- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to dive right back in to
- 0:05Speaker 1: day number three of the Tyler Robinson prelim hearing and
- 0:09Speaker 1: the transcript. And once again, the prosecution is asking the questions. Question.
- 0:17Speaker 1: Agent Davis, who are we seeing here? Answer. That's Tyler Robinson. Question.
- 0:22Speaker 1: Although we're watching it on video, what is he wearing
- 0:24Speaker 1: at this time? Answer. He's wearing a dark colored baseball cap.
- 0:28Speaker 1: I believe it's like maybe The Hurley symbol on it?
- 0:31Speaker 1: Like a white symbol in front. It's a burgundy short-sleeved
- 0:34Speaker 1: shirt with no graphics. It's blue jeans and gray and
- 0:38Speaker 1: white tennis shoes. I believe they're Converse-style tennis shoes. Question,
- 0:42Speaker 1: thank you. Was Mr. Robinson, you stated, that he was
- 0:45Speaker 1: arrested in the early hours of September 12th. Is that right? Answer, yes,
- 0:49Speaker 1: that's correct. Question, did he remain in Washington County Sheriff's
- 0:53Speaker 1: Office or was he taken somewhere else? Answer, no, he
- 0:56Speaker 1: was transported from there to the Utah County Jail. Question.
- 1:00Speaker 1: Prior to being transported to the Utah County Jail, was any,
- 1:03Speaker 1: I guess, personal property taken from him? Clothing, anything like that? Answer.
- 1:08Speaker 1: So prior to our arriving to the St. George, to
- 1:11Speaker 1: the Washington County Sheriff's Office, his cell phone was seized
- 1:14Speaker 1: and taken from his person. But that was the only
- 1:17Speaker 1: thing that was taken from him at the time. Question.
- 1:20Speaker 1: After he was transported to Utah County Jail, were there
- 1:23Speaker 1: any personal items taken from him? Answer. Yes, there were. Question.
- 1:27Speaker 1: And what were those? Answer. After a search warrant was granted,
- 1:31Speaker 1: his clothing was recovered, along with bugle swabs to collect
- 1:34Speaker 1: his DNA, and major case prints, which is fingerprints, palm prints,
- 1:39Speaker 1: pretty much the entire hand. Those were all collected from him. Question, sorry,
- 1:44Speaker 1: you may have stated already, what time, when did he
- 1:47Speaker 1: arrive in Utah County? Answer, we arrived at the Utah
- 1:51Speaker 1: County Jail about 7 a.m. on the 12th of September,
- 1:55Speaker 1: September 12th, and he was formally booked in about 8 a.m.,
- 1:59Speaker 1: of that morning. And then I was with the booking officer. Question,
- 2:04Speaker 1: what does it mean to be the booking officer? Answer,
- 2:08Speaker 1: I filled out the necessary paperwork essentially with the jail,
- 2:11Speaker 1: which gives the individual personal identification of the charges, the
- 2:15Speaker 1: probable cause statement, and then it's signed and submitted to
- 2:18Speaker 1: the system. Question, all right, I want to talk a
- 2:21Speaker 1: bit about search warrants, some of the search warrants that
- 2:24Speaker 1: were executed in the case as part of the investigation.
- 2:27Speaker 1: There were search warrants obtained specifically for areas in southern Utah. Answer. Yes,
- 2:33Speaker 1: there were. Question. And obviously, do not give me an
- 2:36Speaker 1: exact address, but generally from what locations? Answer. It was
- 2:40Speaker 1: the residence of Tyler Robinson and the residence of his parents. Question.
- 2:44Speaker 1: Were those warrants executed? Answer. They were. Question. By whom? Answer.
- 2:49Speaker 1: The residence of Tyler Robinson was a team led by
- 2:52Speaker 1: Sergeant Fulmina with SBI along with Utah State Crime Lab.
- 2:56Speaker 1: and the residence of his parents was a team led
- 2:58Speaker 1: by the FBI, their evidence response team. Question, are you
- 3:03Speaker 1: aware of what date or dates, if applicable, those warrants
- 3:06Speaker 1: were executed? Answer, yes. September 12th, I believe, Tyler's residence,
- 3:11Speaker 1: they started the search warrant about 8 in the morning.
