- 0:00Speaker 1: Now we turn to the reading of the Hazard Herald
- 0:02News of Hazzard in Perry County um Lee Townshend. We
- 0:06begin with the online vission dated December tenth, twenty twenty five.
- 0:12As a reminder, radioized a reading service intended for people
- 0:15who are blind or have other disabilities that make it
- 0:18difficult to read printed material. Hazard takes first step toward
- 0:24repealing restaurant tacks. The Hazard City Commission has taken the
- 0:28first step toward repealing its three percent restaurant tax. In
- 0:32a special meeting December fifth, the Commission held first reading
- 0:36of an ordinance to repeal the tacks, even as it
- 0:40continues to appeal court decisions that declared that because of
- 0:43the city's classification, it could not collect it. The second
- 0:49reading in a vote on the repeal, is expected to
- 0:52be undertaken during the city city's next meeting, except for
- 0:56December fifteenth. In twenty twenty four, the city approved implementing
- 1:01the tax, the proceeds of which were originally intended to
- 1:04fund the Hazard Perry County Tourism Commission, and it took
- 1:08effect on January one. However, the move was contested even
- 1:12before the City of Hazard undertook the effort to enact it.
- 1:16In twenty fifteen, legislation signed into law by the previous
- 1:21year by then Governor Steve Basheer fixed the classification of
- 1:25cities this effect of the tacks. Hazard under the law
- 1:30was not one of those cities that was able to
- 1:33do attacks. In twenty twenty three, Hazard challenged the classification
- 1:38in Franklin Circuit Court and was ultimately successful in getting
- 1:42a judgment that fixed its classification in such a way
- 1:46that it would be allowed to access the tacks. However,
- 1:49that ruling was challenged by Attorney General Russell Coleman before
- 1:53the Kentucky Court of Appeals. The Court of Appeals issued
- 1:56an opinion in October remanding the case by the Franklin
- 2:00Circuit Court for dismissal. In the opinion, the Court of
- 2:04Appeals wrote that in rendering his decision, Franklin Circuit Court
- 2:09Judge Philip Shephard overstepped the balance of the court. All
- 2:13parties acknowledged that Hazard has been misclassified, the opinion said,
- 2:18but that error does not grant the judicial branch the
- 2:21authority to do what only the General Assembly can do
- 2:24under the eighteen ninety one Constitution. The opinion said, the
- 2:29law is not the problem, but the problem is the
- 2:32failure of the General Assembly and Hazard to correct the
- 2:35classification issue until the taxation issue arose. Hazard has been
- 2:41misclassified for decades and never had the authority to enact
- 2:45the tax. The opinion said, it never sought to have
- 2:48their designation corrected. Had it done so prior to twenty fourteen,
- 2:53it would have had the ability to levy the tax
- 2:56that now wishes to enact. It's not arbitrary for the
- 3:00legislature to keep the pool of cities allowed to enact
- 3:03this tax the same as it was when it decided
- 3:06to change the classification system. In the opinion, the Court
- 3:11of Appeals also expressed his concern over Hazard's decision to
- 3:16collect the tax, despite the Court warning the city prior
- 3:20to the tax as the enactment that it would be
- 3:22doing so at its own peril. We're particularly troubled by
- 3:26the decision by Hazard to enact the tax during this litigation.
- 3:30The Court of Appeals October opinion said, Hazard was given
- 3:34fair notice and our order entered on September seventh, twenty
- 3:39twenty four we warned Hazard that it could enact the
- 3:43tax at its own peril. Sadly, upon any finality of
- 3:47this case, a lack of authority to impose attacks may
- 3:51present difficult questions of proper remedy. Hazard City Manager Tony
- 3:57Eversol said that the Tourism Commission is currently holding the
- 4:01tax proceeds collected in an escrow account. Penning the outcome
- 4:05of the court case. Eversoul said, the city hopes it
- 4:08will ultimately be able to assess the tax. We still
- 4:12feel it's good, we still feel it's needed, Eversoul said,
- 4:16adding the intent is to allow the community's tourism industry
- 4:20to compete with others around it that are using the tax.
