- 0:14Speaker 1: Hey, do you have a minute. Yeah, we just spent
- 0:18Speaker 1: three three and a half hours with Amanda Bowling, Brian's sister.
- 0:23Speaker 2: Wow.
- 0:24Speaker 1: Okay, she told a story which I found heartbreaking. You know,
- 0:29Speaker 1: after it all happened, josh was sitting on her parents'
- 0:32Speaker 1: bed and he was crying and emotional, and she went
- 0:36Speaker 1: in and hugged him and said, don't worry, it's gonna
- 0:38Speaker 1: be okay, It'll all work out. And it's heartbreaking because
- 0:42Speaker 1: that was a genuine like, she genuinely felt that way,
- 0:45Speaker 1: and I think she loved Josh And then she now
- 0:48Speaker 1: thinks he did it.
- 0:51Speaker 3: You know, at the moment, did she think it was
- 0:55Speaker 3: an accident that he had shot Brian or did she
- 0:58Speaker 3: think it was.
- 0:59Speaker 4: Like by she thought Brian had done it. That's what
- 1:01Speaker 4: they're being told. So yes, she believed was Russian roulette
- 1:06Speaker 4: or just somehow Brian shot himself, and she did not
- 1:09Speaker 4: doubt that. In the aftermath of Brian's death, though, his
- 1:14Speaker 4: family did begin to have doubts about what Kan Joshua's
- 1:17Speaker 4: story had told them, and investigators would later conclude that
- 1:21Speaker 4: Brian's injury had not been self inflicted, that he had
- 1:25Speaker 4: instead been shot by someone else. Eventually King would be
- 1:30Speaker 4: charged with Brian's murder, but investigators also concluded that he
- 1:35Speaker 4: hadn't done this crime alone. They believed that he had
- 1:37Speaker 4: to have had help, and that's how Lee Clark ended
- 1:40Speaker 4: up being charged in this case as well.
- 1:43Speaker 2: Everybody keeps insisting he was there.
- 1:45Speaker 5: I don't even understand what Dallas's battle.
- 1:47Speaker 2: One of the cops had to physically put him there.
- 1:49Speaker 1: They couldn't believe Kane could have done it.
- 1:51Speaker 5: It made sense, This makes sense.
- 1:53Speaker 1: Of course it was Lee who put him up to it.
- 1:55Speaker 6: Of course it was.
- 1:56Speaker 4: They are just certain that Josh had not done this alone.
- 1:58Speaker 2: He couldn't have done it.
- 1:59Speaker 4: That they can't get passed. So there has to be
- 2:01Speaker 4: a Lee or someone likely Lee had have been there otherwise.
- 2:04Speaker 7: Josh Wooden Dunod.
- 2:11Speaker 8: Hi.
- 2:11Speaker 4: My name is Susan Simpson. I'm an attorney and podcaster
- 2:15Speaker 4: and previously I hosted the Undisclosed podcast.
- 2:18Speaker 1: Hi, I'm just into Davis, and I'm a true crime
- 2:21Speaker 1: TV producer. Last year, Susan and I decide to team
- 2:25Speaker 1: up and reinvestigate the murder of Brian Bowling. Along with
- 2:29Speaker 1: Kevin Fitzpatrick, president of Red Marble Media, we decided to
- 2:33Speaker 1: launch Proof. You can listen to Proof like you would
- 2:36Speaker 1: any podcast, and you can follow us everywhere with the
- 2:39Speaker 1: handle at proofcrime pod and on our website proofcrimepod dot com.
- 2:45Speaker 1: Thanks for listening, and welcome to Season one, Episode two
- 2:49Speaker 1: of Proof. Floyd County, Georgia, is a little over an
- 3:00Speaker 1: hour northwest of Atlanta in the foothills of the Appalachian Mountains.
- 3:05Speaker 1: The town of Rome is the county seat, set among
- 3:08Speaker 1: seven hills, just like the Italian city it's named for.
- 3:12Speaker 1: Rome is a mid sized town with a cute downtown
- 3:15Speaker 1: area with shops and restaurants that line the main street.
- 3:19Speaker 1: The community of Silver Creek, where Brian Bowling and Caine's
- 3:22Speaker 1: story grew up, is about ten miles south of Rome.
- 3:26Speaker 1: It's a rural area and on the stretch of highway
- 3:29Speaker 1: where Brian and Kin lived. There's only one commercial establishment,
- 3:33Speaker 1: the Silver Creek Mini Mart. It's a little convenience store
- 3:36Speaker 1: just a quarter of a mile from the Bowlings trailer.
- 3:40Speaker 1: Last year, we met up with Lee's brother Jamie, who
- 3:43Speaker 1: showed us around where Cain and Brian had lived, and
- 3:46Speaker 1: on our way we stopped by the Silver Creek Mini Mart.
- 3:49Speaker 2: So we're going to drive up on this road here.
- 3:51Speaker 4: Yeah, ive is that sign said bitcoin?
- 3:54Speaker 2: Yeah? Yeah, a lot of take bitcoin here.
- 3:57Speaker 4: Really Yeah, bitcoin live bait, Bitcoin atm and live bait
- 4:03Speaker 4: in one store.
- 4:03Speaker 7: Oh, it's got ding ding in there too. It's got
- 4:06Speaker 7: what ding ding? Yep, I ain't never played ding ding?
- 4:09Speaker 4: I know what's ding ding?
- 4:10Speaker 7: Oh my goodness, it's so fun. It's gambling. Yeah, let's see. Yeah,
- 4:17Speaker 7: turn left right here. Man, this is so grown up.
- 4:20Speaker 7: None of this was grown up like.
- 4:21Speaker 2: This back then.
- 4:23Speaker 7: It was all flattened grass. I mean, you could see.
- 4:26Speaker 7: It's changed so much.
- 4:29Speaker 4: Back when Jamie was a kid, he and his brother
- 4:32Speaker 4: would often hang out in this part of Silver Creek.
- 4:35Speaker 1: Okay, so who's older you really?
- 4:38Speaker 2: Lee? He's got me by two years.
- 4:41Speaker 4: Were you guys close growing up?
- 4:43Speaker 2: Yeah? Yeah, it was real close. My name. Let me
- 4:47Speaker 2: hang out with him?
- 4:49Speaker 1: Well, tell me about his friend group.
- 4:50Speaker 2: Had a little group of me.
- 4:53Speaker 7: Doug Don came, which some of them call him Josh,
- 4:58Speaker 7: but most people know him Kane Brian.
- 5:04Speaker 2: We all run together.
- 5:05Speaker 7: We'd hang out in that cemetery around his house and stuff.
- 5:09Speaker 2: We'd go over to Kane's house spend.
- 5:11Speaker 4: Night One Friday evening in October of nineteen ninety six.
- 5:19Speaker 4: It was just Jamie, Lee and Kane hanging out together.
- 5:23Speaker 4: They'd driven around, listen to music, smoked a joint, nothing
- 5:27Speaker 4: too exciting, and then Cainan showed them the Revolver, a
- 5:31Speaker 4: Smith and Wesson thirty eight Chiefs Special. Caine said he'd
- 5:35Speaker 4: taken it from his father's bedroom that night.
- 5:41Speaker 7: I got Lee and Kane had been riding around and
- 5:45Speaker 7: they picked me up in Lyndale. Then we pulled in here,
- 5:48Speaker 7: dropped Kane off.