- 3:13Speaker 1: And then his parents' residence, they started about 4 p.m.
- 3:17Speaker 1: of September 12th. Question, so to be clear, you've stated
- 3:21Speaker 1: he was involved in executing those warrants. Were you physically present?
- 3:25Speaker 1: For the execution of either of those warrants? Answer. No,
- 3:29Speaker 1: I was not. Question. Are you aware of whether Mr.
- 3:31Speaker 1: Robinson lived with anyone else at the residence at the time? Answer. Yes. Question.
- 3:37Speaker 1: Do you know who that was? Answer. Lance Twiggs. Question.
- 3:41Speaker 1: And we won't get into that too much right now.
- 3:43Speaker 1: We'll cover this with Sergeant Fomina. But did you receive
- 3:46Speaker 1: information from the officers involved in those execution of those warrants?
- 3:50Speaker 1: About what, if anything, had been found? Answer. Yes, I did. Question.
- 3:54Speaker 1: All right. Turning to another area, as part of this investigation,
- 3:58Speaker 1: you have previously mentioned that a family friend came in
- 4:01Speaker 1: initially with the Robinsons. Who was that family friend? Answer,
- 4:05Speaker 1: his name was Mike Mitchell. Question, and who is he
- 4:08Speaker 1: in relation to the Robinsons? Answer, so he's a family friend,
- 4:12Speaker 1: a good family friend. Question, and what was his involvement here? Answer,
- 4:17Speaker 1: so he helped facilitate working with Tyler and his parents
- 4:21Speaker 1: with the sheriff's department for Tyler to turn himself in. Question,
- 4:24Speaker 1: And I believe you mentioned previously that law enforcement conducted
- 4:27Speaker 1: an interview with Mr. Mitchell. Answer, they did. Question, remind
- 4:32Speaker 1: us when that interview occurred. Answer, so that was the
- 4:36Speaker 1: early morning hours of September 12th at the Washington County
- 4:39Speaker 1: Sheriff's Department. Question, and I know you've already stated, but
- 4:43Speaker 1: remind me, who was present for that interview? Answer, that
- 4:47Speaker 1: one was Agent Terry and Agent Smith. Question, and what
- 4:51Speaker 1: agencies are they with? Answer, Terry is with S.B.I. and
- 4:54Speaker 1: Smith is with F.B.I. Question, are you aware if any
- 4:58Speaker 1: second interaction or statement was collected from Mr. Mitchell? Answer,
- 5:02Speaker 1: yes it was. Question, when did that happen? Answer, it
- 5:06Speaker 1: was March 31st of this year. Question, who was present
- 5:09Speaker 1: at the time? Answer, it was Ryan McBride, Chad Grunender,
- 5:14Speaker 1: Kimberly Durfler, and Agent Chris Terry with S.B.I. Question, you
- 5:20Speaker 1: mentioned Ryan McBride, Chad Grunender, and Kimberly Durfler. What office
- 5:25Speaker 1: did they work for? Answer, the Utah County's Attorney's Office. Question,
- 5:30Speaker 1: and you mentioned Agent Chris Terry. Answer, yes. Question, so
- 5:34Speaker 1: you were not present for this collection of this statement? Answer, no,
- 5:37Speaker 1: I was not. Question, have you communicated with Agent Chris
- 5:41Speaker 1: Terry about how this happened? Answer, yes, I have. Question,
- 5:45Speaker 1: how did this happen? Answer, so all those individuals met
- 5:49Speaker 1: with Mike Mitchell? It was the St. George, well, it
- 5:52Speaker 1: was at the St. George courthouse there. They met and
- 5:55Speaker 1: they discussed briefly, just kind of talked generally about the situation.
- 5:59Speaker 1: From there, Mr. Mitchell was given a handwritten 1102 paper
- 6:03Speaker 1: statement and he left the room, went into a separate
- 6:05Speaker 1: office by himself, was there for about an hour where
- 6:08Speaker 1: he hand wrote a statement, filled the statement out. When
- 6:12Speaker 1: that was complete, he came back into the room where
- 6:14Speaker 1: the others were waiting and and provided that 1102 statement
- 6:17Speaker 1: to them. Question. We've heard quite a bit about 1102 statements.
