Latest / Beyond The Horizon / Mega Edition: Chad Daybell Trial (Part 16) (10/22/26)
Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode, we're getting right back to the Chad Daybell
- 0:05Speaker 1: trial and we're gonna recap what went down on day
- 0:09Speaker 1: number 16. And to do that, once again, we're going
- 0:12Speaker 1: to be using eastidahonews.com and the author of this article
- 0:17Speaker 1: is Nate Eaton. 8.26 a.m. We are back in the
- 0:21Speaker 1: courtroom for day number 16 of the trial. There are
- 0:23Speaker 1: more people in the gallery than in days past, around
- 0:26Speaker 1: 40 or 50. Many are here for the first time.
- 0:30Speaker 1: The deputy goes over the courtroom conduct order. Phones must
- 0:33Speaker 1: be silenced. No photos, no sunglasses or hats in the courtroom, etc. 8.27 a.m.
- 0:40Speaker 1: Retired Rexburg detective David Stubbs will be back on the
- 0:43Speaker 1: stand first thing this morning. Madison County prosecuting attorney Rob
- 0:47Speaker 1: Wood will be questioning him. 8.29 a.m. Chad Daybell just
- 0:51Speaker 1: walked into the courtroom with his laptop. He's sitting next
- 0:54Speaker 1: to John Pryor, his defense attorney. Chad's wearing a light
- 0:57Speaker 1: checkered shirt with a yellow tie. Fremont County Prosecuting Attorney
- 1:02Speaker 1: Lindsay Blake and Deputy Prosecuting Attorney Rocky Wixom and Special
- 1:06Speaker 1: Prosecutor Ingrid Beatty are at the prosecution table with Wood. 8.31 a.m.
- 1:11Speaker 1: Attorneys all leave the courtroom to have a sidebar with
- 1:14Speaker 1: Judge Stephen Boyce. 8.37 a.m. The attorneys have walked back
- 1:18Speaker 1: into the courtroom. Wood takes his place at the podium.
- 1:21Speaker 1: Boyce is on the bench and the jurors are being
- 1:24Speaker 1: brought in. 8.40 a.m. Boyce says court will end early today,
- 1:28Speaker 1: around 2 p.m. 8.42 a.m. Wood begins by asking Stubbs
- 1:34Speaker 1: about the search he and officers did of the apartments
- 1:37Speaker 1: in Rexburg. This was the first search for JJ. Stubbs
- 1:40Speaker 1: was wearing a body camera. Wood moves to admit the
- 1:43Speaker 1: video into evidence. 8.44 a.m. Wood plays a video showing
- 1:48Speaker 1: Stubbs walking into apartment 175, Lori's apartment, on November 27, 2019.
- 1:50Speaker 1: He narrates that he's in the front room. There was
- 1:57Speaker 1: some damage to the door from the no-knock entry warrant.
- 2:00Speaker 1: There are keys on the counter, an envelope from Amazon
- 2:03Speaker 1: to Lori Vallow, food in the pantry. We see Stubbs
- 2:06Speaker 1: walking into the garage. There are couches, tables, guns, several totes. 8.47 a.m.
- 2:13Speaker 1: Stubbs now walks up the stairs. We see the master
- 2:16Speaker 1: bedroom and the master bathroom. Lots of hangers in the closet,
- 2:20Speaker 1: but nothing else. It's empty. It made me think that
- 2:23Speaker 1: the occupants left in haste. Stubbs says, There are two
- 2:26Speaker 1: small computer desks with a printer. On the printer is
- 2:29Speaker 1: a lease agreement for Lori Ryan. 8.50 a.m. We now
- 2:33Speaker 1: see two additional bedrooms. In one room there's a bed,
- 2:37Speaker 1: and in the closet are some coats, an empty box,
- 2:40Speaker 1: a fan, a bedspread, and winter clothes in a box.
- 2:43Speaker 1: The other bedroom has a bed, three guitar cases with guitars,
- 2:47Speaker 1: a duffel bag full of toiletries that appear to belong
- 2:50Speaker 1: to a man. The closet is fairly empty, except for
- 2:54Speaker 1: two swords, and empty laundry baskets. 8.52 a.m. The video
- 3:00Speaker 1: is over. Stubbs also walked through apartment 174, Melanie Boudreaux's apartment.
- 3:06Speaker 1: Wood moves to admit body camera footage from her apartment.
- 3:09Speaker 1: Wood asks if anything stood out to him. This particular
- 3:12Speaker 1: apartment appeared someone was residing there. Clothes were in the closet.
- 3:16Speaker 1: There was a car in the garage. Something that struck
- 3:18Speaker 1: me as odd as we were searching. I noticed on
- 3:21Speaker 1: the counter she had a three-ring binder with clear plastic
- 3:24Speaker 1: organizers inside. I thought it was off because I knew
- 3:28Speaker 1: they were divorced that she had numerous of his credit
- 3:31Speaker 1: cards and driver's license in there. 8.55 a.m. We now
- 3:36Speaker 1: see footage of Stubbs entering Melanie's apartment. There's furniture inside
- 3:41Speaker 1: and pictures on the wall. There are items on the counter,
- 3:44Speaker 1: including electronics and a purse. We see Brandon Boudreau's credit
- 3:48Speaker 1: cards on the counter and Brandon's driver's license. So like
- 3:52Speaker 1: I said about Melanie and the rest of these people
- 3:54Speaker 1: that were palling around with Lori and Chad, I don't
- 3:58Speaker 1: trust any of them. And I think the whole entire
- 4:00Speaker 1: woe is me routine when it comes to the fact
- 4:02Speaker 1: that they've been outed for weirdos is way off the mark.
