- 1:55All right, Brett Swartz, welcome to Beyond Fulfillment.
- 1:59Dave, grateful to be here.
- 2:00Thank you for having me.
- 2:01Yes, sir.
- 2:02Thank you for taking the time.
- 2:04So Brett, you run a highly specialized firm that helps entrepreneurs defer capital gains taxes when they're making large exits, correct?
- 2:17Yeah, we serve purpose driven entrepreneurs and investors that are exiting big bitcoin businesses or real estate on the main ones.
- 2:23And they have huge capital gains tax.
- 2:25This is million dollar plus plus exits and they're facing a massive capital gains tax bill and they're looking for ways to defer it and compound the wealth.
- 2:34Okay, all right, so.
- 2:35And you've been, you've been in this business for quite a number of years.
- 2:40Was there an aha moment where you realized that, you know, building this company was.
- 2:46Was what you wanted to do?
- 2:48Yeah, it was.
- 2:49It was during the.
- 2:51More than one.
- 2:51It was actually.
- 2:52It felt like a calling, Dave.
- 2:53And so it felt like a calling because it was during the 2008 crash that everything hit the fan.
- 2:58Financial and a lot Of a lot of things happened with a lot of my clients that I was serving at the time.
- 3:04And I was at Marcus and Millichap helping people buy and sell multifamily properties in Sacramento, California.
- 3:09And my dream was to be able to be an entrepreneur in real estate.
- 3:14And in real estate it's 100% commission.
- 3:16And so I was, I was basically sinking financially, but my clients were losing half or all of their wealth as well.
- 3:22And you know, you get to a moment where you're like, do I really want to do this or is there or am I supposed to be somewhere else?
- 3:29And the neat part about a crash like that is it clarifies quickly what your values are and maybe what your calling is.
- 3:35Because if you're still feeling pulled and called to serve those that are in this space, perhaps it's a good sign, you know, and, and the money's not distracting you from, from that.
- 3:44And so it was that kind of a two year desert between 2000, call it late 07, really up to 2011.
- 3:51So more than like a three year desert where I worked really hard to help people get out of these situations.
- 3:57And we found that the biggest problem was they were overpaying for properties in was called a 1031 exchange.
- 4:04And that put them in a compromised position.
- 4:06And it wasn't just the finances and the tax.
- 4:09It was actually their family, their mission, vision, values for what they wanted to accomplish.
- 4:13It was coming, crumbling down because they felt trapped by capital gains tax.
- 4:18And so here at Capital Gains Tax Solutions, we, we exist to unlock capital gains, to multiply freedom and impact.
- 4:23And there's a story about a gentleman named Steve who had $50 million of real estate, two sons married, big house on the hill.
- 4:30I remember sitting down with him in early 2007 saying, Hey, I think it's a good time to sell.
- 4:34He's like, but Brett, if I sell it, I don't have a great place to invest the funds.
- 4:37And even if I did, I probably going to overpay for it because the market's really hot still.
- 4:42And, and I have a lot of debt that I have to replace and, and if I don't execute this in this tight time frame, I'm going to be hit with a huge tax as these rules you have to
- 4:51follow in the 1031.
- 4:52He goes, I'm going to just stay where I'm at.
- 4:54And he knew that was kind of a, not a great decision, but he kind of felt stuck.
- 4:58And at the time we didn't have the solution for him.
- 5:00So we Couldn't really argue, you know, really give him a good, good solution.
- 5:03Well, fast forward, he loses all of his wealth, 50 million of real estate, loses his marriage and was bankrupt, lost his house.
- 5:12And I couldn't help but think, when I was a kid growing up, my parents were divorced and my brother and I could, couldn't spend time with my dad, who had built real estate and owned rentals and done all
- 5:22of the really cool things.
- 5:22And looking back and saying, you know, if there's a way that can keep families together to multiply freedom and impact within this world of capital gains tax, man, I think we can change a lot of lives and help
- 5:34a lot of families.