- 4:24The idea behind the tax, he said, is that the
- 4:26city can fund tourism initiatives through an option means, as
- 4:31opposed to a tax that is not you don't have
- 4:35to pay it if you don't want to, Eversol said.
- 4:38The Hazard City Commission's next meeting it's set for seven
- 4:41thirty pm on December fifteenth. Elf On the Town Giveaway
- 4:47ending soon, The Hazard Herald will be giving away two
- 4:50hundred and fifty dollars as part of the elf On

- 5:11want a fun Christmas promotion that the whole family could
- 5:15have fun with, and who does not like extra cash
- 5:18at Christmas time? She said, Everyone likes our Easter Egg contests,
- 5:22so we model ELF on the town after it. This
- 5:26is easier. There are no clues that build on each other.
- 5:31There's no going from place to place trying to find
- 5:33the clues. They are in plain sight and not hidden
- 5:37within the businesses. She said. Each ELF sign has a
- 5:40QR code to be scanned in order to upload and
- 5:43register the pictures. However, pictures are selfies with all ten
- 5:47clues are a requirement. Once we have ten pictures from participants,
- 5:51their names will be entered into a random drawing to
- 5:54choose a winner. Ferguson said local businesses participating in the
- 5:59Hazard Harold Elf on the Town Christmas Cash giveaway are
- 6:04ready set. Play Toy Store, Kentucky Farm Bureau, Janet Smith,
- 6:09Coal Country, Campbells, Threads of Love, Merle Norman, East Main
- 6:14Street Pharmacy, Kentucky River Finance, Complete Care, Pharmacy, Belcher in Bordeaux,
- 6:21and Dion's. The deadline for entries is December sixteenth. HPD
- 6:28holds Shop with a Cop at Walmart. Twenty students from
- 6:31Hazard Independent spent Tuesday morning, December ninth, shopping alongside officers
- 6:36from the Hazard Police Department as part of the department's
- 6:40annual Shop with the Cop program at Walmart. Each child
- 6:43received one hundred and fifty dollars to spend on items
- 6:46of their choice through a collaboration with Walmart, which provides
- 6:50a free McDonald's breakfast for the students upon arrival. Funding
- 6:55for the effort included in the HPD's annual budget. According
- 6:59to HPD E chief Zach Miller, the department has a
- 7:02long history of supporting families during the holidays. We've been
- 7:06here for fifteen years and we're always We've done something
- 7:10in some type of Christmas event every year, said Miller.
- 7:13In the past, we did Santa with a Badge and
- 7:16the public would drop off toys and clothes and we
- 7:19would rap and deliver them. We transition to Shop with
- 7:23a Cop within the last couple of years, Miller said.
- 7:27The program carries meaning beyond the shopping trip itself. Events
- 7:31like this are important. Miller said. It's important because typically
- 7:35if these kids have an interaction with the police, it's
- 7:38normally a bad day or a bad experience or event
- 7:41in their lives. He said, creating a positive experience can
- 7:45help re shape how students view law enforcement. We do
- 7:49this to make a positive impact on them and show
- 7:51them a different side of the police. He said. Some
- 7:54of these kids can be inspired by this and it
- 7:57can plant that seed that maybe grows into them wanting
- 8:00to become an officer of the law one day, so
- 8:03they too can help positively impact people. Investigation into crash
- 8:09involving Post thirteen cruiser ongoing KSP says by Justin Begley,
- 8:15the investigation into a crash in not County involving a
- 8:18Kentucky State Police Post thirteen cruiser is ongoing. According to
- 8:23a statement from KSP Post thirteen, at approximately five to
- 8:27nineteen pm on December second, the post was notified of
- 8:31a two vehicle crash on Kentucky eighty at Hyman. Troopers
- 8:35and medical personnel responded, the statement said, and the preliminary
- 8:39investigation indeed indicated that a marked KSP Patrol vehicle being
- 8:44driven by Anthony Versaglia was intransit from Post thirteen to
- 8:49his garage for vehicle maintenance. The statement said the cruiser
- 8:55was traveling eastbound when the front mumper struck the rear
- 8:58bumper of a passenger car that was traveling eastbound operated
- 9:03by Deborah Wallen. According to the statement, Wallin said a
- 9:06juvenile passenger was also transported to Hazard ARH to be
- 9:11treated for possible minor injuries. Versaglia was not injured as
- 9:15a result of the collision, the statement said. On December fourth,
- 9:19KSP Post thirteen spokesman Trooper Matt Gayheart said the investigation
- 9:24into the crash is ongoing. There's a full investigation going
- 9:28on and the accidents being reconstructed. He said more information
- 9:33will be released down the road and will be made available.
