- 0:09Five minutes past the hour. It's Friday on the Morning Show with Preston Scott
- 0:15Show five thirty six. Good morning, I'm Preston. That's Grant Allen.
- 0:19Great to be with you on the Friday, October twenty seventh edition of the
- 0:24program, and I'm thrilled as always to have back with us. Lee Williams,
- 0:28aka the gun Writer. His work can be found at the Gunwriter dot
- 0:32substack dot com. It's as simple as that, and you will get information
- 0:37that is really helpful, some great reporting, some great writing, and some
- 0:43really heady opinion stuff. Lee, good morning, welcome back. How are
- 0:46you. Thanks, appreciate the inviting and it is good to be bad Lee.
- 0:52Obviously a tragedy. I can't help but notice it was, you know,
- 0:56pretty obvious after some thought that what happened in Maine again and gun free
- 1:00zones. Maine has pretty good gun laws in terms of open carrying all that,
- 1:04But it seems pretty intentional that this guy went to places where they're serving
- 1:10alcohol and ergo, you're not supposed to have a firearm, right, Yeah,
- 1:14that seems to be part of his plan. The thing that concerns me
- 1:17most about him is that scope on his rifle is thermal preston, so he
- 1:23has night fighting capabilities, probably better than law enforcement. It's a huge concern.
- 1:32What about the I mean, they're calling it red flags, the mental
- 1:36health issues on this one. Should the guy have had firearms? And I
- 1:41look, you and I both know if he wanted to commit the crime,
- 1:44it wouldn't matter if he turned in or had his guns confiscated or not.
- 1:48Yeah, I see that as kind of a misnomer. You know, if
- 1:53they red flagg him or yellow flag them, which they do in Maine,
- 1:56right, he would have gotten his gun somewhere else. Ciminal and you can't
- 2:01legislate away evil. This guy was probably had these guns for years before he
- 2:07suffered obvious type of breakdown. This then points me to you know, I
- 2:14said that yesterday on the air that now I don't frequent bars. It's not
- 2:19the type of place that I go with my wife. But that said,
- 2:23if I were in a place like that, I would be carrying. It
- 2:25doesn't matter what it says, because I'll take my chances defending my life and
- 2:30that of my family or friends, and I'll deal with the consequences if somebody
- 2:35walks in and starts shooting yeah, we have. We're challenging one of the
- 2:38laws here in Florida that prevents you from carrying in a tavern a place that
- 2:44does not sell food because of brew And you have to look at the historical
- 2:47context of the law and you can't find any founding era statute that prevented guys
- 2:54from carrying a firearm into a bar or from having intoxicating liquor in the firearm.
- 3:01So that law in Florida is going to be challenged. I'm totally with
- 3:05you. I carry everywhere I go, regardless of some sign that may or
- 3:08may not be on the building. Yeah, and that's I think. You
- 3:13know, we do a personal defense segment twice a month here on the program
- 3:15with guys that run arranged law enforcement for their careers, and we talk about
- 3:21situational awareness all the time, and it just breaks my heart that in these
- 3:25two locations there was nobody prepared to try to stop it. No, and
- 3:31that is so sad. I mean, you have to be situationally where you
- 3:36have to be switched on and you have to carry. I mean, don't
- 3:38leave your home, don't leave your kate without your club. One of my
- 3:42buddies always says, yeah, some law or some sign on a building should
- 3:46not put you in a position where you are defenseless as these people were at
- 3:52It still bugs the hell out of you watching that. You know they had
- 3:55no defense other than to run. What is you that? Yeah? What
- 4:00is your inclination on how this ends? Is this guy gonna die by cop?
- 4:04Is he going to die by self? Or is he going to be
- 4:08caught alive? They're going to kill him. They sent in the four tech
- 4:13unit from Customs and Border Protection. These are the guys that got the guy
- 4:17in PA who escaped, and these are the guys that actually went into the
- 4:20school in Umbalde and took out the bad guy after he'd been in there for
- 4:25more than an hour. It's a pretty good at pretty elite unit, and
- 4:28they specialize in hunting guys in the bush, and we know that's where this
- 4:32guy is. Unfortunately, that thermal is going to give him the upper hand.
- 4:38You are listening to the M A D Radio Network. You're challenged to
- 4:42make a difference each and every day. Good morning, and welcome to the
- 4:46Morning Show with Preston Scott. Eleven minutes past subscribe you will get great art
- 5:00coles sent to your email box the gun writer dot substack dot com and you
- 5:06can support the work of Lee Williams, who is our guest this morning.