- 5:35And so that was probably, those three years was the defining moment of where I would be and where I'm now.
- 5:41Okay.
- 5:43So you go through this process and stories like that have a huge impact when you see the, the, the, the lack of this solution and how, how detrimental that can be.
- 5:56Right.
- 5:56So that impacts you.
- 5:57And like you said, this was a calling to basically create this solution for, for, for families to, to, you know, create impact and whatnot.
- 6:08So when you have that, you realize this is what you want to do and you're called to it.
- 6:13How did you go about building this company?
- 6:16Yeah, I think it's one cold call at a time back in those days, you know, and if there's a saying, Dave heard of this, that the profit's not accepted in his hometown.
- 6:23And before this interview, you asked me, so are you like a CPA firm or what?
- 6:26You know, are you CPA or, you know, you know, I'm like, well, actually I'm a trustee and I work with the CP and a tax attorney to set these up and execute them.
- 6:33But I'm, I am the entrepreneur, real estate owner, right?
- 6:36Investor broker.
- 6:37That's, this is who I grew up, you know, and so there's a saying that your best position to serve the person you once were, you know, and, and I, I couldn't help but see that, that what investors want
- 6:50is leverage.
- 6:50What they want is flexibility.
- 6:53And what they want is the ability to steward their wealth with their families in a way that, that, that is, keeps and maintains momentum.
- 7:01And so the, the kind of, the backing of, of like, okay, now I'm going to start, I'm going to start the company.
- 7:08I'm going to, I want to, I want to help these families.
- 7:10I feel called to this, began to begin to say, okay, let me cold call these people, let me talk to them.
- 7:19And you know, as a new entrepreneur, you're you got this idea and you think everyone's going to just jump in on it.
- 7:24And so I'm calling these people, but they're like, who are you?
- 7:26You're just a real estate broker.
- 7:28You're like, you're just a real estate agent.
- 7:30You just, you know, you sell multifamily properties and, yeah, you know, about 1031s, but I've never heard of that.
- 7:34Are you a CPA?
- 7:35Let me talk to my CPA.
- 7:36It seems like it's too good to be true.
- 7:37And, and, and, and so I kept calling and calling and calling and, and I, every now and again I get a meeting and I get a bigger meeting and a little bigger meeting.
- 7:46And all of a sudden I was finding myself in bigger meetings with, you know, billionaires and those that otherwise wouldn't have taken my call because I was actually offering something of value and that could solve their problem.
- 7:57And I found that as the pain of the 08 crash went on, it's like Mike Tyson says, like, everyone's got a plan and everyone's got it all, a solid plan until they get, you know, punched in the mouth,
- 8:06a punch in the nose, right.
- 8:07Once they get into the ring.
- 8:08And that humbled a lot of people.
- 8:10And so I was there saying, look, if there was a way that we could have solved that pain and unlocked your dream, would you have, would you listen?
- 8:18Would you meet with me?
- 8:19And they said, sure.
- 8:20And so that was a little bit of momentum.
- 8:22But it wasn't until really I, I started a podcast, right?
- 8:27I, I wrote a book, right.
- 8:29I went, I went national and I stopped just trying to teach an old dog new tricks, if you say, if you will, right.
- 8:37To be fair, a lot of that time a lot of values were dropped by 40, 50%.
- 8:41So people didn't have a lot of gains.
- 8:43And so they were saying, call me back when you close some deals, call me back when my properties are worth more.
- 8:48But I started to expand.
- 8:49Like what we doing right now, the microphone, right, the, the, the, and compound the, the communication effort.
- 8:55So the podcast really helped a lot.
- 8:57The YouTube channel helped a lot.
- 8:58And we went national versus just hyper local with, with one on one cold calling.
- 9:02I kind of went, I kind of went one to MIDI with podcast.
- 9:06Okay, all right.
- 9:07So as you're building it one cold call at a time, right, you're realizing that you're getting meetings, but it's tough to get results with that approach.