- 9:36The collision is being worked by Colt Stumbo, with a
- 9:39full reconstruction being done by Detective Scott Caudle. It's not
- 9:44uncommon for Versaglia, a retired KSP Commercial Vehicle Enforcement officer,
- 9:49to be driving cruisers, according to Gayheart. Versaglia works for
- 9:54US as a contractors a mechanic. Said Gayheart, he's a
- 9:57retired commercial Vehicle Enforcement officer. In his duties, he oftentimes
- 10:02comes and gets cruisers and takes them to his garage,
- 10:05does routine maintenance on them, and brings them back. In
- 10:10the days following the crash, the family of the injured
- 10:12occupants expressed concerns about both the extent of the injuries
- 10:17and the response after the accident. Alicia Hall, daughter of
- 10:21Deborah Wallen and mother of the juvenile passenger, said her
- 10:25family is still dealing with the aftermath. Hall, who arrived
- 10:29on the scene and photographed damage to her mother's vehicle,
- 10:33said her mother's injuries are far more serious than initially
- 10:36believed when she was discharged. Apple Hazard arh sent my
- 10:42mother home with three broken ribs, three small places broken
- 10:46in her back, a concussion, and fluid around her heart.
- 10:50Hal said, we asked KSP for a rental car to
- 10:53be able to take my mother and daughter to upcoming
- 10:56doctor's appointments, and I was told they never had anything
- 11:00like that happened before, and they weren't sure if they
- 11:02could or not. I had them going to another doctor.
- 11:07Hall added that her daughter has also been struggling emotionally
- 11:11since the collision. My daughter is having nightmares from this,
- 11:14and we still can't find my daughter's glasses from the accident,
- 11:18she said. Hal said the crash has had a significant
- 11:23impact on both her mother and daughter, emphasizing that neither
- 11:26of them had any control over what happened, and praised
- 11:29the response from KSP investigators. They didn't ask for this,
- 11:34she said. Mom wasn't going forty five miles an hour
- 11:38and the other driver was going over ninety. But I
- 11:40have to say that Sergeant Colt Stumbo and Detective Scott
- 11:44Caudle have been very helpful. They stayed and held my
- 11:48daughter's hand while they were cutting them out of the car.
- 11:52The Art Alliance brings A Christmas Story the Musical to
- 11:55the Forum. Amid to many holiday events taking place across

- 12:10twelfth through fourteenth at the Hall Rogers Forum. Creative lead

- 12:23the region. In this community performance, a cast of forty
- 12:27five local adults and children come together to bring this

- 12:39by joining Ralphie and his family as they take you
- 12:42back to that memorable Christmas in the nineteen forties. Cox
- 12:46added that the show is made possible through strong local collaboration.

- 13:24its twenty sixth event December sixth, featuring music and dancing
- 13:28with food and cocktails catered by a Big Blue Smokehouse.
