- 2:03Speaker 3: Charleston City Council met and the discussion on marijuana continues.
- 2:08Speaker 3: Councilman Chad Robinson, one of the council members who's kind
- 2:11Speaker 3: of been a part of the story from the very beginning.
- 2:18Speaker 3: We're having a little technical issue here because I screwed
- 2:20Speaker 3: something up royally. So Ryan, I'm gonna take care of
- 2:23Speaker 3: this for you right now. Okay, just one second, and
- 2:27Speaker 3: I'm going to tell you a funny story about what
- 2:29Speaker 3: your radio buddy Dave did here that really actually you know,
- 2:34Speaker 3: that is right? That is right. Okay. We are trying.
- 2:37Speaker 3: Here's what's going on. We are trying to get Amanda
- 2:40Speaker 3: east ap Burton, who is a former member of the
- 2:43Speaker 3: House of Delegates here and from the canaw County area,
- 2:48Speaker 3: and we are trying to get her on the phone
- 2:50Speaker 3: from the Democratic National Convention. I actually texted her about
- 2:52Speaker 3: thirty minutes ago and said, are we going to be
- 2:55Speaker 3: good to go? And she said, yeah, just call us.
- 2:57Speaker 3: And every time we try to call miss burd it
- 3:00Speaker 3: goes straight to voicemail. So we're efforting. We're efforting right
- 3:04Speaker 3: now to try to get her on the phone. But
- 3:06Speaker 3: for some reason it keeps going straight to voicemail. So
- 3:10Speaker 3: maybe a reception issue. One would think in Chicago that
- 3:12Speaker 3: you would have you'd have good reception, but apparently not,
- 3:17Speaker 3: so we're trying. We're efforting. Ryan is working feverishly trying
- 3:21Speaker 3: to get her on the show. So I just I
- 3:24Speaker 3: think we just texted you. I'm going to send you
- 3:27Speaker 3: another number. Ryan. There's nothing like technology when it works,
- 3:32Speaker 3: and me trying to do this while talking on the air.
- 3:35Speaker 3: So just give me one second here, and all right,
- 3:42Speaker 3: I just sent you In case I type the number wrong,
- 3:45Speaker 3: Ryan in the email, I just texted you her phone number,
- 3:49Speaker 3: so hopefully I got it right. It's still that's the
- 3:52Speaker 3: right number we have and it's still going straight to voicemail. Okay. Well,
- 3:55Speaker 3: we tried Amanda, Amanda frequent, She's been a guest on
- 3:58Speaker 3: the show several times. We try, but it just keeps
- 4:01Speaker 3: going straight to voicemail. So I just texted her Ryan
- 4:04Speaker 3: and said, okay, track calling us. So well, we'll see
- 4:07Speaker 3: if that works. We will make an effort to get
- 4:09Speaker 3: her on the show. But anyway, back to the Charlet
- 4:11Speaker 3: City Council story, Councilman Chad Robinson is going to join
- 4:14Speaker 3: us a little bit later on the show. This has
- 4:16Speaker 3: been an effort by certain members of city council to
- 4:20Speaker 3: not decriminalize marijuana and to not make it legal or
- 4:23Speaker 3: anything like that. It's basically just to kind of change
- 4:26Speaker 3: the wording and some of the what many people think
- 4:30Speaker 3: was archaic language that was written into city code years
- 4:34Speaker 3: and years ago, and it's really not even in line
- 4:36Speaker 3: with what West Virginia law is. And so basically it
- 4:39Speaker 3: I'm gonna let Chad get into this a little bit
- 4:40Speaker 3: later on, but basically what was passed last night, and
- 4:43Speaker 3: we'll get the current status of it, but basically it's
- 4:45Speaker 3: not going to be jail time and not going to
- 4:48Speaker 3: be as many finds or things of that nature, if
- 4:51Speaker 3: any finds at all. So I'll let Chad discuss us
- 4:56Speaker 3: a little bit later. And this has not been nearly
- 4:58Speaker 3: as controversial as what you would think it would be.
- 5:02Speaker 3: It's you know, and I guess the attitudes toward marijuana
- 5:08Speaker 3: have changed greatly over the years. And we'll get into
- 5:12Speaker 3: that fire.
- 5:13Speaker 5: I got.
- 5:13Speaker 3: There's some issues I have with though, and I'll get
- 5:15Speaker 3: into that with Chad a little bit later on. But
- 5:17Speaker 3: I do understand now that Ryan looks like he's getting
- 5:21Speaker 3: my attention like he's got in an airplane in in here.
- 5:23Speaker 3: I think we have a delegate to the DNC, Amanda
- 5:27Speaker 3: eastep Burton with it, Samanda, you there, It just kept
- 5:32Speaker 3: going straight to voicemail.
- 5:33Speaker 5: Well, so I'm in the basement of the hotel for
- 5:36Speaker 5: our mandatory breakfast, so I can't miss the breakfast floors underground.
- 5:41Speaker 3: A lady after my own heart. You're not going to
- 5:44Speaker 3: miss the breakfast, all right. So we got you now,
- 5:46Speaker 3: and we won't keep you along. We'll let you get back.
- 5:48Speaker 3: What will he happened for breakfast?
- 5:49Speaker 5: By the way, Oh so it's actually horrible. It's hotel
- 5:53Speaker 5: eggs and cornby fash.
- 5:55Speaker 3: Well, I like corn beef hash. I mean, they need
- 5:57Speaker 3: some tutors up in there, do they not?
- 5:58Speaker 5: They do? I would give anything for to your career now,
- 6:02Speaker 5: all right?
- 6:03Speaker 3: All right, So Amanda's with us right now. She's one
- 6:04Speaker 3: of the delegates, one of the local How many delegates
- 6:06Speaker 3: are there to the DNC from this.
- 6:08Speaker 5: Area, So there's twenty seven of us. I don't I
- 6:11Speaker 5: think twenty five are delegates. We have some alternates and pages,
- 6:15Speaker 5: but they're twenty seven with the West Virginia delegation.
- 6:18Speaker 3: Okay, all right, And of course President Biden spoke last night.