- 5:50Speaker 2: He got out of the car.
- 5:51Speaker 7: Lee told Kine and he'd get that gun back to
- 5:54Speaker 7: his daddy's state and put it up. Kane said that's
- 5:57Speaker 7: where he was going, was going home, and that's the
- 6:00Speaker 7: last week's thing came go. He went on the other
- 6:06Speaker 7: side of the store. He went behind the store to
- 6:08Speaker 7: the road back here. This road back here goes right
- 6:11Speaker 7: down past Rolph's house.
- 6:13Speaker 4: Should we head over there?
- 6:20Speaker 1: The trailer where Brian lived is still there behind the
- 6:23Speaker 1: Silver Creek Mini Mart, but it's been abandoned for years now.
- 6:27Speaker 1: It's broken down to the point that the first time
- 6:29Speaker 1: Susan and I went there, we couldn't even recognize it
- 6:32Speaker 1: from the crime scene photos.
- 6:35Speaker 8: Your destination is on the left that's it.
- 6:40Speaker 4: That's a trailer.
- 6:43Speaker 1: Are we sure that's it?
- 6:44Speaker 2: No?
- 6:45Speaker 1: But how come nobody puts uh?
- 6:48Speaker 4: Why does no one believe in mailboxes?
- 6:50Speaker 2: No?
- 6:50Speaker 1: I thought he lived across the street from the cemetery.
- 6:54Speaker 9: That could be it.
- 6:55Speaker 4: Right there, that's it.
- 6:58Speaker 1: So I think we go down that road, down the
- 7:02Speaker 1: creepy road cemetery. Jamie had no trouble finding. We're recognizing
- 7:11Speaker 1: the place that twenty five years earlier, he, Lee, Kine,
- 7:15Speaker 1: and Brian would all hang out right.
- 7:18Speaker 2: Up here, this first road to the rat Lair's. Ryns
- 7:21Speaker 2: tried to rat.
- 7:22Speaker 7: Lair, I ain't never been up here, and.
- 7:32Speaker 2: Johny sent weird.
- 7:35Speaker 4: Jamie and Lee say that after dropping Caine off at
- 7:37Speaker 4: the Silver Creek Mini Mart, they'd driven back together to
- 7:40Speaker 4: Lee's apartment in the nearby community of Lyndale. Caine says
- 7:44Speaker 4: that he started walking back home from the mini mart,
- 7:46Speaker 4: but on his way there, he passed by Brian's trailer
- 7:49Speaker 4: and decided to stop in, with his father's thirty eight
- 7:52Speaker 4: Revolver still in his pocket. According to investigators, though Leam
- 7:57Speaker 4: Kine had not actually parted ways that night, they'd gone
- 8:01Speaker 4: to the Bowling's trailer together, only Lee hadn't gone inside, so.
- 8:07Speaker 7: He wrapped back here with Rohn's run wrapped back here,
- 8:10Speaker 7: you'd see the window here.
- 8:14Speaker 4: This window was an important part of the murder case
- 8:17Speaker 4: against Jamie's brother Lee. According to investigators, Lee had been
- 8:21Speaker 4: standing outside of this window when the shot was fired.
- 8:25Speaker 4: Brian's sister Amanda and her husband Kenneth told us why
- 8:28Speaker 4: it makes sense that Lee would have used this window
- 8:31Speaker 4: to get to Brian's bedroom that night.
- 8:33Speaker 8: You know, Brian's window was busted, so he had a
- 8:37Speaker 8: piece of plywood up, you know, to just cover the
- 8:42Speaker 8: bottom part, because that was all that was busted. And
- 8:46Speaker 8: you know, Josh knew it. Everybody knew his little window
- 8:50Speaker 8: was broke, you know, and you could get in and
- 8:52Speaker 8: out without having to go through a door or anything.
- 8:57Speaker 2: You know.
- 8:57Speaker 10: That's why when we did hear about somebody being at
- 9:02Speaker 10: that black window at his window over the version while
- 9:06Speaker 10: the board was down, and so, I mean, it had
- 9:08Speaker 10: been easy just to pull that cart back and ba
- 9:10Speaker 10: standing right there.
- 9:12Speaker 4: Jamie confirmed for us that he and Brian's other friends
- 9:15Speaker 4: had often gone in and out of the Bowlings trailer
- 9:18Speaker 4: through the busted out window.
- 9:20Speaker 7: I remember sneaking in the house many times. On the
- 9:24Speaker 7: back side. Back there, there's base of wood. Wouldn't move
- 9:27Speaker 7: it out of the way to get it?
- 9:28Speaker 4: How would you move it out of the way.
- 9:30Speaker 7: Just slide it out of the way like it in.
- 9:32Speaker 4: His in his room, so it was inside his room
- 9:35Speaker 4: kind and yeah, we.
- 9:36Speaker 7: Just like slide it down. I mean we snuck in
- 9:40Speaker 7: and out that window all the time.
- 9:42Speaker 1: How'd you guys get in and out of the window The.
- 9:44Speaker 11: Bab was drafted there.
- 9:45Speaker 7: I mean we leaked in, just leaked in the window.
- 9:48Speaker 7: Back then we could leap, Uh Like I couldn't Now
- 9:53Speaker 7: I could like roll over in. There ain't no way
- 9:56Speaker 7: I could leap in that window night.
- 9:58Speaker 4: Heen's story was the the only other person in the
- 10:01Speaker 4: bedroom with Brian when Brian was shot, but the busted
- 10:05Speaker 4: out bedroom window explains how Lee Clark could have participated
- 10:08Speaker 4: in this murder too, even when everyone agrees that he
- 10:12Speaker 4: never set foot inside the trailer that night. According to investigators,
- 10:17Speaker 4: the scenario looks something like this. You have Cain inside
- 10:21Speaker 4: the bedroom with Brian pretending to stop by for a
- 10:23Speaker 4: friendly visit, when really he's just there to keep Brian distracted,
- 10:27Speaker 4: and then you have Lee lurking outside the bedroom window
- 10:31Speaker 4: and sliding the loose plywood board aside so that he
- 10:34Speaker 4: can peer inside the room. And finally there's Brian sitting
- 10:38Speaker 4: on his bed, talking on the phone to his girlfriend,
- 10:40Speaker 4: his back to the busted out window, oblivious to what's
- 10:43Speaker 4: going on behind him. And then either King or Lee
- 10:47Speaker 4: pulls out a gun and shoots Brian in the head.
- 10:51Speaker 4: So that's how Brian Bowling was killed according to the
- 10:54Speaker 4: case of trial. But what about the why why would
- 10:58Speaker 4: these two teenagers have conspired to murder their friend and
- 11:02Speaker 4: why did the community think they were capable of such
- 11:04Speaker 4: a crime. To understand that, we need to take a
- 11:08Speaker 4: closer look at the three boys involved in this case
- 11:11Speaker 4: and the friendships between them.
- 11:20Speaker 1: When we talked to Amanda Bowling, she showed us some
- 11:23Speaker 1: family photos of her brother Brian.
- 11:27Speaker 9: That was.
- 11:32Speaker 8: And that one too, must when he was little thing,
- 11:36Speaker 8: This one cracks look he.
- 11:38Speaker 9: Saw in his.
- 11:40Speaker 4: Proper.
