you on yesterday's show that Secretary Warner quite upset by an executive order coming from
2:13
President Biden as it pertains to so called get out the vote campaign. Secretary
2:16
Warner and several other secretaries of state are fighting back, kind of banded together.
2:22
We're going to talk to Secretary Warner about that. Plus, Nitro Mayor
2:25
Dave Casebolt is here as well. Amelia Nicely is with us. She's an
2:30
investigative reporter with West Virginia Watch. She's been closely following some of the tragedy
2:32
situations if on the kids in our state. We're going to talk to her,
2:37
but we're going to start off on a happy note. Let's bring in
2:39
officially now. Drum roll please, the James Beard Award winner direct from Chicago,
2:46
Illinois. Paul Smith. Sheff, Paul, you want it all,
2:50
buddy, Congratulations, Hey, thanks Dave. I really appreciate it. I'm
2:53
sorry, I'm outside in Chicago just taking it all in. So it's a
2:58
little loud. It's gonna have to be with me. Have you had any
3:00
sleep at all? You know, I slept a little bit. The after
3:06
party was epic. You know that there are thirty James Beard Award winning chefs
3:10
and mixologists that are cooking for us, and it was it was surreal.
3:16
I woke up this morning figure it was a dream, and then my wife
3:21
pinched me and I realized it wasn't. And I literally had almost six hundred
3:27
and fifty text messages in my inbox. And that's the beautiful thing about all
3:31
this. You know that the hardware is great, the win is great,
3:36
but just the outpouring from our great state West Virginia is amazing. It's it
3:45
has been a world wind ride. And I was one of those that was
3:47
texting you and Mass and genm and I appreciate you taking time to join us
3:52
on the show. I know you're still taking it all in, but I
3:54
did want to give you the opportunity just to say, uninterrupted by me,
3:58
whatever's on your mind, whatever you want to say. Well, number one,
4:02
I want to say thanks to my partners, my teams. You know,
4:08
Tintin is what restaurant was nominated, but you know, the pitch and
4:15
all of the restaurants that I am involved with, whether it's consulting, whether
4:20
it's helping. You know, this, this rising tide that we're all a
4:26
part of, is raising all of our boats. So I'm just happy to
4:29
be a little bit of the water in the tide. I I was so
4:34
humbled with so many businesses that reached out, like Huntington Bank and the Nel
4:42
Chilton Foundation and you know, Ben Selango and you know it. There were
4:51
probably twenty different sponsors that allowed us to do this event last night at the
4:59
Capitol Mark, you know, the Capital Market AARP. I mean, holy
5:02
cow, it was. It was epic. I mean I saw it for
5:06
the first time this morning. The reaction of that crowd, it was amazing.
5:11
Ugly cried, I literally ugly cried. Harry was like, are you
5:14
okay? And I said, watch this, and you know it's funny.
5:18
I watched the video of the awards last night, and you know, they're
5:24
naming the chefs of the Southeast and when they named my name, you could
5:29
almost hear a pin drop and maybe two or three people clapping that were probably
5:32
Stephen Keith and Jason Adams and my Sioux chefs and my wife right and then
5:39
now everybody knows who West Virginia is. Now everybody knows that we are a
5:45
force to be reckoned with in tourism, in the culinary world. And I'm
5:48
just happy to be able to leave the charge. So, I mean,
5:53
we know, you get the award and the recognition is there like a Golden
5:56
Spatchelor or something that they give you. What goes along with that, they
6:00
give you a medallion you know, on stage that goes around your neck and
6:04
it is you know, it is the Culinary Oscars. You know, it's
6:12
it's an honor to just be you know, Academy Award nominee, James Beard
6:17
nominee. But to win it, you know, it was it was amazing.
6:21
You know, there's there's two thousand chefs at Union Station last night,
6:27
and you know, everyone, not everyone, but so many chefs took their
6:32
time to say, hey, congratulations West Virginia. Huh, that's amazing.
6:39
You're doing great things. I've been there, you know. And that's the
6:43
great thing about West Virginia is once people come here, they they don't want
6:47
to leave. You know, we have this innate sense of hospitality. You
6:51
know, you anytime you're out of town and you run into somebody from West
6:55
Virginia. There were so many people last night that were like, I lived
6:58
in West Virginia, have been hidden, or I lived in Greenbrier County or
7:01
whatever, and it was it was just, this is a surreal experience.