- 4:06Speaker 1: And I don't know how anyone could look at these
- 4:08Speaker 1: people and be like, oh, you know what? They were
- 4:10Speaker 1: just talked into it. They were coerced. No, they all
- 4:12Speaker 1: had these crazy ass ideas. And sometimes crazy just meets crazy, right?
- 4:18Speaker 1: And that's what we see here. A whole bunch of
- 4:20Speaker 1: crazy people colliding with a whole ass bunch of stupid. 8.57 a.m.
- 4:25Speaker 1: Stubbs mispronounces Brandon's last name. Wood pauses the video and says,
- 4:29Speaker 1: it appears you mispronounced Brandon's last name. Stubbs responds, I
- 4:34Speaker 1: surely did, and many in the courtroom chuckle. J.J. Vallow
- 4:37Speaker 1: was not found in the apartment. The search grew to
- 4:40Speaker 1: include Tylee Ryan. 8.59 a.m. Wood asks Stubbs if he
- 4:44Speaker 1: ever found evidence that Brandon lived in apartment 174. Stubbs
- 4:48Speaker 1: says no. Wood asks to publish an exhibit showing the
- 4:51Speaker 1: list of warrants that Stubbs obtained. 9.01am. The first warrant
- 4:56Speaker 1: Stubbs wrote was to Verizon for the original phone number
- 4:59Speaker 1: associated with Lori Vallow. Stubbs explains many of the warrants
- 5:03Speaker 1: on the list were issued before the children were found. 9.03am.
- 5:07Speaker 1: Verizon returned the warrant with names and email addresses associated
- 5:11Speaker 1: with Lori's first number. Stubbs says Google is very good
- 5:14Speaker 1: at keeping track of people. Anytime someone uses a Gmail account,
- 5:18Speaker 1: Google keeps records of what you do, when you do it,
- 5:22Speaker 1: and where you are. So when I talk about anyone
- 5:24Speaker 1: who's out there trying to commit crimes and keeping their
- 5:27Speaker 1: cell phone on them, this is what I mean. You
- 5:30Speaker 1: are going to get caught. It's not a matter of if,
- 5:33Speaker 1: it's a matter of when. 9.06 a.m. Would ask Stubbs
- 5:37Speaker 1: if someone can opt out of geolocation tracking. Stubbs says
- 5:40Speaker 1: location services can be turned off and it would prohibit
- 5:43Speaker 1: Google from keeping that information. 9.07 a.m. The number was
- 5:48Speaker 1: associated with Alex Cox's email address, two of Lori's email accounts,
- 5:53Speaker 1: and one of Chad's email accounts. Stubbs was able to
- 5:56Speaker 1: obtain geolocation data from Alex, the Homer J. Maximus account.
- 6:00Speaker 1: More like Maximus Moron. 9.08 a.m. Stubbs says, We were
- 6:05Speaker 1: still in the process of trying to locate children, JJ
- 6:08Speaker 1: and Tylee. He gets choked up, pauses, and says sorry,
- 6:12Speaker 1: and he goes on to say that a Verizon bill
- 6:14Speaker 1: was found in a Sugar City P.O. box. The bill
- 6:17Speaker 1: had several numbers listed for Lori, Tylee, Alex, and Charles. 9.10 a.m.
- 6:22Speaker 1: Stubbs says nobody returned to the apartments after November 27th.
- 6:26Speaker 1: The landlords went in to clean the units and found
- 6:29Speaker 1: two electronic devices that were turned over to the police.
- 6:32Speaker 1: Police issued a warrant on those devices. 9.12 a.m. Stubbs
- 6:37Speaker 1: requested a tap and trace warrant on the devices as
- 6:41Speaker 1: they searched for JJ and Tylee. Verizon sent police live
- 6:44Speaker 1: data as the phones were on the move. It allowed
- 6:47Speaker 1: officers to see where the device was in real time.
- 6:50Speaker 1: So when I talk about things going on behind the scenes,
- 6:53Speaker 1: this is the sort of stuff I'm talking about as well.
- 6:56Speaker 1: There's so much going on when we're talking about one
- 6:58Speaker 1: of these investigations that it will make your head spin.
- 7:01Speaker 1: And we as the public were only privy to a
- 7:04Speaker 1: small amount of that. 9.15 a.m. Wood asked Stubbs why
- 7:08Speaker 1: they're looking at Chad Daybell's location. He responds, Lori and
- 7:11Speaker 1: Chad were married. We couldn't get a hold of either
- 7:13Speaker 1: one of them. We couldn't get any straight answers from
- 7:16Speaker 1: either one. We couldn't get information on where the children were. 9.16 a.m.