- 13:32Organizers said the fundraiser was a great success with a
- 13:35sold out event. A heartfelt thank you to our wonderful sponsors, supporters,
- 13:40and vendors who make this event such a joy joyful
- 13:44celebration each year, said Vettery Betsy Clemos, executive director of
- 13:49the Hazard Pirie County Chamber of Commerce. Your generosity helped
- 13:54us to raise funds for CASSA and the Dolly Parton
- 13:57Imagination Library support children and families in our community. From
- 14:04the opinion page, the column tis the Jeff Vanderback. I
- 14:10haven't been in the spirit of the season lately, through
- 14:13no fault of my own, after a series of unfortunate
- 14:16circumstances and the pressure of the season to perform. I'm
- 14:20almost ready for January. After Halloween and the season to
- 14:24give thanks Christmas comes way too soon. There's no time
- 14:28to catch up. Let's also not forget that property taxes
- 14:32are due by the end of the year, just when
- 14:34money's already tight. I wish Jesus were born in June,
- 14:38nicer weather and the gifts we bring could be vacation
- 14:41related grills, coolers filled with beverages, etc. But I guess
- 14:46that's asking too much of Mother Mary, so I'll just
- 14:49let it be. The unfortunate circumstances of mine started in
- 14:55Saint Louis last week. As we were visiting family for Thanksgiving.
- 15:00Late Wednesday evening, a black cat ran across the parking lot,
- 15:04and my wife said that was bad luck. I was
- 15:07in total denial until I hit the curb with her
- 15:10brand new car and jocked up the wheel and tire
- 15:14in sub freezing temperatures. On Thanksgiving Day, I needed to
- 15:17find an air hose because the tire was leaking air.
- 15:21I wasn't sure if the leak was from the scrape
- 15:23rim or the flapping rubber on the sidewall of the tire.
- 15:27I was damn determined to fix my faux pas. I
- 15:30pumped up the tire and the genius in me decided
- 15:33that I needed to repair the flapping piece of rubber.
- 15:36So naturally, I used gorilla glue to adhere the rubber
- 15:39back to the sidewall. What could possibly go wrong? On
- 15:44Black Friday, I sat in a car dealership in Saint
- 15:47Louis at seven thirty am, first one there, waiting for
- 15:51the service department to arrive so they could address my issue.
- 15:55The service deck was very understanding and compassionate to my
- 15:58circumstances and ensure me that he would fix the issue
- 16:02so I could make it back to eastern Kentucky. As
- 16:05he was running his hand over the glued tirewall. He
- 16:08asked what had happened. I told him about the gorilla glue,
- 16:11and he said that won't stop a leak. I said
- 16:14he was probably right, and I did that for the
- 16:17same reason why I sing in the shower, because it
- 16:20made me feel better. It may not work, but in
- 16:24my discombobulated minds thinking I felt better. Needless to say,
- 16:29I'm back safely, much to the sagrant of many, I'm sure.
- 16:33The next set of circumstances was Black Friday, which I
- 16:36missed because of my tire escapades, so my stress level increased.
- 16:41Shop Small Saturday, I was snowed in as Saint Louis
- 16:45got nine inches missed out. Cyber Monday was a bust
- 16:50and giving Tuesday almost past. I've ventured up to broke
- 16:54Wednesday and cut up the credit card Thursday Friday. I
- 16:57may be changing my identity. All that said, I had
- 17:01to remember why we celebrate. On our news feed, I
- 17:05saw a Christmas celebration that was performed at Pike Bull
- 17:08Medical Center. They had a big tree. Local students, Saint
- 17:12Carrol's and luminarias were placed around the tree in recognition
- 17:17of organ donors that did it for me. I actually slowed.
- 17:21Speaker 2: Down and realized that while the world is a mess
- 17:24and things don't always go my way, there is a
- 17:27reason to celebrate. I, like many people, often overlook reality
- 17:32and that in life everything will eventually work out.
