Speaker 1: Now we turn to the Mountain Eagle to read news
0:04
from Whitesburg. Your reader today is Bill den Arsdale. We
0:09
will begin with the addition dated January fourteenth, twenty twenty six,
0:14
which the publishers have donated to RADIOI as a reminder.
0:19
Radiois a reading service intended for people who are blind
0:22
or have other disabilities that make it difficult to read
0:25
printed material. The first item is a photograph and the
0:29
caption is work progressing at Fleming Neon Library after being
0:35
closed since it was badly damaged by flooding in July
0:39
twenty twenty two. Reconstruction work is now underway on the
0:43
Fleming Neon Public Library, which is nearer to reopening. The
0:49
next story is co mayors will oversee Jenkins while mayor absent.
0:57
The Jenkins City Council has voted to install two co
1:01
mayors pro tem to make sure city projects don't get
1:05
paused or fall through the cracks after Mayor Todd de
1:10
Priest suffered a heart attack last week. De Priest is
1:14
recovering after a heart attack January seventh at his home.
1:19
An ambulance with a police and Fire department escort left
1:22
the downtown area around five pm last Wednesday evening. De
1:27
Priest was then flown to Pipeville Medical Center. Mary to
1:32
Priest recently suffered a heart attack and is currently recovering.
1:35
He is receiving excellent medical care and his condition is improving.
1:40
The statement issued by the city said, at this time,
1:44
mary to Priest is not receiving visitors. The family respectfully
1:49
asks for privacy as he focuses on his recovery. We
1:53
appreciate the community's thoughts, prayers, and continued support during this time.
2:00
The council held a special meeting January twelfth and voted
2:04
unanimously to appoint City Clerk April Moore and Finance Officer
2:09
Robin Kincer as mayor pro temporary while de Priest is recovering.
2:15
De Priest has been managing several multimillion dollar projects in
2:19
the city since the twenty twenty two flood, including preparations
2:24
for a three hundred home high ground subdivision, rebuilding the
2:28
city's sewer collection system, and extending water and sewer lines
2:33
to the proposed Raven Rock resort on top of Pound Gap.
2:38
The city just finished a renovation of City Hall, adding
2:42
an elevator and making the old office building handicapped accessible.
2:48
The council appointed Moore and Kincer to prevent any of
2:51
those projects from slipping through the cracks. They will have
2:55
the same authority as DePriest to manage the projects and
2:59
sign documents in his absence. De Priest is longtime Jenkins
3:04
volunteer firefighter, former Electric County Deputy sheriff, and former Jenkins
3:10
City manager. He took office as mayor of Jenkins in
3:14
twenty fifteen and is now in his third term. The
3:20
next story is grand jury declines to indict man charged
3:25
with threatening doctor. A grand jury declined to indict Electric
3:31
County man who had been arrested on charges that he
3:34
threatened to kill a Whichburg doctor and strangled his girlfriend,
3:38
who had notified the police about the threats. Richard Devon Wyatt,
3:43
twenty six of thirty five Olive Road, Little dry Fork
3:48
had been charged with one felony count of second degree
3:51
strangulation domestic and for one misdemeanor count of third degree
3:56
terroristic threatening for allegedly threatening to kill or seriously injured
4:01
doctor Shane McDougall on multiple different days from November twenty
4:06
fifth through December ninth. Grand jury proceedings are secret by law,
4:12
so the evidence presented to the grand jury is not known.
4:16
Authorities said Wyatt's girlfriend reported the threats to Whitesburg Police
4:20
Assistant Chief Justin Hunsucker, who obtained a warrant for Wyatt's arrest,
4:26
but Wyatt never made any threats directly to the doctor lecture.
4:31
Commonwealth's Attorney Matt Butler said he will not pursue the
4:34
charges after the grand jury's decision. He said, in cases
4:38
like this one where charges were filed in district court
4:42
prior to being presented to a grand jury, the district
4:45
charges lay dormant until they die on the vine. The
4:51
next headline is parent files suit after school ban. A
4:58
lecture counting parent as filed a federal lawsuit against the
5:02
Jenkins Independent School District alleging she was improperly banned from
5:07
school property and school sponsored events without due process. Elizabeth Jones,
5:14
a social media creator from Jenkins, filed the lawsuit in U. S.
