0:01
Speaker 1: Now we turn to the Mountain Eagle to read news
0:04
from Whitesburg. Your reader today is Bill den Arsdale. We
0:09
will begin with the edition dated May twentieth, twenty twenty six,
0:13
which the publishers have donated to RADIOI as a reminder.
0:18
RADIOI is a reading service intended for people who are
0:21
blind or have other disabilities that make it difficult to
0:24
read printed material. The first headline is Steins ordered to
0:31
attend court hearing June fifth. A judge has ordered former
0:37
Letcher County Sheriff Sean Mickey Steins to appear in person
0:41
on June fifth for a status report on his murder case. Steins,
0:47
who has been in the Leslie County jail since September nineteen,
0:50
twenty twenty four, is charged in the murder of Leccher
0:54
District Judge Kevin R.
0:55
Speaker 2: Mullins.
0:57
Speaker 1: Video showed Stein's shoot Mullins multiple time times in the
1:00
judges chambers. He was arrested a few minutes later and
1:04
charged with murder. Special Lectcher Circuit Judge Christopher Koran issued
1:10
the order for a status conference last week. Stein's will
1:14
be taken out of the Leslie County Jail and transported
1:17
to the Leslie County District courtroom for the hearing set
1:20
for ten am on June fifth. The judge will also
1:24
consider all pending motions at that hearing. Steins's attorneys in
1:30
December asked that Koran recused himself from the case the
1:34
morning he was supposed to begin a bond hearing and
1:36
status conference for Stein's I filed a motion with the
1:40
Supreme Court of Kentucky, but the court ruled it was
1:43
up to Koran to make that decision himself. Koran declined
1:47
to accuse himself, and Stein's attorneys appealed again. Deputy Chief
1:53
Justice Robert Connolly rejected the appeal, which was based solely
1:57
on the fact that both Koran and Mullens were members
2:00
of a seventy five member judicial Commission on Mental Health,
2:03
and both attended a meeting of the commission two weeks
2:06
before Mullins was murdered. The facts, as alleged simply do
2:10
not support a conclusion that a reasonable person would question
2:14
Judge Koran's impartiality, Colly wrote. He wrote that Stein's defense
2:20
is free to appeal after a final judgment is entered.
2:24
The hearing on June fifth will take up all motions
2:27
that are still pending, likely including the question of bond
2:31
and requests that the judge release a metal health report
2:34
on Stein's. Additional motions may be filed prior to the hearing.
2:41
The next story is Jenkins bitcoin mine at center of
2:46
fifty one point five million dollar fight. A foreign owned
2:52
cryptocurrency company has asked a federal judge to enforce a
2:56
fifty one point five million dollar arbitration award against a
3:01
bitcoin mining operation in Lectric County, according to a petition
3:05
filed earlier this month in U. S. District Court in Louisville.
3:10
HBT Power Limited filed a petition May eleventh in U. S.
3:15
District Court for the Western District of Kentucky asking the
3:19
court to confirm a final arbitration award entered April thirteenth
3:24
against Mohawk Energy LLC, a Jenkins based crypto mining company
3:30
owned by Kentucky State Senator Brandon Smith, Republican from Hazard.
3:35
The dispute centers on a large scale bitcoin mining operation
3:40
at Gateway Industrial Park in Jenkins, where Mohawk Energy announced
3:44
in twenty twenty three that it planned to employ hundreds
3:48
of workers in blockchain processing, electronics repair, and related technology work.
3:56
HBT Power a bitcoin mining company tied to Hong Kong
4:00
and British Virgin Islands Entities, claims Mohawk Energy breached a
4:04
licensing agreement governing the mining site and wrongfully seized or
4:09
sold mining equipment worth tens of millions of dollars. According
4:14
to the petition filed by HBT Power, Mohawk entered into
4:18
an operation Right License agreement in twenty twenty two under
4:23
which HBT Power would operate bitcoin mining activities at the
4:27
Gateway Industrial Park, located off US Highway twenty three. The
4:33
bi lingual English Chinese agreement described a thirty megawat bitcoin
4:38
mining operation using bitmain and miner and micro bt Witts
4:43
miner mining machines housed in a forty one thousand square
4:47
foot facility formerly occupied by Ferris Incorporated, a Canadian firm
4:52
that provided liquid nitrogen used in the natural gas industry.