- 6:23Speaker 3: I want to go so far? Is this your first
- 6:25Speaker 3: one of these that you've gone to the DNC is
- 6:27Speaker 3: the first one?
- 6:27Speaker 5: Absolutely, my first one.
- 6:29Speaker 3: All right, Well, so it was that everything you would
- 6:31Speaker 3: thought it would be.
- 6:31Speaker 5: So far, So far it is so much more than
- 6:34Speaker 5: I thought it would be, so exciting, it's so much
- 6:36Speaker 5: it's a great.
- 6:37Speaker 3: So set the mood for us in Chicago, Amanda, after
- 6:41Speaker 3: after day and Night one, As I said, President Biden
- 6:44Speaker 3: spoke last night, as there were some other speakers as well,
- 6:47Speaker 3: talk about Day.
- 6:48Speaker 5: One, Day one. The energy is high. Everybody's really eager
- 6:53Speaker 5: and excited. There are a lot of people send three
- 6:56Speaker 5: overload lights, cameras, action everywhere you go. But everybody's just
- 7:01Speaker 5: really hopeful and energized and happy to be together.
- 7:06Speaker 3: Do you get the idea, Amanda, that most of the
- 7:09Speaker 3: Democrats you've encountered their supported President Biden's decision to step
- 7:12Speaker 3: aside and for Vice President Harris to step up.
- 7:15Speaker 5: Oh, I think so. I haven't seen anybody opposed to it.
- 7:19Speaker 3: Well, tonight among the speakers, the Obamas are scheduled to
- 7:22Speaker 3: speak tonight, And I'm going to go ahead and make
- 7:23Speaker 3: a prediction right now. I don't care what people think
- 7:25Speaker 3: about Barack Obama. He's a dynamic speaker. One way or
- 7:28Speaker 3: the other. And I think he's going to blow the
- 7:31Speaker 3: roof off that place.
- 7:32Speaker 5: Tonight, I hope. So I agree with you. I absolutely
- 7:35Speaker 5: agree with you.
- 7:36Speaker 3: He's a fantastic, fantastic speaker. Again, we're talking with Amanda
- 7:41Speaker 3: east at Burton, who is a delegate from West Virginia
- 7:43Speaker 3: to the Democratic National Convention in Chicago. I know you obviously,
- 7:47Speaker 3: or I would think you probably didn't spend a great
- 7:49Speaker 3: deal of time watching the Republican National Convention last month,
- 7:52Speaker 3: but I'm sure you saw some of it, at least
- 7:54Speaker 3: the highlights. Comparing contrast, Amanda, the message that you saw
- 7:57Speaker 3: coming out of the r NC with what you're seeing
- 8:00Speaker 3: thus far in Chicago with the DNC, Dave.
- 8:03Speaker 5: Honestly, I don't watch much TV, and I only caught
- 8:07Speaker 5: like the entertainers from the R and C and the
- 8:09Speaker 5: JD vance introduction, so I don't really know what happened
- 8:12Speaker 5: at the RNC, So to compare the messages, I would
- 8:17Speaker 5: be lying if I said I even knew what the
- 8:19Speaker 5: message of the RNC was.
- 8:21Speaker 3: I appreciate your honesty. That's one of the reason why
- 8:23Speaker 3: I love heavy on the show from time to time.
- 8:26Speaker 3: What message, Amanda, do you want to impart to the
- 8:29Speaker 3: listeners this morning about voting for and supporting not just
- 8:32Speaker 3: Kamala Harris, but but Democrats in general, because as you know,
- 8:36Speaker 3: it's a big ask of people in a dark red state, Amanda.
- 8:39Speaker 5: It absolutely is, and I realize it's an uphill battle.
- 8:44Speaker 5: The Democrats and Kamala Harris especially are working to rebuild
- 8:47Speaker 5: the middle class, revive our economy, make it to so
- 8:51Speaker 5: everyday working Americans can have an easier life and find
- 8:56Speaker 5: quality job.
- 8:58Speaker 3: Why do you think that Kamala Harris is a better
- 9:00Speaker 3: choice for president than former President Trump?
- 9:05Speaker 5: Well, I mean, for instance, part of someone's speech last
- 9:10Speaker 5: night was that the billionaires in America pay eight and
- 9:13Speaker 5: a half percent tax. Well, my tax rates much higher
- 9:15Speaker 5: than eight and a half percent. Why aren't they at
- 9:17Speaker 5: least paying what I'm paying? Because we need to start
- 9:21Speaker 5: taxing wealthier people, some middle class people can be more
- 9:27Speaker 5: have a better quality of life.
- 9:30Speaker 3: Okay, anything else that excites you about to about Kamala
- 9:33Speaker 3: Harris as opposed to Donald Trump? A man, I know
- 9:35Speaker 3: you're a Democrat. I know you're going to support Kamala Harris,
- 9:37Speaker 3: but what are some of the things that for you
- 9:39Speaker 3: are are are going to make you pull that lever
- 9:41Speaker 3: other than the fact that she's the Democrat, what are
- 9:43Speaker 3: some of the things that are going to make you
- 9:45Speaker 3: pull that lever come November.
- 9:47Speaker 5: So this is a real opportunity for us to really
- 9:48Speaker 5: get to know Kamala what we all know, who she is,
- 9:52Speaker 5: not many of us know a lot about her. So
- 9:55Speaker 5: I can't exactly tell you everything that excites me about
- 9:58Speaker 5: her because I'm sure I'm going to learn a lot
- 9:59Speaker 5: more this week. But she is, she has she has
- 10:03Speaker 5: been a working class citizen. She has came from the
- 10:08Speaker 5: you know, she grew up a lot like I did.
- 10:11Speaker 5: She has worked hard for a living to achieve what
- 10:13Speaker 5: she's achieved, and look at her. She's amazing. So I'm
- 10:17Speaker 5: really excited to get to know more about her and
- 10:20Speaker 5: just grow from her.
