- 6:02Speaker 3: with Queen Angela, you are missing some good nuggets. You
- 6:07Speaker 3: guys gotta you have to tune in and listen. Well,
- 6:11Speaker 3: this morning, I posted that a lot of people don't
- 6:15Speaker 3: think that color plays a part in the justice system
- 6:23Speaker 3: and doing the the sentencing phase.
- 6:28Speaker 4: But you know me, I always love.
- 6:30Speaker 3: To make sure that I'm giving out right information. I
- 6:36Speaker 3: went on and I did my research, and when I
- 6:40Speaker 3: researched it, it came back saying that just like I
- 6:45Speaker 3: thought it does, race dude plays a part in the
- 6:50Speaker 3: justice system when it's when it's come to sentencing and
- 6:54Speaker 3: jury and and other things. So I don't know who
- 7:01Speaker 3: want to start first, If it's kac or Cordnell, you know, Okay, well, I.
- 7:11Speaker 2: Will, I will go ahead and uh allows the case
- 7:14Speaker 2: to come on first, marm and I go ahead and
- 7:16Speaker 2: tell this story because just sill Man Toronto one. I'm
- 7:19Speaker 2: gonna go ahead and say, so, what's the case.
- 7:21Speaker 4: How are you doing?
- 7:24Speaker 2: I'm doing good Cornell and uh, okay, sir, we're gonna
- 7:29Speaker 2: start it out. Oh, I will have your funds, So
- 7:34Speaker 2: I said, you know, fifteen years ago, looking at twenty nine,
- 7:42Speaker 2: two thousand and nine, I would say for San Antonio
- 7:47Speaker 2: and then left court. I get a phone call from
- 7:51Speaker 2: a guy who was happening relationship with my wife. The
- 7:55Speaker 2: guy need I was what was really happened. I had
- 8:00Speaker 2: sugar that was put inside of my truck. Somebody had
- 8:04Speaker 2: played ship in my truck. Wanted to find out this
- 8:06Speaker 2: guy had did it. He was massed to my wife
- 8:09Speaker 2: doesn't need me to be with him, and he called
- 8:13Speaker 2: me my job in front of me, dressed me about
- 8:17Speaker 2: my wife, that she's gonna always be with him, that
- 8:21Speaker 2: she's his and there's nothing I can do it about.
- 8:24Speaker 2: Of course, to get into an argument, I get mad.
- 8:28Speaker 2: I had to do it. I had to get me
- 8:29Speaker 2: someone because an argument about this guy that she was
- 8:36Speaker 2: seeking with putting sugar in my truck. So when I
- 8:39Speaker 2: get home getting him, get into an argument. My stepdaughter
- 8:45Speaker 2: calls her brother. Her brother comes over till I come
- 8:48Speaker 2: over to my house with two of his friends, my
- 8:51Speaker 2: stepson and his friends. The Christ gave me. Then in
- 8:54Speaker 2: the game, my son of his friends had guns on.
- 8:59Speaker 2: I ended up having to shoot my step farm who
- 9:02Speaker 2: threatened me. He threaded to kill me. I shot him
- 9:05Speaker 2: in front of my nail. Pause why he was pointing
- 9:07Speaker 2: white people put a nine million miss gun at me
- 9:11Speaker 2: dress that killed me, threatened to shoot me. When April
- 9:14Speaker 2: waitness he heard it because the kind of of trial
- 9:17Speaker 2: that he heard. His friend ran to fi my garage
- 9:23Speaker 2: up in my driveway and he was raised in his
- 9:25Speaker 2: hand like he's getting ready to shoot me. I couldn't.
- 9:28Speaker 2: I couldn't shot killed me, but I didn't do it.
- 9:31Speaker 2: I shot him in the hands. I shot my step
- 9:33Speaker 2: farm in the hands doing his listidance. He shoot me
- 9:38Speaker 2: so much? Then, why I said, I just signed even
- 9:45Speaker 2: so that I couldn't deal with what had happened, what
- 9:48Speaker 2: I had done. But while I'm at my house concentrating
- 9:52Speaker 2: the suicide by the police officer, everybody calling my my
- 9:57Speaker 2: mother in law, called telling me that the the police
- 10:00Speaker 2: need to kill me, that they need to shoot and
- 10:02Speaker 2: kill me. I said, yeah, people don't do that. I'm
- 10:04Speaker 2: gonna make sure they do that. This is what what
- 10:07Speaker 2: brought me to do this little by Then her cousins
- 10:11Speaker 2: called them, telling me that the reason why they didn't
- 10:14Speaker 2: want to be in my waiting because the sheet know me,
- 10:16Speaker 2: she's always been cheating on h. This is not I
- 10:21Speaker 2: feel like a good thing to be telling somebody who
- 10:24Speaker 2: just this traumatic thing to doing. So now I'm getting
- 10:27Speaker 2: for my marriage is like a lot. I'm looking at that.
- 10:30Speaker 2: Everything that was going on in my life was I
- 10:34Speaker 2: shocked my binion because I feel like that the same
- 10:37Speaker 2: river that I had in my bisiod had been changed.
- 10:39Speaker 2: That it was nothing. I felt dirty, so I thought
- 10:43Speaker 2: it popping bottles. I had some POSI I would leave
- 10:48Speaker 2: a bottle popped. I drank half of it. I popped
- 10:51Speaker 2: the feeling her bottles popped, that half of us drank
- 10:53Speaker 2: that I got a whose court bow. I popped that bottle.
- 10:57Speaker 2: Was wanted to drinking that. I took some Papa. Then
- 11:00Speaker 2: it was in my mom my wife vic and then
- 11:03Speaker 2: I throw a foll in my mouth and I see
- 11:07Speaker 2: the police sometimes and I tried to tie to the
- 11:09Speaker 2: kit the thing on my mind that I just wanted
- 11:14Speaker 2: to jove and every in my life and my man
- 11:16Speaker 2: and everything that was going on in my life. Look,
- 11:19Speaker 2: I'm gonna kids myself. I wanted the police to do
- 11:21Speaker 2: it because I was powered. I was too much to
- 11:23Speaker 2: tower to do it. So I'm talking to a negotiating
- 11:26Speaker 2: during the time of the offense, everything that was going on, negotiating,
- 11:32Speaker 2: he talked me out of and to be able to
- 11:35Speaker 2: turn my tailf he in turned myself in. Come to
- 11:41Speaker 2: find out that I shooting off my window because I
- 11:43Speaker 2: shout out. I shout out my window trying to type
- 11:45Speaker 2: police to shoot me. There was the police if they
- 11:48Speaker 2: was picked across the street. They were sitting in the bush.
- 11:51Speaker 2: The podiander pushed everyone doing oh that's this. It was
- 11:55Speaker 2: a compete degrading bush. And the man was the police
- 11:58Speaker 2: office that was hotting there with a car carpetting rifle
- 12:04Speaker 2: with a nighttime visions scope on it, trying to get
- 12:06Speaker 2: a clear shot in it. But I had no idea
- 12:09Speaker 2: he was in this this bush. He got hit with
- 12:11Speaker 2: the peans of the shotgun I had in two spots
- 12:14Speaker 2: in the sin he said, he pulled them out because
- 12:17Speaker 2: they doesn't go it. I didn't know how to hit
- 12:19Speaker 2: him until after I was driving, after the police was
- 12:22Speaker 2: taking me in for questioning, they told me that I
- 12:25Speaker 2: shot a police officer. I didn't I and that they
- 12:29Speaker 2: said he was all right, that he wasn't hurt. Seriously,
- 12:32Speaker 2: they tell me why myself done? They tell me about
- 12:34Speaker 2: his best friend, and they told me to say shot
- 12:38Speaker 2: but they was okay. But still my mind, my mind,
- 12:42Speaker 2: I was hearing things, but I really wasn't comfortingending the
- 12:46Speaker 2: tool aspect of it. I just wasn't there and continue
- 12:54Speaker 2: that they was supposed to have been doing is putting
- 12:56Speaker 2: me up the sacrifice. Psychological evaluation too, Why was I
- 13:01Speaker 2: trying to do suicide by cop? Nobody casts me about that.