7:06
And you know, I don't do it alone, obviously. You know,
7:10
my team was on Cloud nine last night at ten ten at the pitch at
7:15
Ellen's ice Cream and it's just it is awesome to be able to make a
7:20
difference in people's lives. And usually it's you know, we get to cook
7:26
for people that have means, that have you know, expendable income that could
7:31
come in and enjoy our cuisine. But you know, what the James Beard
7:35
Foundation stands for is inclusion. And I'm so happy that they included geographically.
7:44
You know, we're not in Chicago, we're not in Atlanta, we're not
7:48
in New York City, we're not in la We are in Charleston, West
7:53
Virginia. And it's just amazing that we are in the same conversation and now
7:59
we're congratulations. I've got a Milia Nicely here with us from West Virginia.
8:03
Watch he's going to be on immediately after you and I was going to give
8:07
a Meali, you would like to say hello to the chef pollsman. Hello,
8:09
congratulations. We're also proud of you, and I loved in your acceptance
8:13
speech that you talked a little bit about your personal story and what a beautiful
8:18
representation of West Virginia. So thank you for representing us so well. We're
8:22
proud of you. Well, thank you so much. And you know,
8:24
everybody has something going on in their life, whether it's mental health, whether
8:30
it's addiction, or whether it's just having a bad day. And you know,
8:33
if someone at the top of their game can talk about it and shed
8:37
a little bit of light on it and create a you know, a safe
8:41
place in a restaurant environment like we've created. You know, my door is
8:46
always open, and I know we all have some things going on in our
8:50
lives and we can all overcome them. You know, five years ago this
8:54
wouldn't be possible. But you know, you take you ask for help,
9:00
you accept help, and then you you know, you take charge and your
9:05
trajectory starts going straight up. So thank you so much, Cheff Paul.
9:09
I think you're going to be doing a lot of these type interviews. I'm
9:11
glad I got to be one of the first and I think Dave Wilson's going
9:15
to have you on talk line coming up here in an hour. So I
9:18
appreciate you being here, being here, and again, congratulations from all of
9:20
us. Man, thanks a lot, Thank you so much for having me.
9:24
It's a pleasure. Take care all right, Cheff Paul smith the James
9:26
Beard Award winning Cheff Paul smith Man, meally, is that cool or what
9:30
I mean? You know Nashville, Atlanta, all these big cities and oh
9:35
yeah, Charleston, West Virginia. I know it takes it all. And
9:37
the first time they were able to say West Virginia on the stage, that's
9:41
amazing. I thought he was going to say at some point, oh West
9:45
Virginia. Yeah, somebody's gonna say, yeah, I used to live in
9:46
Richmond. Now you used to live in Rohano. Now we're actually a state
9:50
where actually Amelia Nicely is here. Uh so, I appreciate you. You
9:54
put in your your congratulations there. Million Nicely is here. First of all,
9:56
tell us about West Virginia. Watch about the in the news outlet.
10:01
Sure so we are a nonprofit news outlet, no paywall, and we are
10:05
part of State's newsroom. They have a newsroom in every state, mostly focused
10:07
on politics capital coverage. I have mostly focused on child welfare and education since
10:13
we started last year. And one of the coolest things about us is that
10:18
every paper in the state can use our content for free. So our stories
10:22
regularly are run in the Register Herald, in the Times West Virginian and the
10:26
Fairmount area and I love that. So we're we're available for anyone to run
10:30
our content. And how are you funded and be able to do this?
10:31
Sure? So we are at our corporate level, our state's newsroom, our
10:35
owners. They do the fundraising and it's donation and grant. We also take
10:39
donations on our level as well, but it's mostly grants and donations that they're
10:43
funding us. You know you said that primarily your focus has been child welfare.