- 9:16And you realize that the, the leverage that the speaking one to many with the podcast, the YouTube channel and all that has as you're building this too, and you, I mean, was there like, discouragement too, when you're making
- 9:31all these calls and I'm sure you're working long hours and you have these big ambitions like every entrepreneur does when they start out, but like the results just aren't there yet.
- 9:40Was it, was it like, what was the mindset like in those, those early days?
- 9:45Yeah, I caught the, the honey badger.
- 9:46If you ever look up the honey badger, it's one of the coolest animals to study and get a chance.
- 9:50You know, I, I grew up playing sports and I grew up very competitive, Competitive world.
- 9:56Basketball, played basketball, college and stuff, and football in high school.
- 10:01And you know, it's interesting because you go to college and you don't really know what you're going to do, per se.
- 10:07Maybe, maybe some people do.
- 10:09And then you catch the internships and then you fall in love with an industry like commercial real estate and investing and such, and, and then you're just in it, you know, and all of a sudden you don't know
- 10:19the difference.
- 10:19I think one of the advantages of going and kind of.
- 10:22I graduated in May of 2007.
- 10:24Okay, so this is right before things really hit the fan.
- 10:27Like, you don't have a baseline for what.
- 10:31It's the bottom of the barrel, right?
- 10:33It's like if you can make it in that world and learn in that world and persevere in that world, then it's probably, you're probably pretty, you're pretty set to, to, to kind of persevere.
- 10:43So I had great coaches, great mentors, great people.
- 10:46You know, my mom always inspired my brother's first graduate college.
- 10:49I was the second in both sides of the family.
- 10:52My mom always inspired a belief in us that if, if we, you know, work very hard, if, you know, believe in the gifts that God's given us, well, we can make a big impact and we can, we can,
- 11:01we can achieve, you know, success, you know, much, much success.
- 11:04And so I think a lot of that was kind of instilled into me and I just kept going, you know, and, and, and I also would see others that are achieving it and I'd say, if they can do
- 11:14it, I know I can do it.
- 11:15Right?
- 11:16If they're, if they're doing it after so many years, you give me a few more years, I will, I will figure out a way to be better or at least as good as they are.
- 11:24So.
- 11:24But yeah, it wasn't without the 70 hour weeks, working nights and weeks at Cheesecake Factory.
- 11:29You Know, multiple medical sales job between these, these things as well, driving 22, 000 miles, moving with my brother to his small condo, having to borrow $5,000 from my dad because we literally went broke.
- 11:39We lost all of our money.
- 11:40We had no money left.
- 11:40We had loans, we had debt, all this stuff.
- 11:44And I remember I was working these, these, these nights and weeks at T Shake Factory, these AAU basketball tournaments.
- 11:49I was the hot dog doorman or I take your.
- 11:51Take the door.
- 11:52I was the bill, I was the bouncer.
- 11:53So I put the wristband on you and then I'd sell you a hot dog.
- 11:56And my, my mindset was every single kid that walked through that door, there was $20 in his pocket, he wanted to buy the Gatorade, the hot dog.
- 12:03And if I, if I could sell it, I could make more money like.
- 12:06And that was, it was, it was down.
- 12:08But we were also serving, we're helping the university to be able to bring in more revenue through these AAU basketball tournaments.
- 12:14So, yeah, I guess, I guess you could say hustling.
- 12:16I guess you could say I, I didn't matter.
- 12:19I was going to figure it out.
- 12:20By the way, I was still working at Marcus and Milchev this whole time.
- 12:24I was still doing the cold calls, right?
- 12:26I wasn't just, I didn't just leave that.
- 12:28I was back during the seasons where I learned about all of this.
- 12:31So I would work, you know, call it 7am about 4 or 5pm every day, every Monday through Friday.
- 12:37And then I'd go to Cheesecake Factory about 5 o' clock and I worked till about 9 o'.
- 12:41Clock.
- 12:41I do that over and over and over again.
- 12:44Probably, you know, four or five days a week, you know, doubling up shifts, right?