- 13:06Speaker 2: I was never evacuated for my mental state as a
- 13:09Speaker 2: particular time of what was going on. So I'm I'm
- 13:13Speaker 2: going through the proceedings now of the course.
- 13:17Speaker 4: Can I.
- 13:20Speaker 3: I'm sorry to interrupt, but I just want to jump
- 13:23Speaker 3: in right quick. And then you said something about your
- 13:28Speaker 3: mental and that's what I was about to.
- 13:32Speaker 4: Ask you about your your mental health.
- 13:38Speaker 3: By all of that, what everybody was saying to you
- 13:43Speaker 3: your mother in law saying that you should just go
- 13:47Speaker 3: ahead and let the police kill you and your family
- 13:51Speaker 3: are members calling saying that letting you know the reason
- 13:55Speaker 3: why they wasn't in your wedding.
- 13:58Speaker 4: Because she had child on you. Her cousins.
- 14:01Speaker 3: Oh, her cousins called you, So would yours?
- 14:07Speaker 4: So would you say that right there?
- 14:11Speaker 3: You just had a milk down or you just went
- 14:16Speaker 3: you just lost your mind at that moment, not finding
- 14:19Speaker 3: out what you know at that stage, I had to
- 14:26Speaker 3: shoot my.
- 14:26Speaker 2: Stepm so and I'm so. It's different from someone that
- 14:34Speaker 2: you feel that you were in the threat or that
- 14:37Speaker 2: your life is endangered with like I looked at the
- 14:40Speaker 2: situation is being dangerous. But at the same time I've
- 14:44Speaker 2: had I had a gun training my differences and ex military.
- 14:49Speaker 2: They take me to the gun rings, taught me how
- 14:52Speaker 2: to use weapons. They gave me the protocol or shooting
- 14:55Speaker 2: the building if I have to shoot someone. Because anybody
- 14:59Speaker 2: is been through training and gum training. The you shoot,
- 15:03Speaker 2: shoot killed. They gonna teach you to shoot the room.
- 15:06Speaker 2: They tell you to shoot and kill. When you're taking
- 15:08Speaker 2: any kind of gump training, there is no shoot the
- 15:13Speaker 2: person in the leg or shooting them in the arm
- 15:15Speaker 2: and anything like that. But I felt like that I
- 15:18Speaker 2: was so good that I can neutralize the situation from
- 15:22Speaker 2: getting any serious. So I know from from the standpoint
- 15:26Speaker 2: I looked at my stef front of friends, more dangerous
- 15:31Speaker 2: than them because he was in college. He was taking
- 15:34Speaker 2: with people from his plans who they you know, they
- 15:39Speaker 2: adopted him game like he wasn't know who the remember
- 15:43Speaker 2: and just thing like you know, like being jumped into
- 15:46Speaker 2: it against thee the property through the game procedures how
- 15:49Speaker 2: they do. He was, okay, you cool. See people go
- 15:53Speaker 2: pay you down with us that ain't high and goat
- 15:55Speaker 2: and and everyone just listening to continue that ain't the game?
- 16:00Speaker 2: Like that vote you got the titles whatever whatever you
- 16:06Speaker 2: affiliated with, I.
- 16:08Speaker 4: Think Cornell, I want to ask you a question.
- 16:12Speaker 2: Yeah, okay, So at the time of the incident, right
- 16:19Speaker 2: priortidents that do you have you had any undermental issues
- 16:24Speaker 2: related to your mental consciously as far as you know
- 16:28Speaker 2: to make a determination whether or not you are competent
- 16:32Speaker 2: or at the time of these proceedings that you know
- 16:35Speaker 2: caused you the committed of the incident to what you called,
- 16:38Speaker 2: have you had any far incidents prior to this incident?
- 16:42Speaker 2: That anybody can say, well, hey, you are something's wrong
- 16:45Speaker 2: with you, or you mentioned any competent or you know
- 16:47Speaker 2: you have psychological evaluation problem? Has that in any other
- 16:50Speaker 2: incident other than that? When I was nineteen years old,
- 16:57Speaker 2: I was thinking a girl her mother made killed our baby.
- 17:04Speaker 2: She be going to military playing and almost to marry
- 17:08Speaker 2: this girl and her mother made her get an abortion.
- 17:14Speaker 2: They called me to come to a house and tell
- 17:17Speaker 2: on me. The mother tell me I'm not gready to
- 17:20Speaker 2: be no grandmother, and she's not and my daughter's not
- 17:23Speaker 2: ready to be no more. I made her get rid
- 17:25Speaker 2: of it. So when she said I get rid of it,
- 17:29Speaker 2: I mean, it's just it did something to me. And
- 17:34Speaker 2: nineteen years old not understanding of this emotions and bolts
- 17:39Speaker 2: that I just lost the child and I didn't know
- 17:42Speaker 2: how to affect the emotions. And I tried to deal
- 17:44Speaker 2: with my mother. I didn't want to deal with her.
- 17:48Speaker 2: I didn't want to deal with thinking about it. Okay,
- 17:52Speaker 2: So what did you say that he is a a
- 17:57Speaker 2: rep of that type of an incrument that anytime you
- 18:00Speaker 2: get in a situation and I turn up that guy
- 18:04Speaker 2: came a gun. So you know you was there to
- 18:05Speaker 2: defend yourself. So that would because of the fun of
- 18:08Speaker 2: her self defense case. But after that incident to where
- 18:12Speaker 2: after you shot these individual, you were saying that you
- 18:15Speaker 2: was ready to go out by suicide rockco. So I'm
- 18:18Speaker 2: in the question that did you have any other alternatives
- 18:23Speaker 2: other than trying to go ahead and to have them
- 18:26Speaker 2: Do you see, like she said, did you just felt
- 18:29Speaker 2: like a meltdown from that or what?
- 18:34Speaker 5: Mentally?
- 18:34Speaker 2: I was not there.
- 18:36Speaker 6: I mean, because you can't hate they had left the building,
- 18:41Speaker 6: any any kind of emotional attachment, feeling anything.
- 18:46Speaker 2: It was good. Ah, my marriage, I felt like it
- 18:51Speaker 2: was I felt like that it was real. Oh, I
- 18:55Speaker 2: love it. I love this woman, and I loved her kids.
- 18:59Speaker 2: And and to have to a hurt a sun that
- 19:04Speaker 2: destroyed me inside and I didn't know how to I
- 19:08Speaker 2: didn't know how that happened to me. I felt like
- 19:14Speaker 2: that I was afraiding to my family. I felt like that,
- 19:17Speaker 2: h I felt so. I felt like it was better
- 19:21Speaker 2: be dead than coming back to prison. You know, I've
- 19:24Speaker 2: been to the person before twenty four years ago. I
- 19:27Speaker 2: wasn't planning on making no trip back to no person.