10:46
Well, you've been busy the last couple of months because it seems like
10:50
Amelia every day there's another story about their growing crisis with kids somehow in the
10:54
Mountain state. The two that have gotten the most attention probably the tragic situations
10:58
in Sissonville and also in Boone County. And we know there are more,
11:01
seemingly more come out every day, but these two, for obvious reasons have
11:05
gotten the majority of the attention. I'm gonna let you start with either one
11:09
of those situations in the Sistanmville or the Boone County situation. Now we'll get
11:13
into some other stuff too, but I'm gonna ask you the sixty four million
11:16
dollar question, how did we get here? How does this? How do
11:18
these stories happen? Yeah, we probably don't have time for the full journey,
11:22
right, Well, wrap it up on Thursday, but go ahead,
11:26
But I think it's important to note if you didn't if you don't know anything
11:28
about child welfare, the childwelfare crisis in West Virginia, it is coming out
11:35
of poverty, it is coming out of the opioia crisis, and we have
11:39
an overwhelmed child welfare system. The majority of children we have about six thousand
11:43
kids in foster care right now. The majority of those kids come in for
11:46
abuse and neglect referrals related to drug abuse or substance abuse in the home,
11:52
not all, but many, and years of underfunding the problem other issues we
12:00
have a depleting workforce in West Virginia has resulted and we do not have enough
12:03
CPS workers to check on children, and we do not have enough foster homes,
12:07
traditional foster homes to care for children, and so that has resulted in
12:11
some of these other horrific stories you've heard of kids being left in homes or
12:16
kids sleeping in hotels, kids sleeping and out of state facilities that aren't safe.
12:20
And so that's kind of like the big picture of it. These two
12:24
situations you've mentioned in Sistonville and Boone County are both times where neighbors and even
12:31
in this case a trooper for the Boone County story have said we have called
12:35
CPS and no one came out and checked on these children. And it has
12:39
been a struggle for where I've covered it for four years prior to coming to
12:41
West Virginia Watch, but ask any reporter here, it has been an absolute
12:46
struggle to get any information from the Department of Human Services about this situation.
12:52
And in the Boone County situation, specifically the case of Kennedy, it seems
12:56
like there has been a whole lot of finger pointing going around, yeah,
13:01
and that has been difficult to navigate as a reporter. We had a press
13:05
conference last week. I'm sure you've talked about it at some point on your
13:07
show, but essentially the Troop Western State Police and Department of Human Services,
13:13
which oversees child protective services. They're saying, even if that referral had made
13:18
it to us, it would not have triggered an abuse of neglect investigation.
13:22
So now lawmakers are focused on changing homeschooling regulations because Kennedy had been being homeschooled,
13:28
but there was really no one who stepped up and said I could have
13:30
done X y Z better. And I want to talk about the homeschooling aspect
13:33
of it here. And I know coming up the Little Show preview next hour
13:37
that Dave Wilson's in for Hobby this week and he's going to talk about the
13:41
homeschooling situation. He's got Delagate, Amy Summers and Senator Rucker, I think,
13:45
are both going to be on separately to talk about that. I had
13:48
one of my best friend in high school homeschooled her kids and there was reporting.
13:54
She is in Indiana now, but she was in West Virginia when she
13:56
homeschooled her kids. There was quite a bit of reporting that she she told
14:00
me about that was required to do. And I don't know if it's if
14:03
it's changed somehow, but I mean she may as well been a public school
14:07
teacher for all the Maybe she just did a little bit more than she was
14:09
supposed to do. I don't know, but I mean, we seem to
14:13
have an issue here with this. Yeah, and I think what's going to
14:16
be really key moving forward, both for journalists and lawmakers who are looking to
14:18
make good policy, is to understand the scope of the problem. So right
14:22
now they have four years they have to complete assessments. We know that in
14:26
Kennedy Miller's case they didn't complete that assessment. That should have triggered some type
14:31
of truancy investigation. However, the way the law's written now, they didn't
14:35
have to follow up on it. From everything I'm understanding, but is this
14:39
a widespread problem in homeschooling. We don't know, and I think that's something
14:41
that we need to know. How many kids have failed, have their parents
14:46
fail to turn in those assessments you reference. The press conference was held last
14:50
week with the Governor's office without the governor, but she was staff. Brian
14:52
Abraham and others were there. Your thoughts on that press conference, Well,
14:58
it's the first time we've had an in person press conference at the Governor's office
15:01
in years, so that was, you know, interesting, But I would
15:05
say my thoughts were I'm appreciative of the time that we were given. They
15:09
let us all ask multiple questions. I appreciate that. However, there was
15:13
a lot of finger pointing, as you said, and there was this tone
15:16
of we are not going to talk about this anymore, so get all of
15:18
your questions out now. Well, that's not how news works. We're going
15:22
to continue to dig and continue to ask questions and follow those public records requests.