4:58
The agreement called for Ohawk to provide the site, electrical
5:02
infrastructure and staffing of eleven employees at forty thousand dollars
5:07
a month, while HBT Power would supply specialized computers called ASICs,
5:14
Application specific integrated circuits used to mine bitcoin and pay
5:20
rent of fifty thousand dollars a month, energy costs and
5:24
a ten percent share of mining revenue. The contract references
5:29
who will be a major Chinese cryptocurrency company in describing
5:34
HBT powers, ownership, structure, and operations. Bitcoin is a digital
5:40
currency or a virtual form of cash that allows users
5:45
to make anonymous payments online. Bitcoin mining refers to the
5:50
data processing operations that solve the complicated mathematical equations that
5:56
verify cryptocurrency transactions worldwide. Companies earned rewards in the form
6:02
of new bitcoins in exchange for completing blocks of data
6:07
that are transmitted over peer to peer computer networks or
6:10
block chains around the world. One bitcoin is now worth
6:16
about seventy eight thousand dollars in U S dollars, down
6:20
from its all time high of one hundred twenty six thousand,
6:23
one hundred ninety eight dollars in October two thousand, twenty five.
6:28
The federal petition says the dispute went to arbitration in
6:32
late twenty twenty three and was heard over five days
6:36
in May twenty twenty five before a judicial Arbitration and
6:41
Mediation Services arbitrator who issued an interim award in December
6:46
two thousand twenty five and ordered further briefing on attorney sees, costs,
6:51
prejudgment interest, punitive damages, and the scope of injunctive relief.
6:58
After considering other motions filed by both HBT Power and Mohawk,
7:03
in March twenty twenty six, the arbitrator found that Mohawk
7:07
breached the operating agreement and unlawfully retained or sold mining
7:12
equipment belonging to HBT Power. The petition states the arbitrator
7:17
found Mohawk sold two thousand, fifty nine micro bt wets
7:22
Minor M thirty M thirty one series ASIC miners to
7:26
third parties without authorization after ousting HBT Power from the
7:31
Jenkins facility, and kept two thousand, two hundred seventy bit
7:36
main and Minor S nineteen series ASIC miners for its
7:40
own use.
7:43
Speaker 2: The arbitrator's final.
7:44
Speaker 1: Ruling awarded HBT Power a total of fifty one point
7:48
five million dollars forty six point seven million dollars for
7:52
breach of contract, six hundred thousand dollars for conversion, one
7:57
hundred twenty eight thousand, one hundred twenty five dollars in
8:00
prejudgment interest, three point five to three million dollars in
8:04
attorney fees and five hundred fifty nine thousand eight dollars
8:08
in costs. The petition also asks the court to permanently
8:14
bar Mohawk from selling, using, or transferring mining equipment and
8:19
electrical infrastructure at the site, and to order the return
8:23
of remaining equipment, including two thousand, two hundred seventy S
8:27
nineteen series mining machines, a substation said to have cost
8:31
eight million dollars, fourteen transformers, and fourteen low voltage cabinets.
8:38
HBT Power claims Mohawk has not paid any portion of
8:41
the arbitration award since the April ruling. The filings are
8:47
the latest development in a long running dispute surrounding the
8:50
Jenkins operation. Mohawk Energy held a grand opening in September
8:56
twenty twenty three, touting plans for blockchain computing, electronics repair,
9:02
and aviation related training. At the time, Smith said the
9:06
company would pay workers between twenty five and sixty five
9:09
dollars an hour and eventually employ as many as two
9:12
hundred fifty people, but within months the operation became embroiled
9:18
in litigation. Earlier reporting described disputes between Smith and representatives
9:24
of the Chinese crypto company over payments and control of
9:28
the mining operation. The Gateway Industrial Park site itself has
9:33
a long history of failed industrial projects. The former Firous
9:38
nitrogen plant at the center of the dispute previously sat
9:41
vacant after the collapse of earlier oil and gas related
9:45
industrial projects in eastern Kentucky. The petition asks the federal
9:51
court to convert the arbitration award into an enforceable judgment
9:55
under the Federal Arbitration Act. While the bill his coin
10:00
mining facility is in Jenkins, which is in the U.