- 19:30Speaker 2: I thought I had my life together. I had three
- 19:33Speaker 2: cook jobs and what I mean, I'm a I'm a
- 19:38Speaker 2: black male who had a criminal record. But I thought
- 19:41Speaker 2: I had redeemed my reputation. I thought I had. I
- 19:45Speaker 2: thought I had got all that stuff behind me, and
- 19:48Speaker 2: I moving toward her in a prosaitive way. But you know,
- 19:51Speaker 2: I was looking like I was damaged. I was damaged
- 19:55Speaker 2: in side and I and there was no coming back,
- 19:59Speaker 2: you know, And he's dead than to go through this
- 20:04Speaker 2: type of stuff that I'm falling through right now? You know,
- 20:07Speaker 2: this is this isn't in and there's warehouse looking like that.
- 20:12Speaker 2: I'm some kind of growth natural products and I'm some
- 20:15Speaker 2: kind of I mean just invisted to make other people
- 20:19Speaker 2: money up that you want fifty This is this is
- 20:21Speaker 2: not being treated like an animal less than animal. Anomi,
- 20:26Speaker 2: get to me that I'm getting Get the idiots getting
- 20:29Speaker 2: treated Okay, Well, how would you take society? How would
- 20:34Speaker 2: you take society looking at you, uh and shot two
- 20:38Speaker 2: people and shooting a gun at police officers or stuff
- 20:41Speaker 2: like that. Would you think the society would classify you
- 20:45Speaker 2: as a minister society as a person with anger management
- 20:48Speaker 2: problems or something like that, but totally disregard for the
- 20:51Speaker 2: safety of other people. You wouldn't take it like that?
- 20:54Speaker 2: How would you take it? So I couldn't take it
- 20:58Speaker 2: like that. I was putting in the credit situation, well
- 21:01Speaker 2: that I had an individual pull a gun on me
- 21:04Speaker 2: and telling me that he was gonna kill me. Don't
- 21:06Speaker 2: shoot one of my students. I got found up for
- 21:12Speaker 2: the trem I got found to shoot the tree because
- 21:16Speaker 2: I shot him, and I watched the point because he
- 21:19Speaker 2: well he got shot the first time. He ran the
- 21:21Speaker 2: head behind a car and that like, he's finish, shoot
- 21:24Speaker 2: me again. So in my mind, I'm looking at him.
- 21:27Speaker 2: He's in the shooting stand. She's getting ready to shoot me.
- 21:30Speaker 2: So he he kiels me from behind the shot finish,
- 21:33Speaker 2: geting ready to shoot me, and I had to shoot
- 21:35Speaker 2: him again. I wasn't taking I'm holding up on the
- 21:40Speaker 2: street San Antonio. There's no way that I'm gonna let
- 21:44Speaker 2: somebody get in a position to where they were gonna
- 21:46Speaker 2: kill me after they just threatened threaten to kill me.
- 21:49Speaker 2: So I had to. You know, of course, don't look
- 21:53Speaker 2: at it like that. Called him, you know it was
- 21:55Speaker 2: the closer. Tell him that whole thing was that it
- 21:58Speaker 2: was was up a part, wasn't it was faith?
- 22:04Speaker 3: Why would you call it a court Why why are
- 22:06Speaker 3: you calling the court system faith?
- 22:11Speaker 4: Why give me some.
- 22:15Speaker 6: Will so so so this is this is the point
- 22:20Speaker 6: of the case. He got a procedures that they're supposed
- 22:22Speaker 6: to be doing. I asked for an attorney, so they
- 22:24Speaker 6: take in the court women an attorney to get attorney.
- 22:28Speaker 2: Uh. One of the.
- 22:30Speaker 6: Lawyers that got a pointed to my case, jave, this
- 22:35Speaker 6: is okay. I got a party of the attorney. His
- 22:38Speaker 6: name was Albert Muierris Junior. I'll be Junion James to
- 22:43Speaker 6: busits me. He gave me a contract to sign with him.
- 22:45Speaker 6: In this contract, it's a stated for me. He said,
- 22:49Speaker 6: don't talk to anyone.
- 22:51Speaker 2: Don't don't talk about this case to anyone. So okay.
- 22:56Speaker 2: He told me that he can give me twenty five
- 22:58Speaker 2: years if I decided he walking out of it. So
- 23:00Speaker 2: he said, I'm also real to get you psychological evaluated
- 23:03Speaker 2: from stuff that I told you, the things that I
- 23:06Speaker 2: repeated to y'all. That's what I told him about what happened.
- 23:08Speaker 2: He told me he's gonna get me a psychologically evaluated. Okay.
- 23:12Speaker 2: After he came to see me talking about two three
- 23:14Speaker 2: weeks later and this other attorney came to see me.
- 23:17Speaker 2: His name was Charles J. Bump. Charles J. Bump told
- 23:20Speaker 2: me I told him I got a lawyer. He said,
- 23:23Speaker 2: that other lawyer. You're not gonna see him again. I'm
- 23:25Speaker 2: one hundred thousand dollar the lord you're getting tree that
- 23:28Speaker 2: the lawyer you can't do for you what I can
- 23:30Speaker 2: do for you. With two proxecutivesis prosecuting your case. I
- 23:33Speaker 2: talk to their job. It does this.
- 23:36Speaker 6: It's prosecuting you that you see. He says, she's a
- 23:40Speaker 6: personal friend, a personal friend of mine. Nobody can do
- 23:44Speaker 6: for you what I can do for you to that.
- 23:47Speaker 6: So I'm thinking that this is this is topical season.
- 23:51Speaker 4: It's not.
- 23:53Speaker 2: He violated. He bobated because the boys. So she's about
- 23:57Speaker 2: talking to another person's client, what their permission. He's not
- 24:01Speaker 2: supposed to do that, and started to call it. They
- 24:05Speaker 2: didn't take me before the court to tell me and
- 24:10Speaker 2: to follow motion. They' supposed to follow motions for withdrawal
- 24:13Speaker 2: and the emotional withdraw Then they.
- 24:16Speaker 6: Asked for emotional substitution, so touching a council. None of
- 24:21Speaker 6: these procedures were sold and none of these decsions were done.
- 24:25Speaker 2: They got to ask me do I consent or do
- 24:27Speaker 2: I check? They shouldn't do that at quote the criminal
- 24:34Speaker 2: precision twenty six point zer row four. That's the the
- 24:38Speaker 2: simon and and and and the simon and relations of
- 24:41Speaker 2: the lawyers.
- 24:42Speaker 6: It's also uh call the civil procedures rule ten. That's
- 24:48Speaker 6: a polination of the withdrawal.
- 24:49Speaker 2: That's another and that they didn't do. They didn't follow
- 24:52Speaker 2: their rules and procedures of the court. They swished. This
- 24:57Speaker 2: lawyer gave me this lawyer, this lawyers was set up.