15:26
But I think we all left being a little bit like no one is
15:31
taking responsibility, and I'm not sure the clear steps moving forward besides altering homeschool
15:37
laws, which is just one part of her story. And going back to
15:41
your initial question, as Child Protective Services is very overwhelmed. We've got a
15:45
lot of issues across foster care. I mean, they're embroiled in an extremely
15:48
large lawsuit that outlines many problems in the system. I think it's hard for
15:54
us as journalists to say, how is her case not connected to the foster
15:56
care crisis at all? And that's still a question that's hanging out there.
16:00
So what are you looking at? You and others that are covering this,
16:02
So by the way you've done a fantastic job on it. I think it's
16:04
you know, and I talked about this on the show before. We're all
16:07
quote unquote competitors. You know, we have the media in Charleston, from
16:11
Metro News to the TV stations, yourself and because that mail and whatever.
16:15
But everybody seems to be kind of on the same page on this. And
16:17
Leslie Grubin I think when she was on with Hopey talked about that a couple
16:19
of weeks ago. This is not a thing where we're trying to race to
16:22
get to the story. I mean, well, we'll do that when a
16:25
new business is coming to town or something. This is something, Amelia that's
16:29
far more, far too important to get into that competition between the media outlets.
16:33
I mean, everybody's pretty much on the same page on these stories.
16:37
Yes, absolutely, And excuse me. I could pull up multiple group chats
16:41
with Leslie, with other reporters that are only about this case, where we
16:44
have been sharing records with one another and cheering one another on and really and
16:48
we don't have to remind each other of this, but we all feel the
16:51
same that this is not about us. You know, you might have seen
16:52
there have been attacks on reporters from the administration for covering this case. There
16:57
were comments made that well press conference, for example, Brian Abraham said something
17:02
like, well, the only reason we lied or misspoke. I don't think
17:04
he said lied, but the reason we misspoke is because you all were asking
17:07
us too much, too many questions. Well, that's our job, and
17:11
what better important question than following up on the death of a child. So
17:17
we are not competing on this. We're trying to push each other to continue.
17:19
And while that press conference certainly marked a significant part in this story,
17:25
it is not going to be the end for us, because there are other
17:27
children like Kennedy out there that we need to make sure that. When I
17:32
think, for me, the biggest question moving forward is when someone calls CPS,
17:36
do we know that someone is answering the call, logging the referral and
17:40
going out to check on them and to bring back up Sissonville. Through a
17:44
public records request, I found out that they did indeed have a referral for
17:48
the kids who were locked in a shed without a toilet or running water,
17:52
but they could not produce a single travel record for months showing that they ever
17:56
checked on these kids before the police found them that a tragedy, and now
18:00
we're seeing that some of that same stuff in Kennedy's case. So I think
18:03
that's the biggest question moving forward is what documentation And I've asked EHS that what
18:10
can you give me that can show me that when a mandated reporter or a
18:14
neighbor calls your hotline, that somebody will answer the phone and go check on
18:18
the child. Bill Nicely, we got to leave it there for West Virginia

21:36
Welcome to the show, sir, Good morning, Good morning, Dave.
21:38
How you doing. I'm doing fin. Sorry we're running a little bit
21:41
behind this morning, but I mean important stuff there with Emilia and with chef,
21:47
with Chef Paul Smith, our James Beard award win. That's good stuff.
21:51
Yes, it was good stuff. So yesterday, Mayor, I had
21:55
Mayor Scott James of Saint Albans on the show yesterday and had to say congratulations
22:00
to him because he was re elected to the mayor's ship. You have also
22:03
been re elected. You ran unopposed and now begin your fourth term as mayor.
22:07
So congratulation to you too, Mayor. Well, thank you, Dalve.
22:08
I appreciate that. In fact, we had about every position was unopposed
22:14
except for our Council at large. We had four people run for that position
22:17
and the community ended up electing the three incumbents, Andy Shamblin, Bill James
22:22
an Emily bar So it was another very quiet election, to say the lee.