- 17:37Speaker 1: We all go through challenging financial times, in business, or
- 17:41with our health, even black cats. We can't control others,
- 17:45just ourselves, and when life gets out of hand, and
- 17:48when we least expect it, you find the help and
- 17:51support you need. I say the definition of serendipity is
- 17:57looking for a needle in a haystack and finding the
- 17:59farmer's life was my haystack, and PMC was the farmer's daughter.
- 18:05I found comfort when I least expected it. This season
- 18:09celebrates your life and your family and friends, and as always,
- 18:13thanks for reading The Hazard Hero. Second verse same as
- 18:18the first by rus Cassaday. Here we go again. As
- 18:22someone once said, history doesn't repeat itself, but it often rives.
- 18:27The Hawks initial plans for the war didn't fully work out.
- 18:30They didn't get American boots on the ground in Ukraine
- 18:33or Gaza, so I guess it's all to the next. However,
- 18:37the next potential target for the US war machines, apparently Venezuela,
- 18:41and I think the administration of Donald Trump needs to
- 18:44consider something as they try to determine where American boys
- 18:48and girls will die for oyal or defense contractor profits.
- 18:52When I was growing up in the waning days of
- 18:54the Cold War, we had a real enemy, Russia that
- 18:58was scary as a child, the opportunity to worry on
- 19:01a regular basis about the very real possibility of nuclear annihilation.
- 19:07Of course, the possibility is still there, but you've got
- 19:10to learn to move on at some point. I guess Venzuela,
- 19:14though I don't exactly get a chill up my spine
- 19:17thinking about the possibility of Venezuela conducting an effective, amphibious
- 19:22landing on some Gulf coast beach. More likely they would
- 19:28be met by confused but unimpressed terrorists seeking a respite
- 19:31from cold to climes wondering how they're going to afford
- 19:35their southern vacation. That's the thing about agenda war. It
- 19:39has to have some bogeyman behind it, the big bad
- 19:42that makes the idea of sending American sons and daughters
- 19:46to die in foreign lands more palatable. Vietnam had its
- 19:51creeping cap communism, our misadventures in the Middle East had
- 19:56things like weapons of mass destruction or terror as driving force.
- 20:01So what the administration, especially Secretary of State Little Marco Rubio, Hey,
- 20:06the President's words, not mine, has landed on its war
- 20:11on drugs and hard drugs are undoubtedly a massive problem.
- 20:16The cemeteries and recovery facilities will tell you that story.
- 20:20But you can't tell an Appalachian that all of the
- 20:23most dangerous drug dealers live outside the continental US. I
- 20:28don't recall the military targeting the Cycler family's yachts. So
- 20:33why Venzuela really? I mean, I'm not going to say
- 20:37with one hundred percent certainty that it's because Venzuela holds
- 20:40the world's largest proven oil reserves. There's also the fact
- 20:45that it holds a whole lot of land mass where
- 20:48we can deploy and fire all the toys that keep
- 20:50the executives at Lockheed Martin, Northrop Grumming, General Dynamics, and Boeing,
- 20:56among the others, fed with cash. Makes the market hum happily.
- 21:02So I'd say that for many it's a win win.
- 21:06I'll tell you who a war invens Awela won't benefit
- 21:09the same people. War never benefits the low income and
- 21:12middle income people on both sides, as well as those
- 21:16who we expect to fight and sacrifice their lives in
- 21:19the seemingly endless conflicts. Back in boy Scouts, we used
- 21:24to sing goofy songs about the campfire, and many of
- 21:27them featured a bridge between the repetitive verses that also
- 21:31intended to make the sing along gradually get more unhinged
- 21:35as it went along. Second verse, same as the first,
- 21:39A little bit louder, a little bit worse, eventually leading
- 21:42to something like third verse, same as the first, A
- 21:45whole lot louder and a whole lot worse. History may
- 21:49not repeat, but it certainly rides, and when it comes
- 21:52to war, it gradually gets worse. Here are of the obituaries.