- 25:01Speaker 2: I didn't know who he was until my sais in
- 25:04Speaker 2: here and he walked his blazer or the most to
- 25:09Speaker 2: go into the court to get of a public defense,
- 25:14Speaker 2: a paring from the public defense the program. And he
- 25:18Speaker 2: had gave the DA that was prosecuting my case. He
- 25:22Speaker 2: gave them the fighting on how to fight them fight
- 25:25Speaker 2: the case. And he could even invice on if they
- 25:27Speaker 2: should start my tenising with my pleap argument uh at
- 25:31Speaker 2: for a year. But this is the same man that
- 25:34Speaker 2: the court rooms represented me. He hired an investigator. The
- 25:37Speaker 2: investigator did not do investigations. I asked him questions, who
- 25:43Speaker 2: he talked to, who he address? He couldn't help me
- 25:46Speaker 2: looking for we hadn't had a following out m That's
- 25:49Speaker 2: one thing I asked him about. He comes and he
- 25:53Speaker 2: goes into the states fire to prosecute the start off.
- 25:57Speaker 2: They're evident their witnesses. He did not give me, not
- 26:01Speaker 2: one witness to.
- 26:01Speaker 6: Tell the power of my trial, and that a trial
- 26:04Speaker 6: that I had, He did not do none of those things.
- 26:06Speaker 2: Just couldn't show me nothing that he had had personally
- 26:09Speaker 2: done on his own. When it comes to talking about
- 26:12Speaker 2: the suicide backtop, yes it was the issue on my trial,
- 26:16Speaker 2: but this man never had me psychologically evaluated at a
- 26:20Speaker 2: one point of time during the during the time that
- 26:22Speaker 2: I want to court.
- 26:23Speaker 6: That's the issue is my mistake of time and my
- 26:27Speaker 6: middal state mind was the.
- 26:28Speaker 2: Issue in my trials. Sure doing the chiefs of the trial,
- 26:34Speaker 2: they wanted to look at information from the witness which
- 26:37Speaker 2: was one one of my steps on Trains who was shot.
- 26:43Speaker 2: He's been in trouble. He was no propation in that
- 26:46Speaker 2: courtroom for trying to take the gun from a police
- 26:49Speaker 2: officer doing a hospitation. He was fighting with police, so
- 26:52Speaker 2: he was already on propation at the same courtroom that
- 26:55Speaker 2: I'm in trial with. They had they used him as
- 26:58Speaker 2: a witness me, but I could not say nothing ever
- 27:03Speaker 2: being in trouble or him being in the game. But
- 27:05Speaker 2: they probably motion because literally need the motion. It prepicts me. Well,
- 27:13Speaker 2: I couldn't say nothing about that. They put a bag
- 27:17Speaker 2: in my trial so nobody from the public could be
- 27:19Speaker 2: in there, nobody from the news media, because I had
- 27:22Speaker 2: a high profile taste. They they they wouldn't let the
- 27:26Speaker 2: public be a part of my tribe. And that's another
- 27:29Speaker 2: thing that thing was doing. They was hiding things that
- 27:31Speaker 2: the public could not see. They enhanced me. They enhanced
- 27:35Speaker 2: me for as a probitual offenders. That means that I
- 27:38Speaker 2: had been in trouble two times prior when I was younger.
- 27:43Speaker 2: They used those trust they used those things I've been
- 27:45Speaker 2: in my prime is in order to enhance me to
- 27:47Speaker 2: be there until twenty five in life. However, one of
- 27:52Speaker 2: the truss that they used so they enhanced me in
- 27:54Speaker 2: allegations they couldn't use because I never I never went
- 27:57Speaker 2: I never got convicted on that trial. Just thing the
- 28:01Speaker 2: US was indicted or indicted on the issues made a thought.
- 28:07Speaker 2: So I got time for made up to.
- 28:13Speaker 3: For you know, you know, Casey, some of the things
- 28:19Speaker 3: that you I was just speaking on I heard that
- 28:24Speaker 3: from other men's you know them when they gone to
- 28:30Speaker 3: the courts they have charges that they're not able to
- 28:36Speaker 3: defend against or you know, the judge would say, well
- 28:40Speaker 3: they just.
- 28:42Speaker 4: Because it was mentioned that they let us stay. How
- 28:45Speaker 4: can you.
- 28:47Speaker 3: Convict somebody if you don't allow them the chance to defend,
- 28:54Speaker 3: defend against the the crime whatever you're accusing them of.
- 29:00Speaker 4: How can that? How can that be?
- 29:05Speaker 2: I'm a call I'm okay, okay for now, yes ma'am?
- 29:09Speaker 4: How can that be?
- 29:10Speaker 2: Okay? Okay? Now, I mean you have okay. They have
- 29:17Speaker 2: made a short cut away on how to get convictions
- 29:19Speaker 2: against individuous right, Okay, here's the study. In twenty twenty one,
- 29:23Speaker 2: the Duke Law General published a study Bob Starlars Needo
- 29:27Speaker 2: Al Japan and mister J. Jenum title pay the place
- 29:30Speaker 2: the specic from pound data from over two hundred and
- 29:33Speaker 2: sixty thousand sellermy cases from January two thousand and through
- 29:37Speaker 2: May of twenty eighteen in Hwherson County, Texas. Where As
- 29:41Speaker 2: this where asked Houston, okay, and that just get to
- 29:44Speaker 2: the assignment of council schemes as supposed to be a
- 29:48Speaker 2: wheel system This is where provert attorneys acting as independent
- 29:52Speaker 2: contractors and compensated with public times are individually appointed. It
- 29:57Speaker 2: using a system of rotation to privately of resentation to
- 30:01Speaker 2: an and an independent. However, whereas the initial location is
- 30:05Speaker 2: the loss, it surely wasn't written in stone because the
- 30:08Speaker 2: study found that the Harris County Judge who have to
- 30:11Speaker 2: be elected to the court turning auction block or wart
- 30:15Speaker 2: the lawyers independent contractors who contributed bonds to their campaign
- 30:20Speaker 2: more than twice the amount of cases they are assigned
- 30:24Speaker 2: to non donors doors, generating over twenty seven times the
- 30:28Speaker 2: amount they donate to the so called judge campaign. Hence,
- 30:32Speaker 2: the donors are overwhelmed with a large case loads and
- 30:36Speaker 2: can only underperformed since they're paying. Because of the day
- 30:42Speaker 2: case on the case, they are incouraged and how conny
- 30:47Speaker 2: units being recorded.
- 30:49Speaker 4: Any subject toger to accept this.
- 30:52Speaker 2: Lawyer to case this basic upon the campaign to lack
- 31:00Speaker 2: in cases case. It's beloying them did not have the
- 31:04Speaker 2: will it was not a science symestications case. According to
- 31:08Speaker 2: the wheel, the judge put them on the case in
- 31:10Speaker 2: order to pay the attorney. There would the amount of
- 31:13Speaker 2: money to help them get his convictions, not to help
- 31:16Speaker 2: them defend his convictions. So this is why our system
- 31:20Speaker 2: is so broken, because they have found a shortcut of
- 31:24Speaker 2: how to get convictions. African Americans are being claimed between
- 31:29Speaker 2: all white jury behind this type of a system where
- 31:32Speaker 2: churches are allowing the district attorney and the attorney to
- 31:36Speaker 2: exclude all African Americans from the jury cattle, how to
- 31:39Speaker 2: allow any digital African Americans to be placed between all
- 31:43Speaker 2: white jury tribes to get a conviction with falsified evidence
- 31:46Speaker 2: or perject testimony and all of this. So with a
- 31:49Speaker 2: system like this, ain't nobody paying attention to how they're
- 31:52Speaker 2: getting the convictions. All they care about is we the
- 31:56Speaker 2: jury find that decline to give this charge and indagment.