22:26
It was. Indeed. Now I do want to talk about Rita Cox.
22:30
Miss Cox had been the recorder there for some time in the city.
22:33
In fact, I worked with her when I was working for the Secretary of
22:36
State's office. She opted to retire and rich highly ran ran for that seat
22:41
unopposed and was voted in. But she was a treasurer in your town,
22:44
sir, she was our recorder. Yes, and I'll tell you what she
22:48
was the wisdom whatever I need, some wisdom. That's who I went to.
22:51
Rita is a very smart person and we're going to miss her. I
22:55
hate to see her lee, but Rich'll step in and do a fantastic job.
22:57
We are sure that. So, I guess it's fair to say that
23:02
citizens and others in Nitro must be pretty happy Mayor with what's been going on
23:06
there. Well, I'll tell you, Dave, we just have a fantastic
23:10
staff, fantastic employees who are dedicated, dedicated, hard working. They're deeply
23:18
appreciated by our community. I think the community sees how hard our employees work,
23:23
and they our community does a fantastic job of electing city council members too.
23:30
I'll tell you what I've been involved in city government for. Well,
23:32
this'd be my twenty fourth year, and I'm going to tell you I have
23:36
never seen a city council that works as hard as Nitro City Council. They
23:40
are out in the community every day, involved with our youth, involved with
23:44
our seniors involved with recreation, just doing things to make life better for the
23:49
citizens of Nitro. We just have a fantastic council and the community sees that
23:55
they see how hard they work and they're deeply appreciative that. Talk about the
23:59
levee in thispal levee you had that was approved, right, Yeah, that
24:03
was approved. I think it was approved that eighty or eighty one percent.
24:07
In fact, I think most of the municipal levees were approved. I think
24:10
that's a pretty pretty strong indication that most people in the cities are approved of
24:17
how the money is being spent. So, uh, it was it was
24:21
you know, ours was approved pretty easily. I want to talk about what's
24:25
on the horizon, Mayor, as you begin your new term for the city
24:29
of for your city of Nitro. What are some what are some big things
24:33
that you and the council and the citizens can look forward to. Well,
24:36
I will say this, this will be my last four years. I've now
24:38
set to just about everybody, well at least all city council knows that this
24:45
will be my last four years. But we do have quite a few projects
24:48
that we're working on now that we need to complete. Project at the Lake.
24:52
We have a lot of city improvement, city park improvements that we need
24:55
to complete. We're looking at putting in some electric car charging station, creating
25:00
new investment through our property tax held properties acquisitions. Got a new pickleball court
25:07
cover we need to put over that, and we think we can attract a
25:11
lot of big termaments with that. So we got a lot of things on
25:15
the horizon that we're looking at that we help to get done the next four
25:18
years. I will say this day that I think a big part of our
25:22
success is how we involve the community in our planning. They whenever for a
25:29
future planning, we always we always encourage citizen input and we take their ideas
25:33
and we listen to them, we value those ideas and then we incorporate them
25:37
into our planning. So the community is just as big as part of our
25:41
success as anything else. All right, Well, you guys do some fantastic
25:45
things there in the city of Nitro. I appreciate you. Of course,
25:48
you just had to run for the wall there a couple of weeks ago,
25:52
and I know you get the big pickleball event happening real soon. Johnny Rutherford
25:55
knows, folks, So wish you the best of luck with everything, and
25:57
you're always welcome on the show. Mayor congraduates on your win, and everyone
26:00
else is there and we'll talk soon. Buddy, thanks a lot, Hi,
26:03
Dave, thank you man. Take care. That is Dave Caseball,
26:07
the mayor of Nitro. I don't know if that was breaking news or not
26:10
that he said he's this is the last term he's done after this. He's
26:14
done a great job there, I think, is the mayor. I think
26:15
people in Nitro would probably agree with that, and but this is it for

31:04
Mac Warner on the show, Secretary, good morning, welcome back, Hey,
31:07
good to be with you, Dave. Before we get into the reason
31:11
you're here today, there's a lot of focus, of course on the primary
31:14
elections last month and now looking to add to the November general, but there's
31:18
still a lot of elections going on around the state even today. I heard
31:22
on the air this morning of the Morning I think Martinsburg is one of the
31:25
cities that's having an election today. Generally speaking, the first two tuesdays of
31:29
June. There are a lot of municipal elections around the state. I know,
31:32
as I said, Nitro just had one. Just talk to Mayor Dave
31:33
Casebold, who was re elected to a fourth term. So there's a lot
31:37
of municipal elections going on around the state today. We don't want to forget
31:41
about those there are. The legislature recently has moved to try to make these
31:47
aligned with the general elections, the normal elections, but states or cities have
31:52
their own charters and so forth. So yeah, so, and that's important
31:56
why sports for talk radio shows that get information out people to keep the interest
32:00
the attention on these elections as they occur, because those local elections are the
32:05
ones that are the most important. So I'm glad you're talking. Yeah,
32:09
there's quite a few round the state today. And I'll get to this too.
