1: We haven't even begun to explore Ehud Barak's relationship because,
• 1:00:53
Speaker 1: you know, being based here in America, we have so
• 1:00:55
Speaker 1: many other people that need to be discussed. But don't
• 1:00:58
Speaker 1: think for a minute that Ehud Barak is going to
• 1:01:02
Speaker 1: miss his chance to have a closer look because that's
• 1:01:04
Speaker 1: coming eventually as well. Times reporters spoke with Kessler repeatedly.
• 1:01:10
Speaker 1: One session stretched over eight hours at a Washington Hotel
• 1:01:13
Speaker 1: conference room and involved two bottles of Japanese whiskey, according
• 1:01:18
Speaker 1: to the paper. Two bottles of Japanese whiskey, huh? So
• 1:01:21
Speaker 1: that was the payment? You bought this drunkard a couple
• 1:01:23
Speaker 1: bottles of whiskey? Got them all plied on the sauce
• 1:01:26
Speaker 1: and then thought you were going to get some information
• 1:01:28
Speaker 1: from them, huh? What is the New York Times employing
• 1:01:30
Speaker 1: the CIA's method of getting people to talk? I wouldn't
• 1:01:33
Speaker 1: be shocked considering their symbiotic parasitic relationship with the intelligence community.
• 1:01:40
Speaker 1: The Times sought without luck to substantiate Kessler's claims last fall.
• 1:01:45
Speaker 1: Online searches easily pulled up his supposedly classified documents. A
• 1:01:49
Speaker 1: coffee company denied any knowledge of him as an investor.
• 1:01:52
Speaker 1: He frequently contradicted his own assertions. NPR unsuccessfully sought to
• 1:01:58
Speaker 1: reach Kessler on a mobile phone number he had used
• 1:02:00
Speaker 1: in the past. A message left with a man who
• 1:02:02
Speaker 1: said he knew him was not returned. Most important, Kessler
• 1:02:06
Speaker 1: failed to deliver any proof of his claims. Oh, almost
• 1:02:09
Speaker 1: like the New York Times, huh? Where's all their proof?
• 1:02:12
Speaker 1: A lot of conjecture, but they sure haven't provided us
• 1:02:15
Speaker 1: with any proof. On the time show, The Weekly, business
• 1:02:21
Speaker 1: editor Ellen Pollack describes waiting delivery of Epstein's computer servers
• 1:02:25
Speaker 1: in October from Iceland. The grandiose promise collapsed with Kessler
• 1:02:29
Speaker 1: texting about a fire, a missing team member, and his
• 1:02:32
Speaker 1: own desperate flight to Kiev. The Times team never saw
• 1:02:36
Speaker 1: Kessler again. He didn't even ask for money to be
• 1:02:39
Speaker 1: fronted to him, Boyd says. When you conclude a fraud
• 1:02:41
Speaker 1: has been committed, the question is, why? He's unlikely to
• 1:02:45
Speaker 1: be doing that entirely on his own. Like I said, folks,
• 1:02:49
Speaker 1: from the very beginning, I told you what this was.
• 1:02:52
Speaker 1: This was an intricate plot to try and ruin David
• 1:02:56
Speaker 1: Boyd's credibility, and the vehicle used, once again, was the
• 1:03:01
Speaker 1: moronic New York Times. The Times article contains the hint
• 1:03:06
Speaker 1: of a question. Was he sent to discredit boys in Pottinger,
• 1:03:09
Speaker 1: and by whom? I'll give you a hint. He doesn't
• 1:03:12
Speaker 1: like to take his underpants off, and he is completely
• 1:03:16
Speaker 1: and utterly up to his neck in the Jeffrey Epstein situation.
• 1:03:19
Speaker 1: That would be my guess. Do I have evidence proving that?
• 1:03:22
Speaker 1: I do not, folks. But that would be my guess,
• 1:03:25
Speaker 1: and I said that earlier when we talked about this story.
• 1:03:33
Speaker 1: The Times-Enriched says the paper's reporters continuously hunted Kessler, even
• 1:03:37
Speaker 1: after publishing. What was he? A scam artist? An extortionist?
• 1:03:41
Speaker 1: A plant? They don't know. There is not a day
• 1:03:44
Speaker 1: in those three months, including weekends, that we were not
• 1:03:46
Speaker 1: trying to figure out who Patrick Kessler is. what he
• 1:03:50
Speaker 1: actually has, where he comes from, and why he's doing this,
• 1:03:53
Speaker 1: Enridge says. Oh, even weekends, huh? You guys even work
• 1:03:56
  Speaker 1: on weekends? That's cute. I haven't missed a day in
• 1:03:58
Speaker 1: 158 days. I've been on this podcast 158 straight days,
• 1:04:02
Speaker 1: most days with at least two episodes, and they're talking about, oh,
• 1:04:06
Speaker 1: we've been working weekends? That's nice, with your six-figure salaries.
