Speaker 1: What's up everyone, and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to pick up where we left
• 0:05
Speaker 1: off talking about Brian Colberger and where things currently stand.
• 0:11
Speaker 1: The vehicle evidence developed into a technical dispute over model years,
• 0:15
Speaker 1: visual characteristics, and expert interpretation. Early descriptions reportedly included a
• 0:21
Speaker 1: much more narrow range of Hondai A Lantra model years
• 0:25
Speaker 1: than the year of Coburger's car. Investigators later expanded that
• 0:29
Speaker 1: range after additional review. The defense viewed the change as
• 0:33
Speaker 1: a reason to question whether police had shaped their conclusion
• 0:36
Speaker 1: around the suspect. Prosecutor has treated it as the natural
• 0:41
Speaker 1: refinement of an expert assessment based on incomplete nighttime footage.
• 0:45
Speaker 1: Surveillance video rarely provides the clarity associated with television crime dramas. Headlights, angles, compression, distance,
• 0:53
Speaker 1: and darkness can obscure subtle differences between similar vehicles. A
• 0:58
Speaker 1: jury would have needed to decide whether the recordings reliably
• 1:02
Speaker 1: depicted Coburger's car or merely a common white sedan. The
• 1:06
Speaker 1: state would have supplemented the images with route evidence, phone data,
• 1:11
Speaker 1: and records linking the laundro to Coburger. The defense would
• 1:14
Speaker 1: have emphasized that resemblance was not identification, and that the
• 1:18
Speaker 1: investigative revision could reveal uncertainty. Now, the cell phone evidence
• 1:23
Speaker 1: presented a similar conflict between broad patterns and precise conclusions.
• 1:28
Speaker 1: Historical cell side information can indicate which tower or sector
• 1:32
Speaker 1: communicated with the device, it generally cannot place a person
• 1:36
Speaker 1: inside a particular room or directly beside a specific house.
• 1:40
Speaker 1: The prosecution therefore needed experts to explain what the records
• 1:44
Speaker 1: could and could not establish. The defense was entitled to
• 1:48
Speaker 1: expose any exaggeration in claims about location. Coburger's phone also
• 1:54
Speaker 1: reportedly connected to a tower serving Moscow at a later point,
• 1:58
Speaker 1: when investigators did not believe he was physically in the city.
• 2:02
Speaker 1: That detail gave the defense an example of why tower
• 2:05
Speaker 1: contact could not be equated with presidents at King Road.
• 2:09
Speaker 1: Prosecutors could have responded that their theory depended on a
• 2:12
Speaker 1: sequence of movements rather than one isolated tower connection, and
• 2:17
Speaker 1: when all is said and done, the trial would have
• 2:19
Speaker 1: required jurors to decide which interpretation better fit the total evidence.
• 2:24
Speaker 1: Questions about motive persisted throughout the prosecution because authorities never
• 2:28
Speaker 1: publicly offered a complete explanation for why these four students
• 2:32
Speaker 1: were targeted. Investigators had not established an own relationship between
• 2:37
Speaker 1: Coburger and the victims. The absence of an obvious connection
• 2:41
Speaker 1: creates a disturbing mystery at the center of the case.
• 2:45
Speaker 1: Prosecutors were not legally required to prove motive if they
• 2:48
Speaker 1: could prove identity and intent. Nevertheless, jurors often want to
• 2:52
Speaker 1: understand why a person would commit an act of extraordinary violence.
• 2:57
Speaker 1: The defense could have used the missing motive to argue
• 2:59
Speaker 1: that the state its theory lacked a human or logical foundation.
• 3:04
Speaker 1: The prosecution could have answered that senseless crimes do not
• 3:07
Speaker 1: become less real merely because the offender's internal reason remains unknown.