- 10:22Speaker 3: Have you seen any of the protesters? I know a
- 10:24Speaker 3: lot was made about the protesters and their state's going
- 10:26Speaker 3: to ramp up as the week goes along, Amanda, have
- 10:29Speaker 3: you seen any any protesters?
- 10:31Speaker 5: So, yes, I have, and I'm obviously we're walking around
- 10:33Speaker 5: the city. Everything's really secure, but I have not seen
- 10:36Speaker 5: the level of protesting that I've seen when I've turned
- 10:39Speaker 5: on the news. I don't care which news media is.
- 10:42Speaker 5: It's like they've got some zoomed in shots of a
- 10:46Speaker 5: few people protesting. There's not mass protests happening around me.
- 10:50Speaker 5: I don't feel unsafe. We have some transportation that takes
- 10:54Speaker 5: us from our hotel to the Convention Center, Secret Services
- 10:57Speaker 5: on it. They had to reroute us because there was
- 10:59Speaker 5: some a test in front of the United Center yesterday
- 11:02Speaker 5: that they have to use some feargas for. But I
- 11:06Speaker 5: haven't felt unsafe for a second. I think everybody has
- 11:10Speaker 5: a right to protest, just do so peacefully, and everything's fine.
- 11:14Speaker 3: So what's on tap for today?
- 11:17Speaker 5: I mean today we have the Obamas. Honestly to yesterday.
- 11:20Speaker 5: I learned more about the agenda for the evening ceremonies
- 11:24Speaker 5: from watching CNN. So James Taylor is supposed to be
- 11:28Speaker 5: there last night, he may be there tonight. We've got
- 11:31Speaker 5: the Obamas, We've got several great speakers lined up. This afternoon,
- 11:34Speaker 5: We've got caucus meetings, so I'll be attending the Rural
- 11:37Speaker 5: Caucus because you know, I'm from West Virginia's free rural
- 11:39Speaker 5: and the Women's Caucus at nine point thirty. Yeah, So
- 11:43Speaker 5: it's just it's just a bunch of beatings, learning, growing
- 11:46Speaker 5: and connecting with each other.
- 11:48Speaker 3: Well, I appreciate you taking time away from your corn
- 11:50Speaker 3: beef hash. Sorry, sorry, it's not tutors. If we ever
- 11:54Speaker 3: get these folks to West Virginia, we'll learn them. We'll
- 11:57Speaker 3: learn them on what they eat. Right absolutely about time,
- 12:01Speaker 3: Amanda Ea step Burton. I appreciate you being there. Have
- 12:03Speaker 3: fun and try to keep Mike Pushkin out of jail. Okay, oh,
- 12:06Speaker 3: no problem, all right, we'll let you get back to it.
- 12:09Speaker 3: I appreciate you being here. Thanks a lot, Amanda Eas
- 12:12Speaker 3: step Burton. And she's a delegate to the Democratic National
- 12:15Speaker 3: Convention in Chicago. The interesting about the protest what she said,
- 12:19Speaker 3: because you know, I wanted I actually just re xed
- 12:25Speaker 3: some some video from a friend of mine who does
- 12:27Speaker 3: radio in Pittsburgh of some of the more outlandish protests
- 12:32Speaker 3: that were there. I get that on my on my
- 12:35Speaker 3: social media, actually just on the on the X page.
- 12:38Speaker 5: Uh.
- 12:38Speaker 3: But but she says she hadn't seen a whole lot.
- 12:40Speaker 3: But then they had to reroute traffic because some protesters
- 12:44Speaker 3: had to be tear gassed. According to Delegate Burton, I
- 12:47Speaker 3: will mention this programming note that we will have coverage
- 12:51Speaker 3: of the d n C from Chicago. Again, the Obamas
- 12:54Speaker 3: will be speaking tonight and that's just some of the
- 12:57Speaker 3: speakers are just a couple that will be speaking tonight.
- 12:59Speaker 3: We'll have coverage following Reds Baseball tonight's via ABC. But

- 13:31Speaker 3: I got a little bit of a problem with that too,
- 13:33Speaker 3: But again I was being respectful because Amanda was doing
- 13:35Speaker 3: us a favor. I got a little bit of problem
- 13:37Speaker 3: with that that ideology as well. Uh, Texas, so she's
- 13:41Speaker 3: excited to vote for Harris because she's a Democrat. Not
- 13:43Speaker 3: any of her policies. Hope to learn why she supports her, says.
- 13:47Speaker 3: He what she's gonna learn, That's what she said. She said,

- 18:19Speaker 3: Ha ha, says a texture. All right, So Chad Robinson
- 18:24Speaker 3: is here city counciling in the great City of Charleston.
- 18:27Speaker 6: How are you, man?
- 18:27Speaker 3: Good?
- 18:28Speaker 10: Morning, Dave. I'm here having a good morning.
- 18:31Speaker 3: I'm having a good morning cool down some outside. I
- 18:33Speaker 3: love it. I went out to get to pay for
- 18:34Speaker 3: this morning man, and I was like, wow, this feels
- 18:37Speaker 3: like but next week it's going to be in the
- 18:39Speaker 3: mid nineties again.
- 18:40Speaker 10: So well it'll be talking about de view noon. Yes hot,
- 18:45Speaker 10: Yes against Penn State.
- 18:46Speaker 3: Yeah, go ahead and make your prediction on the game. Now.
- 18:49Speaker 10: I think we'll hang in there. I'm not sure we
- 18:51Speaker 10: can win, but we'll hang in.
- 18:52Speaker 3: There, spoke Hope Springs Eternal as they say, so Councilman
- 18:56Speaker 3: last night the conversation about simple possession of marijuana, and
- 19:00Speaker 3: you'd during the council meeting last night, you and Councilman
- 19:05Speaker 3: Anti I think had been on this kind of from
- 19:07Speaker 3: day one. So what happened last night? We passed a bill.
- 19:11Speaker 10: I don't think it's a bill that either side wanted,
- 19:14Speaker 10: but it's a bill that we passed, and I think
- 19:16Speaker 10: it's a good piece of legislation that moves Charles forward.