- 7:21Speaker 1: The devices tracked to Kauai, Hawaii. Investigators went to Hawaii
- 7:25Speaker 1: and located Chad and Lori. A warrant was obtained to
- 7:28Speaker 1: gather evidence from their vehicle and the townhouse. Ten electronic
- 7:32Speaker 1: devices were taken from their rental car. 9.18 a.m. Stubbs
- 7:36Speaker 1: says the information they got back from Google or Verizon
- 7:40Speaker 1: can be thousands of pages. He says it's impossible for
- 7:43Speaker 1: one person to go through all the data. especially in
- 7:46Speaker 1: a short time frame when officers were trying to find
- 7:48Speaker 1: the kids. Stubbs worked with the FBI and other agencies
- 7:52Speaker 1: to go through all of the info. 921 a.m. Stubbs
- 7:57Speaker 1: says forensic software is always slightly behind the phone. Whenever
- 8:01Speaker 1: a phone comes out with new technology, the software engineers
- 8:04Speaker 1: have to upgrade their systems. Just because you physically have
- 8:07Speaker 1: the phone and software, it doesn't mean you can automatically
- 8:11Speaker 1: get into the device. 923 a.m. Police also obtained a
- 8:15Speaker 1: warrant on Melanie Boudreaux's phone. As Melanie was being interviewed
- 8:18Speaker 1: by police in Rexburg, Stubbs obtained her phone. This was
- 8:22Speaker 1: early in 2020 before Tylee and JJ were found. Police
- 8:28Speaker 1: can obtain evidence from an actual phone and other evidence
- 8:31Speaker 1: from phone carriers. Apps also keep a lot of information
- 8:35Speaker 1: that wouldn't be on the device. Police found a notebook
- 8:39Speaker 1: in the Hawaii vehicle that had pages of email accounts
- 8:42Speaker 1: and passwords. Police worked to obtain warrants on the accounts. 9.30 a.m.
- 8:48Speaker 1: The kids were found on Chad's property on June 9, 2020.
- 8:52Speaker 1: Additional warrants were issued after this time. Police wanted to
- 8:56Speaker 1: bring in specialized equipment onto the property to get cell
- 8:59Speaker 1: phone signal strengths. 9.33 a.m. Stubbs wanted to find anyone
- 9:05Speaker 1: who had spent significant time in or near Chad's property
- 9:08Speaker 1: and Lori's apartment on critical dates. They wanted to see
- 9:12Speaker 1: if there was anyone else that the officers should be investigating. 9.35 a.m.
- 9:17Speaker 1: If someone had their Google location turned off, they would
- 9:20Speaker 1: not show up in the geolocation search. 9.38 a.m. Stubbs
- 9:24Speaker 1: says officers narrowed everything down to 12 devices of interest.
- 9:28Speaker 1: Police requested warrants on the 12 devices to find out
- 9:31Speaker 1: who they belonged to. 9.40 a.m. Google did not respond.
- 9:36Speaker 1: Stubbs got a hold of someone at the company and
- 9:38Speaker 1: was told the 12 devices was too broad. Google suggested
- 9:42Speaker 1: police narrow their search. They lessened the request by two
- 9:46Speaker 1: and asked for details on 10 devices. Police received information
- 9:52Speaker 1: on the 10 devices. Stubbs says an independent expert was
- 9:55Speaker 1: brought in for an outsider's perspective on the phones. 9.42 9.43am
- 10:01Speaker 1: Nothing new was discovered by the independent expert. Woods asked
- 10:05Speaker 1: Stubbs about some of the things found during the search.
- 10:08Speaker 1: He looked at the Lollitime account. A few brought me concern,
- 10:11Speaker 1: he says. On August 25th, the user of Lollitime looked
- 10:14Speaker 1: up wedding rings made of malachite and visited websites about
- 10:18Speaker 1: the rings. The user tried to purchase two rings, an 11.5
- 10:22Speaker 1: size and 4.2 size. The total was $ 808. The credit
- 10:26Speaker 1: card failed and the purchase was declined. 9.46 a.m. On
- 10:32Speaker 1: September 20th, the user searched the definition of possessed. On
- 10:35Speaker 1: September 30th, the user looked up how to remove the
- 10:38Speaker 1: back seat of a Jeep and then watched a video
- 10:41Speaker 1: about how to do it. Two days later, a gray
- 10:43Speaker 1: Jeep Wrangler with Texas license plates was used to shoot
- 10:46Speaker 1: at Brandon in Arizona. It was the same Jeep found
- 10:50Speaker 1: in Rexburg. 9.48 a.m. Stubbs searched the search history of
- 10:55Speaker 1: Chad D. Daybell, gmail.com. On September 8, 2019, the user
- 11:01Speaker 1: of the account looked up what the wind direction was
- 11:04Speaker 1: going to be on September 9. We believe on the 9th,
- 11:07Speaker 1: Tylee's body was burned and buried in the fire pit
- 11:10Speaker 1: behind Chad's house. So that's why he's looking for the
- 11:13Speaker 1: wind direction according to the prosecution. What, he's just up
- 11:17Speaker 1: there wondering which way the wind's gonna be gusting today?
- 11:20Speaker 1: Unless bro has a badminton tournament planned and he's worried
- 11:23Speaker 1: about the shuttlecock moving all over the place, I don't
- 11:25Speaker 1: see why he's worried about where the wind's blowing. 9.50 a.m.