5:18
District Court for the Eastern District of Kentucky in London.
5:22
Named as defendants are the Jenkins Independent School District, Superintendent
5:27
Damian Johnson, Assistant Superintendent Rondell Baker, all the members of
5:32
the Jenkins School Board, the school resource officer who delivered
5:36
the letter banning her, and the district's attorney. According to
5:42
the complaint, Jones is the parent of children enrolled in
5:45
the district and had regularly attended school activities and athletic
5:49
events prior to December twenty twenty five. She alleged that
5:55
on or about December seventeen, she was hand delivered a
5:59
letter dated December fifteenth informing her that she was banned
6:04
from all school property owned or leased by the district
6:08
and from all school sponsored activities. Jones, who filed her
6:13
lawsuit on January fifth, is represented by attorney Jennifer Tayor
6:18
of Belfry in Pike County. Attached as an exhibit to
6:22
her thirty two page complaint is a letter dated December fifteenth,
6:26
twenty twenty five, in which Jenkins's school board attorney, Timothy Crawford,
6:32
informed Elizabeth Jones that she was banned from all property
6:36
owned or leased by the school district and from all
6:39
school sponsored activities. Jones regularly attends basketball games and track
6:46
of hims in which her two middle school aged sons participate.
6:51
While at the games, Jones takes several photographs of players
6:55
in action and shares them in postings on Facebook. The
7:00
letter from school officials, however, says some of Jones's online
7:04
activities appear to be harassment and have caused disruptions to
7:09
the educational process in the school district. The letter says
7:13
the district is concerned for the safety and well being
7:17
of students, staff, visitors, and others who use school facilities
7:22
or attend district activities. It further warns that if Jones
7:27
is found on any district property or at any district
7:31
sponsored activity, she will be removed by law enforcement and
7:35
that the district will seek criminal trespass charges against her.
7:40
The letter does not specify which social media posts prompted
7:44
the ban, does not identify any individual students, does not
7:49
cite any school board policy or law allegedly violated, and
7:54
does not state whether the ban is temporary or permanent.
7:58
It also does not reference any pro by which the
8:00
band could be appealed or reviewed. The letter was signed
8:05
by Crawford in his capacity as school board attorney and
8:09
indicates that copies were provided to the superintendent, principals, and
8:14
school resource officers. It also includes a certificate of service
8:19
stating that the letter was hand delivered to Jones by
8:21
a school resource officer. While the school board did not
8:26
cite the incidents, it was referring to, parents posting online
8:31
have complained about pictures Jones has taken of their children
8:35
and comments they perceive as making fun of them. Among
8:40
those that raised the most anger among parents were comments
8:43
regarding a middle school basketball player from an opposing team
8:47
who has a mustache. Parents explained the boy is a
8:51
cancer survivor whose medication caused him to grow facial hair.
8:57
When parents complained online, she responded by calling them drama
9:02
queens spelled quee e e n s and telling them
9:08
they should get a participation trophy. Looks like he really
9:12
has some issues for such a contact sport. If he's
9:15
so fragile, should he be playing whow get a grip, dude?
9:20
Jones wrote. Jones claims in her lawsuit that the band
9:25
was imposed immediately, applied district wide, and does not state
9:29
whether it was temporary or permanent. She contends she was
9:33
given no prior notice, no hearing, and no opportunity to
9:37
respond before or after the band was imposed. She alleges
9:42
the band has prevented her from attending school events involving
9:45
her own children that remain open to other parents and
9:49
members of the public. Jones claims the district's actions violated
9:54
her rights under the First and fourteenth Amendments to the
9:57
US Constitution. She argued vius that her online speech occurred
10:02
off school property and is protected by the First Amendment,
10:06
and that the ban was imposed in retaliation for that speech.