- 11:42Speaker 1: Then Amanda came across what she thinks might be the
- 11:45Speaker 1: very last picture ever taken of Brian, and this.
- 11:50Speaker 8: One was taken in August of ninety so that is
- 11:55Speaker 8: the last picture we have loving Wow, how don't.
- 12:01Speaker 7: You can see he's you know?
- 12:03Speaker 1: And boys go through that phase yes, all of a
- 12:06Speaker 1: sudden they like grow tall and like.
- 12:08Speaker 8: Yeah, started looking like men, and he did. He had
- 12:12Speaker 8: slammed up, you know, and he was tall, and he
- 12:17Speaker 8: was very handsome. And I didn't realize how handsome my
- 12:19Speaker 8: brother was until afterwards.
- 12:26Speaker 1: Back in nineteen ninety six, Brian's best friends were Cain,
- 12:30Speaker 1: Joshua's story, and another boy named Tommy Hyde.
- 12:35Speaker 8: Tommy lived up on the heel.
- 12:37Speaker 4: Oh is he Kain's man or Josh's neighbor.
- 12:39Speaker 8: Yeah, Josh's neighbor, so he had been. Brian and Brian
- 12:43Speaker 8: were best friends too, all three of them.
- 12:45Speaker 6: They were three peas in a pod.
- 12:48Speaker 1: Kean, Tommy, and Brian all lived on the edges of
- 12:51Speaker 1: the Pleasant Hope Cemetery, just a short walk from one another.
- 12:55Speaker 1: Brian's uncle, Michael, who also lived near the cemetery back then,
- 12:59Speaker 1: remembers them hanging out together just about every day.
- 13:02Speaker 12: I would say Tommy was his best friend and Josh
- 13:07Speaker 12: would have been the second best. Those guys were always together. Now,
- 13:12Speaker 12: Lee was his friend, but Deborah and Rocky didn't like Lee.
- 13:16Speaker 12: I'm not sure exactly why, so he was supposed to
- 13:19Speaker 12: stay away from Lee.
- 13:24Speaker 1: Brain's sister remembers that Josh would sometimes bring Lee by
- 13:28Speaker 1: their place, even though Brain's mom and died didn't like
- 13:31Speaker 1: Lee coming around.
- 13:33Speaker 8: Lee. I had never met Lee until probably my I
- 13:39Speaker 8: was like fourteen, because he just popped up up here,
- 13:45Speaker 8: you know, up at Josh's house. And whenever he was around,
- 13:49Speaker 8: he wouldn't come down to the house that much. They
- 13:51Speaker 8: would walk by, and my brother was always outside, and
- 13:56Speaker 8: you know, and they would he would stop him, you know,
- 14:00Speaker 8: and they would chit chat.
- 14:01Speaker 10: For a little while.
- 14:02Speaker 8: But when Lee was around, Gosh never would hang out
- 14:05Speaker 8: with Brian. He wouldn't hang out with us.
- 14:08Speaker 4: So would you say Lee and Brian were friends.
- 14:10Speaker 8: Or not so much as friends but friend of a friend.
- 14:19Speaker 1: According to investigators, Lee Clark had been in a gang
- 14:22Speaker 1: with Brian Bulling, but everyone including Lee, agrees that he
- 14:27Speaker 1: and Brian only ever hung out when they were with
- 14:29Speaker 1: their mutual friend Kane Slash Josh story.
- 14:34Speaker 9: I was friends of Bribe, but I wouldn't I wasn't
- 14:36Speaker 9: close with him like Kane was. You know what I'm saying.
- 14:38Speaker 9: I can't get right there in the neighborhood with pretty
- 14:41Speaker 9: much every day. I would just stay here and there
- 14:43Speaker 9: when I went overhere, and they wouldn't. Every time I
- 14:44Speaker 9: wouldn't over to stay Kane, I'd go see Brian. It
- 14:47Speaker 9: wasn't like it. He was too much for me, that
- 14:49Speaker 9: hyperactive stuff. I'm not like it. I'm a laid back,
- 14:52Speaker 9: easy going type of guy. I just wanted to do stuff,
- 14:54Speaker 9: take it easy, chill. I lot Brian and I lot
- 14:58Speaker 9: too much a friend, but I just wasn't close. Wouldn't
- 15:00Speaker 9: know what game was.
- 15:05Speaker 4: I asked to Lee what he meant about the hyperactive stuff,
- 15:08Speaker 4: and he told me a story about one time when he, Brian,
- 15:11Speaker 4: and Kane had all been hanging out together.
- 15:15Speaker 9: I mean, I've been with him a game, walking down
- 15:17Speaker 9: the walking down the street from his road, Crane Road,
- 15:20Speaker 9: to cross lot More Highway, and we're crossing the highway
- 15:23Speaker 9: and I'll see him to get out there the middle
- 15:24Speaker 9: highway and laid down in the middle of the highway
- 15:26Speaker 9: when now trunks coming down from there and I'm like, man,
- 15:32Speaker 9: what hell are you doing? LL not want you to watch,
- 15:35Speaker 9: you want you to stop. I said, you stupid, that
- 15:37Speaker 9: the men they're gonna wind you over. But he would do.
- 15:42Speaker 9: Then you're trying to.
- 15:42Speaker 4: Get Other friends of Brian's that we talked to told
- 15:49Speaker 4: us similar stories about Brian playing chicken on motorbikes or
- 15:53Speaker 4: dodging trains, and Amanda told us that the incident le
- 15:57Speaker 4: recalls with Brian on the Rockmart Highway was not the
- 16:00Speaker 4: only time her brother had done something like that. You've
- 16:08Speaker 4: heard this.
- 16:09Speaker 8: One, Yeah, buy him laying in the road right here.
- 16:11Speaker 8: He used to do that out here all the time.
- 16:13Speaker 8: And I would always be I break with him, you know,
- 16:16Speaker 8: get up.
- 16:16Speaker 13: Get up.
- 16:17Speaker 4: Why would he do that?
- 16:18Speaker 8: He just could because he couldn't, Yeah, just cause he
- 16:21Speaker 8: was just a joker, just always getting in trouble, doing
- 16:26Speaker 8: stuff he wasn't supposed to be doing.
- 16:28Speaker 4: Queen of the Transcript, Your brother was on home arrest, at.
- 16:31Speaker 8: The house arrest. Yeah, he had went off with somebody
- 16:35Speaker 8: and got into some trouble after my daddy had a
- 16:38Speaker 8: brain in nurism. He had a gun charge because he
- 16:42Speaker 8: had stolen the gun out of that house. It was
- 16:45Speaker 8: an old gun. You know, it didn't work, but you
- 16:49Speaker 8: know he still stole it from that house. So he
- 16:51Speaker 8: got that charge. He got a bunch of charges that day,
- 16:56Speaker 8: a lot of charges. It was just through the juvenile courts.
- 17:00Speaker 8: So the judge he was expecting to get sent off.
- 17:05Speaker 8: You know, and now I kind of wish they would have.
- 17:07Speaker 4: Sent him are Amanda, like most kids in Silver Creek,
- 17:11Speaker 4: had attended the nearby Pepperrell High School. That's where her
- 17:14Speaker 4: brother had started off in school too, But because of
- 17:17Speaker 4: some of the trouble he had gotten into, Brian had
- 17:19Speaker 4: been transferred up to another school in West Rome. Yeah.