- 11:29Speaker 1: Wood asked Stubbs about a flash drive found. On the drive,
- 11:32Speaker 1: there were several photos of Chad and Lori's wedding from
- 11:35Speaker 1: November 5th, 2019. Stubbs used forensic software to search the
- 11:39Speaker 1: flash drive. so the original content was not disturbed. Stubbs
- 11:43Speaker 1: found that photos of Chad, Tammy, their kids, Chad and
- 11:46Speaker 1: Tammy's courtship to their marriage, to their kids being born,
- 11:49Speaker 1: basically a family album, had all been deleted. Yeah, sounds
- 11:53Speaker 1: like a guy who is really in mourning, a man
- 11:55Speaker 1: that really misses his wife. And I'm sure the jury
- 11:58Speaker 1: is just sucking it up. I'm sure they just love
- 12:01Speaker 1: the fact that Chad Daybell is such a scoundrel. 9.55 a.m.
- 12:04Speaker 1: Morning recess. All right, so we're going to end the
- 12:09Speaker 1: episode here, and in the next episode, we'll pick up
- 12:11Speaker 1: where we left off at day number 16 of the
- 12:14Speaker 1: Chad Daybell trial. All of the information that goes with
- 12:18Speaker 1: this episode can be found in the description box. What's up, everyone,
- 12:22Speaker 1: and welcome back to the program. We're going to pick
- 12:25Speaker 1: up where we left off at day number 16 of
- 12:28Speaker 1: the Chad Daybell trial. Once again, we're using eastidahonews.com as
- 12:33Speaker 1: our guide, and the author of this article is Nate Eaton. 10.28 a.m.
- 12:38Speaker 1: We are back in the courtroom. Wood publishes a photo
- 12:40Speaker 1: of Lori and Chad on the beach with a wedding
- 12:43Speaker 1: officiant on the beach. The next image is of Chad
- 12:46Speaker 1: holding Lori in his arms on the beach as they kiss.
- 12:48Speaker 1: The next photo is Lori doing the hula with Chad
- 12:51Speaker 1: playing a ukulele. 10.30 a.m. The next photo is of
- 12:55Speaker 1: Chad and Lori looking into each other's eyes. Another photo
- 12:58Speaker 1: shows their Amalekite rings. Another image is of Lori's ring
- 13:02Speaker 1: on her left hand. Now we see a picture of
- 13:04Speaker 1: Chad's ring. The next picture is of Chad and Lori
- 13:07Speaker 1: standing in front of the LDS temple in Hawaii. Wood
- 13:10Speaker 1: has no further questions. 10.34 a.m. John Pryor now questions Stubbs.
- 13:17Speaker 1: He asks about universal time and adjusting cellular data. Stubbs
- 13:20Speaker 1: says UTC is a standard time, and depending on where
- 13:24Speaker 1: you are in the world, it's UTC plus or minus hours.
- 13:28Speaker 1: In Rexburg, it's UTS 6 minus 6 hours. or minus seven,
- 13:32Speaker 1: depending on daylight savings. 10.36 a.m. Pryor asks for clarification
- 13:37Speaker 1: about who was living in which apartment in Rexburg. Pryor
- 13:40Speaker 1: asks if Stubbs went through the garages during his search.
- 13:43Speaker 1: He says yes. 10.38 a.m. Pryor asks Stubbs to review
- 13:48Speaker 1: 15 photos on a computer. Stubbs looks over them. 10.40 a.m.
- 13:53Speaker 1: Pryor asks Stubbs if he recognizes the photos. Stubbs says
- 13:56Speaker 1: he was involved in searching different apartments. and doesn't personally
- 13:59Speaker 1: recall seeing the items in the photo. 10.42 a.m. Pryor
- 14:04Speaker 1: asks if Stubbs found any evidence that tickets to Disneyland
- 14:07Speaker 1: or Knott's Berry Farm were purchased. Stubbs says he didn't
- 14:11Speaker 1: personally investigate that aspect of the case, but is aware
- 14:14Speaker 1: of the trip. 10.43 a.m. Pryor asks that because Lori
- 14:20Speaker 1: Vallow's apartment was vacated, that doesn't mean Chad Daybell's home
- 14:24Speaker 1: was vacated. Stubbs says they didn't search Chad's house. They
- 14:28Speaker 1: searched Lori's. 10.45 a.m. Pryor asks Stubbs if he is
- 14:32Speaker 1: aware that Chad Daybell is not implicated in the attempted
- 14:35Speaker 1: murder of Brandon. Stubbs is aware. 10.46 a.m. Pryor asks
- 14:40Speaker 1: Stubbs about trying to reach Melanie Gibb and saying that
- 14:43Speaker 1: Gibb lied to officers. Stubbs says he wasn't involved in
- 14:46Speaker 1: that part of the investigation. 10.48 p.m. Pryor asks Stubbs
- 14:51Speaker 1: about Lori saying she was going to move to live
- 14:53Speaker 1: with Melanie. He asks about Lori saying Melanie and JJ
- 14:57Speaker 1: were at Frozen 2. Pryor asks Stubbs if he looked
- 15:00Speaker 1: into the possibility that Lori was moving to live with Melanie.
- 15:03Speaker 1: Stubbs says they were looking into that possibility. 10.50 a.m.
- 15:08Speaker 1: Pryor asks if Stubbs ever looked at Melanie Gibbs' phone records.