- 31:59Speaker 2: Once that happen from now now have to burn the
- 32:01Speaker 2: ship to the defense to have to pull an and
- 32:05Speaker 2: what a book system like would have today now almost
- 32:09Speaker 2: nearly impossible to pull that. You are to a wok
- 32:13Speaker 2: cooking justice.
- 32:15Speaker 4: Well, you know, Cortnell, I'm sorry to interrupt you. I
- 32:20Speaker 4: just wanted to.
- 32:24Speaker 2: To know.
- 32:26Speaker 3: If they say that you have the your the jury's
- 32:31Speaker 3: is a jury of your peers, because you said that
- 32:34Speaker 3: the courts that that the the jury was an all
- 32:38Speaker 3: white jury, and statistics shows once again it's just not
- 32:45Speaker 3: what we're saying. Statistics shows that African American men's do
- 32:54Speaker 3: not have a jury of their pills of their peers, Okay,
- 33:00Speaker 3: don't as in, you know, in one's case, he had
- 33:09Speaker 3: six white whites, five Hispanics, and one one mix, one
- 33:19Speaker 3: person that had black and the shoes. That's what he
- 33:23Speaker 3: told me, and that's what I you know, this system
- 33:30Speaker 3: was not designed for us. It's not designed for the
- 33:34Speaker 3: people of color. It's not designed for the our brown
- 33:39Speaker 3: brothers and sisters is it's just designed for one person.
- 33:44Speaker 3: Because what I'm hearing with Casey and what I hear
- 33:48Speaker 3: from the other man's you know, is basically the same thing.
- 33:52Speaker 4: Everybody is.
- 33:55Speaker 3: Is in the same thing in the you know, they
- 33:59Speaker 3: say the same thing. Casey, I believe this question is
- 34:04Speaker 3: for you.
- 34:06Speaker 4: What evidence was used against.
- 34:08Speaker 3: You in your trial and why do you believe it
- 34:12Speaker 3: was miss missing, misinterpreted, or incorrect?
- 34:23Speaker 4: Casey?
- 34:24Speaker 2: Uh. First, one of the main issues that was used
- 34:29Speaker 2: against me was my pa. It was like I was
- 34:35Speaker 2: going to trial for something I did for the stage. Yeah,
- 34:41Speaker 2: it was that I've done something in my stage. It
- 34:44Speaker 2: wasn't it wasn't something dead the trial that I was
- 34:47Speaker 2: a right now, they told me this is this is
- 34:52Speaker 2: told me they was acting freely. But they acted freely
- 34:57Speaker 2: because of my attorney, my treat out in their talk
- 35:01Speaker 2: from what they what when when I was getting from them,
- 35:04Speaker 2: they said had if I hadn't never been convicted of
- 35:08Speaker 2: anything in my prime. So during the time that I
- 35:17Speaker 2: was fenicized, when I was trying for attorney, the das
- 35:22Speaker 2: that was in there telling the two prosecutes to move
- 35:26Speaker 2: to females. That couldn't you I'm listening.
- 35:31Speaker 7: To everything going on, they pumped me into that clip.
- 35:34Speaker 2: Room after hours when the cupbom is supposed to be closed.
- 35:39Speaker 2: I went there about thirty in the evening, got into
- 35:42Speaker 2: the courtroom at six, didn't leave to eight person. I'm
- 35:45Speaker 2: the only person in there with all these.
- 35:49Speaker 6: White DA's and the white kids, and so.
- 35:57Speaker 2: They up their attorney pull Later it was a time
- 36:07Speaker 2: to me everything that they against me. Actually it was
- 36:15Speaker 2: imputated from my parents. My parents got me that time.
- 36:20Speaker 2: So you would even to talk what I what I'm done?
- 36:22Speaker 3: So you saying that they use your past to convict
- 36:26Speaker 3: you on in this case, they didn't have no evidence
- 36:31Speaker 3: to gives you because I heard that you said that.
- 36:35Speaker 2: You was a self defense.
- 36:38Speaker 4: It was self defense.
- 36:41Speaker 2: It was self defense started off or not what I'm
- 36:45Speaker 2: self responsibility trump and I'm atomical for that. And then
- 36:54Speaker 2: stay right up. I didn't want to know what get hurt,
- 37:00Speaker 2: you know, and you know and and and it's really
- 37:04Speaker 2: it gets people. My son, I'm I'm gonna be honest
- 37:08Speaker 2: with that. Be at my house. You ask the gang
- 37:13Speaker 2: member and if anyone else is gonna come to gun
- 37:16Speaker 2: on me in my house, I'm gonna shoo killed him.
- 37:21Speaker 2: Terms of his mama in dispartment. They're a friend of
- 37:23Speaker 2: mine at the college. His mother was believe take on
- 37:33Speaker 2: to college and and told me a black college, you know.
- 37:37Speaker 2: And because I'm partitioned with this and and I'm going
- 37:41Speaker 2: to start talking to him on occasions and we talk
- 37:44Speaker 2: to him. I'm to tuital. That's the only reason I
- 37:47Speaker 2: didn't because he wanted to a future. I didn't want
- 37:49Speaker 2: to kill this he you know, Tace, what I had
- 37:54Speaker 2: to hear myself and.
- 37:57Speaker 3: My house and you know, anyone in your position would
- 38:01Speaker 3: have defended their self and they would have seen it
- 38:04Speaker 3: as it was either my my life were there life
- 38:09Speaker 3: self defense, you know, and so you know, I understand
- 38:13Speaker 3: what you're saying with that that you did you taking responsibility?
- 38:17Speaker 3: What happened to your action towards the officer?
- 38:22Speaker 2: Uh think about this to the child said that he
- 38:35Speaker 2: didn't cast witness traum my behalf. He didn't expert witness
- 38:40Speaker 2: to call my behave about mid state. The family just
- 38:46Speaker 2: fot off the whole shot. I mean the expert witness
- 38:50Speaker 2: own politics. I need. I want to tell about the
- 38:54Speaker 2: NY shot the fire, how troub was it because they
- 38:58Speaker 2: could do a shot at on the shotgun and tell
- 39:00Speaker 2: I would the d days my step son and his
- 39:05Speaker 2: friend to lie. They said that they was a street
- 39:09Speaker 2: feet away. They three features for me out of shot.
- 39:13Speaker 2: They were entire party because you know, the tenant of
- 39:18Speaker 2: the gun would have bull fight within the case. It
- 39:22Speaker 2: was a nice sparrel and shot his hands, both of
- 39:27Speaker 2: any hands. Because I know what I was a before.
- 39:29Speaker 2: I was just wanted to make sure that that gun
- 39:31Speaker 2: looking be shot or they were friends to shoot me
- 39:36Speaker 2: through it that way. And I've been practicing shooting guns
- 39:39Speaker 2: for looks up as I was a kid. My neighbors
- 39:41Speaker 2: taught me how to shoot because he's brought the governing.
- 39:44Speaker 2: So it's not something that I haven't been doing. I hunt,
- 39:48Speaker 2: I pinched, I threw all these things, you know. But
- 39:51Speaker 2: it's the same time and that the seed to take
- 39:55Speaker 2: in that child and it all the constitutional rights and
- 40:04Speaker 2: my right to that crystal what to do what they
- 40:06Speaker 2: did because time lady, she had appearance on the back
- 40:14Speaker 2: time and of the jury toward the deliberation. He gives
- 40:17Speaker 2: sentimental choice to discribe them too, that they want to
- 40:21Speaker 2: look at trump my step. They wanted to see this again.