- 19:20Speaker 10: At passed twenty to five. Lots of discussion, as you know,
- 19:24Speaker 10: and you said earlier that we had this bill back
- 19:27Speaker 10: in committee. We heard the bill on my committee three times.
- 19:32Speaker 10: We also met with some interested parties and the Charlesto
- 19:36Speaker 10: and Police department in between those meetings. And you know,
- 19:40Speaker 10: when both sides aren't happy, that's usually a good piece
- 19:43Speaker 10: of legislation, as we do at the Capitol.
- 19:46Speaker 3: So tell us take us back to and you've been
- 19:49Speaker 3: on the show three or four times talking about this,
- 19:51Speaker 3: but let's go back to the very beginning. Where did
- 19:54Speaker 3: this entire thing come from? Did you have a lot
- 19:57Speaker 3: of residents and the city and said we need to
- 19:58Speaker 3: look at it. Was it the police departm I'm in
- 20:00Speaker 3: a combination of all the above. How did this whole
- 20:03Speaker 3: idea come about?
- 20:05Speaker 10: Well, I'm the chairman of Ordnance and Rules Committee on
- 20:07Speaker 10: City Council and I perceive my role as chairman to
- 20:11Speaker 10: look at code, outdated code or ordinances that we can change,
- 20:16Speaker 10: update to state code. This part of our ordinances about
- 20:22Speaker 10: marijuana and simple possession has not been updated since twenty
- 20:26Speaker 10: eleven and state code has changed since then.
- 20:29Speaker 3: So basically what this does is work. Let me go
- 20:31Speaker 3: back to that state code has changing and send for
- 20:33Speaker 3: the listeners what has changed in.
- 20:35Speaker 10: State the different penalties things of that sort. I mean
- 20:37Speaker 10: marijuana has evolved. I mean it you know, look, I
- 20:40Speaker 10: think my personal opinion, I think we're behind times in
- 20:43Speaker 10: West Virginia. I mean, Ohio just passed recreational. I'm not
- 20:46Speaker 10: a marijuana user, but we're the financials of recreational are
- 20:51Speaker 10: beneficial for West Virginia. I mean, look, Ohio's right next door.
- 20:56Speaker 10: It's coming. But we need to update our code in
- 20:58Speaker 10: in terrust. And it's just it's dealing with simple possession.
- 21:02Speaker 3: And so define again for the people who may not
- 21:04Speaker 3: have heard your other interviews, what are we talking about
- 21:06Speaker 3: with simple possessions are lower?
- 21:08Speaker 2: All right?
- 21:08Speaker 3: So I'm downtown and I get stopped for something. Not
- 21:12Speaker 3: that I would because I'm not a marijuana user either,
- 21:14Speaker 3: but I would get stopped for something and they find
- 21:17Speaker 3: it on me. They are frisking me for some other reason,
- 21:20Speaker 3: and it's my first defense. It's simple possession at that point, right.
- 21:23Speaker 10: Correct, fifteen grams or lower, you could be pulled over.
- 21:28Speaker 10: It could be a reason to search things of that sort.
- 21:31Speaker 10: The officer's discretion of whether it's simple possession or intent
- 21:36Speaker 10: to distribute over fifteen grams.
- 21:38Speaker 3: Yeah, because if you're doing under fifteen and you're going
- 21:41Speaker 3: to sell it, you're the worst salesman. In the world.
- 21:43Speaker 10: That's probably right. I don't know anything about I couldn't
- 21:46Speaker 10: tell you what fifteen grams looks like. Well, it's not
- 21:48Speaker 10: a whole lot. I didn't think, so it's not a
- 21:50Speaker 10: whole lot. But and also too, just this is municipal court.
- 21:54Speaker 10: This has nothing to do with magst court. If a
- 21:57Speaker 10: state trooper pulls you over or searched you, or a
- 22:00Speaker 10: county sheriff deputy sheriff, that stuff, those things would go
- 22:04Speaker 10: to master court. Just all municipal, municipal court citations.
- 22:07Speaker 3: Yea, all within the City of Charleston. And we're talking
- 22:09Speaker 3: with councilmen Chad Robinson, and I think it's very important
- 22:14Speaker 3: as I heard the audio from the city council meeting
- 22:17Speaker 3: this morning on our news that you you said on
- 22:20Speaker 3: the record, you know, in front of God and everybody there,
- 22:22Speaker 3: that we are not legalized in marijuana in the City
- 22:24Speaker 3: of Charleston.
- 22:25Speaker 10: I started, I started my comments, this does not legalize marijuana.
- 22:29Speaker 3: Because that was a misconception out there, is that we're
- 22:31Speaker 3: going to become a mini Denver.
- 22:33Speaker 10: And we can't. The federal government has to schedule marijuana. Reschedule,
- 22:37Speaker 10: then the state has to take action, and then that
- 22:40Speaker 10: gives the municipalities the opportunity to change their ordinances if
- 22:43Speaker 10: that ever happens.
- 22:44Speaker 3: So what has been the response from people when you talk?
- 22:47Speaker 3: I mean, obviously there's people that have brought this up
- 22:49Speaker 3: to you, as I said, from various parts of the community,
- 22:51Speaker 3: from law enforcement to residents and so on and so forth.
- 22:53Speaker 3: I know you're a guy that listens a lot to
- 22:56Speaker 3: your constituents. What has been the response to even that.
- 23:00Speaker 3: I know it just happened last night, but the discussion
- 23:02Speaker 3: about the whole thing overall, it's well received.
- 23:06Speaker 2: You know.
- 23:06Speaker 10: I took my time, you know, a lot of times
- 23:09Speaker 10: that council and a lot of times at state Capital.
- 23:11Speaker 10: You know, things are brought up in committee, passed and
- 23:14Speaker 10: done well. This bill was introduced on July first, so
- 23:18Speaker 10: we took over six weeks of time, effort, discussion, brought
- 23:23Speaker 10: everybody in. We went from one extreme of the introduced
- 23:26Speaker 10: version to the other extreme of no penalties, no jail
- 23:29Speaker 10: time for any offenses, and then we brought it back
- 23:32Speaker 10: to the middle, and I think we passed a good
- 23:34Speaker 10: piece of legislation.