- 15:12Speaker 1: Stubbs says no. He asks if Stubbs looked at David
- 15:14Speaker 1: Warwick's phone records. Stubbs says no. 10.51 a.m. Pryor says
- 15:20Speaker 1: David and Melanie were at Lori's house when JJ was
- 15:23Speaker 1: last seen alive. Pryor asks Stubbs if he agrees that
- 15:26Speaker 1: Lori was very convincing. Stubbs disagrees. Pryor talks about Stubbs
- 15:31Speaker 1: not taking action to keep Lori from fleeing during both
- 15:35Speaker 1: visits to her apartment. Stubbs says they had not established
- 15:38Speaker 1: JJ was not with Melanie Gibb at the time, so
- 15:40Speaker 1: they had no reason to detain her. You can't just
- 15:43Speaker 1: go and detain somebody, right? You have to have a reason.
- 15:45Speaker 1: There has to be a probable cause. You know, this
- 15:48Speaker 1: isn't Nazi Germany. You can't just kick in someone's door
- 15:51Speaker 1: and do whatever you want. I know some cops try
- 15:53Speaker 1: to do that, but if you want to have the
- 15:55Speaker 1: conviction stick, you better do it the right way. 10.53 a.m.
- 16:00Speaker 1: Stubbs made the comment, not not, after the visit to
- 16:03Speaker 1: Lori's apartment. That phrase is used in law enforcement, meaning,
- 16:07Speaker 1: turn off the body cameras. Stubbs says it allowed officers
- 16:10Speaker 1: to state their opinions without having them recorded. 10.55 a.m.
- 16:15Speaker 1: Pryor asked Stubbs how many calls he made to Chad
- 16:18Speaker 1: Daybell about JJ. Stubbs, personally, did not make any. There
- 16:22Speaker 1: was no warrant to search Chad's home at the time.
- 16:24Speaker 1: Pryor asked Stubbs if he ever found a message from
- 16:27Speaker 1: Chad to Lori that said, let's kill the kids. Stubbs
- 16:30Speaker 1: did not. So because there's no letter, that means there's
- 16:33Speaker 1: no conspiracy, huh? Is that really your defense, Mr. Pryor? 10.56 a.m.
- 16:39Speaker 1: Stubbs said Rob Wood was present during the search of
- 16:42Speaker 1: Lori Vallow's apartment. Pryor asks about Stubbs tapping phone calls.
- 16:47Speaker 1: Stubbs says no. A tap is to listen to someone.
- 16:49Speaker 1: They did not listen to anyone. Stubbs appears visibly annoyed
- 16:53Speaker 1: as he answers these questions. Pryor is trying to throw
- 16:55Speaker 1: a little bit of doubt into the investigation, right? Trying
- 16:58Speaker 1: to make it seem like they were misstepping, like they
- 17:01Speaker 1: were cutting corners and that there was some kind of
- 17:04Speaker 1: investigative misconduct here. That's what he's looking for, but it's
- 17:09Speaker 1: not going to work out for him. The strategy of
- 17:12Speaker 1: loopholes and technicalities is certainly not going to save Chad Daybell.
- 17:17Speaker 1: 11 a.m. Wood just objected to one of Pryor's questions.
- 17:20Speaker 1: Boyce overruled the objection and Pryor started to ask about
- 17:23Speaker 1: the question. Boyce said, Mr. Pryor, when I make a ruling,
- 17:27Speaker 1: don't ask another question. The witness can answer. 11.02 a.m.
- 17:31Speaker 1: Wood asked Stubbs why people research Malachite. Stubbs says it
- 17:35Speaker 1: has to do with spirituality or other things. 11.03 a.m.
- 17:40Speaker 1: Pryor has no further questions. Wood has some redirect. Wood
- 17:44Speaker 1: asked if Melanie Gibb or David Warwick showed up in
- 17:46Speaker 1: the geofence. Stubbs says no. Wood asked about the tap
- 17:50Speaker 1: and trace and why one wasn't done on Melanie Gibb.
- 17:53Speaker 1: Stubbs says Gibb was cooperating with the police. 11.05 a.m.
- 17:58Speaker 1: Wood asks if any of Gibb's or Warwick's kids were
- 18:00Speaker 1: found on Chad's property. Stubbs says no. Wood has nothing further.
- 18:05Speaker 1: And it's funny that he says that Gibb's was cooperating
- 18:07Speaker 1: with police. It's my opinion that if she didn't cooperate,
- 18:11Speaker 1: she would have been part of this whole thing. So
- 18:13Speaker 1: they probably rolled in there and told her, look, we
- 18:16Speaker 1: know you know more than you're telling us. And if
- 18:18Speaker 1: you don't tell us what you know, well, we're going
- 18:20Speaker 1: to charge you. And I'm sure that was enough to
- 18:23Speaker 1: get her to talk, right? To crack. Let's not make
- 18:25Speaker 1: pretend we're talking about hardened criminals here. Somebody like Melanie
- 18:29Speaker 1: Gibb is not going to be able to face the
- 18:31Speaker 1: pressure of one of these investigations and she's going to
- 18:35Speaker 1: turn on her co-conspirators. The police were aware of that
- 18:38Speaker 1: and they flexed on her and they got information from her.
