- 4:52Speaker 2: in what bumper music you want? Producer Carl might play.
- 4:56Speaker 2: That can happen as well. I have a lot of audio.
- 5:01Speaker 2: But this Comy indictment, James Comy indicted lying to Congress.
- 5:09Speaker 4: That's the.
- 5:11Speaker 2: Statement though, that's the indictment, lying to Congress and obstruction.
- 5:17Speaker 4: Well, I would argue he did lie.
- 5:20Speaker 2: I think that's pretty easy to see, pretty easy to understand.
- 5:28Speaker 2: Jonathan Turley, George Washington University Law was there on Fox
- 5:34Speaker 2: News as this happened.
- 5:36Speaker 4: His take, thank.
- 5:37Speaker 6: You all right, let's go ahead down bring in. Jonathan Turley,
- 5:39Speaker 6: professor at George Washington University Law School. A lot of
- 5:44Speaker 6: people anticipated this coming in light of everything that the
- 5:48Speaker 6: President has said and indicated lately, as well as the
- 5:50Speaker 6: doj I mean, we don't know the chargers yet, but
- 5:53Speaker 6: we know that there is an indictment.
- 5:54Speaker 4: What do you make of it?
- 5:57Speaker 5: Well, this has been an extraordinary A few days the
- 6:00Speaker 5: President issued a social media posting in which he seemed
- 6:04Speaker 5: to pressure indictments against individuals, including Comy, that was then withdrawn.
- 6:09Speaker 5: We also heard reports that prosecutors opposed going to the
- 6:14Speaker 5: grand jury, that they didn't feel that there was a
- 6:16Speaker 5: case to be made here. And now, of course we
- 6:20Speaker 5: have what appears to be an indictment. It is a
- 6:23Speaker 5: seismic event. I mean, you're talking about a former director
- 6:27Speaker 5: of the FBI, and there have been long allegations that
- 6:34Speaker 5: call me was a leaker. If you recall, the Inspector
- 6:37Speaker 5: General report was scathing with regard to Comy's conduct. Call
- 6:43Speaker 5: Mey removed FBI documents, including classified information when he was fired,
- 6:50Speaker 5: and the Inspector General went after but it did not
- 6:52Speaker 5: find that he specifically leaked that to the New York Times.
- 6:57Speaker 5: But this could be a perjury case as opposed to
- 6:59Speaker 5: a case.
- 7:01Speaker 2: Now, he said this before he knew what the indictment
- 7:05Speaker 2: was for obstruction and of line, so one could argue
- 7:09Speaker 2: that when he discusses perjury.
- 7:10Speaker 4: That's where he's at.
- 7:12Speaker 2: When we see that there are people within these institutions, well,
- 7:17Speaker 2: we don't think this is going to work, so we're
- 7:18Speaker 2: not going to bring the charges.
- 7:20Speaker 4: We've seen this every which way.
- 7:22Speaker 2: We saw this from the Special Council Robert her last
- 7:26Speaker 2: name h u R. Regarding Joe Biden, well, we would
- 7:31Speaker 2: bring charges regarding the classified documents.
- 7:34Speaker 4: But a jury would see him as an elderly man
- 7:37Speaker 4: with a poor memory. Wait, did he did he do
- 7:43Speaker 4: it or not? Did he have the documents or not?
- 7:47Speaker 4: Did he commit a crime or not?
- 7:50Speaker 2: So I would even say to Jonathan Turley there I'm
- 7:52Speaker 2: not discounting in that point that they would look at
- 7:56Speaker 2: and say, we don't think there's enough here.
- 7:58Speaker 4: We're not sure we can make this stick.
- 7:59Speaker 2: That's about whether or not they are going to be
- 8:01Speaker 2: able to get the conviction, as opposed to whether or
- 8:04Speaker 2: not we should be looking at the crime committed. And
- 8:08Speaker 2: this is where Americans say, how is this possible?
- 8:13Speaker 4: That for these people over here, it's always it's not
- 8:15Speaker 4: worth the time.
- 8:16Speaker 2: But for these people over here, there's no amount of
- 8:19Speaker 2: money you can't spend to try and destroy them. This
- 8:23Speaker 2: is where people lose faith. Is the prosecutor's job to say, well,
- 8:30Speaker 2: I only prosecute people who I can find guilty, Because
- 8:35Speaker 2: if that's the case, it's not actually prosecution. Isn't that
- 8:38Speaker 2: in and of itself selective. There is a crime that
- 8:41Speaker 2: is committed, we have this evidence. Our job is to
- 8:44Speaker 2: prosecute the crime. Because if we're going to say I
- 8:49Speaker 2: have this evidence but it's not worth it to me,
- 8:51Speaker 2: then every prosecutor in the DOJ is nothing more than
- 8:54Speaker 2: Ryan Meers.
- 8:58Speaker 4: So Joon Turn's reaction here, I think, really is his
- 9:05Speaker 4: point is valid.
- 9:06Speaker 2: I'm not actually upset with mister Turley, but rather I
- 9:10Speaker 2: think it is the thing that most upsets Americans, where
- 9:13Speaker 2: you get into my gosh, there really are two Americas.
- 9:15Speaker 4: These people get charged, these people don't. These people can
- 9:18Speaker 4: get away with anything.
- 9:19Speaker 2: You can't jaywalk without spending time in jail. It is frustrating,
- 9:27Speaker 2: it's frustrating, and it's upsetting. I think that the Catherine
- 9:32Speaker 2: Herridge reporting discusses how Comy lied and did actually speak with.
- 9:37Speaker 4: Reporters and lead things to reporters.
- 9:40Speaker 2: But here it is I can't start an investigation, I
- 9:43Speaker 2: can't stop an investigation. I won't get worked up about
- 9:45Speaker 2: an investigation. James Komy will surrender himself today and then
- 9:51Speaker 2: we see what happens next.