10:03
S District Court's Eastern District of Kentucky, the lawsuit was
10:07
filed in the Western District of Columbia because Louisville was
10:10
designated as the arbitration location in the contracts between HBT
10:15
Power and Mohawk Energy. HBT Power is represented by the
10:20
Lexington law firm of Stahl keenan Ogden, PLLC. Mohawk Energy
10:26
is represented by Frankfurt attorney Anna Stuart Whites. Meanwhile, Brandon
10:32
Smith and Mohawk Energy are named in a separate lawsuit
10:36
that remains pending in Lector Circuit Court. The lawsuit concerns
10:40
the same Gateway industrial park property now at the center
10:44
of the case in which HBT Power is seeking to
10:46
enforce the fifty one and a half million dollar arbitration
10:49
award against Mohawk Energy.
10:53
Speaker 2: According to a.
10:54
Speaker 1: Complaint by Ricky Dale Cole of Danville, Kentucky, Smith approached
10:58
him in April two thousand, two twenty two about leasing
11:02
and eventually purchasing the Old Fears Building in Jenkins. Cole
11:07
says Mohawk initially agreed to lease the property for fifty
11:11
thousand dollars a month under a three year agreement, before
11:15
later negotiating to purchase.
11:17
Speaker 2: The building outright.
11:19
Speaker 1: The complaint says Coal agreed to accept two point five
11:22
million dollars less than the property's asking price in exchange
11:26
for a twenty percent ownership interest in Mohawk Energy.
11:31
Speaker 2: Coal claims Smith.
11:32
Speaker 1: Told him the deal represented an opportunity to invest in
11:36
Mohawk Energy at a very low cost and that the
11:39
company had a strong financial outlook that would produce substantial profits.
11:45
The lawsuit alleges those representations were false and that Coal
11:49
has received nothing additional by way of monetary value since
11:53
the property transfer was completed. Coal further alleges Mohawk failed
12:00
to provide him access to company financial records and information
12:04
regarding ownership interests, transactions, and company assets, despite a formal
12:09
demand made in December twenty twenty four. The suit asks
12:14
the court to order Mohawk to produce company records and
12:18
seeks compensatory damages, punitive damages, attorney fees, and recision of
12:23
the transaction. Mohawk Energy denied the allegations. In its answer.
12:30
Mohawk denied Coal ever acquired a valid ownership interest in
12:34
the company, and claimed he had intentionally and voluntarily relinquished
12:38
any interest he may have had. Mohawk also alleged Coal
12:43
repeatedly told local residents and members of the Jenkins community
12:47
that he had nothing whatsoever to do with Mohawk. The
12:51
company further accused Cole of undermining Mohawk's operations and interfering
12:57
with a major third party contract tied to the Gateway
13:00
Industrial Park project. According to Mohawk's counterclaim, Cole continually undermined, damaged,
13:08
and disrupted the company's business operations, and intentionally interfered with
13:13
a contract that would have generated substantial income for Mohawk.
13:19
Although the filing does not identify the third party by name,
13:23
the allegations appeared to correspond to Mohawk's cryptocurrency mining agreement
13:28
with HBT Power and related Chinese crypto entities that later
13:33
became the subject of arbitration in federal court.
13:37
Speaker 2: Mohawk has asked the court to dismiss.