- 18:41Speaker 1: But you better believe if she was reticent to give
- 18:44Speaker 1: that information over and she was playing games, they would
- 18:47Speaker 1: have definitely gotten a warrant on her phone and they
- 18:50Speaker 1: would have went through it. 11.05 a.m. Wood asks if
- 18:54Speaker 1: any of Gibbs or Warwick's kids were found on Chad's property.
- 18:58Speaker 1: Stubbs says no. Wood has nothing further. 11.07 a.m. Next
- 19:02Speaker 1: witness is FBI Special Agent Steve Daniels. 11.08 a.m. Daniels
- 19:07Speaker 1: was part of the Evidence Response Team, ERT, for the FBI.
- 19:11Speaker 1: He's worked for the FBI for 26 years. He left
- 19:14Speaker 1: ERT one year ago. 11.12 a.m. Daniel describes the extensive
- 19:20Speaker 1: training he completed to be part of the ERT. Since 2001,
- 19:23Speaker 1: he has helped recover human remains in many cases. When
- 19:27Speaker 1: he left ERT, he was the senior team leader in
- 19:30Speaker 1: the Salt Lake office. He was the senior team leader
- 19:33Speaker 1: in the search for JJ and Tylee. Daniels worked with
- 19:39Speaker 1: other FBI departments in the Rexburg Police Department while planning
- 19:42Speaker 1: the search of Chad's property. They came up with a
- 19:45Speaker 1: search strategy and got satellite imagery of the property. They
- 19:48Speaker 1: arrived on the property around 7 a.m. a.m. on June 9, 2020. 11.16 a.m.
- 19:54Speaker 1: Eight ERT members were on the site. They were each
- 19:57Speaker 1: assigned roles and responsibilities prior to arrival. Someone started a
- 20:01Speaker 1: crime scene log, another began taking photos of the crime scene,
- 20:05Speaker 1: and Daniel started an administrative log of the scene. He
- 20:08Speaker 1: also did a walkthrough of the property. 11.17 a.m. Two
- 20:13Speaker 1: ERT members were assigned to assess the fire pit. They
- 20:16Speaker 1: had text message talking about burying something in the pet cemetery,
- 20:20Speaker 1: so Daniels needed to figure out where the pet cemetery was.
- 20:24Speaker 1: They also had a few telephone pings on the property
- 20:27Speaker 1: from September 2019 showing where people were on the property. 11.20 a.m.
- 20:34Speaker 1: Wood asked for a brief sidebar. 11.26 a.m. Sidebar is over.
- 20:38Speaker 1: Wood moves to admit several photos. 11.30 a.m. All of
- 20:42Speaker 1: the photos were taken the day law enforcement searched Chad's
- 20:45Speaker 1: property for JJ and Tylee. 11.32 a.m. Daniels created an
- 20:50Speaker 1: interactive exhibit detailing the work they did on Chad's property.
- 20:54Speaker 1: He describes what a total station device is, a measuring
- 20:57Speaker 1: device that sits on a tripod, using a laser for
- 21:01Speaker 1: a point-to-point measuring. 11.34 a.m. A pharaoh scanner was used
- 21:06Speaker 1: to measure and scan things on the property. Over 40
- 21:09Speaker 1: scans were performed on the property. The data they collected
- 21:12Speaker 1: was voluminous. 11.37 a.m. Wood asked to admit the exhibit
- 21:17Speaker 1: Daniels prepared. It's the key points from all the scans, measurements, etc.
- 21:21Speaker 1: The exhibit is a summary of his findings. And this
- 21:24Speaker 1: is the most damaging information that the jury is going
- 21:27Speaker 1: to receive. When you have all of these spreadsheets, you
- 21:30Speaker 1: have these different exhibits that have been put together. It
- 21:33Speaker 1: puts it all into order for the jurors, right? Makes
- 21:38Speaker 1: it very easy for them to follow along with what
- 21:40Speaker 1: the prosecution is alleging. And basically what we're seeing is
- 21:44Speaker 1: a carbon copy of the Lori Vallow prosecution. They use
- 21:47Speaker 1: the same exact foundation to go after Vallow. And we
- 21:51Speaker 1: all know that that turned out to be very, very successful. 11.39 a.m.
- 21:55Speaker 1: The first slide on the screen shows key locations in
- 21:58Speaker 1: and around the city of Rexburg, including the Salem Church,
- 22:01Speaker 1: the Daybell property, Walmart, BYU, Idaho Library, and Lori's apartment. 11.41 a.m.
- 22:09Speaker 1: Wood is having some technical difficulties prior as for a sidebar.
- 22:12Speaker 1: He gets up to meet with Boyce and Blake as
- 22:15Speaker 1: core tech people go to assist Wood. 11.46 a.m. We're
- 22:19Speaker 1: going to break for lunch while the tech issues get
- 22:21Speaker 1: sorted out. We're just going to roll through and we're
- 22:23Speaker 1: going to finish out the day in this episode. 12.36 p.m.
- 22:27Speaker 1: Back in the courtroom. Larry Woodcock just passed out mints
- 22:30Speaker 1: to several people in the gallery. Kay is not here today. 12.41 p.m.