- 6:22Speaker 1: Sounds like there's an official form that's used. What's present
- 6:26Speaker 1: on that form if you know? Answer. There is an
- 6:29Speaker 1: admission or warning given on those forms that states that
- 6:32Speaker 1: the information you're giving is true and accurate to the
- 6:35Speaker 1: best of your knowledge. That any false statement that is
- 6:38Speaker 1: given or may be given would be punishable by a
- 6:41Speaker 1: Class A misdemeanor. Question. Aside from that being written on
- 6:46Speaker 1: the form, are you aware if this admonition was discussed
- 6:49Speaker 1: with Mr. Mitchell? Answer, yes, it was. Question, do you
- 6:53Speaker 1: know by whom? Answer, yeah, Ryan McBride provided that admonition
- 6:57Speaker 1: to him. Question, and you stated that Mr. Mitchell then
- 7:01Speaker 1: went into a separate room for about an hour and
- 7:04Speaker 1: wrote his statement down? Answer, correct. Question, did anyone, including
- 7:08Speaker 1: prosecutors or law enforcement, direct him what to say? This
- 7:12Speaker 1: draws an objection from the defense. Foundation. Objection. Personal knowledge.
- 7:18Speaker 1: Judge Graff, would you like to respond, Prosecution? Prosecution. I
- 7:22Speaker 1: can lay a little more foundation. Judge Graff, alright, so
- 7:25Speaker 1: I'll sustain the objection for now. Ms. Hunt is moving
- 7:29Speaker 1: forward with laying more foundation. Question. You discussed with Agent Terry,
- 7:34Speaker 1: Chris Terry, about how this statement was obtained. Answer. Yes. Question. No.
- 7:39Speaker 1: Did he mention anything to you about anyone directing Mr.
- 7:42Speaker 1: Mitchell about what to say or what to include in
- 7:44Speaker 1: the form? Answer. No, I spoke to him personally and
- 7:47Speaker 1: reviewed his report also. Question. I'm going to show you
- 7:50Speaker 1: what's been marked for identification as State Exhibit 14.1. Let
- 7:55Speaker 1: me know when you see that on your screen. Answer. Okay,
- 7:58Speaker 1: I see it. Question. What is it? Answer. This is
- 8:01Speaker 1: the written 1102 statement that was provided by Mr. Mike Mitchell.
- 8:07Speaker 1: Now another objection. From the defense, Your Honor, may I
- 8:10Speaker 1: have a minute with Ms. Hunt for the same purpose?
- 8:13Speaker 1: Judge Graff, yes, you may. Question, and how do you
- 8:18Speaker 1: know that? Answer, I'll review it. I reviewed it in
- 8:22Speaker 1: its original as soon as it came to us. I've
- 8:24Speaker 1: seen it prior. Question, Kimberly, if I can have you
- 8:28Speaker 1: slowly scroll down. Sorry, Judge, if I can just have
- 8:31Speaker 1: a moment. So they get to where they're trying to
- 8:34Speaker 1: get to. And prosecution says, once again, so if we
- 8:37Speaker 1: can place that again on the screen for the witness only. Defense,
- 8:42Speaker 1: same exhibit. Answer, yes, sorry. We'd been scrolling through that.
- 8:45Speaker 1: Do you recognize that? Answer, by the agent, I do. Question,
- 8:49Speaker 1: by prosecution. Is it fair and accurate from what you remember? Answer, yeah.