- 23:35Speaker 3: This is an editorial comment on my behalf chat and
- 23:37Speaker 3: it has nothing to do with you, but I think
- 23:41Speaker 3: there are one of the reasons why that across America
- 23:45Speaker 3: that a lot of people that may not necessarily be
- 23:49Speaker 3: that all part of the pun fired up anti marijuana
- 23:54Speaker 3: get a little bit sideways on this because there are
- 23:58Speaker 3: those who want marijuana to be I can smoke it anywhere,
- 24:02Speaker 3: I can do it anywhere or whatever, and that I
- 24:04Speaker 3: think that hurts the argument.
- 24:06Speaker 10: I agree with you, and it's those individuals are not
- 24:11Speaker 10: going to be happy or pleased with whatever we do
- 24:13Speaker 10: until it's legal and you can walk around charless and smoking,
- 24:16Speaker 10: smoking a blunt or smoking.
- 24:18Speaker 3: Marijuana, and that's not going to happen.
- 24:19Speaker 10: That's not going to happen with this peace of legislation, and.
- 24:22Speaker 3: Not at all. I mean it's not to say that
- 24:23Speaker 3: it couldn't happen eventually. Sure, it's because I think we
- 24:25Speaker 3: are going to get to the police Council when where
- 24:27Speaker 3: we're West Virginia legalizes marijuana.
- 24:30Speaker 10: I do too, and I think I think we should
- 24:32Speaker 10: be looking at it, but that's not that's not my decision, right, Yeah,
- 24:35Speaker 10: And I think it's very interesting and I think the
- 24:38Speaker 10: council and your rules Committee and anyone involved should be
- 24:42Speaker 10: committed for getting the police officers involved in this because
- 24:45Speaker 10: so many times when things like this are brought up,
- 24:50Speaker 10: and we saw this as an example with campus carry,
- 24:53Speaker 10: they didn't really talk to And I'm I am a
- 24:57Speaker 10: I know.
- 24:57Speaker 3: I'm getting off on a tangent here. I'm one hundred
- 24:59Speaker 3: percent Second Amendment, I'm pro gun whatever. But when that
- 25:03Speaker 3: legislation was crafted, one of the responses from law enforcements
- 25:06Speaker 3: they didn't really talk to us about this. And sometimes
- 25:09Speaker 3: that happens, you know, legislators or council people or commissions
- 25:13Speaker 3: or whatever. They want to do something, but they don't
- 25:15Speaker 3: talk to the people that this is going to directly
- 25:18Speaker 3: involve you folks did this, Yeah, and that's that's exactly.
- 25:21Speaker 10: You know, I've been at the state capital on my
- 25:23Speaker 10: real job for over twenty five years, and that's the
- 25:25Speaker 10: best thing to do. Bring everybody in. I don't you know,
- 25:28Speaker 10: I might. I told one of the advocates for West Virginia,
- 25:32Speaker 10: can't wait. You can't get everything you want. You have
- 25:37Speaker 10: to negotiate and get to something that we can pass.
- 25:41Speaker 10: And I think we did that. I mean, I'm of
- 25:44Speaker 10: the of the opinion that if a person makes a mistake,
- 25:49Speaker 10: and that's what we're trying to do. If somebody makes
- 25:50Speaker 10: an honest mistake and has a simple possession charge, they
- 25:53Speaker 10: should have the opportunity to get rid of that second offense. Okay,
- 25:57Speaker 10: you know, maybe you had a second offense and you
- 26:00Speaker 10: messed up. But as we get down the line the third, fourth,
- 26:03Speaker 10: and fifth, you have to start learning. And that's what
- 26:06Speaker 10: this bill does.
- 26:07Speaker 3: Zero two fifty five.
- 26:08Speaker 10: Hundred on the first, second, and third offensive.
- 26:11Speaker 3: So when I mean, is it over now?
- 26:12Speaker 8: Is it done?
- 26:13Speaker 10: It is past twenty to five last night.
- 26:15Speaker 3: When is it going to five days?
- 26:17Speaker 10: So after last night?
- 26:19Speaker 3: Five days after last night? So okay. One of the
- 26:22Speaker 3: comments that was made from one of the individuals that
- 26:23Speaker 3: spoke last night, a counseled again, I wasn't there, but
- 26:26Speaker 3: I did hear it, and I don't recall a gentleman's
- 26:29Speaker 3: name is really not important. But it was someone from
- 26:30Speaker 3: the public who said something to the effect of this
- 26:33Speaker 3: was going to negatively impact low income people. I'm sorry, counselmen,
- 26:39Speaker 3: I can't go along with that. I mean, I'm sorry.
- 26:43Speaker 3: If it's still illegal, then it doesn't matter what your
- 26:47Speaker 3: income is. You're still breaking the law, no matter if
- 26:49Speaker 3: you're a multi millionaire or your minimum wage worker. That's
- 26:52Speaker 3: just where I am totally agree.
- 26:53Speaker 10: I think you know, just like I said, you know,
- 26:56Speaker 10: sometimes there's a mistake made, you know, second, second time, Okay,
- 27:00Speaker 10: but it doesn't matter. You're still making mistakes and you
- 27:02Speaker 10: should pay the pay the fine. And you know, there's
- 27:04Speaker 10: no jail time. Last year, I think there was over
- 27:07Speaker 10: two hundred citations written for simple possession. There was no
- 27:11Speaker 10: jail time given by the municipal judge. Back in twenty nineteen,
- 27:14Speaker 10: I think it's over three hundred, uh and there's no
- 27:16Speaker 10: jail time.
- 27:17Speaker 3: So again, we've updated our code.
- 27:19Speaker 10: We worked with the officers. I think this helps them
- 27:22Speaker 10: in Charleston, and I think it's it's it's middle of
- 27:24Speaker 10: the middle of the road passage of something that need.
- 27:28Speaker 3: To be updated. Now, what you're gonna do about the
- 27:31Speaker 3: trafficking Kanal City, Oh, don't start that one thing at
- 27:36Speaker 3: a time. You know you brought that up.