• 1:04:12
Speaker 1: The Times journalists say they never thought to wait to
• 1:04:15
Speaker 1: publish until they unraveled the secret of Patrick Kessler. They
• 1:04:18
Speaker 1: tenaciously held onto the story they sought to tell, as
• 1:04:21
Speaker 1: twisty as it turned out to be, alerted to the
• 1:04:23
Speaker 1: path by a patently unreliable guide. Folks, look. All I
• 1:04:30
Speaker 1: can take away from this is New York Times was
• 1:04:34
Speaker 1: used by the Epstein team to try and discredit the
• 1:04:37
Speaker 1: survivors' lawyers. That's what I'm taking away from this. And
• 1:04:42
Speaker 1: I thought that at the very beginning. And this just
• 1:04:44
Speaker 1: this really confirms it for me and sends it home.
• 1:04:48
Speaker 1: The New York Times is not a reliable source in
• 1:04:52
Speaker 1: the best of times anymore. And when it comes to
• 1:04:55
Speaker 1: the Jeffrey Epstein case, I really have a hard time
• 1:04:58
Speaker 1: believing them when it comes to stories like this. Now,
• 1:05:01
Speaker 1: don't get me wrong. Every now and then they have
• 1:05:03
Speaker 1: a really good piece, like the piece we read last
• 1:05:06
Speaker 1: night that was talking about The core four, that was
• 1:05:10
Speaker 1: a fantastic investigative piece. It wasn't a hit piece. It
• 1:05:13
Speaker 1: was a piece that got down into the weeds. It
• 1:05:15
Speaker 1: dealt with the details of the case. It laid out
• 1:05:18
Speaker 1: who these gals were, how they were involved, etc., etc.
• 1:05:22
Speaker 1: In a story like this, there's a bunch of conjecture
• 1:05:25
Speaker 1: and nonsense and misdirection and basically confusion for the reader.
• 1:05:29
Speaker 1: And that's what the whoever sent Kessler in, that was
• 1:05:33
Speaker 1: their plan to to cause confusion and to cause doubt
• 1:05:37
Speaker 1: and to make people think that the survivor's lawyer is
• 1:05:41
Speaker 1: just in it for a money grab. So that would
• 1:05:44
Speaker 1: in some way demean the survivor's claims as well. And
• 1:05:48
Speaker 1: that was the goal, in my opinion, in this whole
• 1:05:51
Speaker 1: entire Kessler situation. Folks, before I sign off, I'd like
• 1:05:57
Speaker 1: to again reiterate to you that this coronavirus situation, it's
• 1:06:01
Speaker 1: a serious situation. Look, we're not going to all die
• 1:06:03
Speaker 1: from it. It's not a world-ender, nothing like that. But
• 1:06:07
Speaker 1: it is a very serious situation, and even if you're
• 1:06:10
Speaker 1: a very healthy person... and you are somebody who might
• 1:06:14
Speaker 1: contract coronavirus and just have a mild case and you're
• 1:06:18
Speaker 1: not exhibiting any symptoms, you could very well pass that
• 1:06:21
Speaker 1: on to somebody who is not as lucky as you.
• 1:06:24
Speaker 1: Somebody whose immune system is compromised. Somebody who, say, went
• 1:06:28
Speaker 1: through cancer. Somebody who has heart problems. Somebody who has asthma.
• 1:06:32
Speaker 1: Somebody who has diabetes, etc., etc. If you pass on
• 1:06:35
Speaker 1: your mild germ to them, it could become life-threatening for them.
• 1:06:40
Speaker 1: So social distancing is very important, folks. In my opinion,
• 1:06:44
Speaker 1: we don't have to wait for the government to do it.
• 1:06:47
Speaker 1: We can all do it. You know, mitigate your time
• 1:06:50
Speaker 1: in big groups. Mitigate your time around other people. Keep
• 1:06:54
Speaker 1: a six foot, you know, barrier as much as you can.
• 1:06:57
Speaker 1: And of course, everybody's telling you to wash your hands.
• 1:06:59
Speaker 1: And sure, that's great advice. But what they're not telling
• 1:07:02
Speaker 1: you is a lot of reports coming out are saying
• 1:07:06
Speaker 1: that this virus can live on certain surfaces for up
• 1:07:09
Speaker 1: to nine days. So please be very vigilant. Be very vigilant.
• 1:07:14
Speaker 1: If you feel like you're sick, don't go to work.