- 8:54Speaker 1: With the exception of the redactions, yes, it's fair and accurate. Prosecution, judge,
- 8:58Speaker 1: I'll make a record. Defense counsel and I have stipulated
- 9:01Speaker 1: on the redactions that are present. I would move for
- 9:04Speaker 1: its admission. states Exhibit 14 into evidence, but we do
- 9:08Speaker 1: not wish to publish it either to the courtroom gallery
- 9:10Speaker 1: or to the cameras. Judge Graff, all right, could I
- 9:13Speaker 1: have a copy of it? What I have is the
- 9:15Speaker 1: unredacted version, so I want to review it before I
- 9:18Speaker 1: make a decision. Prosecution, may I approach? Judge Graff, you may,
- 9:22Speaker 1: thank you. Judge Graff, all right, I've had a chance
- 9:25Speaker 1: to review State Exhibit 14 and noting the standing objections
- 9:29Speaker 1: by the defense concerning 1102, the court accepts into evidence
- 9:33Speaker 1: State Exhibit 14 And pursuant to the parties, it's not published. Prosecution,
- 9:38Speaker 1: thank you, Judge. All right. I want to move on
- 9:40Speaker 1: to another topic. You've stated that you've been present for
- 9:44Speaker 1: the duration as the case agent of the prelim hearing.
- 9:46Speaker 1: Is that right? Answer, yes. Question, we heard testimony yesterday
- 9:51Speaker 1: about turning to the scene at UVU on September 10th
- 9:55Speaker 1: that a bullet was found on a roof. Do you
- 9:57Speaker 1: remember that testimony? Answer, yes, I do. Question, do you
- 10:00Speaker 1: have any knowledge about the bullet? What that's about? Answer, yes,
- 10:04Speaker 1: I do. Question, what roof was the bullet found on? Answer,
- 10:08Speaker 1: I believe it was, well, it was found on the
- 10:10Speaker 1: computer science building on the roof on the far east
- 10:13Speaker 1: side of the roof of the building itself. Question, how
- 10:16Speaker 1: do you know it was found there? Answer, I reviewed
- 10:18Speaker 1: the agent's report, that found that, documented it, and collected it. Question,
- 10:23Speaker 1: what agent was that? Answer, it was Agent Ben Snyder
- 10:27Speaker 1: with SBI. Question, are you aware of the computer science
- 10:31Speaker 1: building is on campus? Answer, yes. Question, can you explain
- 10:35Speaker 1: generally where it's located? Answer, yeah. From the Losey building.
- 10:39Speaker 1: Is it's a building directly kind of south and east
- 10:42Speaker 1: of there? From the Losey. Question, southeast of the Losey building.
- 10:47Speaker 1: Where is it in connection to the auditorium section that
- 10:50Speaker 1: we've been talking about where Mr. Kirk was stationed? Answer,
- 10:53Speaker 1: it's east of there. East and a little bit south. Yeah,
- 10:56Speaker 1: mostly east. Question, from that roof of the computer science building,
- 10:59Speaker 1: to your knowledge, would there have been a line of
- 11:01Speaker 1: sight to Mr. Kirk's tent? Answer, no, not according to
- 11:05Speaker 1: the agent, Agent Ben Snyder. There was not a line
- 11:08Speaker 1: of sight from there to where the tent was, where Mr.
- 11:11Speaker 1: Kirk was. Question, did you learn from Agent Snyder what
- 11:15Speaker 1: caliber the bullet was? Answer, yes, I did. Question, and
- 11:18Speaker 1: what was that? Answer, it was a. 223 caliber. Question,
- 11:22Speaker 1: was it a live round? Answer, it's a round that
- 11:25Speaker 1: had not been fired, so it still had the projectile,
- 11:27Speaker 1: and it was fully functional ammunition with a bullet. Question,
- 11:31Speaker 1: did you learn if this. 223 bullet found on top
- 11:34Speaker 1: of the computer science building was a live round? Answer, yes. Question,
- 11:38Speaker 1: and how do you know that? Answer, it was still intact.
- 11:41Speaker 1: The primer had not been. It was not dented up
- 11:43Speaker 1: and fired. It had the bullet projectile. on the end
- 11:46Speaker 1: and still sealed. Question, did you observe this bullet personally,
- 11:50Speaker 1: or is this information you're getting from Agent Snyder? Answer,
- 11:53Speaker 1: from Agent Snyder. All right, folks, we're going to wrap
- 11:56Speaker 1: up right here, and in the next episode dealing with
- 11:58Speaker 1: a topic we're going to pick up where we left off.
- 12:01Speaker 1: All the information that goes with this episode can be
- 12:03Speaker 1: found in the description box.
