- 8:54Speaker 5: was melted melted but welcome to let's talk about it
- 9:00Speaker 5: i am your host jeanette johnson i am happy to
- 9:03Speaker 5: be back this is my second season on the crew
- 9:09Speaker 5: podcast and the first season i was working through it
- 9:16Speaker 5: i had to work through my um jitters on tonight
- 9:20Speaker 5: me and Cornell will be going, taking a look inside
- 9:24Speaker 5: of TDCJ, which is Texas. We're gonna go inside of there.
- 9:31Speaker 5: We've been getting quite a few complaints and stuff about
- 9:41Speaker 5: what's going on inside of the prison system over there
- 9:46Speaker 5: in Texas. But until Cornell call, and we also, also Mr.
- 9:56Speaker 5: Legate will be joining us as well. because he has
- 10:02Speaker 5: some things that he had to talk about, about what's
- 10:05Speaker 5: going on where he's at. He's also in a state of.
- 10:59Speaker 6: Oh, I am?
- 11:01Speaker 5: I'm just sitting up here just like... Well, good evening, everyone.
- 11:06Speaker 5: I do apologize for my tardiness. I was in class
- 11:10Speaker 5: and I had to switch everything over. So tonight... Well,
- 11:17Speaker 5: let me go back. This month is Wrongful Conviction Month.
- 11:25Speaker 5: They celebrate They started it on October 2nd, I believe,
- 11:34Speaker 5: where they're bringing awareness to what's going on about the
- 11:41Speaker 5: wrongful convictions. As we also know that the number one
- 11:51Speaker 5: ethnic group that's been wrongfully convicted is the African. It's
- 11:58Speaker 5: the black man. It's the black man. Followed by the
- 12:08Speaker 5: Hispanics and so on down the line. But let's talk.
- 12:18Speaker 5: I was waiting on Mr. Legate to call me because
- 12:21Speaker 5: we wanted to just check in with him. to see
- 12:26Speaker 5: how everything's processing with him. But I can tell you
- 12:33Speaker 5: about a couple of things about my husband, Juan Johnson,
- 12:42Speaker 5: who's over there in Denver, Colorado. He is in the
- 12:47Speaker 5: final stage with the Innocent Project. So they're right now
- 12:51Speaker 5: writing everything up. and getting ready to submit it on
- 12:56Speaker 5: his behalf. So we're just saying prayerful that, you know,
- 13:03Speaker 5: everything works out and we get that date for him
- 13:08Speaker 5: or be waiting at the gate, get the call, you know,
- 13:11Speaker 5: waiting at the gate for him to come walking up
- 13:14Speaker 5: out of the prison. So we just waiting on that.
- 13:18Speaker 5: Also coming out of Denver, You know, like I said,
- 13:23Speaker 5: that this month is wrongful conviction month. We had, it
- 13:27Speaker 5: was a lady, she was on trial. Her name is
- 13:32Speaker 5: Missy Woods. She was a DNA analyst. And she did over, oh,
- 13:46Speaker 5: she had did quite a few cases One of the
- 13:49Speaker 5: cases we know for sure that she worked on was
- 13:53Speaker 5: Glenn Kemp. As you can remember, Glenn Kemp was sentenced
- 13:57Speaker 5: to life in prison with the possibility of parole and
- 14:03Speaker 5: also 199 years added on to that sentence for something
- 14:11Speaker 5: that he didn't even do. So Missy Woods... Her assistants
- 14:22Speaker 5: actually told, rung into the forefront, what she has been doing.
- 14:29Speaker 5: She was manipulating the DNA, the samples, and men and
- 14:36Speaker 5: women was going to jail, and they was getting life sentences,
- 14:43Speaker 5: shaking baby syndrome, and it wasn't true. So they constantly,
- 14:49Speaker 5: they're in there still fighting for their freedom. She went
- 14:53Speaker 5: to court and she was found guilty on, I believe
- 14:59Speaker 5: they said a hundred charges or something. And she, I
- 15:07Speaker 5: forgot the sentence that they was, that she was looking at,
- 15:11Speaker 5: but in June, was it June? I don't know. I
- 15:16Speaker 5: want to say July. She was sentenced. She was sentenced.
- 15:28Speaker 5: To 10 years. 10 years. For falsifying DNA. Over 100 cases.
- 15:42Speaker 5: And do you not know. That. not one of them
- 15:47Speaker 5: means that she falsified um dna samples are out they're
- 15:57Speaker 5: looking at their cases but they haven't given them lawyers
- 16:03Speaker 5: they haven't given them updates uh what's going on um
- 16:08Speaker 5: with them with their cases that she worked on so
- 16:14Speaker 5: it looked like glenn is going to have to pay
- 16:20Speaker 5: for a lawyer for something that he'd been sent for,
- 16:23Speaker 5: I believe Glenn been in prison for over 30 plus years.