- 27:37Speaker 10: You know, November, it's almost November. You know what, let's
- 27:40Speaker 10: see if we have a road November.
- 27:42Speaker 3: What else you're working on? What else? Has said this
- 27:44Speaker 3: is kind of taking up a lot of your time.
- 27:46Speaker 3: But but there's other things on every council person's agenda
- 27:49Speaker 3: and on your plate. What you're looking at?
- 27:52Speaker 10: Hey, you look at Morgantown, you look at wheeling. The
- 27:55Speaker 10: pay handling issue. UH, there's several years ago I introduced
- 27:59Speaker 10: a bill to UH restrict pain handling or reduced for
- 28:02Speaker 10: safety call safety reasons. I'd like to read, you know,
- 28:06Speaker 10: readdress that at some point we have to again look at.
- 28:11Speaker 3: The the and you're just asking for trouble much. You
- 28:13Speaker 3: can't wait people, You know that.
- 28:15Speaker 10: But you know what, Dave, it's it's a safety concern.
- 28:18Speaker 11: You know.
- 28:18Speaker 10: You here, counselman, counsel woman, fag You talk about the
- 28:21Speaker 10: west side, They're they're standing in the medians, are standing
- 28:23Speaker 10: in the right of ways Knaus City. You talk about
- 28:26Speaker 10: the construction, they're standing in the middle of the construction
- 28:29Speaker 10: and asking for money. We have programs in trusts and
- 28:32Speaker 10: that can help these people, and that's what I want
- 28:34Speaker 10: to do.
- 28:34Speaker 3: If they want help, If they want help, and sadly
- 28:37Speaker 3: a lot of the people with the programs will tell
- 28:39Speaker 3: you that, sadly a lot of them don't want the help.
- 28:41Speaker 3: That's exactly right.
- 28:42Speaker 10: I understand that's a give me a hammer and beat
- 28:44Speaker 10: my head, all.

- 32:11Speaker 3: I can't understand the cognitive distance, the dissonance anyway, Dave,
- 32:16Speaker 3: give me your best argument for taxing the rates less.
- 32:19Speaker 3: And if you say job creation, know that the data
- 32:21Speaker 3: doesn't support your position. If you think it does, cite it.
- 32:25Speaker 3: It's an argument for another time. I never said that
- 32:27Speaker 3: I think that the rich should should be taxed less
- 32:30Speaker 3: at all. I never said that at all. Texas says
- 32:35Speaker 3: nice to see the council and mayor undercut the CPD
- 32:37Speaker 3: once again. Hope the officers start to cite under state
- 32:40Speaker 3: law and run the tickets through Kanawha County Court, says
- 32:44Speaker 3: the texture. Brad Mcilhenny's here, Brad, good morning, how you doing?
- 32:47Speaker 4: Good morning, Dave. I'm doing well, And it tracts to
- 32:51Speaker 4: have somebody like yourself ask me questions and respond from
- 32:54Speaker 4: my question.
- 32:56Speaker 3: You know, it may seem, Brad like we just throw
- 32:59Speaker 3: this show together, but myself and the other talk show
- 33:01Speaker 3: host around the state who have shows similar to mine
- 33:03Speaker 3: in various cities. We're in a group email where we
- 33:07Speaker 3: all share topics and gat etc. Et cetera. This morning
- 33:10Speaker 3: I was telling people what I was doing on the show,
- 33:12Speaker 3: and when mentioned in your appearance, I said, Brad would
- 33:16Speaker 3: be giving us a talk about his new book, which
- 33:18Speaker 3: is entitled The Governor and Others who Won't Talk to Me?
- 33:21Speaker 4: Is it too soon for that, Brad Well, I've only
- 33:24Speaker 4: got the one chapter, but I'm working on all right.
- 33:26Speaker 3: Lead story this morning, BRADWV Metro News dot com. Stop
- 33:29Speaker 3: me if you've heard this before. The governor's financial issues.
- 33:33Speaker 3: Now it's health insurance for Greenbrier workers.
- 33:38Speaker 4: And that was a story first worken by the Real
- 33:41Speaker 4: w E, which is a nonprofit news agency in the
- 33:44Speaker 4: Grand Barra Valley. It's run by former Senate Minority Leader
- 33:48Speaker 4: Stephen Baldwin, who has taken on a journalistic hat, you
- 33:54Speaker 4: know hat sort of speak in that area. And you
- 33:57Speaker 4: know he's got good sources. Baldwin does because that community
- 34:03Speaker 4: is just filled with Green Brier employees or people who
- 34:07Speaker 4: depend on the green Brier as an economic driver. And
- 34:13Speaker 4: of course, a letter went out to the Green Brier's employees.
- 34:18Speaker 4: Kind of a stunner yesterday, maybe not in retrospect, but
- 34:22Speaker 4: a stunner in the moment to say that that the
- 34:26Speaker 4: owners of the Green Brier are severely behind four months
- 34:31Speaker 4: to the tune of millions of dollars on their premiums
- 34:35Speaker 4: for health insurance. Furthermore, that letter said that the employees
- 34:39Speaker 4: of the Greenbrier who would be cut off their health
- 34:42Speaker 4: insurance next week, one week from today, if the Green
- 34:46Speaker 4: Brier doesn't make good on it. And finally, there was
- 34:52Speaker 4: a reference in that letter written by lawyers for the
- 34:58Speaker 4: insurance company that help insurance provider to say that the
- 35:03Speaker 4: Grammar had collected premiums from those employees and then didn't
- 35:09Speaker 4: pass on the money. So, you know, just an incredible
- 35:13Speaker 4: and upsetting set of circumstances.
- 35:17Speaker 5: There.