- 12:48And I did that for two straight years.
- 12:50And so I would say that that's what you have to do.
- 12:53It's, it's an and, it's not an or, it's not.
- 12:56Oh, I got to give him my dreams to go work this side, to work this, you know, this job in order to potentially go back to my, my, my dream.
- 13:04It was like, I'll do whatever it takes to do both.
- 13:07Now I had a big support from my wife who was willing to move my brother into a small condo, right?
- 13:13And, and then I got a break where we got to work at a medical sales job.
- 13:16And that got us a salary and benefits.
- 13:18But guess what?
- 13:18When I'm driving 22, 000 miles to all these hospitals all over Southern Oregon and California, northern California, I'm making calls to My real estate clients, right?
- 13:27And I'm checking in with them and I'm seeing how they're doing.
- 13:30Like I didn't give up on the first dream.
- 13:31I'm talking about the dst.
- 13:32I'm talking about the deferred sales trust.
- 13:34I'm talking about tax.
- 13:35I'm still maintaining and building those relationships.
- 13:38Here's why.
- 13:39I told them not to sell a few years back.
- 13:40I said, don't sell.
- 13:41It's not a good time to sell if you don't have to.
- 13:43And now they're calling me when the market roars back and they're like, hey, I'm ready to sell.
- 13:46Like, sweet.
- 13:47So then I found myself, you know, working and being a top professional in the medical sales.
- 13:52And then also I'm getting these, call it now my side hustle in commercial real estate, selling these big, you know, multi million dollar properties, getting these huge check x.
- 14:01And now I have this massive dual income like this harvest season.
- 14:04So that's the answer.
- 14:05I mean it's, it's, it was blood, sweat, tears, but it was also very, I was very fortunate to have a lot of people who supported me.
- 14:13Okay, wow.
- 14:14And that's appreciate you highlighting everything that it took to really get, get to where you are and some of those tough times when you're going through that and you're literally working to a grueling schedule, right.
- 14:297:00am to 9:00pm Multiple jobs every day.
- 14:33Right.
- 14:34With a wife and you know, very, you know, like you said, living in a small condo.
- 14:39And it's just two straight years, right.
- 14:41When you're going through that, was there ever a point in time where you, you thought about like giving up on this dream?
- 14:48Good question.
- 14:50I can't remember like a specific time.
- 14:53I just, I just, I knew.
- 14:57I, I think I've been given a gift of, of faith.
- 14:59You know, believe in where God wants me to be.
- 15:01Believing in God, what has for me and trusting that process.
- 15:07So honestly, not really.
- 15:09I mean I, I had a lot of fun at Cheesecake Factory.
- 15:12I had a lot of fun, you know, at medical sales.
- 15:15Like it wasn't my calling, but I had a lot of fun doing it.
- 15:18I learned a lot.
- 15:18I learned.
- 15:19You learned from one of the best real restaurants in the country.
- 15:22I think it's the number one restaurant.
- 15:24I had great managers, great leaders.
- 15:26I know how to, you know, serve in hospitality, communicate.
- 15:29I mean being a server is not easy, right?
- 15:31Medical sales, going into, you know, ors, you know, training nurses and respiratory therapists, learning about all kinds of, you know, different science I also did veterinarian sales.
- 15:41At one point I would, you know, have you seen the pursuit of happiness in Will Smith?
- 15:44And he's running out those big boxes, right?
- 15:45He's trying to sell them.
- 15:46That was basically me.
- 15:47I had these big boxes, these chemistry hematology machines.
- 15:50And I go into these animal hospitals and I talked to the doctor to try to get him to sell, you know, buy the box.
- 15:55And when he bought the box, they could do, it's called real time care with these, with these animals to be able to give them extra care for dogs and cats.
- 16:02So I had a, I had a blast doing it all.
- 16:04You know, in other words, it was a privilege, not a sacrifice to pay the price for my dreams, right?
- 16:11It's an absolute privilege.
