Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to spin back up to Moscow
- 0:06Speaker 1: and we're going to continue taking a look at the
- 0:08Speaker 1: expert reports behind the prosecution of Brian Kohlberger. 53. Zanna
- 0:15Speaker 1: Kernodel was discovered lying on the floor of her bedroom
- 0:18Speaker 1: as depicted in image ISP 4911. Above the location of
- 0:23Speaker 1: her head, a white nightstand is at an angle to
- 0:26Speaker 1: the bed. A white shelving unit with dark gray drawers
- 0:29Speaker 1: is against the wall between the bed and the closet.
- 0:33Speaker 1: On the wall opposite the bed is a white desk.
- 0:36Speaker 1: A white faux fur chair is between the closet and
- 0:39Speaker 1: the desk. 54. Image ISP 4719 cropped shows a closer
- 0:46Speaker 1: view of the bloodstains on the body of Zanna Kernodel.
- 0:49Speaker 1: The bloodstains on her legs exhibit many transferred stains, wipe stains,
- 0:53Speaker 1: and flow stains. B. Numerous transfer and saturation stains are
- 0:59Speaker 1: noted on her sweatshirt. Fifty-five. On the right thigh of
- 1:02Speaker 1: Zanna Kernodel, a pattern transfer is indicated by the yellow
- 1:06Speaker 1: arrow in image ISP 4927 cropped. An object with a
- 1:11Speaker 1: similar pattern either transferred the blood to her right thigh
- 1:15Speaker 1: or contacted an existing blood stain on her upper right
- 1:18Speaker 1: thigh while it was still wet. Fifty-six. The white nightstand
- 1:23Speaker 1: depicted in image ISP 5077 shows transfers and wipes on
- 1:28Speaker 1: the side closest to the bed and on top surface. A.
- 1:33Speaker 1: The front edge of the nightstand has been moved away
- 1:35Speaker 1: from the bed in order to make room for a
- 1:37Speaker 1: bloody object that created the transfer on the side of
- 1:40Speaker 1: the nightstand to allow room for the drip stains noted
- 1:44Speaker 1: in the floor. B. Drip stains and and drip trails
- 1:48Speaker 1: are noted on the bottom shelf of the nightstand and
- 1:50Speaker 1: on the floor between the bed and the nightstand. Drip
- 1:53Speaker 1: stains and trails are created when a surface, wet with blood,
- 1:57Speaker 1: is above the level of the surface showing deposition. C.
- 2:01Speaker 1: Spatter stains associated with impact are noted on the wall
- 2:05Speaker 1: and on top of the nightstand. 57. Stain 31 in
- 2:07Speaker 1: DSC 4941 is a cessation pattern located on the wall
- 2:10Speaker 1: between the bed and the location of the white nightstand.
- 2:18Speaker 1: This pattern is shown in more detail in image ISP 5074. A.
- 2:24Speaker 1: The shape of the edge characteristics of this pattern indicate
- 2:27Speaker 1: that a bloodied object struck the wall in this location. 58.
- 2:32Speaker 1: Image ISP 5073 depicts an apparent defect in the bedsheet
- 2:37Speaker 1: circled in white. Yellow material is visible beneath the defect
- 2:40Speaker 1: in the bedsheet as seen in the cropped image. 59.
- 2:45Speaker 1: DSC 4556 depicts the area surrounding the white shelving unit
- 2:49Speaker 1: along the west wall of the bedroom near the closet opening. A.
- 2:54Speaker 1: Spatter stains are noted on the wall besides the leg
- 2:56Speaker 1: of the shelving unit and are labeled with the placard 34.
- 3:01Speaker 1: A closer view of the spatter pattern is depicted in
- 3:03Speaker 1: DSC 4562. B. The appearance of the stains indicated by
- 3:09Speaker 1: the yellow oval in DSC 4562 is consistent with diluted blood.
- 3:15Speaker 1: Diluted blood is created when blood is mixed with another liquid. I.
- 3:19Speaker 1: The mouth and nose injuries of Xenocrinodal, as noted in
- 3:22Speaker 1: the autopsy report, are potential sources of diluted blood. C.