- 17:22Speaker 8: Well, he rode one of the little short buses got
- 17:26Speaker 8: kicked off all the time, but so he rode one
- 17:30Speaker 8: of the A school I heard it called, yeah, behavioral school. Yeah,
- 17:35Speaker 8: so that would be a school something like that like Alternatives.
- 17:43Speaker 1: Was while attending a school in Cusa that Brian Bulling
- 17:47Speaker 1: had met his girlfriend, fifteen year old Caprice Hyatt.
- 17:54Speaker 4: Hi, Hi, Hi, I'm just in the We stop by
- 17:59Speaker 4: your mom's earlier.
- 18:02Speaker 1: When we showed up on Caprice's doorstep, it was October nineteenth,
- 18:06Speaker 1: the day after the anniversary of brain shooting.
- 18:11Speaker 14: Yesterday was anniversary.
- 18:12Speaker 2: I already know I'll never forget it. I'm sorry.
- 18:15Speaker 14: I've been twenty five years and I was still never
- 18:16Speaker 14: forget it.
- 18:17Speaker 4: Twenty Yeah, yeah, it was real. It growed me up
- 18:20Speaker 4: real quick.
- 18:21Speaker 1: I bet brain Bullying had been Caprice's first boyfriend.
- 18:31Speaker 14: I was detained and he was deftained. And I went
- 18:35Speaker 14: to Coast High School and he went to high school
- 18:38Speaker 14: which she used to be behind coos and the trailers,
- 18:40Speaker 14: and he was on the little short bus that took
- 18:43Speaker 14: him home all the way across down and I was
- 18:47Speaker 14: walking and we just hollered at me out that he
- 18:49Speaker 14: was one of the bus. He was like, hey, can
- 18:52Speaker 14: I get your remember? I was like, I was like, sure,
- 18:55Speaker 14: he's ye know, but yeah he was.
- 18:58Speaker 4: It's kind of like my first lil fu you love thing.
- 19:01Speaker 9: And then he called you.
- 19:02Speaker 14: He did, and we talked up until to day. All
- 19:06Speaker 14: that happened, but it was natural. It was like, I mean,
- 19:10Speaker 14: he was head over heels and I was smitten. You know.
- 19:13Speaker 14: He asked you to be a boyfriend and girls, oh yeah, yeah,
- 19:16Speaker 14: yeah he did that. You know, first time we tell her,
- 19:19Speaker 14: he said, I just I've seen you. I just knew
- 19:20Speaker 14: that I wanted you to make my girlfriend.
- 19:23Speaker 4: The first time you talked to the phone.
- 19:25Speaker 14: Yes, I said, well, I mean what can you say
- 19:28Speaker 14: to that?
- 19:29Speaker 11: But okay.
- 19:31Speaker 1: Because Caprice and Brian didn't attend the same high school,
- 19:35Speaker 1: and because they were fifteen and couldn't drive themselves anywhere,
- 19:38Speaker 1: they weren't able to meet in person all that often.
- 19:41Speaker 1: Mostly they talked on the phone, which they did just
- 19:44Speaker 1: about any chance they got.
- 19:46Speaker 14: You know, like I got out of school, he either
- 19:49Speaker 14: call me or I called him, and we were on
- 19:51Speaker 14: the phone until until my mama got me off.
- 19:55Speaker 4: You know what I'm saying, Like, that's what we did.
- 20:01Speaker 1: On the day that Brian was shot and killed, Caprice,
- 20:04Speaker 1: like usual, had called him as soon as she had
- 20:07Speaker 1: gotten home from school. Brain was usually around to answer.
- 20:11Speaker 1: He was after all, on house arrest, but had been
- 20:14Speaker 1: Brain's brother in law, Kenneth, who answered the phone that day.
- 20:18Speaker 1: He told her that Brian wasn't home yet, she'd have
- 20:20Speaker 1: to call back. Leader.
- 20:23Speaker 10: Brian was working with the Childers that day. He was
- 20:27Speaker 10: working with them because he had got in a bunch
- 20:30Speaker 10: of trouble, like the week or so, or a couple
- 20:33Speaker 10: of weeks or a month or so before, so he
- 20:36Speaker 10: had gotten a bunch of trouble. I got mad with
- 20:40Speaker 10: him again and tried to tell him, look, Brian, you're
- 20:42Speaker 10: messing up because I done been there, done that. It
- 20:44Speaker 10: doesne messed up my life. And I told him, I said, look, man,
- 20:49Speaker 10: you're gonna screw your life up, you know, And he
- 20:52Speaker 10: went to work with the childers, try to try to
- 20:55Speaker 10: get back, you know, doing something, try to not get
- 20:58Speaker 10: away from people.
- 21:02Speaker 1: Brian's family told us that in October of nineteen ninety six,
- 21:06Speaker 1: Brian had been trying to turn his life around, but
- 21:09Speaker 1: he was still hanging out with friends that his family
- 21:11Speaker 1: thought were a bad influence on him. And, as his
- 21:15Speaker 1: aunt Melody told us, that's what she thinks led to
- 21:18Speaker 1: his death.
- 21:25Speaker 6: He just ran with that with the crowd. Brian had
- 21:29Speaker 6: never been arrested, not to my knowledge, not unless someone
- 21:32Speaker 6: kept it from me. But if they did, they kept
- 21:34Speaker 6: it from my mom too. But you know, I mean
- 21:37Speaker 6: he wasn't perfect, you know, typical boy fifteen years old,
- 21:44Speaker 6: you know, but he had a good heart. And it
- 21:48Speaker 6: just really destroyed our family. I divorced, my brother divorced,
- 21:53Speaker 6: my mom and dad divorced, Deborah and her husband divorced,
- 21:55Speaker 6: and I mean it was just you know a lot
- 21:58Speaker 6: of chaos. I mean it, it did.
- 22:01Speaker 2: It just shatter.
- 22:02Speaker 6: And it wasn't about the trial or anything. It's just
- 22:06Speaker 6: you know, emotions, I guess.
- 22:09Speaker 11: Yeah.
- 22:09Speaker 9: Yeah.
- 22:11Speaker 4: At the time of Brian's death, his family had not
- 22:14Speaker 4: considered King Joshua's story to be one of the bad
- 22:17Speaker 4: influences in his.
- 22:18Speaker 8: Life, because Josh was just Josh was a funny you know,
- 22:23Speaker 8: we all goofed with him.
- 22:25Speaker 2: You know.
- 22:26Speaker 8: He was just not the type of person to have
- 22:28Speaker 8: any kind of violence in him. He was not a
- 22:30Speaker 8: violent person.
- 22:32Speaker 4: Josh and Brian had been so close that to the bullings,
- 22:35Speaker 4: Josh was basically family as well. Brian's uncle Michael told
- 22:38Speaker 4: us that before Brian's death, he hadn't been aware of
- 22:41Speaker 4: any conflict or bad blood between the two boys.
- 22:45Speaker 12: Josh and Brian were at my house like constantly. You know,
- 22:48Speaker 12: they're good friends, so they were there almost daily. Even
- 22:52Speaker 12: the day before that happened, Josh and Brian was at
- 22:56Speaker 12: my house and I had a barn, and they weren't
- 22:59Speaker 12: shooting gun, but there's sheeting water guns, running around, cheating
- 23:02Speaker 12: each other.
- 23:02Speaker 9: You know.