- 5:10Lee explain to our listeners, just give us just the short version of the
- 5:14backstory. Who's Russell Fincher and how is it that a guy named JJ Humphrey
- 5:19is now involved. Russell Fincher lives in a small town in Oklahoma. He's
- 5:25a full time high school teacher, a full time Baptist minister, and a
- 5:29part time gun salesman. Atf rated his home in June and they sent us
- 5:33twelve man swat tea put him in cuffs in front of his thirteen year old
- 5:38kid, even though he fully complied with everything the agents wanted, yelled and
- 5:42screamed until he quote unquote voluntarily rescinded his federal firearms license. Then they cut
- 5:49off his cameras. They took fifty of his guns and they still have him.
- 5:55Then they later they offered him ten dollars per gun. They're about sixty
- 5:59thousand dollars worth of guns. They denied him any kind of due process or
- 6:01anything, violated multiple civil rights. Well, he's got a very good lawmaker
- 6:08who oversees that district. Oklahoma State Rep. JJ Humphrey, and JJ is
- 6:13one of those guys who never shuts off. He's a great man. He's
- 6:16going to see that these ATF agents are charged with multiple state crimes as well
- 6:21as civil rights violations. He's prepared and probable cause affidavit. He's pushing for
- 6:27a grand jury to investigate ATF. What has to happen for a grand jury
- 6:31to be convened in the state of Oklahoma and for this to have some legs,
- 6:36well, pretty much, JJ has to happen. He's already gone for
- 6:41the Attorney General. The Attorney General tried to pass it over to the US
- 6:45Attorney General, and JJ's got a gaggle of other lawmakers who are going to
- 6:48tell the AG now, we want this to be a state grand jury.
- 6:53We don't want the FEDS investigating the FEDS. This is going to be a
- 6:57There are all state crimes, and I see this being a very bad day
- 7:01for ATF. I spoke to the agent briefly who was in charge of the
- 7:05raid and asked him what he thought about the likelihood he could be charged with
- 7:10crimes, and he immediately ended the interview. Really as he hung up the
- 7:15phone, this is the end. Of the interview, he said, and
- 7:18it went click. But yeah, they're looking at extortion, obtaining the signature
- 7:25by extortion, extortion under the color of official right, making, terroristic threats,
- 7:30hampering or disabling security or surveillance camera. And he's going to add theft
- 7:34felony, theft for all the guns they took. I think inside your story
- 7:40on the update, you mentioned something that special Agent Theodore Mongol or Mongel told
- 7:46Fincher during the raid, tell all your FFL buddies were coming for them.
- 7:53Yeah, that's a pretty terroristic threat and that's a felony in Oklahoma. I
- 7:59think you really going to regret running his mouth. JJ is not going to
- 8:03shut off. He comes across this kind of country, but he's been a
- 8:07cop there for thirty years and a rancher and he's worked in the doc The
- 8:11Hell of a Lawmaker. Read his complaint we have we have a link to
- 8:15it in the story. He wrote a great problem cause affidavit. I think
- 8:18this is going to be a real bad day for ATF And you know it's
- 8:22about time. And oh, by the way, State Representative Justin J.
- 8:26J. Humphrey wear's a cowboy hat while presiding in office. Thank you very
- 8:31much, and a bolo give us just a short version the broad picture.
- 8:39The ATF is basically doing this systematically across the country. They are they're doing
- 8:46it like it's cool. They have increased the FFL revocations by five since before
- 8:50Joe Biden got into office. And there later today, I'm talking to a
- 8:56dealer in South Carolina who is just shut down thirty years of selling guns for
- 9:01clerical reasons. They went back eight years and his paperwork and he found some
- 9:05clerical issues. I mean I's and Te's not Bottigan Cross, and they worced
- 9:09him out of business. So it's happening every day. Joe Biden believes no
- 9:15gun dealers, no guns. So that's they've gone to war against the gun
- 9:20dealers. And thereby uh WSLA on your phone with the iHeart radio app and
- 9:24on hundreds of devices like Alexa, Google Home, Xbox and Sonos. Hey,
- 9:30so here we go and Iheart's radio station. Here's the headline, judge,
- 9:43you have a choice, your husband or your guns. No, I'm
- 9:48not making that up. Story Lee Williams, the gun writer, has covered
- 9:54Lee. What's the story. That's amazing. I still people wouldn't believe it.