- 3:27Speaker 1: The shape of area of convergence of these spatter stains
- 3:31Speaker 1: indicate that the source of blood was slightly above the
- 3:33Speaker 1: level of these stains. 60. Spatter stains associated with impact
- 3:39Speaker 1: are located on the wall to the right of the
- 3:42Speaker 1: opening for the closet as depicted in image ISP 4740.
- 3:47Speaker 1: The spatter is indicated by marker 29 in image DSC 4892. A.
- 3:53Speaker 1: The appearance of these spatters is consistent with diluted blood. C.
- 3:57Speaker 1: DSC 4892 cropped. I. The mouth and nose injuries of Xanocarnotl,
- 4:03Speaker 1: as noted in the autopsy report, are potential sources of
- 4:07Speaker 1: diluted blood. B. The directionality of the spatter stain is
- 4:11Speaker 1: from right to left, as indicated by the yellow arrow
- 4:14Speaker 1: inserted in image DSC 4892, cropped. C. These spatter stains
- 4:21Speaker 1: originated from an impact to a source of exposed blood
- 4:24Speaker 1: located approximately 3 feet and 7 inches above the floor,
- 4:29Speaker 1: as indicated by the scale in image DSC 4892, cropped. 61.
- 4:36Speaker 1: Transfer stains are noted on the white faux fur chair
- 4:39Speaker 1: depicted in image ISP 5091. This chair is located adjacent
- 4:44Speaker 1: to the head of Zanacur Notal. There are additional transfer
- 4:47Speaker 1: stains on the uppermost portion of the leg of the
- 4:50Speaker 1: desk depicted in image ISP 1593 and are indicated by
- 4:54Speaker 1: marker 35. A. Marker 35, presumptive test for blood, was positive. B.
- 5:01Speaker 1: DNA match Zanacur Notal. 62. Swipe stains are located on
- 5:06Speaker 1: the trash can underneath the desk as depicted in image
- 5:10Speaker 1: DSC 4800 and DSC 4800 cropped, and indicated by marker T. A.
- 5:17Speaker 1: Swipe stains result from the transfer of blood from a
- 5:20Speaker 1: blood-bearing surface onto another surface, with characteristics that indicate relative
- 5:24Speaker 1: motion between the two surfaces. B. Testing showed the presence
- 5:29Speaker 1: of blood of Xanocarnotl. Upper portion of Xanocarnotl's bedroom door, 63.
- 5:36Speaker 1: DSC 4781 depicts the upper portion of Xanocarnotl's bedroom door.
- 5:41Speaker 1: The bloodstains are depicted and indicate a Cast-off pattern composed
- 5:47Speaker 1: of diluted blood and associated flow patterns. 1. Cast-off is
- 5:51Speaker 1: created when blood is released as a result of a
- 5:53Speaker 1: bloodied object in motion. 2. The appearance of the bloodstains
- 5:57Speaker 1: reveal the blood has been diluted by another liquid. 1.
- 6:01Speaker 1: The mouth and nose injuries of Xanocarnotl, as noted in
- 6:04Speaker 1: the autopsy report, are potential sources of diluted blood. 3.
- 6:09Speaker 1: Flow patterns in this instance are are the result of
- 6:12Speaker 1: gravitational attraction. Lower portion of Xanakernodle's bedroom door and adjacent floor. 64.
- 6:19Speaker 1: DSC 4784 shows the lower portion of Xanakernodle's bedroom door
- 6:24Speaker 1: exterior surface. A. Stain 36 indicates diluted flow stains on
- 6:30Speaker 1: the exterior surface of the bedroom door. 1. The appearance
- 6:34Speaker 1: of these stains indicates that the blood has been diluted
- 6:37Speaker 1: with another liquid, altering their appearance. 2. Subsequent testing of
- 6:42Speaker 1: these flow stains on the exterior of the bedroom door
- 6:45Speaker 1: indicates the blood of Xanocurnodal. 3. The mouth and nose
- 6:50Speaker 1: injuries of Xanocurnodal, as noted in the autopsy report, are
- 6:53Speaker 1: potential sources of diluted blood. B. Drip stains were noted
- 6:57Speaker 1: on the bedroom floor below the door. This relative location
- 7:01Speaker 1: of the drip stains is indicated by a pink marker
- 7:04Speaker 1: on the floor in images DSC 4784. These drip stains
- 7:09Speaker 1: are better visualized In image DSC 4787. 1. These drip
- 7:16Speaker 1: stains do not appear to have been altered or diluted. C.