- 16:32Speaker 5: Within that time, his parents died. All his siblings has
- 16:40Speaker 5: passed away. Glenn is the only one besides his children
- 16:46Speaker 5: that are left. He lost a lot. Not only did
- 16:53Speaker 5: Glenn lose his family, his mother, siblings, and aunts and uncles,
- 17:02Speaker 5: and he lost his freedom. He lost over 30 plus
- 17:08Speaker 5: years wrongfully. And he's still sitting in prison To this day,
- 17:17Speaker 5: he's fighting for his freedom. He just had back surgery
- 17:24Speaker 5: two months ago. And so his health is failing him,
- 17:33Speaker 5: but yet he's fighting. He's fighting to come home. We
- 17:39Speaker 5: had Eugene, Gilbert, he got, he had got, what was that?
- 17:52Speaker 5: He had got clemency in May. In May, he got
- 17:58Speaker 5: clemency in May. Instead of them giving him like a
- 18:07Speaker 5: date to come home soon, they gave the governor a,
- 18:13Speaker 5: gave his date for next year. Eugene was bitten by
- 18:21Speaker 5: a spider and he went into the hospital. They did
- 18:26Speaker 5: surgery on his leg. The doctor went too deep. Just
- 18:34Speaker 5: messed him up. Eugene passed away in August. In August.
- 18:51Speaker 5: In August. So when they gave him a life sentence,
- 18:55Speaker 5: they literally gave him a life sentence. Because that's the
- 19:00Speaker 5: way he came. He came out in a body bag.
- 19:07Speaker 5: And that was devastating to his family. I know his
- 19:12Speaker 5: family personally. And I talked to his sister and I
- 19:18Speaker 5: met his children. He did 34 years. But yet and
- 19:29Speaker 5: still you have a lady that falsified these samples, DNA samples,
- 19:40Speaker 5: to hundreds of cases. And you guys let her, they
- 19:45Speaker 5: let her retire. They let her retire. before her trial.
- 19:52Speaker 5: She retired. So, you know, she got her money, which
- 19:58Speaker 5: wasn't fair. And to only get 10 years. Here you
- 20:06Speaker 5: have one man that you worked on his case. Got
- 20:12Speaker 5: life with the possibility plus 199 years on top of that.
- 20:18Speaker 5: And then you have Eugene Gilbert who got clemency and
- 20:30Speaker 5: didn't even make it home. And people want to know
- 20:37Speaker 5: Why we talk about wrongful convictions. You know, they want
- 20:41Speaker 5: to sweep it up under the rug. We can't do that.
- 20:48Speaker 5: Look what they're doing to our Carmelo Anthony over there. Wrongfully.
- 20:54Speaker 5: You can't even defend yourself. You can't. Without going to prison.
- 21:07Speaker 5: I asked me and my husband, we was talking and
- 21:13Speaker 5: I asked him, I said, why is no relief? Why
- 21:20Speaker 5: do you think that they really don't investigate these claims
- 21:32Speaker 5: when these men said They're innocent. They really don't go
- 21:36Speaker 5: in depth with the investigation. And he said that they
- 21:44Speaker 5: just want to take away their youth. And want to
- 21:47Speaker 5: make sure that they can't have a life. The only
- 21:55Speaker 5: life they're going to get is when they come out,
- 22:06Speaker 5: you know, and they got to relearn and some of
- 22:08Speaker 5: them are all up in ages and, you know, 60
- 22:11Speaker 5: and 70 years old. They don't got, they don't got
- 22:14Speaker 5: they wear out of them. Moving, you know, free, free,
- 22:21Speaker 5: free labor. And then you have a, I believe it
- 22:27Speaker 5: was a, was it a sheriff or judge or something
- 22:30Speaker 5: over in Florida that said, you know, Now they want
- 22:34Speaker 5: them younger. They got a lot of work for you
- 22:38Speaker 5: to do. And they don't care if you're innocent or not,
- 22:43Speaker 5: which is not fair. You know, people just, I mean,
- 22:50Speaker 5: what are you really concerned of? I see on some
- 22:55Speaker 5: of these Facebook pages and stuff, you know, the whys
- 22:59Speaker 5: and stuff. I follow a lot of those. they only
- 23:04Speaker 5: worried about one thing, the states that don't have conjugal
- 23:08Speaker 5: visits or they want to pass a petition around. And
- 23:17Speaker 5: you know, and I asked them like, when you want
- 23:20Speaker 5: to get your husband home, if he's, you said that
- 23:24Speaker 5: he's innocent of these charges, when you want to fight
- 23:30Speaker 5: to get him home instead of passing around a petition
- 23:35Speaker 5: for conjugal visits. You know, I don't understand that. I
- 23:46Speaker 5: don't understand that mindset. And that's why sometimes, you know,
- 23:54Speaker 5: sometimes that's one, a couple of the reasons why you
- 23:59Speaker 5: guys haven't been seeing me, um, on live and Angela
- 24:06Speaker 5: just running tapes and stuff. I'm trying to get myself
- 24:12Speaker 5: right because when you read their cases and you see
- 24:15Speaker 5: the injustice, it overwhelms you. And then when you see
- 24:21Speaker 5: what they're doing to the young, our young men, our
- 24:27Speaker 5: young men, It overwhelms you. We have to.