- 23:08Speaker 1: We met Kane's mom, June Story, at her home in Rome.
- 23:11Speaker 1: She lives in a double wide at the bottom of
- 23:13Speaker 1: a steep hill, the kind of hill that makes you
- 23:16Speaker 1: feel like you're on a roller coaster ride, but somehow scarier.
- 23:21Speaker 1: We don't have that fiber drive that No, it's like
- 23:23Speaker 1: a mile.
- 23:25Speaker 4: This makes me real nervous. It's rude.
- 23:28Speaker 2: Come on, to blow this hill. I can't see a
- 23:30Speaker 2: damn leg.
- 23:32Speaker 1: When we finally made it to her place, you could
- 23:34Speaker 1: tell immediately that the years since Kane's arrest and conviction
- 23:38Speaker 1: have taken a toll. Kane's dad passed away a few
- 23:41Speaker 1: years after the trial, and June says she spends most
- 23:45Speaker 1: of her time thinking about the what ifs.
- 23:49Speaker 13: I was just hoping he would graduate from high school
- 23:51Speaker 13: and go by Bee to college and they won't go
- 23:53Speaker 13: to college, just find a nice lady and get married
- 23:57Speaker 13: and have children and think just a simple, normal life,
- 24:02Speaker 13: normal life. Yeah, and how did it turn out? Trying out?
- 24:06Speaker 13: Pretty bad?
- 24:09Speaker 2: Who did? Now?
- 24:11Speaker 13: I mean, that's why I think God will give people
- 24:14Speaker 13: knowledge to see the future. If I had seen the future,
- 24:17Speaker 13: I would never probably ever been able to bear it,
- 24:21Speaker 13: to know that that was gonna happen down the line.
- 24:25Speaker 1: June showed us pictures of King from when he was
- 24:27Speaker 1: in high school. He is tall almost six foot three
- 24:30Speaker 1: inches in real thin, and although he was seventeen and
- 24:34Speaker 1: nineteen ninety six, he looks much younger. You can hear
- 24:38Speaker 1: the pride in her voice as June describes the pictures.
- 24:41Speaker 13: That was in one of his uh Spring concert at
- 24:44Speaker 13: Peple High School of the music program. They was singing
- 24:47Speaker 13: some song.
- 24:48Speaker 1: So he was active in school.
- 24:50Speaker 9: He was acting.
- 24:51Speaker 13: His music goes and you know he uh yeah, he
- 24:55Speaker 13: was a He wasn't like in sports, he wasn't like
- 24:57Speaker 13: in all that stuff. But he he loved me. In fact,
- 25:01Speaker 13: one of the conference, he sang before a crowd about
- 25:04Speaker 13: thousand people.
- 25:09Speaker 1: On paper, Lee and Kane might not have seemed to
- 25:12Speaker 1: be the likeliest of friends. They had very different interests
- 25:16Speaker 1: and very different personalities. One of those differences was Kane's
- 25:20Speaker 1: musical talent.
- 25:23Speaker 9: They wanted to be a musicians. They wanted to be
- 25:26Speaker 9: a musician. What they want to do, and I'll give
- 25:28Speaker 9: it to him. Kane, Hey can play a guitar, he
- 25:30Speaker 9: can sing. It's got a beautiful boy. They do.
- 25:33Speaker 4: So his big plan was to get a band going.
- 25:38Speaker 9: Yeah, that's what he wanted to do. That's a dream.
- 25:41Speaker 9: They love music, love music.
- 25:44Speaker 1: Lee remembers that Kane and some of his friends put
- 25:46Speaker 1: together a garage band.
- 25:49Speaker 9: And the man from Caine an little money. It wasn't
- 25:53Speaker 9: no big del but it sums up. They getting together
- 25:55Speaker 9: over Caine House on the weekends. They lay in their
- 25:57Speaker 9: little geared stuff.
- 26:00Speaker 4: Told me he didn't know much about the garage band
- 26:02Speaker 4: or Kane's other musical pursuits. It wasn't something that Lee
- 26:05Speaker 4: shared Kine's interest in.
- 26:07Speaker 9: I can't play and don't want to hear many thanks.
- 26:11Speaker 9: It's that looking fat being prone on the company em
- 26:13Speaker 9: party night wielding.
- 26:19Speaker 4: Back in nineteen ninety six, it seemed like things were
- 26:23Speaker 4: going well for Kane. He was still attending the regular
- 26:26Speaker 4: high school, playing in the band, participating in this church's choir,
- 26:29Speaker 4: and before October of that year, he didn't have a record.
- 26:34Speaker 1: I don't think he's got a record.
- 26:35Speaker 4: I don't remember.
- 26:36Speaker 9: No, he didn't. He didn't have no record. Hey game
- 26:39Speaker 9: was gotten. Squaky claim. He was kind of squaky claim at.
- 26:44Speaker 4: Lee's brother Jamie, told us that when he first heard
- 26:46Speaker 4: Kine had been arrested in connection with Brian's death, it
- 26:50Speaker 4: never occurred to him that Kane might be accused of
- 26:52Speaker 4: doing something to intentionally harm his friend.
- 26:56Speaker 5: Do you remember the first time where you heard that
- 26:58Speaker 5: Caine was a suspect in Brian's death, because like went
- 27:04Speaker 5: on before Lee came in, But do you remember hearing
- 27:05Speaker 5: that Kane was a suspect?
- 27:07Speaker 7: I do, and I thought Kay was just a suspect
- 27:12Speaker 7: for bringing the gun down there. And on the same note,
- 27:16Speaker 7: you know, I could have seen Kane accidentally shooting the
- 27:22Speaker 7: boy by accident, you know, when that happened. I could
- 27:25Speaker 7: have seen that happening, you know, because he was just goofy,
- 27:29Speaker 7: like a he trip over Cordo's phone. I mean, that
- 27:34Speaker 7: was just Kane.
- 27:35Speaker 4: A lot of people we spoke to while investigetting this
- 27:38Speaker 4: case told us that on his own Kine Slash Josh
- 27:42Speaker 4: would never have gotten involved in any kind of murder conspiracy.
- 27:45Speaker 4: That just isn't the kind of kid that he was.
- 27:48Speaker 1: In fact, Brian's uncle Michael, believes that it had to
- 27:51Speaker 1: be because of Lee's influence that Josh went along with
- 27:54Speaker 1: what he thinks was a plan to murder Brian.
- 27:57Speaker 4: Everyone describes it as kind of like a follower and
- 28:00Speaker 4: sort of a I don't want to say weaker personality.
- 28:02Speaker 12: But he was, I mean, and that's what we all
- 28:05Speaker 12: kind of thought to you, that Lee had more influence
- 28:09Speaker 12: over him, you know, And I think, honestly, like I said,
- 28:12Speaker 12: that Lee was either in the room or outside the
- 28:15Speaker 12: room kind of making Josh do it, because I don't
- 28:19Speaker 12: think Josh would have never, ever, ever Haulem Brian.
- 28:22Speaker 1: Ever, on his own, it wasn't just Brian's family who
- 28:27Speaker 1: felt this way. A lot of Ken's and Brian's friends
- 28:31Speaker 1: told us something similar, which wasn't something we had expected
- 28:34Speaker 1: when we first start looking into this case.
- 28:37Speaker 2: Wow, I mean, it's just.