- 40:26Speaker 2: She was the thing to play the back kind everything
- 40:32Speaker 2: trying to un they need to look for. They never
- 40:42Speaker 2: looked the final I wanted to try.
- 40:46Speaker 5: The negotiator, h Cornell, have a question for you? Go
- 40:53Speaker 5: ahead for them, go ahead because.
- 41:00Speaker 2: People okay, And outside of that, little did you know
- 41:03Speaker 2: after the shoot you were domed? Why because you were
- 41:08Speaker 2: forced to go to a rigid criminal justice system, you know.
- 41:13Speaker 2: So with that being said, you doing what you had
- 41:16Speaker 2: to do to defend yourself from now. Outside of that,
- 41:19Speaker 2: the little did you know when you got to the
- 41:22Speaker 2: criminal justice system, you didn't know that your lawyer was
- 41:25Speaker 2: going to be a former assistant district attorney and that
- 41:29Speaker 2: the geners who are signing him to represent you were
- 41:32Speaker 2: paying him the amount of the money to offit your conviction.
- 41:35Speaker 4: Now watch this.
- 41:37Speaker 2: The same individuals who he relied on became the Santonio
- 41:41Speaker 2: City's attorney, the d Day, the Justice of the Court
- 41:44Speaker 2: of Appeals, the tenails, and the district attorney again, so
- 41:48Speaker 2: the d re became another district attorney after being an
- 41:51Speaker 2: assistant district attorney. This individual she consulted from the Bay
- 41:55Speaker 2: County Courthouse where he was convicted at. So they did
- 41:58Speaker 2: not want after became America un sery pounder. And it
- 42:02Speaker 2: was already stated it that African Americans were not allowed
- 42:04Speaker 2: on the jity pounds. My name is Cornell Jackie Throwing,
- 42:08Speaker 2: and you can google an under name. I had two
- 42:10Speaker 2: all white Jerry trials in San Antonio there County court House.
- 42:14Speaker 2: I too would reredented by a court the court an
- 42:17Speaker 2: attorney did reach or the one day junior he was
- 42:20Speaker 2: an assistant DA in the same court front. The little
- 42:23Speaker 2: that I know, so you was good after the shots
- 42:27Speaker 2: for five and now here is trying to challenge your
- 42:30Speaker 2: conviction to try to help that would turn your condition
- 42:33Speaker 2: is going to be appeal Bible battle. Wow, because the
- 42:36Speaker 2: traditional system that is killed the help you fail. That's
- 42:40Speaker 2: the system right now we're dealing with. So you know,
- 42:43Speaker 2: like I said, but what ain't it you know?
- 42:47Speaker 3: Can you use because I know me and Casey was
- 42:51Speaker 3: talking earlier and he was telling me about a case
- 42:56Speaker 3: that's similar to his case. Can he go into port
- 43:00Speaker 3: and present that case? Dissimilarities of that case.
- 43:07Speaker 2: He find for many but my sty in the met
- 43:15Speaker 2: forty time in the tank that I just did. The
- 43:19Speaker 2: white guy, Uh he shot a police officers in the
- 43:25Speaker 2: chest the look and he shot his best friend behind
- 43:28Speaker 2: his girlfriend and uh tack guy Carol lot in his
- 43:33Speaker 2: in his in his talk. But allowed this guy to
- 43:37Speaker 2: keep offos nineteen years. He don't have to do nine
- 43:42Speaker 2: So more than like he is, he's a small you
- 43:45Speaker 2: know because me you about for forty years for people.
- 43:53Speaker 2: So why not just talk to go to job and
- 43:57Speaker 2: take my head and while I'm in taking my tanks
- 44:02Speaker 2: after say, the device of individuals in football. You don't
- 44:10Speaker 2: know the rules, regulations and policies and commines and look,
- 44:14Speaker 2: you don't know that they can't do. We don't know
- 44:17Speaker 2: these things. You know. We started in the law in
- 44:22Speaker 2: the CP like from d All that Cippo satact like
- 44:26Speaker 2: that career they keep, they will keep. There's no ethics
- 44:32Speaker 2: in in particular Tom. You know, so I look at
- 44:35Speaker 2: this even with the appeal lawyer, I have one lawyers
- 44:39Speaker 2: quite sea being, so they give me another lawyer. They
- 44:43Speaker 2: made want of look aleven days appeal to sight my
- 44:47Speaker 2: case while almost start forty five in the case is
- 44:51Speaker 2: that she's working on she got to look for days.
- 44:54Speaker 2: She ain't look at my pace and.
- 44:58Speaker 3: Me so basically that you saying your public offender was
- 45:06Speaker 3: over work, that she had twenty five more cases than
- 45:09Speaker 3: they gavery eleven days to look overlook over overlook your case.
- 45:15Speaker 2: Tell she told me after she knew to break my case,
- 45:20Speaker 2: she said, in my opinion, they have a confission. Anything
- 45:26Speaker 2: that you put up this is the purpose I just
- 45:28Speaker 2: basically just need. I'm gonna put up on this because
- 45:31Speaker 2: this is what what I got out of that I
- 45:33Speaker 2: just need to keep up to just through the time
- 45:37Speaker 2: you take my case put it on my level seven
- 45:42Speaker 2: trying to this and to the council. Want them to
- 45:49Speaker 2: answer that by up staying upstated it's true upstanding this
- 45:58Speaker 2: one of them because by not having cycle not have
- 46:02Speaker 2: me psychological you waited They told him they to lead
- 46:07Speaker 2: you to explain it. They just to us and he
- 46:09Speaker 2: brought to his playing Why you can have me psychological evaluate?
- 46:14Speaker 2: He said, in my opinion, I didn't seem needed to
- 46:19Speaker 2: be psychological anyway. You're not. You're not You're not a psychiatrist.
- 46:24Speaker 6: You're not a.
- 46:25Speaker 2: Qualified psychiatrists to be able to entire you hit me
- 46:30Speaker 2: until you feel the thing. Stop your expertise. You exploited.
- 46:34Speaker 2: You're ashamed to be a really bigger your agent and
- 46:38Speaker 2: to ask any kind of patient about my metal.
- 46:46Speaker 6: You can't play with my mental health is because you're
- 46:48Speaker 6: not a psychiatrist.
- 46:51Speaker 2: Let me.
- 46:54Speaker 3: Let me, let me, let me jump in right quick.
- 46:57Speaker 3: So are you telling us that you went through a
- 47:02Speaker 3: whole trial with out being evaluated, having your mental evaluated.
- 47:10Speaker 3: They did not evaluate you.
- 47:12Speaker 2: Yeah, they didn't evaluate me. And then when I come
- 47:16Speaker 2: to prison, I'm still dealing with the residuals of that incident.
- 47:20Speaker 2: I was still having real purring, not using the dreams.
- 47:22Speaker 2: I was still I wasn't really right. I didn't get
- 47:25Speaker 2: my mental state capability at least normal until about that
- 47:30Speaker 2: was I went to prison and December twenty ten, when
- 47:36Speaker 2: I got that they're evaluated it.
- 47:38Speaker 6: We did the problem.