- 22:35Speaker 1: Two deputies just set up a table in front of
- 22:37Speaker 1: the jury. They are in their seats and Daniels is
- 22:40Speaker 1: on the stand. We see a photo of Chad's house
- 22:42Speaker 1: with a vehicle parked in the driveway. 12.43 p.m. The
- 22:47Speaker 1: next slide shows a photo taken from the second story
- 22:49Speaker 1: window looking toward a tree. JJ's remains were found under
- 22:53Speaker 1: the tree. There was a trailer parked near the tree.
- 22:56Speaker 1: It was a law enforcement trailer. Another photo from the
- 22:59Speaker 1: second story shows the view of the property from the
- 23:02Speaker 1: other direction. 12.45pm The next photo shows the view out
- 23:07Speaker 1: of the kitchen window. You can see the barn and
- 23:09Speaker 1: beyond the barn is Tylee Ryan's burial site and the
- 23:12Speaker 1: fire pit. Now we see an image of the property
- 23:15Speaker 1: taken from one of the bedrooms at the house. 12.47pm
- 23:20Speaker 1: We now see a satellite image of the property Daniels
- 23:22Speaker 1: points out the fire pit and the area near the tree,
- 23:25Speaker 1: where they had the telephone pings. Law enforcement did not
- 23:29Speaker 1: exactly know where the pet cemetery was located on the property. 12.48 p.m.
- 23:35Speaker 1: The next satellite image is a close-up of the fire pit.
- 23:37Speaker 1: The location of Tylee's grave is noted, along with the
- 23:40Speaker 1: spot where her charm was found. 12.51 p.m. Law enforcement
- 23:45Speaker 1: found a dog statue on the property and noticed some
- 23:47Speaker 1: depressions in the ground underneath. We see an image of
- 23:50Speaker 1: the grids police made on the property. 12.53 p.m. We
- 23:55Speaker 1: see a photo of exactly what the fire pit looked
- 23:57Speaker 1: like on June 9th. Daniel says the fire pit was
- 24:00Speaker 1: processed layer by layer. Then began by removing limbs and
- 24:05Speaker 1: then went through each layer one at a time. A
- 24:07Speaker 1: tarp was put down and wooden sifters were brought in
- 24:10Speaker 1: to sort through the soil. 12.56 p.m. A picture of
- 24:14Speaker 1: the fire pit with soil and rocks removed is now shown.
- 24:17Speaker 1: The next image is a metal necklace type of chain
- 24:20Speaker 1: found in the fire pit. Possible bone fragments and other
- 24:23Speaker 1: items were found in the fire pit. 12.58 p.m. The
- 24:28Speaker 1: next photo shows the silver charm that was collected in
- 24:30Speaker 1: the fire pit. This was one of the first pieces
- 24:33Speaker 1: of evidence we collected on June 9th. Daniel says the
- 24:37Speaker 1: charm was found just outside of the grid perimeter. The
- 24:39Speaker 1: next picture is a closer view of the charm. 12.59 p.m.
- 24:44Speaker 1: The charm was moved and put on a piece of
- 24:46Speaker 1: paper next to a placard marked with number 1. 101 p.m.
- 24:50Speaker 1: Some physical evidence will now be brought into the courtroom.
- 24:53Speaker 1: 102 p.m. A deputy wearing gloves brings in the pieces
- 24:57Speaker 1: of evidence. They are given to John Pryor for inspection
- 25:00Speaker 1: and then taken to Daniels on the witness stand. 103 p.m.
- 25:05Speaker 1: Daniels is wearing rubber gloves. He opens the exhibit and
- 25:08Speaker 1: we learn the piece of evidence is the necklace chain.
- 25:11Speaker 1: The other exhibit is the charm found at the fire pit.
- 25:14Speaker 1: 107 p.m. Wood displays the chain on the big screen
- 25:17Speaker 1: to the jury. The chain says Pura Vida. The team
- 25:21Speaker 1: found the chain while sifting through soil. Wood displays the
- 25:24Speaker 1: charm on the screen. Wood shows a photo of Tylee
- 25:27Speaker 1: and the picture Tylee is wearing the chain with the charm.
- 25:29Speaker 1: 1111 p.m. We now see an image of part of
- 25:33Speaker 1: the pet cemetery. Dog and cat remains were found in
- 25:36Speaker 1: the general area. The spot was processed by hand. going
- 25:40Speaker 1: layer by layer. The dog and cat remains were removed.
- 25:43Speaker 1: A backhoe was brought in to go deeper. Tylee's burial
- 25:47Speaker 1: site was just north of the pet cemetery site. 1.12 p.m.
- 25:52Speaker 1: Boyce says graphic photos will not be shown. The jury, prosecution,
- 25:55Speaker 1: and defense will see the images, but the public and
- 25:58Speaker 1: livestream will not. 1.15 p.m. Daniels describes the next photo.
- 26:03Speaker 1: It shows one of the two vertebrae found at the scene.
- 26:06Speaker 1: Daniels says around this time, there was a smell of
- 26:08Speaker 1: human decomposition. 1.17 p.m. By this point, the police had
- 26:13Speaker 1: already found JJ's burial site. Hand tools were brought in
- 26:17Speaker 1: at this point. The next photo shows a large white
- 26:19Speaker 1: piece of bone. This was Tylee's burial site. 1.19 p.m.