- 28:39Speaker 3: The interesting thing is that is that some people really
- 28:44Speaker 3: think that Lee is capable of orchestrating all of this,
- 28:50Speaker 3: And I guess I didn't expect that going in.
- 28:52Speaker 1: You know, I didn't either.
- 28:55Speaker 4: Meanwhile, came Josh just looks like a goofy wlanky trying mess.
- 29:01Speaker 4: He does not look sinister, He does not look like
- 29:04Speaker 4: someone capable organizing all this. He looks just like a
- 29:06Speaker 4: goofy lanky team.
- 29:08Speaker 2: Yeah.
- 29:08Speaker 3: I mean, if you were going to cast it as
- 29:10Speaker 3: a film and cast like the movie as like a
- 29:13Speaker 3: killer and the guy who's his follower, you would cast
- 29:17Speaker 3: you know, Lee as the as the lead guy and
- 29:20Speaker 3: Kane as the follower.
- 29:21Speaker 2: Like That's how you would cast it.
- 29:23Speaker 1: Lee is well aware that even before Brian's death, there
- 29:26Speaker 1: had been people in Kane's life who thought he was
- 29:29Speaker 1: leading his friend in a bad direction.
- 29:32Speaker 9: Well, he went to school at Purple High School. He
- 29:34Speaker 9: always had this old, uh good he too shues persna
- 29:38Speaker 9: around him, you.
- 29:39Speaker 15: Know what I mean?
- 29:40Speaker 9: Yeah, people looked at him and and there's people in
- 29:43Speaker 9: high school. I remember when I was still going to
- 29:45Speaker 9: school before I quit. Well kept telling him, man, what
- 29:47Speaker 9: you hanging out with him for?
- 29:49Speaker 15: Man?
- 29:50Speaker 9: Like I would just just mad An Floyd, So I
- 29:52Speaker 9: would just a straight face the trash.
- 29:58Speaker 1: Since being incarcerated, a lot things have changed for Kane.
- 30:02Speaker 1: For one, he no longer has that squeaky clean record.
- 30:06Speaker 15: Went down the wrong path by hey, he's famous for
- 30:09Speaker 15: going down the wrong path over and over again. It
- 30:13Speaker 15: kills me.
- 30:15Speaker 1: In the twenty four years after their arrest and conviction,
- 30:19Speaker 1: Kan and Lee ended up serving time together at three
- 30:21Speaker 1: different prisons in Georgia, but it's now been several years
- 30:25Speaker 1: since they last saw each other. King's disciplinary record means
- 30:29Speaker 1: that he's ended up in higher security facilities. Lee told
- 30:34Speaker 1: us more about King's life in prison.
- 30:36Speaker 15: Every time I call over and taught my mom or something,
- 30:41Speaker 15: I get a little updates jump back Cane un did this,
- 30:44Speaker 15: or canes back in the hole this, and that the
- 30:46Speaker 15: boy ain't never going to learn forty one years old,
- 30:48Speaker 15: still ain't learned shit. I don't think he's got no
- 30:51Speaker 15: good comma sins. And that's what I'm thinking is the
- 30:54Speaker 15: boy he ain't never had no good commacines much since
- 30:56Speaker 15: takes you a long waistness when it comes to books.
- 30:59Speaker 15: The boys a genius. He is a genius when he
- 31:01Speaker 15: coach to books, when he goes to music. He said, genius,
- 31:03Speaker 15: I'll give you my when it cost a good common sense.
- 31:06Speaker 15: He ain't got nothing period.
- 31:09Speaker 4: When we began working on this podcast, I reached out
- 31:12Speaker 4: to Caine through his mother, June. I asked her to
- 31:15Speaker 4: let him know what I was doing and to tell
- 31:17Speaker 4: him that I was hoping to hear his side of
- 31:19Speaker 4: the story about what happened that night in the Bowlings trailer.
- 31:23Speaker 4: June got word back to me that Caine was adding
- 31:25Speaker 4: me to his phone list, and I was hopeful i'd
- 31:27Speaker 4: soon speak to him. He didn't call, though. When I
- 31:30Speaker 4: talked to Lee about this, he was frustrated, but not surprised.
- 31:35Speaker 9: I mean, I don't make no sense to me me
- 31:38Speaker 9: if rose they reversed. As soon as I would have
- 31:42Speaker 9: heard about all this, I'd have been trying to find
- 31:44Speaker 9: some what kind of what he getting? Caught there with
- 31:45Speaker 9: you right then?
- 31:46Speaker 4: It sounds like he's found a way to exist right now,
- 31:49Speaker 4: and he doesn't care about changing.
- 31:51Speaker 9: Yeah, they told me before, hated loved man. He said,
- 31:54Speaker 9: we're gonna die here in all this place, I said,
- 31:56Speaker 9: love Kan, I said, I'm gonay, you're ruting now, rout.
- 31:58Speaker 9: I said, I'm not dying in here. I said, I'm
- 32:01Speaker 9: uping to do it, man. I said, I ain't going
- 32:03Speaker 9: to sit here and sit er and say that I'm
- 32:05Speaker 9: gonna die in prison for something like that. That don't
- 32:08Speaker 9: even sound right, man, I said, you just give en
- 32:10Speaker 9: up any hope of ever getting out of this place.
- 32:15Speaker 4: Not long after that, I received a letter from Kin.
- 32:18Speaker 4: He said he'd been trying to reach out to me,
- 32:20Speaker 4: but the facility that he was at would not let
- 32:22Speaker 4: him call. In his letter, he described the events of
- 32:25Speaker 4: the night that Brian was shot and closed with the following,
- 32:30Speaker 4: we did not kill Brian Bowling. We are two innocent
- 32:33Speaker 4: men who have been incarcerated since were teenagers for a
- 32:36Speaker 4: murder that never happened. Brian killed himself while playing Russian
- 32:39Speaker 4: Roulette with my father's gone. Where Lee was at I
- 32:42Speaker 4: do not know. All I know is he was not
- 32:45Speaker 4: at that house that night, and I did not kill Brian.
- 33:02Speaker 1: Almost everyone who knew brian bullying and Cain's story, agree
- 33:06Speaker 1: that acting on his own, Caine would not have killed
- 33:09Speaker 1: his friend Brian. They believe that Kine's involvement in this
- 33:13Speaker 1: crime can only be explained by some kind of outside
- 33:17Speaker 1: influence by someone who was standing outside of Brian's window
- 33:21Speaker 1: and who either shot Brian themselves or who forced Kine
- 33:25Speaker 1: to be the one to do it. So what is
- 33:28Speaker 1: it about Lee Clark that made people think he could
- 33:30Speaker 1: have been the someone standing outside the window that night?
- 33:39Speaker 1: We reached out to Lee's dad, Glenn, for an interview.
- 33:42Speaker 1: He suggested that we meet at the church where he
- 33:44Speaker 1: is very active, just a short drive from where he
- 33:47Speaker 1: lives in Cave Springs.
- 33:50Speaker 11: My name is Daryl Glenn Clark.
- 33:54Speaker 4: Tell us where we are today.
- 33:56Speaker 11: We are at Live Oak Baptist Church and out of
- 34:00Speaker 11: Ca Sprains, Georgia.
- 34:02Speaker 1: And why did you suggest this location?
- 34:04Speaker 4: What does this church mean?
- 34:05Speaker 11: Well, this church right here is just there's no better
- 34:09Speaker 11: place to be in the House of the Lord home
- 34:11Speaker 11: and just thought it'd be a good place to be here.