• 1:07:16
Speaker 1: Don't take the chance of spreading this to your loved
• 1:07:19
Speaker 1: ones or to other people who have compromised immune systems
• 1:07:23
Speaker 1: who are seriously at risk of really suffering complications here, folks. Because,
• 1:07:28
Speaker 1: you know... I'm not one to ring the bells of alarm,
• 1:07:32
Speaker 1: especially in situations like this. I'm always one who calls
• 1:07:35
Speaker 1: for calm and for everybody to remain in a state
• 1:07:40
Speaker 1: of preparedness, but to remain calm. And that is exactly
• 1:07:43
Speaker 1: what I'm calling for here. This is not a time
• 1:07:45
Speaker 1: for panic. This isn't a time for panic buying. None
• 1:07:49
Speaker 1: of that stuff. We all have to keep our heads
• 1:07:51
Speaker 1: and work together to make sure that we get rid
• 1:07:55
Speaker 1: of this virus as soon as possible. This isn't the flu.
• 1:07:58
Speaker 1: This isn't the common cold. This is a virus with
• 1:08:02
Speaker 1: an R0 of anywhere from 2.5 to 5. And what
• 1:08:06
Speaker 1: the R0 means is that's how many people it gets
• 1:08:09
Speaker 1: spread from one person to the others. And if you
• 1:08:12
Speaker 1: understand what exponential growth is and how exponential growth works
• 1:08:16
Speaker 1: in pandemics, you understand how serious this could be. This
• 1:08:20
Speaker 1: could be just a very, very, very bad situation that
• 1:08:24
Speaker 1: could last for a while. You know, I know a
• 1:08:26
Speaker 1: lot of people are banking on the warmer weather slowing
• 1:08:30
Speaker 1: it down and stopping it. But I have my doubts
• 1:08:33
Speaker 1: about that, folks. Just take a look at the way
• 1:08:36
Speaker 1: it's starting to rage in places like Qatar and the
• 1:08:39
Speaker 1: Middle East and Sub-Saharan Africa is now having a problem.
• 1:08:42
Speaker 1: We can't rely on that sort of thing to make
• 1:08:45
Speaker 1: sure that this virus goes away. We have to work
• 1:08:48
Speaker 1: together to make sure that we're being responsible and we're
• 1:08:53
Speaker 1: not being involved in large gatherings, large groups, And I
• 1:08:57
Speaker 1: know it's hard, especially for the younger people out there.
• 1:08:59
Speaker 1: for the social distancing. But folks, we got to do it.
• 1:09:03
Speaker 1: The lives of our parents and our grandparents and people
• 1:09:07
Speaker 1: with compromised immune systems might very well depend on it.
• 1:09:12
Speaker 1: And all you have to do is take a look
• 1:09:14
Speaker 1: at Italy and what's going on in Italy, especially northern Italy,
• 1:09:17
Speaker 1: where they have a fantastic medical system, where they have
• 1:09:20
Speaker 1: a ton of money. And you see how overwhelmed they
• 1:09:23
Speaker 1: are because the sheer number of cases that need medical
• 1:09:27
Speaker 1: attention in the hospital because of lung issues. So this
• 1:09:30
Speaker 1: is what we face, folks. And we have a couple
• 1:09:33
Speaker 1: of choices here. We can either... to say, screw it,
• 1:09:37
Speaker 1: I'm all about me right now and I'm going to
• 1:09:39
Speaker 1: keep going to these social gatherings and I'm going to
• 1:09:41
Speaker 1: go to, you know, the bar or whatever it may
• 1:09:44
Speaker 1: be and bring those, maybe bring that virus home to
• 1:09:48
Speaker 1: your loved ones or the people you work with that
• 1:09:50
Speaker 1: have COVID compromised immune systems, or we can all suck
• 1:09:55
Speaker 1: it up for a little while and mitigate our contact
• 1:09:59
Speaker 1: with big large crowds and going to the store and
• 1:10:02
Speaker 1: all of that stuff and suck it up for a
• 1:10:05
Speaker 1: couple of weeks and do our best to make sure
• 1:10:08
Speaker 1: that those amongst us that are at the most risk
• 1:10:11
Speaker 1: are taken care of. I've seen so many callous comments,
• 1:10:15
Speaker 1: so many people, oh, it's only older people or immunodeficiency
• 1:10:18
Speaker 1: people or You guys realize that people with obesity fall
• 1:10:22
Speaker 1: into that category as well, right? And in America, what
• 1:10:25
Speaker 1: is the level of obesity, folks? Around 45%? So come on,
• 1:10:30
Speaker 1: let's have a little compassion for those of us who
• 1:10:32
Speaker 1: might not be as strong in our immune systems as
• 1:10:36
Speaker 1: the rest of us. Let's have a little bit of
• 1:10:38
Speaker 1: compassion for the people around us. Let's make sure that
• 1:10:41
Speaker 1: we're being responsible here, folks. I'm not saying panic. I'm
• 1:10:44
Speaker 1: not saying crawl into a bunker. But what I am
• 1:10:47
Speaker 1: saying is follow the advice of the medical professionals. Mitigating
• 1:10:52
Speaker 1: your contact with large groups is just straight up common
• 1:10:55
Speaker 1: sense at this point. And if we needed any more
• 1:10:57
Speaker 1: evidence of it, do you really think the NBA would
• 1:11:00
Speaker 1: be postponing their season if this wasn't a serious deal?