10:11
She also alleges the district denied her due process by
10:15
excluding her from school property and events without providing notice
10:19
or an opportunity to be heard, and claims the ban
10:22
was overly broad and arbitrary. The lawsuit asks the court
10:28
to declare the ban unconstitutional, prohibit the district from enforcing it,
10:33
and require the school system to adopt procedures governing how
10:36
parents may be excluded from school property. Jones also seeks
10:41
monetary damages and attorneys fees. As of press time, no
10:46
response to the lawsuit had been filed in court. In
10:50
addition to Superintendent Johnson, Assistant Superintendent Banker, and the school
10:55
district itself, others named as defendants are School Resource Officer
11:00
Officer Alicia Conleton, and board members Chris Bentley, Paulette Sexton,
11:05
Sarah Brown, Charlotte Mullins, and Patrick Sturgel Crawford, the school
11:10
board's attorney, is also named as a defendant. The Jenkins
11:15
Independent Board of Education was expected to meet in special
11:18
session January thirteenth to hold a closed session for discussing
11:23
the suit. The next story is jury returns indictments in
11:30
theft sex abuse cases. An Indiana man arrested after allegedly
11:36
stealing Christmas packages from a vehicle on Main Street in
11:39
Weisburg has been indicted on one felony charge and two misdemeanors.
11:45
Weisburg City Police arrested Caleb Isaiah Ritchie, twenty of twelve
11:50
thirty Euclid Avenue, Marion, Indiana, on December twentieth, in an
11:55
unused basement space on Broadway. The grand jury has now
12:00
charged him with theft of mail matter, a felony, for
12:03
allegedly stealing packages from a UPS drop box in front
12:07
of the Letcher County Courthouse. He is also charged with
12:11
second degree criminal mischief for allegedly intentionally or wantonly damaging
12:16
property belonging to Pete Mason, and third degree criminal trespassing
12:22
for anningly, entering and staying in a building belonging to Childers,
12:26
an apparent reference to one of two buildings purchased by
12:29
Junior and Missy Childer's Matthews. Missy Matthews is chief executive
12:34
officer of Children's Oil. Police received the call the night
12:39
of December twentieth from Mason reporting someone was breaking into
12:43
his truck, where he had Christmas presents on the seat.
12:48
Police they saw a man running away and followed him
12:51
to the back door of an unused basement on Broadway. Inside,
12:56
officers say they found Richie stuffing packages into a space
13:00
between an air conditioning unit and the wall. Police arrested
13:04
him and allegedly found torn Christmas wrapping paper, a backpack,
13:09
and other items in the basement. Assistant Police Chief Justin
13:14
Hunsucker said at the time that Richie admitted to breaking
13:18
into the locked basement and that he had been squatting there.
13:22
He told the arresting officers that he had been selling
13:24
the packages to buy food to survive. A wood Rock
13:29
man was also indicted last week on a charge of
13:32
first degree sexual abuse. Kevin Lee Sloane, thirty nine of
13:38
five nine seven wood Rock Road. Blackie is accused of
13:41
subjecting a fourteen year old girl to sexual contact. It
13:46
is illegal for someone to have sex with a person
13:48
under sixteen years of age in Kentucky. Sloane is also
13:53
charged with being a first degree persistent felony offender, since
13:57
he has at least five previous convictions to dating back
14:00
to two thousand and six when he was nineteen years old.
14:05
Ritchie and Sloan were among six people named in five
14:09
indictments returned recently by the Letter County Grand Jury. The
14:13
indictments were presented to Letter Circuit Judge James W. Craft.
14:19
Joshua Milt Brock, thirty four of four hundred Daniels Branch, Whitesburg,
14:24
was named in two indictments. In the first, Brock was
14:28
charged with theft of services valued at more than one
14:31
thousand but less than ten thousand dollars and second degree
14:35
criminal mischief. The charges alleged that Brock removed a water
14:39
meter and bypassed it by straight piping the water device.
14:44
Jonathan Eisen testified in the case. In a second indictment,
14:49
Brock was charged with first degree possession of a controlled
14:52
substance methamphetemin first defense. Kentucky State Trooper David Banks testified
14:57
in the case. Rebecca Collins sixty eight of PO Box
15:03
eight four one pound, Virginia was charged with operating a
15:07
motor vehicle under the influence of a substance, first degree
15:11
possession of a control substance fentanyl, first degree possession of
15:15
a control substance methamphetamine, and buying or possessing drug Paraphernaliam
15:21
Kentucky State Trooper Chase Lucas testified in the case. Matthew
15:26
Fraser fifty one of five eight five Sergeant Road Whitesburg
15:31
was charged with first degree possession of a control substance,
15:35
Metham Fetterman, first defense, and possession of marijuana. Letcher County
15:40
Sheriff's Deputy Jackson Day testified in the case. Til This
15:44
Ray Smith sixty five of eight O one five Millard Highway,
15:49
Pikeville was charged with first degree possession of a controlled substance,
15:53
Metham Feteman, first defense, and third degree criminal trespassing. Kentucky
15:59
State Trooper Chase Lucas testified in the case. Indictments are
16:04
formal charges filed by a grand jury. They indicate that
16:08
a majority of the members of that jury believed there
16:11
is enough evidence to warrant holding a trial, but are
16:14
not an indication of guilt. The next story is candidates
16:21
running in May are listed. With the filing deadline for
16:26
the May primaries now closed, voters will have full ballots
16:30
to choose from. Few races are unopposed and one. The U. S.