- 24:47Speaker 5: We can't let this go up under the rugs no more.
- 24:50Speaker 5: We have to start in juvenile courts. Them judges are
- 25:00Speaker 5: voted in. And I know that some of you guys
- 25:07Speaker 5: are not voting. I know you probably just getting the
- 25:12Speaker 5: pamphlet and probably just throwing it in the trash instead
- 25:17Speaker 5: of doing your researches. And then when stuff like this happen,
- 25:23Speaker 5: when our young men are locked up wrongfully or profiled,
- 25:35Speaker 5: Then we want to say something. But we got to
- 25:44Speaker 5: keep using our voice. We got to keep speaking up.
- 25:50Speaker 5: You know, two weeks ago, I was on my way
- 25:55Speaker 5: to work. And I work at night. And the windows
- 26:02Speaker 5: on my car is tinted. But you know, they're not
- 26:09Speaker 5: the real dark tint, but they're tint. If the lights hit,
- 26:13Speaker 5: you can see inside my car. They're not the real
- 26:17Speaker 5: dark tint, but they tint it. And so, you know,
- 26:21Speaker 5: I'm going alone. I'm on the phone talking to my husband.
- 26:25Speaker 5: You know, I ain't touch my phone or anything. My
- 26:28Speaker 5: hair is... I'm getting my hair locked. It's locking up.
- 26:34Speaker 5: And so... The way she got the way the loctician
- 26:40Speaker 5: did my hair, it's like she just put all the
- 26:44Speaker 5: locks together and put them to the back. It don't
- 26:49Speaker 5: bother me, no, because, you know, hey, I'm just going
- 26:53Speaker 5: to work. And I see these, I see this car, like,
- 27:00Speaker 5: kind of, like it was passing me. But then it stopped.
- 27:05Speaker 5: As soon as I passed it, it dropped behind me. So,
- 27:10Speaker 5: you know, I'm watching it and stuff to see, you know,
- 27:13Speaker 5: see what's going on. Like, hey, what's going on? Next
- 27:17Speaker 5: thing I know, I get the lights through on me.
- 27:22Speaker 5: Them blue and reds. Pull over. I pull over to
- 27:31Speaker 5: a safe spot where... I made, I don't just pull,
- 27:35Speaker 5: it's going to be lit up where I pull over
- 27:39Speaker 5: because I want people to see you not finished taking
- 27:43Speaker 5: me off nowhere. And I took the keys out the ignition,
- 27:50Speaker 5: put them on the dashboard without any of them. You know,
- 27:55Speaker 5: I raised down all my windows. So as he walking up,
- 28:00Speaker 5: he can see what's in my, what's in my car.
- 28:03Speaker 5: And when he walked up and he's looking and when
- 28:08Speaker 5: he realized that I was a female, he started stuttering. Oh,
- 28:20Speaker 5: how you doing? How are you doing this evening, ma'am? And, um,
- 28:27Speaker 5: I said, I'm doing well. I'm just headed off to work.
- 28:31Speaker 5: And he said, you know, that something about a taillight
- 28:40Speaker 5: or something. But my taillights was everything on my car work.
- 28:51Speaker 5: And that incident right there, of course, he let me go.
- 28:58Speaker 5: That incident right there, it threw my whole night. Because
- 29:06Speaker 5: I'm like, why? You said a taillight. My taillights is working. No,
- 29:16Speaker 5: you pulled me over because you wanted to see who
- 29:19Speaker 5: was in my car. You wanted to know who exactly,
- 29:23Speaker 5: you know, the way my hair is braided back. That's
- 29:26Speaker 5: the only thing I can think of. And that's what
- 29:28Speaker 5: I told my husband. I said, he didn't have no
- 29:30Speaker 5: reason to pull me over. It's just been passing and
- 29:35Speaker 5: the whole little scene how he came up on the
- 29:39Speaker 5: side of me. and he looked and he just fell back.