• 1:11:03
Speaker 1: When's the last time that we've had something like this
• 1:11:05
Speaker 1: go around and we've seen the elite ruling class catch it?
• 1:11:09
Speaker 1: We've Tom Hanks. NBA stars, Italian Series 1 soccer stars.
• 1:11:14
Speaker 1: I'm sure there's other athletes with it as well. We
• 1:11:17
Speaker 1: see all these politicians catching it. So what it is, folks,
• 1:11:21
Speaker 1: is it's a lot more serious of a situation than
• 1:11:23
Speaker 1: we were led to believe from the very beginning. And
• 1:11:27
Speaker 1: now we're playing catch up and it's not a good situation.
• 1:11:31
Speaker 1: At the end of the day, though, there is hope.
• 1:11:34
Speaker 1: Once we work together and we're all following the guidelines
• 1:11:38
Speaker 1: and we're making sure that, you know, we're washing our hands.
• 1:11:41
Speaker 1: I'm sick of hearing that. I know all of you
• 1:11:43
Speaker 1: are sick of hearing that. We all wash our hands,
• 1:11:45
Speaker 1: I hope, in the best of times. But it's important
• 1:11:47
Speaker 1: that if you go out or you're someplace where you're using,
• 1:11:51
Speaker 1: you're touching surfaces that are high traffic surfaces, make sure
• 1:11:55
Speaker 1: you wash your hands. Keep some wipes with you, whatever
• 1:11:57
Speaker 1: it may be. But most importantly, if you get sick... Self-isolate.
• 1:12:01
Speaker 1: Make sure you self-isolate. Don't run around and say, oh,
• 1:12:04
Speaker 1: it's just allergies or it's just a cough because we
• 1:12:07
Speaker 1: don't know the extent of the outbreak in the country
• 1:12:10
Speaker 1: right now. Believe me when I tell you there has
• 1:12:12
Speaker 1: been a silent outbreak going on in this country for
• 1:12:14
Speaker 1: quite some time. And if you have not been exposed
• 1:12:18
Speaker 1: to it yet, at some point, if you keep going
• 1:12:20
Speaker 1: to gatherings and you keep going out into these big groups,
• 1:12:23
Speaker 1: you will be exposed to this virus. If you catch
• 1:12:27
Speaker 1: it or not, I have no idea. I'm not a
• 1:12:29
Speaker 1: virologist and I'm not going to sit here and tell you, oh,
• 1:12:30
Speaker 1: if you're out and you're in contact with somebody with it,
• 1:12:33
Speaker 1: you're definitely going to catch it. I don't know all
• 1:12:35
Speaker 1: of that. I'm not going to sit here and get
• 1:12:36
Speaker 1: into the scientific weeds with you. I'm just talking some
• 1:12:39
Speaker 1: basic common sense here, folks. Some basic common sense. And
• 1:12:43
Speaker 1: I hope that this is done quickly. I hope that
• 1:12:46
Speaker 1: everybody's life gets back to normal. But while we're living
• 1:12:50
Speaker 1: under the threat of this pandemic, we're all going to
• 1:12:53
Speaker 1: have to take the necessary steps to make sure that
• 1:12:56
Speaker 1: we're doing the right thing for those in our communities
• 1:12:59
Speaker 1: that might not be as equipped to deal with this outbreak.
• 1:13:04

• 1:13:32

• 1:13:36
Speaker 1: paper in the store. You're going to have toilet paper, folks. Relax.
• 1:13:40
Speaker 1: If you're going to go buy anything and spend money,
• 1:13:42
Speaker 1: go get yourself a few bags of rice, a few bags,
• 1:13:45
Speaker 1: some canned food, you know, stuff that you would normally eat.
• 1:13:48
Speaker 1: That way, in case there's a quarantine or a self-imposed quarantine,
• 1:13:52
Speaker 1: you don't have to go to the store. You already
• 1:13:54
Speaker 1: have a few things in the refrigerator. You're already ahead
• 1:13:57
Speaker 1: of the game then if you do that. All right.
• 1:13:59
Speaker 1: But the toilet paper thing, stop it. All right, everybody.
• 1:14:03
Speaker 1: Until later, I'll talk to you then.