32:13
I touched on this just a little yesterday, and I know, having
32:15
worked in the office, that there's not a whole lot you can say about
32:19
the hint of an investigation, but there are people raising some questions Secretary about
32:22
some particular voting, the regularities in the primary and the recent Mingo County election.
32:27
I don't know. You may not be able to say anything at this
32:30
point, but do you care to make a comment. Just we were aware
32:34
of these situations, we are on top of that. We've been doing what
32:37
we're allowed to do or supposed to be doing. And as you said,
32:40
we can't talk about investigations, but people should know that it is we have
32:45
gotten our attention, We're on it, and we'll see how this thing plays
32:50
out very good. Talking to Secretary of State Mac Warner, we posted a
32:52
story Secretary over the weekend that you and Secretary of the State from a few
32:57
other states Arkansas, Indiana, Louisiana, Mississippi, Montana, New Hampshire,
33:01
Tennessee, and Wildbean, some of you have issues with what you say is
33:06
an attempt by the Biden administration to federalize elections. How So, yeah,
33:12
I'm really glad that you're raising this because another example where West Virginia is leading
33:15
the nation in election integrity and security, and we have these other states that
33:20
you just mentioned joining in on us. And where this comes from is a
33:22
case that came came out of Pennsylvania where a number of legislators, about twenty
33:28
eight legislators in Pennsylvania sued on the same premise that we've been talking about now
33:34
for three years, and that is the federal overreach where the Biden administration is
33:37
trying to take over the running of elections and time states how to run the
33:43
election, and it's contrary to the US Constitution. There's an election cause in
33:46
the US Constitution, Article one, Section four. It's the time, place,
33:52
and manner of elections shall be left the state legislatures. And so this
33:57
case in the particular has two interesting components to it. Noticed that word in
34:00
there shall be left to and then state legislatures. And so the issue that
34:06
came out of this Pennsylvania case is the district court in Pennsylvania tossed the case
34:12
out saying that these individual legislats tours didn't have standing. The legislature did that
34:16
not the legislate tours, So the individual people, these twenty eight people.
34:21
So that's what was thrown out, and they appealed and they went straight to
34:24
the Supreme Court. And that's where we have now going in leading these other
34:29
eight states saying we agree, and what we're asking the US Supreme Court to
34:34
do is to side on the merits, not understanding the issue that the came
34:38
out of Pennsylvania, but the actual issue, and that is that the general
34:43
government should not be reaching in and telling states how to run their elections.