- 47:39Speaker 2: Because I have a crime picture. I was still to
- 47:42Speaker 2: have emotional breakdown. And then round January, not between January
- 47:54Speaker 2: and June or twenty fifteen, I was able to stop
- 47:58Speaker 2: back through mental health treatment and assistance uh by a
- 48:03Speaker 2: woman that was on the mark up beside me Jesus
- 48:07Speaker 2: and my mental health UH counselor and my and ands
- 48:12Speaker 2: with April more and and I give everything to her
- 48:15Speaker 2: because she helped me. She became my palp for mental
- 48:18Speaker 2: state and helped me shoot back from that head because
- 48:21Speaker 2: I was messed up for a while. I was really
- 48:23Speaker 2: you know, I was really out of there, you know, phychologically,
- 48:27Speaker 2: I wasn't there my mind, I was, I stopped waking
- 48:34Speaker 2: up and sweat and and and and fear, and somebody
- 48:38Speaker 2: was standing over measide had all different kinds of versions
- 48:41Speaker 2: of the event in my head. In my mind it
- 48:43Speaker 2: was it was really hard for me to get over
- 48:45Speaker 2: there issue for a minute. But through her uh cool teen,
- 48:50Speaker 2: through her her care and she was giving me and
- 48:53Speaker 2: she was she was a black woman, And I haven't
- 48:56Speaker 2: had anyone to kill. Go through the help to talk
- 49:01Speaker 2: things out, to see to keep my keep my keep
- 49:05Speaker 2: my keep my middle capability at the edge where I
- 49:09Speaker 2: feel like that I'm saving you know, because if now
- 49:14Speaker 2: and then you need to talk to somebody about it.
- 49:17Speaker 2: It's too many deaths going on around me and just well,
- 49:20Speaker 2: too much stuff happening in life, and anything could be
- 49:22Speaker 2: a trick. You gotta know your treatments in order to
- 49:25Speaker 2: be able to know where you need to focus help.
- 49:28Speaker 2: And I know what I need when I'm having your question.
- 49:35Speaker 2: But if you brother us listening to this podcast tonight,
- 49:39Speaker 2: what would you want from them to take from your story?
- 49:42Speaker 2: And impossible? How would they be able to help you
- 49:45Speaker 2: in this situation to get some type of help that
- 49:48Speaker 2: you need in order to get your case reviews back
- 49:51Speaker 2: into the court system. If I was gonna contact and
- 49:58Speaker 2: attorney that that my case and disappeared on me, I
- 50:01Speaker 2: want to help you because what happened? How how did
- 50:05Speaker 2: you disappear for me? His nighme is Albert M. Cotierrus Junior.
- 50:09Speaker 2: What happened? How did you leave my case? You told
- 50:13Speaker 2: me just to get me twenty five years You told
- 50:16Speaker 2: me not to talk anyone. How did you need my case?
- 50:18Speaker 2: And how did this on become my lawyer? You know,
- 50:23Speaker 2: I know them the answers that I need fulfilled. Because
- 50:27Speaker 2: if you tell me that he can get me a
- 50:29Speaker 2: twenty five years and you should write a statement that
- 50:32Speaker 2: he told me that I can give my case back
- 50:34Speaker 2: in the court room, and that's one of the moss
- 50:37Speaker 2: that it is that still play. He's still showing it
- 50:40Speaker 2: my attorney because he never bothered with you want to
- 50:43Speaker 2: get off my cape. Okay. So with that being paigntic cases,
- 50:48Speaker 2: you know they are proceedures for which they have to
- 50:50Speaker 2: go through with situations like that under the empty the
- 50:53Speaker 2: defense fun they have a place called the Endergant Defense
- 50:56Speaker 2: fun And if an attorney is a sign in your
- 50:58Speaker 2: place was not supposed to your attorney, they're supposed to
- 51:01Speaker 2: conduct an investigation into that. Why because you have state
- 51:05Speaker 2: agencies who are paying out money with the taxpayers money
- 51:09Speaker 2: to attorneys to help the attorneys to represent people. So
- 51:12Speaker 2: if you're saying that your attorney was not assigned to
- 51:15Speaker 2: you with a client without being a part of the
- 51:18Speaker 2: wheel of the five attorneys on your case, and that
- 51:21Speaker 2: the judge who assigned him to be representing you was
- 51:24Speaker 2: not actually followed on the protocols, don't you think that
- 51:28Speaker 2: it would be necessary to see some type of coming
- 51:30Speaker 2: on investigation and took that process. Well, the kill a
- 51:44Speaker 2: box light association. And what they tell me your law
- 51:51Speaker 2: this issue is they can't do nothing about it because
- 51:55Speaker 2: they have an exploration and time on it and uh
- 51:59Speaker 2: depreciates they can do on any matter. So yeah, they're
- 52:09Speaker 2: not trying to help nobody.
- 52:14Speaker 3: You know, I hear a lot of that that A
- 52:17Speaker 3: lot of a lot of men get time board that
- 52:22Speaker 3: you know, they say once they go through the appeals,
- 52:26Speaker 3: they keep giving the states back the law. They're giving
- 52:29Speaker 3: them back their own law, and they keep getting denied.
- 52:33Speaker 3: And then by time they keep founding all these appeals
- 52:37Speaker 3: trying to get back in court, trying to trying to
- 52:40Speaker 3: prove their innocence. Now they time board, time done ran out.
- 52:46Speaker 3: Now they just now that's it. So I mean when
- 52:50Speaker 3: time when they get time board, what I mean, cortnel
- 52:53Speaker 3: what what what?
- 52:54Speaker 4: Then?
- 52:56Speaker 2: Okay, man, you know that's a good question to be raising. Oh,
- 53:00Speaker 2: now here it is, ma'am. Here is where it started
- 53:03Speaker 2: at appointed executive branch of government. The lists of repleat
- 53:07Speaker 2: with the lawyers Joe Biden, just Da and the attorneys
- 53:10Speaker 2: domer come Oud of Harris, but Rocking Michelle Obama, George Bush,
- 53:13Speaker 2: Bill Henry Clinton, and the Kennedy These individuals were attorneys
- 53:17Speaker 2: from the beginning. Then on the law scale, you've got
- 53:20Speaker 2: Texas Governor Greg Avitt. Then you got the previous attorney,
- 53:23Speaker 2: which is with Parry. Now if you've got these attorney
- 53:27Speaker 2: generals now running for lawyers and coming from the attorneys
- 53:31Speaker 2: and stuff like that. So now our system has came
- 53:34Speaker 2: up with a process on how to limit you from
- 53:37Speaker 2: being able to challenge your commitions. We have not what
- 53:40Speaker 2: we call anti terror was a last if you don't
- 53:43Speaker 2: find something within one year after discovering this information, the
- 53:46Speaker 2: new time las. We have something called the subsequent weird
- 53:49Speaker 2: application laws. If you find one application, you have to
- 53:53Speaker 2: find everything that you can locate in that case to
- 53:56Speaker 2: say that it was a violation of your constitutional life.
- 54:00Speaker 2: So now just mind yourself. It'll take you mainly two
- 54:03Speaker 2: three years just to even get your records. Sometime it
- 54:06Speaker 2: takes you ten years just to get your records. So
- 54:08Speaker 2: by the time you get your records, man, you have
- 54:11Speaker 2: already been time board. So now when you challenge your conviction,
- 54:15Speaker 2: if you discover something after you challenge your conviction, man,
- 54:19Speaker 2: the court say that they do not have jurisdiction to
- 54:21Speaker 2: consider that. Why because you could have brought yourself on
- 54:24Speaker 2: your first issue. So now as of you know what
- 54:28Speaker 2: you just ask, ma'am, they saying that we're a time
- 54:30Speaker 2: board from being able to raise anything else within our
- 54:33Speaker 2: conviction because we should have raised it first time. So
- 54:37Speaker 2: that's a way if they.