16:36
Senate race has nineteen candidates registered, seven Democrats and twelve Republicans.
16:42
That race was left wide open when Senator Mitch McConnell
16:45
announced he would not run. The race includes several familiar names,
16:51
with some running for a second time and others who
16:54
hold other offices currently or have run in other races
16:58
and lost taking another stab at it. Below is a

21:36
Jenkins High School will turn back the clock and celebrate
21:39
generations of Cavalier pride on Saturday, January seventeenth, when the
21:45
school hosts one of the Glory Road Heritage Games organized
21:49
by the Kentucky High School Basketball Hall of Fame. The
21:53
event will recognize Jenkins High School's historic gymnasium and its
21:58
role in shaping the rich tradition of Kentucky high school basketball.
22:02
The Cavaliers will welcome longtime rivals Buckhorn High School for
22:07
both girls and boys contests, with Buckhorn competing under the
22:11
historic name of Witherspoon High School in honor of the
22:15
region's basketball heritage. The roar of the crowd, the squeak
22:20
of sneakers on the hardwood, and the unmistakable spirit of
22:23
green and White are returning to the mountains, said Ashley Addington,
22:28
athletics director at Jenkins High School. We are officially inviting
22:32
all alumni of Jenkins High School to join us for
22:36
a historic night as we celebrate our heritage at the

22:44
about far more than wins and losses. This isn't just
22:48
another game on the schedule. It's a tribute to the
22:51
generations of athletes and fans who have worn the jay
22:55
with pride, she said. We are calling on every former player,
22:59
cheero leader, band member, and student to fill the stands
23:03
once more. The Glory Road Heritage Games Project highlights gymnasiums
23:09

26:39
will be celebrated where it has always lived, on the hardwood,
26:43
in the stands, and in the hearts of Cavalier fans
26:47
past and present. Our next story is Gabby's Fishing Fever
26:53
by Greg Gabby Caudle. Changes in weather affect how fish bite.
27:00
There are some things in the sport of fishing that
27:03
are always going to be affected by Mother Nature, things
27:06
that are in control of the Good Lord, like changes
27:08
in the weather. At this time of year and in
27:12
early spring, the weather changes can be very sudden and drastic.
27:16
A good example is the weather we've had here recently.
27:19
Last week, we had a very nice, warm week with
27:22
temperatures reaching the low seventies. We were even using the
27:26
air conditioner in the car. But as I write this,
27:29
the temperature has dropped to the freezing mark and we've
27:31
had snow. These changes in the weather have a big
27:36
effect on fishing this time of year because this is
27:39
when the biggest temperature changes can happen. The key to
27:42
finding the best times to go fishing is to understand
27:46
how a cold front or a warming trend makes the
27:48
fishing better. When a cold front arrives you will have
27:52
a big drop in temperature on the first day of
27:54
the front. However, you can tell the drop is coming
27:57
a few days in advance. During the day leading up
28:00
to the arrival of the front. Fish can sense this
28:04
and will feed more actively before the colder temperatures hit.
28:08
When you're fishing during a warming trend, over several days
28:12
around the third day of the warm up will bring
28:14
with it the best fishing as the feeding activity picks
28:18
back up. So if you're fishing during a cold front
28:22
or a warming trend, use these tips for your best
28:25
chance to find heating fish. And this concludes the reading
28:31
of the Mountain Eagle. Your reader has been Bilvin Arsdale.
28:36
Now please stay tuned for continued programming on behalf of
28:40
everyone here at Radio I. Thank you for listening and
28:43
have a good day.