34:46
And so what happened we saw in the twenty twenty election was the unusual situation
34:52
that came with COVID, the mail in ballots, that dropped boxes, accepting
34:57
ballots without signatures, accepting ballots after the election was over. Those were issues
35:01
that they tried to federalize. They tried to do that with HR one,
35:06
if you might know it, two or three years ago, but it came
35:08
up in the House and the Senate and it was defeated, that very narrowly
35:13
defeated. And again West Virginia played a key role with our senators being involved
35:17
in that. So now they have tried to take it out of that congressional
35:23
where it should be the congressionally decided issues and turned it into an executive order
35:29
to the President. President Biden said, we're going to turn all six hundred
35:32
federal agencies into get out the vote senators and so things absurd as says the
35:40
Department of Agriculture with their borrowing and loan guarantee programs, that they would now
35:47
hand you a voter registration form and say you ought you want to fill this
35:53
out, Or the Environment of Education with student loans and work study programs handing
35:58
you a voter registration. Department of Treasure were tax assistance, Well here's the
36:04
one. The Immigration Services, Homeland Security would be handing uniform So all those
36:13
sorts of things are just or if you come out of prison or you go
36:16
into fit federal prison, they would encourage you to register to vote. Well,
36:22
we don't think that that should be part of the system. This is
36:24
supposed to be lester the states. And so that's where we've led this effort
36:30
to get the other states to join in and say, federal government, you're
36:35
overreaching. This is supposed to be lefter the states. And that's what we're
36:38
asking the Supreme Court to decide on. What's Regina Secretary of State mac Wanner
36:43
again, So basically, what I'm hearing you say not devot word. If
36:45
you're saying hands off our elections, that's what you and the other Secretary of
36:50
the States are saying. Right, we are that the Constitution clearly says that
36:53
it's left to the to the to the states, not to anybody else,
37:00
not the government, not the federal government, not the governors, no one,
37:04
not the attorney generals. It's left to the state legislatures. And so
37:07
when our state legislature says you will have voter ID, that's what they mean.
37:12
In the federal government. The president shouldn't be able to come in and
37:15
say Nope, you don't need vot ideas, or you can accept ballots without
37:19
signatures, or you can use drift boxes. That's a state prerogative. Let
37:23
us decide how to run our states. And that's what's very clearly in the
37:27
Constitution, and that's why we're leading this effort to say hands off. It's
37:31
somewhat akin to if you remember the doctor Bucks situation. We don't want our
37:37
elections being run by Google, Facebook, Twitter, you know, x whatever,
37:42
coming in and sponsoring elections in the state and giving us hundreds of millions
37:45
of dollars to run our elections to say we're they're particular candidate, just like
37:50
we don't want large corporations to run the elections. Who don't want the federal
37:53
government, whether it's Republican Democrat, I don't care. I don't want them
37:58
to get out the vote. You in federal tax dollars to favor one side
38:04
versus another. Let the states run it. We've been perfectly capable of doing
38:07
this for two hundred and fifty years. Leave us alone and don't try to
38:10
overreach and tell us how to run our election. And you're hoping this will
38:15
get to the Supreme Court. You any other secretary of the state, is
38:16
that right now? Well, we have a wonderful General Counsel, Dave Cook
38:20
in our office wrote the anarchust free and the other states now have liked his
38:24
work and signed on. I've tribute to shout out to Dave Cook and Winter
38:29
for he's done in our office and just a tremendous job writing this brief and
38:35
these states assigned on. It has now been filed with the Supreme Court,
38:37
and we're asking us because of the importance of this with this twenty twenty four
38:42
election. We want them to decide the case right now in the face they
38:46
throw it out, save that the President cover reached in this situation executive order
38:52
it's a one four zero one NAT and say that's unconstitutional in Spreme Court shops
38:57
also that throw it out. Talk you, Secretary of State Macwarner. Before
39:00
we let you go, I want to switch gears for a moment. It
39:02
was a hard fought campaign Secretary for Governor. In the end, Attorney General
39:07
Patrick Morrissey defeated former Delegate more capital yourself and out of dealer Chris Miller to
39:12
gain the Republican nomination for governor. Morrissey will now face honey to Mayor Steve
39:15
Williams in the fall. Is it in your opinion? Time now for Republicans
39:21
to get behind Patrick Morrissey, and will you yourself be supporting Patrick Morrissey for
39:24
governor. Absolutely, And let me just clarify this. This is in my
39:30
role as mac Warner private citizen, yes, governor whatever, not as Secretary
39:35
of State. So just as I didn't, I've never endorsed anybody because of
39:39
my situation as Secretary of State. So I have to maintain that separation in
39:44
my role as Sectuary of State. But as a Republican, there are policies,
39:49
there are ways to run government, and that's Patrick Morrissey's and I see
39:55
things very much alike. And so in that regard, I support Patrick Morrisey,
40:00
the Republican candidate for governor. I am behind him, and I just
40:06
want to be very clear to everybody, but that is not an endorsement in
40:08
any way that would say I can't fairly decide should an issue arise with a
40:15
voting state, but we have gone in Bingo County or some other situation like
40:19
that. I intend to be able to execute my duties as Sexuary Estate unencumbered
40:24
by an endorsement. That's what I think. So I am supportive of Patrick
40:30
Morrisey, think the Republican candidate and the principle that he and I believe in
40:35
very very much alike. So I hope, yeah, yeah, And again
40:38
I want to make sure maybe that was an unfair question on my part.