- 29:43Speaker 5: He just fell back behind me, let me pass him.
- 29:46Speaker 5: And then he just got him. I feel that, you know,
- 29:49Speaker 5: he was profiling. And that really threw my night. But
- 30:04Speaker 5: yet and still, I didn't give him no calls, no
- 30:09Speaker 5: nothing to do anything. I didn't talk smart to him
- 30:11Speaker 5: or anything. I just like, hey, okay, sir. Yes, sir.
- 30:15Speaker 5: All right. Because my main thing was just to get
- 30:19Speaker 5: to work. That's all I was doing was just going
- 30:22Speaker 5: to work, minding my business. But now I see. what
- 30:30Speaker 5: our young men, our brown and black men go through.
- 30:35Speaker 5: I see it. I see the harassments. Going, driving down
- 30:45Speaker 5: the street, I see it. I see how the homeless
- 30:50Speaker 5: men be out there and they harass the homeless people.
- 31:08Speaker 5: When are we going to wake up? When are we
- 31:15Speaker 5: going to come together and stop fighting each other? Stop
- 31:24Speaker 5: looking at skin color. Because we all fight in the
- 31:30Speaker 5: same fight. The injustice is Hispanics wrongfully convicted. I spoke
- 31:41Speaker 5: to some. It's Caucasians that's wrongfully convicted. I spoke to some.
- 31:49Speaker 5: They called me just to check in. And some of
- 32:01Speaker 5: them are fighting and they fighting Mr. Legate is fighting.
- 32:11Speaker 5: And sometimes our last conversation, he was just like, sis,
- 32:16Speaker 5: I just, I just feel like giving up. And, you know,
- 32:20Speaker 5: I tell him, keep going. You know, his mom, he,
- 32:27Speaker 5: he says mom getting old, older, and she's have dementia.
- 32:32Speaker 5: He's writing, he's reaching out to, to people and, you know,
- 32:38Speaker 5: Want people to look at his documentary. The documentary is
- 32:41Speaker 5: up on YouTube. It's been up there for some years.
- 32:49Speaker 5: A news reporter did a whole documentary on Mr. Legate
- 32:54Speaker 5: and found evidence that can prove his innocence. But they
- 32:59Speaker 5: won't look into his case. And he was like, I
- 33:07Speaker 5: don't know what to do. I don't know what to do, sis.
- 33:11Speaker 5: That's what he said. I don't know what to do.
- 33:14Speaker 5: Wrongfully convicted. He's at work. Repo man. Just doing his job.
- 33:25Speaker 5: No gunshot residue on him, on his hands. No nothing.
- 33:34Speaker 5: But he hadn't stilled. Mr. James Legate sits in Texas prison.
- 33:45Speaker 5: And I believe he said it been, I want to
- 33:50Speaker 5: say 25 years. It was 25 years in August that
- 33:56Speaker 5: he been sitting in prison for something he didn't do.
- 34:08Speaker 5: Something he didn't do. His daughter passed away a couple
- 34:12Speaker 5: of years ago. And he talks about her to me.
- 34:17Speaker 5: And he says she was his only hope. She pushed
- 34:24Speaker 5: him to keep going. If someone out there, if you
- 34:33Speaker 5: guys know someone That can help Mr. Legate. Please reach
- 34:40Speaker 5: out to me. Or Angela. And we'll give you his information.
- 34:47Speaker 5: He'd be more than happy to talk to you. His
- 34:52Speaker 5: story has not changed. If you look at his documentary.
- 34:58Speaker 5: And go back and listen to what he had. When
- 35:01Speaker 5: he was on a show with me. When Angela and
- 35:04Speaker 5: I and Carnell. His story remains the same. It has
- 35:11Speaker 5: not changed. But they did find a man that said
- 35:18Speaker 5: that supposedly he was supposed to have been there, but
- 35:22Speaker 5: they found him over in Mexico. That can prove his innocence,
- 35:30Speaker 5: but they won't have him come back. So he sits.
- 35:42Speaker 5: So he sits. Well, you know, I got homework to do.
- 35:52Speaker 5: And it don't look like Mr. Legate is going to call.
- 35:56Speaker 5: I know he said in his letter that the month

- 36:55Speaker 5: complaining about the air, you know, the facility not having air, um,
- 37:00Speaker 5: clean water. They had, Someone donated bottles of water to
- 37:06Speaker 5: the inmates, and they don't even get to buy the water.
- 37:09Speaker 5: The COs get the water. So, you know, it's a