- 26:24Speaker 1: Daniel describes the next photo, which shows charred flesh. Shovels, rakes,
- 26:28Speaker 1: and a variety of other smaller tools were used at
- 26:31Speaker 1: this point. 1.21 p.m. The next photo shows pieces of Tylee.
- 26:36Speaker 1: These were the first pieces that we were able to say,
- 26:39Speaker 1: these are human remains. Crew started to wrap up for
- 26:41Speaker 1: the day and the remains went to the coroner. Jurors
- 26:44Speaker 1: are closely looking at the monitors in front of them
- 26:47Speaker 1: and some are taking notes. 1.23 p.m. The next picture
- 26:51Speaker 1: shows charring pink flesh, Daniel says. Daniels describes the following
- 26:55Speaker 1: photo of what the scene looked like on June 10th. 1.24 p.m.
- 27:00Speaker 1: Daniels describes orange stakes that were put up around Tylee's
- 27:04Speaker 1: burial site. The photo shows one of the wooden sifters. 1.26 p.m.
- 27:09Speaker 1: The next photo shows a melted green bucket. At the
- 27:12Speaker 1: bottom of the picture is Tylee's skull. The oil on
- 27:14Speaker 1: the top side, there was a harder substance to it
- 27:17Speaker 1: that made it difficult for us to excavate. Daniels believed
- 27:21Speaker 1: it could have been concrete, so a backhoe was brought
- 27:23Speaker 1: in to move it. 1.28 p.m. Daniels describes close-up photos
- 27:28Speaker 1: of the melted green bucket and the skull. When the
- 27:31Speaker 1: team went into the ground to remove the remains, they
- 27:34Speaker 1: fell apart, according to Daniels. He says everything fell to pieces,
- 27:38Speaker 1: and they picked them up and they put them into
- 27:40Speaker 1: the body bag. 1.31 p.m. An anthropologist went through the
- 27:44Speaker 1: remains once they were all removed. Daniels describes a photo
- 27:48Speaker 1: of some bricks that were found at the burial site. 1.32 p.m.
- 27:52Speaker 1: The backhoe went a little deeper and wider in the
- 27:54Speaker 1: burial site to make sure police had everything. Once the
- 27:58Speaker 1: backhoe was done, the animal remains were put back in
- 28:01Speaker 1: and the area was filled up with dirt. 1.35 p.m.
- 28:05Speaker 1: Wood displays a photo. Daniels describes it as the garage
- 28:08Speaker 1: barn on Daybell's property. Daniels was interested in what tools
- 28:13Speaker 1: could be used to bury someone. 1.37 p.m. The next
- 28:17Speaker 1: few photos show tools lined up in the garage. After
- 28:20Speaker 1: a brief sidebar, Boyce says there will be no afternoon
- 28:23Speaker 1: break today, but court will dismiss in about 30 minutes.
- 28:26Speaker 1: There are no more graphic pictures today, so everything will
- 28:29Speaker 1: now be displayed on the big screen. 1.42 p.m. We
- 28:33Speaker 1: now see an image of shovels and other tools that
- 28:35Speaker 1: were taken as evidence. These are the tools most likely
- 28:39Speaker 1: used in the burial, Daniel says. There is now a
- 28:42Speaker 1: solo photo of a pickaxe. There was debris on the
- 28:45Speaker 1: blade of the pick and other black marks. 1.44 p.m.
- 28:49Speaker 1: A photo that shows two shovels as evidence is shown
- 28:52Speaker 1: on the screen. Other tools were taken. A saw, clippers,
- 28:56Speaker 1: an axe. Tools that could have been used to do
- 28:59Speaker 1: something to human remains that were found, Daniel says. 1.45 p.m.
- 29:04Speaker 1: Wood displays more photos showing tools in the garage. 1.47 p.m.
- 29:09Speaker 1: All tools were turned over to the Rexburg Police Department.
- 29:12Speaker 1: Wood moves to admit some physical evidence. A police officer
- 29:15Speaker 1: and deputy bring in tools. Daniels approaches the table wearing
- 29:19Speaker 1: gloves and will testify holding a microphone. 1.49 p.m. Daniels
- 29:24Speaker 1: unwraps the pick and holds it up in front of
- 29:26Speaker 1: the jury. Daniels says the pick was dirty. Daniels unwraps
- 29:30Speaker 1: the next exhibit. It's a shovel. 1.52 p.m. Daniel says
- 29:35Speaker 1: the shovel seems dirty and was a tool they were
- 29:38Speaker 1: interested in from the scene. The two pieces of evidence
- 29:41Speaker 1: are removed from the courtroom. Boyce says we will now
- 29:44Speaker 1: break until Monday. Alright, so, another interesting day at the
- 29:48Speaker 1: Chad Daybell trial, but again, in my opinion, same old,
- 29:52Speaker 1: same old. The prosecution continues to make its case, they
- 29:55Speaker 1: continue to slam it home, and I have no idea
- 29:58Speaker 1: how Chad Daybell thinks he's going to get out from
- 30:00Speaker 1: underneath all of this. But either way, we'll be following
- 30:03Speaker 1: along every step of the way until the jury provides
- 30:07Speaker 1: a verdict. All of the information that goes with this
- 30:10Speaker 1: episode can be found in the description box.