13:39
Speaker 1: Cole's lawsuit, ruled that he is not a member of
13:42
the company, or alternatively expel him from the LLC. The
13:47
company is also seeking compensatory and punitive damages for alleged
13:51
interference with its business relationships. Cole has denied Mohawk's counterclaims
13:58
and denied interfering within it the Mohawk contracts. The case
14:03
remains pending in Leiser Circuit Court. In the next story,
14:09
man pleads guilty to lesser charge in girlfriend's death. A
14:16
cram Creek man charged with murdering his girlfriend on November one,
14:20
twenty twenty four, has pleaded guilty to a lesser charge
14:24
of manslaughter. Vincent Fleming, twenty six, admitted to killing twenty
14:30
three year old Renata Don Bailey at flemings home at
14:34
three sixty six Box Rock Road. May King. Bailey, twenty three,
14:40
of Elk Creek at Blackie was found dead inside Fleming's
14:44
home by an ambulance crew after Fleming called nine one
14:47
one and requested an ambulance. Emergency Medical Service personnel notified
14:53
nine one one and requested police shortly after eleven o'clock
14:56
that night, reporting a dead body. Police said there were
15:00
signs of a struggle and there were bruises on her body.
15:06
Bailey had apparently been involved in an all terrain vehicle
15:09
accident two weeks earlier, sources said, but there was also
15:13
fresh bruising on her body. Sources said windows had been
15:18
broken out of the car parked outside, and Bailey's cellular
15:21
telephone was lying in the yard. Police first said that
15:26
she could have been killed when a dresser fell on her,
15:29
but other sources said she had severe bruising all over
15:32
her body and head trauma. Fleming was in the district
15:36
courtroom on the first floor of the courthouse to answer
15:39
numerous traffic violations when the murder indictment was returned. Nearly
15:43
a month later, Fleming pleaded guilty May thirteenth to an
15:49
amended charge of first degree manslaughter in exchange for a
15:52
recommended nineteen year sentence. The charge carries a minimum of
15:57
ten years and a maximum of twenty Formal sentencing is
16:02
set for June third in Lector Circuit Court. In the
16:08
next story, yet another dream appears to fade at Gateway.
16:15
At a grand opening in September twenty twenty three, Mohawk
16:19
Energy owner and state Senator Brandon Smith told visitors touring
16:24
the former Furious Nitrogen plant at the Gateway Industrial Park
16:28
that workers there could earn up to forty six dollars
16:30
an hour repairing high tech electronics, while even the company's
16:35
lowest paid workers would make twenty five dollars an hour.
16:39
The sprawling operation, built around cryptocurrency mining and electronics repair,
16:44
featured rows of powerful computer servers, an eight million dollar
16:49
electrical substation, and plans for aviation repair training. Smith of
16:54
Hazard said the operation was not dependent on public incentives
16:58
and would instead create a self sustaining technology hub in
17:01
the mountains. Less than three years later, the parking lot
17:06
is empty, the doors are locked, and Mohawk Energy now
17:10
faces a court fight over an arbitration award totaling more
17:14
than fifty one point five million dollars. The latest filing
17:21
in US District Court in Louisville asks a federal judge
17:24
to confirm the award in favor of HBT Power Limited,
17:28
a foreign owned cryptocurrency mining company that partnered with Mohawk
17:32
to operate a bitcoin mining facility in Jenkins. According to
17:37
the filing, an arbitrator found that Mohawk breached its operating
17:40
agreement with HBT Power, wrongfully retained computerized equipment to mine bitcoin,
17:46
and sold more than two thousand of the mining machines
17:49
without authorization. The arbitrator awarded forty six point seven million
17:55
dollars for breach of contract, six hundred thousand dollars for
17:59
conversion of proper three point five three million dollars in
18:02
attorney fees, and additional interest and costs, for a total
18:06
of fifty one million, five hundred eighteen thousand, four hundred
18:10
fifty three dollars and thirty cents. HBT Power is also
18:14
asking the court to permanently prohibit Mohawk from selling or
18:19
using mining equipment and to order the return of thousands
18:22
of mining machines and electrical components located at the Jenkins site.