- 35:18Speaker 4: I obviously sometimes get a public reaction on social media
- 35:23Speaker 4: to elements of this Greenbrier saga and the other justice
- 35:30Speaker 4: financial problems, but yesterday really touched a nerve and there
- 35:35Speaker 4: was a lot of social media response, and I think
- 35:37Speaker 4: it's just because it you know, to owe seven hundred
- 35:41Speaker 4: million dollars to international banker credit switch is one thing,
- 35:46Speaker 4: but kind of unimaginable three hundred million dollars to your
- 35:50Speaker 4: longtime local banker quarter bank. Again a vast amount, but
- 35:54Speaker 4: hard to imagine that people can put themselves in the
- 35:57Speaker 4: shoes of those hard working employees who are will have
- 36:01Speaker 4: to be worried one week out about whether they are
- 36:06Speaker 4: going to have health insurance next week, and who must
- 36:08Speaker 4: at the same time be a gas and four or
- 36:12Speaker 4: five if it's true that the groundar collected their premiums
- 36:16Speaker 4: and then didn't put it toward that health insurance.
- 36:19Speaker 3: Brad, I agree with you, and I was actually going
- 36:20Speaker 3: to say that, you know, you and I and normal
- 36:23Speaker 3: people cannot relate to owing millions and millions of dollars
- 36:27Speaker 3: to a bank or to a lending service, or whatever
- 36:30Speaker 3: the case may be. But when we start talking about
- 36:32Speaker 3: dangling people's health insurance in front of them, people that
- 36:36Speaker 3: and I don't know what people at the Greenbrier make,
- 36:38Speaker 3: but I'm gonna guess they all aren't making six figures, Okay,
- 36:41Speaker 3: not the ones that are cleaning your room and are
- 36:43Speaker 3: opening the doors and cooking and waiting tables. You start
- 36:46Speaker 3: at that point to say, okay, this is real now.
- 36:50Speaker 3: I mean it was always real, but this is really real.
- 36:53Speaker 3: Does that make any sense because you can think about that,
- 36:55Speaker 3: you know, put yourself in the position, no matter what
- 36:58Speaker 3: your job is, if you're fortunate enough to health insurance
- 37:00Speaker 3: to know that, through no fault of your own, I
- 37:04Speaker 3: may lose my health insurance because my employer didn't make
- 37:09Speaker 3: the premiums.
- 37:11Speaker 4: Yeah, I mean your heart goes out to those folks.
- 37:15Speaker 4: I've had significant public reaction to the stories that you
- 37:21Speaker 4: can wrap your arms around. The thing about chasing down
- 37:24Speaker 4: the helicopter and trying to liquidate it to pay down
- 37:29Speaker 4: that people. That captured people's imagination because you can imagine
- 37:33Speaker 4: the helicopters. I mean it was a little bit funny.
- 37:36Speaker 4: The US Marshall's trying to chase the thing down. The
- 37:41Speaker 4: potential auction of the ground brier has really captured the
- 37:45Speaker 4: public's imagination because you can't afford to go there. You
- 37:48Speaker 4: know what it looks like, you know, the lush green
- 37:50Speaker 4: grass of a golf course. You probably kind of pride
- 37:53Speaker 4: in it as a West Virginia. You know it's history
- 37:55Speaker 4: and its destination as a place that America's presidents have
- 38:00Speaker 4: gone members of Congress. Uh, So that that pride is
- 38:04Speaker 4: in your heart and you hate to see that it's
- 38:06Speaker 4: potentially going to be up for auction on the courthouse steps,
- 38:09Speaker 4: and you can again it's tangible, you can you can
- 38:13Speaker 4: imagine it.
- 38:14Speaker 5: Uh.
- 38:14Speaker 4: And then finally it's it's this one that's related to that,
- 38:17Speaker 4: which is uh, those employees, and that could be any
- 38:21Speaker 4: one of us who are potentially not going to be
- 38:26Speaker 4: with health insurance next week. You know, got to help
- 38:29Speaker 4: you if you've got a surgery coming up or your
- 38:31Speaker 4: spouse does, and now you've got that kind of thing
- 38:35Speaker 4: to worry about.
- 38:36Speaker 5: Uh.
- 38:37Speaker 4: And and finally, I will say that on things that
- 38:42Speaker 4: the patriarch of the Justice family has said, as we
- 38:46Speaker 4: somewhat jokingly described at the beginning of our conversation, he
- 38:51Speaker 4: lashed out at me for raising questions about these financial
- 38:55Speaker 4: problems that he then described as as fake news. After
- 39:02Speaker 4: the Greenbrier was announced foreclosure sale. He has in multiple
- 39:08Speaker 4: instances blamed politics, said the political forces out to thwart
- 39:14Speaker 4: his run for the US Senate have have somehow caused
- 39:19Speaker 4: that auction to go into effect. But to my way
- 39:25Speaker 4: of thinking, this matter of owing three and a half
- 39:31Speaker 4: million dollars on health premium contributions and potentially having the
- 39:36Speaker 4: employees without health insurance undercuts all of that, I have
- 39:41Speaker 4: no idea how you could spend health insurance premiums and
- 39:45Speaker 4: the failure to pay them Politically.
- 39:47Speaker 3: It's all politics. It's all politics.
- 39:50Speaker 4: There may be a way, but I do not know.
- 39:52Speaker 4: You know, not to say though the people might not
- 39:56Speaker 4: take a look at this and assess their views on
- 39:59Speaker 4: polic But I cannot imagine how politics has costed.
- 40:03Speaker 3: But Dave alland showing five abye line brought to you

- 40:14Speaker 3: Where are we on said auction? Brad? So it's supposed
- 40:18Speaker 3: to be one week from the day, right, that is
- 40:20Speaker 3: a good question.
- 40:21Speaker 4: The Justices on behalf of Charleston Attorney, through through the
- 40:25Speaker 4: efforts of Charleston Attorney Steve Ruby, put forward a emotion
- 40:31Speaker 4: for a temporary injunction yesterday. There are there are three
- 40:35Speaker 4: distinct reasons they cant have to And then there is
- 40:38Speaker 4: a broader argument that the lawyers for the justices make
- 40:42Speaker 4: that this could throw the ground briar into turmoil. As
- 40:51Speaker 4: an employer and as an economic driver, and they're asking
- 40:56Speaker 4: a local judge in Greenborough County to at le delay
- 41:01Speaker 4: that auction, which is scheduled for two pm one week
- 41:04Speaker 4: from today, next Tuesday, there's going to be a hearing
- 41:07Speaker 4: in Greenborough County nine a m. Friday. I know where
- 41:11Speaker 4: I'll be, So don't boot me for this show for
- 41:14Speaker 4: chapter two of my book, but so that this is
- 41:19Speaker 4: an effort at least to slow this whole thing down.