- 34:15Speaker 1: When he was growing up, what did you picture his
- 34:18Speaker 1: future would be like?
- 34:21Speaker 11: Well, I've been in tree business all my life, Okay,
- 34:26Speaker 11: and I maintained right away for utility companies.
- 34:30Speaker 9: And.
- 34:32Speaker 11: I thought maybe he may fall into that, you know
- 34:34Speaker 11: what I'm saying, Because there really wasn't nothing else here
- 34:37Speaker 11: in this town. You either work in a cotton mill,
- 34:40Speaker 11: carpet mill, pants factory. That's what they got here.
- 34:45Speaker 1: Glenn Clark's vision of what his son's future might have
- 34:48Speaker 1: been isn't much different from how Lee imagines things would
- 34:51Speaker 1: have gone too if he hadn't ended up being arrested
- 34:54Speaker 1: for murder when he was seventeen.
- 34:57Speaker 15: If it hadn't happened to you, or you think you'd
- 34:59Speaker 15: be me, Honestly, I'd probably be out there somewhere right
- 35:04Speaker 15: now cutting trees with my dad right now. I like
- 35:07Speaker 15: to think that I would have me a little bit
- 35:09Speaker 15: of money. Save that, I thank God have me a
- 35:10Speaker 15: wife and a couple of kids. By now. I'm fitting
- 35:14Speaker 15: to be forty one years old, and I really want kids.
- 35:17Speaker 15: I want them bad. I just can't get out there
- 35:20Speaker 15: to get any I feel like I'm in a point
- 35:23Speaker 15: in my life right now that really got my head
- 35:24Speaker 15: on my shoulders good, and I feel like I'll be
- 35:27Speaker 15: a great dad.
- 35:28Speaker 1: Back in nineteen ninety six, part of Lee's imagine future
- 35:32Speaker 1: had already come to pass. He was already cutting trees
- 35:36Speaker 1: with his dad. Was a job as dad helped him
- 35:38Speaker 1: get when Lee decided to drop out of high school.
- 35:42Speaker 15: Yeah, I was a dropout. I quit that in the
- 35:44Speaker 15: ninth grade. Yes, I quit and have my dad signed
- 35:48Speaker 15: the papers that I ain't going back. If you don't
- 35:50Speaker 15: sign the papers, I'm just gonna skip. And he told me,
- 35:53Speaker 15: he said, okay, He said, I got something for you.
- 35:55Speaker 15: He said, you want me signing the papers? All right, Hey,
- 35:58Speaker 15: sign them. We said. We got back in the house.
- 36:00Speaker 15: He said, come here.
- 36:01Speaker 9: I said, what's that?
- 36:02Speaker 15: He said, that's a job application.
- 36:03Speaker 11: Fill it out.
- 36:05Speaker 15: I said what I said, mean you're crazy. He said, boy,
- 36:07Speaker 15: I'm gonna take you right now. He said, you think
- 36:09Speaker 15: you're gonna quit school and you're gonna lay it right here.
- 36:11Speaker 15: It ain't having the house building papers out, but you
- 36:14Speaker 15: going to work. And he put me to work the
- 36:16Speaker 15: next day cutting trees. I thought I was grown. I
- 36:20Speaker 15: was literally did. I was working full time, making making money,
- 36:24Speaker 15: paying the bills, and thinking that was grown and not
- 36:27Speaker 15: knowing the whole time I was long ways from it.
- 36:30Speaker 15: You couldn't tell me nothing. I thought I was a ship.
- 36:33Speaker 15: Back then, I thought I had it going on. I
- 36:35Speaker 15: love to get it from my buddies with my older girlfriend,
- 36:38Speaker 15: hang out with her. Thought I was real cool, thought
- 36:41Speaker 15: I was real hip, and so said, I ain't lying.
- 36:45Speaker 15: If I could go back and just see my sixteen
- 36:48Speaker 15: year old self, I guess that's the way it is.
- 36:51Speaker 15: Us wrong.
- 36:51Speaker 10: Boys.
- 36:51Speaker 15: We all think we're the ship that we finally figure
- 36:53Speaker 15: out we ain't. But then it's too late.
- 36:59Speaker 1: Glend us and disagree.
- 37:01Speaker 4: He says.
- 37:01Speaker 1: Lee thought he had it all figured out and it
- 37:04Speaker 1: was starting to get in the way of their relationship.
- 37:07Speaker 1: Now you were saying that when he became a teenager,
- 37:11Speaker 1: you start to butt ha. Yeah, and Lee started to
- 37:13Speaker 1: get into a little bit of trouble.
- 37:15Speaker 13: Tell me about that.
- 37:16Speaker 11: I think the most thing that irritated me about him
- 37:19Speaker 11: that I would I would give him, you know, a job,
- 37:22Speaker 11: I mean our supervisor. I put him on crew and
- 37:26Speaker 11: he liable to work one day and not work next
- 37:28Speaker 11: two days. And that would really crawl onto my skin.
- 37:31Speaker 11: And I really stayed mad at him for that. We
- 37:34Speaker 11: started butting heads kind of that. I mean I was
- 37:36Speaker 11: mad with him, and I said, look, you got to
- 37:38Speaker 11: take up some responsibility. Go to work, do your job.
- 37:42Speaker 11: You play after you do your work. That comes later.
- 37:46Speaker 11: So that's kind of when we started, you know, kind
- 37:48Speaker 11: of drifting away a little bit.
- 37:51Speaker 1: You know, Lee's parents and King's parents were friends when
- 38:00Speaker 1: the two boys were growing up. So Glenn Clark knows
- 38:03Speaker 1: Kane's story too. Tell me more about Lee and Kan's relationship.
- 38:08Speaker 1: Have they been friends all their lives?
- 38:09Speaker 11: Yes, ma'am. When there they were months apart, and they've
- 38:14Speaker 11: been knowing each other all their lives. All their lives.
- 38:17Speaker 11: They raised up with him and kids right on up.
- 38:21Speaker 11: I think after we, I don't know, six seven years old,
- 38:26Speaker 11: we kind of moved away from them. But they've been
- 38:29Speaker 11: long life friends.
- 38:32Speaker 1: Even though the boys grew up together and had been
- 38:35Speaker 1: close all their lives, Glenn no longer approved of his
- 38:38Speaker 1: son's friendship with King.
- 38:41Speaker 11: Him and Kan were running around together, and uh, I
- 38:46Speaker 11: know Kan's mother brought Kane over to our house one
- 38:49Speaker 11: day and dropped him out, and uh, when Kin got
- 38:53Speaker 11: out of the car, he was cussing his mama, saying
- 38:56Speaker 11: some words that I wouldn't tolerate. And I told Lee,
- 39:01Speaker 11: I said, look, you need to quit hanging around whatever.
- 39:04Speaker 11: Boy right there, I said. He gonna get you in trouble.
- 39:06Speaker 11: I said, he ain't no good. He's no good.
- 39:10Speaker 1: Lee's brother Jimmy, has a slightly different perspective. He thinks
- 39:14Speaker 1: Lee and King were equally bad for one another.
- 39:18Speaker 2: Yeah, Lee came, were real close. Uh.