18:29
The lawsuit is only the latest chapter in a business
18:32
saga that has left Gateway Industrial Park once again searching
18:36
for stable industry after years of highly publicised projects that
18:42
collapsed under economic pressure, disputes, or changing markets from promise
18:49
to lawsuits. Mohawk Energy first emerged publicly in twenty twenty
18:54
three as a replacement for an earlier bitcoin mining proposal
18:58
that never materialized. An August twenty twenty three article in
19:03
The Mountain Eagle described Mohawk as part of a multi
19:07
pronged approach to reviving Jenkins through industry, tourism and housing.
19:13
At the time, company officials said Mohawk planned not only
19:17
blockchain processing operations, but also electronics repair and aviation related
19:22
training programs. The company leased the former fires facility at
19:28
Gateway Industrial Park and installed the large transformers needed to
19:32
power cryptocurrency mining operations. By the following month, Smith was
19:38
hosting reporters and invited guests inside the facility, touting custom
19:43
built cooling systems, in house fabrication work by former coal miners,
19:48
and plans to expand electrical capacity from thirty to fifty megawatts.
19:55
Smith and Mohawk Vice president Dustin Rodgers repeatedly emphasized worker
20:00
training and long term opportunity. We don't say we'll give
20:04
you a job, we give a degree, Smith said during
20:07
the twenty twenty three grand opening event, but According to
20:12
a June twenty twenty five Mountain Eagle report, problems surfaced
20:17
almost immediately. Just two months after the grand opening, police
20:22
were called to the site during a dispute between Smith
20:26
and representatives of Huobi, the Chinese lenk company that owned
20:30
the mining servers, over a camper being used by one
20:33
of the company representatives. Huobi, identified in court records as
20:38
HBT Power Limited, later sued Mohawk for breach of contract,
20:43
while Smith counter sued, claiming the company owed Mohawk more
20:47
than seven hundred thousand dollars. That dispute eventually moved into
20:52
private arbitration, which largely remained hidden from public view until
20:57
the recent federal filing seeking confirmation of the arbitration award. Meanwhile,
21:03
Mohawk became embroiled in additional litigation involving the ownership of
21:08
the former Fist building itself. For longtime observers of Gateway
21:14
Industrial Park, the collapse of Mohawk Energy feels painfully familiar.
21:20
The industrial park has seen a succession of heavily promoted
21:23
projects arrived with promises of economic revival, only to close
21:27
a few years later. A twenty seventeen Mountain Eagles story
21:33
traced the cycle through earlier ventures at the same site.
21:37
Before Mohawk occupied the former Fires building, the site housed
21:42
two oil and gas related companies, Ferris Corporation, which shut
21:46
down in twenty fifteen after the collapse of Energy Markets
21:50
and Drillers LLC. At the time, local officials were already
21:55
searching for a new economic direction after repeated setbacks to
22:00
to coal, oil and gas markets. Economic development leaders promoted aerospace,
22:07
automotive manufacturing, and advanced technology as possible futures for the region.
22:14
Mohawk appeared to fit that vision as a technology centered
22:18
employer promising high wages, technical training, and an industrial reuse
22:23
of an otherwise vacant building. Instead, the latest filings suggest
22:29
the project devolved into an international dispute over cryptocurrency mining, equipment,
22:35
electrical infrastructure, and millions of dollars in alleged damages. No
22:41
ruling has yet been issued by the Federal court on
22:44
the request to confirm the arbitration award.
22:48
Speaker 2: When it comes to success.
22:50
Speaker 1: Stories at Gateway Industrial Park, one of them has been
22:54
locally owned Tailor Metal roofing and siding.
23:02
Speaker 2: The next story is.
23:04
Speaker 1: Man held after holding his girlfriend hostage. A man accused
23:10
of holding his girlfriend at gunpoint in a standoff with police.
23:14
Is being held in the Letter County Jail in lieu
23:17
of a fifty thousand dollars cash bond. Dusty Allen Schell,
23:22
thirty six, whose address is listed as Emmelina in Nott County,
23:27
was taken into custody about one pm May thirteenth, after
23:31
he was accused of taking his girlfriend and a man
23:34
in a wheelchair hostage. Jennifer Cantrell's sister called police about
23:40
fourteen am, reporting that Cantrell had been the victim of
23:43
domestic abuse. Police arrived on Buck Creek sometime after six am,
23:50
after first attempting to find the nine to one one
23:53
caller in nearby Love's Branch. They didn't positively find the
23:58
correct house until after six am, and then learned everyone
24:02
in the house had crossed the road to a neighbor's home.