- 41:23Speaker 4: Even if it doesn't derail the auction permanently, it potentially
- 41:27Speaker 4: could throw some scene in the gears. Delay things offer
- 41:32Speaker 4: a greater opportunity for all of the signs of this
- 41:35Speaker 4: complex loan and debt matter to come to the table,
- 41:42Speaker 4: maybe to reach some agreement. The other thing it does,
- 41:46Speaker 4: I'm not sure you can kick it down the tracks
- 41:48Speaker 4: so far that it runs past the election. But to
- 41:51Speaker 4: the degree that this does go into the political gristmill,
- 41:56Speaker 4: it would be to go our justice is political advantage
- 41:59Speaker 4: to teck it on down past the election.
- 42:02Speaker 3: What are you working on today, Brad?
- 42:05Speaker 4: That is a good question, Dave. Yesterday was quite and
- 42:08Speaker 4: I may be picking up the the the pieces of
- 42:13Speaker 4: what we what we laid down yesterday these these two
- 42:16Speaker 4: Green Briar stories are still happening. There are, believe it
- 42:19Speaker 4: or not, there are other debt problems not caused by
- 42:22Speaker 4: me UH that that maybe deserves some some circling back.
- 42:26Speaker 4: And there was a state Senate issue if we just
- 42:28Speaker 4: have a second Senator Chandler Swoope UH filed an official
- 42:34Speaker 4: challenge to the voting in his district, which the district
- 42:40Speaker 4: currently serves, which is Mercer County, UH, McDowell, Mingo and
- 42:45Speaker 4: part of Wayne.
- 42:46Speaker 5: UH.
- 42:46Speaker 4: There were some questions about the Mingo County voting. The
- 42:50Speaker 4: results came back from that and and both sides. The
- 42:54Speaker 4: other side is Republican challenger Craig Hart UH. They agree
- 42:59Speaker 4: that they're really were some uh some flaws and the
- 43:04Speaker 4: voting in Mingo County Democrats who wound up picking Republican
- 43:09Speaker 4: ballots and UH election workers who maybe innocently, maybe maybe
- 43:16Speaker 4: just mistakenly didn't realize that that that should be happening,
- 43:20Speaker 4: or at least didn't stand in the way of it.
- 43:22Speaker 4: But those things truly did happen. Both sides went up
- 43:25Speaker 4: a grand but not to the level that Swope could
- 43:30Speaker 4: prove that the full precincts of balloting should be thrown out,
- 43:35Speaker 4: So Swope, the incumbent is throwing in the towel on
- 43:39Speaker 4: that matter. Craig Hart is going to be the Republican
- 43:43Speaker 4: nominee uh for for that district. And you know we'll see,
- 43:48Speaker 4: uh to what degree out of all this turmoil any
- 43:52Speaker 4: Democrat might be able to pick up some steam and
- 43:56Speaker 4: potentially give Heart a challenge.
- 43:58Speaker 3: All right, Brad, I a little programming note. The Chief
- 44:00Speaker 3: of Staff of the Secretary of State's Office, Dcursey's going

- 48:55Speaker 3: was having this conversation with somebody earlier. One of the
- 48:57Speaker 3: things that always amazes me about the Democrats writing so
- 49:02Speaker 3: hard on Jim Justice for his lack of Bill Payne
- 49:07Speaker 3: is if you go back in time, I'm sorry. With
- 49:11Speaker 3: all due respect to the governor, he and his companies
- 49:13Speaker 3: kind of have a history of this and this wasn't
- 49:17Speaker 3: brought out that much in twenty sixteen when he ran
- 49:20Speaker 3: as a Democrat. Little consistency here, little consistency. So back
- 49:26Speaker 3: to yesterday's show with Tony Hodge. Tony, of course is
- 49:30Speaker 3: the vice chair of the State Republican Party, but he
- 49:32Speaker 3: came on yesterday totally independent of that role to talk
- 49:36Speaker 3: about families and look. I have known Tony Hodge for
- 49:40Speaker 3: a number of years I considered Tony to be a
- 49:41Speaker 3: good friend, in fact, probably one of my best friends.
- 49:44Speaker 3: Tony and I, though, don't agree on everything, and that's
- 49:46Speaker 3: okay as far as that goes. I can't think of
- 49:50Speaker 3: a single one of my five or six closest friends
- 49:53Speaker 3: and I agree with everything on If you didn't hear

- 49:59Speaker 3: the replay on my social media sites or the sites
- 50:02Speaker 3: of the station, the website, etc. Etc. Tony has strong
- 50:05Speaker 3: opinions on things, particularly when it comes to families. Tony's
- 50:08Speaker 3: a devoted family man to his lovely wife Jessica and
- 50:10Speaker 3: their two sons. Tony's a real deal. He walks the
- 50:14Speaker 3: walk and talks to talk, and sometimes what he says
- 50:16Speaker 3: can rub can rub some people the wrong way. But
- 50:21Speaker 3: it just made you think. And if you're thinking, then
- 50:27Speaker 3: I've done my job having him on the show. I
- 50:30Speaker 3: see my job here as an entertainer to give listeners
- 50:33Speaker 3: and many times myself something to think about. And based
- 50:36Speaker 3: on the actions I got on yesterday's show, my listeners
- 50:39Speaker 3: are doing a whole lot of thinking. The text continued
- 50:42Speaker 3: well after the show, emails, Facebook messages, etc. Etc. Tony
- 50:47Speaker 3: apparently hit a nerve with a lot of people yesterday.
- 50:50Speaker 3: Tony's a big believer in the traditional family husband, wife,
- 50:53Speaker 3: two point whatever, kids, period, and I don't always agree
- 50:57Speaker 3: with what he says, but that's okay it. I think