- 9:58At first, you have a gentleman sixty year old guy fell off at
- 10:03dot truck years ago, got addicted to pain pills. You know, Florida
- 10:09cracked down on prescription painkillers made it more difficult to get so he went to
- 10:13some street drugs. Last in twenty twenty two, he had a crisis,
- 10:18put a couple of rounds in his neighbor's house, shot their blue Mercury montigo,
- 10:24which I'm not is even a crime. Police were called, they arrested
- 10:31him, and he went through the legal process. They realized prosecutors realized he
- 10:35had an addiction. Okay, so they sentenced him to ten years of probation,
- 10:39but that could be cut in half if you'd go through treatment, attend
- 10:43AA or NA because they found cocaine in the system. Then the judge in
- 10:48open court tells him, you can't have any guns in your home whatsoever.
- 10:54And his wife was sitting next to him, and she made kind of a
- 10:56face like, what are you talking about? Because she has she has firearms,
- 11:01and she has a Florida Concealed Weapon or of firearm license and she wants
- 11:07to continue caring for her safety. So the judge called her up, swore
- 11:11her in Okay, swore her in she's not a defendant in the case whatsoever,
- 11:16and told and just, I mean literally told her you have a choice.
- 11:20You have your fire you can have your firearms or your husband. And
- 11:24if she hadn't agreed to it, her husband wouldn't have walked out of that
- 11:28courtroom. He would have gone to prison. Uh So I raised holy hell
- 11:31about this, and the judge actually sent a statement, you know, said
- 11:39confirming what he said that uh he she cannot have guns in her home.
- 11:45I mean, clearly violated her Second Amendment rights. She's scared to go pick
- 11:48him up brother. She doesn't want her husband and to go to jail.
- 11:52This is circuit Judge Shannon McPhee, And I got to tell you, I've
- 11:58never seen such an agree just act from anybody wearing the black robe on the
- 12:03bench. I mean, yeah, he's a convicted fellow. But there are
- 12:05ways around this this happens. You can have their son bottom is safe with
- 12:09one key, not a combination lock. One key that she could maintain,
- 12:13she could retain and that would satisfy Florida law. What what are the options
- 12:22available to her to get this overturned? Well, she's hooked up with an
- 12:28attorney, and the attorney's going to have to go into the courtroom and have
- 12:31a hearing on this and tell the judge, look, you're basically violating this
- 12:35woman's civil rights. You have violated her Second Amendment rights and probably her fifth
- 12:39too, so that way she can pick up the guns. There's a couple
- 12:41of guns there too that are very highly collectible on an early cold nineteen eleven.
- 12:46But more importantly, her guns are there, and their son's guns are
- 12:50there. He's a Navy veteran who never did anything wrong, wasn't even home
- 12:54with this when this happened. So yeah, this, Shannon McPhee, Judge
- 13:00Shammer McFee is nuts. I've never seen anything like this in an open court.
- 13:05I expected him to deny it. I never said that, but no,
- 13:09he doubled down on it, actually doubled down on it. Yeah.
- 13:13I mean, he can't say he didn't say it because it's it's recorded by
- 13:16the court reporter, right. But I'm curious. You know, we hear
- 13:22the term judicial temperament. You know, as a judge you can't react,
- 13:26and it sounds like this guy just snapped and reacted, thought about it,
- 13:30and then said Yeah, that's exactly what I meant. Well, you know,
- 13:33you hear about these activist judges. This is way beyond that. This
- 13:39is him stripping this poor woman of her Second Amendment rights in an open courtroom
- 13:43and not caring at all about what he did. So, I you know,
- 13:48I hope the people down there keep us in mind in South Florida when
- 13:54this judge is up for retention. I this is clearly an unconstitutional order.
- 14:00Does this I guess the process is he gets a chance to say, all
- 14:05right, yeah, you're right, I made a mistake and reverse his ruling,
- 14:09or this heads to the appellate level in the state, doesn't it.
- 14:13Yeah. You know, I'm on the board of Florida Carry so we've got
- 14:16one of our general counsel, Eric Friday, he's looking into this. He's
- 14:20one of the best Second Amendment slash gun rates attorneys in the state and he
- 14:26specializes in the firearm law. I mean, he said the judge went too
- 14:30far. It's just a matter of getting this quick because every second those guns
- 14:35spend in the sheriff's office custody, you know, they could be lost or
- 14:39stolen or damaged. Let's put it that way. Yeah, no, kidding
- 14:43all right, Lee, as always, thank you very much for your time
- 14:46and because of the holidays, we'll be off November December. We'll be back
- 14:50in January. Thank you, sir, see you then, thank you all
- 14:54right, Lee Williams and again it's the gun Writer dot substat dot com.