- 16:12You know, I wouldn't change any of, Taught me so much.
- 16:16It gave me so much grit and tenacity.
- 16:18It brought me and my wife closer together.
- 16:20You know, I found that even though financially it was tough for those two years, and by the way, for those two years, I literally was making like 0 and 5,000 in commercial real estate.
- 16:30And then it was just, and then there was no medical sales, there's no salaries, no benefits.
- 16:34And we had our first baby that came and we barely, you know, we really couldn't afford healthcare.
- 16:40We had to get healthcare through to the state.
- 16:42So it was, I mean, it was, it was literally nothing, right, financially.
- 16:47But we were so rich in our marriage.
- 16:48We were so rich in, like, our commitment to each other.
- 16:51My brother was supporting us, my parents were there.
- 16:53We had local family, like, so I mean, wealth.
- 16:56I think too often if we let financial monetary wealth and security be the foundation for what we're building, then you can quickly become poor, right?
- 17:07But when you have wealth of the human relationships, of the family, of the growth man, I, I never felt poor, right?
- 17:18I know we were, we were financially, you know, on our backs, but I never felt poor.
- 17:22So I, I, I, I never thought about giving up.
- 17:26I know I would have just figured out another way to get another job or another thing, you know, or, you know.
- 17:30But I did do medical sales and veterinarian sales.
- 17:32That was like a five, six year term, right?
- 17:34So we're kind of covering a 2006 all the way to basically we're 2025.
- 17:39We launched our company technically in 2017, but I didn't go all in until about 2020.
- 17:46And now we've built it over, you know, 150, $170 million under management, and we're helping all of these families.
- 17:53So the answer is I don't think so, Dave.
- 17:55I'd really never thought about giving up.
- 17:56I just kind of kept going.
- 17:58Okay, all right.
- 17:59And then talk about when.
- 18:01Was there, like, a specific inflection point where things really started to take off after all this.
- 18:07This grit and hustle and.
- 18:09And blood, sweat, and tears over that many years?
- 18:12Yeah.
- 18:12I was sitting in my home office in Roseville, California, and I think Covid is hit.
- 18:19And I remember thinking, okay, I'm about to get on.
- 18:23I need to get on camera.
- 18:24I need to make these videos.
- 18:25Right.
- 18:25Oh, my gosh.
- 18:26I didn't want to be on a video.
- 18:27I was used to cold calling, meeting face to face.
- 18:30Now I'm getting on this video, and I'm starting this YouTube channel I'll never forget.
- 18:34It's a dark room.
- 18:35I got the camera, and I'm, like, talking to my phone.
- 18:38I'm like, this is just so.
- 18:40This is absurd.
- 18:40I just.
- 18:41I just thought it was so absurd.
- 18:42I didn't want to do it.
- 18:43I'm like.
- 18:44And I just kept doing that.
- 18:45And then it helped when I started a podcast and I started interviewing other people because it took the pressure off of me just being the guy talking to the screen.
- 18:53Right.
- 18:54And then I started going to other people's podcast, and that landed me on the biggest stage in commercial real estate, one of the biggest stages for a conference.
- 19:01And that led me to meeting a group who's now at Top Strategic alliance and getting on their stage.
- 19:06And so I honestly would say the moment I got on that camera in my office and pushed through the fear and the awkwardness and said, it's not about if you like this or not.
- 19:17It's not about you.
- 19:18It's about making an impact and using the gifts you've been given and steward those in a way that's going to bless other people.
- 19:25So get over yourself and get on the camera and start talking about what, you know, what you're passionate about.
- 19:31So that was.
- 19:31That was the moment, for sure, that led to all kinds of.
- 19:33All kinds of amazing things.
- 19:35That's such great insights, too.
- 19:37Right?
- 19:37Because you hear that so often from people where maybe they have this spotlight effect type of thing, and they're they're just scared to get on camera.
- 19:48And then a lot of times, too, that fear will just prevent people from doing those necessary actions.
- 19:52And I love that mindset, too, where you take.