• 3:12
Speaker 1: Digital searches, social media activity, surveillance, or other evidence might
• 3:17
Speaker 1: have supplied part of the answer at trial. Because the
• 3:20
Speaker 1: case ended in guilty please, much of the prosecution's intended
• 3:23
Speaker 1: motive evidence was never publicly tested. Colberger's current challenge is
• 3:28
Speaker 1: therefore reviving not only legal questions, but also the unresolved
• 3:33
Speaker 1: question why did these murders occur. Coburger eventually provided a
• 3:39
Speaker 1: limited alibi, suggesting that he'd been driving alone during the
• 3:42
Speaker 1: night of the murders. The defense described nighttime driving as
• 3:46
Speaker 1: something that he regularly did. That account placed him away
• 3:50
Speaker 1: from his residence, but did not identify a witness who
• 3:53
Speaker 1: could confirm his exact location. It also intersected awkwardly with
• 3:57
Speaker 1: the prosecution's evidence showing a similar review traveling between Pullman
• 4:01
Speaker 1: and Moscow. An alibi can be powerful when it places
• 4:06
Speaker 1: a defendant somewhere impossible to reconcile with the crime. This
• 4:10
Speaker 1: one appeared more likely to produce a dispute over roots, timing,
• 4:14
Speaker 1: and the interpretation of electronic data. Defense experts could potentially
• 4:18
Speaker 1: have argued that his phone or vehicle traveled somewhere other
• 4:22
Speaker 1: than King Road. Prosecutors would have contended that his admission
• 4:26
Speaker 1: to driving was consistent with their central allegation. The eventual
• 4:31
Speaker 1: trial would have required a detailed reconstruction of roads, cameras, distances,
• 4:35
Speaker 1: and time stamps. The guilty plea prevented that competing reconstruction
• 4:40
Speaker 1: from being presented to a jury. As the evidence battles continued,
• 4:45
Speaker 1: the defense also sought to move the trial away from
• 4:48
Speaker 1: leytah County. Coberger's attorney argued that intense publicity and the
• 4:52
Speaker 1: community's connection to the victims made it difficult to select
• 4:55
Speaker 1: an impartial jury In Moscow, though prosecution resisted did the
• 5:00
Speaker 1: suggestion that local residents were incapable of following the court's instruction.
• 5:05
Speaker 1: Venue disputes involved more than counting on favorable headlines. Courts
• 5:09
Speaker 1: consider population size, media saturation, community sentiment, and the practical
• 5:15
Speaker 1: ability to question prospective jurors. The judge ultimately transferred the
• 5:19
Speaker 1: proceedings to Ada County, where a larger jury pool offered
• 5:23
Speaker 1: greater protection against local prejudice. The case also received a
• 5:27
Speaker 1: new judge after the move. That change required the court, attorneys, witnesses,
• 5:32
Speaker 1: and families to adapt to a new location. It created
• 5:36
Speaker 1: additional logistical burdens, but reduced a major potential issue for appeal.
• 5:41
Speaker 1: By then, nearly every aspect of the case had been
• 5:43
Speaker 1: shaped by the need to ensure that any verdict would
• 5:46
Speaker 1: withstand later scrutiny. The transferre to Boise moved the case
• 5:52
Speaker 1: physically away from Moscow, but it could not remove the
• 5:55
Speaker 1: emotional history surrounding it. The victims had lived in Moscow,
• 6:00
Speaker 1: attended school there, worked there, and built their friendships there.
• 6:04
Speaker 1: The house itself became a symbol of grief, fear, and controversy.
• 6:08
Speaker 1: University officials eventually demolished the residents, arguing that its removal
• 6:13
Speaker 1: was necessary for healing and campus safety. Critics questioned whether
• 6:17
Speaker 1: the building should have remained available for the defense or
• 6:20
Speaker 1: a future jury view. Investigators had already documented the interior
• 6:25
Speaker 1: extensively through photographs, scans, measurements, and video. The demolition nevertheless
• 6:31
Speaker 1: reflected the tension between preserving a crime scene and allowing
• 6:35
Speaker 1: a community to move forward. By the time the trial
• 6:38
Speaker 1: was relocated, the physical location had disappeared, even though the
• 6:42
Speaker 1: case remained vivid. The courtroom and Boise would have needed
• 6:45
Speaker 1: to reconstruct a house that no longer existed. That reconstruction
• 6:49
Speaker 1: would have depended on evidence rather than powerful experience of
• 6:53
Speaker 1: standing inside the actual rooms. During this period, unidentified DNA
• 6:59
Speaker 1: and other trace evidence WinCE became a major focus of
• 7:01
Speaker 1: public debate. Defense filings referred to genetic material from individuals
• 7:06
Speaker 1: other than Colberger that had reportedly been found during the investigation.
• 7:11
Speaker 1: Online commentators treated those references as proof that unknown perpetrators
• 7:16
Speaker 1: had been ignored. The reality was more complicated because occupied
• 7:20
Speaker 1: homes commonly contained biological material from residents, visitors, workers, and
• 7:25
Speaker 1: incidental contact. The significance of unknown sample depends on where
• 7:30
Speaker 1: it was found, how much existed, what form it took,
• 7:33
Speaker 1: and whether it related to the attack. DNA recovered from
• 7:37
  Speaker 1: a weapon, a victim's wounds, or a blood trail would
• 7:40
Speaker 1: carry different meaning from a DNA found on a shared's surface.
• 7:44
Speaker 1: Prosecutors argued that the unidentified material did not undermine the
• 7:48
Speaker 1: sheath evidence or the rest of the case. The defense
• 7:52
Speaker 1: maintained that potentially exculpatory samples required fuller investigation and disclosure.