- 7:20Speaker 1: The location of these drip stains near the opening edge
- 7:22Speaker 1: of the bedroom door represents the furthermost location of undiluted blood. D.
- 7:28Speaker 1: Once Zanna Kernodel was actively bleeding, there is no physical
- 7:32Speaker 1: evidence that she was ever east of this location. Conclusions.
- 7:37Speaker 1: There's no physical evidence that any of the decedents were
- 7:40Speaker 1: outside of their respective bedrooms after sustaining significant bloodletting injuries.
- 7:45Speaker 1: The only decedent to move from the bed and or
- 7:48Speaker 1: be standing upright after actively bleeding was anachronotal. 2. Someone
- 7:53Speaker 1: other than the decedents had a source of blood on
- 7:55Speaker 1: their person or in their possession and is responsible for
- 7:59Speaker 1: the creation of the bloodstains in the following locations. A.
- 8:03Speaker 1: Madison Mogan's bedroom door. B. Stairway leading from the third
- 8:07Speaker 1: level to the second level. C. Stairway leading from the
- 8:10Speaker 1: second level to the first level. D. Diluted stain on
- 8:14Speaker 1: top of the beer pong table on the second level. E.
- 8:17Speaker 1: Half wall near the end of the beer pong table
- 8:20Speaker 1: on the second level. F. Wooden ledge on the half
- 8:23Speaker 1: wall on the second level. 3. Presence of diluted bloodstains
- 8:28Speaker 1: outside of the respective bedrooms indicates that the person, persons
- 8:31Speaker 1: responsible for the creation of these bloodstains, also caused their dilution. 4.
- 8:37Speaker 1: The cast-off bloodstains on the half-wall at the end of
- 8:40Speaker 1: the beer pong table and in the stairwell between second
- 8:43Speaker 1: and first floor indicate that the source of the diluted
- 8:45Speaker 1: blood was in motion. 5. Presence of diluted blood from
- 8:50Speaker 1: Kaylee Gonsalves and Madison Mogan in the cast-off bloodstains on
- 8:54Speaker 1: the half-wall at the end of the beer pong table
- 8:56Speaker 1: and in the stairwell opening between the second and first
- 8:59Speaker 1: floors establishes that Ms. Gonsalves and Ms. Mogan had already
- 9:04Speaker 1: been injured and that the source of their blood had
- 9:06Speaker 1: been mixed with another liquid before the cast-off stains were created. 6.
- 9:12Speaker 1: Transfer stain D on the north side of the wooden
- 9:14Speaker 1: ledge of the half wall in the living room, which
- 9:17Speaker 1: was identified as containing the blood of Ethan Chapin in
- 9:20Speaker 1: the only undiluted blood stains identified outside of the bedroom. 7.
- 9:25Speaker 1: The knife sheath recovered from the bed of Madison Mogan
- 9:28Speaker 1: had DNA associated with Brian Kohlberger and blood spatters associated
- 9:32Speaker 1: with with an impact delivered to Kaylee Gonsalves and Madison Mogan. 8.
- 9:37Speaker 1: There is no physical evidence to indicate that a significant
- 9:39Speaker 1: amount of time elapsed during the commission of this violent activity. 9.
- 9:44Speaker 1: There is no physical evidence to exclude a single perpetrator
- 9:47Speaker 1: causing the death of these four individuals. 10. There is
- 9:52Speaker 1: no scientific basis to predict the necessary occurrence of secondary
- 9:56Speaker 1: footwear transfer stains due to the overall lack of visible
- 9:59Speaker 1: footwear patterns in the entire crime scene. The findings are
- 10:03Speaker 1: based upon the material provided to date. Submission of additional
- 10:07Speaker 1: material could alter these conclusions. Respectfully submitted, T. Paulette Sutton
- 10:13Speaker 1: Alright folks, we're going to wrap up right here and
- 10:15Speaker 1: in the next episode we're going to pick up where
- 10:17Speaker 1: we left off. And that's going to be with the rebuttals.