- 54:40Speaker 3: Give if they not giving you the proper representation, if
- 54:46Speaker 3: these people are not working for you, they're over work
- 54:50Speaker 3: and they only got giving them ten or eleven days
- 54:53Speaker 3: to look at a case. You know, I mean, make
- 54:57Speaker 3: it make sense. You know, I just seen on the
- 55:01Speaker 3: the the Missouri governor just Asnerate just released the first
- 55:11Speaker 3: white cop that hung a black black man.
- 55:15Speaker 4: He's out.
- 55:16Speaker 2: And this is the same.
- 55:18Speaker 3: Governor, the same governor in August that wouldn't stop the
- 55:24Speaker 3: execution of Marcellus Williams, the black man that was wrongfully conviction.
- 55:32Speaker 3: But you're gonna put an innocent man to death, but
- 55:36Speaker 3: you're gonna let this person out that hung a black man.
- 55:39Speaker 3: Make you know what, I'm gonna let you guys finish
- 55:43Speaker 3: because you know my blood pressure is raising. Go ahead, casey.
- 55:58Speaker 2: This issue here. It's the same as Lady of Charney home,
- 56:03Speaker 2: they'll signed to me the vistorio so you can remember
- 56:07Speaker 2: she's represented me. So she called this wrist what I
- 56:12Speaker 2: called affect the council for her, and she said she
- 56:17Speaker 2: has to answer why that she try to infect the council.
- 56:21Speaker 2: She wants to go find this lady. She will not answer,
- 56:24Speaker 2: and they took six months to find her to bring
- 56:27Speaker 2: into the court. They finally brought the question her if
- 56:33Speaker 2: for good, I want to pay to commit my records.
- 56:35Speaker 2: I want to be able to question her. Understand, if
- 56:39Speaker 2: you want to sign me on to me, I have
- 56:41Speaker 2: to fight to question her if you have to hear it.
- 56:44Speaker 2: So I fought the necessarily text work and be able
- 56:47Speaker 2: to do it. He denied me without the den be
- 56:50Speaker 2: from being able to do it. But they didn't tell
- 56:53Speaker 2: me they had this hearing. After answer to my rid
- 56:57Speaker 2: he denied. But this lady said, when I was reading
- 57:02Speaker 2: her answers, why they question her? They asked her, why
- 57:05Speaker 2: did you file in effected system council or his attorney?
- 57:10Speaker 2: She said the reason why she had pome affected system
- 57:15Speaker 2: counsels because in her experience that justice is down on
- 57:20Speaker 2: other attorneys who filing effected sistant counsels are the lawyers.
- 57:25Speaker 2: She did not do it, just didn't do the job,
- 57:29Speaker 2: did you? You you say about this defense to represent me?
- 57:36Speaker 2: So you didn't do your job because you had fear
- 57:39Speaker 2: of what the childes and other than your parents to
- 57:42Speaker 2: think about you because you follow us against another lorgon
- 57:46Speaker 2: if you'll do your job to represent me and the
- 57:49Speaker 2: questions of the laws. Did I'm supposed to have an
- 57:52Speaker 2: effected system the council?
- 57:53Speaker 4: Did you?
- 57:54Speaker 2: You got on me. Didn't do your job because you
- 57:58Speaker 2: had fear over the states going ink about you because
- 58:02Speaker 2: I didn't have I didn't have a proper appeal process.
- 58:08Speaker 2: I didn't have none of that. And then when I'm
- 58:10Speaker 2: wagging to come out that they have a witness and
- 58:13Speaker 2: which one to negotiate their name and stuff? After I
- 58:15Speaker 2: found out that he had, Yeah, what's a statement. I'm
- 58:20Speaker 2: trying to get the statement from he's right here. Let
- 58:23Speaker 2: him telling me that he signed an agreement with the
- 58:27Speaker 2: prosecutors not to share any information if their positive any
- 58:32Speaker 2: client appreciated my understanding of the letter.
- 58:35Speaker 7: How am I gonna.
- 58:36Speaker 2: Understand when you're hiding information from me? That's some breaking
- 58:39Speaker 2: violations you have through the school.
- 58:42Speaker 7: All evidence you have that bothers me to be able
- 58:48Speaker 7: to uh be able it on the chances, and I was,
- 58:53Speaker 7: I was.
- 58:53Speaker 2: I had do against me.
- 58:54Speaker 6: I could have been put it on that issue because
- 58:58Speaker 6: from my mental state, because.
- 59:00Speaker 2: Because you can do your job.
- 59:02Speaker 4: Well, let me.
- 59:08Speaker 3: Right, let me jump in right quickly because we only
- 59:11Speaker 3: got five minutes left. You know, we're always running out
- 59:16Speaker 3: of time when it's getting good. So you know, O Casey,
- 59:22Speaker 3: we gotta bring you back. But we're gonna be on
- 59:25Speaker 3: break into February, so you know you're coming back in February.

- 1:00:19Speaker 2: y'all if if you got brother against your family members,

- 1:00:35Speaker 2: So y'all all that your family, kids and hustle and

- 1:00:56Speaker 2: We're really talking about the United States, and I messed
- 1:00:59Speaker 2: up our system really is so really, what we should
- 1:01:02Speaker 2: be trying to do is to go to the polls,
- 1:01:06Speaker 2: to push laws, to try to have these people come back,
- 1:01:09Speaker 2: and to revisit our colinal justice system. We have a
- 1:01:13Speaker 2: president who passed our first step First Step Act, and
- 1:01:17Speaker 2: then the first step back. It does nothing to try
- 1:01:19Speaker 2: to curb the problems on our criminal justice system. It
- 1:01:22Speaker 2: only taps into the ice the top of the icebergs
- 1:01:25Speaker 2: the colinal justice system. It does nothing to addresscue judges,
- 1:01:28Speaker 2: these loyant prosecuted, the crime labs, you know what I'm saying,
- 1:01:32Speaker 2: these noble health evaluators. Okay, it does nothing. So if
- 1:01:36Speaker 2: you aren't av to get the criminal justice reform, come out.
- 1:01:39Speaker 2: Let's talk about the real issues that matters. Issues Well,
- 1:01:43Speaker 2: blacks are being convicted about all white cheers Jenners is
- 1:01:46Speaker 2: being paid paying or seventy amount of money to help
- 1:01:49Speaker 2: get convictions. They've come out and talked about these issues
- 1:01:53Speaker 2: and raised the concerns about how African Americans are not
- 1:01:56Speaker 2: just African Americans, but anybody because this deals with everybody,
- 1:02:01Speaker 2: not just the African American. But the statistics are real,
- 1:02:04Speaker 2: so let's believe in the statistics. So this is for everybody.
- 1:02:08Speaker 2: Let's talk about it for everybody. So come on out,
- 1:02:10Speaker 2: join the show and guess what have no boys heard?
- 1:02:14Speaker 2: Go to the police if they're not doing right, go
- 1:02:16Speaker 2: to out the office. But let's address our Cohona's justice
- 1:02:19Speaker 2: system and the right way and start from the top
- 1:02:22Speaker 2: and bring it to the bottom and let's get our
- 1:02:24Speaker 2: kids home because that's what we have. So thank y'all
- 1:02:27Speaker 2: very much for having me on this show. And I