• 7:58
Speaker 1: A jury would have needed signed TIVI testimony rather than
• 8:01
Speaker 1: Internet speculation to evaluate those competing claims. The later plea
• 8:06
Speaker 1: meant that much of this evidence never received that public
• 8:09
Speaker 1: adversarial examination. One disputed item involved a hair reportedly recovered
• 8:15
Speaker 1: from or near Ethan Chapin's hand. Colberger now characterizes that
• 8:20
Speaker 1: evidence as potentially belonging to an unidentified person. That description
• 8:25
Speaker 1: suggests a dramatic possibility that Shapin grabbed an attacker who
• 8:29
Speaker 1: was not Coburger. Reports concerning earlier defense testing, however, indicate
• 8:34
Speaker 1: that the questioned hair was tested by defense expert and
• 8:38
Speaker 1: match Chapin. If those reports accurately describe the testing, the
• 8:42
Speaker 1: hair provides little support for an alternative perpetrator theory, and
• 8:46
Speaker 1: I think this dispute demonstrates how a fragment of forensic
• 8:49
Speaker 1: information can be transformed when removed from the procedural history.
• 8:54
Speaker 1: Evidence may initially be described as unidentified, even though later
• 8:58
Speaker 1: testing resolves its source. Prosecutors are likely to challenge any
• 9:02
Speaker 1: attempt to present previously examined evidence as newly discovered indication
• 9:07
Speaker 1: of innocence. Colberger's new council may dispute the testing, the
• 9:12
Speaker 1: disclosure process, or the advice his former attorneys gave him
• 9:15
Speaker 1: about the result. The court will need the laboratory records
• 9:19
Speaker 1: and complete defense file before it can determine what the
• 9:21
Speaker 1: hair evidence actually establishes. The defense also investigated whether other
• 9:27
Speaker 1: individuals could have committed the murders or assisted the killer.
• 9:31
Speaker 1: Exploring alternative suspects was not merely an act of desperation,
• 9:35
Speaker 1: because competent counsel must examine plausible explanations inconsistent with the
• 9:39
Speaker 1: state's theory. Yet, courts do not generally permit defendants to
• 9:43
Speaker 1: accuse strangers based on rumor or speculation. Evidence linking another
• 9:48
Speaker 1: person to the crime must possess some degree of relevance
• 9:51
Speaker 1: and reliability. The pretrial litigation therefore included arguments over what
• 9:57
Speaker 1: alternative perpetrator evidence could be presented. Prosecutors maintained that the
• 10:02
Speaker 1: investigation had eliminated other individuals and focused on Coburger for
• 10:07
Speaker 1: evidence based reasons. The defense sought greater freedom to expose
• 10:11
Speaker 1: investigative assumptions and possible blind spots. The conflict reflected the
• 10:16
Speaker 1: broader difference between an investigation and the prosecution. Police may
• 10:21
Speaker 1: narrow their focus once evidence points towards the suspect, while
• 10:24
Speaker 1: defense lawyers are trained to challenge that narrowing process. The
• 10:28
Speaker 1: trial was supposed to determine whether the investigation had identified
• 10:33
Speaker 1: their correct man or merely the most convenient one. As
• 10:37
Speaker 1: a scheduled trial approach, both sides faced enormous risk. Prosecutors
• 10:42
Speaker 1: possessed substantial evidence, but a capital trial would have required
• 10:45
Speaker 1: them to prove every essential allegation beyond a reasonable doubt.
• 10:49
Speaker 1: The defense had identified areas for attack, but it could
• 10:53
Speaker 1: not erase the DNA on the sheath or the broader
• 10:55
Speaker 1: pattern described by the state. Jurors would have been asked
• 10:58
Speaker 1: to absorb complex science alongside horrific testimony about the victim's death.
• 11:04
Speaker 1: Any uncertainty during the guilt phase would have determined whether
• 11:07
Speaker 1: Colburger was convicted at all. A conviction would then have
• 11:11
Speaker 1: led to a separate punishment phase, where the death penalty
• 11:15
Speaker 1: remained possible. The families would have had to endure graphic evidence,
• 11:19
Speaker 1: the extensive media coverage, and the unpredictability of jury deliberation.
• 11:23
Speaker 1: Coburger faced the possibility of execution and decades of appellate litigation.
• 11:29
Speaker 1: Against that background, POLA negotiations offered both sides a way
• 11:33
Speaker 1: to exchange uncertainty for certainty. The agreement that emerged was
• 11:38
Speaker 1: therefore not a casual compromise, but a deliberate resolution of
• 11:42
Speaker 1: extraordinary stakes. All right, folks, we're going to wrap up
• 11:45
Speaker 1: right here, and in the next episode dealing with the topic,
• 11:48
Speaker 1: we're going to pick up where we left off. All
• 11:50