- 39:24Speaker 7: I don't want to say the wrong thing about nobody,
- 39:27Speaker 7: but they wouldn't best for each other, I'd say, I mean,
- 39:33Speaker 7: there was always in the mischief, I guess which I
- 39:35Speaker 7: was right along with him most of time.
- 39:38Speaker 1: What kind of mischief?
- 39:39Speaker 4: What kind of trouble did you guys get into?
- 39:41Speaker 6: Oh?
- 39:42Speaker 7: Just kids stuff doing stuff we get strolling my dad's
- 39:46Speaker 7: tools everywhere, you know, stuff like that. Stuff we weren't
- 39:50Speaker 7: supposed to be doing things we shouldn't be doing to
- 39:54Speaker 7: I'd call it terrorizing the neighborhood, a little bit like
- 39:58Speaker 7: we might find dad amma or something said on somebody's
- 40:00Speaker 7: ports just from funny giggles. Wasn't nothing funny about it.
- 40:04Speaker 7: But we didn't realize that then when we was kids.
- 40:10Speaker 4: Not all of what Lee and his friends were up
- 40:12Speaker 4: to was just kids stuff.
- 40:14Speaker 2: Though.
- 40:17Speaker 9: Now, have I told you how bad I was with
- 40:20Speaker 9: distilling those sus and them? I really told you how
- 40:22Speaker 9: bad I was with that stuff.
- 40:25Speaker 4: How mad were you?
- 40:27Speaker 9: Okay, let me tell you. Look, I wasn't.
- 40:30Speaker 15: It wasn't.
- 40:30Speaker 9: I just still that same from James, Mama and Diddy.
- 40:35Speaker 9: I didn't just steal that say from them. Look, I
- 40:37Speaker 9: still stuff from my own Diddy, I still stuff from
- 40:40Speaker 9: my step dad, my mom's h ex husband. Now, because
- 40:44Speaker 9: I thought all that stuff was cold, I was just
- 40:47Speaker 9: still the stuff in people all around the neighborhood. People
- 40:49Speaker 9: didn't live in the neighborhoods with me. I thought I
- 40:52Speaker 9: was just here. I thought I just do whatever I
- 40:54Speaker 9: wanted to do. Wasn't thinking about the time people were
- 40:58Speaker 9: putting in hours, they were sleeping every week to get
- 41:02Speaker 9: this money, to buy these things, to boot in their house,
- 41:05Speaker 9: to give their families, to buy stuff for them. I
- 41:08Speaker 9: wasn't think about none of that stuff, didn't it. None
- 41:10Speaker 9: of that stuff mean nothing to me. I mean, yeah,
- 41:12Speaker 9: when I was Yeah, that's as far as it goes. Yeah,
- 41:15Speaker 9: that's the worst things I've ever did. I was the
- 41:17Speaker 9: thing when I was a kid, I was an idiot.
- 41:24Speaker 4: Lee's dad told us that for a while, Lee and
- 41:27Speaker 4: his friends had been able to get away with what
- 41:29Speaker 4: they were doing.
- 41:31Speaker 11: Yes, Detective Battles and some of these other detectives and
- 41:36Speaker 11: all they had called on that they knew these boys,
- 41:42Speaker 11: that Lee and Kane were doing this, but they could
- 41:45Speaker 11: not catch them.
- 41:46Speaker 4: Lee's brother, Jamie says, it wasn't just what Lee was
- 41:49Speaker 4: doing that caused him to be a person of interest
- 41:52Speaker 4: for local law enforcement. It was also what Lee was saying.
- 41:55Speaker 4: So you think that Stallas Battles problem with Lee was
- 41:59Speaker 4: not so much much the bad kid's stuff he was doing,
- 42:03Speaker 4: but his like disrespect.
- 42:05Speaker 2: Yeah, disrespect towards the law. Yeah, I mean was disrespectful
- 42:10Speaker 2: to and what.
- 42:11Speaker 5: Did what did your brother? What are some of the
- 42:14Speaker 5: things that your brother would have said to him?
- 42:16Speaker 11: Oh?
- 42:16Speaker 7: Well, I mean look, they'd walk the cops would walk up,
- 42:19Speaker 7: and he'd be like I smelled baking. I smell that,
- 42:24Speaker 7: he'd be what the hell you want?
- 42:25Speaker 2: Big? What you what you doing?
- 42:29Speaker 7: And uh, you know just kind of tell him, uh,
- 42:32Speaker 7: you got a problem and walk off from him. Uh.
- 42:36Speaker 2: There wasn't nothing they could do.
- 42:37Speaker 4: There was one officer in particular that Lee often had
- 42:41Speaker 4: run ins with Floyd County Police, Sergeant Dallas battle.
- 42:50Speaker 9: That was a fact of what got me was the
- 42:53Speaker 9: way I felt him.
- 42:54Speaker 13: How did you talk to him?
- 42:56Speaker 9: I thought him Brew. He asked me about burgers and
- 43:00Speaker 9: stuff I was doing. I told him I ain't out
- 43:03Speaker 9: here good, no workers. But if I was, I wouldn't
- 43:05Speaker 9: let no stupid motherfucker lock you cat me? And how
- 43:11Speaker 9: you say it, that's the way I was gam That's
- 43:14Speaker 9: the way I would help.
- 43:15Speaker 11: How do you react to that?
- 43:16Speaker 9: Do you say me back? Oh, Dallas, Yeah, you sell me.
- 43:21Speaker 9: Maybe don't give me one day? Yeah, Hey, you got
- 43:27Speaker 9: me too, You got me good.
- 43:30Speaker 4: On the night Brian was shot, Sergeant Dallas Battle became
- 43:33Speaker 4: the lead investigator on the Brian bowling case. Right away,
- 43:37Speaker 4: he concluded that Brian's death had been an accidental, self
- 43:40Speaker 4: inflicted shooting, a game of Russian roulette in which the
- 43:44Speaker 4: odds hadn't gone in Brian's favor. But a few days
- 43:48Speaker 4: after the shooting, Sergeant Battle changed his mind and he
- 43:52Speaker 4: began to investigate Brian's death as a murder. Next time unproof.
- 44:06Speaker 2: Yeah, I heard something about a pillow.
- 44:08Speaker 4: What did you hear about that?
- 44:10Speaker 11: Somebody told me that they found a pillar where it
- 44:13Speaker 11: was a pillow was used for a silence or something.
- 44:17Speaker 8: Mom had told him that somebody had put something in there,
- 44:19Speaker 8: and they said, we'll miss bowl, and the only way
- 44:21Speaker 8: we're going to be able to know that is if
- 44:23Speaker 8: we are a semispotting.
- 44:26Speaker 4: So you don't really know when you're learned about the
- 44:28Speaker 4: free birds or when they.
- 44:29Speaker 10: Were not may I don't remember. I want to say
- 44:33Speaker 10: it was probably after they had dug him back up
- 44:35Speaker 10: about the little stuff they had found in the cash
- 44:38Speaker 10: get and everything.
- 44:40Speaker 12: After the funeral, It's when it actually happened. We were
- 44:43Speaker 12: getting in the family car to leave to go to
- 44:45Speaker 12: the burial and they were screaming out the window and
- 44:49Speaker 12: I was trying to pull them out of the car.
- 44:50Speaker 12: We kind of everybody started fighting, you know.
- 44:53Speaker 7: Yeah, there was several people throwing punches. I don't know
- 44:56Speaker 7: who they were, Okay, I mean, it all happened so quick.