- 19:55It's not about you, but it's really about stewarding your gifts and serving others and using your gifts to.
- 20:01To create an impact and.
- 20:03And having that help you push through the fear to just take the action.
- 20:07And then ultimately that was the catalyst for all this, this success that you've had.
- 20:12Is that, is that right?
- 20:13Spot on.
- 20:14Okay.
- 20:15All right.
- 20:16And then talk about like the, the growth from there of the company and, and like some of the success stories and people that you've, you've been able to help.
- 20:24Yeah.
- 20:25And so we, we start to get people calling us from all over the country.
- 20:30Right.
- 20:31About what we do and resonating with the stories and, and resonating with the, the transformation it can have for families and, and you know, eventually you get 10,000 hours in a subject and, and you, you know, you've been
- 20:45studying it for over a decade and, and, and you, you know, you become really proficient at it, let's just put it that way.
- 20:52And you start to see and understand how to solve complex wealth problems within the tax world.
- 21:00And so that was a huge, huge piece of this.
- 21:05And the momentum starts to build and, and, and then you start hiring.
- 21:09Right?
- 21:10And then you start, you know, you're building systems.
- 21:12So the systems, there's people, there's process, there's culture, there's core values.
- 21:17I think we have over 10, 10, 10 team members now.
- 21:19And, and you know, we have team members international, we have teams, California team members in, in Texas and Florida.
- 21:26And so, so that now you have to learn how to become a business owner.
- 21:30It's not just a one to one, it's a, it's an entire, it's entire.
- 21:35It's a company, it's a business.
- 21:36And so that's a whole other part of growth.
- 21:39And you know, hiring coaches for that and understanding integrator versus you know, leader versus the visionary and you know, delegation of time.
- 21:49And I mean there's just so, so much the entrepreneur journey is a journey of personal growth and tenacity and it's going to test you in every which way.
- 21:59And yeah, so that's what I would say, unfortunately.
- 22:01Fast forward.
- 22:02My wife and I, we had five kids and she's been full time mom in the whole time, has not had to leave the kids at all.
- 22:09And she yet spread her passion.
- 22:10We homeschool our kids and you look back and you go, wow, it was all worth it.
- 22:15It was all worth it to be on this side.
- 22:17But that, yeah, that was, that's the big thing.
- 22:19I think the other then you shift from like you being the hero to a client's being the hero.
- 22:23And so we'll interview people on our podcast, our clients and, and really they are the heroes.
- 22:27Right.
- 22:27And we're just the guide and having that shift of mindset to, okay, we need to highlight their story because as soon as we empower them with what we have, and they love the growth, they love the personal growth
- 22:40of this because they're stepping out of their box.
- 22:41Because you see these, these are real estate owners and business owners and bitcoin owners that have been used to having unilateral 100 control of their world.
- 22:49Right.
- 22:50And the tax man, if it wasn't for the tax man, they would stay in that state.
- 22:55But this gives them a chance to step out, trust a third party trustee.
- 22:59That's our role.
- 23:00To create a capital gains tax exit plan that allows them to defer all of this gain and then build a wealth plan that gives them what's called truly passive income.
- 23:09And so to wrap it up, it's, it really becomes now about how that's changed their life.
- 23:15Right.
- 23:15And this is the coolest part.
- 23:17So we got to the point where we serve these amazing families.
- 23:20Amazing clients are like family.
- 23:22And now we get to share their stories and highlight them as the heroes.
- 23:26And then, and then it just compounds because client testimonials is much stronger than anything that I could say on a podcast or on a video when they say it.
- 23:35And it transforms their life.
- 23:36Like, it's, it just gets, it gets a lot.
- 23:39It becomes a, it becomes really fun because you're just sharing the transformation versus selling something that, that you offer.
- 23:46Okay.
- 23:48All right.
- 23:48And Brett, if people want to get in touch with you or learn more what you do about what you do, can you just speak to, to who you benefit and, and what's the best way people can reach out