40:42
I want to make sure people realize that it was too that I was asking
40:45
that of Macwarner, not as a not of Secretary of State Macwarner. You
40:50
have to be two different people at times when you work in that office.
40:52

Yeah. I wanted to make sure we drew that distinction there because he
41:10
was actually on the show. That's kind of on me. He was here
41:13
to talk about Secretary of State business, and I kind of threw a little
41:15
curve ball at because I just kind of wanted to see I mean, you
41:19
know, we've heard all this stuff about certain members of the Republican Party wanting
41:23
Joe Manchon Independent Joe Manchon to now get into the race, and you know
41:30
that talk is coming from somewhere, and I had a feeling it was not
41:32
coming from Mac Warner. But I just kind of wanted to clarify that because
41:36
I know there's a big effort right now on behalf of Patrick Morrissey and others
41:38
to try to get everybody. Obviously it's happened in every other election, to
41:43
get everybody behind their candidate. There are some people, I think within the
41:45
Republican Party some and I don't know that there are any of the people I
41:50
mentioned that were candidates in the primary, but there are some who aren't exactly
41:54
enamored with with Patrick Morrison. Possibly would like some to get it, but
41:59

Jeff Jenkins is a story post at wv metro news dot com. There is
48:04
a battle amongst firefighters at the Tyler Mountain Volunteer Fire Department now at least ten
48:10
members. This is according to jeff'sory. At least ten members from Tyler Mountain
48:15
have resigned their positions. The Canawah County Commission issued a statement about it,
48:21
which you can read as part of Jeff's story. In effect, it says
48:23
that the residents and businesses will continue to be served and will not be understaffed
48:30
now. The Commission says they have arranged to have departments from Dunbar Institute,
48:35
Cissonville, Nitro, and Westside to help out. I don't know exactly,
48:39
maybe even get an update on the next couple of days. No word exactly
48:43
what the exact issues are there, and again you can read more about it
48:47
on JEFF'STORYWV Metro News dot com. But I will gladly make time on the
48:52
show for any of the parties involved. For whether it's the firefighters or the
48:58
commission or whomever would like would like to come on the show, I will
49:01
make I will make arrangements to have you on the show. Dave Allen showing

twenty three ninety nine, I told you and have been about the targeted enforcement
49:19
in the construction zone around Nitro and I sixty four. Now you want some
49:22
numbers. Well, they had a particular day on May twenty ninth. That's
49:27
the day I referred to as it looked like smoking the bandit day. I
49:30
was talking about another show yesterday. Man, there was blue lights. There
49:34
are blue lights everywhere on that so on May twenty ninth, and as I
49:38
said, as I was driving home today's valley, on both sides of the
49:44
road at one point there were no fewer than ten police vehicles out on that
49:51
particular day, May twenty nine, and I'll tell you on my drive in
49:52
this morning, saw about seven or eight. They didn't have anybody pulled over,
49:57
but they were there trying to get people to slow down. It's all
49:59
of safety shoe folks. But getting back to the numbers. On the Big
50:02
Blitz day on May twenty ninth, two hundred thirty six vehicles were stopped,
50:08
two thirty six on one day, two hundred and five citations were issued.
50:15
Ninety of those were for speeding. And remember the speed limit is fifty five
50:21
through there, not fifty nine or sixty, it's fifty five. There were
50:25
seven violations for driving on a suspended or revoked license. There were four other
50:32
misdemeanor arrests. No word exactly what those were. There were two DUIs as
50:38
part of that let's get drunk or smoke some weed and speed to a construction
50:44
zone. What could possibly go wrong? Like a fun day anyway. Total
50:51
on May twenty ninth, of two hundred and thirty six vehicles were stopped,
50:53
with two hundred and five citations issued for not just speeding, but as I
50:58
said, dui and other other assorted misdemean or so on and so for good

51:24