24:06
When troopers knocked on the door there, they said a
24:09
man answered and told them Cantrell had left. Police continued
24:14
searching the neighborhood until after six thirty am, after the
24:17
original caller told them they had been at the right
24:20
home and the man who answered the door was lying.
24:24
She also said the man was armed troopers knocked on
24:27
the door again, but no one answered. Shortly afterward, the
24:32
caller told dispatchers that her sister had both hands on
24:35
a window and that Shell was holding her at gunpoint.
24:40
The neighbor, who is in a wheelchair, was also held
24:43
in the house, Police said. Police called in the Kentucky
24:48
State Police Special Response Team when the alleged abuser refused
24:52
to come out. Cantrell was allowed to come out later
24:56
in the day. The others eventually left the house, and
25:00
police arrested Shell on a parole warrant. He was also
25:05
charged with second degree assault, domestic violence, and second degree
25:09
terroristic threatening. Shell has a long criminal history stretching back
25:14
eighteen years. Police also arrested Amy L. Griffith, forty five,
25:20
of Hinman, on a fugitive warrant from Cincinnati, Ohio, and
25:25
lodged her in the Letcher County jail. Griffith also remained
25:29
in jail this week awaiting extradition to Ohio. The next
25:35
story is Letcher County's jobless rate is five point three
25:40
percent higher than state and national rates. Letcher County recorded
25:46
a five point three percent unemployment rate in March twenty
25:50
twenty six, above both the US rate of four point
25:54
three percent and Kentucky's statewide rate of four point six percent,
25:59
according to the Kentucky Center for Statistics. Among the eight
26:04
counties in the Kentucky River Area Development District, Letcher County
26:08
tied with Leslie County for the fourth highest unemployment rate.
26:14
Wolfe County posted the district's highest rate at eight point
26:17
three percent, followed by Breathett County at six point zero percent,
26:22
and Nott County at five point nine percent. Perry County
26:25
and Lee County each recorded four point seven percent, while
26:29
Owsley County posted four point eight percent. According to statistics
26:35
released May fifteenth, Letcher County had a certified labor force
26:39
of seven thy three hundred three, with nine hundred eighteen
26:43
of those people holding jobs, while the statistics show that
26:49
three hundred eighty five people are drawing unemployment benefits. Scores
26:53
of others are jobless but no longer searching for work.
26:58
Unemployment rates fell in all one hundred twenty counties between
27:02
March twenty twenty five and March twenty twenty six, according
27:06
to the Kentucky Center for Statistics, an agency within the
27:09
Kentucky Education.
27:10
Speaker 2: And Labor Cabinet.
27:13
Speaker 1: Hartland County's jobless rate for March stood at six point
27:16
one percent, while Pike County's rate was six point four percent.
27:22
Woodford County recorded the lowest jobless rate in the Commonwealth
27:25
at three point five percent. It was followed by Todd
27:29
County three point six percent, Fayette and Scott Counties three
27:33
point seven percent each, Campbell, Franklin, Jessmine, and Oldham Counties
27:38
three point eight percent each, and Boom, Caldwell, Carroll, Graves
27:42
and Kenton Counties three point nine percent each. Lewis County
27:48
recorded the state's highest unemployment rate at eight point four percent.
27:53
It was followed by Wolf County, Magoffin and Martin Counties
27:57
seven point eight percent each, Elliott County seven point one percent,
28:02
Menefee County seven percent, Jackson County six point nine percent,
28:06
Lawrence County six point seven percent, Carter County six point
28:10
six percent, and Wayne County six point five percent. This
28:17
concludes the reading of the Mountain Eagle. Your reader has
28:21
been Bill den Arsdale. Now please stay tuned for continued
28:25
programming on behalf of everyone here at Radio. I thank
28:29
you for listening and have a good day.
